		  payment of royalty on all oil and gas saved, removed, sold, or discharged under
		  a lease under that Act, and for other purposes.</official-title>

		<section id="HF1E70D615D0A4DAA8621CBBC925D5B5D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Spilled Oil Royalty Collection
			 Act</short-title></quote>.</text>
		</section><section display-inline="no-display-inline" id="H079192D39D4A4BEFAADFDCF3C009088C" section-type="subsequent-section"><enum>2.</enum><header>Application of royalty
			 to oil that is saved, removed, sold, or discharged under offshore oil and gas
			 leases</header>
			<subsection id="HC3B0447427DD49ED93DE3C826EB5F8E4"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 8(a) of the
			 Outer Continental Shelf Lands Act (43 U.S.C. 1337(a)) is amended by adding at
			 the end the following new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="H7250693EF24F452281DE56F3E54F016C" style="OLC">
					<paragraph id="H435EB4605CC640BEA3D9DD3FDBA56C1C" indent="up1"><enum>(9)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H3946981805E740188D399F63700FA881"><enum>(A)</enum><text>Notwithstanding the
				terms of any bidding otherwise authorized by paragraph (1) and the authority of
				the Secretary to reduce or eliminate royalty or net profit share under
				paragraph (3), any royalty under a lease under this section, other than a
				deepwater lease, shall apply to all oil that is saved, removed, sold, or
				discharged, without regard to whether any of the oil is unavoidably lost or
				used on, or for the benefit of, the lease.</text>
						</subparagraph><subparagraph id="H7E9FF0CA7C4C4C2E869FF22E431A5EFB" indent="up1"><enum>(B)</enum><text>Notwithstanding paragraphs (1) and
				(3)—</text>
							<clause id="HC5A5B8BCACC04E0CA8ACC9AEE23AB06C"><enum>(i)</enum><text>royalty shall apply to all oil that is
				discharged under a deepwater lease, at a rate of not less than
				12<fraction>1/2</fraction> percent fixed by the Secretary in amount or value of
				any oil that is discharged; and</text>
							</clause><clause id="HA33782A6ADAE42DA869453165DD145F0"><enum>(ii)</enum><text>such royalty shall apply without
				regard to whether any of the oil is thereafter unavoidably lost.</text>
							</clause></subparagraph><subparagraph id="H946C1545633144FD8B005E8AEA2062F3" indent="up1"><enum>(C)</enum><text>In this paragraph—</text>
							<clause id="H5A9B2A80A676460DBC27C627033A7105"><enum>(i)</enum><text display-inline="yes-display-inline">the term <term>deepwater lease</term> means
				a lease for a tract in water depths of 200 meters or greater; and</text>
							</clause><clause id="H09B88FF8097042BAAED2349D04984ADC"><enum>(ii)</enum><text>the term <term>discharged</term>
				means any emission (other than natural seepage), intentional or unintentional,
				and includes, but is not limited to, spilling, leaking, pumping, pouring,
				emitting, emptying, or
				dumping.</text>
							</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HD6935DD3E6EA43D38D0887F33DA1A470"><enum>(b)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">This section shall take
			 effect April 15, 2010.</text>
