		  animal cruelty) of title 18, United States Code, and for other

		<section id="HD79548DA97C5451BAAA5BB10E9EAF13F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Animal Torture Prevention Act of
			 2010</short-title></quote>.</text>
		</section><section id="H07F1D3191B5D4982A77C46832E1FE548" section-type="subsequent-section"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds the following:</text>
			<paragraph id="H6F4395074B7745D3AF958DD0E2532A01"><enum>(1)</enum><text>The Federal
			 Government and the several States have a compelling interest in preventing acts
			 of extreme animal cruelty.</text>
			</paragraph><paragraph id="H7FB68FCE45984E089B201CB6B69EF222"><enum>(2)</enum><text>Each of the
			 several States and the District of Columbia criminalize intentional acts of
			 extreme animal cruelty.</text>
			</paragraph><paragraph id="H2C5C19E71C954B989A5EBCBB2695C332"><enum>(3)</enum><text>The clandestine
			 nature of certain acts of extreme animal cruelty allows the perpetrators of
			 such crimes to remain anonymous, thus frustrating the ability of Federal and
			 State authorities to enforce the criminal statutes prohibiting such
			 behavior.</text>
			</paragraph><paragraph id="HCF1627C7D3864008B29C1BED7968A054"><enum>(4)</enum><text>These criminal
			 acts constitute an integral part of the production of and market for so-called
			 crush videos and other depictions of extreme animal cruelty.</text>
			</paragraph><paragraph id="H48EA295F93E042E3B2B9C154D0339822"><enum>(5)</enum><text>The creation,
			 advertisement, and sale of crush videos and other depictions of extreme animal
			 cruelty provide an economic incentive for, and are intrinsically related to,
			 the underlying acts of criminal conduct.</text>
			</paragraph></section><section id="H07885E1DF53F48BC8812061447545E29"><enum>3.</enum><header>Depiction of
			 extreme animal cruelty</header>
			<subsection id="H371A151CB37E498CB9B60346B2F27ED2"><enum>(a)</enum><header>In
			 general</header><text>Section 48 of title 18, United States Code, is amended to
			 read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H54E3536F6D524CC594F54A1EDEDF0E74" style="USC">
					<section id="H2E21C0215A9D43429C29D5B5378068F6"><enum>48.</enum><header>Depiction of
				extreme animal cruelty</header>
						<subsection id="H49E4046394AA4454BC451776B62D57A2"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">Whoever, in or affecting interstate or
				foreign commerce, knowingly creates, sells, distributes, or offers to sell or
				distribute a depiction of extreme animal cruelty shall be fined under this
				title or imprisoned not more than 5 years, or both.</text>
						</subsection><subsection id="H04A417677A3A4683A3E97FC4A5BE95C0"><enum>(b)</enum><header>Definitions</header><text>In
				this section—</text>
							<paragraph id="H1055301D05EC45C184F8D4B66FF8128F"><enum>(1)</enum><text>the term
				<quote>depiction of extreme animal cruelty</quote> means any visual depiction,
				including any photograph, motion-picture film, video recording, or electronic
				image, that—</text>
								<subparagraph id="H8616FF437D154EA592B81AB9F9D4F16B"><enum>(A)</enum><text>depicts actual
				conduct in which one or more animals is tortured, maimed, mutilated, or
				subjected to other acts of extreme animal cruelty, if such conduct is committed
				for the primary purpose of creating the depiction;</text>
								</subparagraph><subparagraph id="H1FC1DD9905BE4A2086037B2F0F8BA6FA"><enum>(B)</enum><text>depicts conduct
				that violates a criminal prohibition of intentional cruelty to animals under
				Federal law or the law of the State in which the depiction is created, sold, or
				distributed;</text>
								</subparagraph><subparagraph id="H078E33BDE2DC44E4BD9F1F9BDA2925D4"><enum>(C)</enum><text>appeals to the
				prurient interest; and</text>
								</subparagraph><subparagraph id="HAD0B2CF6151F407DB1F5F617E25D262D"><enum>(D)</enum><text>taken as a whole,
				does not have more than de minimis religious, political, scientific,
				educational, journalistic, historical, or artistic value;</text>
								</subparagraph></paragraph><paragraph id="H68B474B6741C4D328C60EAF66DB39B84"><enum>(2)</enum><text>the term
				<quote>State</quote> means each of the several States, the District of
				Columbia, the Commonwealth of Puerto Rico, the Virgin Islands, Guam, American
				Samoa, the Commonwealth of the Northern Mariana Islands, and any other
				commonwealth, territory, or possession of the United States; and</text>
							</paragraph><paragraph id="H5382AD5D7FF04A7CA0A76BE91D227123"><enum>(3)</enum><text>the term
				<quote>animal</quote> means any live amphibian, reptile, bird, or mammal,
				except human
				beings.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H0C1B8C569FE54EF283F65F74FDB39600"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The item relating to section 48 in the table of
			 sections at the beginning of chapter 3 of title 18, United States Code, is
			 amended to read as follows:</text>
