		<official-title display="yes">To amend title 11, District of Columbia
		  Official Code, to revise certain administrative authorities of the District of
		  Columbia courts, to authorize the District of Columbia Public Defender Service
		  to provide professional liability insurance for officers and employees of the
		  Service for claims relating to services furnished within the scope of
		  employment with the Service, and for other purposes.</official-title>

		<section id="H95B1E468B78A4974AD31F5EEF006734B" section-type="section-one"><enum>1.</enum><header>Short Title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>D.C. Courts and Public Defender
			 Service Act of 2010</short-title></quote>.</text>
		</section><section id="H87E391F241FB4CE6BB8566BAE8D50471" section-type="subsequent-section"><enum>2.</enum><header>Authorities of
			 District of Columbia Courts</header>
			<subsection id="H6CD91540ACFB45E980A9CFE7D1E05A62"><enum>(a)</enum><header>Permitting
			 Judicial Conference on Biennial Basis; Attendance of Magistrate
			 Judges</header><text display-inline="yes-display-inline">Section 11–744,
			 District of Columbia Official Code, is amended—</text>
				<paragraph id="HFF421C42320A4F15BBAC3C49BE513C7C"><enum>(1)</enum><text>in the first
			 sentence, by striking <quote>annually</quote> and inserting <quote>biennially
			 or annually</quote>;</text>
				</paragraph><paragraph id="HA608E382F5EF4341B3E052E877A06B21"><enum>(2)</enum><text>in the first
			 sentence, by striking <quote>active judges</quote> and inserting <quote>active
			 judges and magistrate judges</quote>;</text>
				</paragraph><paragraph id="H7081B2E3994340AB86290435CE3DC9EE"><enum>(3)</enum><text>in the third
			 sentence, by striking <quote>Every judge</quote> and inserting <quote>Every
			 judge and magistrate judge</quote>; and</text>
				</paragraph><paragraph id="H5277F30A4C024E658249F44A237F6F39"><enum>(4)</enum><text display-inline="yes-display-inline">in the third sentence, by striking
			 <quote>Courts of Appeals</quote> and inserting <quote>Court of
			 Appeals</quote>.</text>
				</paragraph></subsection><subsection id="H234CD83B148A4781A6F05A7591A7966F"><enum>(b)</enum><header>Emergency
			 Authority to Toll or Delay Judicial Proceedings</header>
				<paragraph id="H798A69F741E741F693E1F919AF1B134D"><enum>(1)</enum><header>Proceedings in
			 Superior Court</header>
					<subparagraph id="HC46049CC292648A5BC3F25E2DCF396FC"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subchapter III of
			 <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/11/9">Chapter
			 9</external-xref> of title 11, District of Columbia Official Code, is amended
			 by adding at the end the following new section:</text>
						<quoted-block display-inline="no-display-inline" id="H74F30AEE5C7B49979E84A6CD56AC8A72" style="USC">
							<section id="H57C9FA2E28B24214B1C2617FAC48AE4C"><enum>11–947.</enum><header>Emergency
				authority to toll or delay proceedings.</header>
								<subsection id="H3E2DD02319CD4647A77EF9EF8FA672C9"><enum>(a)</enum><header>Tolling or
				delaying proceedings</header>
									<paragraph id="H1BD1E247487549848D375EDFF0BD8E4E"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">In the event of a
				natural disaster or other emergency situation requiring the closure of Superior
				Court or a natural disaster or other emergency situation rendering it
				impracticable for the United States or District of Columbia Government or a
				class of litigants to comply with deadlines imposed by any Federal or District
				of Columbia law or rule that applies in the Superior Court, the chief judge of
				the Superior Court may exercise emergency authority in accordance with this
				section.</text>
									</paragraph><paragraph id="H20FB4E075BFE4337978AE6EEBD8EC164"><enum>(2)</enum><header>Scope of
				authority</header><subparagraph commented="no" display-inline="yes-display-inline" id="HD95654FC777A43D28447C9358E764BC9"><enum>(A)</enum><text>The chief judge may
				enter such order or orders as may be appropriate to delay, toll, or otherwise
				grant relief from the time deadlines imposed by otherwise applicable laws or
				rules for such period as may be appropriate for any class of cases pending or
				thereafter filed in the Superior Court.</text>
										</subparagraph><subparagraph id="H67CC14CA165443C4A2A0C358497D00A2" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">The authority conferred by this section
				extends to all laws and rules affecting criminal and juvenile proceedings
				(including, pre-arrest, post-arrest, pretrial, trial, and post-trial
				procedures) and civil, family, domestic violence, probate and tax
				proceedings.</text>
										</subparagraph></paragraph><paragraph id="HA34DA0B127BE4E2BB9E330A42C4FF062"><enum>(3)</enum><header>Unavailability
				of chief judge</header><text display-inline="yes-display-inline">If the chief
				judge of the Superior Court is absent or disabled, the authority conferred by
				this section may be exercised by the judge designated under section 11–907(a)
				or by the Joint Committee on Judicial Administration.</text>
									</paragraph><paragraph id="HE6ECB6073959465887CD7D6F3F168356"><enum>(4)</enum><header>Habeas corpus
				unaffected</header><text display-inline="yes-display-inline">Nothing in this
				section shall be construed to authorize suspension of the writ of habeas
				corpus.</text>
									</paragraph><paragraph id="H1EBAA26D890340C4BA1F0EA7522DFEE9"><enum>(5)</enum><header>Definitions</header><text display-inline="yes-display-inline">For purposes of this subsection—</text>
										<subparagraph id="HCBA7E5F49F624BFBB3188B4AF37464F5"><enum>(A)</enum><text display-inline="yes-display-inline">the term <quote>natural disaster</quote>
				means any natural catastrophe (including any hurricane, tornado, storm, high
				water, wind-driven water, tidal wave, tsunami, earthquake, volcanic eruption,
				landslide, mudslide, snowstorm, or drought), or, regardless of cause, any fire,
				flood, or explosion; and</text>
										</subparagraph><subparagraph id="H713A6B34328144E082DB0CFCAB5E49B9"><enum>(B)</enum><text display-inline="yes-display-inline">the term <quote>other emergency
				situation</quote> includes but is not limited to any occasion or instance of
				terrorism, enemy attack, sabotage, other hostile action, disease, or any
				manmade cause which results in an imminent threat, severe damage, or injury to
				life or property, or loss thereof, or results in the destruction of or severe
				damage to a court house, or impairs the ability to access a courthouse, or the
				ability to staff the courts.</text>
										</subparagraph></paragraph></subsection><subsection id="H1C6E40B8C8BC4B768834A30FCFD14CFC"><enum>(b)</enum><header>Criminal
				Cases</header><text display-inline="yes-display-inline">In exercising the
				authority under this section for criminal cases, the chief judge shall consider
				the ability of the United States or District of Columbia Government to
				investigate, litigate, and process defendants during and after the emergency
				situation, as well as the ability of criminal defendants as a class to prepare
				their defenses.</text>
								</subsection><subsection id="H5618F157E8BA42B0B4FF8D870744BE2A"><enum>(c)</enum><header>Issuance of
				Orders</header><text display-inline="yes-display-inline">The United States
				Attorney for the District of Columbia or the Attorney General for the District
				of Columbia or the designee of either may request issuance of an order under
				this section, or the chief judge may act on his or her own motion.</text>
								</subsection><subsection id="H89271EF3000648CC82379CC03F577249"><enum>(d)</enum><header>Duration of
				Orders</header><text display-inline="yes-display-inline">An order entered under
				this section may not toll or extend a time deadline for a period of more than
				14 days, except that if the chief judge determines that an emergency situation
				requires additional extensions of the period during which deadlines are tolled
				or extended, the chief judge may, with the consent of the Joint Committee on
				Judicial Administration, enter additional orders under this section in order to
				further toll or extend such time deadline.</text>
								</subsection><subsection id="H03452475F8834EEB8DD504CAE21CF7F7"><enum>(e)</enum><header>Notice</header><text>Upon
				issuing an order under this section, the chief judge—</text>
									<paragraph id="HDF4B206E6965413AA90D5508A3E119E6"><enum>(1)</enum><text display-inline="yes-display-inline">shall make all reasonable efforts to
				publicize the order, including, when possible, announcing the order on the
				District of Columbia Courts web site; and</text>
									</paragraph><paragraph id="H957DA370E7D443969E4CA1F4ECAB429D"><enum>(2)</enum><text display-inline="yes-display-inline">shall send notice of the order, including
				the reasons for the issuance of the order, to the Committee on Homeland
				Security and Governmental Affairs of the Senate and the Committee on Oversight
				and Government Reform of the House of Representatives.</text>
									</paragraph></subsection><subsection id="H00B3F6AEBAD14B788F652AAB902C0015"><enum>(f)</enum><header>Required
				Reports</header><text display-inline="yes-display-inline">Not later than 180
				days after the expiration of the last extension or tolling of a time period
				made by the order or orders relating to an emergency situation, the chief judge
				shall submit a brief report to the Committee on Homeland Security and
				Governmental Affairs of the Senate, the Committee on Oversight and Government
				Reform of the House of Representatives, and the Joint Committee on Judicial
				Administration describing the orders, including—</text>
									<paragraph id="HC0D398B32E0A42E38D7A29353709CDEC"><enum>(1)</enum><text display-inline="yes-display-inline">the reasons for issuing the orders;</text>
									</paragraph><paragraph id="HAE3AB241B0B5457BB1B129163BBC618D"><enum>(2)</enum><text>the duration of
				the orders;</text>
									</paragraph><paragraph id="HCC3D9A53D3FA413389750C22BB178220"><enum>(3)</enum><text>the effects of the
				orders on litigants; and</text>
									</paragraph><paragraph id="HB05AA7A9B4BC4D2ABE442A5125E16270"><enum>(4)</enum><text>the costs to the
				court resulting from the orders.</text>
									</paragraph></subsection><subsection id="H13766F66F395443786CD48342BE39058"><enum>(g)</enum><header>Exceptions</header><text display-inline="yes-display-inline">The notice under subsection (e)(2) and the
				report under subsection (f) are not required in the case of an order that tolls
				or extends a time deadline for a period of less than 14
				days.</text>
								</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="H668157CE1704420EBF022C149ACF57F6"><enum>(B)</enum><header>Clerical
			 amendment</header><text display-inline="yes-display-inline">The table of
			 contents of
			 <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/11/9">chapter
			 9</external-xref> of title 11, District of Columbia Official Code, is amended
			 by adding at the end of the items relating to subchapter III the
			 following:</text>

			 general</header><text display-inline="yes-display-inline">Subchapter III of
			 <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/11/7">Chapter
			 7</external-xref> of title 11, District of Columbia Official Code, is amended
			 by adding at the end the following new section:</text>

				delaying proceedings</header>
									<paragraph id="H2DB211A6C32C4976B3BCDDD066A0703E"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">In the event of a
				natural disaster or other emergency situation requiring the closure of the
				Court of Appeals or a natural disaster or other emergency situation rendering
				it impracticable for the United States or District of Columbia Government or a
				class of litigants to comply with deadlines imposed by any Federal or District
				of Columbia law or rule that applies in the Court of Appeals, the chief judge
				of the Court of Appeals may exercise emergency authority in accordance with
				this section.</text>
									</paragraph><paragraph id="H1D6FD916F6C84451A482A9B91DD124D5"><enum>(2)</enum><header>Scope of
				authority</header><text display-inline="yes-display-inline">The chief judge may
				enter such order or orders as may be appropriate to delay, toll, or otherwise

										<subparagraph id="HC352A9984BE541F8B3EADD4C64BF6FF1"><enum>(A)</enum><text display-inline="yes-display-inline">the term <quote>natural disaster</quote>

				Security and Governmental Affairs of the Senate and the Committee on Oversight
				and Government Reform of the House of Representatives.</text>
									</paragraph></subsection><subsection id="H8AC5A9A7C09349818495565D89F831D0"><enum>(e)</enum><header>Required
				Reports</header><text display-inline="yes-display-inline">Not later than 180

									</paragraph></subsection><subsection id="H6A6DFEB0E4514532B3959D220FC63A4E"><enum>(f)</enum><header>Exceptions</header><text display-inline="yes-display-inline">The notice under subsection (d)(2) and the
				report under subsection (e) are not required in the case of an order that tolls
				or extends a time deadline for a period of less than 14
				days.</text>

			 amendment</header><text display-inline="yes-display-inline">The table of

			 Agreements to Provide Services on a Reimbursable Basis to Other District
			 Government Offices</header>
				<paragraph id="H269D8F12F9C14F89B17EF6CE07F0F136"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 11–1742,
			 District of Columbia Official Code, is amended by adding at the end the
			 following new subsection:</text>
					<quoted-block display-inline="no-display-inline" id="HC4E822614B404DC8A579D16D6308C592" style="traditional">
						<subsection id="H94EAC1A9A70B44B3928537E909ED0BD3"><enum>(d)</enum><text display-inline="yes-display-inline">To prevent duplication and to promote
				efficiency and economy, the Executive Officer may enter into agreements to
				provide the Mayor of the District of Columbia with equipment, supplies, and
				services and credit reimbursements received from the Mayor for such equipment,
				supplies, and services to the appropriation of the District of Columbia Courts
				against which they were
				charged.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H4EE2326A9AEC4CF0B0A4AAFD5342233F"><enum>(2)</enum><header>Effective
			 date</header><text>The amendment made by paragraph (1) shall apply with respect
			 to fiscal year 2010 and each succeeding fiscal year.</text>
				</paragraph></subsection></section><section id="H13ADDE9BECDA41CE8467CECC46027CD7" section-type="subsequent-section"><enum>3.</enum><header>Liability Insurance
			 for Public Defender Service</header><text display-inline="no-display-inline">Section 307 of the District of Columbia
			 Court Reform and Criminal Procedure Act of 1970 (sec. 2–1607, D.C. Official
			 Code) is amended by adding at the end the following new subsection:</text>
			<quoted-block display-inline="no-display-inline" id="H63DA9C71569D475E948F6E2F4A26D6B9" style="traditional">
				<subsection id="H5BB20AAB5EFF4C868DB216329B856ACF"><enum>(e)</enum><text display-inline="yes-display-inline">The Service shall, to the extent the
				Director considers appropriate, provide representation for and hold harmless,
				or provide liability insurance for, any person who is an employee, member of
				the Board of Trustees, or officer of the Service for money damages arising out
				of any claim, proceeding, or case at law relating to the furnishing of
				representational services or management services or related services under this
				Act while acting within the scope of that person’s office or employment,
				including but not limited to such claims, proceedings, or cases at law
				involving employment actions, injury, loss of liberty, property damage, loss of
				property, or personal injury, or death arising from malpractice or negligence
				of any such officer or
				employee.</text>
				</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H3138EE969C754D79827C9843D40E96CD"><enum>4.</enum><header>Reduction in term
			 of service of judges on family court of the superior court</header>
			<subsection id="H47E7123DED244E3FA746B9B66D2062AC"><enum>(a)</enum><header>Reduction in
			 term of service</header><text display-inline="yes-display-inline">Section
			 11–908A(c)(1), District of Columbia Official Code, is amended by striking
			 <quote>5 years</quote> and inserting <quote>3 years</quote>.</text>
			</subsection><subsection id="HBD05C21A94614EF5BA01127AE0290737"><enum>(b)</enum><header>Effective
			 date</header><text>The amendment made by subsection (a) shall apply with
			 respect to any individual serving as a judge on the Family Court of the
			 Superior Court of the District of Columbia on or after the date of the
			 enactment of this Act.</text>
