			 Chesapeake Bay Program under Clean Water Act</header>
			<subsection id="H04EDF46BBF2142E2A414F2C8E3AFB009"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 117(a) of the Federal Water
			 Pollution Control Act (33 U.S.C. 1267(a)) is amended—</text>
				<paragraph id="HFFA3D873186745EA85F09D5E83BBF26B"><enum>(1)</enum><text>by redesignating
			 paragraphs (5) and (6) as paragraphs (6) and (9), respectively;</text>
				</paragraph><paragraph id="H2B80EFC44AAE4A769AA0B7678B107F38"><enum>(2)</enum><text>by inserting after
			 paragraph (4) the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="HC124C2CD2F4B4E069F461E66ED908796" style="OLC">
						<paragraph id="HB2D60ED029644EB2AD8A4F55C848FA3D"><enum>(5)</enum><header>Chesapeake Bay
				State</header><text display-inline="yes-display-inline">The term
				<quote>Chesapeake Bay State</quote> or <quote>State</quote> means Delaware,
				Maryland, New York, Pennsylvania, Virginia, West Virginia, and the District of
				Columbia.</text>
						</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HEFCDF4A25C4642DB9751D797D0B5E23D"><enum>(3)</enum><text>by inserting after
			 paragraph (6), as redesignated, the following new paragraphs:</text>
					<quoted-block display-inline="no-display-inline" id="HC0A241DACB3945248E6A8A08A02B2F67" style="OLC">
						<paragraph id="HBA1630A7405E417D914072F8B5304EE4"><enum>(7)</enum><header>Chief
				Executive</header><text>The term <quote>chief executive</quote> means—</text>
							<subparagraph id="H75C9C8636CC14B1F859EE88E0C86C5B7"><enum>(A)</enum><text>in the case of a
				State or Commonwealth, the Governor of the State or Commonwealth; and</text>
							</subparagraph><subparagraph id="HF7CF5D0F3FCE46B9B8F5A53E298C12C4"><enum>(B)</enum><text>in the case of the
				District of Columbia, the Mayor of the District of Columbia.</text>
							</subparagraph></paragraph><paragraph commented="no" id="H0C6DC3F6D5BE43BEBAFE87288CFBCB09"><enum>(8)</enum><header>Restoration
				Activities</header><text>The term <quote>restoration activities</quote> means
				any Federal or State programs that directly protect, conserve, or restore
				habitat, water resources, or water quality in the Chesapeake Bay watershed,
				including programs that promote responsible land use and stewardship in the
				Chesapeake Bay
				ecosystem.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection display-inline="no-display-inline" id="H85EECB71BF0E41E2B45106589C1B4E7E"><enum>(b)</enum><header>Chesapeake Bay
			 crosscut financial report</header><text display-inline="yes-display-inline">Section 117 of the Federal Water Pollution
			 Control Act (33 U.S.C. 1267) is amended by striking subsection (j) and
			 inserting the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="HA641B727C1B54B27B159EFB49DD0B5B7" style="OLC">
					<subsection id="H2210302A9F1349F0A704AEDEBE6959FD"><enum>(j)</enum><header>Financial
				report</header>
						<paragraph id="H040759B3DF214D49894311BF33B31BD3"><enum>(1)</enum><header>Financial report
				required</header><text display-inline="yes-display-inline">Beginning with the
				budget submission for fiscal year 2012, the Director of the Office of
				Management and Budget, in consultation with other appropriate Federal agencies
				and the chief executive of each Chesapeake Bay State, shall submit to Congress
				a financial report containing—</text>
							<subparagraph id="HA07968BB8CCC45F7945BA5EAA315E5C9"><enum>(A)</enum><text>a summary of an
				interagency crosscut budget that displays—</text>
								<clause id="HEDD67B6250684AE088286566B1223FA6"><enum>(i)</enum><text>the proposed
				funding for any Federal restoration activity to be carried out in the
				succeeding fiscal year, including any planned interagency or intra-agency
				transfer, for each of the Federal agencies that carry out restoration
				activities;</text>
								</clause><clause id="H09689E90ECEA44C99F7BB19AFFBED94C"><enum>(ii)</enum><text display-inline="yes-display-inline">to the extent that information is
				available, the estimated funding for any State restoration activity to be
				carried out in the succeeding fiscal year;</text>
								</clause><clause id="H9FEDF95031A6438484403BA85B9B8452"><enum>(iii)</enum><text display-inline="yes-display-inline">all expenditures for Federal restoration
				activities from the preceding 3 fiscal years, the current fiscal year, and the
				succeeding fiscal year; and</text>
								</clause><clause id="HF1361C45E6A2408C899702E6266A6C7E"><enum>(iv)</enum><text display-inline="yes-display-inline">all expenditures, to the extent that
				information is available, for State restoration activities during the
				equivalent time period described in clause (iii);</text>
								</clause></subparagraph><subparagraph id="H03C55E2859A64B49B3BEC5EFBF2BAF71"><enum>(B)</enum><text>a detailed
				accounting of all funds received and obligated by all Federal agencies for
				restoration activities during the current and preceding fiscal years, including
				the identification of funds which were transferred to a Chesapeake Bay State
				for restoration activities;</text>
							</subparagraph><subparagraph id="H0300F0DFB7FF44FC9B1699204B4CE9A4"><enum>(C)</enum><text>to the extent that
				information is available, a detailed accounting from each State of all funds
				received and obligated from a Federal agency for restoration activities during
				the current and preceding fiscal years; and</text>
							</subparagraph><subparagraph id="HC4E238E64D1745D09C7EF3EE959AC76E"><enum>(D)</enum><text>a description of
				each of the proposed Federal and State restoration activities to be carried out
				in the succeeding fiscal year (corresponding to those activities listed in
				clauses (i) and (ii) of subparagraph (A)).</text>
							</subparagraph></paragraph><paragraph id="H27631E8F2D96450B91087316E6D4185B"><enum>(2)</enum><header>Submission</header><text display-inline="yes-display-inline">Not later than 30 days after the submission
				by the President of the annual budget to Congress, the Director shall submit
				the report required by paragraph (1) to the following congressional
				committees:</text>
							<subparagraph id="HCC174AC8E79B4A278B78E0BA307E07BA"><enum>(A)</enum><text>The Committees on
				Agriculture, Appropriations, Natural Resources, Energy and Commerce, and
				Transportation and Infrastructure of the House of Representatives.</text>
							</subparagraph><subparagraph id="H5E538D8F20B445E5ABF2E5156814D003"><enum>(B)</enum><text display-inline="yes-display-inline">The Committees on Agriculture, Nutrition,
				and Forestry, Appropriations, Environment and Public Works, and Commerce,
				Science, and Transportation of the
				Senate.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HE627C51AFEC546E79FF5C1F13FC21961"><enum>(c)</enum><header>Transparency and
			 accountability</header><text>Section 117 of the Federal Water Pollution Control
			 Act (33 U.S.C. 1267) is amended by adding at the end the following new
			 subsection:</text>
				<quoted-block display-inline="no-display-inline" id="HB08AE9109BBF4CC6AB3BBBDFE3EE4391" style="OLC">
					<subsection id="H72113AE2ED23457A815BB6CCD5DFEA00"><enum>(k)</enum><header>Transparency and
				accountability requirements</header>
						<paragraph id="H2EE30559CD914C97ADF6181EA3BE528B"><enum>(1)</enum><header>State
				Reports</header><text display-inline="yes-display-inline">Not later than 10
				days after the end of each calendar quarter, each State that received funds
				from a Federal agency under subsection (n)(1)(B) shall submit a report to the
				head of the agency that—</text>
							<subparagraph id="H04742B0E4AE34E52ACF1741B4786160A"><enum>(A)</enum><text display-inline="yes-display-inline">identifies the total amount of funds
				received from the agency under such provisions during the preceding calendar
				quarter;</text>
							</subparagraph><subparagraph id="HA5259A272F5E430BAB50002C1C3E8943"><enum>(B)</enum><text display-inline="yes-display-inline">identifies the amount of funds received
				from the agency under such provisions during the preceding calendar quarter or
				earlier that were obligated or expended for projects or activities during the
				preceding calendar quarter; and</text>
							</subparagraph><subparagraph id="HD1E943789D0649A3A6DCCD8E5DC317A1"><enum>(C)</enum><text>contains a list of
				all projects or activities for which the funds were obligated or expended,
				except that such list shall not include personal identifying information of
				individual recipients.</text>
							</subparagraph></paragraph><paragraph id="HC5FA87E9CE134FDD8F6EC8A9A2D32BAD"><enum>(2)</enum><header>Agency
				reports</header><text display-inline="yes-display-inline">Not later than 30
				days after the end of each calendar quarter, the head of each Federal agency
				that made funds available under subsection (n)(1)(B) to any State shall provide
				the information received in reports submitted under paragraph (1) to the
				Administrator. The Administrator shall publish the information on a publicly
				available website, as provided in paragraph (4).</text>
						</paragraph><paragraph id="H0F56FB554EC64C7B964EBE2996AF32DD"><enum>(3)</enum><header>Initial
				Compliance</header><text display-inline="yes-display-inline">Not later than 180
				days after the date of the enactment of the <short-title>Chesapeake Bay Program Reauthorization and Improvement
				Act</short-title>, the head of each Federal agency providing funds under
				subsection (n)(1)(B) shall require, as a condition of receipt of the funds, a
				State recipient of the funds to provide the information required under
				paragraph (1).</text>
						</paragraph><paragraph id="H6AF55D2C235C4A859E64A8EE5BE9DF9D"><enum>(4)</enum><header>Website</header>
							<subparagraph id="H2C9239E7543B44F9A5ACE2499C6860E4"><enum>(A)</enum><header>Website
				required</header><text display-inline="yes-display-inline">The Administrator
				shall establish and maintain, no later than 30 days after enactment of the
				<short-title>Chesapeake Bay Program Reauthorization and
				Improvement Act</short-title>, a user-friendly, public-facing website to foster
				greater accountability and transparency in the use of funds provided under
				subsection (n)(1)(B).</text>
							</subparagraph><subparagraph id="HE66F30BC5F2B4C2C8EE8E3E9352F927A"><enum>(B)</enum><header>Content and
				function</header><text>The website shall provide the following:</text>
								<clause id="H7607807D0C0648AAB0F0E16938A17840"><enum>(i)</enum><text>Accountability
				information, including findings from audits, inspectors general, and the
				Government Accountability Office.</text>
								</clause><clause id="HEFAD4A3E8FB54215B50D3B9BC71F5907"><enum>(ii)</enum><text>Data on relevant
				economic, financial, grant, and contract information in user-friendly visual
				presentations to enhance public awareness of the use of covered funds.</text>
								</clause><clause id="HC77017FEE0CE4870A048527F337B3428"><enum>(iii)</enum><text>Links to other
				government websites where key information relating to efforts to improve the
				water quality of the Chesapeake Bay watershed may be found.</text>
								</clause><clause id="H656E5172038146359CA55DF3B7CCC921"><enum>(iv)</enum><text>Printable reports
				on covered funds obligated by month to each State and congressional
				district.</text>
								</clause><clause id="HDE664E98903747E391FDB11C5D8A3A9A"><enum>(v)</enum><text>Links to other
				government websites with information concerning covered funds, including
				Federal agency and State websites.</text>
								</clause></subparagraph><subparagraph id="HD373E2C02D4642DD950F23ACCA9EFE8B"><enum>(C)</enum><header>Revisions</header><text>The
				Administrator shall enhance and update the website as
				necessary.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection display-inline="no-display-inline" id="H5260EB4235AA4F36AF6679480C628DB1"><enum>(d)</enum><header>Independent
			 evaluation and technical advisory committee for Chesapeake bay
			 program</header><text display-inline="yes-display-inline">Section 117 of the
			 Federal Water Pollution Control Act (33 U.S.C. 1267) is amended by inserting
			 after subsection (k), as added by subsection (c), the following new
			 subsection:</text>
				<quoted-block display-inline="no-display-inline" id="HF389F14A06124975A1B68D85D947F7C9" style="OLC">
					<subsection id="HC5F002CA4CD54152952A4068E596124B"><enum>(l)</enum><header>Independent
				evaluation and technical advisory committee</header>
						<paragraph id="H2C4A87BAFC704636B386919ABEE66925"><enum>(1)</enum><header>Establishment;
				purpose</header><text display-inline="yes-display-inline">There shall be an
				Independent Evaluation and Technical Advisory Committee (in this subsection
				referred to as the <quote>advisory committee</quote>) established to review and
				report on restoration activities in the Chesapeake Bay ecosystem, including
				relevant topics suggested by the Chesapeake Executive Council and the
				Chesapeake Bay Commission</text>
						</paragraph><paragraph id="H86FADD1C6E1346779CA90649EB7F99D6"><enum>(2)</enum><header>Appointment</header><text display-inline="yes-display-inline">The Administrator and the Secretary of
				Agriculture shall appoint the members of the advisory committee, which shall
				consist of the following members:</text>
							<subparagraph id="HE77AA4D7E19844FEB205F7B04B91E0C8"><enum>(A)</enum><text display-inline="yes-display-inline">One individual affiliated with an
				institution of higher education who has expertise in water quality.</text>
							</subparagraph><subparagraph id="H5ABB87459A3D4673B58A7AD9FDE14D87"><enum>(B)</enum><text>Two individuals
				who are engineers or scientists from government and academia who have expertise
				in water quality modeling.</text>
							</subparagraph><subparagraph id="H9234B618ED674D6CB2559312777A2D16"><enum>(C)</enum><text>Two individuals
				with professional experience and expertise concerning urban and agricultural
				storm water issues.</text>
							</subparagraph><subparagraph id="HBD14E1C92E124CF7A1227BE29F9DC429"><enum>(D)</enum><text>One individual
				with professional experience and expertise concerning urban and suburban
				development.</text>
							</subparagraph><subparagraph id="H129BA18916D74A478EE1B720B97E4C26"><enum>(E)</enum><text>One individual
				with professional experience and expertise regarding water quality
				modeling.</text>
							</subparagraph><subparagraph id="H7F8952049A954C76937B644A572447B4"><enum>(F)</enum><text>One individual
				affiliated with an environmental or conservation organization.</text>
							</subparagraph><subparagraph id="HF88D91A97C0E49F797E4242C9C0A93B4"><enum>(G)</enum><text>One individual
				affiliated with agriculture farm commodity programs.</text>
							</subparagraph><subparagraph id="HFB4AD197735E47AC89DFF18A57EE3484"><enum>(H)</enum><text display-inline="yes-display-inline">One individual affiliated with agriculture
				conservation programs.</text>
							</subparagraph><subparagraph id="HA7408C2D4BD4448789FD969FABFFF53B"><enum>(I)</enum><text>One individual
				with professional experience and expertise in economics.</text>
							</subparagraph><subparagraph id="HE96D76A3294F407493D29D24067A9251"><enum>(J)</enum><text>One individual
				with professional experience and expertise in agronomy, crop science, or soil
				science.</text>
							</subparagraph><subparagraph id="H4CD570D9C87547EB834A06586119B470"><enum>(K)</enum><text>One individual
				with professional experience and expertise in wastewater treatment
				systems.</text>
							</subparagraph><subparagraph id="H00F2CEF681B44C8BAD50A3DB701D2C67"><enum>(L)</enum><text>One individual
				with professional experience and expertise in marine biology or fish and
				wildlife habitats.</text>
							</subparagraph><subparagraph id="HF10D05AEA2324CC993CD65753690D296"><enum>(M)</enum><text>One individual
				with professional experience and expertise in implementing building
				permits.</text>
							</subparagraph></paragraph><paragraph id="HB740E5DFAF234EB4BA74F58B1090CAE7"><enum>(3)</enum><header>Term</header><text>A
				member of the advisory committee shall be appointed for a term of two years and
				is limited to three terms on the advisory committee.</text>
						</paragraph><paragraph id="H49E2DA83B5F948AF9553806049518D13"><enum>(4)</enum><header>Bylaws</header><text display-inline="yes-display-inline">The advisory committee shall establish such
				bylaws as may be appropriate to enable the advisory committee to carry out its
				duties under this subsection. Such bylaws shall include provisions to prevent
				any conflict of interest, or the appearance of any conflict of interest, in the
				actions taken or recommendations made by the advisory committee or by any
				member. As an advisory committee, the committee has no power to promulgate
				regulations.</text>
						</paragraph><paragraph id="H30D6A4691F8747BC907D38DCB7476653"><enum>(5)</enum><header>Administrative
				support</header><text>The Department of Agriculture shall be the administering
				agency for the advisory committee.</text>
						</paragraph><paragraph id="H30E84D2FB7BF474099E9BC8F64053DE0"><enum>(6)</enum><header>Duties</header>
							<subparagraph id="H3CC3F05227FB4739BABFACA10D0DFBAB"><enum>(A)</enum><header>Administration
				review</header><text display-inline="yes-display-inline">The advisory committee
				shall provide recommendations to the Administrator and Secretary of Agriculture
				concerning administration of this section.</text>
							</subparagraph><subparagraph id="H4CB7A0F139BB473D96C9A39F41BD0F0B"><enum>(B)</enum><header>Program and
				activities review</header><text display-inline="yes-display-inline">The
				advisory committee shall review, and provide recommendations to the
				Administrator and Secretary of Agriculture concerning, whether—</text>
								<clause id="H51D5EC9493054DD596AD8BBC2853D182"><enum>(i)</enum><text>funds authorized
				for the restoration activities are distributed and used in a manner that are
				consistent with the objectives of improving the water quality in the Chesapeake
				Bay ecosystem;</text>
								</clause><clause id="HB802589FEFC7485C83865049B7323CE1"><enum>(ii)</enum><text>mechanisms are in
				place to ensure that restoration activities are properly implemented;</text>
								</clause><clause id="H4BFE95EE70B141EB8D41FAA647B48B8D"><enum>(iii)</enum><text display-inline="yes-display-inline">mechanisms are in place to ensure that
				progress toward water quality goals for the Chesapeake Bay ecosystem are
				achieved;</text>
								</clause><clause id="HA61C0921FFA74D55864137A105BDCAF0"><enum>(iv)</enum><text display-inline="yes-display-inline">the allocation of funds reflects each
				Chesapeake Bay State’s responsibility and contribution towards achieving water
				quality goals;</text>
								</clause><clause id="H1BAAAA004FD74A0EB8DC5039BA5A1F98"><enum>(v)</enum><text>restoration
				activities are carried out in accordance with this section; and</text>
								</clause><clause id="H25954B92E14242D4BE4B5B9B8756A18F"><enum>(vi)</enum><text>the factual
				information and assumptions incorporated in the Chesapeake Bay model are
				accurate.</text>
								</clause></subparagraph><subparagraph id="H7FD8F28EECDA429AAE4E7AC511F95039"><enum>(C)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than December 31, 2011, and every
				two years thereafter, the advisory committee shall submit to the Administrator,
				the Secretary of Agriculture, and Congress regarding progress made toward
				reaching water quality goals in the Chesapeake Bay ecosystem.</text>
							</subparagraph></paragraph><paragraph id="HCBDA24552DF841239242216E6CEB1681"><enum>(7)</enum><header>Coordination</header><text display-inline="yes-display-inline">To avoid duplication of effort, the
				advisory committee shall coordinate activities with other Federal advisory
				committees working in related areas.</text>
						</paragraph><paragraph id="H36CBDC7733D4437687D1523A188E0467"><enum>(8)</enum><header>Meetings</header><text>The
				advisory committee shall meet at least quarterly.</text>
						</paragraph><paragraph id="HE1162266299C46FDAA423413D064728B"><enum>(9)</enum><header>No regulatory
				authority</header><text display-inline="yes-display-inline">The advisory
				committee does not have the authority to recommend or promulgate
				regulations.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HAE85B5BCF3DB43B79119117EE1D9F0D2"><enum>(e)</enum><header>Nutrient and
			 Sediment Trading Technical Guidelines</header><text>Section 117 of the Federal
			 Water Pollution Control Act (33 U.S.C. 1267) is amended by inserting after
			 subsection (l), as added by subsection (d), the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="H44C40658FC9B452AA6D87C7472A208DD" style="OLC">
					<subsection id="HA6DF1AF8065E4D21B16DBBEE31EBE9E2"><enum>(m)</enum><header>Nutrient and
				Sediment Trading Technical Guidelines</header>
						<paragraph id="HC63D22C3614E4BDABD9E953CD3CF5C5A"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than May 12, 2012, the
				Administrator, in consultation with the Secretary of Agriculture and Chesapeake
				Bay States shall establish technical guidelines to be used by the Chesapeake
				Bay Nutrient and Sediment Trading Commission in establishing an interstate
				nutrient and sediment trading program for the Chesapeake Bay. Such guidelines
				shall not apply to agricultural and non-industrial private forest lands.</text>
						</paragraph><paragraph id="H2121AF792BD242E79408793EFDF9F21E"><enum>(2)</enum><header>Elements</header><text>The
				technical guidelines established under this subsection shall, at a
				minimum—</text>
							<subparagraph id="HD24A93FC407C40E492A1A2E10CBAE088"><enum>(A)</enum><text>define and
				standardize nutrient and sediment credits and establish procedures or standards
				for ensuring equivalent water quality benefits for all credits;</text>
							</subparagraph><subparagraph id="H9B12F141200F4DEF94C7CF90FC8C05B2"><enum>(B)</enum><text>establish
				procedures or standards for nutrient and sediments credits to ensure that
				credit-generating practices from both point sources and nonpoint sources
				(excluding agricultural and forest lands) are achieving reductions in nutrient
				and sediments;</text>
							</subparagraph><subparagraph id="HF86CC0571F854E4BAA758A6B5A171021"><enum>(C)</enum><text>establish
				procedures or standards for generating, quantifying, trading, banking, and
				applying credits to meet regulatory requirements;</text>
							</subparagraph><subparagraph id="HE3DE9A6B47694D22AA031BBA5844F2AA"><enum>(D)</enum><text>establish baseline
				requirements, relevant to the credit being traded, that a credit seller must
				meet before becoming eligible to generate saleable credits; and</text>
							</subparagraph><subparagraph id="HEFC3A628283843FCBED0DF0C12FFCF23"><enum>(E)</enum><text>incorporate an
				approach under the national pollutant discharge elimination system established
				under section 402 that creates a general approval for trading, thereby avoiding
				the need to reopen or reissue permits to incorporate individual
				trades.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H0479CB645A3A4D89A6F890781EF655DC"><enum>(f)</enum><header>Authorization of
			 appropriations and grant authority</header><text display-inline="yes-display-inline">Section 117 of the Federal Water Pollution
			 Control Act (33 U.S.C. 1267) is amended by inserting after subsection (m), as
			 added by subsection (e), the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="H85DD23375D57452E9905DE565B50315D" style="OLC">
					<subsection id="HF1634C71B83D42B7A298B5F5E4108518"><enum>(n)</enum><header>Authorization of
				appropriations; grants</header>
						<paragraph id="H6C4771063E9449F9B33003A8A4803416"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">There are authorized
				to be appropriated to the Administrator for each of fiscal years 2010 through
				2015—</text>
							<subparagraph id="HD4A2830FFE0149EFB6E9ED5EAA04A991"><enum>(A)</enum><text display-inline="yes-display-inline">such sums as are necessary to carry out
				this section; and</text>
							</subparagraph><subparagraph id="H39E2C335D50C46DD82AA87F1D513F845"><enum>(B)</enum><text display-inline="yes-display-inline">such sums as may be necessary to support
				the Chesapeake Bay States in carrying out section 303(d), with priority given
				to Maryland, Virginia, Pennsylvania, and District of Columbia, which shall be
				distributed in the following percentages and for the following purposes:</text>
								<clause id="HCED87F6B43614B7EA0285C0DB9ED8790"><enum>(i)</enum><text>30
				percent for grants to any municipal, intermunicipal, interstate, or State
				agency for construction of publicly owned treatment works, as defined in
				section 212.</text>
								</clause><clause id="H35A3F10BC528486EA7F708F733BA28C6"><enum>(ii)</enum><text display-inline="yes-display-inline">35 percent for grants to any municipality
				that operates a municipal separate stormwater sewage system under section
				402(p).</text>
								</clause><clause id="H898AAAF60BBB4AA2B243E6975904417F"><enum>(iii)</enum><text display-inline="yes-display-inline">35 percent to the Secretary of Agriculture
				to carry out section 1240Q(i) of the Food Security Act of 1985 (16 U.S.C.
				3839bb–4(i)).</text>
								</clause></subparagraph></paragraph><paragraph id="H8C22B3AEC7C34C1BBC813C694480C9AE"><enum>(2)</enum><header>Availability of
				funds</header><text display-inline="yes-display-inline">Amounts appropriated
				pursuant to the authorization of appropriations in paragraph (1) shall remain
				available until expended.</text>
						</paragraph><paragraph commented="no" id="H415B315A0EFF4923B001ECAE3CB85551"><enum>(3)</enum><header>Reservation of
				funds for states</header>
							<subparagraph id="HE1BA518CE7EA465BABFAD194624F7801"><enum>(A)</enum><header>Reservation
				percentages</header><text display-inline="yes-display-inline">Of the amounts
				appropriated pursuant to the authorization of appropriations in paragraph
				(1)(B), the Administrator shall reserve the following percentages for
				allocation pursuant to subparagraph (B):</text>
								<clause id="HF2566E50524140AFB90715930A2A78F8"><enum>(i)</enum><text>10
				percent in fiscal year 2011.</text>
								</clause><clause id="H2E0C6CD435B44C1AAA97E862DEAC1D1D"><enum>(ii)</enum><text>20 percent in
				fiscal year 2013.</text>
								</clause><clause id="H8381652EC20F46CBA80B67743870E358"><enum>(iii)</enum><text>50 percent in
				fiscal year 2015.</text>
								</clause></subparagraph><subparagraph id="H7564770A709D4543B87B65885142940E"><enum>(B)</enum><header>Allocation to
				states</header><text display-inline="yes-display-inline">The Administrator
				shall allot the amounts reserved pursuant to subparagraph (A) among States in
				each fiscal year based on the Administrator’s finding, in consultation with the
				Secretary of Agriculture, that the States have made sufficient progress toward
				meeting water quality goals and are properly managing financial resources
				intended to enable each State in meeting its water quality goals. The
				Administrator, in consultation with the Secretary, shall base the finding upon
				the report of the advisory committee required under subsection
				(l).</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H318031AED0B848C78BEBE78A7E2B063B"><enum>(g)</enum><header>Total maximum
			 daily load for nitrogen, phosphorus, or sediment for Chesapeake
			 Bay</header><text>Section 117 of the Federal Water Pollution Control Act (33
			 U.S.C. 1267) is amended by inserting after subsection (n), as added by
			 subsection (f), the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="H8CFA87F30F4A46B6980135F67CC9CE74" style="OLC">
					<subsection id="H53D2248FF97F4A51840709AED28D5522"><enum>(o)</enum><header>Total maximum
				daily load for nitrogen, phosphorus, or sediment for Chesapeake Bay</header>
						<paragraph id="H7C9D9D24791A4BCEA9517714ACEBDA65"><enum>(1)</enum><header>TMDL
				duration</header><text display-inline="yes-display-inline">A total maximum
				daily load established under section 303(d) for nitrogen, phosphorus, or
				sediment for the Chesapeake Bay and its tributaries may include load
				expressions for wasteload allocations or load allocations using time frames
				other than daily (such as annual, monthly, or seasonal) for sectors, including
				agriculture, where non-daily wasteload or load allocations are most appropriate
				to implement applicable water quality standards.</text>
						</paragraph><paragraph id="H9375F0E5AC47457FB59AA3D5A6A038F5"><enum>(2)</enum><header>Adaptive
				management</header><text display-inline="yes-display-inline">If a Chesapeake
				Bay State develops a plan to implement a total maximum daily load under section
				303(d) for phosphorus, nitrogen, or sediment for the Chesapeake Bay or its
				tributaries that provides for reductions in loading through an iterative
				process that employs adaptive management principles, permits may be issued
				under section 402 for new or existing discharges that include waste load
				allocations consistent with the plan and that demonstrate progress towards
				achieving the waste load allocation, whether by treatment, trading, or other
				means, in accordance with the schedule provided in the plan, as determined by
				the permit issuing authority. In assessing sufficient progress by municipal
				dischargers and other point sources toward meeting water quality goals and
				plans, the Administrator and the States should take into account the
				availability, cost, effectiveness, and appropriateness of practices,
				techniques, methods, or other provisions for the control of such pollutants to
				meet the requirements of section 402(p).</text>
						</paragraph><paragraph id="H0DC31CDAA3B8458A85ABF214337CD5B9"><enum>(3)</enum><header>Options for
				offsetting of stormwater management requirements</header><text display-inline="yes-display-inline">In order to meet Federal or State water
				quality requirements in the Chesapeake Bay ecosystem, an individual or entity
				undertaking land development activities requiring the management of stormwater
				by on-site infiltration shall be permitted to meet the applicable infiltration
				requirements by paying to offset them through the establishment of equivalent
				stormwater management practices off-site within the Chesapeake Bay ecosystem.
				Offsetting stormwater management practices shall include, at a minimum, the
				establishment on agricultural lands of riparian forest buffers, streambank
				fencing, or other best management
				practices.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="HEE8D9C5D07A24873A146D9954AAFF53E" section-type="subsequent-section"><enum>3.</enum><header>Establishment of
			 independent commission to oversee and administer nutrient and sediment trading
			 program for Chesapeake Bay States</header><text display-inline="no-display-inline">The Federal Water Pollution Control Act is
			 amended by inserting after section 117 (33 U.S.C. 1267) the following new
			 section:</text>

				<section id="H6534A89725CF4B3C885770E2B42285ED"><enum>117A.</enum><header>Chesapeake Bay
				Nutrient and Sediment Trading Commission</header>
					<subsection id="HD0CF60FD91024D73A30E0E3F58BFA7AF"><enum>(a)</enum><header>Definitions</header><text>In
				this section:</text>
						<paragraph id="H89D5FC3F1D4149069F5225872CDF144B"><enum>(1)</enum><header>Commission</header><text display-inline="yes-display-inline">The term <quote>Commission</quote> means
				the Chesapeake Bay Nutrient and Sediment Trading Commission.</text>
						</paragraph><paragraph commented="no" id="HA633017D7EF5463BA04FB38ECE711FB4"><enum>(2)</enum><header>Chesapeake Bay
				State</header><text display-inline="yes-display-inline">The term
				<quote>Chesapeake Bay State</quote> means Delaware, Maryland, New York,
				Pennsylvania, Virginia, West Virginia, and the District of Columbia.</text>
						</paragraph><paragraph id="HF94FD6D3A73A406CA0E9AA7EE343A541"><enum>(3)</enum><header>Chesapeake
				Executive Council</header><text>The term <term>Chesapeake Executive
				Council</term> means the signatories to the Chesapeake Bay Agreement.</text>
						</paragraph><paragraph id="H57BA616E6B024499AFE5F31B8BD48849"><enum>(4)</enum><header>Chesapeake bay
				agreement</header><text display-inline="yes-display-inline">The term
				<term>Chesapeake Bay Agreement</term> means the formal, voluntary agreements
				executed to achieve the goal of restoring and protecting the Chesapeake Bay
				ecosystem and the living resources of the Chesapeake Bay ecosystem and signed
				by the Chesapeake Executive Council.</text>
						</paragraph><paragraph id="H05BC783FD3524AD387E0BB868E288CB5"><enum>(5)</enum><header>Nutrient</header><text>The
				term <quote>nutrient</quote> means nitrogen and phosphorous.</text>
						</paragraph></subsection><subsection id="H55C812FD843C42ED9F06FAA33FE2B90B"><enum>(b)</enum><header>Establishment of
				Commission; purpose</header>
						<paragraph id="H002489D5485946ECACE2983EA85C5C08"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">There is established
				a Chesapeake Bay Nutrient and Sediment Trading Commission to oversee and
				administer the nitrogen and phosphorus trading program for the Chesapeake Bay
				States to insure credits are generated to attract market participants and
				facilitate trading mechanisms among and within States to meet water quality
				goals.</text>
						</paragraph><paragraph id="HE6EA306030E1414193CF0EB9B9F92B98"><enum>(2)</enum><header>Independent
				establishment</header><text>The Commission shall be an independent
				establishment, as defined in section 104 of title 5, United States Code.</text>
						</paragraph><paragraph id="H825A396C23034122BD07C645EABADFC8"><enum>(3)</enum><header>Location</header><text display-inline="yes-display-inline">The Commission shall be housed at the
				Office of the Chesapeake Bay Program directed by the Chesapeake Executive
				Council in accordance with the Chesapeake Bay Agreement.</text>
						</paragraph></subsection><subsection id="HFC26D95DB46549159F6D441AF9DF3409"><enum>(c)</enum><header>Duties</header>
						<paragraph id="HFA86479DC37841E391AE47EF0B14C913"><enum>(1)</enum><header>Credits for
				water quality trading</header><text display-inline="yes-display-inline">In
				consultation with market developers and appropriate Federal agencies, the
				Commission shall develop a system to facilitate and generate credits for
				interstate water quality trading in the Chesapeake Bay States.</text>
						</paragraph><paragraph id="HFFAB7C8EF4034C79A7F3384DEF6F0DB4"><enum>(2)</enum><header>Water quality
				trading registry</header><text display-inline="yes-display-inline">The
				Commission shall obtain information from the Administrator, the Secretary of
				Agriculture, and other Federal agencies to operate and oversee a registry for
				interstate water quality trading in the Chesapeake Bay States.</text>
						</paragraph><paragraph id="HD883D7EC23D04404B300CE84D43A84F0"><enum>(3)</enum><header>Trade
				recordkeeping</header><text display-inline="yes-display-inline">The Commission
				shall develop and maintain a system to record specific interstate water quality
				trades in the Chesapeake Bay States.</text>
						</paragraph><paragraph id="H892B1426996E4721AB71E15269B8F968"><enum>(4)</enum><header>Point source and
				non-point source trades</header><text display-inline="yes-display-inline">In
				consultation with market developers and appropriate Federal agencies, the
				Commission shall develop a system to allow for trading to occur between point
				source and non-point source dischargers in the Chesapeake Bay States.</text>
						</paragraph><paragraph id="H537FDA5B023C44D2883CBE84ADE5E0B4"><enum>(5)</enum><header>Consistency with
				state program</header><text>The Commission shall not establish or operate a
				program that conflicts with or modifies a State program.</text>
						</paragraph></subsection><subsection id="HCEC7D349487243018B535BB3F6DBCC35"><enum>(d)</enum><header>Use of technical
				guidelines</header><text display-inline="yes-display-inline">The Commission
				shall rely on the Administrator to provide technical guidelines under section
				117(m) and the Secretary of Agriculture to provide technical guidelines under
				section 1245(b) of the Food Security Act of 1985 (16 U.S.C. 3845(b)).</text>
					</subsection><subsection id="H100AFFE4EEDA4ABEABEF9DCA591B823B"><enum>(e)</enum><header>Members of
				commission</header>
						<paragraph id="H8665C9FB90924C0C9299BAE61FF107E9"><enum>(1)</enum><header>Composition</header><text display-inline="yes-display-inline">The Commission shall consist of five
				members, of which—</text>
							<subparagraph id="HBD92ED40199C4CAF82F5DD34DA1816DE"><enum>(A)</enum><text>one member shall
				be appointed by the Secretary of Agriculture;</text>
							</subparagraph><subparagraph id="H1594D735A8AA47028AC38FA13FBA51DD"><enum>(B)</enum><text display-inline="yes-display-inline">one member shall be appointed by the
				Administrator of the Environmental Protection Agency; and</text>
							</subparagraph><subparagraph id="H2DADD4B72B654BA38FCC62E63D5C163E"><enum>(C)</enum><text>three members
				shall be appointed by the governors from each of the signatory States of the
				Bay Agreement.</text>
							</subparagraph></paragraph><paragraph id="HA4AB7CE4D8A8455FBBEEA9D0126E726C"><enum>(2)</enum><header>Special
				considerations</header><text>With regard to the members appointed under
				paragraph (1)(C)—</text>
							<subparagraph id="HBD0E13746BDD4B29916EE0211107CB0E"><enum>(A)</enum><text>one member shall
				be a representative of the general public;</text>
							</subparagraph><subparagraph id="H1BAEED1F620645D684D9865C081360AA"><enum>(B)</enum><text display-inline="yes-display-inline">not more than two of the members may have
				similar professional experience or expertise in the same field; and</text>
							</subparagraph><subparagraph id="HEE2A2F098E304096A92330B02643354F"><enum>(C)</enum><text display-inline="yes-display-inline">at least one of the members shall be
				experienced in a market based pollutant trading mechanism.</text>
							</subparagraph></paragraph><paragraph id="H23B5844288D04A8A95F111A550967E5D"><enum>(3)</enum><header>Terms</header><text>The
				members of the Commission shall serve a term of five years and may be
				reappointed.</text>
						</paragraph><paragraph id="H1BBA9F26415740C9B3C7CBF9373F55E3"><enum>(4)</enum><header>Chairperson</header><text display-inline="yes-display-inline">The members of the Commission shall
				designate one of the members to serve as chairperson.</text>
						</paragraph><paragraph id="HF75AAF26900E441691458B84ADD9ECE5"><enum>(5)</enum><header>Meetings</header><text>The
				Commission shall meet at the call of the chairperson or a majority of its
				members.</text>
						</paragraph></subsection><subsection id="H146845EEEE9D4967BE3774118D463C68"><enum>(f)</enum><header>Officers and
				staff</header><text>The Commission may appoint, employ, fix the pay of, and
				provide other allowances and benefits for such officers and employees of the
				Commission as the members determine to be appropriate.</text>
					</subsection><subsection id="H3FEBE8379F0D455BB75FDF51E895017D"><enum>(g)</enum><header>Duration</header><text>The
				Commission shall terminate on September 30,
				2015.</text>
					</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HCFA3B76A594A41A4AE723CA3274433DF"><enum>4.</enum><header>Chesapeake Bay
			 watershed assurance standards</header><text display-inline="no-display-inline">Section 1240Q of the Food Security Act of
			 1985 (16 U.S.C. 3839bb–4) is amended by adding at the end the following new
			 subsection:</text>
			<quoted-block display-inline="no-display-inline" id="HCC7CC22A3BCA43D196DF972A9E152014" style="OLC">
				<subsection id="HDC5E5B7538B34EA29424B5A29FC64488"><enum>(i)</enum><header>Chesapeake Bay
				watershed assurance standards</header>
					<paragraph id="H0A5697C6350142EA919817C7C2F81256"><enum>(1)</enum><header>Purpose</header><text display-inline="yes-display-inline">The purpose of this subsection is to
				develop environmental assurance standards for the Chesapeake Bay States to use
				to ensure that farmers and non-industrial private forest landowners in the
				Chesapeake Bay watershed are implementing conservation activities to fulfill
				water quality regulations under applicable Federal and State law.</text>
					</paragraph><paragraph id="H5527175E7952483894EAC177BA62779C"><enum>(2)</enum><header>Duties of
				Secretary</header>
						<subparagraph id="H4654EA3F4F2E424A860C474AD612E8D2"><enum>(A)</enum><header>Establishment of
				standards</header><text display-inline="yes-display-inline">For the purposes of
				this section, the Secretary shall use existing State partnerships and programs
				to establish standards for risk assessment, conservation planning,
				verification, water quality, and auditing practices that Chesapeake Bay States
				can incorporate in their State management plan under section 117(g)(1) of the
				Federal Water Pollution Control Act (33 U.S.C. 1267(g)(1)).</text>
						</subparagraph><subparagraph id="HF3069BA11A7C452E8A17AB5B872A2289"><enum>(B)</enum><header>Technical
				assistance</header><text display-inline="yes-display-inline">The Secretary
				shall provide conservation technical assistance—</text>
							<clause id="H8A9508D8E2974F008B8899FC52108067"><enum>(i)</enum><text>to
				educate agricultural and private forest landowners in the Chesapeake Bay
				watershed regarding State and Federal regulatory water quality requirements and
				possible activities they could undertake to come into compliance with the
				regulations; and</text>
							</clause><clause id="H4232381884B14F42B3992575D45397C1"><enum>(ii)</enum><text>to assist such
				landowners in conservation planning that will achieve and maintain regulatory
				compliance.</text>
							</clause></subparagraph><subparagraph id="H4FA9D22C9AC149AEB7D170FAF75266B5"><enum>(C)</enum><header>Memorandum of
				understanding</header><text display-inline="yes-display-inline">The Secretary
				may enter into a memorandum of understanding with the Administrator of the
				Environmental Protection Agency and with the Chesapeake Bay States to
				coordinate conservation planning for agricultural and non-industrial private
				forest lands to meet applicable State water quality requirements.</text>
						</subparagraph></paragraph><paragraph id="H975C329D03294802B8DC9E86198B8CDA"><enum>(3)</enum><header>Effect of
				assurance standards</header><text display-inline="yes-display-inline">Agricultural and private forest landowners
				who develop and implement a conservation plan in accordance with this
				subsection shall be deemed to be in full compliance with applicable Federal and
				State water quality requirements under section 303(d) of the Federal Water
				Pollution Control Act (33 U.S.C. 1313(d)).</text>
					</paragraph><paragraph id="H5F7F45777DC8496DB0FDFBB9547A0967"><enum>(4)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this subsection:</text>
						<subparagraph id="HCFD498EA71424EDFA73DD2CF4D7A6F8A"><enum>(A)</enum><header>Chesapeake Bay
				State</header><text display-inline="yes-display-inline">The term
				<quote>Chesapeake Bay State</quote> means Delaware, Maryland, New York,
				Pennsylvania, Virginia, West Virginia, and the District of Columbia.</text>
						</subparagraph><subparagraph id="H720A5277AD984630A367DAAA35A7E553"><enum>(B)</enum><header>Conservation
				planning</header><text display-inline="yes-display-inline">The term
				<quote>conservation planning</quote> has the same meaning as established for
				such term in the Natural Resources Conservation Service field office technical
				guide, comprehensive nutrient management plans, and nutrient management
				plans.</text>
						</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H9EDE78E9C9FB4AA49487622506A62274"><enum>5.</enum><header>Technical
			 guidelines for environmental services markets</header>
			<subsection id="HD1E5E3283E564FA2BA2E9F871CDBF082"><enum>(a)</enum><header>Types of
			 guidelines required</header>

				verify and ensure compliance of the environmental service

				</paragraph><paragraph id="H11DB21608D1A4F4EB70B3707E2FB1BC0"><enum>(2)</enum><header>Conforming
			 amendments</header><text display-inline="yes-display-inline">Section 1245(c)(1)
			 of the Food Security Act of 1985 (16 U.S.C. 3845(c)(1)) is amended—</text>
					<subparagraph id="HB98BF0CCF319434E840D2EDAFE60BD3C"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>paragraph (2)</quote>
			 and inserting <quote>paragraph (5)</quote>; and</text>
					</subparagraph><subparagraph id="HFA26F4B0B5C849B9A2C72735552ACBC5"><enum>(B)</enum><text>by striking
			 <quote>paragraph (3)</quote> and inserting <quote>paragraph (6)</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="H5EC2502A7D534E40B106645EA7B9069F"><enum>(b)</enum><header>Additional
			 requirements</header><text>Section 1245 of the Food Security Act of 1985 (16
			 U.S.C. 3845) is amended by adding at the end the following new
			 subsections:</text>
				<quoted-block display-inline="no-display-inline" id="H16C47903E7714C54B5E9C969E069E1CC" style="OLC">
					<subsection id="HF94D27A8DA3B45D0A31DC81A442FB565"><enum>(f)</enum><header>List of eligible
				activities</header>
						<paragraph id="H13BC353C031B4A6AB4DBF6305F4CDF00"><enum>(1)</enum><header>List
				required</header><text display-inline="yes-display-inline">The Secretary shall
				publish a list of eligible domestic agricultural and forestry activities that
				result in environmental service benefits.</text>
						</paragraph><paragraph id="H085E50F20312406E9894616C94557A37"><enum>(2)</enum><header>Deadline;
				publication</header><text>Not later than 14 months after the date of the
				enactment of the <short-title>Chesapeake Bay Program
				Reauthorization and Improvement Act</short-title>, the Secretary shall publish
				in the Federal Register the list of domestic agricultural and forestry
				activities that are eligible for the guidelines established under subsection
				(a).</text>
						</paragraph><paragraph id="HC1260219FEC443CB90C8DB1E7C2A9CC5"><enum>(3)</enum><header>Recommendations</header><text>In
				preparing the list under this subsection, the Secretary shall take into
				consideration the recommendations of the entities referred to in subsection
				(e).</text>
						</paragraph><paragraph id="HECFCCA3279614E08BDC93A57872424B4"><enum>(4)</enum><header>Additions and
				revisions</header><text display-inline="yes-display-inline">Not later than four
				years after the date of the enactment of the <short-title>Chesapeake Bay Program Reauthorization and Improvement
				Act</short-title>, and every two years thereafter, the Secretary shall add to
				and revise the list prepared under this subsection. The additions and revisions
				shall be made only after the Secretary provides an opportunity for public
				notice of and an opportunity for comment on the proposed additions and
				revisions.</text>
						</paragraph></subsection><subsection id="HCAA2F325807842B8800779F853F1F5F9"><enum>(g)</enum><header>Guidelines for
				provision of technical assistance</header>
						<paragraph id="H872F15DE500C428191EC9E783017ECE1"><enum>(1)</enum><header>Verification
				guidelines</header><text>As part of the regulations promulgated under this
				title, the Secretary shall establish guidelines for the provision of technical
				assistance to ensure—</text>
							<subparagraph id="HAC260AE928824AC985D70E6D7A27AF3B"><enum>(A)</enum><text>that environmental
				service benefits have been implemented properly; and</text>
							</subparagraph><subparagraph id="HCEAD01E563FE4A25A6046FF6BAB8A1DD"><enum>(B)</enum><text>the quantification
				of the benefits have resulted in an environmental benefit.</text>
							</subparagraph></paragraph><paragraph id="HC36486FAEBAD4E5397BA5D95D119E1EC"><enum>(2)</enum><header>Technical
				Assistance Provider Accreditation</header><text>As part of the regulations
				promulgated under this title, the Secretary shall establish a process and
				requirements for periodic accreditation of certified technical assistance
				providers for environmental service benefits to ensure that those technical
				service providers are professionally qualified and have no conflicts of
				interest. Each technical service provider meeting the requirements for
				accreditation in accordance with this paragraph shall be listed in a publicly
				accessible database, which shall be maintained and updated by the
				Secretary.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="H4DDF5D34B6064715B3E02F4D3F3EB58F"><enum>6.</enum><header>Chesapeake Bay
			 watershed pilot program for creating environmental service
			 markets</header><text display-inline="no-display-inline">Section 1240Q of the
			 Food Security Act of 1985 (16 U.S.C. 3839bb–4) is amended by inserting after
			 subsection (i), as added by section 102, the following new subsection:</text>
			<quoted-block display-inline="no-display-inline" id="H274B70C9B4104F839D704E248C767A7C" style="OLC">
				<subsection id="H25634E4B24FE47D49465979FD76E8905"><enum>(j)</enum><header>Pilot program
				for creating environmental service markets</header>
					<paragraph id="H6F3B89DF0FED4C499320204B8E9DC792"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary shall establish a pilot
				program for the Chesapeake Bay watershed for the facilitation of creating
				environmental service markets based on the guidelines outlined in section 1245
				as long as those environmental service benefits do not result in taking
				eligible land wholly out of agricultural production. The Secretary shall ensure
				that the pilot program is consistent with the policies, protocols, and
				regulations established under existing environmental service markets in the
				Chesapeake Bay watershed.</text>
					</paragraph><paragraph id="HDB94CC9A521F49138E244EBB0CACC07D"><enum>(2)</enum><header>Transmission of
				data to Chesapeake Bay Nutrient and Sediment Trading Commission</header><text display-inline="yes-display-inline">The Secretary shall transmit to the
				Chesapeake Bay Nutrient and Sediment Trading Commission such data acquired by
				the Secretary as may be necessary to the effective administration of nutrient
				and sediment trading programs administered by the Commission under section 117A
				of the Federal Water Pollution Control
				Act.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
