		<section id="H6DA584E86BAE4F5D8FFF47C121C77ADC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Brownfields Reauthorization Act of
			 2010</short-title></quote>.</text>
		</section><section id="H72AE475D12FA4671AFF3F12008437412"><enum>2.</enum><header>Clarification of
			 State or local government ownership</header><text display-inline="no-display-inline">Section 101(20)(D) of the Comprehensive
			 Environmental Response, Compensation, and Liability Act of 1980 (42 U.S.C.
			 9601(20)(D)) is amended by striking <quote>involuntarily</quote> after
			 <quote>acquired ownership or control</quote>.</text>
		</section><section id="H008A1B638D0D4BB89198DF787E5F613F"><enum>3.</enum><header>Nonprofit
			 organization eligibility</header>
			<subsection id="H46114E7394D54513B258FCE80B50E378"><enum>(a)</enum><header>Definition of
			 eligible entity</header><text display-inline="yes-display-inline">Section
			 104(k)(1) of the Comprehensive Environmental Response, Compensation, and
			 Liability Act of 1980 (42 U.S.C. 9604(k)(1)) is amended—</text>
				<paragraph id="HA0564A4958F7407DA875F8D636ECE63B"><enum>(1)</enum><text>in subparagraph
			 (G), by striking <quote>Alaska; or</quote> and inserting
			 <quote>Alaska;</quote>;</text>
				</paragraph><paragraph id="HC5F3438ABED84BACADDA532EED8FC255"><enum>(2)</enum><text>in subparagraph
			 (H), by striking <quote>Indian community.</quote> and inserting <quote>Indian
			 community; or</quote>; and</text>
				</paragraph><paragraph commented="no" id="HD596BF2574614661991F2EA4D2F49D31"><enum>(3)</enum><text>by adding at the
			 end the following new subparagraph:</text>
					<quoted-block display-inline="no-display-inline" id="H2E2B11023CD74F4580E7E523234D8768" style="OLC">
						<subparagraph commented="no" id="HA13941F180EA4114A3E6738E8F10B95B"><enum>(I)</enum><text display-inline="yes-display-inline">a nonprofit organization, including—</text>
							<clause commented="no" id="HD792563821604AD8AB115AB9D06424C9"><enum>(i)</enum><text>an organization
				described in section 501(c)(3) of the Internal Revenue Code of 1986 and exempt
				from taxation under section 501(a) of such Code;</text>
							</clause><clause commented="no" id="HE9A3A0EA725047BF8F31A9E293C348FC"><enum>(ii)</enum><text>a limited
				liability corporation in which all managing members or all members are
				organizations described under clause (i);</text>
							</clause><clause commented="no" id="HBDADD14BD0E04CA1977C346A80A1C911"><enum>(iii)</enum><text>a limited
				partnership in which all general partners are—</text>
								<subclause commented="no" id="H786F45DEC12B4F6192DA88472F68CAEC"><enum>(I)</enum><text>organizations
				described under clause (i);</text>
								</subclause><subclause commented="no" id="HED666C5D8D42464A9E12521FA689C908"><enum>(II)</enum><text>limited liability
				corporations whose members are all organizations described under clause (i);
				or</text>
								</subclause><subclause commented="no" id="H4EACB47E8DF543649A457BBA6E1CF6DD"><enum>(III)</enum><text>any combination
				of subclauses (I) and (II); or</text>
								</subclause></clause><clause commented="no" id="HA8F08F3727BD4E7A81452ECFA70932A7"><enum>(iv)</enum><text>a qualified
				community development entity, as defined in section 45D(c)(1) of the Internal
				Revenue Code of
				1986.</text>
							</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H21EFCB5E031B47A1942032A75902739D"><enum>(b)</enum><header>Conforming
			 amendments</header><text>Section 104(k) of the Comprehensive Environmental
			 Response, Compensation, and Liability Act of 1980 (42 U.S.C. 9604(k)) is
			 amended—</text>
				<paragraph id="H6709B250CA15450D968E5BA42F00779C"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (3)—</text>
					<subparagraph id="HDDA4D4D9B5894BC492093FE4E53641B9"><enum>(A)</enum><text>in subparagraph
			 (A)(ii)—</text>
						<clause id="H8F8CE44CD9C343E0B32E2C7C5C517FAD"><enum>(i)</enum><text>by
			 striking <quote>or nonprofit organizations</quote>; and</text>
						</clause><clause id="H4EFDF512D3874DD88202DACB55F84F4E"><enum>(ii)</enum><text>by
			 striking <quote>or organization</quote>; and</text>
						</clause></subparagraph><subparagraph id="H55892AB551B94627889241F10F289415"><enum>(B)</enum><text>in subparagraph
			 (B)(ii)—</text>
						<clause id="H970528870E24472F91D21A4F03C21A5B"><enum>(i)</enum><text>by
			 striking <quote>or other nonprofit organization</quote>; and</text>
						</clause><clause id="H40DD175D1B4849659A516F2073873792"><enum>(ii)</enum><text>by
			 striking <quote>or nonprofit organization</quote>; and</text>
						</clause></subparagraph></paragraph><paragraph id="H49BA376E160A4458AD69906D822EC27F"><enum>(2)</enum><text>in paragraph
			 (6)(A), by striking <quote>or nonprofit organizations</quote>.</text>
				</paragraph></subsection></section><section id="H99C48954D7994BC5B9EEB439A3D5E9CD" section-type="subsequent-section"><enum>4.</enum><header>Increased funding
			 limit for direct remediation</header><text display-inline="no-display-inline">Section 104(k)(3)(A) of the Comprehensive
			 Environmental Response, Compensation, and Liability Act of 1980 (42 U.S.C.
			 9604(k)(3)(A)), as amended in section 3(b), is further amended—</text>
			<paragraph id="HDBB2DB66D28746C59BE79DBC76BAD33A"><enum>(1)</enum><text>in clause
			 (ii)—</text>
				<subparagraph id="H4BB5F18CCD304E00B2D29CC8BBDE36D7"><enum>(A)</enum><text>by striking
			 <quote>$200,000</quote> and inserting <quote>$750,000</quote>; and</text>
				</subparagraph><subparagraph id="H8C1021EC6B8E417C80D5C0B9B6E8FB55"><enum>(B)</enum><text>by inserting
			 <quote>, except that during the period of fiscal years 2011 through 2016, the
			 President may, on not more than 2 occasions, waive such $750,000 limitation to
			 permit the entity to receive a grant in an amount not to exceed $1,500,000 for
			 a site to be remediated based on special circumstances, as determined by the
			 President.</quote> after <quote>site to be remediated</quote>; and</text>
				</subparagraph></paragraph><paragraph id="H1F245C36B4AA4B9E95D768B8724BD6DD"><enum>(2)</enum><text>by adding after
			 clause (ii) the following:</text>
				<quoted-block display-inline="no-display-inline" id="HB62FEEEE0F654DD490129E0AB76D9DF8" style="OLC">
					<quoted-block-continuation-text quoted-block-continuation-text-level="section">The
				President may transfer any duties under this subparagraph to the
				Administrator.</quoted-block-continuation-text><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section commented="no" id="HA927AABBC653405486C32BBADA34B6CF"><enum>5.</enum><header>Indirect
			 costs</header><text display-inline="no-display-inline">Subparagraph (B) of
			 section 104(k)(4) of the Comprehensive Environmental Response, Compensation,
			 and Liability Act of 1980 (42 U.S.C. 9604(k)(4)) is amended—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="HB611F51E0FFE4427B6C2F55042346543"><enum>(1)</enum><text>in clause (i), by
			 striking subclause (III) and redesignating subclauses (IV) and (V) as
			 subclauses (III) and (IV), respectively; and</text>
			</paragraph><paragraph commented="no" id="H15C8395947ED4A9A8CB6A70D030B3496"><enum>(2)</enum><text>by striking clause
			 (ii) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="HAB24496BE7DC4664994905545413F7EF" style="OLC">
					<clause commented="no" id="H34BC36596FF243E282AD6EDC3EE9EC2B"><enum>(ii)</enum><header>Acceptable use
				of funds</header>
						<subclause commented="no" id="HC0E6F2CF44DA4B39BFD52724A2785DDC"><enum>(I)</enum><header>In
				general</header><text>In addition to other acceptable purposes described in
				this subsection, a grant or loan under this subsection may be used for payment
				for the costs of—</text>
							<item commented="no" id="HBDE4242BB3F7476D8667EF900A15641E"><enum>(aa)</enum><text>investigation and
				identification of the extent of contamination;</text>
							</item><item commented="no" id="H42189C086D3D492C9EFBECAEA0457CC9"><enum>(bb)</enum><text>design and
				performance of a response action; and</text>
							</item><item commented="no" id="H0A7D47A1A614459AB55E4E753767ECD2"><enum>(cc)</enum><text>monitoring of a
				natural resource.</text>
							</item></subclause><subclause commented="no" id="H406DB47C95E24C719C2FCDC9A5D02AAD"><enum>(II)</enum><header>Indirect
				costs</header><text>Not more than 10 percent of a grant or loan under this
				subsection may be used for the payment of indirect
				costs.</text>
						</subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H2335E4360E154B79A9E0E95DD339E79B"><enum>6.</enum><header>Eligibility for
			 funding for brownfield sites acquired prior to January 11, 2002</header><text display-inline="no-display-inline">Subparagraph (B) of section 104(k)(4) of the
			 Comprehensive Environmental Response, Compensation, and Liability Act of 1980
			 (42 U.S.C. 9604(k)(4)), as amended in section 5 of this Act, is further amended
			 by striking clause (iii) and inserting the following:</text>
			<quoted-block display-inline="no-display-inline" id="H7F75FAA3190A45CD88A2587D97E7681C" style="OLC">
				<clause id="HF9FE198DA8824980AB6504754E984C2D"><enum>(iii)</enum><header>Exceptions</header><text display-inline="yes-display-inline">Notwithstanding clause (i)(III), the
				Administrator may use funds made available to carry out this subsection for one
				or more of the following:</text>
					<subclause id="H8CE7297C0C404B669D68954958F1599E"><enum>(I)</enum><text>To make a grant
				under paragraph (2) to an eligible entity that acquired a brownfield site to be
				covered by the grant on or before January 11, 2002.</text>
					</subclause><subclause id="HE22DE0290ED5450CBC038A49E294822C"><enum>(II)</enum><text display-inline="yes-display-inline">To make a grant under paragraph (3) to an
				eligible entity if such eligible entity, except as otherwise provided in this
				subclause, satisfies all of the elements set forth in section 101(40) to
				qualify as a bona fide prospective purchaser, except that the date of
				acquisition of the brownfield site was on or before January 11, 2002. The
				Administrator may make exceptions with regard to compliance with the elements
				set forth in section 101(40) based on mitigating circumstances, including any
				of the following:</text>
						<item id="H3F9D5E577FB9427E815B1DD88A39CA5E"><enum>(aa)</enum><text>The
				brownfield site was acquired prior to May 31, 1997, and compliance with all
				appropriate inquiry (as required under section 101(40)(B)) cannot be fairly
				determined.</text>
						</item><item id="H444A83C95BC747C9BA126BA58DA9DCB5"><enum>(bb)</enum><text>A
				current site assessment of the brownfield site has found no evidence that the
				eligible entity caused, exacerbated, or failed to exercise appropriate care (as
				required under section 101(40)(D)) with respect to contamination found at the
				site.</text>
						</item><item id="H918799DDE67A49ABB0C4624BA7B60881"><enum>(cc)</enum><text display-inline="yes-display-inline">The eligible entity held a public hearing
				with respect to the grant application and no substantive testimony was offered
				that indicates that the eligible entity caused, exacerbated, or failed to
				exercise appropriate care (as required under section 101(40)(D)) with respect
				to contamination found at the site.</text>
						</item><item id="HD44F45DF602040BEBAF2BB6F50A2EB3F"><enum>(dd)</enum><text>There are other
				circumstances that make compliance with the elements set forth in section
				101(40) impractical and not in the public interest.</text>
						</item></subclause><subclause id="H96FCA9250618437DA8DF3B4D134BC8CA"><enum>(III)</enum><text>To make a grant
				or loan under this subsection to an eligible entity if such entity—</text>
						<item id="H061DC38143954E54B6A3F37A478AE2A9"><enum>(aa)</enum><text>acquired
				ownership of the brownfield site at least 30 years prior to the date of the
				grant or loan, but not later than May 31, 1997;</text>
						</item><item id="HF2242E715B034BAEA1EAD9FEDD8A9579"><enum>(bb)</enum><text>did
				not cause or contribute to the contamination on the brownfield site; and</text>
						</item><item id="H0219D0B71B11483ABAC4C4E64CC9DEAF"><enum>(cc)</enum><text display-inline="yes-display-inline">can reasonably indicate why such entity
				cannot comply with the elements set forth in section 101(40) to qualify as a
				bona fide prospective
				purchaser.</text>
						</item></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H87A52C02D8C34976A9F0EA9D4A4189FE"><enum>7.</enum><header>Multi-purpose
			 brownfield grants</header>
			<subsection id="H35F30F33DD9B468D9A86255B5D71C954"><enum>(a)</enum><header>Multi-Purpose
			 grant program</header><text display-inline="yes-display-inline">Section 104(k)
			 of the Comprehensive Environmental Response, Compensation, and Liability Act of
			 1980 (42 U.S.C. 9604(k)), is amended—</text>
				<paragraph id="H76C963DE424B422AB469F3C75D5B8874"><enum>(1)</enum><text>by redesignating
			 paragraph (12) as paragraph (15);</text>
				</paragraph><paragraph id="HFDF8D5BD31684D7EAA9B53B343165C85"><enum>(2)</enum><text>by redesignating
			 paragraphs (4) through (11), as amended, as paragraphs (5) through (12),
			 respectively; and</text>
				</paragraph><paragraph id="H1F93388DCE39401FA5547759E1D5AF45"><enum>(3)</enum><text>by adding after
			 paragraph (3) the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="H5A9E9EFA670343F585B1E486F48FC2FB" style="OLC">
						<paragraph id="HE4DA1B7D24BC405281CF07A7A4B2B177"><enum>(4)</enum><header>Multi-purpose
				brownfield grants</header>
							<subparagraph id="H6169ED19FFF7419C87C6B83A715882F9"><enum>(A)</enum><header>Establishment of
				program</header><text>Subject to paragraphs (5) and (6), the Administrator
				shall establish a program to provide multi-purpose grants to eligible entities,
				where warranted, as determined by the Administrator based on considerations
				under paragraph (3)(C), to be used to inventory, characterize, assess, conduct
				planning related to, or remediate (or any combination thereof), one or more
				brownfield sites in an area, in amounts not to exceed $1,500,000 per
				grant.</text>
							</subparagraph><subparagraph id="HA4C9E86A074A497B8681C3224FD18096"><enum>(B)</enum><header>Additional
				considerations</header><text>In addition to the considerations under paragraph
				(3)(C), in determining whether a multi-purpose grant is warranted under the
				program under subparagraph (A), the Administrator shall consider the extent to
				which the eligible entity demonstrates—</text>
								<clause id="HA5BBA2DF421140BA867D06E42B8DFA26"><enum>(i)</enum><text>an
				overall plan for revitalization of brownfield sites in the area in which the
				multi-purpose grant will be used;</text>
								</clause><clause id="H466605E53BE94111973883CA68A4FB2D"><enum>(ii)</enum><text>the capacity to
				conduct the range of eligible activities that will be funded by the
				multi-purpose grant; and</text>
								</clause><clause id="HE67EB933DB2D4A7EB491B1119A97696A"><enum>(iii)</enum><text>that a
				multi-purpose grant is appropriate for meeting the needs of the area in which
				the grant will be used.</text>
								</clause></subparagraph><subparagraph commented="no" id="H09B5B3158A7C42EF901DD65F3B914D4E"><enum>(C)</enum><header>Grant
				funds</header><text>Grants provided under the program established under
				subparagraph (A) shall be expended not later than 3 years after the award of
				grant funding to the eligible entity, unless the Administrator determines that
				an extension of not more than 2 years is justified.</text>
							</subparagraph><subparagraph id="H90B9A9CD03E3472DB9D4EFC4EAD744B3"><enum>(D)</enum><header>Ownership</header><text>A
				recipient of a grant under this paragraph may not use amounts from such grant
				on remediation of a brownfield site until such recipient owns such site.</text>
							</subparagraph><subparagraph id="H8FFE700E8AC84A42AA8A1BB589D8B044"><enum>(E)</enum><header>Existing
				authority</header><text>Nothing in this paragraph shall limit any other
				authority of the President or the Administrator under this
				subsection.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H078F2F58F07D4F85BFCB236F4BBDB172"><enum>(b)</enum><header>Conforming
			 amendments</header>
				<paragraph id="H856C1F7E4458411C8FA6A62C8121B859"><enum>(1)</enum><text>Section
			 104(k)(3)(A) of the Comprehensive Environmental Response, Compensation, and
			 Liability Act of 1980 (42 U.S.C. 9604(k)(3)(A)), as amended, is further amended
			 by striking <quote>Subject to paragraphs (4) and (5)</quote> and inserting
			 <quote>Subject to paragraphs (5) and (6)</quote>.</text>
				</paragraph><paragraph id="HD7BA5C9F17754FD2B3588D13FE800100"><enum>(2)</enum><text display-inline="yes-display-inline">Section 104(k)(3)(C) of the Comprehensive
			 Environmental Response, Compensation, and Liability Act of 1980 (42 U.S.C.
			 9604(k)(3)(C)) is amended by inserting <quote>or paragraph (4)</quote> after
			 <quote>under subparagraph (A)(ii) or (B)(ii)</quote>.</text>
				</paragraph></subsection></section><section id="H37A0C347521A43919FDE48437CF477D0"><enum>8.</enum><header>Program for
			 sustainable reuse and alternative energy on brownfield sites</header><text display-inline="no-display-inline">Section 104(k) of the Comprehensive
			 Environmental Response, Compensation, and Liability Act of 1980 (42 U.S.C.
			 9604(k)) is amended by adding after paragraph (12), as redesignated by section
			 7(a)(2) of this Act, the following new paragraph:</text>
			<quoted-block display-inline="no-display-inline" id="H3E37E2352CC1400D9CB2FC91DA3B803B" style="OLC">
				<paragraph id="H32BE734F0D954A5AB06ECB0BF5ECDB59"><enum>(13)</enum><header>Program for
				sustainable reuse and alternative energy on brownfield sites</header>
					<subparagraph id="H5FE06DE70841490085078821404D256F"><enum>(A)</enum><header>Establishment
				and use of funds</header><text display-inline="yes-display-inline">The
				Administrator shall establish a program to make grants, on a competitive basis,
				to eligible entities to be used at one or more brownfield sites for projects
				that reduce environmental impact, increase community livability, and encourage
				sustainability, including—</text>
						<clause id="H78DC08D15ACB4739AD23112759E1BC79"><enum>(i)</enum><text>sustainable reuse
				planning and site analysis, including—</text>
							<subclause id="H13F1E2FBB65344FE8326E84CAEB2F951"><enum>(I)</enum><text>site
				characterization and assessment;</text>
							</subclause><subclause id="H84B6BCEFA6F648F387CF7C62AC7C0395"><enum>(II)</enum><text>area and corridor
				sustainability plans; and</text>
							</subclause><subclause id="HE006FB87CC9941328F47904E88823B6A"><enum>(III)</enum><text>engineering or
				feasibility analysis of environmentally beneficial site improvements;</text>
							</subclause></clause><clause id="H00C580A5672748CE9FE5234DB8994ED1"><enum>(ii)</enum><text>remediation;</text>
						</clause><clause id="H8D66D4DC88DF439F8B8CED71948B89E1"><enum>(iii)</enum><text>ecosystem
				restoration; and</text>
						</clause><clause id="H879482A26C8C4C0A94B8899F1868BAD9"><enum>(iv)</enum><text>habitat
				restoration.</text>
						</clause></subparagraph><subparagraph id="H870D510CD20E4606875078181340633B"><enum>(B)</enum><header>Project
				selection</header><text display-inline="yes-display-inline">In addition to the
				criteria under paragraph (6), in selecting grant recipients under this
				paragraph, the Administrator shall take into consideration the extent to which
				a grant will facilitate future use of a brownfield site in an environmentally
				beneficial and sustainable manner, including the potential for renewable energy
				production and green infrastructure, including greenways and hike-bike trails,
				green buildings, and mixed use and transit-oriented development in smart growth
				locations.</text>
					</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H7D4EB0C1EE544658BB564B86B5243F02"><enum>9.</enum><header>Staff for small,
			 disadvantaged, or rural communities</header><text display-inline="no-display-inline">Section 104(k) of the Comprehensive
			 Environmental Response, Compensation, and Liability Act of 1980 (42 U.S.C.
			 9604(k)) is amended by adding after paragraph (13) (as added by section 8 of
			 this Act) the following:</text>
			<quoted-block display-inline="no-display-inline" id="HCE966FBF4A704BB788047E28FB7EFA3E" style="OLC">
				<paragraph id="H389709C06EA04B43AB53FB8260C587B9"><enum>(14)</enum><header>Staff for
				small, disadvantaged, or rural communities</header><text display-inline="yes-display-inline">The Administrator, upon approval of an
				application made by an eligible entity serving a community that has a small
				population, is disadvantaged, or is in a rural location, and in accordance with
				the applicable provisions of subchapter VI of chapter 33 of title 5, United
				States Code, may assign employees of the Environmental Protection Agency to
				such eligible entity to build local capacity for the remediation and
				revitalization of brownfield sites located in such communities. The
				Administrator shall determine, consistent with existing law and regulation in
				effect as of the date of enactment of this paragraph, what qualifies as a
				community that has a small population, is disadvantaged, or is in a rural
				location for purposes of this paragraph, provided that such definitions include
				rural municipalities, municipalities with populations of up to 20,000, and
				municipalities in which the median household income is at or less than
				<fraction>2/3</fraction> of the State
				average.</text>
				</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H6EFB57C667A9443491308ED95F40472D" section-type="subsequent-section"><enum>10.</enum><header>Authorization of
			 appropriations</header>
			<subsection id="HAE9ACDA7FEEE40FD94A49F6C70A349A4"><enum>(a)</enum><header>Authorization of
			 appropriations</header><text display-inline="yes-display-inline">Subparagraph
			 (A) of paragraph (15) (as redesignated by section 7(a)(1) of this Act) of
			 section 104(k) of the Comprehensive Environmental Response, Compensation, and
			 Liability Act of 1980 (42 U.S.C. 9604(k)) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="HC5BCB124DA5945FDAB4B01727F65ECCB" style="OLC">
					<subparagraph id="HB9709046A8654792AA2FFC8486738A31"><enum>(A)</enum><header>Authorization of
				appropriations</header><text display-inline="yes-display-inline">There are
				authorized to be appropriated to carry out this subsection—</text>
						<clause id="HA76E021862E64AFCA533A8545109C5DA"><enum>(i)</enum><text>$350,000,000 for
				fiscal year 2011;</text>
						</clause><clause id="HB78657E3C6514D2CB9691D7FCD91C13E"><enum>(ii)</enum><text>$400,000,000 for
				fiscal year 2012;</text>
						</clause><clause id="H7D69345C937B42CA8630087DBCA46266"><enum>(iii)</enum><text>$450,000,000 for
				fiscal year 2013;</text>
						</clause><clause id="H537FED95E99143C199FB336C58E4830E"><enum>(iv)</enum><text>$500,000,000 for
				fiscal year 2014;</text>
						</clause><clause id="HCEF7FF7637E7457BAFC198C46A632CC9"><enum>(v)</enum><text>$550,000,000 for
				fiscal year 2015; and</text>
						</clause><clause id="H026D245FEBA245B18849BC9F28D8B515"><enum>(vi)</enum><text>$600,000,000 for
				fiscal year
				2016.</text>
						</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H9C1F48C1A9694C80BA053327EBB943A5"><enum>(b)</enum><header>Petroleum set
			 aside</header><text display-inline="yes-display-inline">Paragraph (15) of
			 section 104(k) of the Comprehensive Environmental Response, Compensation, and
			 Liability Act of 1980 (42 U.S.C. 9604(k)), as redesignated by section 7(a)(1)
			 of this Act and as amended by subsection (a) of this section, is further
			 amended, in subparagraph (B), by inserting <quote>at least</quote> before
			 <quote>25 percent</quote>.</text>
			</subsection><subsection id="H19D0C05AA62246698C4734D4F28D18D5"><enum>(c)</enum><header>Set aside for
			 sustainable reuse</header><text display-inline="yes-display-inline">Paragraph
			 (15) of section 104(k) of the Comprehensive Environmental Response,
			 Compensation, and Liability Act of 1980 (42 U.S.C. 9604(k)), as redesignated by
			 section 7(a)(1) of this Act and as amended by subsections (a) and (b) of this
			 section, is further amended by adding after subparagraph (B) the following new
			 subparagraph:</text>
				<quoted-block display-inline="no-display-inline" id="H597DE40AC65D4D1290B536A42DEECE9B" style="OLC">
					<subparagraph id="HD8E6B0B53EEF42F9A5C97207BDDD4545"><enum>(C)</enum><header>Set aside for
				program for sustainable reuse and alternative energy on brownfield
				sites</header><text display-inline="yes-display-inline">Of amounts made
				available each fiscal year pursuant to subparagraph (A), at least 7.5 percent
				of such amounts shall be used to carry out the program under paragraph (13).</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="HA59847D9ED8D40FC8FC8A4F5A68B67D6"><enum>11.</enum><header>State response
			 programs</header><text display-inline="no-display-inline">Section 128(a)(3) of
			 the Comprehensive Environmental Response, Compensation, and Liability Act of
			 1980 (42 U.S.C. 9628(a)(3)) is amended to read as follows:</text>
			<quoted-block display-inline="no-display-inline" id="H64A79C8F9FF640E18B1F3E3780B6D555" style="OLC">
				<paragraph id="HB77FF8FE923E4DDBA0B892310A3C899C"><enum>(3)</enum><header>Funding</header><text display-inline="yes-display-inline">There are authorized to be appropriated to
				carry out this subsection $70,000,000 for fiscal year 2011, $80,000,000 for
				fiscal year 2012, $90,000,000 for fiscal year 2013, $100,000,000 for fiscal
				year 2014, $110,000,000 for fiscal year 2015, and $120,000,000 for fiscal year
				2016 and each fiscal year
				thereafter.</text>
