		<official-title>To establish the Program Reform Commission to review and
		  identify unnecessary Federal programs and make recommendations for termination,
		  modification, or retention of such programs, and to express the sense of the
		  Congress that the Congress should promptly consider legislation that would make
		  the changes in law necessary to implement the recommendations.</official-title>

		<section id="H2F2863D688514DF5B2F21A00A0EA9D8F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Program Reform Commission
			 Act</short-title></quote>.</text>
		</section><section id="H9BB3BC42089341258C78F9816717CE85"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds that—</text>
			<paragraph id="H0BF5207786674F4197AC5725CBC8E423"><enum>(1)</enum><text>Federal programs
			 which may have been enacted with a valid purpose can become obsolete, or no
			 longer in the public interest, making such programs unnecessary or
			 undesired;</text>
			</paragraph><paragraph id="HF04F17C9BE9C4A5291F6782A903FD33E"><enum>(2)</enum><text>it is unfair to
			 force the United States taxpayer to support unnecessary programs that do not
			 provide a substantial public benefit or serve the public interest;</text>
			</paragraph><paragraph id="H1DB298A27D4B4D409B736CA995863184"><enum>(3)</enum><text>the Congress has
			 been unable to evaluate methodically those Federal programs that are unfair and
			 unnecessary and require reform or elimination; and</text>
			</paragraph><paragraph id="HC6FD2C6E68654859AF6822F65A018012"><enum>(4)</enum><text>a
			 Commission to advise the Congress is essential to a comprehensive review of
			 such programs and to the reform or elimination of such programs.</text>
			</paragraph></section><section id="HA50A00D3FA18410CA88A6FDCE5E4D18E"><enum>3.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to establish a
			 fair and deliberative process that will result in the timely identification,
			 review, and reform or elimination of programs of the Federal Government.</text>
		</section><section id="HF0B12E36156F410A9CF5317508AA4492"><enum>4.</enum><header>Program
			 criteria</header><text display-inline="no-display-inline">In order for a
			 department, agency, or the Commission to consider a program for recommendations
			 under this Act, the program—</text>
			<paragraph id="H11AA1EA51CD84B45A5F91A38D2920C28"><enum>(1)</enum><text>must be a system
			 of services or projects that is provided by the Federal Government; and</text>
			</paragraph><paragraph id="H18DE0FBFBB304E48BA29A834F49DF8FB"><enum>(2)</enum><text>may not be a
			 service or project that exists for the purposes of research and development in
			 the broad public interest on the basis of a peer reviewed or other open,
			 competitive, merit-based procedure.</text>
			</paragraph></section><section id="H632321958AAD47E5996621E87922BD89"><enum>5.</enum><header>Program Reform
			 Commission</header>
			<subsection id="HC68B41B1FC6B45259895BC42CCE93849"><enum>(a)</enum><header>Establishment</header><text>There
			 is established within the legislative branch of the Federal Government an
			 independent commission to be known as the <quote>Program Reform
			 Commission</quote> (hereafter in this Act referred to as the
			 <quote>Commission</quote>).</text>
			</subsection><subsection id="H817250F52F9F4DBDA5BB45C64C4CC16C"><enum>(b)</enum><header>Duties</header><text>The
			 Commission shall—</text>
				<paragraph id="HA47B3D7C6D174D04895D2D970A175C2C"><enum>(1)</enum><text>examine the
			 programs of the Federal Government and identify programs that are no longer
			 necessary or that merit modification; and</text>
				</paragraph><paragraph id="HBC686C77E8834AFD812FBC7066713450"><enum>(2)</enum><text>submit the report
			 required under section 6(c) to the Congress, making recommendations regarding
			 the termination, modification, or retention of programs.</text>
				</paragraph></subsection><subsection id="H273BC43F80BC49B9A5E88AEBB0AD9C1A"><enum>(c)</enum><header>Appointment</header>
				<paragraph id="HE207DA5A041C46E99A6F5A01658FC554"><enum>(1)</enum><header>Members</header><text>The
			 Commission shall be composed of 8 members, of whom—</text>
					<subparagraph display-inline="no-display-inline" id="H4B377B7E46AB482AAB768F3C60F663C8"><enum>(A)</enum><text>2 shall be
			 appointed by the Speaker of the House of Representatives;</text>
					</subparagraph><subparagraph id="H1B873042D6DE47EFB40201F6A9BF17A6"><enum>(B)</enum><text>2 shall be
			 appointed by the minority leader of the House of Representatives;</text>
					</subparagraph><subparagraph id="HB163046722194B929700BB0B48B8505B"><enum>(C)</enum><text>2 shall be
			 appointed by the majority leader of the Senate; and</text>
					</subparagraph><subparagraph id="HD3D4944DD6934AD29C3D1EDBA032A27A"><enum>(D)</enum><text>2 shall be
			 appointed by the minority leader of the Senate.</text>
					</subparagraph></paragraph><paragraph id="H48266ECB2F1749CAB78359CA1E4B81EC"><enum>(2)</enum><header>Consultation
			 required</header><text>The Speaker of the House of Representatives, the
			 minority leader of the House of Representatives, the majority leader of the
			 Senate, and the minority leader of the Senate shall consult among themselves
			 prior to the appointment of the members of the Commission.</text>
				</paragraph><paragraph id="H966F2831217A44DEADCDEBFBEA9D617A"><enum>(3)</enum><header>Background</header><text display-inline="yes-display-inline">The members of the Commission shall
			 represent a broad array of expertise and points of view with respect to the
			 subject matter, programs, and laws the Commission is likely to review.</text>
				</paragraph><paragraph id="HE999A05CAF224B70840D57E97830E963"><enum>(4)</enum><header>Limitation on
			 federal officer</header><text>No officer or employee of a Federal agency may
			 serve as a member of the Commission.</text>
				</paragraph><paragraph id="H1CE5332CE93E40909EAD057BF86CF131"><enum>(5)</enum><header>Terms</header><text>The
			 members of the Commission shall be appointed for the life of the
			 Commission.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HDD1258630E41485EA1BB2881ABCF358F"><enum>(d)</enum><header>Co-Chairs</header>
				<paragraph commented="no" id="H3BDC4EDEB56940198CF687BF88F6ADAD"><enum>(1)</enum><header>In
			 general</header><text>The Commission shall be co-chaired by 2 members, selected
			 by the 8 members of the Commission.</text>
				</paragraph><paragraph commented="no" id="HB1135B759E394A8596410A08676B0208"><enum>(2)</enum><header>House and Senate
			 representation</header><text>Of the members selected to be co-chairs—</text>
					<subparagraph commented="no" id="H04A34F4C5C8A471AB03E37AB1AD1F46F"><enum>(A)</enum><text>one shall be a
			 member appointed under subsection (c)(1)(A) or subsection (c)(1)(B); and</text>
					</subparagraph><subparagraph commented="no" id="HE22CEF8E3F974E508C1B4062AC97F07C"><enum>(B)</enum><text>one shall be a
			 member appointed under subsection (c)(1)(C) or subsection (c)(1)(D).</text>
					</subparagraph></paragraph><paragraph commented="no" id="H4907A7B1510143BFA3F90737730D07D1"><enum>(3)</enum><header>Political
			 affiliation</header><text>The two members selected to be co-chairs may not be
			 of the same political party.</text>
				</paragraph></subsection><subsection id="H881AAB4B6F2F43DBA19587E3E1A22013"><enum>(e)</enum><header>Meetings</header>
				<paragraph id="H4FDD1D3277644CA4B909D5CBE845808B"><enum>(1)</enum><header>Initial
			 meeting</header><text>No later than April 1, 2011, the Commission shall conduct
			 its first meeting.</text>
				</paragraph><paragraph id="H43D6AA47351945FD9E67CF6F1127603E"><enum>(2)</enum><header>Open
			 meetings</header><text display-inline="yes-display-inline">Each meeting of the
			 Commission shall be open to the public, except that in cases in which
			 classified information, trade secrets, or personnel matters are discussed, the
			 co-chairs may close the meeting. All proceedings, information, and
			 deliberations of the Commission shall be available, upon request, to the
			 Speaker of the House of Representatives, the majority leader and minority
			 leader of the House of Representatives, the majority leader and minority leader
			 of the Senate, and the chairman and ranking minority member of the relevant
			 Committee of Congress having jurisdiction to report legislation regarding the
			 subject matter thereof.</text>
				</paragraph></subsection><subsection id="HCDCE7352693C40218EA78B99A0521DBA"><enum>(f)</enum><header>Vacancies</header><text>A
			 vacancy on the Commission shall be filled in the same manner as the original
			 appointment.</text>
			</subsection><subsection id="HAF6EA3FDF69641C88BE40BACD8C8B597"><enum>(g)</enum><header>Pay and travel
			 expenses</header>
				<paragraph id="H162E00BDCB6F41C588D1AA9665CDED64"><enum>(1)</enum><header>Pay</header><text>Each
			 member of the Commission, other than the co-chairs, shall be paid at a rate
			 equal to the daily equivalent of the minimum annual rate of basic pay for level
			 IV of the Executive Schedule under section 5315 of title 5, United States Code,
			 for each day (including travel time) during which the member is engaged in the
			 actual performance of duties vested in the Commission.</text>
				</paragraph><paragraph id="H6377636D67584081BE7C044C93B7B31B"><enum>(2)</enum><header>Co-chairs</header><text>The
			 co-chairs shall be paid for each day referred to in paragraph (1) at a rate
			 equal to the daily payment of the minimum annual rate of basic pay payable for
			 level III of the Executive Schedule under section 5314 of title 5, United
			 States Code.</text>
				</paragraph><paragraph id="H77554027E77944FCA56A37C635883BD5"><enum>(3)</enum><header>Travel
			 expenses</header><text>Members of the Commission shall receive travel expenses,
			 including per diem in lieu of subsistence, in accordance with section 5702 and
			 5703 of title 5, United States Code.</text>
				</paragraph></subsection><subsection id="HED9BFBE87B594BCE82256A354D86E888"><enum>(h)</enum><header>Director of
			 staff</header>
				<paragraph id="HE2B524F215304E3CA912FCF5E5598848"><enum>(1)</enum><header>Qualifications</header><text>The
			 co-chairs shall appoint as Director an individual who has not, during the 12
			 months preceding the date of such appointment, served in any of the entities,
			 or worked directly with any of the programs, that the Commission intends to
			 review.</text>
				</paragraph><paragraph id="H3561B232316C49089CBA960CF56F9450"><enum>(2)</enum><header>Pay</header><text>The
			 Director shall be paid at the rate of basic pay payable for level IV of the
			 Executive Schedule under section 5315 of title 5, United States Code.</text>
				</paragraph><paragraph id="HE0302C7ED9544F8F94C366F816F0A6C9"><enum>(3)</enum><header>Reports</header><text>The
			 Director shall submit periodic reports on administrative and personnel matters
			 to the co-chairs of the Commission and the chairman and ranking minority member
			 of the Committee on Homeland Security and Governmental Affairs of the Senate
			 and the Committee on Oversight and Government Reform of the House of the
			 Representatives.</text>
				</paragraph></subsection><subsection id="HE5C3493160774B37B488A24DD2D1C2E9"><enum>(i)</enum><header>Staff</header>
				<paragraph id="H01024ACD4F8948DB83422DE996DEADF1"><enum>(1)</enum><header>Additional
			 personnel</header><text>Subject to paragraphs (2) and (4), the Director, with
			 the approval of the Commission, may appoint and fix the pay of additional
			 personnel.</text>
				</paragraph><paragraph id="H6D55B1E2F61C47FB9AE59CB0B83DC9F7"><enum>(2)</enum><header>Appointments</header><text>The
			 Director may make such appointments without regard to the provisions of title
			 5, United States Code, governing appointments in the competitive service, and
			 any personnel so appointed may be paid without regard to the provisions of
			 chapter 51 and subchapter III of chapter 53 of that title relating to
			 classification and General Schedule pay rates.</text>
				</paragraph><paragraph id="H1B7BB5E45B7E47ECAE0BE732B06E38B2"><enum>(3)</enum><header>Legal
			 staff</header><text>The Director shall appoint under paragraph (2) such
			 professional legal staff as are necessary for the performance of the functions
			 of the Commission.</text>
				</paragraph><paragraph id="H1BB363CC3A7744E8B834B4E48C870FF5"><enum>(4)</enum><header>Detailees</header><text>Upon
			 the request of the Director, the head of any Federal department or agency may
			 detail any of the personnel of that department or agency to the Commission to
			 assist the Commission in accordance with an agreement entered into with the
			 Commission.</text>
				</paragraph><paragraph id="H9A443628A1E547F885B3E07D0C848868"><enum>(5)</enum><header>Restrictions on
			 personnel and detailees</header><text>The following restrictions shall apply to
			 personnel and detailees of the Commission:</text>
					<subparagraph id="H9ED4A601D7F440C58414B9EB1D944B69"><enum>(A)</enum><header>Personnel</header><text>No
			 more than one-third of the personnel detailed to the Commission may be on
			 detail from Federal agencies that deal directly or indirectly with the Federal
			 programs the Commission intends to review.</text>
					</subparagraph><subparagraph id="H2ABEA2B82E854EC5A691ECDD72247112"><enum>(B)</enum><header>Analysts</header><text>No
			 more than one-fifth of the professional analysts of the Commission may be
			 persons detailed from a Federal agency that deals directly or indirectly with
			 the Federal programs the Commission intends to review.</text>
					</subparagraph><subparagraph id="HAC5FED43493141CDBCF708263418A61F"><enum>(C)</enum><header>Lead
			 analyst</header><text>No person detailed from a Federal agency to the
			 Commission may be assigned as the lead professional analyst with respect to an
			 entity or program the Commission intends to review if the person has been
			 involved in regulatory or policymaking decisions affecting any such entity or
			 program in the 12 months preceding such assignment.</text>
					</subparagraph><subparagraph id="H16DA53FF8F9845A9B8F5402CEF9995CE"><enum>(D)</enum><header>Detailee</header><text>A
			 person may not be detailed from a Federal agency to the Commission if, within
			 12 months before the detail is to begin, that person participated personally
			 and substantially in any matter within that particular agency concerning the
			 preparation of recommendations under this Act.</text>
					</subparagraph><subparagraph id="HB27D4DE4ECD4415BAB278AAF28AE347F"><enum>(E)</enum><header>Limitation on
			 staff size</header>
						<clause display-inline="no-display-inline" id="HF75088BAFACC421890770E87D6D03AE0"><enum>(i)</enum><header>Restriction on
			 number of staff</header><text>Subject to clause (ii), there may not be more
			 than 25 persons (including any detailees) on the staff at any time.</text>
						</clause><clause id="HE3F5C8C3A5C642C592401C609075562E"><enum>(ii)</enum><header>Notification of
			 increase</header><text>The Commission may increase the number of its personnel
			 in excess of the limitation under clause (i) 15 days after submitting
			 notification of such increase to the Committee on Homeland Security and
			 Governmental Affairs of the Senate and the Committee on Oversight and
			 Government Reform of the House of Representatives.</text>
						</clause></subparagraph><subparagraph id="H3C9003B680604D58875DFF497B3766FA"><enum>(F)</enum><header>Prohibition of
			 compensation</header><text>Members of the staff of the Commission who are
			 full-time officers or employees of the United States may not receive additional
			 pay, allowances, or benefits by reason of their service for the Commission.</text>
					</subparagraph></paragraph><paragraph id="H3660285A0E1641A7A614AD7A65F08DC1"><enum>(6)</enum><header>Assistance</header>
					<subparagraph id="H1E316440CDAE40FF96A4368A8F3B505D"><enum>(A)</enum><header>In
			 general</header><text>The Comptroller General of the United States shall
			 provide assistance, including the detailing of employees, to the Commission in
			 accordance with an agreement entered into with the Commission.</text>
					</subparagraph><subparagraph id="H863ADC9D1D234BCC9F4848B7260A20AD"><enum>(B)</enum><header>Consultation</header><text>The
			 Commission and the Comptroller General of the United States shall consult with
			 the Committee on Homeland Security and Governmental Affairs of the Senate and
			 the Committee on Oversight and Government Reform of the House of
			 Representatives on the agreement referred to under subparagraph (A) before
			 entering into such agreement.</text>
					</subparagraph></paragraph></subsection><subsection id="HCCA88202C2B948F19177BE753350EA36"><enum>(j)</enum><header>Other
			 authority</header>
				<paragraph id="H800061207C38457489C6F498B8612749"><enum>(1)</enum><header>Experts and
			 consultants</header><text display-inline="yes-display-inline">The Commission
			 may procure by contract the temporary or intermittent services of experts or
			 consultants pursuant to section 3109 of title 5, United States Code.</text>
				</paragraph><paragraph id="HAE80FF9B060641A3882F6CF2952B49C3"><enum>(2)</enum><header>Leasing</header><text display-inline="yes-display-inline">The Commission may lease space and acquire
			 personal property.</text>
				</paragraph><paragraph id="HB33BE0079D654B888FC306933ED867C4"><enum>(3)</enum><header>Limitation on
			 contract authority</header><text display-inline="yes-display-inline">The
			 authority to enter into contracts under this subsection shall be available only
			 to the extent or in the amounts provided in advance in appropriation
			 Acts.</text>
				</paragraph></subsection><subsection id="H53E6EFDFE59F4EC7B72D5498CD694A05"><enum>(k)</enum><header>Authorization of
			 appropriations</header><text>There are authorized to be appropriated to the
			 Commission such sums as are necessary to carry out its duties under this
			 Act.</text>
			</subsection><subsection id="HABCD7DF3A04A489998B4B955730A83F3"><enum>(l)</enum><header>Termination</header><text>The
			 Commission shall terminate on January 1, 2013.</text>
			</subsection></section><section id="H20C9DD8F873542689D9F949DA244BC1B"><enum>6.</enum><header>Procedure for
			 making recommendations to terminate programs</header>
			<subsection id="HA58A95C2D4B5424B9474C6DCD751DFBA"><enum>(a)</enum><header>Agency
			 plan</header>
				<paragraph id="HEC5B2F051A0D41578D9985C234B1D9B7"><enum>(1)</enum><header>In
			 general</header><text>The head of each Federal department or agency shall
			 include in the documents submitted in support of the budget of the agency for
			 fiscal year 2012 a list identifying all programs administered by that
			 department or agency that the head of the department or agency determines no
			 longer are necessary.</text>
				</paragraph><paragraph id="H3D9702F4DF314D999AFD8CF4A311D46E"><enum>(2)</enum><header>Contents</header><text>Such
			 list shall include—</text>
					<subparagraph id="HC608725745E14085ADA84482FE936CDB"><enum>(A)</enum><text>a detailed
			 description of each program in question;</text>
					</subparagraph><subparagraph id="H8917FA22BC1A42DD9D2738AACC00D84F"><enum>(B)</enum><text>a statement
			 identifying and detailing the extent to which each service or project of the
			 program complies with the provisions of section 4;</text>
					</subparagraph><subparagraph id="H6E5B51C6D1AA4340AB0B132D6DBE8435"><enum>(C)</enum><text>a statement
			 summarizing the legislative history and purpose of such services or projects
			 and the laws or policies directly or indirectly giving rise to the need for
			 such programs; and</text>
					</subparagraph><subparagraph id="H6826FAA631974B4DAA75A8A755BAA970"><enum>(D)</enum><text>a recommendation
			 to the Commission regarding the termination, modification, or retention of each
			 program identified in the list.</text>
					</subparagraph></paragraph></subsection><subsection id="H0B1FC6BA67C042AAB7BABD976B2F0CB7"><enum>(b)</enum><header>Review by the
			 commission</header>
				<paragraph id="H12F4C752A47F49178CE7566CFD836C7E"><enum>(1)</enum><header>In
			 general</header><text>At any time after the submission of the budget documents
			 to the Congress, the Commission shall conduct public hearings regarding, and
			 review, the termination, modification, or retention of all programs
			 administered by each Federal department or agency, including the
			 recommendations included in the lists required under subsection (a).</text>
				</paragraph><paragraph id="H52D5D2B2ADC04BBD94D83718D2EDD8B5"><enum>(2)</enum><header>Testimony under
			 oath</header><text>All testimony before the Commission at a public hearing
			 conducted under this paragraph shall be presented under oath.</text>
				</paragraph></subsection><subsection id="H40CB194F7F414573818B157D7A600674"><enum>(c)</enum><header>Report and
			 recommendations of commission</header>
				<paragraph id="HC1399AF0F6BD4701976344FAC790FA86"><enum>(1)</enum><header>Report to
			 congress</header>
					<subparagraph id="HDC8C74D46A2F459382641EC916587F86"><enum>(A)</enum><header>Requirement</header><text>No
			 later than March 31, 2012, the Commission shall submit a report to the Congress
			 containing the Commission’s findings and recommendations for termination,
			 modification, or retention of each of the programs reviewed by the
			 Commission.</text>
					</subparagraph><subparagraph id="HC3FD5A1747BC4FA1A6867C86BF7EEC12"><enum>(B)</enum><header>Contents</header><text>Such
			 findings and recommendations shall specify—</text>
						<clause id="HE178EC16C6DD4DA3B9DFCC546A75D066"><enum>(i)</enum><text>all
			 actions, circumstances, and considerations relating to or bearing upon the
			 recommendations; and</text>
						</clause><clause id="H7DB77CD965B74B8EABAED9C9094925C1"><enum>(ii)</enum><text>to
			 the maximum extent practicable, the estimated effect of the recommendations
			 upon the policies, laws, and programs directly or indirectly affected by the
			 recommendations.</text>
						</clause></subparagraph><subparagraph id="HA11639C666544A4AB1D4D6A4BD64CC70"><enum>(C)</enum><header>Supermajority
			 requirement</header><text>The Commission may not include a recommendation in
			 the report unless inclusion of the recommendation is approved by at least 6
			 members of the Commission.</text>
					</subparagraph></paragraph><paragraph id="H935D9FD6D5014C3FBBAF111FB2FAD1D9"><enum>(2)</enum><header>Information and
			 justifications</header><text>The Commission shall include in its report
			 information specifying—</text>
					<subparagraph id="HDEBCD6A8CB1D42BE951C3E4FDFFD1ECE"><enum>(A)</enum><text>the reasons and
			 justifications for the recommendations of the Commission;</text>
					</subparagraph><subparagraph id="HA89233F7F26A46C1ABCA3223B0201C7A"><enum>(B)</enum><text>all actions,
			 circumstances, and considerations relating to or bearing upon the
			 recommendations;</text>
					</subparagraph><subparagraph id="H1E2E95C77D61401FB7F0D11ACE9715D1"><enum>(C)</enum><text>to the maximum
			 extent practicable, the estimated economic impact of accepting its
			 recommendations;</text>
					</subparagraph><subparagraph id="H96EE749896E1447F94280CE5BB49377C"><enum>(D)</enum><text>the amount of the
			 projected savings and budgetary impact that would result from the acceptance of
			 each of its recommendations; and</text>
					</subparagraph><subparagraph id="HB69741C8355D4096AF3DEE6627372CDB"><enum>(E)</enum><text>the specific
			 changes in Federal statutes necessary to implement the recommendations,
			 including citation of the relevant provisions of existing law.</text>
					</subparagraph></paragraph><paragraph id="H9BCD3549C910498FBBC2F966F185943D"><enum>(3)</enum><header>Submission to
			 congress</header><text>The report submitted to the Congress under this
			 subsection shall be submitted to the Senate and the House of Representatives on
			 the same day, and shall be delivered to the Secretary of the Senate if the
			 Senate is not in session, and to the Clerk of the House of the Representatives
			 if the House is not in session.</text>
				</paragraph><paragraph id="HBF6B1AA9E62D428F985037EDA7369642"><enum>(4)</enum><header>Federal
			 register</header><text>The report submitted under this subsection shall be
			 printed in the first issue of the Federal Register after such
			 submission.</text>
				</paragraph><paragraph id="H310DBF6590ED4CD6BE656E5405C968C6"><enum>(5)</enum><header>Changes in
			 agency or department recommendations</header>
					<subparagraph id="HFCAA73576F694808BDCE5C41E7386AA4"><enum>(A)</enum><header>In
			 general</header><text>Subject to the deadline in paragraph (1) and to
			 subparagraphs (B) and (C) of this paragraph, in making its recommendations, the
			 Commission may make changes in any of the recommendations made by a department
			 or agency.</text>
					</subparagraph><subparagraph id="HD3A8BCE2755E4A2BA6172ED7E0B85C2B"><enum>(B)</enum><header>Public hearing
			 requirement</header><text>Subject to subparagraph (C), the Commission may make
			 a change in the recommendations made by a department or agency only if the
			 Commission conducts a public hearing on the Commission’s proposed
			 changes.</text>
					</subparagraph><subparagraph id="HAA1654184D8E479688CFA1F4AF43AA91"><enum>(C)</enum><header>Limitation on
			 public hearing requirement</header><text>Subparagraph (B) shall apply only to a
			 change by the Commission in a department or agency recommendation that
			 would—</text>
						<clause id="HCEED00A666A0435CB801798089EF08C3"><enum>(i)</enum><text>add
			 or delete a program to or from, respectively, the list recommended for
			 termination;</text>
						</clause><clause id="H26C39354D07D400D9205357AB7D5C5D2"><enum>(ii)</enum><text>add
			 or delete a program to or from, respectively, the list recommended for
			 modification; or</text>
						</clause><clause id="HB77FCC21FD014C69B710A2F5C062DC3F"><enum>(iii)</enum><text>increase or
			 decrease the extent of a recommendation to modify a program, included in a
			 department’s or agency’s recommendation.</text>
						</clause></subparagraph></paragraph><paragraph id="H9E42CFD5DCE242598519DB4358F5FE4B"><enum>(6)</enum><header>Provision of
			 information to members of congress</header><text>After March 31, 2012, the
			 Commission shall, upon request, promptly provide to any Member of Congress the
			 information used by the Commission in making its recommendations.</text>
				</paragraph><paragraph id="H940966F0050F457E981CC24B22760CDC"><enum>(7)</enum><header>Comptroller
			 general</header><text>The Comptroller General of the United States
			 shall—</text>
					<subparagraph id="H0669048992444B76A0DDDC61551FE815"><enum>(A)</enum><text>assist the
			 Commission, to the extent requested, in the Commission’s review and analysis of
			 the lists, statements, and recommendations made by departments and agencies
			 under subsection (a); and</text>
					</subparagraph><subparagraph id="H19AA3E083BD74C8B996C39A778BE4110"><enum>(B)</enum><text>no later than
			 April 1, 2011, or 60 days after the public release of the President’s budget
			 documents for fiscal year 2012, whichever is earlier, submit to the Congress
			 and to the Commission a report containing a detailed analysis of the list,
			 statements, and recommendations of each department or agency.</text>
					</subparagraph></paragraph></subsection></section><section id="H13CE9125A801423692AFB5859144C4D8"><enum>7.</enum><header>Congressional
			 action on commission recommendations</header><text display-inline="no-display-inline">It is the sense of the Congress that,
			 following submission of the report of the Program Reform Commission under
			 section 6, the House of Representatives and the Senate should promptly consider
			 legislation that would enact changes in Federal statutes necessary to implement
			 the recommendations of the Commission.</text>
