<section id="H3EC3EF16367C47788D2973393A52D93D"><enum>2.</enum><header>Definition of Secretary</header><text display-inline="no-display-inline">In this Act, the term <term>Secretary</term> means the Secretary of the Interior, acting through the Bureau of Land Management.</text></section>

<section id="HB2962741084846468272C3AD48CEBC1B"><enum>101.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>
<paragraph id="H17D9D64DE9CE40C6B129ECCB22B4E4EF"><enum>(1)</enum><header>City</header><text>The term <term>city</term> means the city of Elko, Nevada.</text></paragraph>
<paragraph id="H80D1884148394D24B4DD4A045929BF00"><enum>(2)</enum><header>County</header><text>The term <term>county</term> means the county of Elko, Nevada.</text></paragraph>
<paragraph id="HA54B1FC0FCCB49A69A0CC7AA71D86005"><enum>(3)</enum><header>Map</header><text>The term <term>map</term> means the map entitled <quote>Elko Motocross Park</quote> and dated January 9, 2010.</text></paragraph></section>
<section id="H05D726E91C8443ABBF118EFE01451123"><enum>102.</enum><header>Conveyance of land to county</header>
<subsection id="H879E922EBC3D4A528DABD19DF6677D3F"><enum>(a)</enum><header>In General</header><text>As soon as practicable after the date of enactment of this Act, subject to valid existing rights, and notwithstanding the land use planning requirements of sections 202 and 203 of the Federal Land Policy and Management Act of 1976 (43 U.S.C. 1712, 1713), the Secretary shall convey to the county, without consideration, all right, title, and interest of the United States in and to the land described in subsection (b).</text></subsection>
<subsection id="HE52E05526B274D25880C901646332268"><enum>(b)</enum><header>Description of Land</header><text>The land referred to in subsection (a) consists of approximately 300 acres of land managed by the Bureau of Land Management, Elko District, Nevada, as depicted on the map as <quote>Elko Motocross Park</quote>.</text></subsection>
<subsection id="H22AB22C921C14D3BBEF0CD8E6E931169"><enum>(c)</enum><header>Map and Legal Description</header>
<paragraph id="H485E2CA57B2C4C02AB4DCB3D28261107"><enum>(1)</enum><header>In general</header><text>As soon as practicable after the date of enactment of this Act, the Secretary shall finalize the legal description of the parcel to be conveyed under this section.</text></paragraph>
<paragraph id="HF3F05844566B43E697F2239973BFE2DB"><enum>(2)</enum><header>Minor errors</header><text>The Secretary may correct any minor error in—</text>
<subparagraph id="HE843FA67394345CF8913765AF3DE8051"><enum>(A)</enum><text>the map; or</text></subparagraph>
<subparagraph id="H92FD9A93A31C4AD0B18530BB9DFAB490"><enum>(B)</enum><text>the legal description.</text></subparagraph></paragraph>
<paragraph id="H3A55AA35B15E4BF483ED05240D7C8540"><enum>(3)</enum><header>Availability</header><text>The map and legal description shall be on file and available for public inspection in the appropriate offices of the Bureau of Land Management.</text></paragraph></subsection>
<subsection id="HD8D5C7ADA56A425B8820A35451B2F091"><enum>(d)</enum><header>Use of Conveyed Land</header><text>The land conveyed under subsection (a) shall be used only—</text>
<paragraph id="H9779BEAE75D64A29B723B23ADBAEA37D"><enum>(1)</enum><text>as a motocross, off-highway vehicle, and stock car racing area; or</text></paragraph>
<paragraph id="H8700D5742A3C4264BA367FDB05BB648B"><enum>(2)</enum><text>for any other public purpose consistent with the Act of June 14, 1926 (commonly known as the <quote>Recreation and Public Purposes Act</quote>), (43 U.S.C. 869 et seq.).</text></paragraph></subsection>
<subsection id="H2FD43865E5E84E27AB40B287FC32F6AF"><enum>(e)</enum><header>Administrative costs</header><text>The Secretary shall require the county to pay all survey costs and other administrative costs necessary for the preparation and completion of any patents for, and transfers of title to, the land described in subsection (b).</text></subsection>
<subsection id="H3FB371BC45BE41DCB2A54E04937F31AA"><enum>(f)</enum><header>Reversion</header><text>If the land conveyed under subsection (a) ceases to be used for the public purpose for which the land was conveyed, the land shall, at the discretion of the Secretary, revert to the United States.</text></subsection></section></title>
<title id="H2A75028AB8224732B78F5D9FA93DC8C6"><enum>II</enum><header>Elko Indian Colony Expansion</header>
<section id="H230B83C617044C67A427DF8B4725139E"><enum>201.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>
<paragraph id="HE515FEF512E04ECDA9593DD38B54044F"><enum>(1)</enum><header>Map</header><text>The term <term>map</term> means the map entitled <quote>Te-moak Tribal Land Expansion</quote>, dated September 30, 2008, and on file and available for public inspection in the appropriate offices of the Bureau of Land Management.</text></paragraph>
<paragraph id="H9C5A14045F7C43A0A04E0A63919204D3"><enum>(2)</enum><header>Tribe</header><text>The term <term>Tribe</term> means the Te-moak Tribe of Western Shoshone Indians of Nevada, which is a federally recognized Indian tribe.</text></paragraph></section>
<section id="H8C1250A2386A4B5F88D0FD8B7BF35B2A"><enum>202.</enum><header>Land to be held in trust for the Te-moak Tribe of Western Shoshone Indians of Nevada</header>
<subsection id="HC287EA73E0E54424BC03FBF98C59002A"><enum>(a)</enum><header>In general</header><text>Subject to valid existing rights, all right, title, and interest of the United States in and to the land described in subsection (b)—</text>
<paragraph id="HCDB83A231E8447628DDAE089B4AEE3CF"><enum>(1)</enum><text>shall be held in trust by the United States for the benefit and use of the Tribe; and</text></paragraph>
<paragraph id="H1F061B86FEAB4DEE98D881BBDD381FFF"><enum>(2)</enum><text>shall be part of the reservation of the Tribe.</text></paragraph></subsection>
<subsection id="H9EB482B567724AF4B87849D8AF0A81D4"><enum>(b)</enum><header>Description of land</header><text>The land referred to in subsection (a) consists of approximately 373 acres of land administered by the Bureau of Land Management and identified on the map as <quote>Lands to be Held in Trust</quote>.</text></subsection>
<subsection id="H66DA54E786C94A4EB4508D608D097C7B"><enum>(c)</enum><header>Survey</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall complete a survey of the boundary lines to establish the boundaries of the land taken into trust under subsection (a).</text></subsection>
<subsection id="H3044BECEB162465BA4107B5A910B112B"><enum>(d)</enum><header>Conditions</header>
<paragraph id="H074F66C65B454BCA8985F51CAB321E21"><enum>(1)</enum><header>Rights-of-way</header><text>Before taking the land into trust under subsection (a), not later than 120 days after the date of enactment of this Act, the Secretary shall—</text>
<subparagraph id="HE20451BBF58C414BB416500BA849AC19"><enum>(A)</enum><text>complete any applicable environmental review for conveyance of a right-of-way for Jennings Road, as depicted on the map; and</text></subparagraph>
<subparagraph id="H02C6B07E9E204C19851E26D8E3FAE827"><enum>(B)</enum><text>subject to the environmental review under subparagraph (A), convey the right-of-way to the City of Elko.</text></subparagraph></paragraph>
<paragraph id="HC4E1994AF64041ECBF7B0E72DCED5A16"><enum>(2)</enum><header>Gaming</header><text>Land taken into trust under subsection (a) shall not be eligible, or considered to have been taken into trust, for class II gaming or class III gaming (as those terms are defined in section 4 of the Indian Gaming Regulatory Act (25 U.S.C. 2703)).</text></paragraph>
<paragraph id="H42E0E42B51014E498DACE8C09D8369E1"><enum>(3)</enum><header>Use of trust land</header><text>With respect to the use of the land taken into trust under subsection (a), the Tribe shall limit the use of the land to—</text>
<subparagraph id="HEAEC5538474449078C3E151A598B3FC2"><enum>(A)</enum><text>traditional and customary uses;</text></subparagraph>
<subparagraph id="H169F47BBD60942819ED443F664498D9C"><enum>(B)</enum><text>stewardship conservation for the benefit of the Tribe; and</text></subparagraph>
<subparagraph id="HA7C1C5B7EF60427681CE1089CC95FC6F"><enum>(C)</enum>
<clause commented="no" display-inline="yes-display-inline" id="H3833FB28744042F7A3DD4AD24E23B4F7"><enum>(i)</enum><text>residential or recreational development; or</text></clause>
<clause id="H31158978C09A49D9B00E351EA6FF64EA" indent="up1"><enum>(ii)</enum><text>commercial use.</text></clause></subparagraph></paragraph>
<paragraph id="H4194CDBB6D7C4B1AA3AC9D69ED7FDBF7"><enum>(4)</enum><header>Thinning; landscape restoration</header><text>With respect to the land taken into trust under subsection (a), the Secretary, in consultation and coordination with the Tribe, may carry out any fuels reduction and other landscape restoration activities on the land that is beneficial to the Tribe and the Bureau of Land Management.</text></paragraph></subsection></section>
<section id="H9A1A4184A06E4ABB8B50956472DA939B"><enum>203.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated such sums as are necessary to carry out this title.</text></section></title>
