<section id="HD96564A0C176477D92B478A236F9E626" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Sex Crime Re-Entry EvaluatioN (SCREEN) Act of 2010</short-title></quote>.</text></section> 
<section id="HAF683B5F61C1412BA8C55EF76B72A371"><enum>2.</enum><header>Sentence of special confinement for the prevention of sexual predation authorized</header><text display-inline="no-display-inline">Section 3551(b) of title 18, United States Code, is amended as follows:</text> 
<paragraph id="HAD1F05DDC2004BF78E58663D6699EE7F" commented="no"><enum>(1)</enum><text>in paragraph (2) by striking <quote>or</quote>;</text></paragraph> 
<paragraph id="HE8BFE8C2DB6F499D839201039C64D742" commented="no"><enum>(2)</enum><text>in paragraph (3) by striking the period at the end and inserting <quote>; or</quote>;</text></paragraph> 
<paragraph id="H27BE9790AAE04D2B8FF1755FF7928B2F" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">inserting after paragraph (3) the following:</text>

<paragraph id="HF463F2114AFF47B7AF88827694FEB0B8" commented="no"><enum>(4)</enum><text display-inline="yes-display-inline">in the case of certain offenses, a term of special confinement for the prevention of sexual predation as authorized by subchapter E.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H2835D5E721D046B9820BB725170356E8"><enum>(4)</enum><text>adding after <quote>in addition to any other sentence.</quote> the following: <quote>A sentence to a term of special confinement for the prevention of sexual predation may be imposed in addition to a sentence to a term of imprisonment.</quote>.</text></paragraph></section>

<section id="H27583796E113475DBD8E0BAEBEA68CFA"><enum>3587a.</enum><header>Sentence of special confinement for the prevention of sexual predation</header> 
<subsection id="H1E67B22F4F244B6BB1CED91F1D919B96"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The court may sentence to a term of special confinement for the prevention of sexual predation a defendant who—</text> 
<paragraph id="HDD9C847BF35C44B3B973E6C6D466DCFB"><enum>(1)</enum><text>has been found guilty of a qualifying offense; and</text></paragraph> 
<paragraph id="HEC8CF4FA2D534D94B318DD5DD0ADF6AD"><enum>(2)</enum><text>has been sentenced to a term of imprisonment for that qualifying offense.</text></paragraph> </subsection> 
<subsection id="HD3FE3489E059461F9612CE2B6691D72B"><enum>(b)</enum><header>Qualifying Offenses</header><text display-inline="yes-display-inline">For purposes of this section, a qualifying offense is any of the following:</text> 
<paragraph id="HE50BA4B29641464AB9E451B7C2305B82"><enum>(1)</enum><text>An offense under section 2241.</text></paragraph> 
<paragraph id="H652E96DD04B24CFE9785F812846F724A"><enum>(2)</enum><text>An offense under section 2242.</text></paragraph> 
<paragraph id="HA270FBE572A44D5A9E917384ACA3AA1E"><enum>(3)</enum><text>An offense under section 2245.</text></paragraph> 
<paragraph id="H31A0515623C04DF2AF3C8BC1079E143A"><enum>(4)</enum><text>An offense under section 2251(e).</text></paragraph></subsection> 
<subsection id="HD875BDC1048447388D1DE715B2F0A25E"><enum>(c)</enum><header>Authorized terms</header><text display-inline="yes-display-inline">The authorized term of special confinement for the prevention of sexual predation is for the duration of the defendant’s life.</text></subsection></section> 
<section id="HF7CFF3A8815A43D6A1CE62DAFA4D61B7" commented="no"><enum>3587b.</enum><header>Effect of finality of judgment</header><text display-inline="no-display-inline">Notwithstanding the fact that a sentence to a term of special confinement for the prevention of sexual predation can subsequently be—</text> 
<paragraph id="HEDB69C3ABCF344FBA6CB3773B05934AB" commented="no"><enum>(1)</enum><text>corrected under rule 35 of the Federal Rules of Criminal Procedure and section 3742; or</text></paragraph> 
<paragraph id="HE11661C8582A45C48D7AC827C80F8F01" commented="no"><enum>(2)</enum><text>appealed and modified under section 3742;</text></paragraph><continuation-text continuation-text-level="subsection" commented="no"> a judgment of conviction that includes such a sentence constitutes a final judgment for all other purposes.</continuation-text></section> 
<section id="H734AC4208DA546A88C5E161223182E18"><enum>3587c.</enum><header>Right to hearing</header><text display-inline="no-display-inline">The defendant shall have the right to a hearing to determine whether the defendant is a sexually dangerous person. That hearing shall be conducted not earlier than 180 days before the scheduled release of the defendant from the custody of the Bureau of Prisons after the term of imprisonment.</text></section> 
<section id="HE7939A8BA58A4331A6B350384C77B576"><enum>3587d.</enum><header>Hearings to determine status as a sexually dangerous person</header> 
<subsection id="H754CC727454D43159537EC71BC0D1953"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Any hearing to determine whether a person sentenced to a term of special confinement for the prevention of sexual predation is a sexually dangerous person for purposes of this subchapter or subchapter D of chapter 229 shall be conducted as provided under this section.</text></subsection> 
<subsection id="H563615B68EA04D48AEA116A8A6A99C4C"><enum>(b)</enum><header>Disposition</header><text display-inline="yes-display-inline">If the person establishes by clear and convincing evidence that the person is not a sexually dangerous person, the court shall set aside or terminate a sentence to a term of special confinement for the prevention of sexual predation and order the release of the person as soon as possible after the date that the person is released from the custody of the Bureau of Prisones after a term of imprisonment.</text></subsection> 
<subsection id="H2F9C2F1A420248BB920BEAF7BB85F90A"><enum>(c)</enum><header>Examination and report</header><text>In conducting a hearing under this section, the court shall order an examination of the defendant by a licensed psychologist or psychiatrist to determine whether the person is a sexually dangerous person and a report on the results of that examination. </text></subsection> 
<subsection id="HCF595D062E43499BB3B28CA235D07CDF"><enum>(d)</enum><header>Rights of person</header> 
<paragraph id="H971297FC6FE64AC3B60A5BD26556D3B5"><enum>(1)</enum><text>Except as provided in paragraph (2), a hearing under this section shall be conducted in same manner as a hearing under section 4247(d).</text></paragraph> 
<paragraph id="H1EAFAE945149430FB55A4F8403BB28B1"><enum>(2)</enum><text>The person shall have the right to have the issue of whether that person is a sexually dangerous person determined by a jury impanelled pursuant to chapter 121 of title 28, United States Code.</text> </paragraph></subsection> 
<subsection id="H543B8CECF32444D08D6151D3ED8142C7" commented="no"><enum>(e)</enum><header>Role of the Government</header><text>In a hearing under this section, the attorney for the Government may present evidence, subpoena witnesses, and confront and cross-examine witnesses.</text></subsection></section> 
<section id="H41C07724D196419C8D92D12E55D4B379" commented="no"><enum>3587e.</enum><header>Commencement of sentence</header><text display-inline="no-display-inline">A sentence to a term of special confinement for the prevention of sexual predation commences on the date that the defendant is released from the custody of the Bureau of Prisons after a term of imprisonment.</text></section> 
<section id="H5FA3D34641BC4664BA40B9AA9A2667A8"><enum>3587f.</enum><header>Definitions</header> 
<subsection id="H4EB218D5F67247FF876603D8734B2ECE" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Except as otherwise provided in this subchapter, terms used in this subchapter have the meanings given such terms in section 4247.</text></subsection> 
<subsection id="HD4A4D510DBED422BA0660D79D029E02E"><enum>(b)</enum><header>Sexually dangerous person</header><text display-inline="yes-display-inline">For purposes of this subchapter, the term <term>sexually dangerous person</term> means an individual who has been convicted of a sexual offense that includes violent conduct as an element of the offense, and who suffers from a mental, behavioral, or emotional disorder affecting the emotional or volitional capacity which predisposes that individual toward engaging in violent sexual acts to a degree constituting such individual a menace to the health and safety of others.</text></subsection></section> 
<section id="H060A36BA3DED443FA2BA3C35F2F1B44F"><enum>3587g.</enum><header>Implementation of a sentence of special confinement for the prevention of sexual predation</header><text display-inline="no-display-inline">The implementation of a sentence of special confinement for the prevention of sexual predation is governed by the provisions of subchapter D of chapter 229.</text></section></subchapter><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HC1367C9840D148C188C6F53E72BBB23C"><enum>4.</enum><header>Postsentence Administration</header><text display-inline="no-display-inline">Chapter 229 of title 18, United States Code, is amended by adding at the end the following:</text>

<section id="HAB0C19C8D32248A2827D548B32542427"><enum>3631.</enum><header>Special confinement for the prevention of sexual predation</header> 
<subsection id="H8ADED8A6CEE64CDC8D3F07A17D4A457C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">A person who has been sentenced to a term of special confinement for the prevention of sexual predation pursuant to the provisions of subchapter E of chapter 227 shall be treated as provided under subsection (b). The person shall be committed to the custody of the Attorney General until—</text> 
<paragraph id="HC7805A7BD7414B05BBF9FE837BE170DE"><enum>(1)</enum><text>the expiration of the term imposed;</text></paragraph> 
<paragraph id="H91C93B4F517D4366A4A2DC15FE7D456A"><enum>(2)</enum><text>the earlier release of the person pursuant to a hearing under section 3587d; or</text></paragraph> 
<paragraph id="H136774EA735F4D16B4208CD1BCD9155E"><enum>(3)</enum><text>the transfer of that person to the custody of a State pursuant to subsection (c).</text></paragraph></subsection> 
<subsection id="HAE1FAEF9B7CF4809BF6ECEBD0974A5D2"><enum>(b)</enum><header>Placement in a suitable facility</header><text display-inline="yes-display-inline">If no State assumes custody and responsibility of the defendant under subsection (c), the Attorney General shall place the defendant in a suitable facility for treatment.</text> </subsection> 
<subsection id="H87644C32F42644DB96155F032E5F2F9B"><enum>(c)</enum><header>State Custody</header><text>If the State in which the person was domiciled or tried will assume custody of the person and responsibility for carrying out the sentence of special confinement for the prevention of sexual predation in a manner consistent with the conditions described in section 3632, the Attorney General shall commit the defendant to the custody of that State. The Attorney General shall make every reasonable effort to cause that State to assume such custody and responsibility. </text></subsection></section> 
<section id="H783B918328744C0780DA5EC586D05B63"><enum>3632.</enum><header>Annual hearings</header> 
<subsection id="H38D27553ED374B7D8CC4D82E1A101E7D"><enum>(a)</enum><header>Commenced by confined person</header><text>The confined person has the right to not more than one hearing under section 3587d to determine whether the confined person is a sexually dangerous person for each year that person is confined.</text></subsection> 
<subsection id="H2B3381A603524B52B331071355B6A3C5"><enum>(b)</enum><header>Commenced by supervisor certification</header><text>Not more than once each year, the supervisor of the facility in which the confined person is confined may commence a hearing under section 3587d to determine whether the confined person is a sexually dangerous person by filing with the court a certificate stating that the supervisor believes that person is not a sexually dangerous person.</text></subsection></section> 
<section id="HA2F2439C08894CCFA97FE3C287F92C84"><enum>3633.</enum><header>Definitions</header><text display-inline="no-display-inline">Terms used in this subchapter have the same meanings as terms under subchapter E of chapter 227.</text> </section></subchapter><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H85A2A9303CEF4FBCB8706717E9F7E990"><enum>5.</enum><header>Sentence of special confinement for the prevention of sexual predation imposed for certain offenses</header> 
<subsection id="HE29CF14F586846ACA9025BFABF88BDB6"><enum>(a)</enum><header>Aggravated sexual abuse</header><text>Section 2241 of title 18, United States Code, is amended by adding at the end the following:</text>

<subsection id="HB6EBDD1ABF0A4D26940FA49906647AB3"><enum>(e)</enum><header>Additional punishment</header><text display-inline="yes-display-inline">Whoever commits an offense under this section and is sentenced to a term of imprisonment shall, in addition, be punished by special confinement for the prevention of sexual predation for life.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H304D9D5F1DAE47E09CF775BEED06D749"><enum>(b)</enum><header>Sexual abuse</header><text>Section 2242 of title 18, United States Code, is amended by adding at the end the following: <quote>Whoever commits an offense under this section and is sentenced to a term of imprisonment shall, in addition, be punished by special confinement for the prevention of sexual predation for life.</quote>. </text></subsection> 
<subsection id="HED5ABD05ABBD4AD692EE0CA1BD91CF8E"><enum>(c)</enum><header>Offenses resulting in death</header><text display-inline="yes-display-inline">Section 2245(a) of title 18, United States Code, is amended by adding at the end the following: <quote>Whoever commits an offense under this section and is sentenced to a term of imprisonment shall, in addition, be punished by special confinement for the prevention of sexual predation for life.</quote>.</text></subsection> 
<subsection id="H1532A0B1E9D943CEB98C8C1C7092F695"><enum>(d)</enum><header>Sexual exploitation of children</header><text display-inline="yes-display-inline">Section 2251(e) of title 18, United States Code, is amended by adding at the end the following: <quote>Whoever commits an offense under this section and is sentenced to a term of imprisonment shall, in addition, be punished by special confinement for the prevention of sexual predation for life.</quote>.</text></subsection></section>
