			</subsection></section><title id="HBD32360B22E04E47A26F00B72647ACC1"><enum>I</enum><header>Sunsetting of
			 Federal Agencies</header>
			<section display-inline="no-display-inline" id="H9366FD109DD24F8BBC004709CEA3B0AC" section-type="subsequent-section"><enum>101.</enum><header>Review and
			 abolishment of Federal agencies</header>
				<subsection id="H93F3141F7E6B42F58BC860557B345C70"><enum>(a)</enum><header>Schedule for
			 review</header><text>Not later than one year after the date of the enactment of
			 this Act, the Federal Agency Sunset Commission established under section 102
			 (in this title referred to as the <quote>Commission</quote>) shall submit to
			 Congress a schedule for review by the Commission, at least once every 12 years
			 (or less, if determined appropriate by Congress), of the abolishment or
			 reorganization of each agency.</text>
				</subsection><subsection id="HB213E6FCD19545C700E808B22D42C88F"><enum>(b)</enum><header>Review of
			 agencies performing related functions</header><text>In determining the schedule
			 for review of agencies under subsection (a), the Commission shall provide that
			 agencies that perform similar or related functions be reviewed concurrently to
			 promote efficiency and consolidation.</text>
				</subsection><subsection id="H118FA53A62204EBCA152A0A885E52D7E"><enum>(c)</enum><header>Abolishment of
			 agencies</header>
					<paragraph id="H2DB65B327980438BA4A9F351B52E80BB"><enum>(1)</enum><header>In
			 general</header><text>Each agency shall—</text>
						<subparagraph id="H76150D2C0E9441E4BA4FF39CE68B3924"><enum>(A)</enum><text>be reviewed
			 according to the schedule created pursuant to this section; and</text>
						</subparagraph><subparagraph id="H2354182CF71B4366B3BA272E6C68821E"><enum>(B)</enum><text>be abolished not
			 later than one year after the date that the Commission completes its review of
			 the agency pursuant to such schedule, unless the agency is reauthorized by the
			 Congress.</text>
						</subparagraph></paragraph><paragraph id="H9EB3E053D5D9440496A9E1611700CD4F"><enum>(2)</enum><header>Extension</header><text>The
			 deadline for abolishing an agency may be extended for an additional two years
			 after the date described in paragraph (1)(B) if the Congress enacts legislation
			 extending such deadline by a vote of a super majority of the House of
			 Representatives and the Senate.</text>
					</paragraph></subsection></section><section display-inline="no-display-inline" id="H283091CAA1984080B91F6EC73452EF88" section-type="subsequent-section"><enum>102.</enum><header>Establishment of
			 Commission</header>
				<subsection id="H3076E866B0DF45C4A217E8F8C329C9A3"><enum>(a)</enum><header>Establishment</header><text>There
			 is established a commission to be known as the <quote>Federal Agency Sunset
			 Commission</quote>.</text>
				</subsection><subsection id="H401D9859178A4675848011A3414146C3"><enum>(b)</enum><header>Composition</header><text>The
			 Commission shall be composed of 12 members (in this title referred to as the
			 <quote>members</quote>) who shall be appointed as follows:</text>
					<paragraph id="H64486C60C71746219EA48D9FB2D37BCB"><enum>(1)</enum><text>Six members shall
			 be appointed by the Speaker of the House of Representatives, one of whom may
			 include the Speaker of the House of Representatives, with minority members
			 appointed with the consent of the minority leader of the House of
			 Representatives.</text>
					</paragraph><paragraph id="H5EE841E977A54D82AEA57D1BD803BDA4"><enum>(2)</enum><text>Six members shall
			 be appointed by the majority leader of the Senate, one of whom may include the
			 majority leader of the Senate, with minority members appointed with the consent
			 of the minority leader of the Senate.</text>
					</paragraph></subsection><subsection id="H9D7C396EB4D84F159244FBC25DBDE292"><enum>(c)</enum><header>Qualifications
			 of members</header>
					<paragraph id="H00A98AEB320246899E071E501546F7D6"><enum>(1)</enum><header>In
			 general</header><subparagraph commented="no" display-inline="yes-display-inline" id="HD93ACCA0A8CB4129935E80DEF791622"><enum>(A)</enum><text>Of
			 the members appointed under subsection (b)(1), four shall be members of the
			 House of Representatives (not more than two of whom may be of the same
			 political party), and two shall be an individual described in subparagraph
			 (C).</text>
						</subparagraph><subparagraph id="H90A0E8A443D7430E9FA25C4D0090BAB6" indent="up1"><enum>(B)</enum><text>Of the members appointed under
			 subsection (b)(2), four shall be members of the Senate (not more than two of
			 whom may be of the same political party) and two shall be an individual
			 described in subparagraph (C).</text>
						</subparagraph><subparagraph id="H7580A4A5DFDD4DFE8492F898CDD5A63E" indent="up1"><enum>(C)</enum><text>An individual under this subparagraph
			 is an individual—</text>
							<clause id="H23407B731E0140488BFD66CF3695E00"><enum>(i)</enum><text>who is not a member of Congress;
			 and</text>
							</clause><clause id="H6CD4E4F31FF94366B052EACD007370E6"><enum>(ii)</enum><text>with expertise in the operation
			 and administration of Government programs.</text>
							</clause></subparagraph></paragraph><paragraph id="H9245AA7073AB4D7688B6FE206500FA79"><enum>(2)</enum><header>Continuation of
			 membership</header><text>If a member was appointed to the Commission as a
			 Member of Congress and the member ceases to be a Member of Congress, that
			 member shall cease to be a member of the Commission. The validity of any action
			 of the Commission shall not be affected as a result of a member becoming
			 ineligible to serve as a member for the reasons described in this
			 paragraph.</text>
					</paragraph></subsection><subsection id="HF45444C8D37449E59E7DD1D38CAB459D"><enum>(d)</enum><header>Initial
			 appointments</header><text>All initial appointments to the Commission shall be
			 made not later than 90 days after the date of the enactment of this Act.</text>
				</subsection><subsection id="HA08E1E6A71534BF09857C2F451D6BC1D"><enum>(e)</enum><header>Chairman; vice
			 Chairman</header>
					<paragraph id="H59651B5B79954D9CBEC5CD0026C7D351"><enum>(1)</enum><header>Initial
			 Chairman</header><text>An individual shall be designated by the Speaker of the
			 House of Representatives from among the members initially appointed under
			 subsection (b)(1) to serve as chairman of the Commission for a period of 2
			 years.</text>
					</paragraph><paragraph id="H2A3F3B9917EB4D9DABE453ACE9D89830"><enum>(2)</enum><header>Initial
			 vice-chairman</header><text>An individual shall be designated by the majority
			 leader of the Senate from among the individuals initially appointed under
			 subsection (b)(2) to serve as vice-chairman of the Commission for a period of
			 two years.</text>
					</paragraph><paragraph id="H0F33E70CFF584F9BB681B8F54822E1A6"><enum>(3)</enum><header>Alternate
			 appointments of chairmen and vice-chairmen</header><text>Following the
			 termination of the two-year period described in paragraphs (1) and (2), the
			 Speaker and the majority leader shall alternate every two years in appointing
			 the chairman and vice-chairman of the Commission.</text>
					</paragraph></subsection><subsection id="H40C66CEB5C294368A25D5F2D47BAC00"><enum>(f)</enum><header>Terms of
			 members</header>
					<paragraph id="HAB6752B79F6044CCAE3B2BC1816727BB"><enum>(1)</enum><header>Members of
			 Congress</header><text>Each member appointed to the Commission who is a member
			 of Congress shall serve for a term of six years, except that, of the members
			 first appointed under paragraphs (1) and (2) of subsection (b), 2 members shall
			 be appointed to serve a term of three years under each such paragraph.</text>
					</paragraph><paragraph id="HADCDD734460D43ADAA1E76AF7D550744"><enum>(2)</enum><header>Other
			 members</header><text>Each member of the Commission who is not a member of
			 Congress shall serve for a term of three years.</text>
					</paragraph><paragraph id="H225D4ADC9CCB4FF28043CFBF2B6DA101"><enum>(3)</enum><header>Term
			 limit</header><subparagraph commented="no" display-inline="yes-display-inline" id="H5819222225C1431D8F6C775F71973EE7"><enum>(A)</enum><text>A
			 member of the Commission who is a member of Congress and who serves more than
			 three years of a term may not be appointed to another term as a member.</text>
						</subparagraph><subparagraph id="H2D677C6C5D5C412690E273434F35F7BD" indent="up1"><enum>(B)</enum><text>A member of the Commission who is not
			 a member of Congress and who serves as a member of the Commission for more than
			 56 months may not be appointed to another term as a member.</text>
						</subparagraph></paragraph></subsection><subsection id="HFA34DA35314248F8B9E87A46BD6A2C6"><enum>(g)</enum><header>Powers of
			 Commission</header>
					<paragraph id="H276F9D84FF7A415BB003B96673080000"><enum>(1)</enum><header>Hearings and
			 sessions</header><text>The Commission may, for the purpose of carrying out this
			 title, hold such hearings, sit and act at such times and places, take such
			 testimony, and receive such evidence as the Commission considers appropriate.
			 The Commission may administer oaths to witnesses appearing before it.</text>
					</paragraph><paragraph id="H6FDC46584E0A4572963700F1EFAB3338"><enum>(2)</enum><header>Obtaining
			 information</header><text>The Commission may secure directly from any
			 department or agency of the United States information necessary to enable it to
			 carry out its duties under this title. Upon request of the Chairman, the head
			 of that department or agency shall furnish that information to the Commission
			 in a full and timely manner.</text>
					</paragraph><paragraph id="HEA258B4FA75C475AAF8D4E84CA771D00"><enum>(3)</enum><header>Subpoena
			 power</header><subparagraph commented="no" display-inline="yes-display-inline" id="H8891373CCC134C279086F1CFEA00FE6"><enum>(A)</enum><text>The
			 Commission may issue a subpoena to require the attendance and testimony of
			 witnesses and the production of evidence relating to any matter under
			 investigation by the Commission.</text>
						</subparagraph><subparagraph id="H17B7E4566D014346A15300E4FD001BE9" indent="up1"><enum>(B)</enum><text>If a person refuses to obey an order
			 or subpoena of the Commission that is issued in connection with a Commission
			 proceeding, the Commission may apply to the United States district court in the
			 judicial district in which the proceeding is held for an order requiring the
			 person to comply with the subpoena or order.</text>
						</subparagraph></paragraph><paragraph id="HAA2D849DE3CA46828735F34C80B8B55E"><enum>(4)</enum><header>Immunity</header><text>The
			 Commission is an agency of the United States for purposes of part V of title
			 18, United States Code (relating to immunity of witnesses).</text>
					</paragraph><paragraph id="H36813A803657435E9CC1ECBAB67218A3"><enum>(5)</enum><header>Contract
			 authority</header><text>The Commission may contract with and compensate
			 government and private agencies or persons for services without regard to
			 section 3709 of the Revised Statutes (41 U.S.C. 5).</text>
					</paragraph></subsection><subsection id="HDFC578F68CA94D9D9E583433192DAD59"><enum>(h)</enum><header>Commission
			 procedures</header>
					<paragraph id="H1E098958BF0946F3866C42A1DFBF48FA"><enum>(1)</enum><header>Meetings</header><text>The
			 Commission shall meet at the call of the Chairman.</text>
					</paragraph><paragraph id="H2A8100839A1C483C98C23D88F71667E4"><enum>(2)</enum><header>Quorum</header><text>Seven
			 members of the Commission shall constitute a quorum but a lesser number may
			 hold hearings.</text>
					</paragraph></subsection><subsection id="H470BA418B77544108F8183D7A5AFBA84"><enum>(i)</enum><header>Personnel
			 matters</header>
					<paragraph id="H66D957DACCCA45DBBF36BCB000B8CFA4"><enum>(1)</enum><header>Compensation</header><text>Members
			 shall not be paid by reason of their service as members.</text>
					</paragraph><paragraph id="H9E6306FF94604286BAA882F1B3D313AC"><enum>(2)</enum><header>Travel
			 expenses</header><text>Each member shall receive travel expenses, including per
			 diem in lieu of subsistence, in accordance with sections 5702 and 5703 of title
			 5, United States Code.</text>
					</paragraph><paragraph id="HDB5ED81CF22343A49E61D600A109C066"><enum>(3)</enum><header>Director</header><text>The
			 Commission shall have a Director who shall be appointed by the Chairman. The
			 Director shall be paid at a rate not to exceed the maximum rate of basic pay
			 payable for GS–15 of the General Schedule.</text>
					</paragraph><paragraph id="H50DC41EFAAB34A96B18B296765A8DD72"><enum>(4)</enum><header>Staff</header><text>The
			 Director may appoint and fix the pay of additional personnel as the Director
			 considers appropriate.</text>
					</paragraph><paragraph id="H0A9DCD841C504E69B0B8A46FDDAE3CAC"><enum>(5)</enum><header>Applicability of
			 certain civil service laws</header><text>The Director and staff of the
			 Commission shall be appointed subject to the provisions of title 5, United
			 States Code, governing appointments in the competitive service, and shall be
			 paid in accordance with the provisions of chapter 51 and subchapter III of
			 chapter 53 of that title relating to classification and General Schedule pay
			 rates.</text>
					</paragraph></subsection><subsection id="HC8D03900EF124098B78CE1E3EA1FEA02"><enum>(j)</enum><header>Other
			 administrative matters</header>
					<paragraph id="HF57A0A63F50E4283A3ADFB239EAA829B"><enum>(1)</enum><header>Postal and
			 printing services</header><text>The Commission may use the United States mails
			 and obtain printing and binding services in the same manner and under the same
			 conditions as other departments and agencies of the United States.</text>
					</paragraph><paragraph id="HD41B36271B654B6095963269DD075B7"><enum>(2)</enum><header>Administrative
			 support services</header><text>Upon the request of the Commission, the
			 Administrator of General Services shall provide to the Commission, on a
			 reimbursable basis, the administrative support services necessary for the
			 Commission to carry out its duties under this title.</text>
					</paragraph><paragraph id="HA06918F39EE447818D56DBA2C91BE610"><enum>(3)</enum><header>Experts and
			 consultants</header><text>The Commission may procure temporary and intermittent
			 services under section 3109(b) of title 5, United States Code.</text>
					</paragraph></subsection><subsection id="H68553752ED634F808CD05FC3AF66A722"><enum>(k)</enum><header>Sunset of
			 Commission</header><text>The Commission shall terminate on December 31, 2033,
			 unless reauthorized by Congress.</text>
				</subsection></section><section display-inline="no-display-inline" id="H8020A1B111924D8E976BEFAE9565616F" section-type="subsequent-section"><enum>103.</enum><header>Review of efficiency
			 and need for Federal agencies</header>
				<subsection id="H1015DFB2608A4CA9A2E5076E24790060"><enum>(a)</enum><header>In
			 general</header><text>The Commission shall review the efficiency and public
			 need for each agency in accordance with the criteria described in section
			 104.</text>
				</subsection><subsection id="H1774BB7E3CA64136857D50D0375E2D13"><enum>(b)</enum><header>Recommendations;
			 report to Congress</header><text>The Commission shall submit to Congress and
			 the President not later than September 1 of each year a report
			 containing—</text>
					<paragraph id="H4F3D9D00370744E98BFCC5EC8288DCA9"><enum>(1)</enum><text>an analysis of the
			 efficiency of operation and public need for each agency to be reviewed in the
			 year in which the report is submitted pursuant to the schedule submitted to
			 Congress under section 101;</text>
					</paragraph><paragraph id="HBDDDD7E48CBE4C5789636D4FD892CD15"><enum>(2)</enum><text>recommendations on
			 whether each such agency should be abolished or reorganized;</text>
					</paragraph><paragraph id="HC77645196C71467CB33F91816572A84E"><enum>(3)</enum><text>recommendations on
			 whether the functions of any other agencies should be consolidated,
			 transferred, or reorganized in an agency to be reviewed in the year in which
			 the report is submitted pursuant to the schedule submitted to Congress under
			 section 101; and</text>
					</paragraph><paragraph id="H9AB24ADCCF0B44C286C7B660E0B9F8A4"><enum>(4)</enum><text>recommendations
			 for administrative and legislative action with respect to each such agency, but
			 not including recommendations for appropriation levels.</text>
					</paragraph></subsection><subsection id="H9FECF1E55C1D4190BC6D1D882D2CBF99"><enum>(c)</enum><header>Draft
			 legislation</header><text>The Commission shall submit to Congress and the
			 President not later than September 1 of each year a draft of legislation to
			 carry out the recommendations of the Commission under subsection (b).</text>
				</subsection><subsection id="H93B50A03D9014C0F9F7DE92084AB1103"><enum>(d)</enum><header>Information
			 gathering</header><text>The Commission shall—</text>
					<paragraph id="H8E275E67588044DDAC59C84C53A196E1"><enum>(1)</enum><text>conduct public
			 hearings on the abolishment of each agency reviewed under subsection
			 (b);</text>
					</paragraph><paragraph id="H1A5BE25C2C4C4E25BFDD5279B0BE2780"><enum>(2)</enum><text>provide an
			 opportunity for public comment on the abolishment of each such agency;</text>
					</paragraph><paragraph id="H4A6921D071E94709BE91CA005410A965"><enum>(3)</enum><text>require the agency
			 to provide information to the Commission as appropriate; and</text>
					</paragraph><paragraph id="HF0847E9A001E4ACBA40232D577B93300"><enum>(4)</enum><text>consult with the
			 General Accounting Office, the Office of Management and Budget, the Comptroller
			 General, and the chairman and ranking minority members of the committees of
			 Congress with oversight responsibility for the agency being reviewed regarding
			 the operation of the agency.</text>
					</paragraph></subsection><subsection id="H9B6D059F47654316BC975568DEBCBA3B"><enum>(e)</enum><header>Use of program
			 inventory</header><text>The Commission shall use the program inventory prepared
			 under section 108 in reviewing the efficiency and public need for each agency
			 under subsection (a).</text>
				</subsection></section><section display-inline="no-display-inline" id="H580F7B1E268244A2A9C86F2CD4EB5932" section-type="subsequent-section"><enum>104.</enum><header>Criteria for
			 review</header><text display-inline="no-display-inline">The Commission shall
			 evaluate the efficiency and public need for each agency pursuant to section 103
			 using the following criteria:</text>
				<paragraph id="H402DE33CD46647BBB19B0053C84C3746"><enum>(1)</enum><text>The effectiveness,
			 and the efficiency of the operation of, the programs carried out by each such
			 agency.</text>
				</paragraph><paragraph id="HE18B6EBC626C45D1B63C537ED00041B6"><enum>(2)</enum><text>Whether the
			 programs carried out by the agency are cost-effective.</text>
				</paragraph><paragraph id="HB9B61BDA531E4DD4A417E0929C5841D"><enum>(3)</enum><text>Whether the agency
			 has acted outside the scope of its original authority, and whether the original
			 objectives of the agency have been achieved.</text>
				</paragraph><paragraph id="H9D159E5046934FAFB82CFFE2A3FEC997"><enum>(4)</enum><text>Whether less
			 restrictive or alternative methods exist to carry out the functions of the
			 agency.</text>
				</paragraph><paragraph id="H3991C9C1F84741E5A5D00FDF0B4BACC"><enum>(5)</enum><text>The extent to which
			 the jurisdiction of, and the programs administered by, the agency duplicate or
			 conflict with the jurisdiction and programs of other agencies.</text>
				</paragraph><paragraph id="H9E167DD1BBB94C25A701E3C2D38C006E"><enum>(6)</enum><text>The potential
			 benefits of consolidating programs administered by the agency with similar or
			 duplicative programs of other agencies, and the potential for consolidating
			 such programs.</text>
				</paragraph><paragraph id="HB61DC3098F3F49178BFB56A6FA9F00FB"><enum>(7)</enum><text>The number and
			 types of beneficiaries or persons served by programs carried out by the
			 agency.</text>
				</paragraph><paragraph id="HAFC15A10B8B3414C85EA21500057A680"><enum>(8)</enum><text>The extent to
			 which any trends, developments, and emerging conditions that are likely to
			 affect the future nature and extent of the problems or needs that the programs
			 carried out by the agency are intended to address.</text>
				</paragraph><paragraph id="HF66EA6513F48435D9636DE24D2A43411"><enum>(9)</enum><text>The extent to
			 which the agency has complied with the provisions contained in the
			 <act-name parsable-cite="FPRA93">Government Performance and Results Act of
			 1993</act-name> (Public Law 103–62; 107 Stat. 285).</text>
				</paragraph><paragraph id="H372B88A2CE3E40D4BE07BF39D9B4AB26"><enum>(10)</enum><text>The promptness
			 and effectiveness with which the agency seeks public input and input from State
			 and local governments on the efficiency and effectiveness of the performance of
			 the functions of the agency.</text>
				</paragraph><paragraph id="H0B47221AD8074D9E9345778B508400B5"><enum>(11)</enum><text>Whether the
			 agency has worked to enact changes in the law that are intended to benefit the
			 public as a whole rather than the specific business, institution, or
			 individuals that the agency regulates.</text>
				</paragraph><paragraph id="HE46F25769AC1483EB67C2CC88D944193"><enum>(12)</enum><text>The extent to
			 which the agency has encouraged participation by the public as a whole in
			 making its rules and decisions rather than encouraging participation solely by
			 those it regulates.</text>
				</paragraph><paragraph id="H532623577ADC4518987C972DEAEA0018"><enum>(13)</enum><text>The extent to
			 which the public participation in rulemaking and decisionmaking of the agency
			 has resulted in rules and decisions compatible with the objectives of the
			 agency.</text>
				</paragraph><paragraph id="H3DA15036B83D4710ACB9B1C2E4EDCC52"><enum>(14)</enum><text>The extent to
			 which the agency complies with section 552 of title 5, United States Code
			 (commonly known as the <quote>Freedom of Information Act</quote>).</text>
				</paragraph><paragraph id="H3D00B9E243C144F7A4A460EBB180CF48"><enum>(15)</enum><text>The extent to
			 which the agency complies with equal employment opportunity requirements
			 regarding equal employment opportunity.</text>
				</paragraph><paragraph id="H6B4874B4E7194510A54879F298D615B2"><enum>(16)</enum><text>The extent of the
			 regulatory, privacy, and paperwork impacts of the programs carried out by the
			 agency.</text>
				</paragraph><paragraph id="HCC74C6829AE64AF8A7159E21F8C832B6"><enum>(17)</enum><text>The extent to
			 which the agency has coordinated with State and local governments in performing
			 the functions of the agency.</text>
				</paragraph><paragraph id="HF1FFE3EBEE584B27BD9ED1794C029900"><enum>(18)</enum><text>The potential
			 effects of abolishing the agency on State and local governments.</text>
				</paragraph><paragraph id="H9E15565F62A54A428956A000B97224DB"><enum>(19)</enum><text>The extent to
			 which changes are necessary in the authorizing statutes of the agency in order
			 that the functions of the agency can be performed in the most efficient and
			 effective manner.</text>
				</paragraph></section><section display-inline="no-display-inline" id="HECC0765128754A4595D04C4E279C00F8" section-type="subsequent-section"><enum>105.</enum><header>Commission
			 oversight</header>
				<subsection id="H82BB96C5772D4350AD5BB238D5B8B99"><enum>(a)</enum><header>Monitoring of
			 implementation of recommendations</header><text>The Commission shall monitor
			 implementation of laws enacting provisions that incorporate recommendations of
			 the Commission with respect to abolishment or reorganization of
			 agencies.</text>
				</subsection><subsection id="H1DC37CCDD46C48A29E5CEAE93F8B0673"><enum>(b)</enum><header>Monitoring of
			 other relevant legislation</header>
					<paragraph id="H2F72AF9E90DA4551855C7500CCB54742"><enum>(1)</enum><header>In
			 general</header><text>The Commission shall review and report to Congress on all
			 legislation introduced in either house of Congress that would establish—</text>
						<subparagraph id="H9AFB3E46C2BE4019ABA5621ECAB83E80"><enum>(A)</enum><text>a new agency;
			 or</text>
						</subparagraph><subparagraph id="H6AC7579786AF4D97A0B15989BFC80097"><enum>(B)</enum><text>a new program to
			 be carried out by an existing agency.</text>
						</subparagraph></paragraph><paragraph id="H990E0B68551041CA8FD7C0C08097ECB5"><enum>(2)</enum><header>Report to
			 Congress</header><text>The Commission shall include in each report submitted to
			 Congress under paragraph (1) an analysis of whether—</text>
						<subparagraph id="H6432921D6AB94C239E6F68725E3B6042"><enum>(A)</enum><text>the functions of
			 the proposed agency or program could be carried out by one or more existing
			 agencies;</text>
						</subparagraph><subparagraph id="HBBC1D7D61795468CB8E72763BAEDCD89"><enum>(B)</enum><text>the functions of
			 the proposed agency or program could be carried out in a less restrictive
			 manner than the manner proposed in the legislation; and</text>
						</subparagraph><subparagraph id="H1E9D70765D324C5A98048DF7043E4745"><enum>(C)</enum><text>the legislation
			 provides for public input regarding the performance of functions by the
			 proposed agency or program.</text>
						</subparagraph></paragraph></subsection></section><section display-inline="no-display-inline" id="H3C79BF058CB4412FA259E4E25F51FAFB" section-type="subsequent-section"><enum>106.</enum><header>Rulemaking
			 authority</header><text display-inline="no-display-inline">The Commission may
			 promulgate such rules as necessary to carry out this title.</text>
			</section><section id="HBBAF846C4F154D97B63C87644EA32398"><enum>107.</enum><header>Relocation of
			 Federal employees</header><text display-inline="no-display-inline">If the
			 position of an employee of an agency is eliminated as a result of the
			 abolishment of an agency in accordance with this title, there shall be a
			 reasonable effort to relocate such employee to a position within another
			 agency.</text>
			</section><section id="H09EC3DDA8B0840D389CB5F355BB6C32B"><enum>108.</enum><header>Program
			 inventory</header>
				<subsection id="H6AAA78E734E34104993C2E15CD8ECD69"><enum>(a)</enum><header>Preparation</header><text>The
			 Comptroller General and the Director of the Congressional Budget Office, in
			 cooperation with the Director of the Congressional Research Service, shall
			 prepare an inventory of Federal programs (in this title referred to as the
			 <quote>program inventory</quote>) within each agency.</text>
				</subsection><subsection id="H8320FECDEB7F44909223AEDFFE733DD9"><enum>(b)</enum><header>Purpose</header><text>The
			 purpose of the program inventory is to advise and assist the Congress and the
			 Commission in carrying out the requirements of this title. Such inventory shall
			 not in any way bind the committees of the Senate or the House of
			 Representatives with respect to their responsibilities under this title and
			 shall not infringe on the legislative and oversight responsibilities of such
			 committees. The Comptroller General shall compile and maintain the inventory
			 and the Director of the Congressional Budget Office shall provide budgetary
			 information for inclusion in the inventory.</text>
				</subsection><subsection id="H32E4D6F620A74CAEAE43F74C65C766C7"><enum>(c)</enum><header>Inventory
			 content</header><text>The program inventory shall set forth for each program
			 each of the following matters:</text>
					<paragraph id="H04BE8A45C5EA49A398BF178686E6D54"><enum>(1)</enum><text>The specific
			 provision or provisions of law authorizing the program.</text>
					</paragraph><paragraph id="HE4CBCC10CE974BB9BDA2F8936549CD00"><enum>(2)</enum><text>The committees of
			 the Senate and the House of Representatives which have legislative or oversight
			 jurisdiction over the program.</text>
					</paragraph><paragraph id="HD7CED78EDE5D4DCFABB1732C97C121CB"><enum>(3)</enum><text>A
			 brief statement of the purpose or purposes to be achieved by the
			 program.</text>
					</paragraph><paragraph id="H2113396EC76041638E65000796247482"><enum>(4)</enum><text>The committees
			 which have jurisdiction over legislation providing new budget authority for the
			 program, including the appropriate subcommittees of the Committees on
			 Appropriations of the Senate and the House of Representatives.</text>
					</paragraph><paragraph id="H4A8E316D20A24628B414C1D2E40043CA"><enum>(5)</enum><text>The agency and, if
			 applicable, the subdivision thereof responsible for administering the
			 program.</text>
					</paragraph><paragraph id="HF190DC96119648A5AB70C9541B68CF32"><enum>(6)</enum><text>The grants-in-aid,
			 if any, provided by such program to State and local governments.</text>
					</paragraph><paragraph id="H4ABB8287854142FEB5818D019E1FF31"><enum>(7)</enum><text>The next
			 reauthorization date for the program.</text>
					</paragraph><paragraph id="H679E780FD4DF48E3AD00D154A737DAC"><enum>(8)</enum><text>A
			 unique identification number which links the program and functional category
			 structure.</text>
					</paragraph><paragraph id="H12E2A70CDF724E5895B17FDFB2C2474C"><enum>(9)</enum><text>The year in which
			 the program was originally established and, where applicable, the year in which
			 the program expires.</text>
					</paragraph><paragraph id="H496D8BBD1F624F60AF7B6DC7761F0091"><enum>(10)</enum><text>Where applicable,
			 the year in which new budget authority for the program was last authorized and
			 the year in which current authorizations of new budget authority expire.</text>
					</paragraph></subsection><subsection id="HF01B45BA51AC41518ECD8F08ADCB4F21"><enum>(d)</enum><header>Budget
			 authority</header><text>The report also shall set forth for each program
			 whether the new budget authority provided for such programs is—</text>
					<paragraph id="HA30CA28DAA174CF48062D6B703A4DFF"><enum>(1)</enum><text>authorized for a
			 definite period of time;</text>
					</paragraph><paragraph id="H0DEC96C2DF9946F8A3264D0000FDDB63"><enum>(2)</enum><text>authorized in a
			 specific dollar amount but without limit of time;</text>
					</paragraph><paragraph id="HC7F59A5EAF8A4E2895CA7E11D1F2A408"><enum>(3)</enum><text>authorized without
			 limit of time or dollar amounts;</text>
					</paragraph><paragraph id="HEC63257CC5A14F4EA897A89DDB049700"><enum>(4)</enum><text>not specifically
			 authorized; or</text>
					</paragraph><paragraph id="H29ACCFA25A13420DAFA97387676D19FC"><enum>(5)</enum><text>permanently
			 provided,</text>
					</paragraph><continuation-text continuation-text-level="subsection">as
			 determined by the Director of the Congressional Budget Office.</continuation-text></subsection><subsection id="HA7CC800E1FF44F01B8764FDD90A9C9E7"><enum>(e)</enum><header>CBO
			 information</header><text>For each program or group of programs, the program
			 inventory also shall include information prepared by the Director of the
			 Congressional Budget Office indicating each of the following matters:</text>
					<paragraph id="HF3F8C0F1D0754877B2009EAAD84D6EA1"><enum>(1)</enum><text>The amounts of new
			 budget authority authorized and provided for the program for each of the
			 preceding four fiscal years and, where applicable, the four succeeding fiscal
			 years.</text>
					</paragraph><paragraph id="HE3689637CE9E48EABB44E0E86E48D63"><enum>(2)</enum><text>The functional and
			 subfunctional category in which the program is presently classified and was
			 classified under the fiscal year 2009 budget.</text>
					</paragraph><paragraph id="HBFD84454A78A4CCC89BCFB485E481794"><enum>(3)</enum><text>The identification
			 code and title of the appropriation account in which budget authority is
			 provided for the program.</text>
					</paragraph></subsection><subsection id="H68674DA3C2CD41CE982B0253E1037025"><enum>(f)</enum><header>Mutual exchange
			 of information</header><text>The General Accounting Office, the Congressional
			 Research Service, and the Congressional Budget Office shall permit the mutual
			 exchange of available information in their possession which would aid in the
			 compilation of the program inventory.</text>
				</subsection><subsection id="HD5E809F5E6464D6E9FA15FB5CC419DE3"><enum>(g)</enum><header>Assistance by
			 Executive branch</header><text>The Office of Management and Budget, and the
			 Executive agencies and the subdivisions thereof shall, to the extent necessary
			 and possible, provide the General Accounting Office with assistance requested
			 by the Comptroller General in the compilation of the program inventory.</text>
				</subsection></section><section display-inline="no-display-inline" id="H19E2D0D6C8794EDE86C891B0B027C600" section-type="subsequent-section"><enum>109.</enum><header>Definition of
			 agency</header><text display-inline="no-display-inline">As used in this title,
			 the term <term>agency</term> has the meaning given that term by section 105 of
			 title 5, United States Code, except that such term includes an advisory
			 committee as that term is defined in section 102(2) of the
			 <act-name parsable-cite="FACA">Federal Advisory Committee
			 Act</act-name>.</text>
			</section><section id="H2884D4401C7841E3A90000657611CF1F"><enum>110.</enum><header>Offset of
			 amounts appropriated</header><text display-inline="no-display-inline">Amounts
			 appropriated to carry out this title shall be offset by a reduction in amounts
			 appropriated to carry out programs of other Federal agencies.</text>
			</section></title><title id="H2BBE1A949D0A4B9DA81186F1997BCC3B"><enum>II</enum><header>Treatment of
			 Emergency Spending Legislation</header>
			<section display-inline="no-display-inline" id="H83E35758CD5C4F9CB5D3A64E00AF3449" section-type="subsequent-section"><enum>201.</enum><header>Single
			 purpose</header><text display-inline="no-display-inline">It shall not be in
			 order in the House of Representatives or the Senate to consider any measure
			 making supplemental appropriations for two or more unrelated
			 emergencies.</text>
			</section><section id="HA5B250A6E4AD4DFF96DAB5C3CEDDD223"><enum>202.</enum><header>Treatment</header>
				<subsection id="HE46D24094D164389909EC687A480959E"><enum>(a)</enum><header>Point of
			 Order</header><paragraph commented="no" display-inline="yes-display-inline" id="H4609BE51DFBF45378D1B187414C64EB7"><enum>(1)</enum><text>A
			 provision containing any spending that is not designated as emergency spending
			 may not be reported in a measure making supplemental appropriations.</text>
					</paragraph><paragraph id="H04277E3BAF3E490080319800C3F500B7" indent="up1"><enum>(2)</enum><text>It shall not be in order in the House
			 of Representatives or the Senate to consider the conference report on any
			 measure making supplemental appropriations if such measure contains any
			 spending that is not designated as emergency spending.</text>
					</paragraph><paragraph id="HB11FD2940C654D76B2E8CE00F352FA2B" indent="up1"><enum>(3)</enum><text>It shall not be in order in the House
			 of Representatives or the Senate to consider any bill, joint resolution, or
			 conference report if the accompanying report or joint statement of managers, as
			 applicable, does not comply with subsection (b).</text>
					</paragraph></subsection><subsection id="H333E07963B3643E89FAC0727949B1109"><enum>(b)</enum><header>Committee
			 Notification of Emergency Legislation</header><text>Whenever the Committee on
			 Appropriations or any other committee of the House of Representatives or the
			 Senate (including a committee of conference) reports any bill or joint
			 resolution that provides budget authority for any emergency, the report
			 accompanying that bill or joint resolution (or the joint explanatory statement
			 of managers in the case of a conference report on any such bill or joint
			 resolution) shall identify all provisions that provide budget authority and the
			 outlays flowing therefrom for such emergency and include a statement of the
			 reasons why such budget authority meets the definition of an emergency and a
			 justification of why such funding is in a supplemental appropriation and not
			 the regular appropriation for the next fiscal year.</text>
				</subsection><subsection id="H74926FA4FEC049EFB9A8124241E3E4BC"><enum>(c)</enum><header>Definition of
			 Emergency</header><paragraph commented="no" display-inline="yes-display-inline" id="H6D10E615CFB84752BF1BDCD5284222B5"><enum>(1)</enum><text>As used in this section,
			 the term <term>emergency</term> means a situation that—</text>
						<subparagraph id="H71D3440BAEE44F9E9F2161FA4449E84" indent="up1"><enum>(A)</enum><text>requires new budget authority and
			 outlays (or new budget authority and the outlays flowing therefrom) for the
			 prevention or mitigation of, or response to, loss of life or property, or a
			 threat to national security; and</text>
						</subparagraph><subparagraph id="H812E1AD1125A4556A7C1D5A8EEBC987C" indent="up1"><enum>(B)</enum><text>is unanticipated.</text>
						</subparagraph></paragraph><paragraph id="H117FC4B82B2D42C297F9A66CD9353D4B" indent="up1"><enum>(2)</enum><text>As used in paragraph (1), the term
			 <term>unanticipated</term> means that the situation is—</text>
						<subparagraph id="H86A94D84D28D48E7BAFC189FC0C07EFF"><enum>(A)</enum><text>sudden, which means quickly coming
			 into being or not building up over time;</text>
						</subparagraph><subparagraph id="H64202E2F3422467E84620276A1F5008C"><enum>(B)</enum><text>urgent, which means a pressing and
			 compelling need requiring immediate action;</text>
						</subparagraph><subparagraph id="H02CB8DC739AF4FD99532B31502DE878"><enum>(C)</enum><text>unforeseen, which means not predicted
			 or anticipated as an emerging need; and</text>
						</subparagraph><subparagraph id="H844A0DE9D8C14034963E15B87EDDAC12"><enum>(D)</enum><text>temporary, which means not of a
			 permanent duration.</text>
						</subparagraph></paragraph></subsection></section><section display-inline="no-display-inline" id="HB43D90C63BEE4BDC94A260E58D76C725" section-type="subsequent-section"><enum>203.</enum><header>Treatment of
			 earmarks</header>
				<subsection id="H98477EEF5CD143B2934DE81C939D17AB"><enum>(a)</enum><header>Points of
			 Order</header><paragraph commented="no" display-inline="yes-display-inline" id="H6A2072B496DA486ABC8F11C79705F932"><enum>(1)</enum><text>A
			 provision containing an earmark may not be reported in a measure making
			 supplemental appropriations.</text>
					</paragraph><paragraph id="H07CF0FC8A24D403C8057793DE44135DD" indent="up1"><enum>(2)</enum><text>It shall not be in order in the House
			 of Representatives or the Senate to consider the conference report on any
			 measure making supplemental appropriations if such measure contains any
			 earmarks.</text>
					</paragraph></subsection><subsection id="H3DA199DE0F0A4617B911D6A45CB88BB4"><enum>(b)</enum><header>Definition of
			 Earmark</header><text display-inline="yes-display-inline">As used in subsection
			 (a), the term <term>earmark</term> has the meaning given to the term
			 <quote>congressional earmark</quote> in clause 9 of rule XXI of the Rules of
			 the House of Representatives, One Hundred Eleventh Congress.</text>
				</subsection></section></title><title id="H43D77E6237BD407EAFF5E4F7C6E6D962"><enum>III</enum><header>Statutory
			 Discretionary Spending Caps</header>
			<section id="H928F1F9323BA4CF5B8D45B4046289829"><enum>301.</enum><header>Congressional
			 action</header><text display-inline="no-display-inline">Within 90 days after
			 the date of enactment of this Act, the Committees on the Budget of the House of
			 Representatives and the Senate shall each report a bill—</text>
				<paragraph id="H48C12982E7AB4D3500446279FF3CEDED"><enum>(1)</enum><text>establishing
			 discretionary spending limits for at least each of the 3 fiscal years beginning
			 at least 90 calendar days after such bill is reported; and</text>
				</paragraph><paragraph id="HE890300AB9CB4F8897E8DA02F1414781"><enum>(2)</enum><text>providing that
			 such limits shall be enforceable through presidential sequestration
			 orders.</text>
				</paragraph></section></title><title id="HE3AB17AC6A7E4F049725BE15CAC685BD"><enum>IV</enum><header>Additional
			 Budgetary Enforcement Measures</header>
			<section id="H99DEDFBEA3094EA79535FD2B22439392"><enum>401.</enum><header>Specific dollar
			 amounts required for authorizations</header><text display-inline="no-display-inline">It shall not be in order in the House of
			 Representatives or the Senate to consider any bill or joint resolution, or
			 amendment thereto or conference report thereon, that authorizes a program,
			 project, or activity and does not set forth a specific dollar amount for such
			 authorization.</text>
			</section><section id="H56D34D692F8E40DE99B6F6573BFE3801"><enum>402.</enum><header>GAO statement
			 in committee reports</header>
				<subsection id="H53A7FD8773B746C18E463500D61879EB"><enum>(a)</enum><header>Committee
			 reports</header><text display-inline="yes-display-inline">Each report of a
			 committee of the House of Representatives or the Senate on a bill or joint
			 resolution authorizing any program, project, or activity shall contain a
			 statement by the General Accounting Office describing the degree to which such
			 authorization is duplicative of an existing authorization for any program,
			 project, or activity.</text>
				</subsection><subsection id="H9B6961D2DB844E66A0BB355F1E66392B"><enum>(b)</enum><header>Conforming
			 amendment</header><text>The Director of the General Accounting Office shall
			 prepare for each bill or joint resolution described in subsection (a) and
			 reported by any committee of the House of Representatives or the Senate, and
			 submit to such committee the information required by that subsection.</text>
				</subsection></section><section id="HFC15DE2CA6E84866AEF4AFBBC587324F"><enum>403.</enum><header>CBO cost
			 estimate required for all bills considered by the House of Representatives or
			 the Senate</header><text display-inline="no-display-inline">It shall not be in
			 order in the House of Representatives or the Senate to consider any bill or
			 joint resolution, or amendment thereto or conference report thereon, unless the
			 chairman of the committee with jurisdiction over such bill or joint resolution
			 has made available an estimate by the Director of the Congressional Budget
			 Office of the costs which would be incurred in carrying out such bill or joint
			 resolution in the fiscal year in which it is to become effective and each of
			 the 4 fiscal years following such fiscal year, together with a basis for each
			 such estimate.</text>
			</section><section id="HA728C4EC8B1342CEB2A04D35EB58CD04"><enum>404.</enum><header>Recorded votes
			 required on authorization of more than $75,000,000</header><text display-inline="no-display-inline">In
			 the House of Representatives or the Senate, a recorded vote shall be required
			 on final passage of any bill, joint resolution, or conference report that
			 authorizes the appropriations of more than $75,000,000 for a period of not to
			 exceed 5 fiscal years.</text>
