		<official-title>To amend the Internal Revenue Code of 1986 to treat
		  certain solar energy credits as refundable credits, to allow a new refundable
		  credit for equipment used to manufacture solar energy property, to waive the
		  application of the subsidized financing rules to such property, and for other
		  purposes.</official-title>

		<section id="H92244793069F4DBCA0903994D5CCB83F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Solar Stimulus for Job Creation and
			 Energy Independence Act of 2009</short-title></quote>.</text>
		</section><section id="H7BF2DCDB5FE54441B1EE57780066A98C"><enum>2.</enum><header>Temporary
			 refundability of solar energy credit</header>
			<subsection id="H06FFBFBEF34445969768B9F31B50DDBC"><enum>(a)</enum><header>Residential
			 solar energy credit</header><text display-inline="yes-display-inline">Subsection (c) of section 25D of the
			 Internal Revenue Code of 1986 (relating to limitation based on amount of tax;
			 carryforward of unused credit) is amended by adding at the end the following
			 new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="H354C50AE6488400EB51588954E906435" style="OLC">
					<paragraph id="H0CF4DA3519894BF1BCB64288249343F4"><enum>(3)</enum><header>Temporary
				refundability of solar energy credit</header>
						<subparagraph id="HC454D86837FC4BEE898530010504D25B"><enum>(A)</enum><header>In
				general</header><text>The aggregate credits allowed to the taxpayer under
				subpart C shall be increased by the credit which would be determined under
				paragraphs (1) and (2) of subsection (a) for expenditures made during the
				taxable year without regard to section 26(a)(2) or paragraphs (1) of this
				subsection, as the case may be. Credits allowed under subpart C by reason of
				the preceding sentence shall not be taken into account in determining the
				excess described in paragraph (2).</text>
						</subparagraph><subparagraph display-inline="no-display-inline" id="HECC3241404984B92A11732A8CD60722B"><enum>(B)</enum><header>Termination</header><text>Subparagraph
				(A) shall not apply to any taxable year ending after December 31,
				2010.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H9110D5B2F0A840DBA43860B9896E009E"><enum>(b)</enum><header>Business solar
			 energy credit</header>
				<paragraph id="H114AD7D0FF28465AB48EEE1D20721FB4"><enum>(1)</enum><header>In
			 general</header><text>Subsection (c) of section 38 of such Code (relating to
			 limitation based on amount of tax) is amended by redesignating paragraph (5) as
			 paragraph (6) and by inserting after paragraph (4) the following new
			 paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="H02657772EAF34AD5A398693C89134CEA" style="OLC">
						<paragraph id="H0275D7E5796447089FB9FCD7F3F2001F"><enum>(5)</enum><header>Special rules
				for solar energy credits</header>
							<subparagraph id="H9EDC6F2084B5447F94B0386EB3B4B1B4"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">In the case of the
				solar energy credits—</text>
								<clause id="H6EF4B74EDEE74EFFA293A4805B54555D"><enum>(i)</enum><text>this section and
				section 39 shall be applied separately with respect to such credits,</text>
								</clause><clause id="H8B7AC78F82D5414FB34567F0F59D800"><enum>(ii)</enum><text>in
				applying paragraph (1) to such credits—</text>
									<subclause id="H78794F4FF67E40F396A2F0FC938FC77B"><enum>(I)</enum><text>the tentative
				minimum tax shall be treated as being zero, and</text>
									</subclause><subclause id="H1E11723AF9A146659206B803DDD8227"><enum>(II)</enum><text>the limitation
				under paragraph (1) (as modified by subclause (I)) shall be reduced by the
				credit allowed under subsection (a) for the taxable year (other than the solar
				energy credits), and</text>
									</subclause></clause><clause id="H4CB3FFF38AA242FAAEC3CBE06C4DEB12"><enum>(iii)</enum><text>the amount of
				the solar energy credits in excess of the limitation under paragraph (1) (as
				modified by subclause (II)) shall be treated as a credit under subpart
				C.</text>
								</clause></subparagraph><subparagraph id="HB42CC8B192704CD7A28F7778FAC1E500"><enum>(B)</enum><header>Solar energy
				credits</header><text>For purposes of this subsection, the term <term>solar
				energy credits</term> means so much of the energy credit as is attributable to
				property described in clause (i) or (ii) of section 48(a)(3)(A).</text>
							</subparagraph><subparagraph id="HF37A7DAC34454A8CA0F29404CB667DD4"><enum>(C)</enum><header>Termination</header><text>This
				paragraph shall not apply to any taxable year ending after December 31,
				2010.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H7C2CD56BDC1447749122721DCD91BB36"><enum>(2)</enum><header>Conforming
			 amendments</header>
					<subparagraph id="H00C547FCA5034F2CB0D1BDF27F5B829F"><enum>(A)</enum><text display-inline="yes-display-inline">Subclause (II) of section 38(c)(2)(A)(ii)
			 of such Code is amended by striking <quote>and the specified credits</quote>
			 and inserting <quote>the specified credits, and the solar energy
			 credits</quote>.</text>
					</subparagraph><subparagraph id="H99518B50A35743C48199533E492CC5A2"><enum>(B)</enum><text>Subclause (II) of
			 section 38(c)(3)(A)(ii) of such Code is amended by striking <quote>and the
			 specified credits</quote> and inserting <quote>, the specified credits, and the
			 solar energy credits</quote>.</text>
					</subparagraph><subparagraph id="HE4B39AD092E344F900DD6C8FBDECA292"><enum>(C)</enum><text>Subclause (II) of
			 section 38(c)(4)(A)(ii) of such Code is amended by inserting <quote>and the
			 solar energy credits</quote> after <quote>specified credits</quote>.</text>
					</subparagraph><subparagraph id="HC22B61ADE38847EF9E489D97CA876F87"><enum>(D)</enum><text>Paragraph (2) of
			 section 1324(b) of title 31, United States Code, is amended—</text>
						<clause id="HE69F3290C82C4C4DA061008FD8B5F37E"><enum>(i)</enum><text>by
			 inserting <quote>25D(c)(3),</quote> before <quote>35,</quote> and</text>
						</clause><clause id="H9A223FA3479B49DA898FD1B7B19FF124"><enum>(ii)</enum><text>by
			 inserting <quote>38(c)(5),</quote> after <quote>36,</quote> .</text>
						</clause></subparagraph></paragraph></subsection><subsection id="HC241409EF3ED48A5B8FC56E5B38991E4"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to taxable
			 years beginning after the date of the enactment of this Act.</text>
			</subsection></section><section id="H5856F9B817D94C3B9E816D4F4C76C82C"><enum>3.</enum><header>Temporary
			 refundability of depreciation deduction for solar energy property</header>
			<subsection id="H280AD375CE574726A858026E55033DC0"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subparagraph (A) of
			 section 48(a)(2) of the Internal Revenue Code of 1986 (relating to energy
			 credit) is amended by striking <quote>and</quote> at the end of clause (i), by
			 redesignating clause (ii) as clause (iii), and by inserting after clause (i)
			 the following new clause:</text>
				<quoted-block display-inline="no-display-inline" id="H9A553C17A11945558BF3D6D21B1B8566" style="OLC">
					<clause id="HE06F5AD348D74E2BB9D3E26E86DB5D88"><enum>(ii)</enum><text display-inline="yes-display-inline">at the election of the taxpayer for any
				taxable year ending before January 1, 2011, 33<fraction>1/3</fraction> percent
				of the aggregate deductions which would (but for subparagraph (C)) be allowed
				for the taxable year for property described in clause (i) or (ii) of paragraph
				(3)(A),
				and</text>
					</clause><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HBE704FBD16974E2500EC69C509B46125"><enum>(b)</enum><header>Denial of
			 depreciation where credit elected</header><text>Paragraph (2) of section 48(a)
			 of such Code is amended by adding at the end the following new
			 subparagraph:</text>
				<quoted-block display-inline="no-display-inline" id="HF2EA6A7E28504987A650B25F8124033E" style="OLC">
					<subparagraph id="HA5E9E1A6515F419D8FEF50FF9C68CB00"><enum>(C)</enum><header>Denial of
				depreciation, etc., where credit elected</header><text display-inline="yes-display-inline">No deduction for depreciation (or
				amortization in lieu of depreciation) shall be allowed for the taxable year
				with respect to property described in clause (i) or (ii) of paragraph (3)(A) if
				the taxpayer makes the election under subparagraph (A)(ii) with respect to such
				property. Notwithstanding the preceding sentence, deductions not allowed by the
				preceding sentence shall be treated as allowed for purposes of applying section
				1016.</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HB10484A0A55D4191AD66D285384957A3"><enum>(c)</enum><header>Conforming
			 amendment</header><text>Clause (iii) of section 48(a)(2) of such Code is
			 amended by striking <quote>clause (i) does not apply</quote> and inserting
			 <quote>neither clause (i) nor (ii) apply</quote>.</text>
			</subsection><subsection id="H6ED8F6E452A547E496FA3876FB5918F1"><enum>(d)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to taxable
			 years beginning after the date of the enactment of this Act.</text>
			</subsection></section><section id="HCC767620D4B7463BB35E76EDAF741B94"><enum>4.</enum><header>Exception from
			 private activity bond tests for financing of solar energy property</header>
			<subsection id="H886EC00886F44EEEBD75663B780089D7"><enum>(a)</enum><header>Exception from
			 private business use test</header><text>Paragraph (6) of section 141(b) of the
			 Internal Revenue Code of 1986 is amended by adding at the end the following new
			 subparagraph:</text>
				<quoted-block display-inline="no-display-inline" id="HEB4D4CB15CB044C1BED9FDA4D9F306D" style="OLC">
					<subparagraph id="H47BC944564474C3C80562120829C9013"><enum>(C)</enum><header>Solar energy
				property</header><text display-inline="yes-display-inline">For purposes of
				subparagraph (A), property described in clause (i) or (ii) of section
				48(a)(3)(A) shall not be treated as used in a trade or business.</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H3A1EF78E61A04BB685F72F9B48006BAC"><enum>(b)</enum><header>Exception from
			 private loan financing test</header><text display-inline="yes-display-inline">Paragraph (2) of section 141(c) of such
			 Code (relating to exception for tax assessment, etc., loans) is amended by
			 striking <quote>or</quote> at the end of subparagraph (B), by striking the
			 period at the end of subparagraph (C) and inserting <quote>, or</quote>, and by
			 adding at the end the following new subparagraph:</text>
				<quoted-block display-inline="no-display-inline" id="HA66FCDB81E794E8CADB6189FE1CE677F" style="OLC">
					<subparagraph id="H682CF9A58CE046D582472E17F01C397F"><enum>(D)</enum><text display-inline="yes-display-inline">enables the borrower to finance the
				acquisition, construction, and installation of property described in clause (i)
				or (ii) of section
				48(a)(3)(A).</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H660017012E354357BF6918823187D64"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to
			 obligations issued after the date of the enactment of this Act.</text>
			</subsection></section><section id="H445492578AEF4425A643547B6FD4864D"><enum>5.</enum><header>Exception from
			 subsidized energy financing rules for solar energy property</header>
			<subsection id="H2F46B7995CD24B40BF1800A286DD00D2"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subparagraph (C) of
			 section 48(a)(4) of the Internal Revenue Code of 1986 (defining subsidized
			 energy financing) is amended by adding at the end the following new sentence:
			 <quote>Such term shall not include any loan described in section
			 141(c)(2)(D).</quote></text>
			</subsection><subsection id="H491F6F93AB4B45F4B574A5D0BA7D4414"><enum>(b)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendment made by
			 subsection (a) shall apply to property placed in service after such date in
			 taxable years ending after such date.</text>
			</subsection></section><section id="HDFD2BB2DA8F74250B27D2085BBF149B5"><enum>6.</enum><header>Refundable
			 investment credit for property used to manufacture solar energy
			 property</header>
			<subsection id="HF5C83C234C744F70857BB3A87D004E05"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subparagraph (A) of
			 section 48(a)(3) of the Internal Revenue Code of 1986 (defining energy
			 property) is amended by striking <quote>or</quote> at the end of clause (vi),
			 by adding <quote>or</quote> at the end of clause (vii), and by inserting after
			 clause (vii) the following new clause:</text>
				<quoted-block display-inline="no-display-inline" id="HD724258730FF422DAE97E800C8DE09CC" style="OLC">
					<clause id="HCD314474A4AA4300A3A21BEF39BBB326"><enum>(viii)</enum><text display-inline="yes-display-inline">property used to manufacture equipment
				described in clause (i) or
				(ii),</text>
					</clause><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H45116883260A42EBA68840B7D1F04055"><enum>(b)</enum><header>Credit To be
			 refundable</header><text>Section 38(c)(5)(B) of such Code, as added by this
			 Act, is amended by striking <quote>or (ii)</quote> and inserting <quote>, (ii),
			 or (viii)</quote>.</text>
			</subsection><subsection id="H725ED3FED93A4E789CC9D75901006376"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to taxable
			 years beginning after the date of the enactment of this Act.</text>
			</subsection></section><section id="H4D1FFF6964074CFFBD97297FA089DCAF"><enum>7.</enum><header>Government
			 procurement of solar energy</header><text display-inline="no-display-inline">Section 203 of the Energy Policy Act of 2005
			 (42 U.S.C. 15852) is amended—</text>
			<paragraph id="H48A19A8406E24E8CB2E4EB166305C635"><enum>(1)</enum><text>by redesignating
			 subsection (d) as subsection (e); and</text>
			</paragraph><paragraph id="HD7856155150C424392FF4D869B2E7BA4"><enum>(2)</enum><text>by inserting after
			 subsection (c) the following new subsection (d):</text>
				<quoted-block display-inline="no-display-inline" id="H7DAE042EAF9041AF800777FCE25CD9C9" style="OLC">
					<subsection id="H0C011DBFD9584CD2BF4DBE87D00846C"><enum>(d)</enum><header>Contracts for
				renewable energy</header><text>Notwithstanding section 501(b)(1)(B) of title
				40, United States Code, a contract for renewable energy may be made for a
				period of not more than 25
				years.</text>
