		<official-title>To direct the Administrator of the Federal Emergency
		  Management Agency to establish a disaster recovery assistance program for
		  businesses, and for other purposes.</official-title>

		<section id="HE78558A0B7B74B52B2E74DB9419E0673" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Business Disaster Recovery Assistance Act of
			 2010</short-title></quote>.</text>
		</section><section id="H2D3C793DFFA1489180C86C02601A5156"><enum>2.</enum><header>Business disaster
			 recovery assistance program</header>
			<subsection id="H79FDD6203E834CF7819C50B7B04FABED"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 30 days after the date of
			 enactment of this Act, the Administrator of the Federal Emergency Management
			 Agency shall establish a program to assist covered entities affected by a major
			 disaster.</text>
			</subsection><subsection id="HF8891EA29A7E4546A1615EDD7A107DC9"><enum>(b)</enum><header>Grant
			 authority</header><text>In carrying out the program under subsection (a), the
			 Administrator is authorized to make a grant to a covered entity to assist the
			 following:</text>
				<paragraph id="H9C3241440ED54D4FA081FE3174B53A64"><enum>(1)</enum><text>The repair or
			 replacement of property owned by the entity and damaged as a direct result of a
			 major disaster, including real estate, inventory, supplies, machinery, and
			 equipment.</text>
				</paragraph><paragraph id="HCE7B9CE6AB7D41CA933CC49837872EE4"><enum>(2)</enum><text display-inline="yes-display-inline">The meeting of ordinary and necessary
			 financial obligations of the entity that, as a direct result of a major
			 disaster, might not otherwise be met.</text>
				</paragraph></subsection><subsection id="H338D54FEBCB647C19460304AF823BBEB"><enum>(c)</enum><header>Application
			 process</header><text>The Administrator shall establish a process for the
			 submission of applications for grants under subsection (b).</text>
			</subsection><subsection id="H65E06FDB2A094416B72B50250F5E48BA"><enum>(d)</enum><header>Grant
			 amount</header>
				<paragraph id="H06C7DCEAB4AE4914846535C2753C0DAF"><enum>(1)</enum><header>In
			 general</header><text>A grant made to a covered entity under subsection (b)
			 shall be in an amount not exceeding $28,000.</text>
				</paragraph><paragraph id="H20AE41A772E84A13A8AE85647E18D652"><enum>(2)</enum><header>Adjustment of
			 limit</header><text>The Administrator shall adjust annually the limit
			 established under paragraph (1) to reflect changes in the Consumer Price Index
			 for All Urban Consumers published by the Department of Labor.</text>
				</paragraph></subsection><subsection id="H43E24C6A164E4443A6CC041250A7581E"><enum>(e)</enum><header>Relationship to
			 other law</header><text>Nothing in this section may be construed to prohibit a
			 recipient of a grant under subsection (b) from receiving assistance under any
			 other Federal law.</text>
			</subsection><subsection id="HB0832E0B07464FE8B016EBCCD9DC977D"><enum>(f)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this Act, the following definitions
			 apply:</text>
				<paragraph id="H280841202E964C149584969C6510A8AB"><enum>(1)</enum><header>Covered
			 entity</header><text>The term <term>covered entity</term> means a business or
			 private nonprofit organization operating in an area with respect to which the
			 President declared, during the 60-day period preceding the date the entity
			 submitted an application under subsection (c), a major disaster under section
			 401 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (42
			 U.S.C. 5170).</text>
				</paragraph><paragraph id="H12A70124F133463C907458A463E568A0"><enum>(2)</enum><header>Major
			 disaster</header><text display-inline="yes-display-inline">The term <term>major
			 disaster</term> has the meaning given that term in section 102 of such Act (42
			 U.S.C. 5122).</text>
				</paragraph></subsection></section></legis-body>
