		<section id="HE2068C7029734D46916591D89D3849E0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Dairy Price Stabilization Program Act
			 of 2010</short-title></quote>.</text>
		</section><section id="H6EF2EF5C417B4FF79E45EA96AF1CBAE8"><enum>2.</enum><header>Dairy Price
			 Stabilization Program</header><text display-inline="no-display-inline">The
			 Dairy Production Stabilization Act of 1983 (7 U.S.C. 1421 note; title I of
			 Public Law 98–189) is amended by adding at the end the following new
			 subtitle:</text>

				<subtitle id="H1DE05587DB8F45BEA548A15C913D0F37"><enum>D</enum><header>Dairy Price
				Stabilization Program</header>
					<section id="HB676076DA996490AB522346DFC4712C5"><enum>141.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subtitle:</text>
						<paragraph id="H67402CA701D9470AA25E93955F3CFAC5"><enum>(1)</enum><header>Allowable milk
				marketing</header><text>The term <term>allowable milk marketing</term> means
				the quantity of milk production that a dairy facility may produce during a
				quarter without incurring a market access fee, as determined under section
				143(b)(1).</text>
						</paragraph><paragraph id="H2CA6AA91374A4773B6D2A9C9E72E91D8"><enum>(2)</enum><header>Allowable milk
				marketing growth rate</header><text>The term <term>allowable milk marketing
				growth rate</term> means the allowable milk marketing growth rate established
				by the Secretary for the applicable quarter under section 143(b)(1).</text>
						</paragraph><paragraph id="HECBE71730E274DC5B28F3F86B7948EDB"><enum>(3)</enum><header>Alternative
				market access fee</header><text>The term <term>alternative market access
				fee</term> means a fee described in section 143(b)(2) that is assessed on all
				milk produced in excess of the allowable milk marketings of a dairy
				facility.</text>
						</paragraph><paragraph id="H90B843063EFA477BB016461776DE16B0"><enum>(4)</enum><header>Appeals
				Committee</header><text>The term <term>Appeals Committee</term> means the
				producer appeals committee established under section 142(c).</text>
						</paragraph><paragraph id="H1246ABA367B742659060880E41C6ACB4"><enum>(5)</enum><header>Dairy
				facility</header><text>The term <term>dairy facility</term> means an operation
				on a property, or set of properties that are contiguous or separated only by a
				public right-of-way, that is directly related to raising cows or producing milk
				from cows for the purpose of making a profit or for a livelihood.</text>
						</paragraph><paragraph id="HA3397E4FA5234F58A7D332B79C49B99C"><enum>(6)</enum><header>Market access
				fee dividend</header><text>The term <term>market access fee dividend</term>
				means the market access fees collected during an applicable quarter that are
				redistributed to dairy facilities with allowable milk marketings under section
				143(e).</text>
						</paragraph><paragraph id="H937111DBF5204AA9B51A62C5A18E5185"><enum>(7)</enum><header>Milk
				handler</header><text>The term <term>milk handler</term> means a person that
				makes payments to a dairy facility for milk produced in the United States and
				purchased from the dairy facility for commercial use.</text>
						</paragraph><paragraph id="HFFD5D73D082C44E4836B75189276B639"><enum>(8)</enum><header>Order</header><text>The
				term <term>order</term> means an order issued by the Secretary under section
				142(a).</text>
						</paragraph><paragraph id="H7E374E48E6A145E4A4522DE69CB6B9E6"><enum>(9)</enum><header>Producer</header><text display-inline="yes-display-inline">The term <term>producer</term> means all
				persons engaged in the production of bovine milk for commercial use. All
				producers holding a milk license shall be included.</text>
						</paragraph><paragraph id="H7D19B986189949CC9640F0CAC8B44F00"><enum>(10)</enum><header>Producer
				Board</header><text>The term <term>Producer Board</term> means the Producer
				Board established under section 142(b).</text>
						</paragraph><paragraph id="H50D0FF353A824AC08F4FA731FB6295FA"><enum>(11)</enum><header>Program</header><text>The
				term <term>Program</term> means the Dairy Price Stabilization Program
				established under section 142(a).</text>
						</paragraph><paragraph id="HC19243C2D25843BEB5D2C3428F38D2D5"><enum>(12)</enum><header>Quarter</header><text>The
				term <quote>quarter</quote> means each of the following 4 quarters of a
				calendar year:</text>
							<subparagraph id="HA2051DBE845C4E95865AC86D244ABCE7"><enum>(A)</enum><text>January 1 through
				March 31.</text>
							</subparagraph><subparagraph id="H2091426309FE47F395E40CA0A7227693"><enum>(B)</enum><text>April 1 through
				June 30.</text>
							</subparagraph><subparagraph id="H86C6665BEA2A4744B4EF1A9428B85505"><enum>(C)</enum><text>July 1 through
				September 30.</text>
							</subparagraph><subparagraph id="HA321347CD5D347F3ABFDB7925060542C"><enum>(D)</enum><text>October 1 through
				December 31.</text>
							</subparagraph></paragraph><paragraph id="H3C6852F1B57344698704A18F53EC10D4"><enum>(13)</enum><header>Region</header><text>The
				term <term>region</term> means each of the following</text>
							<subparagraph id="H08FFA6CF9C3C4C19983311BD0226CDEC"><enum>(A)</enum><text display-inline="yes-display-inline">Region 1, Northeast, consisting of the
				States of Connecticut, Delaware, Maine, Maryland, Massachusetts, New Hampshire,
				New Jersey, New York, Pennsylvania, Rhode Island, Vermont, and West
				Virginia.</text>
							</subparagraph><subparagraph id="HBD74867364444BF084B1D72E99560AA3"><enum>(B)</enum><text display-inline="yes-display-inline">Region 2, Southeast, consisting of the
				States of Alabama, Arkansas, Florida, Georgia, Kentucky, Louisiana,
				Mississippi, Missouri, North Carolina, South Carolina, Tennessee, and
				Virginia.</text>
							</subparagraph><subparagraph id="H772406BCE3084935A1F480642C475E7E"><enum>(C)</enum><text display-inline="yes-display-inline">Region 3, Midwest, consisting of the States
				of Illinois, Indiana, Iowa, Michigan, Minnesota, Nebraska, North Dakota, Ohio,
				South Dakota, and Wisconsin.</text>
							</subparagraph><subparagraph id="H66D4C4690C2048BE860C3F1B7A4F1144"><enum>(D)</enum><text display-inline="yes-display-inline">Region 4, South, consisting of the States
				of Kansas, New Mexico, Oklahoma, and Texas.</text>
							</subparagraph><subparagraph id="H3734634E0D7846928A582BA2FA8264E7"><enum>(E)</enum><text>Region 5,
				Northwest, consisting of the States of Colorado, Idaho, Montana, Oregon, Utah,
				Washington, and Wyoming.</text>
							</subparagraph><subparagraph id="H47412A9A616C4FB68172521A31F0E59E"><enum>(F)</enum><text display-inline="yes-display-inline">Region 6, West, consisting of the States of
				Arizona, California, and Nevada.</text>
							</subparagraph></paragraph><paragraph id="H4B5A731420A94A96816001E5D6B02955"><enum>(14)</enum><header>Secretary</header><text>The
				term <term>Secretary</term> means the Secretary of Agriculture, acting in
				consultation with the Appeals Committee or Producer Board (as
				appropriate).</text>
						</paragraph><paragraph id="H722B2F4C99BA47299471C0A6B6698C76"><enum>(15)</enum><header>Standard market
				access fee</header><text>The term <term>standard market access fee</term> means
				a fee assessed under section 143(d) on all milk produced by a dairy
				facility.</text>
						</paragraph></section><section id="HF276F8637B3F435B832ECE0CD908180C"><enum>142.</enum><header>Establishment</header>
						<subsection id="HB6C8BA12B4284A95A6FB528FFF65B0D3"><enum>(a)</enum><header>Issuance of
				orders</header>
							<paragraph id="H99FD0BF7C60E4FAC9EEAB99EBFC5B494"><enum>(1)</enum><header>Proposed
				order</header><text display-inline="yes-display-inline">Not later than 60 days
				after the date of the enactment of this subtitle, the Secretary shall publish
				in the Federal Register a proposed order to establish a program to be known as
				the <quote>Dairy Price Stabilization Program</quote> that shall apply to all
				dairy facilities within the contiguous United States that produce milk for sale
				commercially.</text>
							</paragraph><paragraph id="H7B295B0EE24C49BD9E5EFBC11DC7793B"><enum>(2)</enum><header>Referendum on
				proposed order</header><text display-inline="yes-display-inline">Not later than
				90 days after the date of the enactment of this subtitle, the Secretary shall
				conduct a referendum among producers who, during a representative period (as
				determined by the Secretary), have been engaged in the production of milk for
				commercial use for the purpose of ascertaining whether the proposed order shall
				take effect. The Program shall be implemented only if the Secretary determines
				that it has been approved by not less than a majority of the eligible producers
				voting in the referendum. If implementation of the Program is not approved by a
				majority of the eligible producers voting in the referendum, the Secretary may
				not issue a final order to establish the Program. To determine the approval or
				disapproval of producers, the Secretary shall consider the approval or
				disapproval by any cooperative association of producers, engaged in a bona fide
				manner in marketing milk or the products thereof, as the approval or
				disapproval of the producers who are members of or under contract with such
				cooperative association of producers. If a cooperative association of producers
				elects to vote on behalf of its members, such cooperative association shall
				provide each producer, on whose behalf the cooperative association is
				expressing approval or disapproval, a description of the question presented in
				the referendum together with a statement of the manner in which the cooperative
				association intends to cast its vote on behalf of the membership. Such
				information shall inform the producer of procedures to follow to cast an
				individual ballot should the producer so choose within the period of time
				established by the Secretary for casting ballots. Such notification shall be
				made at least 30 days before the referendum and shall include an official
				ballot. The ballots shall be tabulated by the Secretary and the vote of the
				cooperative association shall be adjusted to reflect the individual
				votes.</text>
							</paragraph><paragraph id="HF0EFF5F5272D413F986B90AE4F536685"><enum>(3)</enum><header>Final
				order</header><text display-inline="yes-display-inline">If the Secretary
				determines that the proposed order has been approved by not less than a
				majority of the eligible producers voting in the referendum required by
				paragraph (2), the Secretary shall issue, not later than 30 days after such
				determination, a final order to establish the Program.</text>
							</paragraph><paragraph id="H2879934BC29544C6AC8FAE237C401DA2"><enum>(4)</enum><header>Referendum on
				continuation of Program</header><text>Not later than 3 years after the date of
				the enactment of this subtitle, the Secretary shall conduct a referendum among
				producers who, during a representative period (as determined by the Secretary),
				have been engaged in the production of milk for commercial use, for the purpose
				of ascertaining whether the Program then in effect shall be continued. The
				program shall be continued only if the Secretary determines that it has been
				approved by not less than a majority of the eligible producers voting in the
				referendum. If continuation of the Program is not approved by a majority of the
				eligible producers voting in the referendum, the Secretary shall terminate
				collection of fees under the Program within six months after the Secretary
				determines that such action is favored by a majority of the eligible producers
				voting in the referendum and shall terminate the program in an orderly manner
				as soon as practicable after such determination.</text>
							</paragraph></subsection><subsection id="HD18C0F374DEB4746A8F6595D54EFA8F7"><enum>(b)</enum><header>Producer
				Board</header>
							<paragraph id="H5582FA21755842A4870510139BF53B67"><enum>(1)</enum><header>In
				general</header><text>The order shall provide for the establishment of a board
				of directors to be known as the <quote>Producer Board</quote> to advise the
				Secretary on administration of the Program.</text>
							</paragraph><paragraph id="H41B84AB8EF814814B52FCCA865474804"><enum>(2)</enum><header>Composition</header><text>The
				Producer Board shall be composed of 30 members, of whom—</text>
								<subparagraph id="H5100F493DDB849949F414410AADA3F0A"><enum>(A)</enum><text>24 shall be
				producers, of whom—</text>
									<clause id="H3093F0E2927F456B921647A6D67C30C4"><enum>(i)</enum><text display-inline="yes-display-inline">12 producers shall be appointed based upon
				region, with 2 members from each of the 6 dairy producing regions in the United
				States; and</text>
									</clause><clause id="H8C23210BF09D47978C542BEB79D4083E"><enum>(ii)</enum><text display-inline="yes-display-inline">12 producers shall be appointed based upon
				the geographical distribution of milk production volume throughout the United
				States;</text>
									</clause></subparagraph><subparagraph id="H695B7E8028B94C35862BEF3F975753C1"><enum>(B)</enum><text>2 shall represent
				dairy consumers;</text>
								</subparagraph><subparagraph id="H096679A001DB434D8CF87BE284B7839D"><enum>(C)</enum><text>2 shall represent
				fluid milk bottlers; and</text>
								</subparagraph><subparagraph id="H6497F06749E94173A4D533D42DBE7F6A"><enum>(D)</enum><text>2 shall represent
				dairy product processors.</text>
								</subparagraph></paragraph><paragraph id="HC56F874EA9824FB299D1F3ACCD58CD9D"><enum>(3)</enum><header>Appointment</header><text>The
				Secretary shall appoint the members of the Producer Board after considering any
				nominations submitted by interested parties.</text>
							</paragraph><paragraph id="H003992A3AFA94AB5A41FE6B8B71255EA"><enum>(4)</enum><header>Advisor</header>
								<subparagraph id="H8C45EA4E31094C879345C9AE9AB50FAA"><enum>(A)</enum><header>In
				general</header><text>The Secretary shall appoint a dairy economist to advise
				the Producer Board.</text>
								</subparagraph><subparagraph id="H67F00E178F404DD08662F2DFD8E409BF"><enum>(B)</enum><header>Nonvoting
				member</header><text>The individual appointed under subparagraph (A) shall be a
				nonvoting member of the Producer Board.</text>
								</subparagraph></paragraph></subsection><subsection id="HC07E52431C1B41FE832CCFE5C548D878"><enum>(c)</enum><header>Producer Appeals
				Committee</header><text>The order shall require the Producer Board to establish
				a committee to be known as the <quote>Producer Appeals Committee</quote> to
				advise the Secretary on appeals of decisions made during the first year of
				operation of the Program.</text>
						</subsection></section><section id="HFFC536014D7F4DBBABFE2E91BB850867"><enum>143.</enum><header>Operation of
				the Program</header>
						<subsection id="HD7DBD85D85BE4CC6A919128EA740FBEF"><enum>(a)</enum><header>Establishment of
				rates, fees, dividends, and initial allowable milk marketings</header>
							<paragraph id="H0A83759B505D4E2C981D129728DA8B09"><enum>(1)</enum><header>In
				general</header><text>The order shall provide for the establishment of rates
				and fees and the payment of dividends in accordance with this section.</text>
							</paragraph><paragraph id="H79592F93F5354FBAAFE233F8356D2D6C"><enum>(2)</enum><header>Initial
				establishment of allowable milk marketings</header><text>The initial
				establishment of allowable milk marketings for a dairy facility under this
				subtitle shall based on the highest of the annual milk marketings of the dairy
				facility from the calendar year ending—</text>
								<subparagraph id="H03FE216877C74B0DA5B2AEDF4A196FBA"><enum>(A)</enum><text>December 31,
				2007;</text>
								</subparagraph><subparagraph id="H8288593E89314092960A1FC785BFE430"><enum>(B)</enum><text>December 31, 2008;
				or</text>
								</subparagraph><subparagraph id="H964152AC789840F2B7D9953B858AF7FD"><enum>(C)</enum><text>December 31,
				2009.</text>
								</subparagraph></paragraph></subsection><subsection id="H0E3058B4D885473AB45760289D9713BE"><enum>(b)</enum><header>Establishment of
				rates and fees</header>
							<paragraph id="H3CFA78773BC3451D85471BFAD73A4B04"><enum>(1)</enum><header>Allowable milk
				marketing growth rate</header>
								<subparagraph id="H77BD2C91B05E491F95582C7BB802AC07"><enum>(A)</enum><header>Calculation of
				allowable milk marketing</header><text display-inline="yes-display-inline">The
				allowable milk marketings of a dairy facility for a quarter shall be equal to
				the quantity of milk commercially produced by the dairy facility during the
				corresponding quarter during the previous calendar year, as adjusted to reflect
				the allowable milk marketing growth rate for the quarter.</text>
								</subparagraph><subparagraph id="HB5D825EE635E4FE68A2CFA459A279805"><enum>(B)</enum><header>Calculation of
				allowable milk marketing growth rate</header><text display-inline="yes-display-inline">At least 30 days before the first day of
				each quarter, the Secretary, after considering any recommendations made by the
				Producer Board, shall establish the allowable milk marketing growth rate for
				the upcoming quarter based on the following table:</text>

								</subparagraph><subparagraph id="HFB8BD88578FE43D3AE836165B3DCD8F0"><enum>(C)</enum><header>Milk feed
				ration</header><text display-inline="yes-display-inline">For purposes of this
				paragraph and paragraph (2)(A), the Secretary shall calculate a milk feed ratio
				for a month using the same procedures used to calculate the milk feed ratio on
				page 64 of the USDA January 2010 Agricultural Prices publication (including the
				data and factors noted in footnote 4).</text>
								</subparagraph><subparagraph id="H9CC82C6C07184033B8DD869FFE357D3B"><enum>(D)</enum><header>Quarterly
				announcement of the allowable milk marketing growth rate</header><text>For the
				purpose of announcing the quarterly allowable milk marketing growth rate, the
				Secretary shall use the simple average of the three most recently available
				monthly figures for the milk feed ratio.</text>
								</subparagraph></paragraph><paragraph id="H5648AD9FD6294390B5F2695B3ED9FB8F"><enum>(2)</enum><header>Standard and
				alternative market access fees</header>
								<subparagraph id="HB2F2B19BB48043A69EFE9F2CAACF101D"><enum>(A)</enum><header>Standard market
				access fee</header>
									<clause id="H171FD77538E746C7BA80D748B87AA8B9"><enum>(i)</enum><header>In
				general</header><text>At least 30 days before the first day of each quarter,
				the Secretary shall establish the standard market access fee to be assessed on
				all commercial milk production of a dairy facility for that quarter.</text>
									</clause><clause id="HBFB5EE5C2E5B43EABF56EA80CD64D2A9"><enum>(ii)</enum><header>Requirement</header><text>The
				standard market access fee shall be based on the number of hundredweights of
				raw milk produced for commercial use, as determined by the Secretary.</text>
									</clause><clause id="H365AEF0EA30249348BD01F7AC0BA9DAE"><enum>(iii)</enum><header>Calculation of
				standard market access fee</header><text display-inline="yes-display-inline">The standard market access fee shall be
				determined using the following table:</text>

									</clause><clause id="HD3FA9DAB7AA9436DA52941D0BC08D6AB"><enum>(iv)</enum><header>Quarterly
				announcement of the market access fee</header><text display-inline="yes-display-inline">For the purpose of announcing the quarterly
				standard market access fee, the Secretary shall use the simple average of the
				three most recently available monthly figures for the milk feed ratio.</text>
									</clause></subparagraph><subparagraph id="H3D8AE83BB4854DE1A2BA6BAC2B9D89CE"><enum>(B)</enum><header>Alternative
				access fee</header><text>The amount of the alternative market access fee to be
				assessed on all commercial milk production of a dairy facility that exceeds the
				allowable milk marketings of the dairy facility for a quarter shall be equal to
				the product obtained by multiplying—</text>
									<clause commented="no" id="H2B3C15B248F2474789AC4F541BB38D49"><enum>(i)</enum><text>5; by</text>
									</clause><clause id="HB5AD47B79C7447D09EE7E6C9BCA8B800"><enum>(ii)</enum><text>the standard
				market access fee amount per hundredweight of milk.</text>
									</clause></subparagraph></paragraph><paragraph id="HC507A9F408FB449ABA1DFD602C2F7DB8"><enum>(3)</enum><header>Revisions</header><text display-inline="yes-display-inline">The Secretary may make revisions to the
				calculations of the market access fee and allowable milk marketing growth rate,
				but only if at least two-thirds of the members of the Producer Board support
				the revisions. For any revisions, the Secretary shall consider—</text>
								<subparagraph id="H4AF06C35067F4149B75811ACEE1E407B"><enum>(A)</enum><text>the economic
				conditions of the dairy industry in the United States;</text>
								</subparagraph><subparagraph id="H77CC1FFD899E4225B656194D7EB8E05B"><enum>(B)</enum><text>the economic
				conditions of the world dairy market;</text>
								</subparagraph><subparagraph id="HC6C89CEA16014706B0ECF26010088C8A"><enum>(C)</enum><text>the commercial
				disappearance of fluid and manufactured milk products;</text>
								</subparagraph><subparagraph id="HD5BB1F23411D4526806B55A505A10C7A"><enum>(D)</enum><text>the domestic
				on-farm cost of producing raw milk;</text>
								</subparagraph><subparagraph id="H6918FD3A64DA4A0AAAE6B0615DE2D629"><enum>(E)</enum><text>the domestic
				farm-gate milk price paid to dairy farmers in the United States;</text>
								</subparagraph><subparagraph id="HB60E8116FDF948379CAD03D913EC2CD6"><enum>(F)</enum><text>the international
				value of manufactured dairy products;</text>
								</subparagraph><subparagraph id="H1F344E4A0D96484EB775288518177BF3"><enum>(G)</enum><text>the current United
				States import/export balance in dairy products;</text>
								</subparagraph><subparagraph id="H2457486351664D7B8C1487F2B8E7E82B"><enum>(H)</enum><text>any foreseen
				purchases by the Federal Government for nutrition programs; and</text>
								</subparagraph><subparagraph id="H6F054D44EBE24FBAB0FF6E9DD0FC49A9"><enum>(I)</enum><text>any other economic
				indicator that the Secretary determines to be appropriate.</text>
								</subparagraph></paragraph></subsection><subsection id="H490825CB4846443994E2047DB4382F2B"><enum>(c)</enum><header>Allowable milk
				marketings</header>
							<paragraph id="H06B32380F40A4547831E9FA3A3420E39"><enum>(1)</enum><header>In
				general</header><text>At least 30 days before the first day of each quarter,
				the Secretary shall—</text>
								<subparagraph id="HDAF4B849BCD34F84B5FF2880601C8CE0"><enum>(A)</enum><text>establish the
				quantity of allowable milk marketings for each dairy facility; and</text>
								</subparagraph><subparagraph id="HF24FB3E83B514A2B8FB017BABDB05175"><enum>(B)</enum><text>notify each dairy
				facility of the quantity.</text>
								</subparagraph></paragraph><paragraph id="H6961C4D963CE4B31A2534525C5CD8C33"><enum>(2)</enum><header>Appeal</header><text>A
				dairy facility may appeal to the Secretary any discrepancy in the quantity of
				allowable milk marketings established for the dairy facility.</text>
							</paragraph><paragraph id="H0BBE11E52B664CBBA7D01095E9BE6BBA"><enum>(3)</enum><header>Transfers of
				allowable milk marketings</header><text>The 1 or more owners of the
				milk-producing cows at a dairy facility may transfer, in full, the allowable
				milk marketings associated with the dairy facility to—</text>
								<subparagraph id="H2C107300BE4A4E329F332F894C726ED2"><enum>(A)</enum><text>an individual or
				entity that purchases the dairy facility; or</text>
								</subparagraph><subparagraph id="H7329C9858462406B89E14048BA1823AA"><enum>(B)</enum><text>another dairy
				facility under the same ownership.</text>
								</subparagraph></paragraph><paragraph id="H11A2ED66CC9845EFAA87720DD4329721"><enum>(4)</enum><header>Leap-year
				adjustment</header>
								<subparagraph id="H6177EB267BA04D55ABADC36DF50063D8"><enum>(A)</enum><header>Effect of leap
				year</header><text display-inline="yes-display-inline">During a calendar year
				that consists of 366 days, <fraction>1⁄90</fraction>th of the allowable milk
				marketings for the first quarter shall be added to the allowable milk
				marketings of each dairy producer.</text>
								</subparagraph><subparagraph id="HFC7DE36C3626486AAE3432188AC8F9C3"><enum>(B)</enum><header>Subsequent
				year</header><text>Following a year described in subparagraph (A),
				<fraction>1⁄91</fraction>st of the allowable milk marketings shall be
				subtracted from the allowable milk marketings of each dairy producer during the
				preceding year.</text>
								</subparagraph></paragraph></subsection><subsection id="HFF37F72FED774508BECEBB3D0B91C90E"><enum>(d)</enum><header>Collection of
				market access fees</header>
							<paragraph id="H3067614C63504AC2AE9EA773F89BAAA3"><enum>(1)</enum><header>In
				general</header><text>During any quarter, a dairy facility that produces and
				markets milk in a quantity that is greater than the allowable milk marketings
				of the dairy facility for that quarter shall be assessed the standard market
				access fee in the following quarter unless, not later than 7 days after the end
				of the quarter, the dairy facility notifies in writing the appropriate local
				office of the Farm Services Agency of the intent of the dairy facility to pay
				the alternative market access fee in lieu of the standard market access
				fee.</text>
							</paragraph><paragraph id="H23A12A7072924860A9E32C9AAF011916"><enum>(2)</enum><header>Notice</header><text>Not
				later than 25 days after the end of a quarter during which a dairy facility
				exceeded the allowable milk marketings of the dairy facility, the Secretary
				shall send to the dairy facility and to each of the milk handlers of the dairy
				facility a notice that describes the market access fee to be assessed against
				the dairy facility during the following quarter.</text>
							</paragraph><paragraph id="H862FD201D4484C5AAE92D053BB395138"><enum>(3)</enum><header>Milk
				handlers</header>
								<subparagraph id="H205301D409BD458DA33ED3BACD862439"><enum>(A)</enum><header>In
				general</header><text>Each milk handler of a dairy facility notified under
				paragraph (2) shall—</text>
									<clause id="H3D443FCD4FAE4156BBC2845CD8AC8900"><enum>(i)</enum><text>during the quarter
				in which the milk handler receives the notice, collect an assessment per
				hundredweight of milk from the dairy facility in the amount of the market
				access fee described in the notice; and</text>
									</clause><clause id="H6C6B9A6322CF41368598A31AAD311E5A"><enum>(ii)</enum><text>deposit the
				assessment amounts into the protected account described in subsection
				(f).</text>
									</clause></subparagraph><subparagraph id="H5D2D83B214AD468AA317E0D4393AEE72"><enum>(B)</enum><header>Alternative
				market access fee</header><text>If a dairy facility notifies the appropriate
				local office of the Farm Services Agency under paragraph (1) of an intent to
				pay the alternative market access fee, the amount of the assessment described
				in the notice under paragraph (2) shall be—</text>
									<clause id="HDD04DA3AE8A1427DAC180359FAC26A74"><enum>(i)</enum><text>deducted from the
				revenues of the dairy facility in 3 equal monthly installments; and</text>
									</clause><clause id="H80F6B3F0B1104D75BC7D5553A84FE072"><enum>(ii)</enum><text>deposited into
				the protected account described in subsection (f).</text>
									</clause></subparagraph></paragraph><paragraph id="H04A8EA504B5F4097860F6E7441602079"><enum>(4)</enum><header>Subsequent
				overages</header><text>If a dairy facility exceeds the allowable milk
				marketings of the dairy facility in a quarter and any of the 4 subsequent
				quarters, the dairy facility shall be assessed a market access fee in an amount
				that is equal to the lesser of—</text>
								<subparagraph id="H1173B8102E5F452F864731ED94EA3AB5"><enum>(A)</enum><text>the market access
				fee announced after the first quarter in which the dairy facility exceeded the
				allowable milk marketings; or</text>
								</subparagraph><subparagraph id="H8ACFA3B9B7C04535A60114471DFDC098"><enum>(B)</enum><text display-inline="yes-display-inline">the market access fee announced for the 4
				quarters in which the dairy facility subsequently exceeds the allowable milk
				marketings of the dairy facility.</text>
								</subparagraph></paragraph><paragraph id="H33D0CB396BDA4C809F773D526E7B4CE0"><enum>(5)</enum><header>Responsibility</header><text>The
				milk handler for the 1 or more owners of the milk-producing cows at a dairy
				facility that receives a notice under paragraph (2) shall give notice to the
				owners that the market access fees shall be—</text>
								<subparagraph id="HDECCB1B525B94DECBF5CA727E084E79B"><enum>(A)</enum><text>deducted from the
				proceeds of the dairy facility; and</text>
								</subparagraph><subparagraph id="H1C606400D4434F22BBD8B66E7CD38EF9"><enum>(B)</enum><text>submitted to the
				local office of the Farm Services Agency with which the owners have
				registered.</text>
								</subparagraph></paragraph></subsection><subsection id="H81B2481265E447488A65F67DAD5BC47D"><enum>(e)</enum><header>Payment of
				market access fee dividends</header>
							<paragraph id="H3F228BCD35A54D6F94219A8518153F56"><enum>(1)</enum><header>In
				general</header><text>During any quarter, a dairy facility that produces and
				markets a quantity of milk that is less than or equal to the allowable milk
				marketings of the dairy facility for that quarter shall be entitled to receive
				a market access fee dividend in an amount based on the ratio that—</text>
								<subparagraph id="HD8E24E9233624DBCB4F936BFA95C68C8"><enum>(A)</enum><text>each hundredweight
				of allowable milk marketings produced during that quarter at the dairy
				facility; bears to</text>
								</subparagraph><subparagraph id="H7EC7C4717CEA485A9161E0C10CF26ED5"><enum>(B)</enum><text display-inline="yes-display-inline">total hundredweights produced by all
				facilities that did not exceed their allowable milk marketings during that
				quarter.</text>
								</subparagraph></paragraph><paragraph id="H4008633822664CEE8A5D640BF246BF3D"><enum>(2)</enum><header>Total
				amount</header><text display-inline="yes-display-inline">The total amount of
				market access fee dividends available during a quarter shall be equal to the
				cumulative market access fees collected under this subtitle for a
				quarter.</text>
							</paragraph><paragraph id="HEBA23C647C044B678DBF3B3C7A50CF3A"><enum>(3)</enum><header>Distribution</header>
								<subparagraph id="HD0DC4B7480504AA09A13A91D78D797CE"><enum>(A)</enum><header>In
				general</header><text>The market access fee dividends for a quarter shall be
				distributed to each qualifying dairy facility not later than 30 days after the
				last day of the following quarter.</text>
								</subparagraph><subparagraph id="HF9DB8A01A1FA44BAA6D70AFF1B6D240B"><enum>(B)</enum><header>Eligibility</header><text>The
				1 or more owners of the milk-producing cows at a dairy facility described in
				paragraph (1) shall be eligible to receive any market access fee dividends paid
				to the dairy facility under this subsection.</text>
								</subparagraph><subparagraph id="H31608435F6E04D4185DACADF8BBCA08F"><enum>(C)</enum><header>Payment</header><text>Payment
				of market access fee dividends shall be by check or direct deposit.</text>
								</subparagraph></paragraph></subsection><subsection id="HC402A95515C74A05A637A8B428CD3A9A"><enum>(f)</enum><header>Administration</header><text>Amounts
				collected by milk handlers under subsection (d) shall be deposited into a
				protected account established by the Secretary from which amounts may not be
				withdrawn other than for distribution as market access fee
				dividends.</text>
