<section id="H4EF0B00390934B14916637A691D23B0C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Coal Accountability and Retired Employee Act of 2010</short-title></quote> or the <quote><short-title>CARE Act</short-title></quote> .</text> </section>
<section id="H0D975B4CA7D54F6183CCA5718BCE4DCC" section-type="subsequent-section"><enum>2.</enum><header>Amendment of Surface Mining Control and Reclamation Act of 1977</header><text display-inline="no-display-inline">Section 402(i)(2) of the Surface Mining Control and Reclamation Act of 1977 (30 U.S.C. 1232(i)(2)) is amended—</text> 
<paragraph id="H6491CDD664BA41F4B9171551E820BA02"><enum>(1)</enum><text>by striking <quote>Subject to</quote> and inserting the following:</text> 
<quoted-block display-inline="no-display-inline" id="HB581C9FB4E964D24B8B290EAFA7DA340" style="traditional"> 
<subparagraph id="HBED0B4FB49DB4B81B8BD39D91C2F78C8"><enum>(A)</enum><header>In general</header><text>Subject to</text> </subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block> </paragraph>
<paragraph id="H79059BCD03424822988F0A0292C90432"><enum>(2)</enum><text>by adding at the end the following new subparagraph:</text>

<subparagraph id="HB89DCACF78394D05B508BF16D01140BA"><enum>(B)</enum><header>Excess amounts</header> 
<clause id="H00C63CFA4B4648F3AF27A8B130A7C016"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to paragraph (3), and after all transfers referred to in paragraph (1) and subparagraph (A) of this paragraph have been made, any amounts remaining after the application of paragraph (3)(A) (without regard to this subparagraph) shall be transferred to the trustees of the 1974 UMWA Pension Plan and used solely to pay pension benefits required under such plan.</text> </clause>
<clause id="HC82D5544D11B4F3B9855F17349170221"><enum>(ii)</enum><header>1974 UMWA Pension Plan</header><text display-inline="yes-display-inline">In this subparagraph the term <quote>1974 UMWA Pension Plan</quote> means a pension plan referred to in section 9701(a)(3) of the Internal Revenue Code of 1986 but without regard to whether participation in such plan is limited to individuals who retired in 1976 and thereafter.</text> </clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></section>
