		<official-title>To authorize the Secretary of Agriculture to make grants
		  for the prevention of cruelty to animals to States that have enacted laws
		  prohibiting the devocalization of dogs and cats for purposes of
		  convenience.</official-title>

		<section id="H827B7344EC21454EBAA7C3BA29B20773" section-type="section-one"><enum>1.</enum><header>Animal cruelty prevention
			 grants to States with laws prohibiting devocalization of dogs and cats</header>
			<subsection id="H817F4160B8FE42689777B49C00C9EAFF"><enum>(a)</enum><header>Authorization</header><text display-inline="yes-display-inline">The Secretary of Agriculture may make
			 grants on a competitive basis for the prevention of cruelty to animals to
			 States that have enacted laws prohibiting the performance of devocalization
			 procedures on dogs and cats for purposes of convenience.</text>
			</subsection><subsection id="HAE936BFD079C47F78FAF17D21016CC96"><enum>(b)</enum><header>Eligibility</header><text display-inline="yes-display-inline">The Secretary may only award a grant under
			 this section to a State that—</text>
				<paragraph id="H596CB541EA964CC5A63D8DCAA7E039D1"><enum>(1)</enum><text display-inline="yes-display-inline">has enacted a law imposing criminal
			 penalties on any individual who performs a devocalization procedure on a dog or
			 cat for purposes of convenience; and</text>
				</paragraph><paragraph id="H567FDB105E8E4DCDB5B2844705912911"><enum>(2)</enum><text display-inline="yes-display-inline">submits an application at such time, in
			 such form, and accompanied by such information and assurances as the Secretary
			 may require, including a copy of the law described in paragraph (1).</text>
				</paragraph></subsection><subsection id="H72A397D0CAD748D5868D6FAF63D747FB"><enum>(c)</enum><header>Use of
			 funds</header>
				<paragraph id="HD0073791D6264CEF866EB92F76620723"><enum>(1)</enum><header>In
			 general</header><text>A State that receives a grant under this section shall
			 use the grant funds for activities that prevent or promote the prevention of
			 cruelty to animals. Such activities may include—</text>
					<subparagraph id="H6151E94FDC2C408DA7D65AFB79A2999B"><enum>(A)</enum><text>care for animals
			 that are unwanted or have been abused; and</text>
					</subparagraph><subparagraph id="H19624C8B0316462995BD98A36B7963BD"><enum>(B)</enum><text>public education
			 about—</text>
						<clause id="HB2E7D0DEB4544F2C8A67874FF9413D96"><enum>(i)</enum><text>animal abuse and
			 how individuals may prevent such abuse or care for animals that are unwanted or
			 have been abused; and</text>
						</clause><clause id="H8CBEDB813F6B4E6999691A0BF7A11E9E"><enum>(ii)</enum><text>the
			 effects of performing a devocalization procedure on a dog or cat for purposes
			 of convenience.</text>
						</clause></subparagraph></paragraph><paragraph id="H84C06F4361AD4CB0A0390305D6C2CEAF"><enum>(2)</enum><header>Subgrants</header><text>A
			 State that receives a grant under this section may use grant funds to make
			 grants to entities that agree to use such funds to carry out the activities
			 described in paragraph (1).</text>
				</paragraph></subsection><subsection id="H4D845EC0E7324B8CB079C8F93C9303F7"><enum>(d)</enum><header>Grant
			 amount</header><text>The Secretary may not award more than $1,000,000 under
			 this section to a single State.</text>
			</subsection><subsection id="H8503ED8B25874A0C85F4960FAC9FCD4D"><enum>(e)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text>
				<paragraph id="H650ACE178F2F4DF888A737443B2AEFDD"><enum>(1)</enum><header>Devocalization
			 procedure</header><text display-inline="yes-display-inline">The term
			 <term>devocalization procedure</term> means a surgical procedure that prevents
			 an animal’s larynx from producing sound or reduces the ability of the larynx to
			 produce sound.</text>
				</paragraph><paragraph id="HF4CB9AB9DBAF4943AF4E1DE66D8055B2"><enum>(2)</enum><header>For purposes of
			 convenience</header><text>The term <term>for purposes of convenience</term>
			 means, with respect to the performance of a devocalization procedure on an
			 animal, that the procedure is not performed primarily for the therapeutic
			 benefit of the animal.</text>
				</paragraph></subsection><subsection id="H6EA9B367E26E4A9F839BD08CA461A49A"><enum>(f)</enum><header>Authorization of
			 appropriations</header><text>There is authorized to be appropriated to carry
			 out this section $12,000,000 for each of the fiscal years 2011 and 2012.</text>
