		<legis-type>A BILL</legis-type>
		<official-title>To require immediate payment by BP p.l.c to the United
		  States of an amount for use to compensate all affected persons for removal
		  costs and damages arising from the explosion and sinking of the mobile offshore
		  drilling unit Deepwater Horizon, to make that amount available to the Secretary
		  of the Interior to pay such compensation, and for other
		  purposes.</official-title>

		<section id="H3CD3FA40721E4AB9AB63DBF4872BC93E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Oil Spill Responsibility Act of
			 2010</short-title></quote>.</text>
		</section><section id="H48B7C59AFD4F4D1988881A71E72FCE4B"><enum>2.</enum><header>Payment of
			 compensation for removal costs and damages arising from the <quote>Deepwater
			 Horizon</quote> incident</header>
			<subsection id="HBFA00F43138541CFB30312B1905B745B"><enum>(a)</enum><header>Finding</header><text display-inline="yes-display-inline">Congress finds that BP p.l.c confessed
			 under oath before Congress to being the responsible party for the discharge of
			 oil in the Gulf of Mexico resulting from the explosion on and sinking of the
			 mobile offshore drilling unit Deepwater Horizon.</text>
			</subsection><subsection id="H80A8A13EB4E7489295115C75903D9D75"><enum>(b)</enum><header>Payment by
			 BP</header>
				<paragraph id="H2BFB9005F696416CAB9F64C93EB4EED3"><enum>(1)</enum><header>Payment
			 required</header><text>BP shall immediately pay to the United States
			 $25,000,000,000 as partial compensation for removal costs and damages for which
			 BP is liable.</text>
				</paragraph><paragraph commented="no" id="H206A9E32B5D34EC8B81E0536CE3B8289"><enum>(2)</enum><header>Limitation on
			 damages not applicable</header><text>Section 1004(a)(3) of the Oil Pollution
			 Act of 1990 (33 U.S.C. 2703(a)(3)) shall not apply with respect to the
			 explosion on and sinking of the mobile offshore drilling unit Deepwater
			 Horizon.</text>
				</paragraph><paragraph commented="no" id="H84A219E2C0A4407389DD9F4F0EEC7AE4"><enum>(3)</enum><header>No limitation on
			 liability</header><text>This section shall not be construed to limit the
			 liability of BP to the amount set forth in paragraph (1).</text>
				</paragraph></subsection><subsection id="H1E133AE80D2F4226972AEC6A48DA16A3"><enum>(c)</enum><header>Deposit and
			 use</header><text display-inline="yes-display-inline">Amounts paid by BP under
			 subsection (a) shall be deposited into a separate account in the Treasury and
			 shall be available to the Secretary of the Interior without further
			 appropriation to reimburse any person for removal costs and damages incurred by
			 the person as a result of the explosion on and sinking of the mobile offshore
			 drilling unit Deepwater Horizon.</text>
			</subsection><subsection id="H04C3829933D44060B50627496CA79D1D"><enum>(d)</enum><header>Definitions</header><text>In
			 this section—</text>
				<paragraph id="H42C75F6C1A214165B25C7C413E42542E"><enum>(1)</enum><header>BP</header><text>The
			 term <quote>BP</quote> means BP p.l.c.</text>
				</paragraph><paragraph id="H7C7D8BACD0CE495D9795307ED099B461"><enum>(2)</enum><header>Terms defined in
			 Oil Pollution Act of 1990</header><text display-inline="yes-display-inline">Each of the terms <term>damages</term>,
			 <term>discharge</term>, <term>oil</term>, <term>removal costs</term>,
			 <term>remove</term>, and <term>responsible party</term> has the meaning given
			 that term in section 1001 of the Oil Pollution Act of 1990 (33 U.S.C.
			 2701).</text>
				</paragraph></subsection></section></legis-body>
