		<official-title display="yes">To amend the effective date of the gift
		  card provisions of the Credit Card Accountability Responsibility and Disclosure
		  Act of 2009.</official-title>

		<section id="HBC1EB1FD61034DA8869697B924BC71D8" section-type="section-one"><enum>1.</enum><header>Delay of effective
			 date</header><text display-inline="no-display-inline">Title IV of the Credit
			 Card Accountability Responsibility and Disclosure Act, is amended by striking
			 section 403 and inserting the following:</text>

				<section id="HFFB942648CDC4C038A5F665E87ED6FEF"><enum>403.</enum><header>Effective
				date</header>
					<subsection id="HB38DA47904344C87AD018B75880C575D"><enum>(a)</enum><header>In
				General</header><text display-inline="yes-display-inline">Except as provided
				under subsection (b) of this section, this title and the amendments made by
				this title shall become effective 15 months after the date of enactment of this
				Act.</text>
					</subsection><subsection id="H270290B6B2CD444D8308F7545B85D16E"><enum>(b)</enum><header>Exception</header>
						<paragraph id="H277AFE5D610941A2A8F82A51081343A2"><enum>(1)</enum><header>In
				general</header><text>In the case of a gift certificate, store gift card, or
				general-use prepaid card that was produced prior to April 1, 2010, the
				effective date of the disclosure requirements described in sections 915(b)(3)
				and (c)(2)(B) of the Electronic Funds Transfer Act shall be January 31, 2011,
				provided that an issuer of such a certificate or card shall—</text>
							<subparagraph id="HF5A96135B0B84FA8B709E8A80F6AFD92"><enum>(A)</enum><text>comply with
				paragraphs (1) and (2) of section 915(b) of such Act;</text>
							</subparagraph><subparagraph id="HE5EF077821784F1CB6D6B87E597DFE10"><enum>(B)</enum><text>consider any such
				certificate or card for which funds expire to have no expiration date with
				respect to the underlying funds;</text>
							</subparagraph><subparagraph id="H206E2D653E4049939FE30F071BFEF2D5"><enum>(C)</enum><text>at a consumer’s
				request, replace such certificate or card that has funds remaining at no cost
				to the consumer; and</text>
							</subparagraph><subparagraph id="H6F212D3DE10E4768BA6C0535ABB5A33B"><enum>(D)</enum><text>comply with the
				disclosure requirements of paragraph (2) of this subsection.</text>
							</subparagraph></paragraph><paragraph id="H8787961B9BE645509F8589E911475457"><enum>(2)</enum><header>Disclosure
				requirements</header><text>The disclosure requirements of this subsection are
				met by providing notice to consumers, via in-store signage, messages during
				customer service calls, Web sites, and general advertising, that—</text>
							<subparagraph id="HF927DC983A7A49FCA70A94A95BEF17FB"><enum>(A)</enum><text>any such
				certificate or card for which funds expire shall be deemed to have no
				expiration date with respect to the underlying funds;</text>
							</subparagraph><subparagraph id="HA6DF93920399472C95E09F38F1229C28"><enum>(B)</enum><text>consumers holding
				such certificate or card shall have a right to a free replacement certificate
				or card that includes the packaging and materials, typically associated with
				such a certificate or card; and</text>
							</subparagraph><subparagraph id="H3290DD060622464F9D476FFBCA5F02C7"><enum>(C)</enum><text>any dormancy fee,
				inactivity fee, or service fee for such certificates or cards that might
				otherwise be charged shall not be charged if such fees do not comply with
				section 915 of the Electronic Funds Transfer Act.</text>
							</subparagraph></paragraph><paragraph id="H959A5EFEE3D9474D9A886472193FA017"><enum>(3)</enum><header>Period for
				disclosure requirements</header><text>The notice requirements in paragraph (2)
				of this subsection shall continue until January 31,
				2013.</text>
