		  through the Commissioner of Reclamation, to conduct a feasibility study of
		  water augmentation alternatives in the Sierra Vista

		<section display-inline="no-display-inline" id="H7A87561832634C2BA12BADD96D8FBAE9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Sierra Vista Subwatershed Feasibility
			 Study Act</short-title></quote>.</text>
		</section><section id="H26B4378DEA5949C580CF30F1083010AA"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="H6FFF4FBE459D4755952C8E85B5A9890"><enum>(1)</enum><header>Appraisal
			 report</header><text>The term <term>appraisal report</term> means the appraisal
			 report concerning the augmentation alternatives for the Sierra Vista
			 Subwatershed in the State of Arizona, dated June 2007 and prepared by the
			 Bureau of Reclamation.</text>
			</paragraph><paragraph id="HF0E0826AA4744FBD8BA3EA931F57BB07"><enum>(2)</enum><header>Principles and
			 guidelines</header><text>The term <term>principles and guidelines</term> means
			 the report entitled <quote>Economic and Environmental Principles and Guidelines
			 for Water and Related Land Resources Implementation Studies</quote> issued on
			 March 10, 1983, by the Water Resources Council established under title I of the
			 Water Resources Planning Act (42 U.S.C. 1962a et seq.).</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5F6E01E7394B4E71BADF4125D3E6E682"><enum>(3)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior.</text>
			</paragraph></section><section id="HBEF23AD45669498D904FAD25F7002E6F"><enum>3.</enum><header>Sierra Vista
			 Subwatershed Feasibility Study</header>
			<subsection id="HBBE8E158DC5E4CD2B3E181C1543B1EC0"><enum>(a)</enum><header>Study</header>
				<paragraph id="H5C9126E512E54CC681CE4580C77E58D1"><enum>(1)</enum><header>In
			 general</header><text>In accordance with the reclamation laws and the
			 principles and guidelines, the Secretary, acting through the Commissioner of
			 Reclamation, may complete a feasibility study of alternatives to augment the
			 water supplies within the Sierra Vista Subwatershed in the State of Arizona
			 that are identified as appropriate for further study in the appraisal
			 report.</text>
				</paragraph><paragraph id="HD3BBEB36B130484E91633BAB72E87807"><enum>(2)</enum><header>Inclusions</header><text>In
			 evaluating the feasibility of alternatives under paragraph (1), the Secretary
			 shall—</text>
					<subparagraph id="H9E11CE58273E4A63A8D5E6D5DDD2BD9D"><enum>(A)</enum><text>include—</text>
						<clause id="HDDF63C6B7A844E1B9823B77208EB7B28"><enum>(i)</enum><text>any
			 required environmental reviews;</text>
						</clause><clause id="H79B8AA20815646629736D40000F1D7C"><enum>(ii)</enum><text>the
			 construction costs and projected operations, maintenance, and replacement costs
			 for each alternative; and</text>
						</clause><clause id="H7A63AF7C001740DEA09BA4B6CD213B77"><enum>(iii)</enum><text>the economic
			 feasibility of each alternative;</text>
						</clause></subparagraph><subparagraph id="HF2F4DD527D2849B8BB5F5B70815ED52D"><enum>(B)</enum><text>take into
			 consideration the ability of Federal, tribal, State, and local government
			 sources and private sources to fund capital construction costs and annual
			 operation, maintenance, energy, and replacement costs;</text>
					</subparagraph><subparagraph id="H024BF2AF254145E8BD5B7F9000169048"><enum>(C)</enum><text>establish the
			 basis for—</text>
						<clause id="H1811FAABC2A6423B8725CA532E723F6C"><enum>(i)</enum><text>any
			 cost-sharing allocations; and</text>
						</clause><clause id="H1D5D797C4AE54E0AA861A8EAD3A9CB14"><enum>(ii)</enum><text>anticipated
			 repayment, if any, of Federal contributions; and</text>
						</clause></subparagraph><subparagraph id="HA428A39C7C43457AB4C85657F9C0EC5B"><enum>(D)</enum><text>perform a
			 cost-benefit analysis.</text>
					</subparagraph></paragraph></subsection><subsection id="H7023FF9140A9430FBBF3DE89FA254976"><enum>(b)</enum><header>Cost sharing
			 requirement</header>
				<paragraph id="HB8CDF55DC3464C81BAA68D86B0F7DCEE"><enum>(1)</enum><header>In
			 general</header><text>The Federal share of the total costs of the study under
			 subsection (a) shall not exceed 45 percent.</text>
				</paragraph><paragraph id="H2E46B42BD59D4A7A009C7B74BAE3F867"><enum>(2)</enum><header>Form of
			 non-Federal share</header><text>The non-Federal share required under paragraph
			 (1) may be in the form of any in-kind service that the Secretary determines
			 would contribute substantially toward the conduct and completion of the study
			 under subsection (a).</text>
				</paragraph></subsection><subsection id="HAAD496EA941846C3BA52DFB9A1EB4C17"><enum>(c)</enum><header>Statement of
			 Congressional intent relating to completion of study</header><text>It is the
			 intent of Congress that the Secretary complete the study under subsection (a)
			 by a date that is not later than 30 months after the date of enactment of this
			 Act.</text>
			</subsection><subsection id="H0AFFA52AC6B24C01BA339BDCC035E7E8"><enum>(d)</enum><header>Authorization of
			 appropriations</header><text>There is authorized to be appropriated to the
			 Secretary to carry out this section $1,260,000.</text>
			</subsection></section><section id="HCE65C70FB76E4651875454BDB67872D5"><enum>4.</enum><header>Water
			 rights</header><text display-inline="no-display-inline">Nothing in this Act
			 affects—</text>
			<paragraph id="H6F15B423B4764B49887FD3B6787349D"><enum>(1)</enum><text>any valid or vested
			 water right in existence on the date of enactment of this Act; or</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD6C83165E3594E8997AA00D5ED9F5DB3"><enum>(2)</enum><text>any application
			 for water rights pending before the date of enactment of this Act.</text>
