<official-title display="yes">To provide for adjustment of status for certain Haitian orphans paroled into the United States after the earthquake of January 12, 2010.</official-title>

<section id="H52FF31F580694BACAED274A26F81539C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as—</text> 
<paragraph id="HF0B311A0D56B4E1A84334AED14841A83"><enum>(1)</enum><text>the <quote>Help Haitian Adoptees Immediately to Integrate Act of 2010</quote>; or</text> </paragraph> 
<paragraph id="HD4C1140AD2944827815CF59EBB7F4319"><enum>(2)</enum><text>the <quote>Help HAITI Act of 2010</quote>.</text> </paragraph></section> 
<section id="H36B6B005A9CE462A832501452B1645C7"><enum>2.</enum><header>Adjustment of status for certain Haitian orphans</header> 
<subsection id="HD64776A71E6746BBA640700B9C23EA46"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Homeland Security may adjust the status of an alien described in subsection (b) to that of an alien lawfully admitted for permanent residence if the alien—</text> 
<paragraph id="HE0573A5ED2B74AA3955E64F1D407A8E8"><enum>(1)</enum><text>subject to subsection (c), applies for such adjustment;</text> </paragraph> 
<paragraph id="H335C6D1089E343A3BC85106C560CF610"><enum>(2)</enum><text>is physically present in the United States on the date the application for such adjustment is filed; and</text> </paragraph> 
<paragraph id="HC4555969F59045C4B88DF70CE2F6B88D"><enum>(3)</enum><text>is admissible to the United States as an immigrant, except as provided in subsection (d).</text> </paragraph></subsection> 
<subsection id="H655755D464D34870B313F9844AD66B88"><enum>(b)</enum><header>Aliens eligible for adjustment of status</header><text>An alien is described in this subsection if the alien was inspected and granted parole into the United States pursuant to the humanitarian parole policy for certain Haitian orphans announced on January 18, 2010, and suspended as to new applications on April 15, 2010.</text> </subsection> 
<subsection id="H8292EDB6F7C242E589F83D1A8318496A"><enum>(c)</enum><header>Application</header><text display-inline="yes-display-inline">In the case of a minor, an application under this section may be submitted on behalf of the alien by—</text> 
<paragraph id="H651F0D25D4654C12A00F6D111A5417CD"><enum>(1)</enum><text>an adoptive parent; or</text> </paragraph> 
<paragraph id="H226FA59652CA41A3A12B4567FA9A6A6A"><enum>(2)</enum><text>a legal guardian.</text> </paragraph></subsection> 
<subsection id="H84C097465763467EA6808ADD7CC54C9A"><enum>(d)</enum><header>Grounds of inadmissibility</header><text display-inline="yes-display-inline">Paragraphs (4) and (7)(A) of section 212(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)</external-xref>) shall not apply to adjustment of status under this section.</text> </subsection> 
<subsection id="H93B1FCFCBDD7458DBEB7EE7B448C8540"><enum>(e)</enum><header>Visa availability</header><text display-inline="yes-display-inline">When an alien is granted the status of having been lawfully admitted for permanent residence under this section, the Secretary of State shall not be required to reduce the number of immigrant visas authorized to be issued under the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101 et seq.</external-xref>).</text> </subsection> 
<subsection id="HB6CC4E264713433EBFD070C1EC2727C5"><enum>(f)</enum><header>Aliens deemed to meet definition of child</header><text display-inline="yes-display-inline">An unmarried alien described in subsection (b) who is under the age of 18 years shall be deemed to satisfy the requirements applicable to adopted children under section 101(b)(1) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(b)(1)</external-xref>) if—</text> 
<paragraph id="H501310C9A6FD41FB832FEBA60399F79C"><enum>(1)</enum><text>the alien obtained adjustment of status under this section; and</text> </paragraph> 
<paragraph id="H97E6F1FEE0924FD5958B3049B7A975B9"><enum>(2)</enum><text>a United States citizen adopted the alien before, on, or after the date of the decision granting adjustment of status under this section.</text> </paragraph></subsection> 
<subsection id="H5EBECAE2ECB6499FB9A83B2069B39D43"><enum>(g)</enum><header>No immigration benefits for birth parents</header><text display-inline="yes-display-inline">No birth parent of an alien who obtains adjustment of status under this section shall thereafter, by virtue of such parentage, be accorded any right, privilege, or status under this section or the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101 et seq.</external-xref>).</text></subsection></section> 
<section id="HB782BB2748D643E98E3C0FED03992CBD"><enum>3.</enum><header>Compliance with PAYGO</header><text display-inline="no-display-inline">The budgetary effects of this Act, for the purpose of complying with the Statutory Pay-As-You-Go Act of 2010, shall be determined by reference to the latest statement titled “Budgetary Effects of PAYGO Legislation” for this Act, submitted for printing in the Congressional Record by the Chairman of the Committee on the Budget of the House of Representatives, provided that such statement has been submitted prior to the vote on passage.</text> </section>
