		<section id="HCF6B4DB5A2D34121A0371BF0876A02C7" section-type="section-one"><enum>1.</enum><header>America’s Waterway Watch
			 Program</header>
			<subsection id="HB591907EF8B64D588F014F1C07362D28"><enum>(a)</enum><header>Short
			 title</header><text>This section may be cited as the <quote><short-title>America’s Waterway Watch Act</short-title></quote>.</text>
			</subsection><subsection id="HC8CD5A797C924534BE9BF5A4BB0B4290"><enum>(b)</enum><header>Sense of
			 Congress</header><text>It is the sense of Congress that the Secretary of
			 Homeland Security should establish, within the Department of Homeland Security,
			 citizen watch programs that promote voluntary reporting of suspected terrorist
			 activity and suspicious behavior.</text>
			</subsection><subsection id="HB9510FDFD73E494DAC315E855AEFA161"><enum>(c)</enum><header>America’s
			 Waterway Watch Program</header>
				<paragraph id="HAFABC7F443AC4E8C94260C1DDE9A30C9"><enum>(1)</enum><header>In
			 general</header><text>There is hereby established, within the Coast Guard, the
			 America’s Waterway Watch Program (hereinafter in this section referred to as
			 the <term>Program</term>).</text>
				</paragraph><paragraph id="HEDE3A9AFCE664BFA857BF1E30154A172"><enum>(2)</enum><header>Purpose</header><text>The
			 Secretary of Homeland Security, acting through the Commandant of the Coast
			 Guard, shall administer the Program in a manner that promotes voluntary
			 reporting of activities that may indicate that a person or persons may be
			 preparing to engage or engaging in a violation of law relating to a threat or
			 an act of terrorism (as that term is defined in section 3077 of title 18,
			 United States Code) against a vessel, facility, port, or waterway.</text>
				</paragraph><paragraph id="H8B1A4092B290495993CED77FD801F629"><enum>(3)</enum><header>Information;
			 training</header>
					<subparagraph id="H8D64D2AF84D84D9ABE3683A013B8CA40"><enum>(A)</enum><header>Information</header><text>The
			 Secretary, acting through the Commandant, may establish, as an element of the
			 Program, a network of individuals and community-based organizations that
			 enhance the situational awareness within the Nation’s ports and waterways. Such
			 network shall, to the extent practicable, be conducted in cooperation with
			 Federal, State, and local law enforcement agencies.</text>
					</subparagraph><subparagraph id="H74F8AE9338444055BB44EFD861E4CD83"><enum>(B)</enum><header>Training</header><text>The
			 Secretary, acting through the Commandant, may provide training in—</text>
						<clause id="HC0688A5B485E4C2897529BBFFDB0D2DD"><enum>(i)</enum><text>observing and
			 reporting on covered activities; and</text>
						</clause><clause id="HFBF9752595824059A72B020EA07CCE7E"><enum>(ii)</enum><text>sharing such
			 reports and coordinating the response by Federal, State, and local law
			 enforcement agencies.</text>
						</clause></subparagraph></paragraph><paragraph id="H795F39B562E2413A8833D22F70F146AF"><enum>(4)</enum><header>Instructional
			 materials</header>
					<subparagraph id="HA693B2A280604FE69EBA6B23A37C1A3D"><enum>(A)</enum><header>In
			 general</header><text>The Secretary of Homeland Security, acting through the
			 Commandant of the Coast Guard, may—</text>
						<clause id="HC2F3BF7A199B4F8FB8F1EA9E7C2FC855"><enum>(i)</enum><text>develop
			 instructional materials that—</text>
							<subclause id="H03E380E784FF4B98976C1410513BCFFC"><enum>(I)</enum><text>provide
			 information on inland waterways, ports and harbors, and coastal regions for a
			 specific region, as well as specific vulnerabilities and threats common to a
			 specific region; and</text>
							</subclause><subclause id="HFCC12F76594240A1AD1C6E2951B1A8B3"><enum>(II)</enum><text>promote voluntary
			 reporting of activities that may indicate that a person or persons may be
			 preparing to engage or engaging in a violation of law relating to a threat or
			 an act of terrorism (as that term is defined in section 3077 of title 18,
			 United States Code) against a vessel, facility, port, or waterway; and</text>
							</subclause></clause><clause id="H137653123E244D0F9A3C124B2C80F353"><enum>(ii)</enum><text>distribute such
			 materials to States, political subdivisions of the States, or non-governmental
			 organization that provide instruction on boating or vessel operation in
			 conjunction with any other instruction provided.</text>
						</clause></subparagraph><subparagraph id="H04868B5C9983428892F46C396B52A895"><enum>(B)</enum><header>Dissemination</header><text display-inline="yes-display-inline">The Secretary, acting through the
			 Commandant—</text>
						<clause id="HFF392276BBF14BE48F0F7F89DE39CA1F"><enum>(i)</enum><text>shall ensure that
			 such materials are made available to any person or persons; and</text>
						</clause><clause id="H72FD4DD11B294917B4D0FB4B1C38A917"><enum>(ii)</enum><text>is
			 authorized to require, as a condition of receipt of funding or materials,
			 pursuant to subparagraph (A), that the recipient of such funding or materials
			 develops a program to reach the widest possible audience.</text>
						</clause></subparagraph><subparagraph id="H571BC507F76C4D2A94C5F84B0C4CFE5E"><enum>(C)</enum><header>Eligibility,
			 Federal assistance</header><text>The receipt, use, and dissemination of such
			 materials shall not diminish the eligibility of any State, political
			 subdivision of such State, or non-governmental organization to receive Federal
			 assistance or reduce the amount of Federal assistance that such State,
			 political subdivision of such State, or non-governmental organization that
			 otherwise receive.</text>
					</subparagraph></paragraph><paragraph id="HB2ADD4DFF39D4E29A163EAB343031E06"><enum>(5)</enum><header>Voluntary
			 participation</header><text>Participation in the Program—</text>
					<subparagraph id="HE83369E183EA41DF836AEA851B217180"><enum>(A)</enum><text>shall be wholly
			 voluntary;</text>
					</subparagraph><subparagraph id="HD20F6D40C7EA4B9BAC410E446526CAF7"><enum>(B)</enum><text>shall not be a
			 prerequisite to eligibility for, or receipt of, any other service or assistance
			 from, or to participation in, any other program of any kind; and</text>
					</subparagraph><subparagraph id="H00FAFFD225114B12B230219FC2E95A02"><enum>(C)</enum><text>shall not require
			 disclosure of information regarding the individual reporting covered activities
			 or, for proprietary purposes, the location of such individual.</text>
					</subparagraph></paragraph><paragraph id="H5C5FF1E2AA1A405594F7EC9E4E23FA26"><enum>(6)</enum><header>Definitions</header><text>In
			 this subsection:</text>
					<subparagraph id="H4AABEEE8F71A43F189075995968A918A"><enum>(A)</enum><text>The term
			 <term>covered activity</term> means any suspicious transaction, activity, or
			 occurrence that involves, or is directed against, a vessel or facility (as that
			 term is defined in section 70101(2) of title 46, United States Code) indicating
			 that an individual or individuals may be preparing to engage, or engaging, in a
			 violation of law relating to—</text>
						<clause id="H8B6EB0666A3945439D6FD5B631D3B9F7"><enum>(i)</enum><text>a
			 threat to a vessel, facility, port, or waterway; or</text>
						</clause><clause id="H58D5181A5ADB4648A4B4EEF279A32301"><enum>(ii)</enum><text>an
			 act of terrorism (as that term is defined in section 3077 of title 18, United
			 States Code).</text>
						</clause></subparagraph><subparagraph id="H2815664948404E77BEA52ABBCEAA7294"><enum>(B)</enum><text>The term
			 <term>facility</term> has the same meaning such term has in section 70101(2) of
			 title 46, United States Code.</text>
					</subparagraph></paragraph><paragraph id="H135548B92EF1447AA422460E65396CD2"><enum>(7)</enum><header>Authorization of
			 appropriations</header><text display-inline="yes-display-inline">There is
			 authorized to be appropriated for the purposes of this section $3,000,000 for
			 fiscal years 2010 through 2015. Such funds shall remain available until
			 expended.</text>
				</paragraph></subsection><subsection id="H8417E972A5EA449EA411AA351ABDCC50"><enum>(d)</enum><header>Coordination</header><text>The
			 Secretary shall coordinate the Program with other like watch programs. The
			 Secretary shall submit, concurrent with the President’s budget submission for
			 each fiscal year, a report on coordination of the Program and like watch
			 programs within the Department of Homeland Security to the Committee on
			 Homeland Security and Governmental Affairs of the Senate and the Committee on
			 Homeland Security of the House of Representatives.</text>
			</subsection></section><section id="HA7B317EC92AA4563869910398EB3FC12"><enum>2.</enum><header>Transportation
			 Worker Identification Credential</header>
			<subsection id="HD84599AE47F04D1F87DF30D0BA23BAA6"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than 120
			 days after completing the pilot program under section 70105(k)(1) of title 46,
			 United States Code, to test TWIC access control technologies at port facilities
			 and vessels nationwide, the Secretary of Homeland Security shall submit to the
			 Committee on Homeland Security and the Committee on Transportation and
			 Infrastructure of the House of Representatives, the Committee on Commerce,
			 Science, and Transportation of the Senate, and the Committee on Homeland
			 Security and Governmental Affairs of the Senate and to the Comptroller General
			 a report containing an assessment of the results of the pilot. The report shall
			 include—</text>
				<paragraph id="H662F0BDCF0D2407DB869FEB30E145CAA"><enum>(1)</enum><text>the findings of
			 the pilot program with respect to key technical and operational aspects of
			 implementing TWIC technologies in the maritime sector;</text>
				</paragraph><paragraph id="HFC234C474E644C77B116D5A974D7DEA5"><enum>(2)</enum><text>a
			 comprehensive listing of the extent to which established metrics were achieved
			 during the pilot program; and</text>
				</paragraph><paragraph id="HE76B22BD91544C28825C0EFA87A78D29"><enum>(3)</enum><text>an analysis of the
			 viability of those technologies for use in the maritime environment, including
			 any challenges to implementing those technologies and strategies for mitigating
			 identified challenges.</text>
				</paragraph></subsection><subsection id="H5B2CD6699DFE434BB9689DE1E4249A12"><enum>(b)</enum><header>GAO
			 assessment</header><text>The Comptroller General shall review the report and
			 submit to the Committee on Homeland Security and the Committee on
			 Transportation and Infrastructure of the House of Representatives, the
			 Committee on Commerce, Science, and Transportation of the Senate, and the
			 Committee on Homeland Security and Governmental Affairs of the Senate an
			 assessment of the report’s findings and recommendations.</text>
			</subsection></section><section id="H265931EC00C54C2EA5FE5CD8BC49D340"><enum>3.</enum><header>Review of
			 interagency operational centers</header>
			<subsection id="HE4569A3EA5694018862C88D058389090"><enum>(a)</enum><header>In
			 general</header><text>Within 180 days of enactment of this Act, the Department
			 of Homeland Security Inspector General shall provide a report to the Committee
			 on Homeland Security and the Committee on Transportation and Infrastructure of
			 the House of Representatives and the Committees on Homeland Security and
			 Governmental Affairs and Commerce, Science, and Transportation of the Senate
			 concerning the establishment of Interagency Operational Centers for Port
			 Security required by section 108 of the SAFE Port Act (Public Law
			 109–347).</text>
			</subsection><subsection id="H32091896D7F54C1F964FB577DA60AB4B"><enum>(b)</enum><header>Report</header><text>The
			 report shall include—</text>
				<paragraph id="HC1868E8751024385A746E7924759EBDD"><enum>(1)</enum><text>an examination of
			 the Department’s efforts to establish the Interagency Operational
			 Centers;</text>
				</paragraph><paragraph id="HC9B6574D49A14DCE909C778D42B7E34B"><enum>(2)</enum><text>a
			 timeline for construction;</text>
				</paragraph><paragraph id="H13ABDFD955C943D4B48F78ACFF484B91"><enum>(3)</enum><text>a
			 detailed breakdown, by center, as to the incorporation of those representatives
			 required by section 70107A(b)(3) of title 46, United States Code;</text>
				</paragraph><paragraph id="H0399BD9969664AD88CAFAFEA34A523B1"><enum>(4)</enum><text>an analysis of the
			 hurdles faced by the Department in developing these centers;</text>
				</paragraph><paragraph id="HF4D528BC608F45C2A1EBF7F22EDD2738"><enum>(5)</enum><text>information on the
			 number of security clearances attained by State, local, and tribal officials
			 participating in the program; and</text>
				</paragraph><paragraph id="H30668D4E4DC34984A7381E1F54EB2B08"><enum>(6)</enum><text>an examination of
			 the relationship between the Interagency Operational Centers and State, local,
			 and regional fusion centers participating in the Department of Homeland
			 Security’s State, Local, and Regional Fusion Center Initiative under section
			 511 of the Implementing the Recommendations of the 9/11 Commission Act of 2007
			 (Public Law 110–53), with a particular emphasis on—</text>
					<subparagraph id="H338749E1AB0341E0B04D3DDBE3BFC3C0"><enum>(A)</enum><text>how the centers
			 collaborate and coordinate their efforts;</text>
					</subparagraph><subparagraph id="H638417E306BD4F289F1AD2778154522E"><enum>(B)</enum><text>the resources
			 allocated by the Coast Guard to both initiatives; and</text>
					</subparagraph><subparagraph id="H74086B63873E43FE92E7E6A5262FE45C"><enum>(C)</enum><text>architecture for
			 integrated interagency targeting.</text>
					</subparagraph></paragraph></subsection></section><section id="HE6339A27DEE4461CA65F7ABE06748723"><enum>4.</enum><header>Maritime security
			 response teams</header>
			<subsection id="HB19E320612934371821890EF0BAA1E93"><enum>(a)</enum><header>In
			 general</header><text>Section 70106 of title 46, United States Code, is amended
			 by striking subsection (c) and inserting the following:</text>
				<quoted-block id="H7C9B4AC6BF94455A97BFC1545C24F18A" style="OLC">
					<subsection id="HE5EABB93C7E54322ACDD750DFE35BF17"><enum>(c)</enum><header>Maritime
				security response teams</header>
						<paragraph id="H8F7DC5330AA546D4A52F2CEAD4C364CF"><enum>(1)</enum><header>In
				general</header><text>In addition to the maritime safety and security teams,
				the Secretary shall establish no less than two maritime security response teams
				to act as the Coast Guard’s rapidly deployable counterterrorism and law
				enforcement response units that can apply advanced interdiction skills in
				response to threats of maritime terrorism.</text>
						</paragraph><paragraph id="HF592618C08954D8C9AE0FF4C467BDC6C"><enum>(2)</enum><header>Minimization of
				response time</header><text>The maritime security response teams shall be
				stationed in such a way to minimize, to the extent practicable, the response
				time to any reported maritime terrorist threat.</text>
						</paragraph></subsection><subsection id="H7179FFA3490148B2B862C88D8F5F0BFB"><enum>(d)</enum><header>Coordination
				with other agencies</header><text>To the maximum extent feasible, each maritime
				safety and security team and maritime security response team shall coordinate
				its activities with other Federal, State, and local law enforcement and
				emergency response
				agencies.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="H2F36170A93074671B9A599AAEB1DB81A"><enum>5.</enum><header>Coast Guard
			 detection canine team program expansion</header>
			<subsection id="H0CB6A816D6E844FAB7972CA36361DBA3"><enum>(a)</enum><header>Definitions</header><text>For
			 purposes of this section:</text>
				<paragraph id="H9C664956AF4146A2A4DF702E12FD59D6"><enum>(1)</enum><header>Canine detection
			 team</header><text>The term <term>detection canine team</term> means a canine
			 and a canine handler that are trained to detect narcotics or explosives, or
			 other threats as defined by the Secretary.</text>
				</paragraph><paragraph id="H9947B63D9CC1472B8B33C1807DE407CD"><enum>(2)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of Homeland Security.</text>
				</paragraph></subsection><subsection id="H6D006DB0A1F8454C99860748D230D124"><enum>(b)</enum><header>Detection canine
			 teams</header>
				<paragraph id="HDD89CD3090BD41468D31963FFF04B858"><enum>(1)</enum><header>Increased
			 capacity</header><text>Not later than 240 days after the date of enactment of
			 this Act, the Secretary shall—</text>
					<subparagraph id="H7EA606E6852D44B9B5DD0AF2082CC2BD"><enum>(A)</enum><text>begin to increase
			 the number of detection canine teams certified by the Coast Guard for the
			 purposes of maritime-related security by no fewer than 10 canine teams annually
			 through fiscal year 2012; and</text>
					</subparagraph><subparagraph id="H4B052A6248084880AB8344DBF861D61F"><enum>(B)</enum><text>encourage owners
			 and operators of port facilities, passenger cruise liners, oceangoing cargo
			 vessels, and other vessels identified by the Secretary to strengthen security
			 through the use of highly trained detection canine teams.</text>
					</subparagraph></paragraph><paragraph id="H45BC2B34ED9340FEB0298EB7E98C3F2A"><enum>(2)</enum><header>Canine
			 procurement</header><text>The Secretary, acting through the Commandant of the
			 Coast Guard, shall—</text>
					<subparagraph id="H00E83C4FE021400DAA2370900C32397E"><enum>(A)</enum><text>procure detection
			 canine teams as efficiently as possible, including, to the greatest extent
			 possible, through increased domestic breeding, while meeting the performance
			 needs and criteria established by the Commandant;</text>
					</subparagraph><subparagraph id="H0FDA118140CB48DEAEA76ED59A94B9D6"><enum>(B)</enum><text display-inline="yes-display-inline">support expansion and upgrading of existing
			 canine training facilities operated by the Department of Homeland Security;
			 and</text>
					</subparagraph><subparagraph id="HFA39D668E7BB4A23B167B5CDF1AD0A44"><enum>(C)</enum><text>as appropriate,
			 partner with other Federal, State, or local agencies, nonprofit organizations,
			 universities, or the private sector to increase the breeding and training
			 capacity for Coast Guard canine detection teams.</text>
					</subparagraph></paragraph></subsection><subsection id="HA50104842D8A456A9CC9CB5ED87BAD7E"><enum>(c)</enum><header>Deployment</header><text>The
			 Secretary shall prioritize deployment of the additional canine teams to ports
			 based on risk, consistent with the Security and Accountability For Every Port
			 Act of 2006 (Public Law 109–347).</text>
			</subsection><subsection id="HE3E7ED9F41334CA1BA758CC5D5026B61"><enum>(d)</enum><header>Authorization</header><text>There
			 are authorized to be appropriated to the Secretary such sums as may be
			 necessary to carry out this section for fiscal years 2010 through 2012.</text>
			</subsection></section><section id="H0B634B56B7884748AB44F802FD949875"><enum>6.</enum><header>Coast Guard port
			 assistance program</header>
			<subsection id="H62C780BC4E5A42FF84ECB13EE83F8A41"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 70110 of
			 title 46, United States Code, is amended by adding at the end the
			 following:</text>
				<quoted-block id="H820E36F20E214DEDA99CBB776113AF3F" style="OLC">
					<subsection id="H4DDC9CA71317495EB66708E11D8C8149"><enum>(f)</enum><header>Coast Guard
				Assistance Program</header>
						<paragraph id="H62FDC1AB36CA447DB3BAA11C48A6262E"><enum>(1)</enum><header>In
				general</header><text>The Secretary may lend, lease, donate, or otherwise
				provide equipment, and provide technical training and support, to the owner or
				operator of a foreign port or facility—</text>
							<subparagraph id="H4C69A5C7AFBC407C89D00B051F8B158A"><enum>(A)</enum><text>to assist in
				bringing the port or facility into compliance with applicable International
				Ship and Port Facility Code standards;</text>
							</subparagraph><subparagraph id="HD5E8BFF2673141699CDA131CE53D46F7"><enum>(B)</enum><text>to assist the port
				or facility in meeting standards established under section 70109A of this
				chapter; and</text>
							</subparagraph><subparagraph id="H6E267718D8BD4AD9B17B98D964B866A0"><enum>(C)</enum><text>to assist the port
				or facility in exceeding the standards described in subparagraphs (A) and
				(B).</text>
							</subparagraph></paragraph><paragraph id="HB19B534EF2C4456A9AD4486F112BBAFE"><enum>(2)</enum><header>Conditions</header><text>The
				Secretary—</text>
							<subparagraph id="HEDA33D4BB9FE43B88A1A361575E817DD"><enum>(A)</enum><text>shall provide such
				assistance based upon an assessment of the risks to the security of the United
				States and the inability of the owner or operator of the port or facility
				otherwise to bring the port or facility into compliance with those standards
				and to maintain compliance with them;</text>
							</subparagraph><subparagraph id="H5F9ECB2917E040119BBA398F83C7B6A9"><enum>(B)</enum><text>may not provide
				such assistance unless the port or facility has been subjected to a
				comprehensive port security assessment by the Coast Guard or a third party
				entity certified by the Secretary under section 70110A(b) to validate foreign
				port or facility compliance with International Ship and Port Facility Code
				standards; and</text>
							</subparagraph><subparagraph id="H8845958E8AAF44FF8062F7B4E7478DED"><enum>(C)</enum><text>may only lend,
				lease, or otherwise provide equipment that the Secretary has first determined
				is not required by the Coast Guard for the performance of its
				missions.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H7A5D6DDDB3FF49FEA868A99688723E14"><enum>(b)</enum><header>Safety and
			 security assistance for foreign ports</header>
				<paragraph id="HB9791FA7053D4D8C89598F010847ACC9"><enum>(1)</enum><header>In
			 General</header><text>Section 70110(e)(1) of title 46, United States Code, is
			 amended by striking the second sentence and inserting the following: <quote>The
			 Secretary shall establish a strategic plan to utilize those assistance programs
			 to assist ports and facilities that are found by the Secretary under subsection
			 (a) not to maintain effective antiterrorism measures in the implementation of
			 port security antiterrorism measures.</quote>.</text>
				</paragraph><paragraph id="H921F7663667D487A97357316D9C18CB4"><enum>(2)</enum><header>Conforming
			 Amendments</header>
					<subparagraph id="H3FCA1C6ECB8A4099AFB23C0C6F24A194"><enum>(A)</enum><text>Section 70110 of
			 title 46, United States Code, is amended—</text>
						<clause id="H49C6C895900F4D479CAD045C336AA57B"><enum>(i)</enum><text>by
			 inserting <quote><header-in-text style="USC">or
			 facilities</header-in-text></quote> after <quote><header-in-text style="USC">ports</header-in-text></quote> in the section heading;</text>
						</clause><clause id="H0EEBCE41613D44DFAEB07939325D3D41"><enum>(ii)</enum><text>by
			 inserting <quote>or facility</quote> after <quote>port</quote> each place it
			 appears; and</text>

			 biometric identification</header>
			<subsection id="HB5C472BA01F54D49BD83C279710A5297"><enum>(a)</enum><header>In
			 general</header><text>Within one year after the date of the enactment of this
			 Act, the Secretary of Homeland Security, acting through the Commandant of the
			 Coast Guard, shall conduct, in the maritime environment, a program for the
			 mobile biometric identification of suspected individuals, including terrorists,
			 to enhance border security and for other purposes.</text>
			</subsection><subsection id="HBE9CD14F38E54D84934106E8E0A05B50"><enum>(b)</enum><header>Requirements</header><text>The
			 Secretary shall ensure the program required in this section is coordinated with
			 other biometric identification programs within the Department of Homeland
			 Security.</text>
			</subsection><subsection id="HF3C89CCED5A742EEA287A4EE89888019"><enum>(c)</enum><header>Cost
			 analysis</header><text>Within 90 days after the date of the enactment of this
			 Act, the Secretary shall submit to the Committees on Appropriations and
			 Homeland Security of the House of Representatives and the Committees on
			 Appropriations and Homeland Security and Governmental Affairs of the Senate an
			 analysis of the cost of expanding the Coast Guard’s biometric identification
			 capabilities for use by the Coast Guard's Deployable Operations Group, cutters,
			 stations, and other deployable maritime teams considered appropriate by the
			 Secretary, and any other appropriate Department of Homeland Security maritime
			 vessels and units. The analysis may include a tiered plan for the deployment of
			 this program that gives priority to vessels and units more likely to encounter
			 individuals suspected of making illegal border crossings through the maritime
			 environment.</text>
			</subsection><subsection id="H84EAA9B956B142C097AFD843479A23B8"><enum>(d)</enum><header>Definition</header><text display-inline="yes-display-inline">For the purposes of this section, the term
			 <term>biometric identification</term> means use of fingerprint and digital
			 photography images and facial and iris scan technology.</text>
			</subsection><subsection id="HFC235998C3E540049C402BAF13204F3B"><enum>(e)</enum><header>Study on
			 combination of facial and iris recognition</header>
				<paragraph id="HE92E7CD107C842B5A41DF1DF80F562A9"><enum>(1)</enum><header>Study
			 required</header><text display-inline="yes-display-inline">The Secretary of
			 Homeland Security shall carry out a study on the use by the Coast Guard of the
			 combination of facial and iris recognition to rapidly identify individuals for
			 security purposes. Such study shall focus on—</text>
					<subparagraph id="H7C61FE843A8B4AA2896B0456854DB5CA"><enum>(A)</enum><text>increased accuracy
			 of facial recognition;</text>
					</subparagraph><subparagraph id="H38ABA8747F42434A850A633B538BE3A4"><enum>(B)</enum><text>enhancement of
			 existing iris recognition technology; and</text>
					</subparagraph><subparagraph id="H34A5587A24E64EAB8673ECB2300B7B21"><enum>(C)</enum><text>establishment of
			 integrated face and iris features for accurate identification of
			 individuals.</text>
					</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="HC2209061EEC74B88A7B975EA78960075"><enum>(2)</enum><header>Purpose of
			 study</header><text display-inline="yes-display-inline">The purpose of the
			 study required by paragraph (1) is to facilitate the use of a combination of
			 facial and iris recognition to provide a higher probability of success in
			 identification than either approach on its own and to achieve transformational
			 advances in the flexibility, authenticity, and overall capability of integrated
			 biometric detectors and satisfy one of major issues with war against
			 terrorists. The operational goal of the study should be to provide the
			 capability to nonintrusively collect biometrics (face image, iris) in an
			 accurate and expeditious manner to assist the Coast Guard in fulfilling its
			 mission to protect and support national security.</text>
				</paragraph></subsection></section><section id="HC0469BB6C8A14168980E805078E12300"><enum>8.</enum><header>Review of
			 potential threats</header><text display-inline="no-display-inline">Not later
			 than 1 year after the date of enactment of this Act, the Secretary of Homeland
			 Security shall submit to the Committee on Homeland Security and the Committee
			 on Transportation and Infrastructure of the House of Representatives and the
			 Committee on Commerce, Science, and Transportation of the Senate a report
			 analyzing the threat, vulnerability, and consequence of a terrorist attack on
			 gasoline and chemical cargo shipments in port activity areas in the United
			 States.</text>
		</section><section id="H11B61866C81944F6BD90071156708C4D"><enum>9.</enum><header>Port security
			 pilot</header><text display-inline="no-display-inline">The Secretary of
			 Homeland Security shall establish a pilot program to test and deploy preventive
			 radiological or nuclear detection equipment on Coast Guard vessels and other
			 locations in select port regions to enhance border security and for other
			 purposes. The pilot program shall leverage existing Federal grant funding to
			 support this program and the procurement of additional equipment.</text>
		</section><section id="H14E06376BC364B3FBD649DBFA507B96D"><enum>10.</enum><header>
			 Seasonal workers</header>
			<subsection id="HCA69F418F3A6479BA5FF4FBCE7D7AF9E"><enum>(a)</enum><header>Study</header><text>The
			 Comptroller General of the United States shall conduct a study on the effects
			 that the Transportation Worker Identification Credential (in this section
			 referred to as <quote>TWIC</quote>) required by section 70105 of title 46,
			 United States Code, has on companies that employ seasonal employees.</text>
			</subsection><subsection id="HED5C0D07556F4BC089FFF28FB95D1F58"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than one year after the date of
			 enactment of this Act, the Comptroller General shall submit a report to the
			 Committee on Homeland Security and the Committee on Transportation and
			 Infrastructure of the House of Representatives and the Committee on Commerce,
			 Science, and Transportation of the Senate on the results of the study,
			 including—</text>
				<paragraph id="H36A5EAF546FC4A64A11367CDF4931752"><enum>(1)</enum><text>costs associated
			 in requiring seasonal employees to obtain TWIC cards on companies;</text>
				</paragraph><paragraph id="HFF9C008194B648B39A77DF366DC41F89"><enum>(2)</enum><text>whether the Coast
			 Guard and Transportation Security Administration are processing TWIC
			 applications quickly enough for seasonal workers to obtain TWIC
			 certification;</text>
				</paragraph><paragraph id="H671BF541DD124F03A37A9EC579AE4A64"><enum>(3)</enum><text>whether TWIC
			 compliance costs or other factors have led to a reduction in service;</text>
				</paragraph><paragraph id="H68F0408C69164D058B833D74B1D2D8BB"><enum>(4)</enum><text>the impact of TWIC
			 on the recruiting and hiring of seasonal and other temporary employees;
			 and</text>
				</paragraph><paragraph id="HEE2DAF19C4C2487BAA741D7372812A2F"><enum>(5)</enum><text>an assessment of
			 possible alternatives to TWIC certification that may be used for seasonal
			 employees including any security vulnerabilities created by those
			 alternatives.</text>
				</paragraph></subsection></section><section display-inline="no-display-inline" id="H9EA16D97CF3B4F77A4903538D722A8E2" section-type="subsequent-section"><enum>11.</enum><header>Pilot Program for
			 fingerprinting of maritime workers</header>
			<subsection id="HA4B34EAE788A4DFE9BDD448933B7C08F"><enum>(a)</enum><header>In
			 general</header><text>Within 180 days after the date of enactment of this Act,
			 the Secretary of Homeland Security shall establish procedures providing for an
			 individual who is required to be fingerprinted for purposes of obtaining a
			 transportation security card under section 70105 of title 46, United States
			 Code, to be fingerprinted at any facility operated by or under contract with an
			 agency of the Department of Homeland Security that fingerprints the public for
			 the Department.</text>
			</subsection><subsection id="HA708137B16CA402EBD9C4C36A531F6C9"><enum>(b)</enum><header>Expiration</header><text>This
			 section expires on December 31, 2012.</text>
			</subsection></section><section display-inline="no-display-inline" id="H24AD0A04169C40A4AA093570D7E17DE8" section-type="subsequent-section"><enum>12.</enum><header>Transportation
			 security cards on vessels</header><text display-inline="no-display-inline">Section 70105(b)(2) of title 46, United
			 States Code, is amended—</text>
			<paragraph id="H3FA2D19C975D4C68B3EC718D3BE426E9"><enum>(1)</enum><text>in subparagraph
			 (B), by inserting after <quote>title</quote> the following: <quote>allowed
			 unescorted access to a secure area designated in a vessel security plan
			 approved under section 70103 of this title</quote>; and</text>
			</paragraph><paragraph id="HB671353DE3384F8688F217102D1DB099"><enum>(2)</enum><text>in subparagraph
			 (D), by inserting after <quote>tank vessel</quote> the following:
			 <quote>allowed unescorted access to a secure area designated in a vessel
			 security plan approved under section 70103 of this title</quote>.</text>
			</paragraph></section><section id="H5E753012497D44CF9FC7FE9EA6516E29"><enum>13.</enum><header>International
			 labor study</header><text display-inline="no-display-inline">The Comptroller
			 General of the United States shall conduct a study of methods to conduct a
			 background security investigation of an individual who possesses a biometric
			 identification card that complies with International Labor Convention number
			 185 that are equivalent to the investigation conducted on individuals applying
			 for a visa to enter the United States. The Comptroller General shall submit a
			 report on the study within 180 days after the date of enactment of this Act to
			 the Committee on Transportation and Infrastructure and the Committee on
			 Homeland Security of the House of Representatives and the Committee on
			 Commerce, Science, and Transportation of the Senate.</text>
		</section><section id="H00C3E44573984C7FBFFC9466B3ED0249"><enum>14.</enum><header>Maritime
			 Security Advisory Committees</header><text display-inline="no-display-inline">Section 70112 of title 46, United States
			 Code, is amended—</text>
			<paragraph id="H061C7408C78C446F88438DAB5F43C41C"><enum>(1)</enum><text>by amending
			 subsection (b)(5) to read as follows:</text>
				<quoted-block id="H510461D2C1E849AA91FBED4627444B3B" style="OLC">
					<paragraph id="HCE58086D65BE40A6AF852198069A6CBE" indent="up1"><enum>(5)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H3FBF37975E7B4CB0821A2D5D0532F3E6"><enum>(A)</enum><text display-inline="yes-display-inline">The National Maritime Security Advisory
				Committee shall be composed of—</text>
							<clause id="HE32740D086744FF8AD1BBCFAA4A131C8"><enum>(i)</enum><text>at least 1 individual who
				represents the interests of the port authorities;</text>
							</clause><clause id="HB72137D73F3F4B7985655BE6716AF5B9"><enum>(ii)</enum><text>at least 1 individual who
				represents the interests of the facilities owners or operators;</text>
							</clause><clause id="H05F97CB3B55C44B78872059542E539CA"><enum>(iii)</enum><text>at least 1 individual who
				represents the interests of the terminal owners or operators;</text>
							</clause><clause id="H9E4E1E2F5BA2409E99C0FCD9802D18E2"><enum>(iv)</enum><text>at least 1 individual who
				represents the interests of the vessel owners or operators;</text>
							</clause><clause id="HF2245FB6FB1A4E32835586D65D429A7D"><enum>(v)</enum><text>at least 1 individual who
				represents the interests of the maritime labor organizations;</text>
							</clause><clause id="H5C72D0F059874773B722AAD92400C581"><enum>(vi)</enum><text>at least 1 individual who
				represents the interests of the academic community;</text>
							</clause><clause id="H8E971A0D32A5499282AA76A1A9D72279"><enum>(vii)</enum><text>at least 1 individual who
				represents the interests of State or local governments; and</text>
							</clause><clause id="H6AC8A2F07F10417B98B3ED5BD5A6C2AE"><enum>(viii)</enum><text>at least 1 individual who
				represents the interests of the maritime industry.</text>
							</clause></subparagraph><subparagraph id="HCAEDD48450D04EC9B2CE0902FC8B9ECD" indent="up1"><enum>(B)</enum><text>Each Area Maritime Security Advisory
				Committee shall be composed of individuals who represents the interests of the
				port industry, terminal operators, port labor organizations, and other users of
				the port areas.</text>
						</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="H57708179178C489CBE0B4C8E7FB6BD0A"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (g)—</text>
				<subparagraph id="H74E036186AED43FC8823EAC314241C5A"><enum>(A)</enum><text>in paragraph
			 (1)(A), by striking <quote>2008;</quote> and inserting

				</subparagraph></paragraph></section><section display-inline="no-display-inline" id="H04A28CFEAD894621B0D6CE038A2C5ACB" section-type="subsequent-section"><enum>15.</enum><header>Seamen’s shoreside
			 access</header><text display-inline="no-display-inline">Each facility security
			 plan approved under section 70103(c) of title 46, United States Code, shall
			 provide a system for seamen assigned to a vessel at that facility, pilots, and
			 representatives of seamen’s welfare and labor organizations to board and depart
			 the vessel through the facility in a timely manner at no cost to the
			 individual.</text>
		</section><section display-inline="no-display-inline" id="H47AD66F432594B3E84936AEB1192F2E5" section-type="subsequent-section"><enum>16.</enum><header>Waterside security of
			 certain dangerous cargo</header>
			<subsection id="HFE7B3DF7E80A443F8D3C1C43295C011B"><enum>(a)</enum><header>National
			 Study</header>
				<paragraph id="H8D05B3B966014C67B560603811CB8723"><enum>(1)</enum><header>In
			 general</header><text>The Secretary of Homeland Security, acting through the
			 Commandant of the Coast Guard, shall—</text>
					<subparagraph id="H89121EE451434290A756B863F60E4D9E"><enum>(A)</enum><text>initiate a
			 national study to identify measures to improve the security of maritime
			 transportation of certain dangerous cargo; and</text>
					</subparagraph><subparagraph id="HFEFF09820E4B4376AA049FFD0B66C653"><enum>(B)</enum><text>coordinate with
			 other Federal agencies, the National Maritime Security Advisory Committee, and
			 appropriate State and local government officials through the Area Maritime
			 Security Committees and other existing coordinating committees, to evaluate the
			 waterside security of vessels carrying, and waterfront facilities handling,
			 certain dangerous cargo.</text>
					</subparagraph></paragraph><paragraph id="H8DE66D268E764D98A008AF894628F0AF"><enum>(2)</enum><header>Matters to be
			 included</header><text>The study conducted under this subsection shall
			 include—</text>
					<subparagraph id="H422C9866295D495284126E5A6DE1A693"><enum>(A)</enum><text>an analysis of
			 existing risk assessment information relating to waterside security generated
			 by the Coast Guard and Area Maritime Security Committees as part of the
			 Maritime Security Risk Assessment Model;</text>
					</subparagraph><subparagraph id="H085596988BF34814868A45162E089E36"><enum>(B)</enum><text>a review and
			 analysis of appropriate roles and responsibilities of maritime stakeholders,
			 including Federal, State, and local law enforcement and industry security
			 personnel, responsible for waterside security of vessels carrying, and
			 waterfront facilities handling, certain dangerous cargo, including—</text>
						<clause id="H4AC7CEAD47BA458BA9A03B5D9110670D"><enum>(i)</enum><text>the
			 number of ports in which State and local law enforcement entities are providing
			 any services to enforce Coast Guard-imposed security zones around vessels
			 transiting to, through, or from United States ports or to conduct security
			 patrols in United States ports;</text>
						</clause><clause id="HCA7ED13D1E324CE0A511AE0D08191687"><enum>(ii)</enum><text>the
			 number of formal agreements entered into between the Coast Guard and State and
			 local law enforcement entities to engage State and local law enforcement
			 entities in the enforcement of Coast Guard-imposed security zones around
			 vessels transiting to, through, or from United States ports or the conduct of
			 port security patrols in United States ports, the duration of those agreements,
			 and the aid that State and local entities are engaged to provide through such
			 agreements;</text>
						</clause><clause id="HE7E5FF2CA1E14CFC9AAFCCA63F3241E8"><enum>(iii)</enum><text>the extent to
			 which the Coast Guard has set national standards for training, equipment, and
			 resources to ensure that State and local law enforcement entities engaged in
			 enforcing Coast Guard-imposed security zones around vessels transiting to,
			 through, or from United States ports or in conducting port security patrols in
			 United States ports (or both) can deter to the maximum extent practicable a
			 transportation security incident;</text>
						</clause><clause id="H990DEC9D1230485FB56A17D9EFBCC501"><enum>(iv)</enum><text>the
			 extent to which the Coast Guard has assessed the ability of State and local law
			 enforcement entities to carry out the security assignments that they have been
			 engaged to perform, including their ability to meet any national standards for
			 training, equipment, and resources that have been established by the Coast
			 Guard in order to ensure that those entities can deter to the maximum extent
			 practicable a transportation security incident;</text>
						</clause><clause id="H144273ED37CA4CDD8AC7239601316AE5"><enum>(v)</enum><text>the
			 extent to which State and local law enforcement entities are able to meet
			 national standards for training, equipment, and resources established by the
			 Coast Guard to ensure that those entities can deter to the maximum extent
			 practicable a transportation security incident;</text>
						</clause><clause id="H2C13F880571243BA96B4214F1DFB39FC"><enum>(vi)</enum><text>the
			 differences in law enforcement authority, and particularly boarding authority,
			 between the Coast Guard and State and local law enforcement entities, and the
			 impact that these differences have on the ability of State and local law
			 enforcement entities to provide the same level of security that the Coast Guard
			 provides during the enforcement of Coast Guard-imposed security zones and the
			 conduct of security patrols in United States ports; and</text>
						</clause><clause id="H0C31D3C36EB2453CBC3DD64789C956BE"><enum>(vii)</enum><text>the extent of
			 resource, training, and equipment differences between State and local law
			 enforcement entities and the Coast Guard units engaged in enforcing Coast
			 Guard-imposed security zones around vessels transiting to, through, or from
			 United States ports or conducting security patrols in United States
			 ports;</text>
						</clause></subparagraph><subparagraph id="HF2D1F7F81B0243E7894DBB47D3256F9B"><enum>(C)</enum><text>recommendations
			 for risk-based security measures to improve waterside security of vessels
			 carrying, and waterfront facilities handling, certain dangerous cargo;
			 and</text>
					</subparagraph><subparagraph id="H11D458735C284AD6BF050FB337488F9A"><enum>(D)</enum><text>identification of
			 security funding alternatives, including an analysis of the potential for
			 cost-sharing by the public and private sectors as well as any challenges
			 associated with such cost-sharing.</text>
					</subparagraph></paragraph><paragraph id="H0ED5F204AEAD445992B36663641DCA09"><enum>(3)</enum><header>Information
			 protection</header><text>In carrying out the coordination necessary to
			 effectively complete the study, the Commandant shall implement measures to
			 ensure the protection of any sensitive security information, proprietary
			 information, or classified information collected, reviewed, or shared during
			 collaborative engagement with maritime stakeholders and other Government
			 entities, except that nothing in this paragraph shall constitute authority to
			 withhold information from—</text>
					<subparagraph id="HC8F0FE9EB36A42769F7E9B55D7D15541"><enum>(A)</enum><text>the Congress;
			 or</text>
					</subparagraph><subparagraph id="H13EA8C0B31B8463B8A8A103775C46239"><enum>(B)</enum><text>first responders
			 requiring such information for the protection of life or property.</text>
					</subparagraph></paragraph><paragraph id="H0DA5FC54AE5B4EC38AD8DEF3D6F31372"><enum>(4)</enum><header>Report</header><text>Not
			 later than 12 months after the date of enactment of this Act, the Secretary,
			 acting through the Commandant, shall submit to the Committees on Homeland
			 Security and Transportation and Infrastructure of the House of Representatives
			 and the Committees on Commerce, Science, and Transportation and Homeland
			 Security and Governmental Affairs of the Senate a report on the results of the
			 study under this subsection.</text>
				</paragraph></subsection><subsection display-inline="no-display-inline" id="H4045BC8349334364960A64B8A7994E50"><enum>(b)</enum><header>National
			 strategy</header><text>Not later than 6 months after submission of the report
			 required by subsection (a), the Secretary, acting through the Commandant, shall
			 develop, in conjunction with appropriate Federal agencies, a national strategy
			 for the waterside security of vessels carrying, and waterfront facilities
			 handling, certain dangerous cargo. The strategy shall utilize the results of
			 the study required by subsection (a).</text>
			</subsection><subsection id="H25032E1E336B4B8D82D3584F0CE9D195"><enum>(c)</enum><header>Security of
			 certain dangerous cargo</header>
				<paragraph id="H842F7B56F0CF48DE95AF5F8659290708"><enum>(1)</enum><header>Enforcement of
			 security zones</header><text>Consistent with other provisions of Federal law,
			 the Coast Guard shall coordinate and be responsible for the enforcement of any
			 Federal security zone established by the Coast Guard around a vessel containing
			 certain dangerous cargo. The Coast Guard shall allocate available resources so
			 as to deter and respond to a transportation security incident, to the maximum
			 extent practicable, and to protect lives or protect property in danger.</text>
				</paragraph><paragraph id="HEADB90D36F584200A7B782D4078857E0"><enum>(2)</enum><header>Limitation on
			 reliance on State and local government</header><text>Any security arrangement
			 approved after the date of enactment of this Act to assist in the enforcement
			 of any security zone established by the Coast Guard around a vessel carrying a
			 certain dangerous cargo or around a waterfront facility handling a certain
			 dangerous cargo may not be based upon the provision of security by a State or
			 local government unless the Secretary, acting through the Commandant of the
			 Coast Guard, ensures that the waterborne patrols operated as part of that
			 security arrangement by a State or local government have the training,
			 resources, personnel, and experience necessary to carry out the security
			 responsibilities that they have been engaged to perform in order, to the
			 maximum extent practicable, to deter and respond to a transportation security
			 incident.</text>
				</paragraph><paragraph id="H0B2613B7CC7C46F3B54967A89FE38D3A"><enum>(3)</enum><header>Determination
			 required for new facilities</header><text>The Secretary of Homeland Security,
			 acting through the Commandant of the Coast Guard, may not approve a facility
			 security plan under section 70103 of title 46, United States Code, for a new
			 facility the construction of which is begun after the date of enactment of this
			 Act, that receives or ships through maritime commerce certain dangerous cargo
			 unless the Secretary determines that there are sufficient resources available
			 to ensure compliance with the facility security plan.</text>
				</paragraph><paragraph id="HC0CB02BD66F04EC68DCFC6F233A212C9"><enum>(4)</enum><header>Resource
			 deficiency reporting</header><text>The Secretary, acting through the Commandant
			 of the Coast Guard, shall provide to the Committees on Homeland Security and
			 Transportation and Infrastructure of the House of Representatives and the
			 Committees on Commerce, Science, and Transportation and Homeland Security and
			 Governmental Affairs of the Senate 90 days after the end of each fiscal year a
			 report indicating—</text>
					<subparagraph id="H159BB0F8653C4347B300B743A6A9C58F"><enum>(A)</enum><text>the number of
			 security zones established for certain dangerous cargo shipments;</text>
					</subparagraph><subparagraph id="HA349EA23ED2B4501837206FCD1ABF806"><enum>(B)</enum><text>the number of
			 certain dangerous cargo shipments provided a waterborne security escort,
			 subdivided by Federal, State, local, or private security; and</text>
					</subparagraph><subparagraph id="H6994105673C247A7A3AE5CC3BAF85A7B"><enum>(C)</enum><text>an assessment as
			 to any additional vessels, personnel, infrastructure, and other resources
			 necessary to provide waterborne escorts to those certain dangerous cargo
			 shipments for which a security zone is established.</text>
					</subparagraph></paragraph></subsection><subsection display-inline="no-display-inline" id="H9B2BD875845F4C6F808DF577694EE042"><enum>(d)</enum><header>Definitions</header><text>For
			 the purposes of this section, the follow definitions apply:</text>
				<paragraph id="H53BFA49DB5734B92AE759E88B2CFA7DC"><enum>(1)</enum><header>Certain
			 dangerous cargo</header><text>The term <term>certain dangerous cargo</term>
			 means a material, or a group or class of material, in a particular amount and
			 form that the Secretary, through the Commandant, determines by regulation poses
			 a significant risk of creating a transportation security incident while being
			 transported in maritime commerce.</text>
				</paragraph><paragraph id="H515B051C33EF42B9BDE88A631865FD43"><enum>(2)</enum><header>Area Maritime
			 Security Committee</header><text>The term <term>Area Maritime Security
			 Committee</term> means each of those committees responsible for producing Area
			 Maritime Transportation Security Plans under chapter 701 of title 46, United
			 States Code.</text>
				</paragraph><paragraph id="H77EC8F7AEE684014B2F4C3DC29798A20"><enum>(3)</enum><header>Transportation
			 security incident</header><text>The term <term>transportation security
			 incident</term> has the same meaning as that term has in section 70101 of title
			 46, United States Code.</text>
				</paragraph></subsection></section><section display-inline="no-display-inline" id="HE075D9EF985D44E4991F438605DA0443" section-type="subsequent-section"><enum>17.</enum><header>Review of Liquefied
			 Natural Gas Facilities</header>
			<subsection id="H2EF03822E1484A47AD7D3D5359DB0871"><enum>(a)</enum><header>Notice of
			 recommendation</header><text display-inline="yes-display-inline">Consistent
			 with other provisions of law, the Secretary of Homeland Security must notify
			 the Federal Energy Regulatory Commission when a recommendation is made that the
			 waterway to a proposed waterside liquefied natural gas facility is suitable or
			 unsuitable for the marine traffic associated with such facility.</text>
			</subsection><subsection id="HC087871B8DBB465186EED73BAB8431F4"><enum>(b)</enum><header>Federal Energy
			 Regulatory Commission response</header><text display-inline="yes-display-inline">The Federal Energy Regulatory Commission
			 shall respond to the Secretary’s recommendation under subsection (a) by
			 informing the Secretary within 90 days of notification or at the conclusion of
			 any available appeal process, whichever is later, of what action the Commission
			 has taken, pursuant to its authorities under the Natural Gas Act, regarding a
			 proposal to construct and operate a waterside liquefied natural gas facility
			 subject to a determination made under subsection (a).</text>
			</subsection></section><section id="H7093C9B38FD34C89B2B4BF9FFDC290D0"><enum>18.</enum><header>Use of secondary
			 authentication for transportation security cards</header><text display-inline="no-display-inline">The Secretary of Homeland Security may use a
			 secondary authentication system for individuals applying for transportation
			 security cards when fingerprints are not able to be taken or read to enhance
			 transportation security.</text>
		</section><section id="HEBDA3431A25C4157B5832A8BEA43B4AF"><enum>19.</enum><header>Assessment of
			 transportation security card enrollment sites</header>
			<subsection id="H5ED813A355014F6A915B77AA2479E4F0"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than 30
			 days after the date of the enactment of this Act, the Secretary of Homeland
			 Security shall prepare an assessment of the enrollment sites for transportation
			 security cards issued under section 70105 of title 46, United States Code,
			 including—</text>
				<paragraph id="H80779C237ADB498CA6AE5580C31A9741"><enum>(1)</enum><text display-inline="yes-display-inline">the feasibility of keeping those enrollment
			 sites open after the date of enactment of this Act; and</text>
				</paragraph><paragraph id="HBAC9A982D0D445DA8A0741E87D08AECB"><enum>(2)</enum><text>the quality of
			 customer service, including the periods of time individuals are kept on hold on
			 the telephone, whether appointments are kept, and processing times for
			 applications.</text>
				</paragraph></subsection><subsection id="H7815F1A0C34946E8A8E89BA865B7220B"><enum>(b)</enum><header>Timelines and
			 benchmarks</header><text display-inline="yes-display-inline">The Secretary
			 shall develop timelines and benchmarks for implementing the findings of the
			 assessment as the Secretary deems necessary.</text>
			</subsection></section><section id="HD92F38B49192453D93AC740C17F89BFE"><enum>20.</enum><header>Assessment of
			 the feasibility of efforts to mitigate the threat of small boat attack in major
			 ports</header><text display-inline="no-display-inline">The Secretary of the
			 department in which the Coast Guard is operating shall assess and report to
			 Congress on the feasibility of efforts to mitigate the threat of small boat
			 attack in security zones of major ports, including specifically the use of
			 transponders or radio frequency identification devices to track small
			 boats.</text>
		</section><section display-inline="no-display-inline" id="H985C55752A894B16BB627BE726584723" section-type="subsequent-section"><enum>21.</enum><header>Report and
			 recommendation for uniform security background checks</header><text display-inline="no-display-inline">Not later than one year after the date of
			 enactment of this Act, the Comptroller General shall submit to the Committee on
			 Homeland Security of the House of Representatives a report that
			 contains—</text>
			<paragraph id="H8D88BD751C174990853B389E33156EB2"><enum>(1)</enum><text display-inline="yes-display-inline">a review of background checks and forms of
			 identification required under State and local transportation security
			 programs;</text>
			</paragraph><paragraph id="H7251F1C6C47A43678923D9CBEF72E6EB"><enum>(2)</enum><text>a
			 determination as to whether the background checks and forms of identification
			 required under such programs duplicate or conflict with Federal programs;
			 and</text>
			</paragraph><paragraph id="HCD014F0F71B94BE79A9CDCD7BCC1C3A8"><enum>(3)</enum><text>recommendations on
			 limiting the number of background checks and forms of identification required
			 under such programs to reduce or eliminate duplication with Federal
			 programs.</text>
			</paragraph></section><section display-inline="no-display-inline" id="H244B1BBB5104435EB60E73B1EB0CE174" section-type="subsequent-section"><enum>22.</enum><header>Animal-propelled
			 vessels</header><text display-inline="no-display-inline">Notwithstanding
			 section 70105 of title 46, United States Code, the Secretary shall not require
			 an individual to hold a transportation security card, or be accompanied by
			 another individual who holds such a card if—</text>
			<paragraph id="H512EE56C7DFE4C16AA4C41F4719F0846"><enum>(1)</enum><text>the individual has
			 been issued a license, certificate of registry, or merchant mariner’s document
			 under part E of subtitle II of title 46, United States Code;</text>
			</paragraph><paragraph id="H21DB1F9C9E014214BAC1E79936904D7D"><enum>(2)</enum><text>the individual is
			 not allowed unescorted access to a secure area designated in a vessel or
			 facility security plan approved by the Secretary; and</text>
			</paragraph><paragraph id="HA03BAA37BA1B4AA0BFD82A84151E704B"><enum>(3)</enum><text>the individual is
			 engaged in the operation of a live animal-propelled vessel.</text>
			</paragraph></section><section display-inline="no-display-inline" id="H6B68F7A59687448FB92D7FEF16C796CE" section-type="subsequent-section"><enum>23.</enum><header>Requirements for
			 issuance of transportation security cards; access pending issuance; redundant
			 background checks</header><text display-inline="no-display-inline">Section
			 70105 of title 46, United States Code, is amended by adding at the end the
			 following new subsections:</text>
			<quoted-block id="H5DBDB0557F354B2D9FAF9DAFCFC9981F" style="OLC">
				<subsection id="HB3CCD47B1D3F4F4D9BC25977B4B6070B"><enum>(n)</enum><header>Escorting</header><text>The
				Secretary shall coordinate with owners and operators subject to this section to
				allow any individual who has a pending application for a transportation
				security card under this section or is waiting for reissuance of such card,
				including any individual whose card has been lost or stolen, and who needs to
				perform work in a secure or restricted area to have access to such area for
				that purpose through escorting of such individual in accordance with subsection
				(a)(1)(B) by another individual who holds a transportation security
				card.</text>
				</subsection><subsection id="H93A6E719085C4E9FB8B023A1F7063EAA"><enum>(o)</enum><header>Processing
				time</header><text>The Secretary shall review an initial transportation
				security card application and respond to the applicant, as appropriate,
				including the mailing of an Initial Determination of Threat Assessment letter,
				within 30 days after receipt of the initial application. The Secretary shall,
				to the greatest extent practicable, review appeal and waiver requests submitted
				by a transportation security card applicant, and send a written decision or
				request for additional information required for the appeal or waiver
				determination, within 30 days after receipt of the applicant’s appeal or waiver
				written request. For an applicant that is required to submit additional
				information for an appeal or waiver determination, the Secretary shall send a
				written decision, to the greatest extent practicable, within 30 days after
				receipt of all requested information.</text>
				</subsection><subsection id="HC90D53B0B8E54125BE0D36970BC54608"><enum>(p)</enum><header>Receipt of
				cards</header><text>Within 180 days after the date of enactment of this
				subsection, the Secretary shall develop a process to permit an individual
				approved for a transportation security card under this section to receive the
				card at the individual’s place of residence.</text>
				</subsection><subsection id="HF8C19D905CBB464FA689C4AEE11ABA81"><enum>(q)</enum><header>Fingerprinting</header><text>The
				Secretary shall establish procedures providing for an individual who is
				required to be fingerprinted for purposes of this section to be fingerprinted
				at facilities operated by or under contract with an agency of the Department of
				the Secretary that engages in fingerprinting the public for transportation
				security or other security purposes.</text>
				</subsection><subsection id="H53039D24CAB9429891315AA77907E9B2"><enum>(r)</enum><header>Redundant
				background checks</header><text display-inline="yes-display-inline">The
				Secretary shall prohibit a State or political subdivision thereof from
				requiring a separate security background check for any purpose for which a
				transportation security card is issued under this section. The Secretary may
				waive the application of this subsection with respect to a State or political
				subdivision thereof if the State or political subdivision demonstrates a
				compelling homeland security reason that a separate security background check
				is
				necessary.</text>
				</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HEB9A68E0CA92414E83882AEB6FE35B6A"><enum>24.</enum><header>Harmonizing
			 security card expirations</header><text display-inline="no-display-inline">Section 70105(b) of title 46, United States
			 Code, is amended by adding at the end the following new paragraph:</text>
			<quoted-block id="H4601422D7524438EB291D69868D606DC" style="OLC">
				<paragraph id="HF7110A50797A464684E411DFC8D186EA" indent="up1"><enum>(6)</enum><text>The Secretary may extend for up to
				one year the expiration of a biometric transportation security card required by
				this section to align the expiration with the expiration of a license,
				certificate of registry, or merchant mariner document required under chapter 71
				or 73.</text>
				</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H2F4B6C4CCDBD44F0BB5FB6E1EE994A88"><enum>25.</enum><header>Administration
			 of Maritime Security</header>
			<subsection id="H8CCCAF66656A48B4B5ABDCBE54C10A60"><enum>(a)</enum><header>Establish
			 maritime security as a Coast Guard function</header><text>Chapter 5 of title
			 14, United States Code, is further amended by adding at the end the following
			 new section:</text>
				<quoted-block id="H14B9FA0ED58745FE8785AED9E8C2B711" style="USC">
					<section id="H4A56D7C0FB3349E6B8361051C68C90BB"><enum>103.</enum><header>Maritime
				security</header><text display-inline="no-display-inline">To protect life,
				property, and the environment on, under, and over waters subject to the
				jurisdiction of the United States and on vessels subject to the jurisdiction of
				the United States, the Commandant shall promote maritime security as
				follows:</text>
						<paragraph id="H672ECC18F66B44438409114F3686EC8A"><enum>(1)</enum><text>By taking actions
				necessary in the public interest to protect such life, property, and the
				environment.</text>
						</paragraph><paragraph id="H47F9B9BB2E4A446E9C745856B7B12852"><enum>(2)</enum><text>Based on
				priorities established by the Commandant including—</text>
							<subparagraph id="HF4F02F94D5194B91BDA72F1E6B2E85CA"><enum>(A)</enum><text>protecting
				maritime borders from all intrusions, reducing the risk from terrorism to
				United States passengers at foreign and domestic ports and in designated
				waterfront facilities, and preventing and responding to terrorist attacks and
				other homeland security threats;</text>
							</subparagraph><subparagraph id="H9C99C073B08744059138DE5F8EF686D5"><enum>(B)</enum><text>protecting
				critical maritime infrastructure and other key resources; and</text>
							</subparagraph><subparagraph id="H77D5FB1DCF2F48F48ED0F0E80B437233"><enum>(C)</enum><text>preventing, to the
				maximum extent practicable, a transportation security incident as defined in
				section 70101 of title
				46.</text>
							</subparagraph></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H9FABC0B468064592B4F5148A4D668F76"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The analysis at the beginning of such chapter is
			 further amended by adding at the end the following new item:</text>

				general</header><text>The Secretary, acting through the Commandant, shall
				ensure appropriate coverage of maritime security missions within the workforce
				in each sector.</text>
								</paragraph><paragraph id="H31B0A55BDB9746CDA8CF1C1BF40C5A4B"><enum>(2)</enum><header>Required
				positions</header><text>In designating positions under paragraph (1), the
				Secretary shall include the following maritime security-related
				positions:</text>
									<subparagraph id="HE452E3CAC20F43CDAF3495A868FA9D39"><enum>(A)</enum><text>Program
				oversight.</text>
									</subparagraph><subparagraph id="H08FC958373814D51892BE076A7D1A65D"><enum>(B)</enum><text>Counterterrorism
				functions.</text>
									</subparagraph><subparagraph id="H9E00FB32FBFB46D4A698D10FAD8A3F45"><enum>(C)</enum><text>Counterintelligence
				functions.</text>
									</subparagraph><subparagraph id="H6E26EE93A05D489180F914864E3EA3B1"><enum>(D)</enum><text>Criminal
				investigations related to maritime security.</text>
									</subparagraph><subparagraph id="H255E1EE0DD944BB98F6246BA3480E854"><enum>(E)</enum><text>Port security
				enforcement.</text>
									</subparagraph><subparagraph id="H3E232A3FDEE141A79423CA7516216EC6"><enum>(F)</enum><text>Any other
				activities that the Commandant deems as necessary.</text>
									</subparagraph></paragraph><paragraph id="H071F22753559461F9F26B636EA79FAE9"><enum>(3)</enum><header>Maritime
				security management activities</header><text>The Secretary shall also designate
				under paragraph (1) those maritime security-related management positions
				located at Coast Guard headquarters, Coast Guard Readiness Command, Coast Guard
				Operations Command, the Deployable Operations Group, and the Intelligence
				Coordination Center.</text>
								</paragraph></subsection><subsection id="HAD1DDC5C30A94FE0BF6A6BE90288F7DA"><enum>(b)</enum><header>Career
				paths</header><text>The Secretary, acting through the Commandant, may establish
				appropriate career paths for civilian and military Coast Guard personnel who
				wish to pursue careers in maritime security are identified in terms of the
				education, training, experience, and assignments necessary for career
				progression of civilians and member of the Armed Forces to the most senior
				maritime security positions. The Secretary shall make available published
				information on such career paths.</text>
							</subsection><subsection id="HBB94C99D20BF402BB2A6BE65B1AA5C51"><enum>(c)</enum><header>Balanced
				workforce policy</header><text>In the development of maritime security
				workforce policies under this section with respect to any civilian employees or
				applicants for employment with the Coast Guard, the Secretary shall, consistent
				with the merit system principles set out in paragraphs (1) and (2) of section
				2301(b) of title 5, take into consideration the need to maintain a balance
				workforce in which women and members of racial and ethnic minority groups are
				appropriately represented in Government service.</text>
							</subsection><subsection id="H02B23914F09E4C0FB842103B412912BF"><enum>(d)</enum><header>Sector Chief of
				Maritime Security</header>
								<paragraph id="HD7117CA2B8624891A932A71BD6ADFC31"><enum>(1)</enum><header>In
				general</header><text>The Commandant may assign, as appropriate, a Chief of
				Maritime Security who shall be at least a Lieutenant Commander or civilian
				employee within the grade GS–13 of the General Schedule in each Coast Guard
				sector.</text>
								</paragraph><paragraph id="HF75D1EB4BB31458AAF1C39F61E29B1B0"><enum>(2)</enum><header>Functions</header><text>The
				Chief of Maritime Security for a sector—</text>
									<subparagraph id="H9171E3233A744FE8B6407AD3C9D14388"><enum>(A)</enum><text>is responsible for
				all individuals who, on behalf of the Coast Guard, conduct port security
				operations, counterterrorism operations, intelligence and counterintelligence
				operations, and support national defense operations; and</text>
									</subparagraph><subparagraph id="H0B15E9AF77F34BF19D13756E3C343656"><enum>(B)</enum><text>if not the Coast
				Guard officer in command of that sector, is the principal advisor to the Sector
				Commander regarding maritime security matters in that sector.</text>
									</subparagraph></paragraph></subsection><subsection id="H4769A08DE6D5408C995A26494859306D"><enum>(e)</enum><header>Signatories of
				letter of qualification</header><text>Each individual signing a letter of
				qualification for maritime security personnel must hold a letter of
				qualification for the type being certified.</text>
							</subsection></section><section id="HDD5E103A32C7498D9E78D6F0B5B21027"><enum>61.</enum><header>Centers of
				expertise for maritime security</header>
							<subsection id="HB7D9C24F89544C8EBAD1EA5EACB43C00"><enum>(a)</enum><header>Establishment</header><text>The
				Commandant may establish and operate one or more centers of Maritime Security
				(in this section referred to as a <quote>Center</quote>).</text>
							</subsection><subsection id="H48D51166A64B4B45B8F6A05CD69AD7B1"><enum>(b)</enum><header>Missions</header><text>The
				Centers shall—</text>
								<paragraph id="H2398A3AB61494E07AA88BB1EF18E94AA"><enum>(1)</enum><text>be used to
				facility education, training, and research in maritime security including
				maritime domain awareness, counterterrorism policy and operations, and
				intelligence collection, fusion, and dissemination;</text>
								</paragraph><paragraph id="HB86C7C95589F4337969C24E8B845C544"><enum>(2)</enum><text>develop a
				repository on information on maritime security; and</text>
								</paragraph><paragraph id="HCC3521768069433FA15DB9417877FDCE"><enum>(3)</enum><text>perform any other
				function as the Commandant may specify.</text>
								</paragraph></subsection><subsection id="H9166EA933D8C4E55AAC29D265B6A6F80"><enum>(c)</enum><header>Joint operation
				with educational institution authorized</header><text>The Commandant may enter
				into an agreement with an appropriate official of an institution of higher
				education to—</text>
								<paragraph id="H26AA5A59807B46E592ED5BE0EAAFEF84"><enum>(1)</enum><text>provide for joint
				operation of a Center; and</text>
								</paragraph><paragraph id="HA8E7D86EF16146478DF5DB950B2A4B3B"><enum>(2)</enum><text>provide necessary
				administrative service for a Center, including administration and allocation of
				funds.</text>
								</paragraph></subsection><subsection id="H0BDB686A1A214CC7902055D7043E9C80"><enum>(d)</enum><header>Acceptance of
				donations</header>
								<paragraph id="H7BC83A42DA02427184748FD157C2587D"><enum>(1)</enum><header>In
				general</header><text>The Commandant may accept, on behalf of a center,
				donations to be used to defray the costs of the Center or to enhance the
				operation of the Center.</text>
								</paragraph><paragraph id="H0DF926F1FC2F4C6E8E57E0C2D683678F"><enum>(2)</enum><header>Guidance</header><text>The
				Commandant shall prescribe written guidance setting forth the criteria to be
				used in determining if the acceptance of a donation is
				appropriate.</text>
								</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H57D4512B822C42ABA7F3C9DD0D9953DE"><enum>(2)</enum><header>Clerical
			 amendment</header><text>The analysis at the beginning of such chapter is
			 further amended by adding at the end the following new items:</text>

			 duties</header><text>Section 93 of title 14, United States Code, is amended by
			 adding at the end the following new subsection:</text>
				<quoted-block id="H357633A695B649F4A86BC5A951CADA30" style="OLC">
					<subsection id="H45CC028F4AAA457C88A77B786493BF7E"><enum>(e)</enum><text>In exercising the
				Commandant’s duties and responsibilities with regard to maritime security, the
				Commandant shall designate a flag officer to serve as the principal advisor to
				the Commandant for maritime security. The designee shall have at least 10 years
				combined experience in operations, intelligence, counterterrorism,
				counterintelligence, port security, criminal investigations (except maritime
				casualty investigations), and port security or other maritime security
				functions, and at least four years of leadership experience at a staff or unit
				carrying out maritime security
				functions.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="H2AE4DAC5F5CA46DEA833C23B2BE7D4CA"><enum>26.</enum><header>Fresnel Lens in
			 the Presque Isle Light House in Presque Isle, Michigan</header><text display-inline="no-display-inline">The Commandant of the Coast Guard shall
			 conduct a study and analysis of the feasibility of the restoring the Fresnel
