		<section id="HD7E015AA4CB54DEB89D3DC9FC4654DD0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Safe Highway Markings Act of
			 2010</short-title></quote>.</text>
		</section><section id="H3B617BC7D4DD4C8E930455F652DF624C"><enum>2.</enum><header>Minimum standards
			 for engineered glass beads used in reflective markings</header>
			<subsection id="H7FEE6ABE193E4F7FB9453B3836920BD3"><enum>(a)</enum><header>Amendment</header><text display-inline="yes-display-inline">Chapter 3 of title 23, United States Code,
			 is amended by adding after section 329 the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="H9713685FCA824A8FBFB1FE51961141ED" style="USC">
					<section id="HD5AEC9E0BE2246308EEC2E2985A26A20"><enum>330.</enum><header>Minimum
				standards for engineered glass beads used in reflective markings</header>
						<subsection id="H2AD4E187BEA34B07A0CF91F5D7DC9C99"><enum>(a)</enum><header>Minimum
				standards</header>
							<paragraph id="H4ACD000596DE48A4A20BE77B140C3ED2"><enum>(1)</enum><header>In
				general</header><text>Subject to paragraph (2), a State that receives funds
				under this title shall ensure that any new application of reflective markings,
				on or along any road or highway, shall be made from a binder that has been
				mixed, in whole or in part, with engineered glass beads. Such beads may not
				contain more than 200 parts per million arsenic, as determined by the
				Environmental Protection Agency Method 6010C in conjunction with the
				Environmental Protection Agency Method 3052 modified.</text>
							</paragraph><paragraph id="H3F081EFDB1BC4376B0BAD378C56621D6"><enum>(2)</enum><header>Failure to
				comply</header><text display-inline="yes-display-inline">The Secretary of
				Transportation, acting through the Administrator of the Federal Highway
				Administration, shall withhold up to 5 percent of the amount required to be
				apportioned to a State under section 104(b) (1), (3), and (4) of title 23 on
				the first day of the fiscal year beginning after September 30, 2011, throughout
				which the State does not comply substantially with a requirement of this
				section.</text>
							</paragraph><paragraph id="H290D36800AD5497CB54989F364E0CD29"><enum>(3)</enum><header>Availability for
				apportionment</header><text display-inline="yes-display-inline">Amounts
				withheld under this section from apportionment to a State after September 30,
				2011, are not available for apportionment to the State.</text>
							</paragraph></subsection><subsection id="H35CB969FC7EB4A938B7C3C227FCAC4FC"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text>
							<paragraph id="HC4DFC04D3B574F3D9EB38A5F8DD08950"><enum>(1)</enum><header>Engineered glass
				beads</header><text display-inline="yes-display-inline">The term
				<quote>engineered glass beads</quote> means glass beads produced to meet
				retroreflectivity and durability performance based on the following
				properties:</text>
								<subparagraph id="H855E6E38CF9C43D1A74D8918DEF21D30"><enum>(A)</enum><text display-inline="yes-display-inline">Size distribution (bead size distribution
				ranges between 100 U.S. Mesh to 14 U.S. Mesh) exposes at least 35 percent of
				the diameter of the glass beads above the dry paint surface with remaining
				glass embedded into the paint.</text>
								</subparagraph><subparagraph id="HAFD4E2355A574D139FE324412DE40953"><enum>(B)</enum><text>Surface functional
				coating ensures that the inorganic composition of the glass bead surface is
				compatible with the organic composition of the paint formulation to achieve
				adequate bead-paint adhesion.</text>
								</subparagraph><subparagraph id="H16E877BA015242F9A8C0671C32BDF449"><enum>(C)</enum><text display-inline="yes-display-inline">Refractive index of the glass bead provides
				the required light refraction characteristics that will enable adequate
				retroreflectivity performance (refractive index in the 1.50 to 1.60 range)
				required for the application.</text>
								</subparagraph><subparagraph id="H81D06DC21FC6468A9F1BF7ECC418DFA3"><enum>(D)</enum><text display-inline="yes-display-inline">Mechanical properties of the glass bead
				allow adequate strength (compressive strength of at least 30,000 pounds per
				square inch) to withstand the conditions in the roadways.</text>
								</subparagraph><subparagraph id="H9916FA671EB14C35ABDA2C7642964118"><enum>(E)</enum><text display-inline="yes-display-inline">Chemical make of the glass beads
				(soda-lime-silica based chemistry) allows the use of environmentally acceptable
				recycled glass types, such as flat and container type glasses, as the main raw
				material in the manufacturing process.</text>
								</subparagraph></paragraph><paragraph id="H3A60193E7AB94825ADA88A9DD4947D81"><enum>(2)</enum><header>Reflective
				marking</header><text display-inline="yes-display-inline">The term
				<quote>reflective marking</quote> means a system composed of pigmented binders,
				including paint, thermoplastic, and epoxy, that is applied at a predefined
				thickness onto the pavement surface with glass beads mixed into or dropped onto
				the binder at a predefined surface coverage
				rate.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H15B4C8EFF2D242D182B14EDCE1DF4161"><enum>(b)</enum><header>Conforming
			 amendment</header><text>The analysis for chapter 3 of title 23 is amended by
			 adding after the item relating to section 329 the following:</text>

			</subsection></section><section id="H02ADAF0BABE945DCB0951A95760A9B5B"><enum>3.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">This Act and the
			 amendments made by this Act shall become effective 90 days after the date of
			 enactment of this Act.</text>
