		<section id="HA92FE5A5E170486EAFAA3B779C2AD36A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Preventing Waste, Fraud, and Abuse Act of
			 2010</short-title></quote>.</text>
		</section><section id="H5B0EBA670CE94E1AAC5EA24CC6F75126"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds the following:</text>
			<paragraph id="HE4FA41590A4A4806915BE55158FB03D1"><enum>(1)</enum><text>To protect the
			 taxpayer and the Treasury, it is the responsibility of the Congress to provide
			 Federal agencies with the financial resources necessary to enforce the laws of
			 the United States and to prevent waste, fraud, and abuse of taxpayer’s
			 dollars.</text>
			</paragraph><paragraph id="H232401C862C940FEA1904AB3D209ED18"><enum>(2)</enum><text display-inline="yes-display-inline">For every $1 invested in the Department of
			 Health and Human Services and the Department of Justice for program integrity
			 efforts to prevent waste, fraud, and abuse of Medicare, Medicaid, and the
			 Children’s Health Insurance Program, approximately $1.55 will be saved,
			 according to a report issued by the Office of Management and Budget.</text>
			</paragraph><paragraph id="H579B5C2F3D424D45A865F7E7C7D1F002"><enum>(3)</enum><text display-inline="yes-display-inline">Increased program integrity efforts by the
			 Department of Health and Human Services and the Department of Justice can
			 provide an estimated savings of $4,470,000,000 on an investment of
			 $3,100,000,000 in Medicare, Medicaid, and the Children’s Health Insurance
			 Program over the next 5 fiscal years and an estimated savings of $9,870,000,000
			 on an investment of $6,753,000,000 over the next 10 fiscal years, according to
			 a report issued by the Office of Management and Budget.</text>
			</paragraph><paragraph id="HD57C04DA706348BE894AEFE8085754AD"><enum>(4)</enum><text display-inline="yes-display-inline">For every $1 invested in the Social
			 Security Administration for program integrity efforts to increase the volume of
			 continuing disability reviews conducted pursuant to section 221(i) of the
			 Social Security Act (42 U.S.C. 421(i)) to determine whether a recipient of
			 disability insurance benefits under section 223(a) of such Act (42 U.S.C.
			 423(a)) will continue to be eligible for such benefits, approximately $10 will
			 be saved, according to a report issued by the Office of Management and
			 Budget.</text>
			</paragraph><paragraph id="H551D5741F0EC4E9CB3C28B2D6FF2ED4F"><enum>(5)</enum><text display-inline="yes-display-inline">For every $1 invested in the Social
			 Security Administration for program integrity efforts to increase the volume of
			 continuing disability reviews conducted pursuant to section 1631(j) of Social
			 Security Act (42 U.S.C. 1383(j)) to determine whether a recipient of
			 supplemental security income benefits under section 1611 of such Act (42 U.S.C.
			 1382) will continue to be eligible for such benefits, approximately $8 will be
			 saved, according to a report issued by the Office of Management and
			 Budget.</text>
			</paragraph><paragraph id="H8C2A2DC11A904982B926800C0AC92E76"><enum>(6)</enum><text display-inline="yes-display-inline">Providing additional funding to the Social
			 Security Administration to increase the volume of continuing disability reviews
			 conducted pursuant to sections 221(i) and 1631(j) of Social Security Act (42
			 U.S.C. 421(i), 1383(j), respectively) can provide an estimated savings of
			 $16,102,000,000 on an investment of $3,953,000,000 over the next 5 fiscal years
			 and an estimated savings of $57,838,000,000 on an investment of $10,252,000,000
			 over the next 10 fiscal years, according to a report issued by the Office of
			 Management and Budget.</text>
			</paragraph><paragraph id="H653F6202CAC0482CB7AA5BAF9813D1D5"><enum>(7)</enum><text display-inline="yes-display-inline">The tax gap, the difference between the
			 annual amount of Federal income taxes owed and the amount voluntarily paid on
			 time, places an undue burden upon the overwhelming majority of taxpayers who
			 fully and voluntarily pay their taxes on time.</text>
			</paragraph><paragraph id="HCD13ED754FF74BD5A7F73315D1C83456"><enum>(8)</enum><text>In a report
			 released in 2009 by the Internal Revenue Service, it was estimated that in 2005
			 (the most recent estimate available) the gross tax gap was $345,000,000,000 and
			 the net tax gap (after the collection of late and enforced payments) was
			 $290,000,000,000.</text>
			</paragraph><paragraph id="H7D90E1F26BCA46C28364FEB40EEC5F40"><enum>(9)</enum><text display-inline="yes-display-inline">In 2009, for every $1 that was invested for
			 the purposes of enforcing the tax code, the Internal Revenue Service returned
			 an average of $4 to the Treasury, with some enforcement activities returning as
			 much as $11 for every $1 invested, according to a report issued by the Office
			 of Management and Budget.</text>
			</paragraph><paragraph id="HE10DBD43551E488A93565B81E0D48B53"><enum>(10)</enum><text display-inline="yes-display-inline">By increasing overall tax enforcement
			 efforts, the Internal Revenue Service can provide an estimated savings of
			 $13,874,000,000 on an investment of $8,869,000,000 over the next 5 fiscal years
			 and an estimated savings of $62,217,000,000 on an investment of $23,275,000,000
			 over the next 10 fiscal years, according to a report issued by the Office of
			 Management and Budget.</text>
			</paragraph><paragraph id="HD4E6D66D5D8743ED9F2661DD8F3DA2A5"><enum>(11)</enum><text display-inline="yes-display-inline">For each $1 invested to increase the volume
			 of in-person reemployment and eligibility assessments conducted by States for
			 the Department of Labor’s unemployment insurance program, approximately $3.19
			 will be saved over the next 10 years, according to a report issued by the
			 Office of Management and Budget.</text>
			</paragraph><paragraph id="HD424FB412F7F4173A347EE79C86C56CD"><enum>(12)</enum><text display-inline="yes-display-inline">States will save the Department of Labor’s
			 unemployment insurance program an estimated $937,000,000 on an investment of
			 $325,000,000 by increasing the volume of in-person reemployment and eligibility
			 assessments over the next 5 fiscal years and an estimated savings of
			 $2,296,000,000 on an investment of $720,000,000 over the next 10 fiscal years,
			 according to a report issued by the Office of Management and Budget.</text>
			</paragraph><paragraph id="H1BE317BF6310434FA7A5DF47989116F3"><enum>(13)</enum><text>The investments
			 described in the preceding paragraphs, if carried out, will save the taxpayers
			 nearly $2,000,000,000 during fiscal year 2011, while laying the foundations for
			 saving more than $35,000,000,000 over the next 5 fiscal years and more than
			 $132,000,000,000 over the next 10 fiscal years.</text>
			</paragraph></section><section id="HC0FEC1F443AF40D7BAAF8860C6CE10CD"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="H1871526AFCD34455A74BACED1358BEE5"><enum>(1)</enum><header>Agency
			 head</header><text display-inline="yes-display-inline">The term <term>agency
			 head</term> means—</text>
				<subparagraph id="H92CCE9AD8DF645AE8865EBA90B4DB1B3"><enum>(A)</enum><text>the Attorney
			 General;</text>
				</subparagraph><subparagraph id="HFD10C6A714FB46258C33A98AC199539D"><enum>(B)</enum><text>the Commissioner
			 of Social Security;</text>
				</subparagraph><subparagraph id="H42A74C35E0D4421F992C18E58582B2CA"><enum>(C)</enum><text>the Secretary of
			 Health and Human Services;</text>
				</subparagraph><subparagraph id="H1B40E45A7BEB4D169C0C832C37EEC1DB"><enum>(D)</enum><text>the Secretary of
			 Labor; and</text>
				</subparagraph><subparagraph id="H493B10D6211F412B91472EAEC505E604"><enum>(E)</enum><text>the Secretary of
			 the Treasury.</text>
				</subparagraph></paragraph><paragraph id="H4839EC1885A3463685C3EF759C5F9031"><enum>(2)</enum><header>Director</header><text display-inline="yes-display-inline">The term <term>Director</term> means the
			 Director of the Office of Management and Budget.</text>
			</paragraph></section><section id="HE29B5D8F0F23466282C4130B5B95A45C"><enum>4.</enum><header>Increasing
			 program integrity efforts</header>
			<subsection id="HAABF7B507ADF4A7A8C000EED36E8BCAD"><enum>(a)</enum><header>Program
			 integrity efforts</header>
				<paragraph id="H094444A017714137840863FB27491963"><enum>(1)</enum><header>In
			 general</header><text>Each agency head, in consultation with the Director,
			 shall—</text>
					<subparagraph id="H979F6B756CA44F9BABF8063FEF688CE5"><enum>(A)</enum><text>identify existing
			 Federal laws and regulations that may impede the ability to decrease waste,
			 fraud, and abuse of funds appropriated to the agency head’s agency; and</text>
					</subparagraph><subparagraph id="HD8578366DE274363B21FF962363AFB03"><enum>(B)</enum><text display-inline="yes-display-inline">develop appropriate performance metrics to
			 measure such agency’s success in decreasing waste, fraud, and abuse.</text>
					</subparagraph></paragraph><paragraph id="H1EA898554DB844E3B4433CC4ABBE7045"><enum>(2)</enum><header>Development of
			 metrics</header><text display-inline="yes-display-inline">In developing
			 performance metrics referred to in paragraph (1)(B), each agency head
			 shall—</text>
					<subparagraph id="H59857125274D4A73BF04151C60C07C46"><enum>(A)</enum><text display-inline="yes-display-inline">ensure that such metrics accurately
			 demonstrate the effectiveness of the programs and activities referred to in
			 subsection (d) in decreasing waste, fraud, and abuse;</text>
					</subparagraph><subparagraph id="HC1F398998DD747A8903185F1E9A111C8"><enum>(B)</enum><text display-inline="yes-display-inline">provide estimates for points of diminishing
			 returns on the funds provided under this Act to increase program integrity
			 efforts;</text>
					</subparagraph><subparagraph id="HA90EF5BDB56C465FA751C845F3122A4F"><enum>(C)</enum><text>identify optimal
			 baselines for each of the metrics developed under this subsection and
			 appropriate methods to measure variations from such baselines; and</text>
					</subparagraph><subparagraph id="H8E9649D5E8AF4855915B2448600AE153"><enum>(D)</enum><text display-inline="yes-display-inline">set performance targets for each of fiscal
			 years 2012 through 2020.</text>
					</subparagraph></paragraph></subsection><subsection id="H43E68D86AC224BCD94E99499BF563ED1"><enum>(b)</enum><header>Innovation and
			 development</header><text display-inline="yes-display-inline">Each agency head
			 shall make appropriate accommodations for innovation and development to address
			 the program integrity efforts for programs and activities referred to in
			 subsection (d).</text>
			</subsection><subsection id="H4662EA26850E4B15AFB5D5A2E7162589"><enum>(c)</enum><header>Reports</header>
				<paragraph id="HF4A31765AFD04A6EBBC9253D708C6474"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Each agency head
			 shall submit to Congress—</text>
					<subparagraph id="H4172D6C8F75D4902B856DD3EC36C484E"><enum>(A)</enum><text display-inline="yes-display-inline">not later than 6 months after the date of
			 enactment of this Act, an interim report that includes a description of—</text>
						<clause id="HAA114320A5CC4903AC52D7B655B43497"><enum>(i)</enum><text>what the performance metrics developed under subsection (a) will be measuring;
			 and</text>
						</clause><clause id="H54B1F4995F714787BFD8629EB0EE32A2"><enum>(ii)</enum><text display-inline="yes-display-inline">how such metrics will measure and provide
			 an accurate analysis of the performance of the applicable programs and
			 activities referred to in subsection (d); and</text>
						</clause></subparagraph><subparagraph id="H6F61AC7EE60649B19881AA7A250BB01E"><enum>(B)</enum><text display-inline="yes-display-inline">not later than 1 year after the date of
			 enactment of this Act, a final report that sets forth the performance metrics
			 developed under subsection (a).</text>
					</subparagraph></paragraph><paragraph id="HAFD379B0417D4A88A21A92A2B86FAACC"><enum>(2)</enum><header>Federal
			 register; Web site</header><text display-inline="yes-display-inline">Each
			 agency head shall publish in the Federal Register and make available on the
			 agency Web site the performance metrics set forth in its final report submitted
			 under paragraph (1)(B) not later than 30 days after such report is
			 submitted.</text>
				</paragraph><paragraph display-inline="no-display-inline" id="H2A3814632041419B9984E0638AB5024B"><enum>(3)</enum><header>Modification of
			 performance metrics</header><text display-inline="yes-display-inline">Not later
			 than 30 days after the date on which any performance metrics developed under
			 subsection (a) are modified by an agency head, such agency head shall submit to
			 Congress a written notice describing such modifications.</text>
				</paragraph><paragraph id="HEF79A29A584240A1AB161591FD952CAC"><enum>(4)</enum><header>OMB annual
			 report</header><text display-inline="yes-display-inline">Using the performance
			 metrics developed under subsection (a), each year, beginning with the first
			 fiscal year following the date on which the final reports are required to be
			 submitted under paragraph (1)(B), on or after the first Monday in January but
			 not later than the first Monday in February, the Director shall submit to
			 Congress an annual report measuring the success of the agency head’s agency in
			 decreasing waste, fraud, and abuse of funds appropriated to such agency. Each
			 annual report shall include a summary of and justifications for any modified
			 performance metrics submitted to Congress pursuant to paragraph (3).</text>
				</paragraph><paragraph id="H07DC7B0FE6904C348018980064A6E140"><enum>(5)</enum><header>Referral of
			 reports</header><text display-inline="yes-display-inline">Each report submitted
			 pursuant to this subsection shall be referred to the Committee on
			 Appropriations and the Committee on the Budget of the House of Representatives
			 and the Committee on Appropriations and the Committee on the Budget of the
			 Senate, and any other appropriate committee of jurisdiction.</text>
				</paragraph></subsection><subsection id="H8CE1115BD41B418DA4C1759EED2E62E0"><enum>(d)</enum><header>Authorization of
			 appropriations</header>
				<paragraph id="H424EA97A76134A1E88654ADFE116FF07"><enum>(1)</enum><header>Department of
			 Health and Human Services; Department of Justice</header><text display-inline="yes-display-inline">For the purposes of continuing and
			 increasing program integrity efforts of the Department of Health and Human
			 Services and the Department of Justice to prevent waste, fraud, and abuse of
			 Medicare, Medicaid, and the Children’s Health Insurance Program, there are
			 authorized to be appropriated the following sums:</text>
					<subparagraph id="H5F479734A58744BBBE2037F2FBC24DC3"><enum>(A)</enum><text>$561,000,000 for
			 fiscal year 2011, to remain available through September 30, 2012.</text>
					</subparagraph><subparagraph id="H7DEF7432A53D4239892AD2553A71838C"><enum>(B)</enum><text>$589,000,000 for
			 fiscal year 2012, to remain available through September 30, 2013.</text>
					</subparagraph><subparagraph id="H041AD667B00747078E1770D7C37EFAC8"><enum>(C)</enum><text>$619,000,000 for
			 fiscal year 2013, to remain available through September 30, 2014.</text>
					</subparagraph><subparagraph id="H548FC76A8E604ACB83013199C786A40B"><enum>(D)</enum><text>$649,000,000 for
			 fiscal year 2014, to remain available through September 30, 2015.</text>
					</subparagraph><subparagraph id="H535BCF16F01347A386A05F0EF2D9B552"><enum>(E)</enum><text>$682,000,000 for
			 fiscal year 2015, to remain available through September 30, 2016.</text>
					</subparagraph><subparagraph id="HCDC3C0F152904F2EA664D943C07B77CD"><enum>(F)</enum><text>$3,653,000,000 for
			 the period encompassing fiscal years 2016 through 2020.</text>
					</subparagraph></paragraph><paragraph id="H13893A189D2848F9A3E19E160DBFDD85"><enum>(2)</enum><header>Social Security
			 Administration</header><text display-inline="yes-display-inline">For the
			 purposes of continuing and increasing program integrity efforts of the Social
			 Security Administration by increasing the volume of continuing disability
			 reviews conducted pursuant to sections 221(i) and 1631(j) of the Social
			 Security Act (42 U.S.C. 421(i), 1383(j), respectively), there are authorized to
			 be appropriated to the Commissioner of Social Security the following
			 sums:</text>
					<subparagraph id="H06D65C93A72A4A37A8F23C16DB697D2B"><enum>(A)</enum><text display-inline="yes-display-inline">$513,000,000 for fiscal year 2011, to
			 remain available through September 30, 2012.</text>
					</subparagraph><subparagraph id="HDFA4FD84496A4726AAF628F39EFE6BE1"><enum>(B)</enum><text>$642,000,000 for
			 fiscal year 2012, to remain available through September 30, 2013.</text>
					</subparagraph><subparagraph id="H195D41EFAB304224BC52BD1B6AFA3252"><enum>(C)</enum><text>$751,000,000 for
			 fiscal year 2013, to remain available through September 30, 2014.</text>
					</subparagraph><subparagraph id="H13B7C929A9B246AB8DF9E8C51CD7057F"><enum>(D)</enum><text>$924,000,000 for
			 fiscal year 2014, to remain available through September 30, 2015.</text>
					</subparagraph><subparagraph id="H182BD7E5C8F8488FAB9F0EF3546A2093"><enum>(E)</enum><text>$1,123,000,000 for

					</subparagraph></paragraph><paragraph id="H9F22D4DE665647488227285DE034C6A8"><enum>(3)</enum><header>Department of
			 the Treasury</header><text display-inline="yes-display-inline">For purposes of
			 continuing and increasing program integrity efforts of the Department of the
			 Treasury by expanding tax enforcement activities, there are authorized to be
			 appropriated to the Secretary of the Treasury the following sums:</text>
					<subparagraph id="H06E629D7AA8F44EF97D221FC1EA53F67"><enum>(A)</enum><text display-inline="yes-display-inline">$1,115,000,000 for fiscal year 2011, to
			 remain available through September 30, 2012.</text>
					</subparagraph><subparagraph id="HEFC20E52382F490582E8FE719FBFCB2D"><enum>(B)</enum><text>$1,357,000,000 for
			 fiscal year 2012, to remain available through September 30, 2013.</text>
					</subparagraph><subparagraph id="HEEB0ECA3A929410EAFD6ACC561DA275E"><enum>(C)</enum><text>$1,724,000,000 for
			 fiscal year 2013, to remain available through September 30, 2014.</text>
					</subparagraph><subparagraph id="HB7347A75F97142F680D7F16C70057974"><enum>(D)</enum><text>$2,105,000,000 for
			 fiscal year 2014, to remain available through September 30, 2015.</text>
					</subparagraph><subparagraph id="H4CFE2681B9F140968A4C8DEF94FED232"><enum>(E)</enum><text>$2,568,000,000 for
			 fiscal year 2015, to remain available through September 30, 2016.</text>
					</subparagraph><subparagraph id="HD00A199AE65348F09A9717732E235F69"><enum>(F)</enum><text display-inline="yes-display-inline">$14,406,000,000 for the period encompassing
			 fiscal years 2016 through 2020.</text>
					</subparagraph></paragraph><paragraph id="HDE530E4D96FF4180B28860FCBF332A4F"><enum>(4)</enum><header>Department of
			 Labor</header><text display-inline="yes-display-inline">For purposes of
			 continuing and increasing program integrity efforts of the Department of Labor
			 by increasing the volume of in-person reemployment and eligibility assessments
			 of unemployment insurance beneficiaries conducted by States, there are
			 authorized to be appropriated to the Secretary of Labor the following
			 sums:</text>
					<subparagraph id="H5E3B3C055E984B2A90A1019218EAF25B"><enum>(A)</enum><text display-inline="yes-display-inline">$55,000,000 for fiscal year 2011, to remain
			 available through September 30, 2012.</text>
