<official-title>To amend the Truth in Lending Act to permit deferrals on certain home mortgage foreclosures for a limited period to allow homeowners to take remedial action, to require home mortgage servicers to provide advance notice of any upcoming reset of the mortgage interest rate, and for other purposes.</official-title>

<section id="HFEBADA78703243598F0038C41CE31E9B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Home Retention and Economic Stabilization Act of 2009</short-title></quote>.</text> </section>
<section id="HA45C5BD8DA334A79B916AD3E1F07C61"><enum>2.</enum><header>Foreclosure deferment</header> 
<subsection id="H96F28A9ACAFC43A2991896E565D567BE"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Chapter 2 of the Truth in Lending Act (15 U.S.C. 1631 et seq.) is amended by inserting after section 128 the following new section:</text>

<section id="H2214EAB160A2453B956962660200789E"><enum>128A.</enum><header>Foreclosure deferment and reset notification for mortgages</header> 
<subsection id="HCDF97B70DE2A4ABEB02B88383B5200D7"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">For purposes of this section, the following definitions shall apply:</text> 
<paragraph id="H11B524A970294192B2907C86EB1476BA"><enum>(1)</enum><header>Deferment payment amount</header><text>The term <term>deferment payment amount</term> means the amount of the monthly payment that is due on an eligible deferred-foreclosure mortgage during the deferment period.</text> </paragraph>
<paragraph id="HBE734029F7D146FCB75C7178D226D96C"><enum>(2)</enum><header>Deferment period</header><text display-inline="yes-display-inline">The term <term>deferment period</term> means the period that—</text> 
<subparagraph id="H3F58AE130E8C4F2D89F178D8A4123991"><enum>(A)</enum><text display-inline="yes-display-inline">begins when the eligible consumer sends notice of the exercise of the deferral right under subsection (b)(1) with respect to an eligible deferred-foreclosure mortgage to the creditor or servicer; and</text> </subparagraph>
<subparagraph id="H279AF581A67348AF95BFA00401F8D0F8"><enum>(B)</enum><text>ends on the earliest of the following applicable dates:</text> 
<clause id="HBD852C98976D45F68D746CCB918D1C4C"><enum>(i)</enum><text>The date that is 270 days after the beginning of the period.</text> </clause>
<clause id="HEF1C5ACD0A5247158670503782390073"><enum>(ii)</enum><text display-inline="yes-display-inline">The end of the 30-day period beginning on any due date for any deferment payment (on such mortgage, in accordance with this section) which remains unpaid as of the end of such 30-day period.</text> </clause>
<clause id="H6BAFC2A11E84437690FC87239586602"><enum>(iii)</enum><text>The date on which the creditor or servicer enters into a qualified loan modification with the consumer.</text> </clause>
<clause id="HDA6DE0F574844AC4BFEAFC3CF0F9392B"><enum>(iv)</enum><text>The date on which the deferment is terminated by judicial order.</text> </clause></subparagraph></paragraph>
<paragraph id="H07CAB5CC59344870BADE8BFB76B3C3C6"><enum>(3)</enum><header>Deferment period trigger</header><text display-inline="yes-display-inline">The term <term>deferment period trigger</term> means the date on which the consumer becomes eligible for a deferment under subsection (b)(1) with respect to an eligible deferred-foreclosure mortgage and occurs on the earlier of—</text> 
<subparagraph commented="no" id="H1EA83DE20434432FA591D6DCF6081D62"><enum>(A)</enum><text>the date of any adjustment or reset of the interest rate on such mortgage;</text> </subparagraph>
<subparagraph id="id01170237224F4827817F0C52EE2C972A"><enum>(B)</enum><text display-inline="yes-display-inline">the date by which the consumer is 60 days delinquent on mortgage payments; or</text> </subparagraph>
<subparagraph commented="no" id="H8913FA4946924AFF88D2C4C22C6ED1C4"><enum>(C)</enum><text>the date of the first increase in the minimum monthly payment due under such mortgage after the origination of such mortgage.</text> </subparagraph></paragraph>
<paragraph id="H3BE73EAC8381496EBCAF060410A47D47"><enum>(4)</enum><header>Eligible deferred-foreclosure mortgage</header><text display-inline="yes-display-inline">The term <term>eligible deferred-foreclosure mortgage</term> means a consumer credit transaction that is secured by the principal dwelling of an eligible consumer that—</text> 
<subparagraph id="idA2109DA110274B6984CB7E7510E2F61B"><enum>(A)</enum><text display-inline="yes-display-inline">was entered into before the date of enactment of this section; and</text> </subparagraph>
<subparagraph id="idFEAF42D964F446F88344DF6AACD484AF"><enum>(B)</enum><text display-inline="yes-display-inline">has reached the deferment period trigger.</text> </subparagraph></paragraph>
<paragraph id="H4C6990CA260C463D9B5B9BD9DD1E6C14"><enum>(5)</enum><header>Eligible consumer</header><text>The term <term>eligible consumer</term> means a consumer who—</text> 
<subparagraph id="HBC1CA6C12DE24952A835002BC933E91F"><enum>(A)</enum><text display-inline="yes-display-inline">is a mortgagor or borrower on an eligible deferred-foreclosure mortgage;</text> </subparagraph>
<subparagraph id="H373EFC09619741028842A259ED00DB93"><enum>(B)</enum><text>has resided at the property secured by such mortgage since the mortgage transaction was entered into and intends to reside at such property at least until the end of the deferment period;</text> </subparagraph>
<subparagraph commented="no" id="H9E1B11438F684F23BD79C5C5FEC7B1AC"><enum>(C)</enum><text display-inline="yes-display-inline">has a current monthly income that, when multiplied by 12, is less than 200 percent of the area median annual income for the relevant family size in the State in which the residence is located; and</text> </subparagraph>
<subparagraph commented="no" id="HDE194E07CEFD4DD29984EB6BA9BF1425"><enum>(D)</enum><text display-inline="yes-display-inline">during the deferment period, responds to reasonable inquiries from a creditor or servicer with respect to an eligible deferred-foreclosure mortgage.</text> </subparagraph></paragraph>
<paragraph id="HAE3E55D3BC984EE2B0595344F5CCE8B"><enum>(6)</enum><header>Qualified loan modification</header> 
<subparagraph id="id45BA0883093842C0BF3B2940E6D6B42B"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>qualified loan modification</term> means a permanent, sustainable loan modification.</text> </subparagraph>
<subparagraph id="idD39A5BE36E234ADBBB07182077CF924C"><enum>(B)</enum><header>FDIC regulations</header><text display-inline="yes-display-inline">Not later than 60 days after the date of enactment of the <short-title>Home Retention and Economic Stabilization Act of 2009</short-title>, the Chairperson of the Federal Deposit Insurance Corporation shall promulgate rules establishing under what circumstances a loan modification will qualify as permanent and sustainable.</text> </subparagraph></paragraph></subsection>
<subsection id="H864921A67EAD4FEBB716EE48EF9EDA67"><enum>(b)</enum><header>Right to deferment of institution of or action on foreclosure</header> 
<paragraph id="HDC901F98D87E4D3AAA44C5D81D759480"><enum>(1)</enum><header>Right established</header><text>Any eligible deferred-foreclosure consumer shall have the right to defer any initiation of a foreclosure, whether judicial or nonjudicial, or any action in connection with a foreclosure already instituted, including any foreclosure sale, with respect to any eligible deferred-foreclosure mortgage by any creditor, servicer, or holder of such mortgage, or any other person acting on behalf of any such creditor, servicer, or holder, until the end of the deferment period.</text> </paragraph>
<paragraph id="HB9568AF4FDD94525B563A663AC65CEE7"><enum>(2)</enum><header>Enforcement of right</header><text display-inline="yes-display-inline">An eligible deferred-foreclosure consumer may defend against a foreclosure or bring an action in any court of competent or general jurisdiction to compel compliance with the right of the consumer under paragraph (1) to defer any initiation of a foreclosure or any action in connection with a foreclosure already instituted, including any foreclosure sale, with respect to any eligible deferred-foreclosure mortgage.</text> </paragraph></subsection>
<subsection id="HE3B4B841A8654945A606E4A0B2BB293C"><enum>(c)</enum><header>Notice to consumer before any foreclosure action</header> 
<paragraph id="HD381DBB3397C4CC68904772C34EA9BC1"><enum>(1)</enum><header>Notice of right required</header><text display-inline="yes-display-inline">Before initiating any foreclosure with respect to any eligible deferred-foreclosure mortgage, the creditor or servicer shall notify, by personal service, any eligible deferred-foreclosure consumer with respect to such mortgage of such consumer’s right under subsection (b) to defer the initiation of foreclosure.</text> </paragraph>
<paragraph id="HEE27D2694D674E039C1F1EE2C3FDCDF8"><enum>(2)</enum><header>Contents of notice</header><text display-inline="yes-display-inline">The Board shall prescribe, by regulations under sections 105 and 122, the content and format, including the size of the font, of the notices under paragraph (1) in a manner that maximizes the likelihood that the consumer will obtain and understand all the information necessary to exercise the right to defer any action to institute foreclosure, including—</text> 
<subparagraph id="HB57CFF4EF63444F092DCFF4D59C05B45"><enum>(A)</enum><text>the manner and format for obtaining such deferral, including a sample notice form, an identification form, and a certification form for the consumer to use in complying with subsection (d)(1);</text> </subparagraph>
<subparagraph id="HBE5F81207DB64E8DA9A464E5DA4E73EA"><enum>(B)</enum><text>contact information for the creditor or servicer, as the case may be and any third party involved in foreclosure proceedings, including State or local officials; and</text> </subparagraph>
<subparagraph id="H4801D1C46BC94A6DA94B34DB5EF8ED5D"><enum>(C)</enum><text>contact information for obtaining any counseling concerning the exercise of such deferral from a counselor approved by the appropriate State housing finance agency or the Secretary of Housing and Urban Development.</text> </subparagraph></paragraph>
<paragraph commented="no" id="HB1E45C4161CE4981AFF034B504EBFED2"><enum>(3)</enum><header>Timing</header><text display-inline="yes-display-inline">No foreclosure action or proceeding with respect to any eligible deferred-foreclosure mortgage shall be valid unless the creditor or servicer has provided the notice required under this subsection to the consumer at least 30 days before instituting any such action or proceeding and at least once during each subsequent 30-day period until the foreclosure becomes final.</text> </paragraph></subsection>
<subsection id="H4E4FC63F8365499F9F383BD6B9DDF152"><enum>(d)</enum><header>Institution of deferment</header> 
<paragraph id="HF030A99D4DC344B0A40025E684DBE052"><enum>(1)</enum><header>Procedure required</header><text>Any eligible deferred-foreclosure consumer who chooses to exercise a deferment right under subsection (b) shall provide—</text> 
<subparagraph id="H89CC08007CA14F5497FF565E13909266"><enum>(A)</enum><text>notice of the exercise of such to the servicer or other person described in the notice to the consumer under subsection (e) by any reasonable means including by mail, service whether directly or to any agent, including at the address of any registered agent;</text> </subparagraph>
<subparagraph id="HB8205A80869A48DEB6BFE71FF12E33D0"><enum>(B)</enum><text display-inline="yes-display-inline">a clear identification of the eligible deferred-foreclosure consumer and the address of the property securing the mortgage; and</text> </subparagraph>
<subparagraph id="HF3E02E0E4F0F4768AAD85F7D9FA5DBBE"><enum>(C)</enum><text display-inline="yes-display-inline">a certification that at least 1 consumer borrower with respect to such mortgage resides at the property secured by such mortgage and intends to reside at such property at least until the end of the deferment period.</text> </subparagraph></paragraph>
<paragraph id="HAF0755B5C925446F83BA2F93D8BC0F1"><enum>(2)</enum><header>Sufficiency of notice</header> 
<subparagraph id="HFA0ED50DA15C4024BF39FDABDCA59CB"><enum>(A)</enum><header>In general</header><text>Notice and delivery of an affidavit under paragraph (1) may be made by any reasonable means including by mail, service whether directly or to any agent, including at the address of any registered agent with the secretary of state for the State in which the property is located, or any attorney representing the consumer, or by such means as the terms of the mortgage or regulations prescribed by the Board may provide.</text> </subparagraph>
<subparagraph id="HBE5F9274C5184464B235DE511F64B5D4"><enum>(B)</enum><header>Other parties</header><text display-inline="yes-display-inline">If any court, any sheriff or other official designated under State law, or any other person authorized under State law and the contracts of the parties to maintain any foreclosure proceeding or conduct any foreclosure sale receives, directly or indirectly, a copy of any notice provided under this subsection by an eligible deferred-foreclosure consumer with respect to any eligible deferred-foreclosure mortgage, no foreclosure action may be taken by the court, sheriff, official, or other person with respect to such mortgage during the applicable deferred-foreclosure period.</text> </subparagraph></paragraph>
<paragraph id="HB681F38723D24C3AB214B8DEF95F96D2"><enum>(3)</enum><header>Acknowledgment</header> 
<subparagraph id="H4EF9B938068248D781D21E6F3869254C"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Any creditor, servicer, or holder of an eligible deferred-foreclosure mortgage, or any other person acting on behalf of any such creditor, servicer, or holder, who receives a notice from a consumer under paragraph (2) shall acknowledge to the consumer the receipt of the notice of the exercise of the deferment right under subsection (b) before the end of the 10-business day period beginning on the date of such receipt.</text> </subparagraph>
<subparagraph id="H5C2121584B2849A191BDC12C000048A3"><enum>(B)</enum><header>Contents of notice</header><text display-inline="yes-display-inline">The acknowledgment provided to any eligible deferred-foreclosure consumer under subparagraph (A) shall include the date on which the next payment is due on the eligible deferred-foreclosure mortgage, the deferment payment amount, the date on which each subsequent payment is due, and the address or the delivery method for each such payment that is acceptable to the recipient.</text> </subparagraph></paragraph>
<paragraph id="H8A27A670E2C34CD1B17E6247B9522CC5"><enum>(4)</enum><header>Monthly payment notices</header><text display-inline="yes-display-inline">Each periodic statement of account submitted by the creditor or servicer with respect to any eligible deferred-foreclosure mortgage during the period while any deferment right under subsection (b) is in effect shall include—</text> 
<subparagraph id="H6018859A12BA4357ABA2D72367E83FC"><enum>(A)</enum><text>the due date and the amount of the next payment due on such mortgage;</text> </subparagraph>
<subparagraph id="H84D1F89681444CB891D0B05FF941AE86"><enum>(B)</enum><text>the address or the delivery method for such payment;</text> </subparagraph>
<subparagraph id="H7929F149089941A29300C535A236B538"><enum>(C)</enum><text>the date on which the deferral of the foreclosure will terminate; and</text> </subparagraph>
<subparagraph id="HCDDE0D7C538C4C1DBF55B694D7005803"><enum>(D)</enum><text>a notice that failure to make such payment in a timely manner will jeopardize the continuation of the deferral of the foreclosure.</text> </subparagraph></paragraph></subsection>
<subsection id="H269E8374BF164E0F9399E339D727FEA0"><enum>(e)</enum><header>Deferment payment</header> 
<paragraph id="HF4EA8FE0FE034FEE99B8ECEA6CE0EC39"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">During the deferment period with respect to any eligible deferred-foreclosure mortgage for which any deferment right has been exercised under subsection (b), monthly payments shall continue to be made by the consumer with respect to such mortgage.</text> </paragraph>
<paragraph id="H99ECC45F32DA4759B8F57100003D0511"><enum>(2)</enum><header>Amount of payment</header><text display-inline="yes-display-inline">The deferment payment amount for purposes of monthly payments under paragraph (1) with respect to any eligible deferred-foreclosure mortgage shall be, as applicable, the lesser of—</text> 
<subparagraph id="H1492E20D4C324427B4FCF806BA930055"><enum>(A)</enum><text>the minimum monthly payment of principal and interest on the date on which the loan was originated;</text> </subparagraph>
<subparagraph commented="no" id="H5C2A77DC9E0F4FD7A99E9687A0896E18"><enum>(B)</enum><text display-inline="yes-display-inline">a monthly payment based on the outstanding loan principal plus a rate of interest calculated at a fixed annual percentage rate, in an amount equal to the most recent conventional mortgage rate plus a 100 basis point premium for risk, amortized over a period of 30 years minus the period of time since the origination of the loan; or</text> </subparagraph>
<subparagraph id="H14DC5D4991C84A5FA3CDC3BFB7489706"><enum>(C)</enum><text display-inline="yes-display-inline">the amount of the first minimum monthly payment due under the mortgage after the origination of such mortgage.</text> </subparagraph></paragraph>
<paragraph id="HCCE65BD441124CAE816EF65C2C2C9629"><enum>(3)</enum><header>Amortization of difference</header><text display-inline="yes-display-inline">The difference between the amount of any monthly payment due under the terms of any eligible deferred-foreclosure mortgage and the deferment payment amount shall be amortized over the life of the mortgage beginning after the deferred-foreclosure period in accordance with regulations which the Board shall prescribe.</text> </paragraph>
<paragraph id="HF816E200172E440E90B3257254393D09"><enum>(4)</enum><header>Charges prohibited</header><text display-inline="yes-display-inline">No creditor or servicer may impose any late fee or other fee or charge during the deferment period with respect to any eligible deferred-foreclosure mortgage for which any deferment right has been exercised under subsection (b) or in connection with the exercise of such deferment right.</text> </paragraph></subsection>
<subsection display-inline="no-display-inline" id="H2582F55090764618B36CD6D900BB2492"><enum>(f)</enum><header>Notice of reset and alternatives</header><text display-inline="yes-display-inline">During the 1-month period that ends 120 days before the date on which the interest rate in effect during the introductory period of an eligible deferred-foreclosure mortgage adjusts or resets to a variable interest rate, or the minimum monthly payment of principal and interest required first increases from the amount of the first such minimum monthly payment due under the mortgage after the origination of such mortgage, the creditor or servicer of such loan shall provide a written notice, separate and distinct from all other correspondence to the consumer, that includes the following:</text> 
<paragraph id="H3FE5693D428C453598CC69F08B1BD0F7"><enum>(1)</enum><text display-inline="yes-display-inline">Any index or formula used—</text> 
<subparagraph id="H98AF61776D2B4B00AB1085566327898D"><enum>(A)</enum><text display-inline="yes-display-inline">in determining the annual percentage rate applicable as of the effective date of a reset or adjustment; and</text> </subparagraph>
<subparagraph id="HA15A173527B8451F9B00300710275C6C"><enum>(B)</enum><text display-inline="yes-display-inline">in making any increases in the minimum monthly payments due, and a source of information about the index or formula.</text> </subparagraph></paragraph>
<paragraph id="H12F4C9D7A3EB47CBAD77F220151128DF"><enum>(2)</enum><text display-inline="yes-display-inline">A good faith estimate, based on accepted industry standards and disclosed in a clear and conspicuous manner, of the creditor or servicer of the amount of the monthly payment that will apply after the date of the adjustment or reset, or increase, as applicable, and the assumptions on which this estimate is based.</text> </paragraph>
<paragraph id="H4AA475C3B71B450FB43FDA3D8C6C6800"><enum>(3)</enum><text display-inline="yes-display-inline">A list of alternatives consumers may pursue before the date of adjustment or reset, or increase, as applicable, and descriptions of the actions consumers must take to pursue such alternatives, including—</text> 
<subparagraph id="H3C585CD7B21C4284B5C967780A35025"><enum>(A)</enum><text>refinancing;</text> </subparagraph>
<subparagraph id="H445A0E5268034AB88C17CBBEB90009AD"><enum>(B)</enum><text>renegotiation of loan terms;</text> </subparagraph>
<subparagraph id="HFFC2AFD8CB1E406D83F1E02731D09F89"><enum>(C)</enum><text>payment forbearance;</text> </subparagraph>
<subparagraph id="HBE8DDFB8309140AC89B6C557971D2F04"><enum>(D)</enum><text>pre-foreclosure sales;</text> </subparagraph>
<subparagraph id="H62E7BBCF7F5A4C8291AA0038206455B3"><enum>(E)</enum><text>any payment assistance available from the State in which the property is located; and</text> </subparagraph>
<subparagraph commented="no" id="ID83adc20bdfa443bfb296092fac1c73ee"><enum>(F)</enum><text>any refinancing, loan modification, or other assistance program available through the Federal Government that may apply to the loan.</text> </subparagraph></paragraph>
<paragraph id="H330C098F436F4EF4A5FE1EB26EC76600"><enum>(4)</enum><text display-inline="yes-display-inline">The names, addresses, telephone numbers, and Internet addresses of counseling agencies or programs reasonably available to the consumer that have been certified or approved and made publicly available by the Secretary of Housing and Urban Development or a State housing finance authority (as defined in section 1301 of the Financial Institutions Reform, Recovery, and Enforcement Act of 1989).</text> </paragraph>
<paragraph id="H852269EF3EDD4864A95E733DCA86B77E"><enum>(5)</enum><text display-inline="yes-display-inline">The address, telephone number, and Internet address for the State housing finance authority (as so defined) for the State in which the consumer resides.</text> </paragraph></subsection>
<subsection commented="no" id="H8A50E3F4EEE94334A1A71537C05B451B"><enum>(g)</enum><header>Most recent conventional mortgage rate</header><text>For purposes of subsection (f)(1)(A)(ii), the term <term>most recent conventional mortgage rate</term> means the contract interest rate on commitments for fixed-rate first mortgages most recently published in the Federal Reserve Statistical Release on selected interest rates (daily or weekly), and commonly referred to as the H.15 release (or any successor publication), in the week preceding a date of determination for purposes of applying this subsection.</text> </subsection>
<subsection id="H936893035807452E87260575ADCB0612"><enum>(h)</enum><header>Duty of consumer To maintain property</header> 
<paragraph id="HC0DCA4327C3A497B8FAD079E6259340"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Any eligible deferred-foreclosure consumer for whom a deferment of foreclosure is in effect under this section with respect to any eligible deferred-foreclosure mortgage may not, with respect to any property securing such mortgage, destroy, damage, or impair such property, allow the property to substantially deteriorate, or commit waste on the property.</text> </paragraph></subsection>
<subsection id="HAE250621F0F3492A912931BD2DBD4604"><enum>(i)</enum><header>Declaration of rights</header><text display-inline="yes-display-inline">In addition to the right of any party to a mortgage to seek a declaratory judgment under section 2201 of title 28, United States Code, any such party may apply prior to the end of the deferment period to any State court of competent or general jurisdiction for an order establishing the rights, duties, and conditions imposed on or applicable to any party to the mortgage, including the terms and conditions of a deferment.</text> </subsection>
<subsection id="H493DE87824364A839921C2DD61734768"><enum>(j)</enum><header>Coordination with State law</header> 
<paragraph id="H36DC8376633A42398580A5069620C9C8"><enum>(1)</enum><header>In general</header><text>No provision of this section shall be construed as annulling, altering, or affecting the laws of any State relating to deferment of foreclosures, except to the extent that those laws are inconsistent with the provisions of this section, and then only to the extent of the inconsistency.</text> </paragraph>

<subsection id="H130188BCB3FB4FC080FDA383D6367E27"><enum>(a)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated for fiscal year 2009, $200,000,000 for the Neighborhood Reinvestment Corporation, for carrying out foreclosure mitigation activities under the terms and conditions contained in the second paragraph under the heading <quote>Neighborhood Reinvestment Corporation—Payment to the Neighborhood Reinvestment Corporation</quote> in title III of division K of Public Law 110–161 (121 Stat. 2441), which may include use for costs of providing additional counselors, translators, and other staffers and costs of providing additional computers and improving databases and overall operations to better assist mortgagor families.</text> </subsection>
<subsection id="idBD0185905C374072970571517CD5070E"><enum>(b)</enum><header>Counseling services</header><text display-inline="yes-display-inline">Amounts made available under this Act may also be used by counseling intermediaries approved by the Department of Housing and Urban Development or the Neighborhood Reinvestment Corporation to assist homeowners who have legal issues directly related to the homeowner’s foreclosure, delinquency, or short sale, either by hiring attorneys directly or by contracting with legal aid agencies experienced in foreclosure work. Such attorneys or agencies shall be capable of assisting homeowners of owner-occupied homes with mortgages in default, in danger of default, or subject to or at risk of foreclosure and who have legal issues that cannot be handled by counselors already employed by such intermediaries.</text> </subsection></section>
