<section id="H1243" section-type="resolved"><text>That the House agree to the amendment numbered 3 of the Senate to the aformentioned bill, with the following</text></section><amendment>

<section id="HB8BB0710883B41D0A30C54FDEA6E0865"><enum>4.</enum><header>Short title</header><text display-inline="no-display-inline">Notwithstanding section 1, sections 5 through 16 of this Act may be cited as the <quote><short-title>Development, Relief, and Education for Alien Minors Act of 2010</short-title></quote> or the <quote><short-title>DREAM Act of 2010</short-title></quote>.</text></section> 
<section id="HB8B1823DD7CC48DE910F0E18274C8C73"><enum>5.</enum><header>Definitions</header><text display-inline="no-display-inline">In this section and sections 6 through 16 of this Act:</text> 
<paragraph id="H6D955775C54D454B982F6EF8088FB3D4"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as otherwise specifically provided, a term used in this section and section 6 through 16 of this Act that is used in the immigration laws shall have the meaning given such term in the immigration laws.</text></paragraph> 
<paragraph id="HA80EF5626FE14F5BA5B29FC89D8951A0"><enum>(2)</enum><header>Armed Forces</header><text>The term <quote>Armed Forces</quote> has the meaning given the term <quote>armed forces</quote> in section 101(a) of title 10, United States Code.</text></paragraph> 
<paragraph id="HD0FD4C798CC347B8B5C42062A2927FE0"><enum>(3)</enum><header>Conditional nonimmigrant</header> 
<subparagraph id="H007DA6E2DD184E449143B3342B33D56E"><enum>(A)</enum><header>Definition</header><text>The term <term>conditional nonimmigrant</term> means an alien who is granted conditional nonimmigrant status under this Act.</text></subparagraph> 
<subparagraph id="H45E3019E872743AB83824D12C3C2C780"><enum>(B)</enum><header>Description</header><text>A conditional nonimmigrant—</text> 
<clause id="H0F50BE4255A14D009DFDAEFADAB055B5"><enum>(i)</enum><text>shall be considered to be an alien within a nonimmigrant class for purposes of the immigration laws;</text></clause> 
<clause id="H41594F4A4E8B4C178DCDD77AC7518AD3"><enum>(ii)</enum><text>may have the intention permanently to reside in the United States; and</text></clause> 
<clause id="HCDD3D4ED6DE3425CA34946FE97F5DFBE"><enum>(iii)</enum><text>is not required to have a foreign residence which the alien has no intention of abandoning.</text></clause></subparagraph></paragraph> 
<paragraph id="H4B187DC378D64E1A83FA6CC7D6AAC788"><enum>(4)</enum><header>Immigration laws</header><text>The term <quote>immigration laws</quote> has the meaning given such term in section 101(a)(17) of the Immigration and Nationality Act (8 U.S.C. 1101(a)(17)).</text></paragraph> 
<paragraph id="H2A80DEC58CF1411285450A5DB42207B2"><enum>(5)</enum><header>Institution of higher education</header><text display-inline="yes-display-inline">The term <quote>institution of higher education</quote> has the meaning given such term in section 102 of the <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (20 U.S.C. 1002), except that the term does not include an institution of higher education outside the United States.</text></paragraph></section> 
<section id="H60CAE77BB3674F35A0D1C8422C85B7DA" display-inline="no-display-inline" section-type="subsequent-section"><enum>6.</enum><header>Cancellation of removal of certain long-term residents who entered the United States as children</header> 
<subsection id="HC293E01B46E2496CB13E1AC42269521C"><enum>(a)</enum><header>Special rule for certain long-term residents who entered the United States as children</header> 
<paragraph id="HE4AF211A6776496BBCD57B9964D37417"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of law and except as otherwise provided in this section and sections 7 through 16 of this Act, the Secretary of Homeland Security may cancel removal of an alien who is inadmissible or deportable from the United States, and grant the alien conditional nonimmigrant status, if the alien demonstrates by a preponderance of the evidence that—</text> 
<subparagraph id="HFFA30426C4934D73ABDCE553364626F6"><enum>(A)</enum><text>the alien has been physically present in the United States for a continuous period of not less than 5 years immediately preceding the date of the enactment of this Act and was younger than 16 years of age on the date the alien initially entered the United States;</text></subparagraph> 
<subparagraph id="H5013DE3A578A4B7C9B822847EA8565A0"><enum>(B)</enum><text>the alien has been a person of good moral character since the date the alien initially entered the United States;</text></subparagraph> 
<subparagraph id="HA7800398C49248939AC9876B054E2309"><enum>(C)</enum><text>subject to paragraph (2), the alien—</text> 
<clause id="H75C7CBFC8C844B29A8E79DC1B63A89E8"><enum>(i)</enum><text>is not inadmissible under paragraph (1), (2), (3), (4), (6)(E), (6)(G), (8), (10)(A), (10)(C), or (10)(D) of section 212(a) of the Immigration and Nationality Act (8 U.S.C. 1182(a));</text></clause> 
<clause id="H0B7C4DD47E8E4F008525D616C7FC1256"><enum>(ii)</enum><text>is not deportable under paragraph (1)(E), (1)(G), (2), (4), (5), or (6) of section 237(a) of the Immigration and Nationality Act (8 U.S.C. 1227(a));</text></clause> 
<clause id="H68B78C7D0E6C4D918B6E7273E2FC733A"><enum>(iii)</enum><text>has not ordered, incited, assisted, or otherwise participated in the persecution of any person on account of race, religion, nationality, membership in a particular social group, or political opinion; and</text></clause> 
<clause id="H9BE2AA3BBE8A45329D7E9BFC5CBAA35D"><enum>(iv)</enum><text>has not been convicted of—</text> 
<subclause id="H0F97B8EB21F04EEFA366AC4B0690056A"><enum>(I)</enum><text>any offense under Federal or State law punishable by a maximum term of imprisonment of more than 1 year; or</text></subclause> 
<subclause id="H5BBB6269AFEF4F48B50DA54533C1F9BB"><enum>(II)</enum><text>3 or more offenses under Federal or State law, for which the alien was convicted on different dates for each of the 3 offenses and sentenced to imprisonment for an aggregate of 90 days or more;</text></subclause></clause></subparagraph> 
<subparagraph id="H8EDF09DF50C14CFB85D6B9344934473E"><enum>(D)</enum><text>the alien—</text> 
<clause id="HD6AA288FCA784B0F9BBF6F02E2756F40"><enum>(i)</enum><text>has been admitted to an institution of higher education in the United States; or</text></clause> 
<clause id="H9BD7D631CE1D4DAC88759A4256E39AEC"><enum>(ii)</enum><text>has earned a high school diploma or obtained a general education development certificate in the United States;</text></clause></subparagraph> 
<subparagraph id="HC74EC663ADB143139DA987E44D8716D3"><enum>(E)</enum><text>the alien has never been under a final administrative or judicial order of exclusion, deportation, or removal, unless the alien—</text> 
<clause id="HB9BC09B990BF4161865FB66AEF341949"><enum>(i)</enum><text>has remained in the United States under color of law after such order was issued; or</text></clause> 
<clause id="HC5F10CF17C8940ECA4C0449279E2B2D1"><enum>(ii)</enum><text>received the order before attaining the age of 16 years; and</text></clause></subparagraph> 
<subparagraph id="H5E3AE6BFA11E4EDF86AC4E2DAA7557B3"><enum>(F)</enum><text>the alien was younger than 30 years of age on the date of the enactment of this Act.</text></subparagraph></paragraph> 
<paragraph id="H4246D99F80D5425E93CC4B34D399C949" commented="no"><enum>(2)</enum><header>Waiver</header><text display-inline="yes-display-inline">With respect to any benefit under this section and sections 7 through 16 of this Act, the Secretary of Homeland Security may waive the ground of inadmissibility under paragraph (1), (4), or (6) of section 212(a) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (8 U.S.C. 1182(a)) and the ground of deportability under paragraph (1) of section 237(a) of that Act (8 U.S.C. 1227(a)) for humanitarian purposes or family unity or when it is otherwise in the public interest.</text></paragraph> 
<paragraph id="HADE4841CDC5E45B8847CEF077B78189A"><enum>(3)</enum><header>Procedures</header><text>The Secretary of Homeland Security shall provide a procedure by regulation allowing eligible individuals to apply affirmatively for the relief available under this subsection without being placed in removal proceedings.</text></paragraph> 
<paragraph id="H372D5B2669884E838B1D0FADAF48CDF8"><enum>(4)</enum><header>Surcharge</header><text>The Secretary of Homeland Security shall charge and collect a surcharge of $525 per application on all applications for relief under this subsection. Such surcharge shall be in addition to the otherwise applicable application fee imposed for the purpose of recovering the full costs of providing adjudication and processing services. Notwithstanding any other provision of law, including section 286 of the Immigration and Nationality Act (8 U.S.C. 1356), any surcharge collected under this paragraph shall be deposited as offsetting receipts in the General Fund of the Treasury and shall not be available for obligation or expenditure.</text></paragraph> 
<paragraph id="H30E36456CC684D68806D8A3C3BFEE103"><enum>(5)</enum><header>Deadline for submission of application</header><text>An alien shall submit an application for cancellation of removal and conditional nonimmigrant status under this subsection no later than the date that is 1 year after the later of—</text> 
<subparagraph id="HE1AF464B54E345158297F33E74898DF4"><enum>(A)</enum><text>the date the alien earned a high school diploma or obtained a general education development certificate in the United States; or</text></subparagraph> 
<subparagraph id="H9A475209081A4656A225A3D39CEAF6E5"><enum>(B)</enum><text display-inline="yes-display-inline">the effective date of the interim regulations under subsection (d).</text></subparagraph></paragraph> 
<paragraph id="H7F647FA4E99241D6BFE9E9479A64EE22"><enum>(6)</enum><header>Submission of biometric and biographic data</header><text>The Secretary of Homeland Security may not cancel the removal of an alien or grant conditional nonimmigrant status to the alien under this subsection unless the alien submits biometric and biographic data, in accordance with procedures established by the Secretary. The Secretary shall provide an alternative procedure for applicants who are unable to provide such biometric or biographic data because of a physical impairment.</text></paragraph> 
<paragraph id="HFF50CB387B57438F8C0687F093323C8C"><enum>(7)</enum><header>Background checks</header> 
<subparagraph id="H9D0C6EE094654E43BED7ED743DBE5145"><enum>(A)</enum><header>Requirement for background checks</header><text>The Secretary of Homeland Security shall utilize biometric, biographic, and other data that the Secretary determines is appropriate—</text> 
<clause id="HA8B6611EF04043B5BBA4FBBD20C47B0A"><enum>(i)</enum><text>to conduct security and law enforcement background checks of an alien seeking relief available under this subsection; and</text></clause> 
<clause id="H6C42A8B525034DBAB78A55A1CC372E52"><enum>(ii)</enum><text>to determine whether there is any criminal, national security, or other factor that would render the alien ineligible for such relief.</text></clause></subparagraph> 
<subparagraph id="H7690402F200E4801B541B838A2C41096"><enum>(B)</enum><header>Completion of background checks</header><text>The security and law enforcement background checks required by subparagraph (A) shall be completed, to the satisfaction of the Secretary, prior to the date the Secretary cancels the removal of the alien under this subsection.</text></subparagraph></paragraph> 
<paragraph id="HCE373CBEB05D4D95826E6D10E5C16141"><enum>(8)</enum><header>Medical examination</header><text>An alien applying for relief available under this subsection shall undergo a medical observation and examination. The Secretary of Homeland Security, with the concurrence of the Secretary of Health and Human Services, shall prescribe policies and procedures for the nature and timing of such observation and examination.</text></paragraph> 
<paragraph id="HCD8AA39ECD3E44C589D9E0F27A622EB3"><enum>(9)</enum><header>Military selective service</header><text>An alien applying for relief available under this subsection shall establish that the alien has registered under the Military Selective Service Act (50 U.S.C. App. 451 et seq.), if the alien is subject to such registration under that Act.</text></paragraph></subsection> 
<subsection id="H8AE646EB2A7D44BE97E4EAC532792BC0"><enum>(b)</enum><header>Termination of continuous period</header><text>For purposes of this section, any period of continuous residence or continuous physical presence in the United States of an alien who applies for cancellation of removal under subsection (a) shall not terminate when the alien is served a notice to appear under section 239(a) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (8 U.S.C. 1229(a)).</text></subsection> 
<subsection id="H08B07730B6B74F81A519AED83825362D"><enum>(c)</enum><header>Treatment of certain breaks in presence</header> 
<paragraph id="H3BEC7BB75967415BAC1D2A7953079B96"><enum>(1)</enum><header>In general</header><text>An alien shall be considered to have failed to maintain continuous physical presence in the United States under subsection (a) if the alien has departed from the United States for any period in excess of 90 days or for any periods in the aggregate exceeding 180 days.</text></paragraph> 
<paragraph id="H87CE872D052A4FBCBB7761639A401B1F"><enum>(2)</enum><header>Extensions for exceptional circumstances</header><text>The Secretary of Homeland Security may extend the time periods described in paragraph (1) if the alien demonstrates that the failure to timely return to the United States was due to exceptional circumstances. The exceptional circumstances determined sufficient to justify an extension should be no less compelling than serious illness of the alien, or death or serious illness of a parent, grandparent, sibling, or child.</text></paragraph></subsection> 
<subsection id="H3F7172DA2EEF45E298C52FFDFB3CE2F9"><enum>(d)</enum><header>Regulations</header> 
<paragraph id="HA83FACE49D5D4E53B3BDEB81615E54D1"><enum>(1)</enum><header>Initial publication</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary of Homeland Security shall publish regulations implementing this section.</text></paragraph> 
<paragraph id="HB896C3E6C98A4D1184BE2B13D85359C7"><enum>(2)</enum><header>Interim regulations</header><text>Notwithstanding section 553 of title 5, United States Code, the regulations required by paragraph (1) shall be effective, on an interim basis, immediately upon publication but may be subject to change and revision after public notice and opportunity for a period of public comment.</text></paragraph> 
<paragraph id="HDAF450DD3EFA4ABCBD232A00874F81ED"><enum>(3)</enum><header>Final regulations</header><text>Within a reasonable time after publication of the interim regulations in accordance with paragraph (1), the Secretary of Homeland Security shall publish final regulations implementing this section.</text></paragraph></subsection> 
<subsection id="H02E2769E26854B1FB032079B8488DF7C"><enum>(e)</enum><header>Removal of alien</header><text>The Secretary of Homeland Security may not remove any alien who—</text> 
<paragraph id="HC5FDCDB608D046B88B3B52ACED0C6E8B"><enum>(1)</enum><text>has a pending application for conditional nonimmigrant status under this Act; and</text></paragraph> 
<paragraph id="H80E882651418495EAA9BA3A627E7B723"><enum>(2)</enum><text>establishes prima facie eligibility for cancellation of removal and conditional nonimmigrant status under subsection (a).</text></paragraph></subsection></section> 
<section id="HFCA74D3F594C4423AB78969997706729" display-inline="no-display-inline" section-type="subsequent-section"><enum>7.</enum><header>Conditional nonimmigrant status</header> 
<subsection id="HE8159652B1E449E39B89606D82C3512D"><enum>(a)</enum><header>Length of status</header><text>Conditional nonimmigrant status granted under section 6 shall be valid for an initial period of 5 years, subject to termination under subsection (c) of this section.</text></subsection> 
<subsection id="H06D60F4EFA874FC3B1CF7095F7528BD6"><enum>(b)</enum><header>Terms of conditional nonimmigrant status</header> 
<paragraph id="H6C1FF605781049E18197A2BCCB2DF965"><enum>(1)</enum><header>Employment</header><text>A conditional nonimmigrant shall be authorized to be employed in the United States incident to conditional nonimmigrant status.</text></paragraph> 
<paragraph id="HA46AF63815A34BD2B41E1FDF22EF5B43" commented="no"><enum>(2)</enum><header>Travel</header><text>A conditional nonimmigrant may travel outside the United States and may be admitted (if otherwise admissible) upon return to the United States without having to obtain a visa if—</text> 
<subparagraph id="HD7B33714F6444679A287240192447BE6" commented="no"><enum>(A)</enum><text>the alien is the bearer of valid, unexpired documentary evidence of conditional nonimmigrant status; and</text></subparagraph> 
<subparagraph id="HA4AD9448CE7F459AB5FAA560D199A2AF" commented="no"><enum>(B)</enum><text>the alien’s absence from the United States was not for a period exceeding 180 days.</text></subparagraph></paragraph></subsection> 
<subsection id="H083666132E094F21B7CD3203BC784A1B"><enum>(c)</enum><header>Termination of status</header> 
<paragraph id="H6847B031BD044D3B8374B953168DEAA4"><enum>(1)</enum><header>In general</header><text>The Secretary of Homeland Security shall terminate the conditional nonimmigrant status of any alien if the Secretary determines that the alien—</text> 
<subparagraph id="HA1771991717B458E92A197420AB78475"><enum>(A)</enum><text>ceases to meet the requirements of subparagraph (B) or (C) of section 6(a)(1);</text></subparagraph> 
<subparagraph id="HD0C20BFA1E894E1D931761CCC9B250B6"><enum>(B)</enum><text>has become a public charge; or</text></subparagraph> 
<subparagraph id="HEB74B30F25164B5D8B6C11E51A6D6F37"><enum>(C)</enum><text>has received a dishonorable or other than honorable discharge from the Armed Forces.</text></subparagraph></paragraph> 
<paragraph id="H231EDE31A0A04A9BB22125ED54A7F73C"><enum>(2)</enum><header>Return to previous immigration status</header><text>Any alien whose conditional nonimmigrant status is terminated under paragraph (1) shall return to the immigration status the alien had immediately prior to receiving conditional nonimmigrant status.</text></paragraph></subsection> 
<subsection id="H71ACFDDDD44640C58758671276552EE2"><enum>(d)</enum><header>Extension of status</header> 
<paragraph id="H1FFA0A8362A54AA4B5C7478ED789D45B"><enum>(1)</enum><header>Eligibility</header><text>The Secretary of Homeland Security shall extend the conditional nonimmigrant status of an alien for a second period of 5 years if the following requirements are met:</text> 
<subparagraph id="HDB9028C84DBE4A869B9BAFF63C26AB78"><enum>(A)</enum><text>The alien has demonstrated good moral character during the entire period the alien has been a conditional nonimmigrant.</text></subparagraph> 
<subparagraph id="H4E4959C4925A4A308C93DC4E7BFA625F"><enum>(B)</enum><text>The alien is in compliance with section 6(a)(1)(C).</text></subparagraph> 
<subparagraph id="HBD958A12094046A2A9D458FE1F0C7CAF" commented="no"><enum>(C)</enum><text>The alien has not abandoned the alien’s residence in the United States. For purposes of this subparagraph—</text> 
<clause id="H9EF51D5346484868A295AF51BE750E61"><enum>(i)</enum><text>the Secretary shall presume that the alien has abandoned such residence if the alien is absent from the United States for more than 365 days, in the aggregate, during the period of conditional nonimmigrant status, unless the alien demonstrates that the alien has not abandoned the alien’s residence; and</text></clause> 
<clause id="H3739653A23634FCDA8548E07ED2ACDA6"><enum>(ii)</enum><text>an alien who is absent from the United States due to active service in the Armed Forces has not abandoned the alien’s residence in the United States during the period of such service.</text></clause></subparagraph> 
<subparagraph id="H59B55F12F16140D083DB7A19F5852C4A" commented="no"><enum>(D)</enum><text>The alien—</text> 
<clause id="HB238E90ED07748D195009B7B741CDDA5" commented="no"><enum>(i)</enum><text>has acquired a degree from an institution of higher education in the United States or has completed at least 2 years, in good standing, in a program for a bachelor’s degree or higher degree in the United States; or</text></clause> 
<clause id="HB9075666E21B40748BA082A8F0BB5450" commented="no"><enum>(ii)</enum><text>has served in the Armed Forces for at least 2 years and, if discharged, has received an honorable discharge.</text></clause></subparagraph> 
<subparagraph id="HC4BFDF4878D64C48AA5AF12773B1B0B1"><enum>(E)</enum><text display-inline="yes-display-inline">The alien has provided a list of each secondary school (as that term is defined in section 9101 of the Elementary and Secondary Education Act of 1965 (20 U.S.C. 7801)) that the alien attended in the United States.</text></subparagraph></paragraph> 
<paragraph id="H23AB9CEB52074DA4A0235DA57784F1D9" display-inline="no-display-inline"><enum>(2)</enum><header>Surcharge</header><text display-inline="yes-display-inline">The Secretary of Homeland Security shall charge and collect a surcharge of $2,000 per application on all applications for an extension under this subsection. Such surcharge shall be in addition to the otherwise applicable application fee imposed for the purpose of recovering the full costs of providing adjudication and processing services. Notwithstanding any other provision of law, including section 286 of the Immigration and Nationality Act (8 U.S.C. 1356), any surcharge collected under this paragraph shall be deposited as offsetting receipts in the General Fund of the Treasury and shall not be available for obligation or expenditure.</text></paragraph> 
<paragraph id="H37BEC3B039E14F709E744A2ABCBA5075"><enum>(3)</enum><header>Hardship exception</header><text display-inline="yes-display-inline">The Secretary of Homeland Security may, in the Secretary’s discretion, extend the conditional nonimmigrant status of an alien if the alien—</text> 
<subparagraph id="HCB15350D45DF498CA63DB788F7ABE3DF"><enum>(A)</enum><text>satisfies the requirements of subparagraphs (A), (B), and (C) of paragraph (1);</text></subparagraph> 
<subparagraph id="H13DCC7ABBB3642F98750AB84760584B1"><enum>(B)</enum><text>demonstrates compelling circumstances for the inability to complete the requirements described in paragraph (1)(D); and</text></subparagraph> 
<subparagraph id="HE3B807A5DB89420A8ABC7D2BF28F76E2"><enum>(C)</enum><text>demonstrates that the alien’s removal from the United States would result in exceptional and extremely unusual hardship to the alien or the alien’s spouse, parent, or child who is a citizen or a lawful permanent resident of the United States.</text></subparagraph></paragraph></subsection></section> 
<section id="HE3BA7D1777FE444998A452B81CB81B46" display-inline="no-display-inline" section-type="subsequent-section"><enum>8.</enum><header>Adjustment of status</header> 
<subsection id="HF8B585082C6A43DF8B481D00E9C113BA"><enum>(a)</enum><header>In general</header><text>A conditional nonimmigrant may file with the Secretary of Homeland Security, in accordance with subsection (c), an application to have the alien’s status adjusted to that of an alien lawfully admitted for permanent residence. The application shall provide, under penalty of perjury, the facts and information so that the Secretary may make the determination described in subsection (b)(1).</text></subsection> 
<subsection id="HA79580D1E24641C190E1A8162FD49D41"><enum>(b)</enum><header>Adjudication of application for adjustment of status</header> 
<paragraph id="H39BCDF47CC284006A882CF8785B9021C"><enum>(1)</enum><header>In general</header><text>If an application is filed in accordance with subsection (a) for an alien, the Secretary of Homeland Security shall make a determination as to whether the alien meets the requirements set out in paragraphs (1) through (4) of subsection (d).</text></paragraph> 
<paragraph id="HC1083C608561464AA29A8336FF43AF11"><enum>(2)</enum><header>Adjustment of status if favorable determination</header><text>If the Secretary determines that the alien meets such requirements, the Secretary shall notify the alien of such determination and adjust the alien’s status to that of an alien lawfully admitted for permanent residence, effective as of the date of approval of the application.</text></paragraph> 
<paragraph id="HF2164CC8506F4C8AA215D790C0178CC0"><enum>(3)</enum><header>Termination if adverse determination</header><text>If the Secretary determines that the alien does not meet such requirements, the Secretary shall notify the alien of such determination and terminate the conditional nonimmigrant status of the alien as of the date of the determination.</text></paragraph></subsection> 
<subsection id="H8F0CE83436124C34B0B23912EC72D162"><enum>(c)</enum><header>Time to file application</header><text>An alien shall file an application for adjustment of status during the period beginning 1 year before and ending on either the date that is 10 years after the date of the initial grant of conditional nonimmigrant status or any other expiration date of the conditional nonimmigrant status as extended by the Secretary of Homeland Security in accordance with this Act. The alien shall be deemed to be in conditional nonimmigrant status in the United States during the period in which such application is pending.</text></subsection> 
<subsection id="H6C09A272ADED47FC83087813ACFFED42" commented="no"><enum>(d)</enum><header>Contents of application</header><text>Each application for an alien under subsection (a) shall contain information to permit the Secretary of Homeland Security to determine whether each of the following requirements is met:</text> 
<paragraph id="HF640637F55214CFF872A54D53B6A3A27" commented="no"><enum>(1)</enum><text>The alien has demonstrated good moral character during the entire period the alien has been a conditional nonimmigrant.</text></paragraph> 
<paragraph id="HA1DC3AA6F7684951BDCB26AB2A78BA3D" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">The alien is in compliance with section 6(a)(1)(C).</text></paragraph> 
<paragraph id="HEC6960D233D2432E80DDBA27848B7817" commented="no"><enum>(3)</enum><text>The alien has not abandoned the alien’s residence in the United States. For purposes of this paragraph—</text> 
<subparagraph id="H34B113FE11584784B95A1D52267127D0"><enum>(A)</enum><text>the Secretary shall presume that the alien has abandoned such residence if the alien is absent from the United States for more than 730 days, in the aggregate, during the period of conditional nonimmigrant status, unless the alien demonstrates that the alien has not abandoned the alien’s residence; and</text></subparagraph> 
<subparagraph id="HA495D6DB36E4498F91937A5CA4DEC3A9"><enum>(B)</enum><text>an alien who is absent from the United States due to active service in the Armed Forces has not abandoned the alien’s residence in the United States during the period of such service.</text></subparagraph></paragraph> 
<paragraph id="H30D18B9B6C794104B2CBAD766585FBFD" commented="no"><enum>(4)</enum><text display-inline="yes-display-inline">If previously granted a hardship exception under section 7(d)(3) from the requirements of section 7(d)(1)(D) with respect to extension of conditional nonimmigrant status, the alien has subsequently complied with such requirements, unless the alien is granted a hardship exception with respect to adjustment of status under the criteria described in section 7(d)(3).</text></paragraph></subsection> 
<subsection id="H003136D7378F42768C26C237BA448DB7"><enum>(e)</enum><header>Citizenship requirement</header> 
<paragraph id="H74555FB6D317423BB462E4EA84B5A87C"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), the status of a conditional nonimmigrant shall not be adjusted to permanent resident status unless the alien demonstrates that the alien satisfies the requirements of section 312(a) of the Immigration and Nationality Act (8 U.S.C. 1423(a)).</text></paragraph> 
<paragraph id="HD657BD6CD0BD4CBDB4566957D2FB6B32"><enum>(2)</enum><header>Exception</header><text>Paragraph (1) shall not apply to an alien who is unable because of a physical or developmental disability or mental impairment to meet the requirements of such paragraph.</text></paragraph></subsection> 
<subsection id="HDCA55BC09B8C4B88A72302A8238AA28E"><enum>(f)</enum><header>Payment of Federal taxes</header> 
<paragraph id="H876C2EB9C1D34E77834346E3C63D24C9"><enum>(1)</enum><header>In general</header><text>Not later than the date on which an application is filed under subsection (a) for adjustment of status, the alien shall satisfy any applicable Federal tax liability due and owing on such date.</text></paragraph> 
<paragraph id="H8EFC79CC99FF45F4B27BA8D750BA4258"><enum>(2)</enum><header>Applicable Federal tax liability</header><text>For purposes of paragraph (1), the term <quote>applicable Federal tax liability</quote> means liability for Federal taxes imposed under the Internal Revenue Code of 1986, including any penalties and interest thereon.</text></paragraph></subsection> 
<subsection id="H5A915D20345241F1830C2987A5CD555F"><enum>(g)</enum><header>Submission of biometric and biographic data</header><text>The Secretary of Homeland Security may not adjust the status of an alien under this section unless the alien submits biometric and biographic data, in accordance with procedures established by the Secretary. The Secretary shall provide an alternative procedure for applicants who are unable to provide such biometric or biographic data because of a physical impairment.</text></subsection> 
<subsection id="H89ECA888294043B4A81F10A5D3714550"><enum>(h)</enum><header>Background checks</header> 
<paragraph id="H47421D3D1FFB49AEB0D4427388226454"><enum>(1)</enum><header>Requirement for background checks</header><text>The Secretary of Homeland Security shall utilize biometric, biographic, and other data that the Secretary determines appropriate—</text> 
<subparagraph id="HD57D1E3C7C3F4F08AC789945E764B9CE"><enum>(A)</enum><text>to conduct security and law enforcement background checks of an alien applying for adjustment of status under this section; and</text></subparagraph> 
<subparagraph id="H5C6642A3E9B948DDB0E321699C609FE6"><enum>(B)</enum><text>to determine whether there is any criminal, national security, or other factor that would render the alien ineligible for such adjustment of status.</text></subparagraph></paragraph> 
<paragraph id="HD25A38EC94E040ED81051DE1BF2ACE41"><enum>(2)</enum><header>Completion of background checks</header><text>The security and law enforcement background checks required by paragraph (1) shall be completed, to the satisfaction of the Secretary, prior to the date the Secretary grants adjustment of status.</text></paragraph></subsection> 
<subsection id="H03C8328FBFCC43CF9339BE5E3BBDA6CE" commented="no"><enum>(i)</enum><header>Exemption from numerical limitations</header><text>Nothing in this section or in any other law may be construed to apply a numerical limitation on the number of aliens who may be eligible for adjustment of status under this section.</text></subsection> 
<subsection id="HCE7B6BFD8CC245198AA74049F6E7DB71"><enum>(j)</enum><header>Eligibility for naturalization</header><text>An alien whose status is adjusted under this section to that of an alien lawfully admitted for permanent residence may be naturalized upon compliance with all the requirements of the immigration laws except the provisions of paragraph (1) of section 316(a) of the Immigration and Nationality Act (8 U.S.C. 1427(a)), if such person immediately preceding the date of filing the application for naturalization has resided continuously, after being lawfully admitted for permanent residence, within the United States for at least 3 years, and has been physically present in the United States for periods totaling at least half of that time and has resided within the State or the district of U.S. Citizenship and Immigration Services in the United States in which the applicant filed the application for at least 3 months. An alien described in this subsection may file the application for naturalization as provided in the second sentence of subsection (a) of section 334 of the Immigration and Nationality Act (8 U.S.C. 1445).</text></subsection></section> 
<section id="HF04DFBE6FAC4474BBD0772275E42F0F6" display-inline="no-display-inline" section-type="subsequent-section"><enum>9.</enum><header>Treatment of aliens meeting requirements for extension of conditional nonimmigrant status</header><text display-inline="no-display-inline">If, on the date of the enactment of this Act, an alien has satisfied all the requirements of section 6(a)(1) and section 7(d)(1)(D), the Secretary of Homeland Security may cancel removal and grant conditional nonimmigrant status in accordance with section 6, and may extend conditional nonimmigrant status in accordance with section 7(d). The alien may apply for adjustment of status in accordance with section 8(a) if the alien has met the requirements of subparagraphs (A), (B), and (C) of section 7(d)(1) during the entire period of conditional nonimmigrant status.</text></section> 
<section id="H7B56E730EAFB4B0B9C5567916BD97592"><enum>10.</enum><header>Exclusive jurisdiction</header> 
<subsection id="H764193F1F6DC47AB9F91257C5A434CE6"><enum>(a)</enum><header>In general</header><text>The Secretary of Homeland Security shall have exclusive jurisdiction to determine eligibility for relief under sections 6 through 16 of this Act, except where the alien has been placed into deportation, exclusion, or removal proceedings either prior to or after filing an application for cancellation of removal and conditional nonimmigrant status or adjustment of status under this Act, in which case the Attorney General shall have exclusive jurisdiction and shall assume all the powers and duties of the Secretary until proceedings are terminated, or if a final order of deportation, exclusion, or removal is entered the Secretary shall resume all powers and duties delegated to the Secretary under this Act. If the Secretary grants relief under sections 6 through 16 of this Act, the final order of deportation, exclusion, or removal shall be terminated.</text></subsection> 
<subsection id="H751DF7B1ED634D50B7CAAE3574A24056"><enum>(b)</enum><header>Stay of removal of certain aliens enrolled in primary or secondary school</header> 
<paragraph id="H068C1A04DB1D4A9FAFDE46D92FFE4845"><enum>(1)</enum><header>In general</header><text>The Attorney General shall stay the removal proceedings of any alien who—</text> 
<subparagraph id="H209730BE093A40A3A4785513BDDF1F03"><enum>(A)</enum><text>meets all the requirements of subparagraphs (A), (B), (C), and (E) of section 6(a)(1);</text></subparagraph> 
<subparagraph id="HDA982656C1D0487984492233E89B5E9B"><enum>(B)</enum><text>is at least 12 years of age; and</text></subparagraph> 
<subparagraph id="H82BC150E9F6E415ABD64923ABEDF8C59"><enum>(C)</enum><text>is enrolled full-time in a primary or secondary school.</text></subparagraph></paragraph> 
<paragraph id="HD772BC20C733488BAEA559BBE0CFCED3" commented="no"><enum>(2)</enum><header>Aliens not in removal proceedings</header><text>For aliens who are not in removal proceedings, the Secretary of Homeland Security shall not commence such proceedings with respect to the alien if the alien meets the requirements of subparagraphs (A) through (C) of paragraph (1).</text></paragraph></subsection> 
<subsection id="H1F9615E6C85E49BDA8D11A675588D7DC"><enum>(c)</enum><header>Employment</header><text>An alien whose removal is stayed pursuant to subsection (b)(1) may be engaged in employment in the United States consistent with the Fair Labor Standards Act (29 U.S.C. 201 et seq.) and State and local laws governing minimum age for employment.</text></subsection> 
<subsection id="H8D05E840F2864BC3B2658C146850C664"><enum>(d)</enum><header>Lift of stay</header><text>The Attorney General shall lift the stay granted pursuant to subsection (b)(1) if the alien—</text> 
<paragraph id="HD539B13FB0B1405FA89A3373534BA235"><enum>(1)</enum><text>is no longer enrolled in a primary or secondary school; or</text></paragraph> 
<paragraph id="H7223423F67514E0296DC9A735206946D"><enum>(2)</enum><text>ceases to meet the requirements of such subsection.</text></paragraph></subsection></section> 
<section id="H390CDEA2981A41F8ABD385FEA93D001B" display-inline="no-display-inline" section-type="subsequent-section"><enum>11.</enum><header>Penalties for false statements</header><text display-inline="no-display-inline">Whoever files an application for any benefit under sections 6 through 16 of this Act and willfully and knowingly falsifies, misrepresents, or conceals a material fact or makes any false or fraudulent statement or representation, or makes or uses any false writing or document knowing the same to contain any false or fraudulent statement or entry, shall be fined in accordance with title 18, United States Code, imprisoned not more than 5 years, or both.</text></section> 
<section id="H3874BC4BC95944E7AE933082661ED3AA"><enum>12.</enum><header>Confidentiality of information</header> 
<subsection id="HBFA57E1C73F74DCD889DBD21B49B1D4A"><enum>(a)</enum><header>Prohibition</header><text>Except as provided in subsection (b), no officer or employee of the United States may—</text> 
<paragraph id="HA0B70A85A1FB4B0197A9E1CD3583C5AA"><enum>(1)</enum><text>use the information furnished by an individual pursuant to an application filed under sections 6 through 16 of this Act to initiate removal proceedings against any person identified in the application;</text></paragraph> 
<paragraph id="H1CCAC9D5186844549C17C2CA1B807928"><enum>(2)</enum><text>make any publication whereby the information furnished by any particular individual pursuant to an application under sections 6 through 16 of this Act can be identified; or</text></paragraph> 
<paragraph id="HF26202FE53724847852A1CA4632C7E58"><enum>(3)</enum><text>permit anyone other than an officer or employee of the United States Government or, in the case of an application filed under sections 6 through 16 of this Act with a designated entity, that designated entity, to examine such application filed under such sections.</text></paragraph></subsection> 
<subsection id="H4E5D38988F3C4C96A413F34D0418EA44"><enum>(b)</enum><header>Required disclosure</header><text>The Attorney General or the Secretary of Homeland Security shall provide the information furnished under sections 6 through 16 of this Act, and any other information derived from such furnished information, to—</text> 
<paragraph id="H8A62CA7580084ABBBD775CBECA64EA18"><enum>(1)</enum><text>a Federal, State, tribal, or local law enforcement agency, intelligence agency, national security agency, component of the Department of Homeland Security, court, or grand jury in connection with a criminal investigation or prosecution, a background check conducted pursuant to the Brady Handgun Violence Protection Act (Public Law 103–159; 107 Stat. 1536) or an amendment made by that Act, or for homeland security or national security purposes, if such information is requested by such entity or consistent with an information sharing agreement or mechanism; or</text></paragraph> 
<paragraph id="H3A7BD18716734D8E8481BA02BB908B77"><enum>(2)</enum><text>an official coroner for purposes of affirmatively identifying a deceased individual (whether or not such individual is deceased as a result of a crime).</text></paragraph></subsection> 
<subsection id="H85B4C10FEE95451C90470377888A029D"><enum>(c)</enum><header>Fraud in application process or criminal conduct</header><text>Notwithstanding any other provision of this section, information concerning whether an alien seeking relief under sections 6 through 16 of this Act has engaged in fraud in an application for such relief or at any time committed a crime may be used or released for immigration enforcement, law enforcement, or national security purposes.</text></subsection> 
<subsection id="H85B5B90269AE4ED3AD4DE518A9E3F2D2"><enum>(d)</enum><header>Penalty</header><text>Whoever knowingly uses, publishes, or permits information to be examined in violation of this section shall be fined not more than $10,000.</text></subsection></section> 
<section id="H847123440FAE4F70832BA91CF6CA48A9" display-inline="no-display-inline" section-type="subsequent-section"><enum>13.</enum><header>Higher education assistance</header><text display-inline="no-display-inline">Notwithstanding any provision of the Higher Education Act of 1965 (20 U.S.C. 1001 et seq.), with respect to assistance provided under title IV of the Higher Education Act of 1965 (20 U.S.C. 1070 et seq.), an alien who is granted conditional nonimmigrant status or lawful permanent resident status under this Act shall be eligible only for the following assistance under such title:</text> 
<paragraph id="H67ECAB3E3CEA4B5C84E34683E25C7326"><enum>(1)</enum><text>Student loans under parts D and E of such title IV (20 U.S.C. 1087a et seq., 1087aa et seq.), subject to the requirements of such parts.</text></paragraph> 
<paragraph id="H8A89AF8B20DC468C8923B3ADDAC5DCDA"><enum>(2)</enum><text>Federal work-study programs under part C of such title IV (42 U.S.C. 2751 et seq.), subject to the requirements of such part.</text></paragraph> 
<paragraph id="H5D5FE01F9C474F40850F3AEF0F619C96"><enum>(3)</enum><text>Services under such title IV (20 U.S.C. 1070 et seq.), subject to the requirements for such services.</text></paragraph></section> 
<section id="H3CA41B34568B45AFA9E3F73BC9EDACCA" display-inline="no-display-inline" section-type="subsequent-section"><enum>14.</enum><header>Treatment of conditional nonimmigrants for certain purposes</header> 
<subsection id="H093AFB2605144EB0A77D99D3C115DF87"><enum>(a)</enum><header>In general</header><text>An individual granted conditional nonimmigrant status under this Act shall, while such individual remains in such status, be considered lawfully present for all purposes except—</text> 
<paragraph id="H9B574DEE6CFC4373AB93A0129B5AF3E7"><enum>(1)</enum><text>section 36B of the Internal Revenue Code of 1986 (concerning premium tax credits), as added by section 1401 of the Patient Protection and Affordable Care Act (Public Law 111–148); and</text></paragraph> 
<paragraph id="H054E0065544648E5A59FB07A92252832"><enum>(2)</enum><text>section 1402 of the Patient Protection and Affordable Care Act (concerning reduced cost sharing; 42 U.S.C. 18071).</text></paragraph></subsection> 
<subsection id="HF897E98F1BED4035A26B9B3ABC0D89D9"><enum>(b)</enum><header>For purposes of the 5-year eligibility waiting period under PRWORA</header><text>An individual who has met the requirements under this Act for adjustment from conditional nonimmigrant status to lawful permanent resident status shall be considered, as of the date of such adjustment, to have completed the 5-year period specified in section 403 of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (8 U.S.C. 1613).</text></subsection></section> 
<section id="H7893E2F6BD8149EFBD4A0E4EF5E72E96" display-inline="no-display-inline" section-type="subsequent-section"><enum>15.</enum><header>Military enlistment</header><text display-inline="no-display-inline">Section 504(b)(1) of title 10, United States Code, is amended by adding at the end the following new subparagraph:</text> 
<quoted-block display-inline="no-display-inline" id="HD159F13A44954709B181BCC8A152D7AC" style="OLC"> 
<subparagraph id="HA6815D832CFA48BEA7265DD0E5995AC6" indent="up1"><enum>(D)</enum><text>An alien who is a conditional nonimmigrant (as that term is defined in section 5 of the DREAM Act of 2010).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HB4882E44F5FE496CA55E72859A40EA44"><enum>16.</enum><header>GAO report</header><text display-inline="no-display-inline">Not later than 7 years after the date of the enactment of this Act, the Comptroller General of the United States shall submit to the Committee on the Judiciary of the Senate and the Committee on the Judiciary of the House of Representatives a report setting forth—</text> 
<paragraph id="HA2B071D858574D0DA3207684507A01EA"><enum>(1)</enum><text>the number of aliens who were eligible for cancellation of removal and grant of conditional nonimmigrant status under section 6(a);</text></paragraph> 
<paragraph id="HCD5D515FFC3E48F69ECB124BB67FB2DC"><enum>(2)</enum><text>the number of aliens who applied for cancellation of removal and grant of conditional nonimmigrant status under section 6(a);</text></paragraph> 
<paragraph id="HEBF13F7D27C049DD97C990C2BC5A820B"><enum>(3)</enum><text>the number of aliens who were granted conditional nonimmigrant status under section 6(a); and</text></paragraph> 
<paragraph id="H84195F41BE1D404AB64EABE543A9344F"><enum>(4)</enum><text>the number of aliens whose status was adjusted to that of an alien lawfully admitted for permanent residence under section 8.</text></paragraph></section>
