		<section id="HF1B975E1585444B6A4A77FF8CD94E1D9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Veteran Employment Transition Act of
			 2010</short-title></quote>.</text>
		</section><section id="HFE31D531718F46758682D9615B16C2F9"><enum>2.</enum><header>Work opportunity
			 credit for certain recently discharged veterans</header>
			<subsection id="HA1089C4079B5489BAD95CB063AFCB2C0"><enum>(a)</enum><header>In
			 general</header><text>Subparagraph (A) of section 51(d)(3) of the Internal
			 Revenue Code of 1986 is amended by striking <quote>means any veteran</quote>
			 and all that follows and inserting <quote>means any recently discharged veteran
			 and any disadvantaged veteran.</quote></text>
			</subsection><subsection id="H2C9470F2DE0C44A19B81F971EA96DA08"><enum>(b)</enum><header>Recently
			 discharged veteran; disadvantaged veteran</header><text>Paragraph (3) of
			 section 51(d) of the Internal Revenue Code of 1986 is amended—</text>
				<paragraph id="H64E4E0FED0FE47FDA5C9F83BC53BF418"><enum>(1)</enum><text>by redesignating
			 subparagraphs (B) and (C) as subparagraphs (D) and (E), respectively,
			 and</text>
				</paragraph><paragraph id="H0BEBE8EE519A40B0A60F5401CAE02AA3"><enum>(2)</enum><text>by inserting after
			 subparagraph (A) the following new subparagraphs:</text>
					<quoted-block act-name="" id="H1FA2E6EB79D140F5BD124B0D03D1B3BF" style="OLC">
						<subparagraph id="H7E6840A825DA4B7A84070A21846C690A"><enum>(B)</enum><header>Recently
				discharged veteran</header><text>For purposes of subparagraph (A), the term
				<term>recently discharged veteran</term> means—</text>
							<clause id="H5024AAE537B2474EB10533C1D5BCA22D"><enum>(i)</enum><text>any individual who
				has served on active duty (other than active duty for training) in the Armed
				Forces of the United States for more than 180 total days (whether consecutive
				or not),</text>
							</clause><clause id="HA2C933340D7549FC86C4E65BCF81AAF7"><enum>(ii)</enum><text>any individual
				who has been discharged or released from active duty in the Armed Forces of the
				United States for a service-connected disability, and</text>
							</clause><clause id="HF977F234078A44E4BC5D40EAA2A5365B"><enum>(iii)</enum><text>any member of
				the National Guard who has served for more than 180 total days (whether
				consecutive or not) of—</text>
								<subclause id="H551E1B4CABD44BF8B6262AADD555743B"><enum>(I)</enum><text>active duty
				(within the meaning of title 32, United States Code) other than for
				training,</text>
								</subclause><subclause id="H576DF26D41934AA3B7C47683AEB5488C"><enum>(II)</enum><text>full-time
				National Guard duty (within the meaning of such title 32) other than for
				training,</text>
								</subclause><subclause id="H5C8FA89777714CF88359F3463B1A968B"><enum>(III)</enum><text>duty, other than
				inactive duty or duty for training, in State status (within the meaning of such
				title 32), or</text>
								</subclause><subclause id="HAE2286CBDB6F479B9A47B4DFE5F77CD0"><enum>(IV)</enum><text>any combination
				of duty described in subclause (I), (II), or (III),</text>
								</subclause></clause><continuation-text continuation-text-level="subparagraph">who has
				been discharged or released from such duty at any time during the 5-year period
				ending on the hiring date. Such term shall not include any unemployed veteran
				who begins work for the employer before the date of the enactment of the
				<short-title>Veteran Employment Transition Act of
				2010</short-title>.</continuation-text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA5A64ADC980442A7959A1435B3D3D539"><enum>(C)</enum><header display-inline="yes-display-inline">Disadvantaged veteran</header><text display-inline="yes-display-inline">For purposes of subparagraph (A), the term
				<term>disadvantaged veteran</term> means any veteran who is certified by the
				designated local agency as—</text>
							<clause commented="no" display-inline="no-display-inline" id="H400A8523B5A74359A68C00EDC6B499A4"><enum>(i)</enum><text>being a member of
				a family receiving assistance under a supplemental nutrition assistance program
				under the Food and Nutrition Act of 2008 for at least a 3-month period ending
				during the 12-month period ending on the hiring date, or</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="H3FFA4B5D4E2D44DB8923BAAEB3F23FAB"><enum>(ii)</enum><text>entitled to
				compensation for a service-connected disability, and—</text>
								<subclause id="H5E62C0D4EF374ABA9A48D19D8DCEC696"><enum>(I)</enum><text>having a hiring
				date which is not more than 1 year after having been discharged or released
				from active duty in the Armed Forces of the United States, or</text>
								</subclause><subclause id="H7E456D451995493D9C17C8617149A8F0"><enum>(II)</enum><text>having aggregate
				periods of unemployment during the 1-year period ending on the hiring date
				which equal or exceed 6
				months.</text>
								</subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HD3FE83A0947043C3B2CA82E43A2FAFAD"><enum>(c)</enum><header>Conforming
			 amendments</header><text>Section 51 of the Internal Revenue Code of 1986 is
			 amended—</text>
				<paragraph id="HE1BD081780DA4E72A60324EAE106F430"><enum>(1)</enum><text>by striking
			 <quote>(d)(3)(A)(ii)</quote> in paragraph (3) of subsection (b) and inserting
			 <quote>(d)(3)(C)(ii)</quote>,</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE48F7D021E96482E92D3AA6EF4DEA764"><enum>(2)</enum><text>by striking
			 <quote>For purposes of subparagraph (A)</quote> each place it appears in
			 subparagraphs (D) and (E) of subsection (d)(3), as redesignated by subsection
			 (b), and inserting <quote>For purposes of subparagraph (C)</quote>,</text>
				</paragraph><paragraph id="H5BCCA11054B54927AB5150F2C651D0D7"><enum>(3)</enum><text>by adding at the
			 end of paragraph (13) of subsection (d) the following new subparagraph:</text>
					<quoted-block act-name="" id="HC1BD6B90AF9442B6B302CDCF406D2972" style="OLC">
						<subparagraph id="HE2862C787EFE4734AAAD041BB3278FBD"><enum>(D)</enum><header>Pre-screening of
				recently discharged veterans</header>
							<clause id="H2E3A53A154AA4CBF8BEB4CF8FE6CAACB"><enum>(i)</enum><header>In
				general</header><text>For purposes of subparagraph (A), the term
				<term>pre-screening notice</term> shall include any documentation provided to
				an individual by the Department of Defense or the National Guard upon release
				or discharge from the Armed Forces or from service in the National Guard which
				includes information sufficient to establish that such individual is a recently
				discharged veteran.</text>
							</clause><clause id="H96E058C2443B49AD979EDD0827EA5940"><enum>(ii)</enum><header>Additional
				certification not required</header><text>Subparagraph (A) shall be applied
				without regard to clause (ii)(II) thereof in the case of a recently discharged
				veteran who provides to the employer documentation described in clause
				(i).</text>
							</clause></subparagraph><after-quoted-block>,</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H21A66FEEF08C4E37B67BD47F686411DE"><enum>(4)</enum><text>by inserting
			 <quote>who begins work for the employer after December 31, 2008, and before the
			 date of the enactment of the <short-title>Veteran
			 Employment Transition Act of 2010</short-title>,</quote> after <quote>Any
			 unemployed veteran</quote> in subparagraph (A) of subsection (d)(14),
			 and</text>
				</paragraph><paragraph id="HD47EAA44D08E43DFA11E84A5D6F297BF"><enum>(5)</enum><text>by inserting a
			 comma after <quote>during 2009 or 2010</quote> in subparagraph (A) of
			 subsection (d)(14).</text>
				</paragraph></subsection><subsection id="H125CB1D401F84CCEBAFA76AA0D3F216A"><enum>(d)</enum><header>Effective
			 date</header><text>The amendments made by subsections (a), (b), and (c) shall
			 apply to individuals whose hiring date (as defined in section 51(d)(11) of the
			 Internal Revenue Code of 1986) is on or after the date of the enactment of this
			 Act.</text>
			</subsection><subsection id="HC6FD6F41E3F44C33BF75911668538977"><enum>(e)</enum><header>Department of
			 Defense documentation</header>
				<paragraph id="H321E6A00F27146B39420DC2CA17A857C"><enum>(1)</enum><header>In
			 general</header><text>The Department of Defense and the National Guard, as
			 applicable, shall provide—</text>
					<subparagraph id="HBDCA2D872080408099127FEE6C75D63B"><enum>(A)</enum><text>to each individual
			 who is discharged or released from active duty in the Armed Forces of the
			 United States on or after the date of the enactment of this Act; and</text>
					</subparagraph><subparagraph id="HFF1A2E7C9942412A83AA1A6E7C4A6B61"><enum>(B)</enum><text>to each member of
			 the National Guard who is released from duty described in section
			 51(d)(3)(B)(iii) of the Internal Revenue Code of 1986 (as added by this Act) on
			 or after the date of the enactment of this Act;</text>
					</subparagraph><continuation-text commented="no" continuation-text-level="paragraph">in addition to the documentation
			 which, without regard to this subsection, is provided at the time of such
			 discharge or release, documentation described in paragraph (4). If the
			 documentation which is provided without regard to this subsection at the time
			 of the discharge or release described in the preceding sentence does not
			 include information sufficient to satisfy the requirements of section
			 51(d)(13)(D)(i) of the Internal Revenue Code of 1986 (as added by this Act),
			 the Department of Defense or the National Guard, whichever is applicable, shall
			 provide additional documentation which includes such information.</continuation-text></paragraph><paragraph id="HC2A6E1AFCD9F4A6A8EDF973421D3F40D"><enum>(2)</enum><header>Informational
			 briefing</header><text>In the case of an individual who is discharged or
			 released from duty described in subparagraph (A) or (B) of paragraph (1) after
			 the date of the enactment of this Act, the Department of Defense or the
			 National Guard, whichever is applicable, shall provide a briefing to such
			 individual before or at the time of such discharge or release to inform such
			 individual of the credit for employment of recently discharged veterans under
			 section 51 of the Internal Revenue Code of 1986.</text>
				</paragraph><paragraph id="HDD448BB70A7D442F904D6F9486B57B3E"><enum>(3)</enum><header>Request for
			 documentation</header><text>The Department of Defense or the National Guard,
			 whichever is applicable, shall provide upon request the documentation described
			 in paragraph (1) to any individual who is discharged or released from duty
			 described in subparagraph (A) or (B) of paragraph (1) during the 5-year period
			 preceding and including the date of the enactment of this Act.</text>
				</paragraph><paragraph id="HD71BF9740DDE4B03A001D967BCB6D5CF"><enum>(4)</enum><header>Instructions for
			 use of work opportunity credit</header><text>The documentation described in
			 this paragraph is a document which includes—</text>
					<subparagraph id="HF35D33B3FFDE4F9586134CCC687F5E04"><enum>(A)</enum><text>instructions for
			 an individual to ensure treatment as a recently discharged veteran for purposes
			 of section 51(d)(3)(B) of the Internal Revenue Code of 1986 (as added by this
			 Act),</text>
					</subparagraph><subparagraph id="H594D00A5323A4B969D0556A31442BC9F"><enum>(B)</enum><text>instructions for
			 employers detailing the use of the credit under such section 51 with respect to
			 such individual, and</text>
					</subparagraph><subparagraph id="HBB6265B4DE4E452B9EA40BF9B79FA2A8"><enum>(C)</enum><text>the dates during
			 which the credit under such section 51 is available.</text>
					</subparagraph><continuation-text continuation-text-level="paragraph">Such
			 instructions shall be developed in collaboration with the Internal Revenue
			 Service.</continuation-text></paragraph></subsection></section></legis-body>
