		<official-title display="yes">To amend title III of the Public Health
		  Service Act to authorize the Secretary of Health and Human Services to
		  establish and implement a birth defects prevention, risk reduction, and public
		  awareness program.</official-title>

		<section id="HB4F82B0C80B349A49AD3C0DFC7E8CDB3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Birth Defects Prevention, Risk
			 Reduction, and Awareness Act of 2010</short-title></quote>.</text>
		</section><section id="H98C91617210A40B6913C64BDFA21726D"><enum>2.</enum><header>Birth defects
			 prevention, risk reduction, and awareness</header>
			<subsection id="H2F10DDE5E7574CDA88E2C36E5FF8B1B1"><enum>(a)</enum><header>Program</header><text display-inline="yes-display-inline">The Public Health Service Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/201">42 U.S.C. 201 et
			 seq.</external-xref>) is amended by inserting after section 317T
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/247b-22">42 U.S.C.
			 247b–22</external-xref>) the following new section:</text>

					<section id="H6C516A1C3DD84AEBBC0B296159FC8946"><enum>317U.</enum><header>Birth defects
				prevention, risk reduction, and awareness</header>
						<subsection display-inline="no-display-inline" id="H3139F5CBD7DC453DB7A947CF7F948E25"><enum>(a)</enum><header>Grant
				program</header><text>The Secretary shall establish and implement a birth
				defects prevention and public awareness program to award grants to States or
				organizations for the provision of pregnancy and breastfeeding information
				services.</text>
						</subsection><subsection id="H09881D3CF447480B939D25D68B749710"><enum>(b)</enum><header>Preference</header><text>In
				the case of States or organizations that are otherwise equally qualified, the
				Secretary, in awarding a grant under this section, shall give preference
				to—</text>
							<paragraph id="HEF3DFBC6C59140BDADF7657ADEF5B6FF"><enum>(1)</enum><text>States that made
				pregnancy and breastfeeding information services available on January 1, 2006;
				and</text>
							</paragraph><paragraph id="H1E33C336A10B4ABE99E9ED5FF2C0C7FB"><enum>(2)</enum><text>organizations that
				will provide pregnancy and breastfeeding information services in such
				States.</text>
							</paragraph></subsection><subsection id="H9FBABC4C16D7418584F4F982231C03B4"><enum>(c)</enum><header>Matching
				funds</header><text>The Secretary may only award a grant under this section to
				a State or organization that agrees, with respect to the costs to be incurred
				in carrying out the grant activities, to make available (directly or through
				donations from public or private entities) non-Federal funds toward such costs
				in an amount equal to not less than 25 percent of the amount of the
				grant.</text>
						</subsection><subsection id="H1B50952FA94E4A039DC089815E89F984"><enum>(d)</enum><header>Coordination</header><text display-inline="yes-display-inline">The Secretary shall ensure that activities
				carried out using a grant under this section are coordinated, to the maximum
				extent practicable, with other birth defects prevention and environmental
				health activities of the Federal Government, including activities carried out
				by the Health Resources and Services Administration and the Centers for Disease
				Control and Prevention with respect to pediatric environmental health specialty
				units and children’s environmental health centers.</text>
						</subsection><subsection display-inline="no-display-inline" id="HFF557D71569B411FBFE472EB5181E86B"><enum>(e)</enum><header>Evaluation</header><text>In
				furtherance of the program established under subsection (a), the Secretary
				shall provide for an evaluation of pregnancy and breastfeeding information
				services to identify efficient and effective models of—</text>
							<paragraph id="HCE53B260B76E4176988C12E66707BFBE"><enum>(1)</enum><text>providing
				information;</text>
							</paragraph><paragraph id="H29EEE96451F54E4E971C97B0EC5CFAE5"><enum>(2)</enum><text>raising awareness
				and increasing knowledge about birth defects prevention measures;</text>
							</paragraph><paragraph id="H217FEF56E1954FC7A24E1211BA7437E1"><enum>(3)</enum><text>modifying risk
				behaviors; or</text>
							</paragraph><paragraph id="HFDEC812DB3E44790B46210B2AD0BAE4D"><enum>(4)</enum><text>other outcome
				measures as determined appropriate by the Secretary.</text>
							</paragraph></subsection><subsection id="H7C7DCBF39A764244A6873D0F37F0F8EC"><enum>(f)</enum><header>Pregnancy and
				breastfeeding information services defined</header><text>For purposes of this
				section, the term <quote>pregnancy and breastfeeding information
				services</quote> includes only—</text>
							<paragraph id="H6F135F27709442C894D258A08633C7E3"><enum>(1)</enum><text>information
				services to provide accurate, evidence-based, clinical information regarding
				maternal exposures during pregnancy or breastfeeding that may be associated
				with birth defects or other health risks to an infant that is breastfed, such
				as exposures to medications, chemicals, infections, foodborne pathogens,
				illnesses, nutrition, or lifestyle factors;</text>
							</paragraph><paragraph id="HB45C333BF53E4A498956A792396D4E02"><enum>(2)</enum><text>the provision of
				accurate, evidence-based information weighing risks of exposures during
				breastfeeding against the benefits of breastfeeding; and</text>
							</paragraph><paragraph id="HC7A990FD136F4EDDBBB5EE68B47E9AD8"><enum>(3)</enum><text>the provision of
				information described in paragraph (1) or (2) through counselors, Web sites,
				fact sheets, telephonic or electronic communication, community outreach
				efforts, or other appropriate means.</text>
							</paragraph></subsection><subsection id="H048E2E618CB74A7391F89EB9437310DD"><enum>(g)</enum><header>Authorization of
				appropriations</header><text>To carry out this section, there are authorized to
				be appropriated $4,500,000 for fiscal year 2012, $5,500,000 for fiscal year
				2013, $6,500,000 for fiscal year 2014, $7,500,000 for fiscal year 2015, and
				$8,500,000 for fiscal year
				2016.</text>
