		<official-title>To permit physicians and suppliers a new election to
		  become Medicare participating physicians and suppliers if Medicare physician
		  fee schedule rates are extended.</official-title>

		<section id="HCCF7D223C0704D25823BCB965027BE39" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>More Doctors, More Choices Act of
			 2010</short-title></quote>.</text>
		</section><section id="H8614DD6E0A2940ABAB2316704F91E53C"><enum>2.</enum><header>Additional
			 election opportunity for physicians and suppliers to become Medicare
			 participating physicians and suppliers if Medicare physician fee schedule rates
			 are extended</header>
			<subsection id="HE455CE0D4DE5433FBAE3FDD66B5BE16B"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Notwithstanding any
			 other provision of law, if a Medicare SGR extension law is enacted during the
			 111th Congress, the Secretary of Health and Human Services shall permit a
			 physician or supplier who furnishes (or may furnish) services for which payment
			 is made under the Medicare physician fee schedule (or would be so made but for
			 a contract under section 1802(b) of the Social Security Act) and is not a
			 Medicare participating physician or supplier to elect to become such a Medicare
			 participating physician or supplier.</text>
			</subsection><subsection id="H75560CECC3EB497DA21EFF75FDCCDD2F"><enum>(b)</enum><header>Election
			 process</header><text display-inline="yes-display-inline">The election under
			 subsection (a)—</text>
				<paragraph id="H7843965DCC61456DB017FC87E0E24266"><enum>(1)</enum><text>shall occur during
			 a period specified by the Secretary of not less than 30 days beginning not
			 later than 30 days after the date of the enactment of the Medicare SGR
			 extension law;</text>
				</paragraph><paragraph id="HC1621E244B7E424CA4D54887029E70CE"><enum>(2)</enum><text>shall be made
			 through a process that is consistent with the existing open enrollment process
			 under which physicians and suppliers otherwise make a participation election;
			 and</text>
				</paragraph><paragraph id="H587E7D7310844A04871014B94A3452F8"><enum>(3)</enum><text>shall become
			 effective for items and services furnished on or after the date that is 15 days
			 after the last date of the election period under paragraph (1).</text>
				</paragraph></subsection><subsection id="H507B21870B3441E6B2CAEBD245ADAE7D"><enum>(c)</enum><header>Treatment of
			 private contracts</header><text>In the case of a physician or practitioner who
			 has entered into a contract under section 1802(b) of the Social Security Act
			 (42 U.S.C. 1395a(b)) that is in effect as of the date of the enactment of the
			 Medicare SGR extension law (or this Act, if later) and who makes an election to
			 be a Medicare participating physician or supplier under this section during the
			 election period under subsection (b)(1)—</text>
				<paragraph id="HEA4C8DE7E9D44DB19E5FF57BFBB1920B"><enum>(1)</enum><text>such election
			 shall not apply to the contract until the date of the contract would otherwise
			 terminate without regard to this subsection, unless the medicare beneficiary
			 involved terminates the contract through timely notice to the physician or
			 practitioner; and</text>
				</paragraph><paragraph id="H2A28A829F0C7466CB2A1C35E2D408045"><enum>(2)</enum><text>notwithstanding
			 such section 1802(b), the 2-year limitation imposed under the affidavit
			 described in paragraph (3)(B)(i) of such section shall not apply to services
			 furnished as a participating physician or supplier pursuant to such
			 election.</text>
				</paragraph></subsection><subsection id="H6D677B2368C94F8FA88DEBF00D6D69F4"><enum>(d)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text>
				<paragraph id="H29F9E4E5F5234267A0E34C0757743A48"><enum>(1)</enum><header>Medicare
			 participating physician or supplier</header><text display-inline="yes-display-inline">The term <term>Medicare participating
			 physician or supplier</term> has the meaning given the term participating
			 physician or supplier in section 1842(h)(1) of the Social Security Act (42
			 U.S.C. 1395u(h)(1)).</text>
				</paragraph><paragraph id="HEF08D9E22F4C47DCB3EC5DBABBDD496B"><enum>(2)</enum><header>Medicare
			 physician fee schedule</header><text>The term <term>Medicare physician fee
			 schedule</term> means the payment schedule under section 1848 of the Social
			 Security Act (42 U.S.C. 1395w–4).</text>
				</paragraph><paragraph id="H9C5C345748364A6EA163C93AC3205459"><enum>(3)</enum><header>Medicare SGR
			 extension law</header><text>The term <term>Medicare SGR extension law</term>
			 means a law that extends or revises for at least 1 year the amount of the
			 conversion factor under section 1848(d) of the Social Security Act (42 U.S.C.
			 1395w–4(d)) so that it is not lower than the conversion factor for May
			 2010.</text>
				</paragraph><paragraph id="H939FB7E63260486191B4D164FDC3902B"><enum>(4)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of Health and Human Services.</text>
