		<official-title display="yes">To revise laws regarding liability in
		  certain civil actions arising from maritime incidents, and for other
		  purposes.</official-title>

		<section id="H221BC8F1F53F438B8317B651212BC0DB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Securing Protections for the Injured
			 from Limitations on Liability Act</short-title></quote>.</text>
		</section><section id="H9EECFD1AD8644442BE6C66A7AACA8060" section-type="subsequent-section"><enum>2.</enum><header>Improvements to
			 recovery under Death on the High Seas Act</header><text display-inline="no-display-inline">The Death on the High Seas Act
			 (<external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/303">chapter 303</external-xref> of title 46,
			 United States Code), is amended—</text>
			<paragraph id="HAEA1C35CB82047B9A74D3381F9B99694"><enum>(1)</enum><text>in section
			 30302—</text>
				<subparagraph id="H9275D0B040454AE89A8099187DFA09C9"><enum>(A)</enum><text display-inline="yes-display-inline">by inserting <quote>or law</quote> after
			 <quote>admiralty</quote>; and</text>
				</subparagraph><subparagraph id="HBBE9A6C7765742839E67EB1C28387915"><enum>(B)</enum><text>by inserting
			 before <quote>spouse</quote> the following: <quote>survivors,
			 including</quote>;</text>
				</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H1C4AB566227142B08EC2F7565C1ED473"><enum>(2)</enum><text>in section
			 30303—</text>
				<subparagraph id="H5B845E0967A74112A99380A009CFE437"><enum>(A)</enum><text>by inserting
			 <quote>and nonpecuniary loss</quote> after <quote>pecuniary
			 loss</quote>;</text>
				</subparagraph><subparagraph id="H71C73C685F2741D7B6063837FB60165A"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>by</quote> and all that
			 follows through the end, and inserting <quote>, plus a fair compensation for
			 the decedent’s pain and suffering.</quote>; and</text>
				</subparagraph><subparagraph id="H4437CE0D4F374AEF8FA7B97EF8AA1D1A"><enum>(C)</enum><text>by adding at the
			 end the following: <quote>In this section, the term <term>nonpecuniary
			 loss</term> means loss of care, comfort, and companionship.</quote>;</text>
				</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H566205BCF3F94450AE225D33D3BC771E"><enum>(3)</enum><text display-inline="yes-display-inline">in section 30305 by inserting <quote>or
			 law</quote> after <quote>admiralty</quote>;</text>
			</paragraph><paragraph id="H19573CB74E1F4D319AF520D7061A2C44"><enum>(4)</enum><text>in section 30306,
			 by inserting <quote>or law</quote> after <quote>admiralty</quote>;</text>
			</paragraph><paragraph id="H0B183D65E4F545419F219BD1FC78DA65"><enum>(5)</enum><text>by striking
			 section 30307; and</text>
			</paragraph><paragraph id="H55731FFF8ADC421B9CBE9AD198822B33"><enum>(6)</enum><text>in the table of
			 sections at the beginning of such chapter, by striking the item relating to
			 sections 30307.</text>
			</paragraph></section><section id="H9340DCF6E76345DBAA1FB044BC1036DC"><enum>3.</enum><header>Improvements to
			 recovery under Jones Act</header><text display-inline="no-display-inline">Title
			 46, United States Code, is amended—</text>
			<paragraph id="H4BC49FC070D94AEC81F499CC8EB20CDB"><enum>(1)</enum><text>in section 30104,
			 by adding at the end the following: <quote>In addition to other amounts
			 authorized under such laws, the recovery for a seaman who so dies shall include
			 recovery for loss of care, comfort, and companionship.</quote>; and</text>
			</paragraph><paragraph id="HF2130DA909CB466EA07628D32AA63BA4"><enum>(2)</enum><text display-inline="yes-display-inline">by striking section 30105 and the item
			 relating to that section in the table of sections at the beginning of chapter
			 301.</text>
			</paragraph></section><section id="HA77BEED09C844471A37C6618DD61A5A6"><enum>4.</enum><header>Repeal of
			 Limitation of Liability Act</header>
			<subsection id="H2869FB86BB474B89B4FC0FDD742CACEA"><enum>(a)</enum><header>Repeal</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/305">Chapter 305</external-xref> of title 46,
			 United States Code, is amended by repealing sections 30505, 30506, 30507,
			 30511, and 30512 and the items relating to those sections in the table of
			 sections at the beginning of chapter 305.</text>
			</subsection><subsection id="H80B848BB78E141CE816650E41656F9B2"><enum>(b)</enum><header>Conforming
			 amendments</header>
				<paragraph id="H437123A225CC43B6AE279E2A568E9F1D"><enum>(1)</enum><header>Oil Pollution
			 Act of 1990</header><text>Section 1018 of the Oil Pollution Act of 1990
			 (<external-xref legal-doc="usc" parsable-cite="usc/33/2718">33 U.S.C.
			 2718</external-xref>) is amended—</text>
					<subparagraph id="HED62D81DB5BA41E9A63F1118C36141F8"><enum>(A)</enum><text>in subsection (a),
			 by striking <quote>or the Act of March 3, 1851</quote>; and</text>
					</subparagraph><subparagraph id="H9DB2B024CC3A497089961F655085C212"><enum>(B)</enum><text>in subsection (c),
			 by striking <quote>, the Act of March 3, 1851 (<external-xref legal-doc="usc" parsable-cite="usc/46/183">46 U.S.C. 183 et
			 seq.</external-xref>),</quote>.</text>
					</subparagraph></paragraph><paragraph id="HD30CA4D5C26F4A0EB576F2886E3F0439"><enum>(2)</enum><header>Title
			 46</header><text><external-xref legal-doc="usc" parsable-cite="usc/46/14305">Section 14305(a)</external-xref> of title 46,
			 United States Code, is amended by striking paragraph (5) and redesignating the
			 subsequent paragraphs as paragraphs (5) through (14), respectively.</text>
				</paragraph></subsection></section><section id="HF074DF9F5E73404080DA5D1DED6C3CA9" section-type="subsequent-section"><enum>5.</enum><header>Bankruptcy protection
			 for tort claims arising from oil incidents</header>
			<subsection id="HFEC6072A7FA147DBBFD2199204458BF2"><enum>(a)</enum><header>Conditions on
			 sale or lease of significant property of the estate</header>
				<paragraph id="H49D5045B6B0E47E088E3C339B2A45B01"><enum>(1)</enum><header>In
			 general</header><text><external-xref legal-doc="usc" parsable-cite="usc/11/363">Section 363</external-xref> of title 11, United
			 States Code, is amended by adding at the end the following:</text>
					<quoted-block id="H24E963950182432D99E7544FBED9AC63" style="OLC">
						<subsection id="HEB820F8DD89F4999A9C28EDBABF76989"><enum>(q)</enum><text display-inline="yes-display-inline">Notwithstanding any other provision of this
				section, if the debtor is liable under any law for a claim for wrongful death,
				personal injury, or property damage arising from an incident (as defined in
				section 1001 of the Oil Pollution Act of 1990, and that gives rise to liability
				under such Act), the trustee may not sell or lease, other than in the ordinary
				course of business, significant property of the estate (or, to the extent that
				the court has jurisdiction over any affiliate of the debtor, significant
				property of such affiliate) unless—</text>
							<paragraph id="H1031A0E913384403AF58E445705A8871"><enum>(1)</enum><text display-inline="yes-display-inline">creditors holding at least two-thirds in
				amount, and more than one-half in number, of all such claims not paid by the
				debtor consent to such sale or lease; or</text>
							</paragraph><paragraph id="H91C96A7CFB1B41DA9AAC173DECE86B9F"><enum>(2)</enum><text>the court finds,
				after notice and a hearing, that—</text>
								<subparagraph id="H2C1E38BC3F8A4BF3ABAC5948F496FD12"><enum>(A)</enum><text>sufficient
				property will remain in the estate; or</text>
								</subparagraph><subparagraph id="H57EF3BC1B2A74022A78E5E33F577578A"><enum>(B)</enum><text>the debtor’s
				anticipated future income will be sufficient;</text>
								</subparagraph><continuation-text continuation-text-level="paragraph">that all
				such claims will be paid in
				full.</continuation-text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph display-inline="no-display-inline" id="HA437B776CBE24EE1BDCC9629CD5B6446"><enum>(2)</enum><header> Under plan of
			 reorganization</header><text><external-xref legal-doc="usc" parsable-cite="usc/11/1129">Section 1129(b)(2)(B)(ii)</external-xref> of title
			 11, United States Code, is amended—</text>
					<subparagraph id="HDD9292C8735A4C8BA0EFBE9290CCA389"><enum>(A)</enum><text display-inline="yes-display-inline">by inserting <quote>(other than the holder
			 of a claim described in subclause (II))</quote> after <quote>claim</quote> the
			 1st place it appears;</text>
					</subparagraph><subparagraph id="H8083984EEF174B9D8F767E338F1F4F29"><enum>(B)</enum><text>by inserting
			 <quote>(I)</quote> after <quote>(ii)</quote>;</text>
					</subparagraph><subparagraph id="H949DB1F281924F988D8F1C215DDA02B4"><enum>(C)</enum><text>by striking the
			 period at the end and inserting <quote>; and</quote>; and</text>
					</subparagraph><subparagraph id="H9EB33E1A359B490E8D18016E378DD71F"><enum>(D)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block id="H12C1A6BFD66A40368339CC46DB5150DB" style="OLC">
							<subclause id="H8E20ECA44E564842B52569DD3D02B7D8" indent="up2"><enum>(II)</enum><text display-inline="yes-display-inline">if the plan provides for claims of the kind
				described in section 363(q) and provides for a sale or lease of significant
				property of the estate, creditors holding at least two-thirds in amount, and
				more than one-half in number, of such claims consent to such sale or
				lease.</text>
							</subclause><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection id="H4FB3995950794561888F2318F9D93EE4"><enum>(b)</enum><header>Conforming
			 amendment</header><text><external-xref legal-doc="usc" parsable-cite="usc/11/303">Section 303(f)</external-xref> of title 11, United
			 States Code, is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H18B831CBFFB84057B72F52628C459E6C" style="OLC">
					<quoted-block-continuation-text quoted-block-continuation-text-level="subsection">If the
				debtor is liable under any law for a claim for wrongful death, personal injury,
				or property damage arising from an incident (as defined in section 1001 of the
				Oil Pollution Act of 1990, and that gives rise to liability under such Act),
				the debtor may not sell or lease, other than in the ordinary course of
				business, significant property of the estate (or, to the extent that the court
				has or can obtain jurisdiction over any affiliate of the debtor, significant
				property of such affiliate) unless—</quoted-block-continuation-text><paragraph id="HC1CB672DC332496CA721F45624DD8105"><enum>(1)</enum><text display-inline="yes-display-inline">creditors holding at least two-thirds in
				amount, and more than one-half in number, of all such claims not paid by the
				debtor consent to such sale or lease; or</text>
					</paragraph><paragraph id="HA062D13C04174326923A0D82CFD5F19D"><enum>(2)</enum><text>the court finds,
				after notice and a hearing, that—</text>
						<subparagraph id="H7AFF0693BD504A49A1CA00F25C215B60"><enum>(A)</enum><text>sufficient
				property will remain in the estate; or</text>
						</subparagraph><subparagraph id="HE48FA54D90F34E9DBA854CC7DB4DD9FF"><enum>(B)</enum><text>the debtor’s
				anticipated future income will be sufficient;</text>
						</subparagraph><continuation-text continuation-text-level="paragraph">that all
				such claims will be paid in
				full.</continuation-text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="HFF777CB701CE4537AACFF8E7C86BC96A"><enum>6.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">This Act and the
			 amendments made by this Act shall take effect on the date of enactment of this
			 Act and shall apply with respect to claims arising on or after April 20, 2010,
			 that are pending on or after such date of enactment.</text>
