		<section id="H0B8BE2F33A854007A35C06C1B40AF9FA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Virtual Screening for Colorectal
			 Cancer Act of 2010</short-title></quote>.</text>
		</section><section id="HB8EA248CCF4D40DF8C307129A2E28EF6"><enum>2.</enum><header>Covering
			 screening computed tomography colonography as a colorectal cancer screening
			 test under Medicare.</header>
			<subsection id="H0031B64D3E13430FBD784E1A64E75EAC"><enum>(a)</enum><header>In
			 General</header><text>Section 1861(pp)(1) of the Social Security Act (42 U.S.C.
			 1395x(pp)(1)) is amended—</text>
				<paragraph id="HA4417DBCC6FF44068B3FABCC1D686749"><enum>(1)</enum><text>by redesignating
			 subparagraph (D) as subparagraph (E); and</text>
				</paragraph><paragraph id="HE44732FDA3F24C5591E66E7D0BF4E52A"><enum>(2)</enum><text>by inserting after
			 subparagraph (C) the following new subparagraph:</text>
					<quoted-block id="HD1F421C133C842CBB1ABACCA902F8883" style="OLC">
						<subparagraph id="H8060520827E3488F81670A23B94EBD76"><enum>(D)</enum><text>Screening computed
				tomography
				colonography.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HE56F9298808144E5B04C1EEB529A8996"><enum>(b)</enum><header>Frequency Limits
			 and Payment</header><text>Section 1834(d) of such Act (42 U.S.C. 1395m(d)) is
			 amended by adding at the end the following new paragraph:</text>
				<quoted-block id="H9DBEC9A2EFBC497B8968906D2D80568A" style="OLC">
					<paragraph id="H8FCE38C2C05A4B0AA4C8ED57DC92CBEB"><enum>(4)</enum><header>Screening
				computed tomography colonography</header>
						<subparagraph id="H979057023085493A86FFE6E3238C366A"><enum>(A)</enum><header>Fee
				schedule</header><text>With respect to a colorectal cancer screening test
				consisting of screening computed tomography colonography, subject to
				subparagraph (B), payment under section 1848 shall be consistent with payment
				under such section for similar or related services.</text>
						</subparagraph><subparagraph id="HCCFF5257259F41AE8A73D4691D6D2791"><enum>(B)</enum><header>Payment
				limit</header><text>In the case of screening computed tomography colonography,
				payment under this part shall not exceed such amount as the Secretary
				specifies.</text>
						</subparagraph><subparagraph id="H66E1C30F9B0A4D1EA42C67ECB97835A8"><enum>(C)</enum><header>Facility payment
				limit</header>
							<clause id="HEA57A613BD9B45239AE8D11942660ED3"><enum>(i)</enum><header>Limitation on
				coinsurance</header><text>Notwithstanding any other provision of this title, in
				the case of an individual who receives screening computed tomography
				colonography—</text>
								<subclause id="HE53CF125CDE94C2689EE5021A9433E2D"><enum>(I)</enum><text>in computing the
				amount of any applicable coinsurance, the computation of such coinsurance shall
				be based upon the fee schedule under which payment is made for the services;
				and</text>
								</subclause><subclause id="H2E89D01CB1A0447CA6E932BA6DFABDCA"><enum>(II)</enum><text>the amount of
				such coinsurance shall not exceed 25 percent of the payment amount under the
				fee schedule described in subparagraph (A).</text>
								</subclause></clause></subparagraph><subparagraph id="HFB3A4A0EF745475BA0B4AF53408A44C2"><enum>(D)</enum><header>Frequency
				limit</header><text>No payment may be made under this part for a colorectal
				cancer screening test consisting of a screening computed tomography
				colonography—</text>
							<clause id="H740E768466D3493D8D2792F9A483B3EF"><enum>(i)</enum><text>if
				the individual is under 50 years of age; or</text>
							</clause><clause id="H7B1908DB30A145318C904C1E5AD1CD04"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="HB1169D6AA5DB47D4B803D6E803891723"><enum>(I)</enum><text>in the case of
				individuals at high risk for colorectal cancer, if the procedure is performed
				within the 23 months after a previous screening computed tomography
				colonography or a previous screening colonoscopy; or</text>
								</subclause><subclause id="HA920CFF354CA42AFAE7F0B09ADAFFA8A" indent="up1"><enum>(II)</enum><text>in the case of an individual who is not
				at high risk for colorectal cancer, if the procedure is performed within the
				119 months after a previous screening colonoscopy or within the 59 months after
				a previous screening flexible sigmoidoscopy or a previous screening computed
				tomography
				colonography.</text>
								</subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HA37B159004AB4034BCB438B4C0A7D3A2"><enum>(c)</enum><header>Conforming
			 Frequency Limits for Other Colorectal Cancer Screening Tests</header>
				<paragraph id="H27A00DE2C24A42A38FEAE3216AD59BED"><enum>(1)</enum><header>Screening
			 flexible sigmoidoscopy</header><text>Paragraph (2)(E)(ii) of section 1834(d) of
			 the Social Security Act (42 U.S.C. 1395m(d)) is amended by inserting <quote>or
			 screening computed tomography colonography</quote> after <quote>previous
			 screening flexible sigmoidoscopy</quote>.</text>
				</paragraph><paragraph id="H047E2DAB7EC64EB3A86808259F49B610"><enum>(2)</enum><header>Screening
			 colonoscopy</header><text>Paragraph (3)(E) of such section is amended—</text>
					<subparagraph id="H68BCF3E569284FB3B99F1B859EBDC3B0"><enum>(A)</enum><text>by inserting
			 <quote>or screening computed tomography colonography</quote> after <quote>23
			 months after a previous screening colonoscopy</quote>; and</text>
					</subparagraph><subparagraph id="HB7C8821164144FA294B411200C12F79E"><enum>(B)</enum><text>by inserting
			 <quote>or screening computed tomography colonography</quote> after
			 <quote>screening flexible sigmoidoscopy</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="H7A6D6B5054704A66819D87D5386C4B92"><enum>(d)</enum><header>Effective
			 Date</header><text>The amendments made by this section shall apply to items and
			 services furnished on or after January 1, 2011.</text>
			</subsection></section><section id="H7F177B7BAA704E73A2803AF0B0A70ACF"><enum>3.</enum><header>Exemption of
			 screening computed tomography colonography from special rule on payment for
			 imaging services</header>
			<subsection id="H0A1A866613CE420DA59C65C62160161D"><enum>(a)</enum><header>In
			 General</header><text>Section 1848(b)(4)(B) of the Social Security Act (42
			 U.S.C. 1395w–4(b)(4)(B)) is amended by inserting <quote>and screening computed
			 tomography colonography</quote> after <quote>diagnostic and screening
			 mammography</quote>.</text>
			</subsection><subsection id="H096C4B1324E0483094F0320B7C913B97"><enum>(b)</enum><header>Effective
			 Date</header><text>The amendment made by subsection (a) shall apply to items
			 and services furnished on or after January 1, 2011.</text>
			</subsection></section><section id="H763BC970D52E46E68F1125979A42503D"><enum>4.</enum><header>Report on the
			 effectiveness of screening CTC in improving overall CRC compliance</header>
			<subsection commented="no" id="H2797F895818B452094A5410699423475"><enum>(a)</enum><header>GAO Study and
			 Reports on Effectiveness of Screening Computed Tomography Colonograpy in
			 Improving Overall Colorectal Cancer Compliance</header>
				<paragraph commented="no" id="H72DED0510C9143E79D83D621D632C741"><enum>(1)</enum><header>Study</header>
					<subparagraph commented="no" id="HC91EB9A7247F40D0BCC5486DF99F2513"><enum>(A)</enum><header>In
			 general</header><text>The Comptroller General of the United States (in this
			 subsection referred to as the <quote>Comptroller General</quote>) shall conduct
			 a study, by colorectal cancer screening procedure type, on—</text>
						<clause commented="no" id="H8260246B526144F4AAB38DB60465E82D"><enum>(i)</enum><text>the effect of the
			 addition of the screening computed tomography colonography (in this subsection
			 referred to as <quote>screening CTC</quote>) benefit under section
			 1861(pp)(1)(D) of the Social Security Act, as added by section 2(a);</text>
						</clause><clause commented="no" id="H06868EAEC94C493CB3E7B78F0C1985F1"><enum>(ii)</enum><text>the effect of the
			 addition of such benefit as part of an overall set of colorectal cancer
			 screening (in this subsection referred to as the <quote>CRC screening</quote>)
			 made available to relevant Medicare population, including individuals over 50
			 years of age and over 75 years of age; and</text>
						</clause><clause commented="no" id="HA5C74A57D2E14B5895C5D45B149BF79B"><enum>(iii)</enum><text>any other
			 relevant questions involving access to, beneficiary preference of, and the
			 value of, screening CTC for Medicare beneficiaries.</text>
						</clause></subparagraph><subparagraph commented="no" id="HB8B470D540644203962645BEB5BD40B9"><enum>(B)</enum><header>Issues</header><text>The
			 study conducted under subparagraph (A) shall examine the following:</text>
						<clause commented="no" id="HE0124C67F0B8425D95650F58DFA9EE77"><enum>(i)</enum><text>The impact of
			 screening CTC on the change in CRC screening compliance of Medicare
			 beneficiaries.</text>
						</clause><clause commented="no" id="HD54A67A2D2DA42B7B13717E8DBE61A6A"><enum>(ii)</enum><text>The various
			 utilization rates for the each available CRC screening option before and after
			 the availability of screening CTC, including—</text>
							<subclause commented="no" id="HC666E4F24AF24F34B74D8CD796EC4814"><enum>(I)</enum><text>by initial CRC
			 screening performed as a Medicare beneficiary, including the beneficiary age
			 when initial screening was performed; and</text>
							</subclause><subclause commented="no" id="H72A5642315C946DDB2A917C403D99F02"><enum>(II)</enum><text>by follow-on
			 screening performed, whereby the analysis demonstrates to what extent screening
			 CTC was used as a substitute for a previous screening procedure.</text>
							</subclause></clause><clause commented="no" id="H75F6FD0D62514A0599FA57A82650FBC5"><enum>(iii)</enum><text>The referral
			 rate of screening CTC to follow-on optical colonoscopy.</text>
						</clause><clause commented="no" id="H108D6C3796D64B46B0D1682D5B7929EF"><enum>(iv)</enum><text>An analysis of
			 beneficiary preference to the various CRC screening options.</text>
						</clause><clause commented="no" id="H8B708D82C34C4E4E92B4C5F663712E33"><enum>(v)</enum><text>Access to
			 screening CTC by Medicare beneficiaries, especially in rural areas or
			 underserved populations, before and after implementation of such screening
			 benefit.</text>
						</clause><clause commented="no" id="HEFD24517E07E4A168AE9675D4FB3EE30"><enum>(vi)</enum><text>Such other issues
			 as the Comptroller General determines appropriate.</text>
						</clause></subparagraph></paragraph><paragraph commented="no" id="H5E25C0AF48244885A65E6B7140B4065D"><enum>(2)</enum><header>Reports</header>
					<subparagraph commented="no" id="H26334EA2C40A4E44A9A81C7A80F627D5"><enum>(A)</enum><header>Preliminary
			 report</header><text>Not later than March 1, 2015, the Comptroller General
			 shall submit a preliminary report to Congress on the study conducted under
			 paragraph (1).</text>
					</subparagraph><subparagraph commented="no" id="HCEB27588646A4121BD3EC0FE88E71EBB"><enum>(B)</enum><header>Final
			 report</header><text>Not later than March 1, 2016, the Comptroller General
			 shall submit a final report to Congress on the study conducted under paragraph
			 (1), together with recommendations for such legislation and administrative
			 action as the Comptroller General determines appropriate.</text>
					</subparagraph></paragraph></subsection></section></legis-body>
