		<section id="HCEEB8023284D4D09ABA0DB06CD5B344D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Earmark Transparency Act of
			 2010</short-title></quote>.</text>
		</section><section id="H360CDCD820204EFDB7CD9685EB8C2A59" section-type="subsequent-section"><enum>2.</enum><header>Unified and searchable
			 database for congressionally directed spending items</header>
			<subsection id="HD9FFB43C697D4BD9A503E945B74638FF"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Title III of the
			 Congressional Budget Act of 1974 is amended by adding at the end the following
			 new section:</text>
				<quoted-block display-inline="no-display-inline" id="H56AEC601506940CA88F0A820CA9F337C" style="traditional">
					<section id="HCA0CA18CA0BD47B19734829EA31D1451"><enum>316.</enum><header>Unified and searchable database for congressionally directed
		  spending items</header><subsection commented="no" display-inline="yes-display-inline" id="HE8383DB633EF4A7BB424AFA3D9F112CB"><enum>(a)</enum><header>Establishment of
				database</header><text display-inline="yes-display-inline">Within six months
				after the date of enactment of this section, the Clerk of the House of
				Representatives and the Secretary of the Senate shall jointly establish a
				searchable website, available to the public at no cost, listing all requests by
				Members of Congress for congressionally directed spending items.</text>
						</subsection><subsection id="HB8E9115DAFE340558ECB0EC910AE2D1B"><enum>(b)</enum><header>Content</header><text>The
				website established under subsection (a) shall be comprised of a database
				including the following information for each congressionally directed spending
				item requested by a Member of Congress:</text>
							<paragraph id="HC27135FE345042DEA14F284D34DC6698"><enum>(1)</enum><text display-inline="yes-display-inline">The fiscal year in which the item would be
				funded.</text>
							</paragraph><paragraph id="H222F8C56609C43F490E8BB2FD8E60A3E"><enum>(2)</enum><text>The number of the
				bill or joint resolution for which the request is made, if available.</text>
							</paragraph><paragraph id="H54B2E7635DA04B49A11D2DEDB4C2898A"><enum>(3)</enum><text>The amount of the
				initial request made by the Member of Congress.</text>
							</paragraph><paragraph id="H0A4FCB095BDF4B2E9EDEBD457665F2D3"><enum>(4)</enum><text>The amount
				approved by the committee of jurisdiction.</text>
							</paragraph><paragraph id="H9F4F82BF2502420CA0B9DCCD46C41F88"><enum>(5)</enum><text>The amount carried
				in the bill or joint resolution (or accompanying report) as passed by the
				House, as passed by the Senate, and as transmitted to the President, as
				applicable.</text>
							</paragraph><paragraph id="H82A5F31DB4DC41E5B9A0398B5C39F573"><enum>(6)</enum><text>The name of the
				department or agency, and the account or program, through which the item will
				be funded.</text>
							</paragraph><paragraph id="H1D1DA8EF76AE4013BA1EA9C594D48497"><enum>(7)</enum><text>The name and the
				State or district of the Member of Congress who made the request.</text>
							</paragraph><paragraph id="H907CDD2EB0F9458F9E125FBE502B1DE3"><enum>(8)</enum><text>The name and
				address of the intended recipient.</text>
							</paragraph><paragraph id="HE32570F8F9AC47D69E2B0F60E67FC6BE"><enum>(9)</enum><text display-inline="yes-display-inline">The type of organization (public, private
				nonprofit, or private for profit entity) of the intended recipient.</text>
							</paragraph><paragraph id="H436E4D011ADF49EFB1D566E99F21BAEC"><enum>(10)</enum><text>The project name,
				description, and estimated completion date.</text>
							</paragraph><paragraph id="H8C60D3DFEAD442E898FCD674203F8DED"><enum>(11)</enum><text>A justification
				of the benefit to taxpayers.</text>
							</paragraph><paragraph id="HB4550F1A37C54FFABD610F917D98D57E"><enum>(12)</enum><text>Whether the
				request is for a continuing project and if so, when funds were first
				appropriated for such project.</text>
							</paragraph><paragraph id="HF6588BE6CFA5404D96D2F3A32A07A8FB"><enum>(13)</enum><text>A description, if
				applicable, of all non-Federal sources of funding.</text>
							</paragraph><paragraph id="H0ADE9ADDF93F457EBC39FE37F3188FF1"><enum>(14)</enum><text>Its current
				status in the legislative process, including whether it was carried in any bill
				or joint resolution (or accompanying report) passed by either House, added in a
				committee of conference between the Houses (or joint explanatory statement of
				managers) or in an amendment between the Houses, or included in a bill or joint
				resolution enacted into law, including any changes in the final dollar
				amount.</text>
							</paragraph></subsection><subsection id="HA0CD5B24990648BF83CB561E77BF46A7"><enum>(c)</enum><header>Accessibility of
				data</header><text display-inline="yes-display-inline">The website established
				under subsection (a) shall allow the public to—</text>
							<paragraph id="H9650E49E5E41412FA637C42672C13F5D"><enum>(1)</enum><text>search, sort, and
				download all information in the database in a machine-readable format;</text>
							</paragraph><paragraph id="H09934EADC30C4E46B198AB2B0B6F7625"><enum>(2)</enum><text>ascertain through
				a single search, by individual Member of Congress, the total number and dollar
				value of congressionally directed spending items requested by that Member and
				the total number and dollar value of such items contained in bills or joint
				resolutions as passed by either House or enacted into law by fiscal
				year;</text>
							</paragraph><paragraph id="HE613E70E1B514E369953E8E30B4D953B"><enum>(3)</enum><text>search and
				aggregate data based on any category set forth in subsection (b); and</text>
							</paragraph><paragraph id="H7BF784A192984CA5849FCB5E7629BD9E"><enum>(4)</enum><text>access the website
				from the home page of the website of the Clerk of the House of Representatives
				and of the Secretary of the Senate.</text>
							</paragraph></subsection><subsection id="H0C3443F45A404FD8B33ED90323023B01"><enum>(d)</enum><header>Timeliness of
				data</header><paragraph commented="no" display-inline="yes-display-inline" id="HD01CDB0A51C842EA992A5036A8C237D8"><enum>(1)</enum><text display-inline="yes-display-inline">Within 5 calendar days of receipt of a
				request for a congressionally directed spending item from a Member of Congress,
				each committee of the House of Representatives and of the Senate shall provide
				to the Clerk of the House of Representatives or the Secretary of the Senate, as
				applicable, the initial information regarding that request that is required
				under this section to be placed on the website established under subsection
				(a). That committee shall provide up-to-date information to the Clerk or
				Secretary, as applicable.</text>
							</paragraph><paragraph commented="no" id="HD913483884FA40C096D434696729BFB0" indent="up1"><enum>(2)</enum><text>The Clerk of the House of
				Representatives and the Secretary of the Senate shall post on the website
				established under subsection (a) the information received under paragraph (1)
				within 2 calendar days (excluding Saturdays, Sundays, or legal holidays except
				when the House or Senate is in session on such a day).</text>
							</paragraph></subsection><subsection id="H53C156644B1E4393A0684236198FD26B"><enum>(e)</enum><header>Point of
				order</header><paragraph commented="no" display-inline="yes-display-inline" id="HE32CC289C2B840F2BD53C07337A839F0"><enum>(1)</enum><text>It
				shall not be in order to consider any bill or joint resolution, or amendment
				thereto or conference report thereon unless it meets the requirements of this
				section.</text>
							</paragraph><paragraph id="H254885274B47455FBE52E43FA0DD1B22" indent="up1"><enum>(2)</enum><text>Subsections (c)(1) and (d)(2) of
				section 904 of the Congressional Budget Act of 1974 are each amended by
				inserting <quote>316, </quote> after <quote>313, </quote>.</text>
							</paragraph></subsection><subsection id="H71AE8ED09E7F450AAD83005BC59691D9"><enum>(f)</enum><header>Definitions</header><text display-inline="yes-display-inline">As used in this section—</text>
							<paragraph id="H965704F2C634431F808FA1460A08E25B"><enum>(1)</enum><text display-inline="yes-display-inline">the term <quote>congressionally directed
				spending item</quote> means a provision or report language included primarily
				at the request of a Member of Congress providing, authorizing, or recommending
				a specific amount of discretionary budget authority, credit authority, or other
				spending authority for a contract, loan, loan guarantee, grant, loan authority,
				or other expenditure with or to an entity, or targeted to a specific State,
				locality, or congressional district, other than through a statutory or
				administrative formula-driven or competitive award process; and</text>
							</paragraph><paragraph id="H56E26104FA274C0AB79B502BB64DDD23"><enum>(2)</enum><text>the term
				<quote>Member of Congress</quote> means a Senator in, a Representative in, or a
				Delegate or Resident Commissioner to, the
				Congress.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H48E8A08D234643389877EA36309BB5EA"><enum>(b)</enum><header>Conforming
			 amendment</header><text display-inline="yes-display-inline">The table of
			 contents set forth in section 1(b) of the Congressional Budget and Impoundment
			 Control Act of 1974 is amended by inserting after the item relating to section
			 315 the following new item:</text>
