		<official-title>To limit the relief available to persons who have been
		  unconstitutionally prohibited from protesting at military and other
		  funerals.</official-title>

		<section display-inline="no-display-inline" id="H42CCEBC9D693458D86874CE41901F0D9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be referred to as the
			 <quote><short-title>Sons and Daughters of America
			 Act</short-title></quote>.</text>
		</section><section id="H649AFBC417EC49AEB3A82E20C296C7F4"><enum>2.</enum><header>Limitations on
			 liability to funeral protestors under the Revised Statutes</header>
			<subsection id="H3752D2FAF5374280A9DC8D4AC5EC558A"><enum>(a)</enum><header>Relief in civil
			 action</header><text>Section 1979 of the Revised Statutes of the United States
			 (42 U.S.C. 1983) is amended—</text>
				<paragraph id="HFA43C050F1DB40999BC96B26FEFBE14A"><enum>(1)</enum><text>by inserting
			 <quote><header-in-text level="subsection" style="OLC"><enum-in-header>(a)</enum-in-header></header-in-text></quote>
			 before the first sentence; and</text>
				</paragraph><paragraph id="H9A54D0F16750415E83878C06256C1DAB"><enum>(2)</enum><text>by adding at the
			 end the following new subsection:</text>
					<quoted-block display-inline="no-display-inline" id="HDBCFD593D8BF49CCB2CC974A7EE54FE9" style="OLC">
						<subsection id="HA0A2A86862D54B85B1F152E6280D48AA"><enum>(b)</enum><text display-inline="yes-display-inline">The party injured shall not be granted any
				relief other than injunctive or declaratory relief in a proceeding for redress
				under subsection (a) for an injury referred to in this subsection. The injury
				referred to in this subsection is a deprivation of the right to freedom of
				speech secured by the Constitution, if the deprivation is under authority of a
				statute, ordinance, regulation, custom, or usage that prohibits or restricts
				picketing, protesting, or demonstration at or in proximity to a funeral or any
				other ceremony, procession, or memorial service held in connection with the
				burial or cremation of the
				dead.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HB0EE1A3595EE490E8B270D43AB6E7EE9"><enum>(b)</enum><header>Attorney’s
			 fee</header><text>Section 722(b) of the Revised Statutes of the United States
			 (42 U.S.C. 1988(b)) is amended—</text>
				<paragraph id="HD72346BEFFDB44DCB08DF85BE9C271B7"><enum>(1)</enum><text>by inserting an em
			 dash after <quote>except that</quote>;</text>
				</paragraph><paragraph id="H8F9B91A578504BE1B7B49C7636962FDE"><enum>(2)</enum><text>by designating the
			 matter beginning with <quote>in any action brought against a judicial
			 officer</quote> and all that follows as a new paragraph (1);</text>
				</paragraph><paragraph id="H3DCE46E9E90C4E77A5FF54CA2B844575"><enum>(3)</enum><text>in paragraph (1)
			 (as designated by paragraph (2) of this subsection), by striking the period at
			 the end and inserting <quote>; and</quote>; and</text>
				</paragraph><paragraph id="H39BA2A8B3B854987A1386BD022DC87C0"><enum>(4)</enum><text>by adding after
			 such paragraph the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="H0B0F2C16138A42BE824C73392C0EFD5C" style="OLC">
						<paragraph id="HC9793C2DF2664A3AA1589198C388485F"><enum>(2)</enum><text display-inline="yes-display-inline">an attorney’s fee shall not be awarded in
				an action or proceeding to which section 1979(b)
				applies.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section commented="no" id="H64C68F0A9D934F6B9866464502B28ACC"><enum>3.</enum><header>Limitations on
			 liability of the United States and Federal officials to funeral
			 protestors</header><text display-inline="no-display-inline">Notwithstanding any
			 other provision of law, a court shall not grant any relief other than
			 injunctive or declaratory relief, and shall not award fees or expenses of
			 attorneys to the prevailing party, on a claim that—</text>
			<paragraph id="H76B9EC555E9F4688BA802CA70D6D09F8"><enum>(1)</enum><text>is brought against
			 the United States, a department or agency of the United States, or an official
			 of the United States acting in his or her official capacity; and</text>
			</paragraph><paragraph id="H9339B194783A40A1BA3542759C760EFF"><enum>(2)</enum><text display-inline="yes-display-inline">alleges an injury referred to in section
			 1979(b) of the Revised Statutes of the United States (42 U.S.C.
			 1983(b)).</text>
			</paragraph></section><section id="H34B4E5CE01154846B5448A2C708A119C"><enum>4.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">This Act and the
			 amendments made by this Act shall apply to any case that—</text>
			<paragraph id="HF6CF3EDFDA94468F86283301D7653E56"><enum>(1)</enum><text>is pending on the
			 date of enactment of this Act; or</text>
			</paragraph><paragraph id="H03C4D06D724D47EA913E6318C572AF40"><enum>(2)</enum><text>commences on or
			 after the date of enactment of this Act.</text>
