		<section id="HBDEF3F67B95941A3BF3FE00CBA686E5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Airport Security Act of 2010</short-title></quote>.</text>
		</section><section id="H9B7087504ACA444582009572875CB111"><enum>2.</enum><header>Prohibition of
			 possession of firearms at airports</header>
			<subsection id="H9A986726F6544979BFD64B7E420019E5"><enum>(a)</enum><header>Program To
			 prohibit possession</header><text display-inline="yes-display-inline">Section
			 44903 of title 49, United States Code, is amended by adding at the end the
			 following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="H40C7E8515C674693BC78BFD8D1EEC81F" style="USC">
					<subsection id="H94F884DA9DD74F1EA95E88DDC7253068"><enum>(m)</enum><header>Program To
				prohibit possession of firearms at airports</header>
						<paragraph id="H3D91385188AD48D4BB98434D92011BEE"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Assistant Secretary of Homeland
				Security (Transportation Security Administration) shall establish and carry out
				a program to prohibit, except as provided in paragraph (3), any individual from
				possessing a firearm at a covered airport, including any individual who enters
				the airport, or who exits public transportation at the airport, for the
				following purposes:</text>
							<subparagraph id="HB2176A79233043F0A4922AFD9E21783D"><enum>(A)</enum><text>Air travel.</text>
							</subparagraph><subparagraph id="H197EC2C177E145799000E09A17A7F4B4"><enum>(B)</enum><text>Meeting another
				individual.</text>
							</subparagraph><subparagraph id="H63149800C5164E758B66396B02BC3833"><enum>(C)</enum><text>Picking up
				cargo.</text>
							</subparagraph><subparagraph id="HD67B98280806442D8D73A79B5F8ABE97"><enum>(D)</enum><text>Employment at the
				airport.</text>
							</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="HD5010859998F4ECC8356491BFDB27E9"><enum>(2)</enum><header>Requirements for
				airport operators</header><text display-inline="yes-display-inline">In carrying
				out the program established under paragraph (1), the Assistant Secretary shall
				require each airport operator to—</text>
							<subparagraph id="H8724AB10FA394CCAB900BF7B55EEC8E4"><enum>(A)</enum><text>conspicuously
				display notices summarizing the program—</text>
								<clause id="H58F1ECAE3B864E168DF389F069947CCB"><enum>(i)</enum><text>at
				each entrance to the airport; and</text>
								</clause><clause id="H38E81B1B98BD4AB0B94F797FCD9BA59"><enum>(ii)</enum><text>in
				such form, and containing such information, as the Assistant Secretary shall by
				regulation prescribe; and</text>
								</clause></subparagraph><subparagraph id="H691B6D8921CB4495A3595C58B47B129F"><enum>(B)</enum><text>require law
				enforcement personnel to—</text>
								<clause id="HEEC46C20A02F402FB434288C23E2BA93"><enum>(i)</enum><text>monitor the
				airport to prevent violations of paragraph (1); and</text>
								</clause><clause id="HC02A38D119054D8BBEB00181BBC4B951"><enum>(ii)</enum><text>escort any
				individual described in paragraph (3)(B)(ii) who is discovered by such
				personnel to be in possession of a firearm referred to in paragraph (3)(B)(i),
				to ensure that such individual continues to be excepted from paragraph (1) by
				reason of paragraph (3)(B).</text>
								</clause></subparagraph></paragraph><paragraph display-inline="no-display-inline" id="HED1ABAED538940A9A8919D6F74944CDE"><enum>(3)</enum><header>Exceptions</header><text display-inline="yes-display-inline">The following individuals shall not be
				prohibited by paragraph (1) from possessing a firearm under such
				paragraph:</text>
							<subparagraph id="H07C5E804357F48F192036BD0EB7382F"><enum>(A)</enum><header>Individuals
				authorized to carry a firearm</header><text>An individual who, by regulation,
				is authorized by the Administrator of the Federal Aviation Administration or
				the Assistant Secretary to carry a firearm at the covered airport.</text>
							</subparagraph><subparagraph id="H26C69393453047529E1304D7C81B40AA"><enum>(B)</enum><header>Travelers</header><text>An
				individual who possesses a firearm, if—</text>
								<clause id="H8A22E723697C4C7A9D8F12AC6E485BB5"><enum>(i)</enum><text>the firearm is
				unloaded, carried in a hard-sided container that is locked, and the key or
				combination to the lock is in the exclusive possession of the individual;
				and</text>
								</clause><clause display-inline="no-display-inline" id="H256BA571F3BD4646ADEEDA00F6A40003"><enum>(ii)</enum><text>the
				individual—</text>
									<subclause id="H38B700BD553B4B378F59FCE22CAE29C5"><enum>(I)</enum><text>is carrying a
				ticket in the name of the individual for a flight that is scheduled for
				departure from the covered airport within 24 hours or that has arrived at the
				airport within the preceding 24 hours; or</text>
									</subclause><subclause id="H9A0589AAFB194B17A4D34F3FF6C28BF2"><enum>(II)</enum><text display-inline="yes-display-inline">communicates the intention to obtain a
				ticket for departure referred to in subclause (I) at the covered airport and
				obtains and carries such ticket or does not obtain such ticket for a compelling
				reason.</text>
									</subclause></clause></subparagraph><subparagraph id="H96CCEC31C5C343E2B3C85E7F1133EE68"><enum>(C)</enum><header>Individuals
				shipping firearms</header><text>An individual who possesses a firearm in a
				capacity relating to the shipment of the firearm in air commerce and who, by
				regulation, is authorized by the Administrator of the Federal Aviation
				Administration or the Assistant Secretary to possess the firearm at the covered
				airport in such capacity.</text>
							</subparagraph><subparagraph id="HB7882355E41B4C9598237088408570F0"><enum>(D)</enum><header>Law enforcement
				officers</header><text>An on-duty law enforcement officer of a State or
				political subdivision of a State, or an officer or employee of the Federal
				Government, who is authorized to carry a firearm.</text>
							</subparagraph><subparagraph id="HD08769EB073040B0874A497044903D6D"><enum>(E)</enum><header>Certain
				individuals on public transportation</header><text display-inline="yes-display-inline">An individual passing through an airport on
				public transportation.</text>
							</subparagraph><subparagraph id="H22DCDEDDB4C5485FBB00421EFB733326"><enum>(F)</enum><header>Additional
				authorized individuals</header><text display-inline="yes-display-inline">An
				individual who is otherwise authorized by the Administrator of the Federal
				Aviation Administration or the Assistant Secretary to possess a firearm at a
				covered airport.</text>
							</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="HB88D5D3EE3BD481DA0B5D4D26385CBC"><enum>(4)</enum><header>Issuance of
				regulations</header><text>Not later than one year after the date of enactment
				of this Act, the Assistant Secretary of Homeland Security (Transportation
				Security Administration) shall issue regulations to carry out this
				subsection.</text>
						</paragraph><paragraph id="H7DA10A48B478499EA8432CAEBF70CBFD"><enum>(5)</enum><header>Definitions</header><text>In
				this subsection:</text>
							<subparagraph id="H58C89DF49341478B9CEED3FA90C50094"><enum>(A)</enum><header>Airport</header><text display-inline="yes-display-inline">The term <quote>airport</quote> means an
				airport and any appurtenant building or area that is related to the operation
				of the airport, including a building or area on the site of the airport
				designed to—</text>
								<clause id="HE778591183244864B845F1FCE2BB0B2"><enum>(i)</enum><text>receive passengers
				or cargo before or after a flight; or</text>
								</clause><clause id="H96C3AF3FAD0D445DBC1408E9007B9E87"><enum>(ii)</enum><text>facilitate
				arrival at or departure from the airport, including—</text>
									<subclause id="HA2F05D9EF02C47C18F58F76F07E3C2AA"><enum>(I)</enum><text display-inline="yes-display-inline">a road or section of road used primarily
				for arrival at or departure from the airport;</text>
									</subclause><subclause id="HFB6EF6798F5040669B1398B7642E268E"><enum>(II)</enum><text>an airport
				parking area; and</text>
									</subclause><subclause id="HF4D3414756644A9ABB02464912CA46B1"><enum>(III)</enum><text>a public
				transportation stop.</text>
									</subclause></clause></subparagraph><subparagraph display-inline="no-display-inline" id="H1C4B598A604D4F148D7E7F4F12D315CE"><enum>(B)</enum><header>Airport
				operator</header><text>The term <quote>airport operator</quote> means the
				operator of a covered airport.</text>
							</subparagraph><subparagraph display-inline="no-display-inline" id="H1DEBC15DFC054368B915B1D061A2159E"><enum>(C)</enum><header>Assistant
				Secretary</header><text display-inline="yes-display-inline">The term
				<quote>Assistant Secretary</quote> means the Assistant Secretary of Homeland
				Security (Transportation Security Administration).</text>
							</subparagraph><subparagraph id="HED163EBA7D81456B896EC746A884F3BE"><enum>(D)</enum><header>Covered
				airport</header><text display-inline="yes-display-inline">The term
				<quote>covered airport</quote> means an airport that in the preceding fiscal
				year received an amount allocated or apportioned under chapter 471.</text>
							</subparagraph><subparagraph display-inline="no-display-inline" id="H8B2532882BAE4A8E0072D0A9E1E1441B"><enum>(E)</enum><header>Firearm</header><text>The
				term <quote>firearm</quote> has the meaning given the term in section 921(a)(3)
				of title 18.</text>
							</subparagraph><subparagraph id="H34AB4B0A156E43F2996BD98F5EA4BF71"><enum>(F)</enum><header>Public
				transportation</header><text display-inline="yes-display-inline">The term
				<quote>public transportation</quote> means a conveyance that provides regular
				and continuing general or special transportation to the
				public.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H4E80DABB32DD46EEABFC50977EB1D0A1"><enum>(b)</enum><header>Criminal penalty
			 for possession</header>
				<paragraph id="H5FE2BAB97D7440D0BE424B8D611168C7"><enum>(1)</enum><header>In
			 general</header><text>Chapter 44 of title 18, United States Code, is amended by
			 adding at the end the following new section:</text>
					<quoted-block display-inline="no-display-inline" id="HCFC079F835CC41ACA10031205D16229D" style="USC">
						<section id="HDD077A0B7C644A36AC004BFE815152E4"><enum>932.</enum><header>Possession of
				firearms at airports</header>
							<subsection id="H82D8D929F7504CF2A000CF28AA95FA40"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">Except as provided in
				subsection (b), an individual who knowingly possesses a firearm at a covered
				airport shall be fined under this title, imprisoned not more than 10 years, or
				both.</text>
							</subsection><subsection id="HA8432058F30A41DABA8999BF6013008D"><enum>(b)</enum><header>Exceptions</header><text>Subsection
				(a) shall not apply to an individual described in section 44903(m)(3) of title
				49.</text>
							</subsection><subsection id="H4500E6CADCB44122A59D3B8E993D3EAE"><enum>(c)</enum><header>Definition of
				covered airport</header><text>In this section, the term <quote>covered
				airport</quote> has the meaning given the term in section 44903(m)(5)(D) of
				title
				49.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H083096148F964870B4CB518FCDC20087"><enum>(2)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendment made by
			 paragraph (1) shall take effect on the date that is 30 days after the date on
			 which the Assistant Secretary of Homeland Security (Transportation Security
			 Administration) has issued regulations pursuant to section 44903(m)(4) of title
			 49, United States Code (as added by subsection (a)).</text>
				</paragraph><paragraph id="HDEA95DACA4BE4C299BA8DC49018D6FBF"><enum>(3)</enum><header>Conforming
			 amendment</header><text>The table of sections for chapter 44 of title 18,
			 United States Code, is amended by adding at the end the following new
			 item:</text>
