			 United States force structure in Europe and report on future changes in
			 composition and capabilities</header>
			<subsection display-inline="no-display-inline" id="HD44D061DC2F0431C9FC7AD3CCF6BAD5B"><enum>(a)</enum><header>Force Structure
			 policy</header><text display-inline="yes-display-inline">It is the policy of
			 the United States that the current deployment of units of the United States
			 Armed Forces at military installations in European member nations of the North
			 Atlantic Treaty Organization is a force-structure arrangement and set of
			 military capabilities that are adequate to permit the United States—</text>
				<paragraph id="H7B32F551B5AA409F942100BBE6B1F295"><enum>(1)</enum><text display-inline="yes-display-inline">to satisfy the commitments undertaken by
			 United States pursuant to article 5 of the North Atlantic Treaty, signed at
			 Washington, District of Columbia, on April 4, 1949, and entered into force on
			 August 24, 1949 (63 Stat. 2241; TIAS 1964);</text>
				</paragraph><paragraph id="HF60FC6A536DE4529A10411B67EC64BA0"><enum>(2)</enum><text display-inline="yes-display-inline">to address the current security environment
			 in Europe, including United States participation in theater cooperation
			 activities; and</text>
				</paragraph><paragraph id="HAD552A92BE36487484D8AE60EA483861"><enum>(3)</enum><text display-inline="yes-display-inline">to contribute to peace and stability in
			 Europe.</text>
				</paragraph></subsection><subsection id="HF4480CAE3CCD4F6C9EBA52C2E939A04B"><enum>(b)</enum><header>Report on force
			 structure changes in composition and capabilities</header>
				<paragraph id="HE9DEA250AD5D4095800D110993E9DF6C"><enum>(1)</enum><header>Report
			 required</header><text display-inline="yes-display-inline">Not later than one
			 year after the date of the enactment of this Act, the Secretary of Defense
			 shall submit to the Committees on Armed Services of the Senate and House of
			 Representatives a report evaluating potential changes in the composition and
			 capabilities of units of the United States Armed Forces at military
			 installations in European member nations of the North Atlantic Treaty
			 Organization—</text>
					<subparagraph id="HEB1B316D70FA497ABCBC5AF7B47CE9CB"><enum>(A)</enum><text>to better achieve
			 the policy objectives specified in paragraphs (1), (2), and (3) of subsection
			 (a); and</text>
					</subparagraph><subparagraph id="H3522782A686B4163838396664CC535FD"><enum>(B)</enum><text>to better utilize
			 such units to respond to other United States national security
			 responsibilities.</text>
					</subparagraph></paragraph><paragraph id="H9AC4FADE304B4A7581C81D7CCC1D20F8"><enum>(2)</enum><header>Matters to be
			 considered</header><text display-inline="yes-display-inline">As part of the
			 report, the Secretary of Defense shall consider—</text>
					<subparagraph id="H25E42906EB004BAD828CF80871EFDECB"><enum>(A)</enum><text display-inline="yes-display-inline">the stationing of advisory and assist
			 brigades at military installations in Europe;</text>
					</subparagraph><subparagraph id="H46256A2250B04B7EA0844D8FB2005693"><enum>(B)</enum><text display-inline="yes-display-inline">the expanded use of Joint Task Forces to
			 train and build mutual capabilities with partner countries; and</text>
					</subparagraph><subparagraph id="H70F5FBC29C4D4E0081CE2C80E942A392"><enum>(C)</enum><text display-inline="yes-display-inline">the stationing of units of the United
			 States Armed Forces to support missile defense and cyber-security
			 missions.</text>
					</subparagraph></paragraph></subsection></section><section id="HD2F2010D3276464D870F1D982911B593" section-type="subsequent-section"><enum>3.</enum><header>Codification of
			 congressional notification requirement before permanent relocation of any
			 United States military unit stationed outside the United States</header>
			<subsection id="HFA829ED9A44242ED8F6C0C103224DEAB"><enum>(a)</enum><header>Codification and
			 related report</header><text display-inline="yes-display-inline">Chapter 6 of
			 title 10, United States Code, is amended by inserting after section 162 the
			 following new section:</text>
				<quoted-block display-inline="no-display-inline" id="H446C22812F1C45A18A6FD7B0842422E0" style="USC">
					<section id="HE3EDA7FD4984416CA2913D1E6E63ECA9"><enum>162a.</enum><header>Congressional
				notification before permanent relocation of military units stationed outside
				the United States</header>
						<subsection display-inline="no-display-inline" id="H7656948E2D6244C7BBB3ED464EC25010"><enum>(a)</enum><header>Notification
				requirement</header><text>The Secretary of Defense shall notify Congress at
				least 30 days before the permanent relocation of a unit stationed outside the
				United States.</text>
						</subsection><subsection id="HA9ED5F6789AD45BC82E8474A9D4295A9"><enum>(b)</enum><header>Elements of
				notification</header><text display-inline="yes-display-inline">The notification
				required by subsection (a) shall include a description of the following:</text>
							<paragraph id="H302E48A43CE4415FBF368C2929CA3F48"><enum>(1)</enum><text>How relocation of
				the unit supports the United States national security strategy.</text>
							</paragraph><paragraph id="HBA50D44229AD4AB8A5B7D0540CD46F58"><enum>(2)</enum><text display-inline="yes-display-inline">How relocation of the unit supports the
				security commitments undertaken by the United States pursuant to any
				international security treaty, including the North Atlantic Treaty, the Treaty
				of Mutual Cooperation and Security between the United States and Japan, and the
				Security Treaty Between Australia, New Zealand, and the United States of
				America.</text>
							</paragraph><paragraph id="H26F81757B20542C9B244E5B02B42114B"><enum>(3)</enum><text display-inline="yes-display-inline">How relocation of the unit addresses the
				current security environment in the affected geographic combatant command’s
				area of responsibility, including United States participation in theater
				security cooperation activities and bilateral partnership, exchanges, and
				training exercises.</text>
							</paragraph><paragraph id="H92BF755A84FA45E69C604F26FB248E61"><enum>(4)</enum><text display-inline="yes-display-inline">How relocation of the unit impacts the
				status of overseas base closure and realignment actions undertaken as part of a
				global defense posture realignment strategy and the status of development and
				execution of comprehensive master plans for overseas military main operating
				bases, forward operating sites, and cooperative security locations of the
				global defense posture of the United States.</text>
							</paragraph></subsection><subsection id="HF8FF60DC1C7A47E3998E727C469DB50B"><enum>(c)</enum><header>Exceptions</header><text display-inline="yes-display-inline">Subsection (a) does not apply in the case
				of—</text>
							<paragraph id="H016E2B0A9CF540B7B7DC3600C0D0E816"><enum>(1)</enum><text>the relocation of
				a unit deployed to a combat zone; or</text>
							</paragraph><paragraph id="H6C8435D811A74E35BD0113C16DECD2A3"><enum>(2)</enum><text display-inline="yes-display-inline">the relocation of a unit as the result of
				closure of an overseas installation at the request of the government of the
				host nation in the manner provided in the agreement between the United States
				and the host nation regarding the installation.</text>
							</paragraph></subsection><subsection id="HC26F29087EC747669368ECD66F5D7C68"><enum>(d)</enum><header>Definitions</header><text>In
				this section:</text>
							<paragraph id="H4E9795821F4D408B95121BD4E44FB232"><enum>(1)</enum><header>Combat
				zone</header><text display-inline="yes-display-inline">The term <term>combat
				zone</term> has the meaning given that term in section 112(c)(2) of the
				Internal Revenue Code of 1986.</text>
							</paragraph><paragraph id="H1E9FCED2AD604CCFBD13BD8937D75BB0"><enum>(2)</enum><header>Geographic
				combatant command</header><text>The term <term>geographic combatant
				command</term> means a combatant command with a geographic area of
				responsibility that does not include North America.</text>
							</paragraph><paragraph id="HCF769C468A6849F6A721F21EBDDE080A"><enum>(3)</enum><header>Unit</header><text>The
				term <term>unit</term> has the meaning determined by the Secretary of Defense
				for purposes of this
				section.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HF4C26342B77D41BCAF17A1D28C384CBD"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of sections at the beginning of such chapter
			 is amended by inserting after the item relating to section 162 the following
			 new item:</text>

			 superceded notification requirement</header><text display-inline="yes-display-inline">Section 1063 of the National Defense
			 Authorization Act for Fiscal Year 2010 (Public Law 111–84; 123 Stat. 2469; 10
			 U.S.C. 113 note) is repealed.</text>
			</subsection></section><section id="H001B5F85CA9244C5BDD7615C5DF3C718" section-type="subsequent-section"><enum>4.</enum><header>Modification and
			 extension of authorities relating to program to build the capacity of foreign
			 military forces to support the European Command and other geographic combatant
			 commands</header>
			<subsection id="H1A3E84D184784F38AB8ED8B8C5846D97"><enum>(a)</enum><header>Authority</header><text display-inline="yes-display-inline">Subsection (a) of section 1206 of the
			 National Defense Authorization Act for Fiscal Year 2006 (Public Law 109–163;
			 119 Stat. 3456), as most recently amended by section 1206(a) of the Duncan
			 Hunter National Defense Authorization for Fiscal Year 2009 (Public Law 110–417;
			 122 Stat. 4625), is further amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H17E4A8D0D0444E4387A392FD60783844" style="OLC">
					<paragraph id="H727647B3DE4C4F839E6B9C6C198AE1A8"><enum>(3)</enum><text display-inline="yes-display-inline">To build the capacity of a foreign
				country’s national military forces in order for that country to support the
				theater priorities of the applicable geographic combatant
				command.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HE1419A81BE3B4B999F6E33F8A0C1BEDB"><enum>(b)</enum><header>Limitations</header>
				<paragraph id="HA395B4F66C9A4295A580FF122442E125"><enum>(1)</enum><header>Annual funding
			 limitation</header><text>Subsection (c)(1) of such section, as amended by
			 section 1206(b) of the Duncan Hunter National Defense Authorization Act for
			 Fiscal Year 2009 (Public Law 110–417; 122 Stat. 4625), is further amended by
			 striking <quote>$350,000,000</quote> and inserting
			 <quote>$500,000,000</quote>.</text>
				</paragraph><paragraph id="HB98DD4FFE3D54992B2C2631A8B6C0F9D"><enum>(2)</enum><header>Availability of
			 funds for activities across fiscal years</header><text>Subsection (c)(4) of
			 such section is amended by striking <quote>the next fiscal year</quote> and
			 inserting <quote>any of the next 2 fiscal years</quote>.</text>
				</paragraph></subsection><subsection id="H3C64C0B5AE7945BF9F07D46446671A66"><enum>(c)</enum><header>Implementation
			 plan; definition</header><text>Such section is further amended—</text>
				<paragraph id="HA5B21A3374034E1598AC8DBED0DF76F1"><enum>(1)</enum><text>by redesignating
			 subsection (g) as subsection (i); and</text>
				</paragraph><paragraph id="H2C1A06AB0F0F4ECEA0236FE0E92182BC"><enum>(2)</enum><text>by inserting after
			 subsection (f) the following:</text>
					<quoted-block display-inline="no-display-inline" id="H6DB8B52BC288460F83A2A0188D3AA8BC" style="OLC">
						<subsection id="H92ECB799FF104AED86FFDD86DD7C2687"><enum>(g)</enum><header>Report on
				implementation plan</header>
							<paragraph id="HDE1742BD9F484730B5721B785844B039"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Secretary of
				Defense shall submit to the congressional committees specified in subsection
				(e)(3) a report on the plan for the implementation of the program described in
				subsection (a)(3) and the allocation of funds under such program for each of
				fiscal years 2011 through 2013. Such plan shall be submitted in conjunction
				with the budget submitted to Congress by the President pursuant to section
				1105(a) of title 31, United States Code, for each of fiscal years 2011 through
				2013.</text>
							</paragraph><paragraph id="H0D9B81A99E3448069E9AAB9F9A92805B"><enum>(2)</enum><header>Matters
				covered</header><text>The report required under paragraph (1) shall contain a
				description of—</text>
								<subparagraph id="HEBF0387CBAA0444FB6B3B06A9C3E6AEF"><enum>(A)</enum><text display-inline="yes-display-inline">how the plan supports the United States
				national security strategy;</text>
								</subparagraph><subparagraph id="HD0E6C6D7285E4F1EBED99356AB8535E8"><enum>(B)</enum><text>how the plan
				addresses the current security environment in each geographic combatant
				command’s area of responsibility, including United States participation in
				theater security cooperation activities and bilateral partnership, exchanges,
				and training exercises; and</text>
								</subparagraph><subparagraph id="H68B94FBFCDA0420A89EBF2EE975816D1"><enum>(C)</enum><text>any comments
				resulting from an interagency review of the plan that includes the Department
				of State and other relevant Federal departments and agencies.</text>
								</subparagraph></paragraph></subsection><subsection id="H9F43272B1EDD43D2AB6FA9097EDD8B10"><enum>(h)</enum><header>Definition</header><text display-inline="yes-display-inline">In this section, the term <term>geographic
				combatant command</term> means a combatant command with a geographic area of
				responsibility that does not include North
				America.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H98D02F01B4E34DB28A545D4C6933835D"><enum>(d)</enum><header>Two-Year
			 extension of authority</header><text>Subsection (i) of such section, as
			 redesignated by subsection (d)(1) of this section and as most recently amended
			 by section 1206(c) of the Duncan Hunter National Defense Authorization Act for
			 Fiscal Year 2009 (Public Law 110–417; 122 Stat. 4625), is further amended
			 by—</text>
				<paragraph id="H0B1E9799A1624C5DB63A109AAC5DA6C9"><enum>(1)</enum><text>by striking
			 <quote>September 30, 2011</quote> and inserting <quote>September 30,
			 2013</quote>; and</text>
				</paragraph><paragraph id="HDD68474A5E9E4274BA2244883D770C37"><enum>(2)</enum><text>by striking
			 <quote>fiscal years 2006 through 2011</quote> and inserting <quote>fiscal years
			 2006 through 2013</quote>.</text>
				</paragraph></subsection></section><section id="HCE18E40DB0D2459C8591241344EBE3F9" section-type="subsequent-section"><enum>5.</enum><header>Extended deterrence
			 commitment to Europe</header>
			<subsection id="HBF43FE5CD7D64B74974C6D303E48CC6A"><enum>(a)</enum><header>Policy on
			 extended deterrence commitment to Europe</header><text display-inline="yes-display-inline">It is the policy of the United States
			 that—</text>
				<paragraph id="H3EDC8B0068044F88838D79A189EDE25A"><enum>(1)</enum><text display-inline="yes-display-inline">it maintain its commitment to extended
			 deterrence, specifically the nuclear alliance of the North Atlantic Treaty
			 Organization, as an important component of ensuring and linking the national
			 security interests of the United States and the security of its European
			 allies;</text>
				</paragraph><paragraph id="H7D847CB142664C20B63CC8AFD69A190A"><enum>(2)</enum><text display-inline="yes-display-inline">forward-deployed nuclear forces of the
			 United States shall remain based in Europe in support of the nuclear policy and
			 posture of NATO; and</text>
				</paragraph><paragraph id="HAF248035809B45339EBFFACD6A4D85B9"><enum>(3)</enum><text display-inline="yes-display-inline">the presence of nuclear weapons of the
			 United States in Europe—combined with NATO’s unique nuclear sharing
			 arrangements under which non-nuclear members participate in nuclear planning
			 and possess specially configured aircraft capable of delivering nuclear
			 weapons—contributes to the cohesion of NATO and provides reassurance to allies
			 and partners who feel exposed to regional threats.</text>
				</paragraph></subsection><subsection id="H6D02468934D24E2A881AE60568087F16"><enum>(b)</enum><header>Limitation on
			 reductions in nuclear forces based in Europe</header><text display-inline="yes-display-inline">In light of the policy expressed in
			 subsection (a), no action may be taken to effect or implement the reduction of
			 nuclear forces of the United States that are based in Europe unless—</text>
				<paragraph id="H1F9AE24724CA4B388B737DC7E83E3A35"><enum>(1)</enum><text display-inline="yes-display-inline">the reduction in such nuclear forces is
			 requested by the government of the host nation in the manner provided in the
			 agreement between the United States and the host nation regarding the forces;
			 or</text>
				</paragraph><paragraph id="HE6FC5B16A99F400592BE0FABBFDC70E6"><enum>(2)</enum><text display-inline="yes-display-inline">the President certifies that—</text>
					<subparagraph id="H0976FABA986548BDB661354099B4A735"><enum>(A)</enum><text display-inline="yes-display-inline">the nuclear policy and nuclear posture of
			 NATO has changed, reducing the need for such nuclear forces to be based in
			 Europe;</text>
					</subparagraph><subparagraph id="HA2D4D586E20E4A249AA60ADCCCD3CC5A"><enum>(B)</enum><text display-inline="yes-display-inline">NATO member states have considered the
			 reduction in the High Level Group and NATO has decided to support such
			 reduction;</text>
					</subparagraph><subparagraph id="H693E5AAFBC054F63B0BDC34FA17CF7C2"><enum>(C)</enum><text>the remaining
			 nuclear forces of the United States that are based in Europe after such
			 reduction provide a commensurate or better level of safety, security,
			 reliability, and credibility as before such reduction;</text>
					</subparagraph><subparagraph id="H14C2713CD9D745E49D10E282DE915A3A"><enum>(D)</enum><text display-inline="yes-display-inline">such reduction is compensated by other
			 measures (such as nuclear modernization, conventional forces, and missile
			 defense) which together provide a commensurate or better deterrence capability
			 and assurance of NATO member states in a manner consistent with the NATO
			 Strategic Concept; and</text>
					</subparagraph><subparagraph id="H015F55FAC1604686822EEDEB395C8D2F"><enum>(E)</enum><text>the Russian
			 Federation has made commensurate reductions to its deployed tactical nuclear
			 weapons.</text>
					</subparagraph></paragraph></subsection><subsection id="HE0475158CE3F471BA7F68C97470AC185"><enum>(c)</enum><header>Report</header><text display-inline="yes-display-inline">Upon any decision to reduce the nuclear
			 forces of the United States that are based in Europe, the President shall
			 submit to the Committees on Armed Services of the Senate and House of
			 Representatives a report containing—</text>
				<paragraph id="H0F2BDA6191BF40569FF14E2808E2FA5B"><enum>(1)</enum><text display-inline="yes-display-inline">the certification required by subsection
			 (b)(2);</text>
				</paragraph><paragraph id="H0C13300F2FC449AEB682FF8E16B1562F"><enum>(2)</enum><text>justification for
			 such reduction; and</text>
				</paragraph><paragraph id="HB6B5512083B14EF68C56F07AF3A485E2"><enum>(3)</enum><text display-inline="yes-display-inline">an assessment of how NATO member states, in
			 light of such reduction, assess the credibility of the deterrence capability of
			 the United States in support of its commitments undertaken pursuant to article
			 5 of the North Atlantic Treaty, signed at Washington, District of Columbia, on
			 April 4, 1949, and entered into force on August 24, 1949 (63 Stat. 2241; TIAS
			 1964).</text>
				</paragraph></subsection><subsection display-inline="no-display-inline" id="H684B32C25D33478896E7594D54791EA6"><enum>(d)</enum><header>Notice and wait
			 requirement</header><text display-inline="yes-display-inline">The President may
			 not commence a reduction in the nuclear forces of the United States that are
			 based in Europe for which the certification required by subsection (b)(2) is
			 made until the expiration of a 180-day period beginning on the date on which
			 the President submits the report under subsection (c) containing the
			 certification.</text>
			</subsection><subsection commented="no" id="H8D569A18E40A485AAE9EFDB956671815"><enum>(e)</enum><header>Authorization of
			 appropriations</header><text display-inline="yes-display-inline">There is
			 authorized to be appropriated to the Secretary of Defense and the Administrator
			 for Nuclear Security a total of $300,000,000 for fiscal year 2011 for—</text>
				<paragraph id="HF8C3713B1D0645FA9459DCF971042E64"><enum>(1)</enum><text>developing the
			 F–35 Lightning II aircraft into a dual-capable aircraft by outfitting it with a
			 nuclear-capable delivery system; and</text>
				</paragraph><paragraph id="H3F003B76F2EC4404B3371217F71CF536"><enum>(2)</enum><text>supporting the
			 life extension program for the B61 gravity bomb.</text>
				</paragraph></subsection></section><section id="H687FCB2817D84119A6145A08B22BBD0C"><enum>6.</enum><header>Availability of
			 funds for long-range missile defense in Europe</header>
			<subsection id="H6D2573E76C24431A948CFCCFE74E8C5F"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds the following:</text>
				<paragraph id="HC1AF4E60CC4648AAAB3D0646C4471A59"><enum>(1)</enum><text display-inline="yes-display-inline">Missile defense promotes the collective
			 security of the United States and NATO and improves linkages among member
			 nations of NATO by defending all members of NATO against the full range of
			 missile threats.</text>
				</paragraph><paragraph id="H6C69D20E36A240E3AAD017F62C3FC6C7"><enum>(2)</enum><text display-inline="yes-display-inline">The Director of National Intelligence,
			 appearing before the Senate Select Committee on Intelligence on February 2,
			 2010, testified that, <quote>The Iranian regime continues to flout UN Security
			 Council restrictions on its nuclear program … We judge Iran would likely choose
			 missile delivery as its preferred method of delivering a nuclear weapon. Iran
			 already has the largest inventory of ballistic missiles in the Middle East and
			 it continues to expand the scale, reach, and sophistication of its ballistic
			 missile forces—many of which are inherently capable of carrying a nuclear
			 payload.</quote>.</text>
				</paragraph><paragraph id="H492FBC571AAC48C8B55019A11AFB460A"><enum>(3)</enum><text>The Unclassified
			 Report on Military Power of Iran, dated April 2010, states that, <quote>With
			 sufficient foreign assistance, Iran could probably develop and test an
			 intercontinental ballistic missile (ICBM) capable of reaching the United States
			 by 2015. Iran could also have an intermediate-range ballistic missile (IRBM)
			 capable of threatening Europe.</quote>.</text>
				</paragraph><paragraph id="H801F9EC8C05E47F1B04D7E1A54A4A50B"><enum>(4)</enum><text>However, phase 3
			 of the proposed phased, adaptive approach for missile defense in Europe is
			 planned to provide coverage of all of Europe by 2018 and phase 4 is planned to
			 provide additional coverage of the United States by 2020.</text>
				</paragraph><paragraph id="HACCC1C48A27148AE9F53F9934CC781A1"><enum>(5)</enum><text display-inline="yes-display-inline">According to the February 2010 Ballistic
			 Missile Defense Review, the United States will continue the development and
			 assessment of a two-stage ground-based interceptor as part of a hedging
			 strategy and, as further noted by the Under Secretary of Defense for Policy
			 during testimony before the Committee on Armed Services of the House of
			 Representatives on October 1, 2009, <quote>We keep the development of the
			 two-stage [ground-based interceptor] on the books as a hedge in case things
			 come earlier, in case there’s any kind of technological challenge with the
			 later models of the SM–3.</quote>.</text>
				</paragraph></subsection><subsection id="H1F469677A7C349C6A4A3038F84ACBCF9"><enum>(b)</enum><header>Policy</header><text>It
			 shall be the policy of the United States to—</text>
				<paragraph id="H195A0954028C4CECB042DB368FF0851A"><enum>(1)</enum><text>field long-range
			 missile defenses in Europe that provide territorial defense of all NATO allies
			 from intercontinental and intermediate-range ballistic missiles by the time
			 such threats materialize;</text>
				</paragraph><paragraph id="H6B5CFE7D0C104D5F818FC25C16743023"><enum>(2)</enum><text display-inline="yes-display-inline">ensure that the standard missile-3 block
			 IIA interceptors provide full coverage of Europe against medium- and
			 intermediate-range ballistic missiles launched from the Middle East and that
			 the standard missile-3 block IIB interceptors provide additional coverage of
			 the United States against intercontinental ballistic missiles launched from the
			 Middle East; and</text>
				</paragraph><paragraph commented="no" id="H63AD8F11DDCB4D739E122C639F6C18BB"><enum>(3)</enum><text>continue the
			 development and testing of the two-stage ground-based interceptor to maintain
			 it—</text>
					<subparagraph id="HCEC560DD81374553BE1A5691C104198C"><enum>(A)</enum><text display-inline="yes-display-inline">in the event that the long-range ballistic
			 missile threat materializes sooner than the planned availability of the
			 standard missile-3 block IIA or block IIB interceptor missiles;</text>
					</subparagraph><subparagraph id="HE5E13BA225974A88BA6F7082826A61FE"><enum>(B)</enum><text>in the event of
			 technical challenges associated with the standard missile-3 interceptor
			 missile; and</text>
					</subparagraph><subparagraph id="H851D52F3983F42AC85EA22BDE0C440C4"><enum>(C)</enum><text>as a complement to
			 the missile defense capabilities deployed in Alaska and California for the
			 defense of the United States.</text>
					</subparagraph></paragraph></subsection><subsection id="HF370C46EB2EB4B369A4CEBE4AC911FEF"><enum>(c)</enum><header>Reservation of
			 funds</header><text display-inline="yes-display-inline">Of the funds
			 appropriated pursuant to an authorization of appropriations made available for
			 fiscal years 2012 and 2013 for the Missile Defense Agency, $300,000,000 shall
			 be available only for long-range missile defense in Europe as described
			 subsection (d).</text>
			</subsection><subsection id="HC089EE0DFC2D404CB90DAE809D0F90F0"><enum>(d)</enum><header>Use of
			 funds</header><text display-inline="yes-display-inline">Funds reserved under
			 subsection (c) may be obligated and expended by the Secretary of
			 Defense—</text>
				<paragraph id="HB3F1FC8018964304ACC2575304277E33"><enum>(1)</enum><text>to accelerate the
			 research, development, test, evaluation, procurement, and fielding of a
			 standard missile-3 block IIA or block IIB interceptor capable of intercepting
			 intermediate or intercontinental ballistic missiles;</text>
				</paragraph><paragraph id="H6C4FE8EBB3AF4F9A8234BAEB0705AE7D"><enum>(2)</enum><text>on the research,
			 development, test, evaluation, procurement, and fielding of a two-stage
			 ground-based interceptor; and</text>
				</paragraph><paragraph id="HDD46603E44D4467580AA2FA79F5AA571"><enum>(3)</enum><text>on an additional
			 flight test of a two-stage ground-based interceptor.</text>
				</paragraph></subsection></section><section id="HB28884388B0E47C2A5C8283ED7CC7AE7" section-type="subsequent-section"><enum>7.</enum><header>Sense of Congress on
			 missile defense and New Start Treaty with Russian Federation</header>
			<subsection id="H142DD92F99DB4C74968D9B5E53BBB6F1"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds the following:</text>
				<paragraph id="H72087197D80341808F1DE21454E9C129"><enum>(1)</enum><text display-inline="yes-display-inline">The United States and the Russian
			 Federation signed the Treaty between the United States of America and the
			 Russian Federation on Measures for the Further Reduction and Limitation of
			 Strategic Offensive Arms (commonly known as the <quote>New START
			 Treaty</quote>) on April 8, 2010.</text>
				</paragraph><paragraph id="HDC7EE200BBCA4CB4AA0EF2AA99482AF4"><enum>(2)</enum><text>The preamble of
			 the New START Treaty states, <quote>Recognizing the existence of the
			 interrelationship between strategic offensive arms and strategic defensive
			 arms, that this interrelationship will become more important as strategic
			 nuclear arms are reduced, and that current strategic defensive arms do not
			 undermine the viability and effectiveness of the strategic offensive arms of
			 the Parties.</quote>.</text>
				</paragraph><paragraph id="HD73E759A4BA04F3E9F27884BB39C6E10"><enum>(3)</enum><text display-inline="yes-display-inline">Officials of the United States have stated
			 that the New START Treaty does not restrain the program for missile defense of
			 the United States at bases in California and Alaska, nor does it restrain the
			 phased, adaptive approach for missile defense in Europe.</text>
				</paragraph><paragraph id="HF3C84276D2CC4E55B5E63378AE49AFB7"><enum>(4)</enum><text>However, a
			 statement from the office of the Russian president states, <quote>The Treaty
			 between the Russian Federation and the United States of America on the
			 Reduction and Limitation of Strategic Offensive Arms signed in Prague on April
			 8, 2010, can operate and be viable only if the United States of America
			 refrains from developing its missile defence capabilities quantitatively or
			 qualitatively.</quote>.</text>
				</paragraph><paragraph id="H209339237BDE42A4BB86859B9D937C36"><enum>(5)</enum><text>Additionally,
			 Russian Foreign Minister Sergei Lavrov stated that Russia would have the right
			 to withdraw from the treaty <quote>if the U.S.’s build-up of its missile
			 defense strategic potential in numbers and quality begins to considerably
			 affect the efficiency of Russian strategic nuclear forces.</quote>.</text>
				</paragraph></subsection><subsection id="H2B52E0A4CD0B4959BAF6F85DE4BB97EC"><enum>(b)</enum><header>Sense of
			 Congress</header><text>It is the sense of Congress that—</text>
				<paragraph id="HEA08C9615CDA45E5B563AFBC87A5547E"><enum>(1)</enum><text>there are no
			 limitations on any phases of the phased, adaptive approach to missile defense
			 resulting from ratification of the New START treaty between the United States
			 and Russia, signed on 8 April 2010;</text>
				</paragraph><paragraph id="HECD68748FCD24B0F974633771B9CFC33"><enum>(2)</enum><text>the United States
			 should deploy all four phases of the phased, adaptive approach for missile
			 defense in Europe to protect the United States, deployed forces, and NATO
			 allies against short, medium, and long-range ballistic missile threats
			 consistent with the announced time lines of such threats; and</text>
				</paragraph><paragraph id="HC62037DCFAB04E63884940C290B35892"><enum>(3)</enum><text>the ground-based
			 midcourse defense system in Alaska and California should be maintained,
			 evolved, and expanded because it is the only missile defense capability as of
			 the date of the enactment of this Act that would protect the United States from
			 the growing threat of a long-range ballistic missile attack.</text>
				</paragraph></subsection></section><section display-inline="no-display-inline" id="H630606989C7F4F8495CAEBE01E9A000C" section-type="subsequent-section"><enum>8.</enum><header>Air Force scholarships
			 for Partnership for Peace nations to participate in the Euro-NATO Joint Jet
			 Pilot Training Program</header>
			<subsection id="HFB49AB9B2C3C4D148960F1B610A6179A"><enum>(a)</enum><header>Scholarships
			 authorized</header><text display-inline="yes-display-inline">Chapter 901 of
			 title 10, United States Code, is amended by adding at the end the following new
			 section:</text>
				<quoted-block display-inline="no-display-inline" id="H1720CC0CC84C4EC482571422308530F3" style="USC">
					<section id="H328677190B474C9A9B0374356E7ED06F"><enum>9325.</enum><header>Euro-NATO
				Joint Jet Pilot Training Program: participation scholarships for Partnership
				for Peace nations</header>
						<subsection id="H8125E8A89DF34F518FF8C17875766527"><enum>(a)</enum><header>Establishment of
				scholarship program</header><text display-inline="yes-display-inline">Under
				regulations prescribed by the Secretary of Defense, the Secretary of the Air
				Force shall establish and maintain a scholarship program to allow personnel of
				the air forces of countries that are signatories of the Partnership for Peace
				Framework Document to receive undergraduate pilot training and necessary
				related training through the Euro-NATO Joint Jet Pilot Training (ENJJPT)
				program.</text>
						</subsection><subsection id="H87E4F016AA4543988AF29C8B2EB372F4"><enum>(b)</enum><header>Transportation,
				supplies, and allowance</header><text display-inline="yes-display-inline">Under
				such conditions as the Secretary of the Air Force may prescribe, the Secretary
				may provide to a person receiving a scholarship under the scholarship
				program—</text>
							<paragraph id="H58D16FD8D0CB4C4E9524BC0B34BDDDAB"><enum>(1)</enum><text display-inline="yes-display-inline">transportation incident to the training
				received under the ENJJPT program;</text>
							</paragraph><paragraph id="HF3B2AEC1F26E4B7F8318226B3D8AF1AD"><enum>(2)</enum><text>supplies and
				equipment to be used during the training;</text>
							</paragraph><paragraph id="HBF06E9DF9C9D48E18092038D0722F29E"><enum>(3)</enum><text>flight clothing
				and other special clothing required for the training;</text>
							</paragraph><paragraph id="HBD58350F756940B2B2BCD3056FEA5A19"><enum>(4)</enum><text>billeting, food,
				and health services; and</text>
							</paragraph><paragraph id="HC3E240E688084279AA885F3DF3C14473"><enum>(5)</enum><text display-inline="yes-display-inline">a living allowance at a rate to be
				prescribed by the Secretary, taking into account the amount of living
				allowances authorized for a member of the armed forces under similar
				circumstances.</text>
							</paragraph></subsection><subsection id="H8F6BDB9121664FE68A37FE4688B23744"><enum>(c)</enum><header>Rules of
				construction</header><paragraph commented="no" display-inline="yes-display-inline" id="H153689E44CAE457AB75830FCA5005398"><enum>(1)</enum><text display-inline="yes-display-inline">The provision of scholarships under the
				scholarship program to personnel of an air force of a foreign country shall not
				be construed or interpreted to imply diplomatic recognition of the country as a
				member of the North Atlantic Treaty Organization.</text>
							</paragraph><paragraph id="H588C5330E02347F68A218CDD45DFB586" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Nothing in this section shall be construed
				or interpreted to supersede the authority of the ENJJPT Steering Committee
				under the ENJJPT Memorandum of Understanding. Countries whose air force
				personnel receive scholarships under the scholarship program shall not have
				privilege of ENJJPT Steering Committee representation.</text>
							</paragraph></subsection><subsection id="H9DDAEC44E6E3442789FF12BA6C320447"><enum>(d)</enum><header>Cost-Sharing</header><text display-inline="yes-display-inline">For purposes of ENJJPT cost-sharing,
				personnel of an air force of a foreign country who receive a scholarship under
				the scholarship program shall be counted as United States
				pilots.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HD4A8FADB23B849E2B0C9C0EE9FA88CEC"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of sections at the beginning of such chapter
			 is amended by adding at the end the following new item:</text>
