		  incentives to registered owners of high fuel consumption automobiles to replace
		  such automobiles with fuel efficient automobiles or public transportation, and

		<section id="H269A6F45912144F9A882CFD19EEC97" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Accelerated Retirement of Inefficient
			 Vehicles Act of 2009</short-title></quote>.</text>
		</section><section id="H1FF11029533B4DD9A45BBD25A3239800"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="HF96530CC64FD4D3C9CDFCEA75C2DFCD"><enum>(1)</enum><header>Automobile;
			 manufacturer; model; model year</header><text>The terms
			 <term>automobile</term>, <term>manufacturer</term>, <term>model</term>, and
			 <term>model year</term> have the meanings given such terms in section 32901(a)
			 of title 49, United States Code.</text>
			</paragraph><paragraph id="H62785E0002644EDBA897046C31DF00AE"><enum>(2)</enum><header>Certificate of
			 title</header><text>The term <term>certificate of title</term> means a
			 State-issued document showing ownership of an automobile.</text>
			</paragraph><paragraph id="HD76919AFFBFA436FBB3740DF00E46C2"><enum>(3)</enum><header>Dealer</header><text>The
			 term <term>dealer</term> means a person residing in a State that engages in the
			 sale, lease, or distribution of new automobiles to the first person (except a
			 dealer buying as a dealer) that is an ultimate purchaser.</text>
			</paragraph><paragraph id="HB36E48A68FFD421CB7EA00D9C750C581"><enum>(4)</enum><header>Dismantler</header><text>The
			 term <term>dismantler</term> means a person residing in a State who is licensed
			 to operate a business employing 3 or more persons to take automobiles apart for
			 the purpose of reclaiming usable parts and recyclable materials.</text>
			</paragraph><paragraph id="HCF61B9D9A5A04ED9A74855CCA928E75C"><enum>(5)</enum><header>Eligible fleet
			 operator</header><text>The term <term>eligible fleet operator</term>
			 means—</text>
				<subparagraph id="HA3ABAE61ACE946A50006DCE58F8F12C0"><enum>(A)</enum><text>the operator of a
			 fleet of automobiles that is owned by a State, Indian tribe, or local
			 government; or</text>
				</subparagraph><subparagraph id="H06151691A7D043AB00DB139EF7C3CC37"><enum>(B)</enum><text>the owner of 2 or
			 more automobiles authorized to carry passengers for hire under State, tribal,
			 or local regulations governing the operation of taxi cabs.</text>
				</subparagraph></paragraph><paragraph id="H51E60B46C2404BACBCE725EC072900C0"><enum>(6)</enum><header>Eligible high
			 fuel consumption automobile</header><text>The term <term>eligible high fuel
			 consumption automobile</term> means a high fuel consumption automobile that, at
			 the time it is presented for participation in the program established under
			 section 3—</text>
				<subparagraph id="HDFA3FBAD58654767823495005E07A85D"><enum>(A)</enum><text>is in drivable
			 condition; and</text>
				</subparagraph><subparagraph id="H51A4100A4E4748A69063FCCBAAC05EEE"><enum>(B)</enum><text>has been
			 continuously registered and licensed to operate in any State for a period of
			 not fewer than 120 consecutive days for operation on public roads.</text>
				</subparagraph></paragraph><paragraph id="H7DD16271FE3B4E2D977000B024E73D42"><enum>(7)</enum><header>Fuel efficient
			 automobile</header><text>The term <term>fuel efficient automobile</term> means
			 an automobile manufactured for any model year after 2003 that, at the time of
			 the original sale to a consumer—</text>
				<subparagraph id="H15E4FAE1D98D4EBDA81200168982EBE1"><enum>(A)</enum><text>carries a
			 manufacturer’s suggested retail price of $45,000 or less;</text>
				</subparagraph><subparagraph id="H8A622A2E451545EC912D48026F16D2A9"><enum>(B)</enum><text>complies with the
			 applicable air emission and related requirements under the National Emission
			 Standards Act (42 U.S.C. 7521 et seq.);</text>
				</subparagraph><subparagraph id="H93141947CDE144C48F893DE0324B264B"><enum>(C)</enum><text>qualifies for
			 listing in emission bin 1, 2, 3, 4, or 5 (as defined in section 86.1803–01 of
			 title 40, Code of Federal Regulations); and</text>
				</subparagraph><subparagraph id="HF7971A252C6649B49C246BB8C84F4764"><enum>(D)</enum><clause commented="no" display-inline="yes-display-inline" id="HFA170E7AFE464951AEB0A206D600D1D5"><enum>(i)</enum><text>for automobiles
			 manufactured in any of the model years 2004 through 2010, achieves a measured
			 fuel economy level that exceeds by 25 percent the fuel economy standard
			 prescribed by the Secretary of Transportation under section 32902 of title 49,
			 United States Code, for the model year and compliance category of such
			 automobile; or</text>
					</clause><clause id="H36BA5480B9A14DF88D0072DFE05D9930" indent="up1"><enum>(ii)</enum><text>for automobiles manufactured for
			 any model year after 2010, achieves a measured fuel economy level that exceeds
			 by 25 percent the fuel economy target prescribed by the Secretary of
			 Transportation under such section 32902 for the model year and automobile
			 attribute group into which such automobile is classified.</text>
					</clause></subparagraph></paragraph><paragraph id="H1CA984BB6B48433CB4FDE510829086D1"><enum>(8)</enum><header>High fuel
			 consumption automobile</header><text>The term <term>high fuel consumption
			 automobile</term> means an automobile manufactured for any model year before
			 2008 for which the originally certified measured fuel economy level is less
			 than 18 miles per gallon.</text>
			</paragraph><paragraph id="HA82B7DFA1566462E992BC95687E32DE4"><enum>(9)</enum><header>Measured fuel
			 economy level</header><text>The term <term>measured fuel economy level</term>
			 means the fuel economy level of a new automobile model measured in accordance
			 with section 32904 of title 49, United States Code, and regulations prescribed
			 thereunder.</text>
			</paragraph><paragraph id="HA2690B80A45C404599DF52D53DB6C6E5"><enum>(10)</enum><header>New
			 automobile</header><text>The term <term>new automobile</term> means an
			 automobile for which a manufacturer, distributor, or dealer has never
			 transferred the equitable or legal title to such automobile to an ultimate
			 purchaser.</text>
			</paragraph><paragraph id="HEE6781BF0ADF496FA59E0084FAE3C1BB"><enum>(11)</enum><header>Nonpassenger
			 automobile</header><text>The term <term>nonpassenger automobile</term> means an
			 automobile classified as a light truck under part 523 of title 49, Code of
			 Federal Regulations.</text>
			</paragraph><paragraph id="HDDF15B7C6CC74E22BD23A81D00285900"><enum>(12)</enum><header>Person</header><text>The
			 term <term>person</term> has the meaning given such term in section 551 of
			 title 5, United States Code.</text>
			</paragraph><paragraph id="H6511A161441E4D9AB429004D11160203"><enum>(13)</enum><header>Program</header><text>The
			 term <term>Program</term> means the Accelerated Retirement of Inefficient
			 Vehicles Program established under section 3.</text>
			</paragraph><paragraph id="H21D75155F0624E02B22DBA38EFBFBCA2"><enum>(14)</enum><header>Registered
			 owner</header><text>The term <term>registered owner</term> means, with respect
			 to an automobile, the person whose name appears on the current State
			 certificate of registration for such automobile.</text>
			</paragraph><paragraph id="H5B843A449C6542AFBAFA10A48C00B77"><enum>(15)</enum><header>Scrap recycling
			 facility</header><text>The term <term>scrap recycling facility</term> means a
			 business—</text>
				<subparagraph id="H6BACAFF579E5496C873C00DE847FDAD5"><enum>(A)</enum><text>employing 3 or
			 more individuals at a fixed location in a State, where machinery and equipment
			 are utilized for processing and manufacturing scrap metal into prepared grades;
			 and</text>
				</subparagraph><subparagraph id="H3C86E3F3597B4DC284A7E9A54F65CEEB"><enum>(B)</enum><text>whose principal
			 product is scrap iron, scrap steel, or nonferrous metallic scrap for sale for
			 remelting purposes.</text>
				</subparagraph></paragraph><paragraph id="H6648634946FF44D89C9FB070BB9B93B8"><enum>(16)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of Energy.</text>
			</paragraph><paragraph id="H99D579A7230C4B0B8F5CA1CBFDD5DC5B"><enum>(17)</enum><header>State</header><text>The
			 term <term>State</term> has the meaning given such term in section 32101 of
			 title 49, United States Code.</text>
			</paragraph><paragraph id="H3E9791BE26054B8700A65084E35BB83E"><enum>(18)</enum><header>Ultimate
			 purchaser</header><text>The term <term>ultimate purchaser</term> means, with
			 respect to any new automobile, the first person who in good faith purchases
			 such automobile for purposes other than resale.</text>
			</paragraph><paragraph id="H4E1CB2AD1DBA462AA247AD8B30353262"><enum>(19)</enum><header>Voucher</header><text>The
			 term <term>voucher</term> means a voucher issued to the registered owner of an
			 eligible high fuel consumption automobile under section 3(a).</text>
			</paragraph></section><section id="H6590E74B3D89475185569FE9CD19E43"><enum>3.</enum><header>Accelerated
			 retirement of inefficient vehicles program</header>
			<subsection id="H82E66985DB0F4064BC7E5822EE36800"><enum>(a)</enum><header>Establishment</header><text>There
			 is established in the Department of Energy a program to be known as the
			 <quote>Accelerated Retirement of Inefficient Vehicles Program</quote>, through
			 which the Secretary shall—</text>
				<paragraph id="H93CB094A4886411CA1E86FD9CDEC16F0"><enum>(1)</enum><text>authorize the
			 issuance of a voucher, subject to the limitations described in subsection
			 (e)(1), to any person or eligible fleet operator who is a registered owner of
			 an eligible high fuel consumption automobile, which voucher may be used solely
			 by such person or eligible fleet operator for the purchase of a new or used
			 fuel efficient automobile upon the transfer of the certificate of title to such
			 high fuel consumption automobile to a dealer, dismantler, or scrap recycling
			 facility participating in the Program;</text>
				</paragraph><paragraph id="HF61DC80117DB4926BC6E370093D3ABF0"><enum>(2)</enum><text>allow any dealer,
			 dismantler, or scrap recycling facility to participate in the Program if the
			 dealer, dismantler, or scrap recycling facility agrees to—</text>
					<subparagraph id="H8F0B7BB5B6274B82984EEF409ED592DF"><enum>(A)</enum><text>scrap any eligible
			 high fuel consumption automobile upon receiving the certificate of title to
			 such automobile pursuant to the Program;</text>
					</subparagraph><subparagraph id="H98BAC482A9044222B7E119FEEABDF797"><enum>(B)</enum><text>issue a voucher to
			 the registered owner of such automobile;</text>
					</subparagraph><subparagraph id="H6877C106FAC241CA99597BF8BF4062A7"><enum>(C)</enum><text>certify to the
			 Secretary that such automobile has been crushed or shredded in accordance with
			 subsection (e)(4); and</text>
					</subparagraph><subparagraph id="HB82E41D0D15E493D8C99799D3B0200AD"><enum>(D)</enum><text>comply with all
			 applicable requirements under this Act and any regulations promulgated by the
			 Secretary to carry out this Act;</text>
					</subparagraph></paragraph><paragraph id="HBA5AB220A810490EB0117099D83BB758"><enum>(3)</enum><text>require that all
			 dealers accept vouchers presented by a person or eligible fleet operator
			 described in paragraph (1) as partial payment for the purchase of a new or used
			 fuel efficient automobile; and</text>
				</paragraph><paragraph id="H397ACBF73E9A43DAB3D83198525D5B8B"><enum>(4)</enum><text>make payments to
			 dealers for vouchers accepted by such dealers under paragraph (3) between
			 January 1, 2009 and December 31, 2014, in accordance with the provisions of
			 this section.</text>
				</paragraph></subsection><subsection id="H2274D954F7D0484284EC38915726B026"><enum>(b)</enum><header>Amount of
			 Voucher</header>
				<paragraph id="HEF2A1ADF1CD84EB699447E1FFC006ECF"><enum>(1)</enum><header>Voucher
			 redemption value if used toward purchase of new a fuel efficient
			 automobile</header><text>A voucher issued under the Program during the 4-year
			 period beginning on January 1, 2009, may be applied to offset the purchase
			 price of a new fuel efficient automobile by—</text>
					<subparagraph id="H8A933479008C432A86F454CA5C3A4C"><enum>(A)</enum><text>$4,500 if the
			 eligible high fuel consumption automobile was manufactured for a model year
			 that is 7 or fewer years less than the calendar year in which the voucher was
			 issued;</text>
					</subparagraph><subparagraph id="HD496D53BB306473A867063311E9590DC"><enum>(B)</enum><text>$3,000 if the
			 eligible high fuel consumption automobile was manufactured for a model year
			 that is 8 to 10 years less than the calendar year in which the voucher was
			 issued; and</text>
					</subparagraph><subparagraph id="H71FF1C9449C5484CB2095F4356393800"><enum>(C)</enum><text>$2,500 if the
			 eligible high fuel consumption automobile was manufactured for a model year
			 that is 11 or more years less than the calendar year in which the voucher was
			 issued.</text>
					</subparagraph></paragraph><paragraph id="H8C126822A8C541D8BF40B17ED8333F11"><enum>(2)</enum><header>Voucher
			 redemption value if used toward purchase of a used fuel efficient
			 automobile</header><text>A voucher issued under the Program during the 4-year
			 period beginning on January 1, 2009, may be applied to offset the purchase
			 price of a used fuel efficient automobile by—</text>
					<subparagraph id="HCD59DD584FCD4BE891A55DEEAAB591E"><enum>(A)</enum><text>$3,000 if the
			 eligible high fuel consumption automobile was manufactured for a model year
			 that is 7 or fewer years less than the calendar year in which the voucher was
			 issued;</text>
					</subparagraph><subparagraph id="H2579C1CF85174B36887C73A534BE3DA"><enum>(B)</enum><text>$2,000 if the
			 eligible high fuel consumption automobile was manufactured for a model year
			 that is 8 to 10 years less than the calendar year in which the voucher was
			 issued; and</text>
					</subparagraph><subparagraph id="H89DA298B69544DC5B5402E4590A094C2"><enum>(C)</enum><text>$1,500 if the
			 eligible high fuel consumption automobile was manufactured for a model year
			 that is 11 or more years less than the calendar year in which the voucher was
			 issued.</text>
					</subparagraph></paragraph><paragraph id="HF7BBE55E9C9C470297B193F23CC55995"><enum>(3)</enum><header>Voucher
			 redemption value if used toward purchase of a highly fuel efficient
			 automobile</header><text display-inline="yes-display-inline">The values
			 determined under paragraphs (1) or (2) shall be increased by $1,000 if the
			 voucher issued under the Program is applied to offset the purchase price of a
			 fuel efficient automobile that achieves a measured fuel economy level that
			 exceeds by 50 percent the fuel economy standard prescribed by the Secretary of
			 Transportation under section 32902 of title 49, United States Code, for the
			 model year and compliance category of such automobile.</text>
				</paragraph><paragraph id="HA7BE8B232ED7402FB25BF68F64078DDB"><enum>(4)</enum><header>Voucher
			 redemption value if used for transit fare credits</header><text>A voucher
			 issued under the program during the 4-year period beginning on January 1, 2009,
			 may be applied to acquire single-passenger transit fare credits from
			 participating transit operators in an amount equal to the amounts provided
			 under paragraph (2).</text>
				</paragraph></subsection><subsection id="H599B68D15E8A48438B1E512600FD4159"><enum>(c)</enum><header>Administrative
			 payments to participating dealers, dismantlers, and scrap recycling
			 facilities</header><text>The Secretary shall provide for a payment of $50, or
			 another amount determined reasonable by the Secretary, to participating
			 dealers, dismantlers, and scrap recycling facilities for each voucher issued
			 under the Program in consideration of the administrative costs related to such
			 issuance.</text>
			</subsection><subsection id="H53E2B33BEB184EF9A18867AA23237752"><enum>(d)</enum><header>Lists of
			 eligible automobiles To be maintained</header><text>The Secretary, in
			 cooperation with the Secretary of Transportation, shall prepare, maintain,
			 publicize, and make available through the Internet, lists of automobiles,
			 classified by make and model, which are classified under this section
			 as—</text>
				<paragraph id="H88FCD3DC08AE41A69538F007984B6177"><enum>(1)</enum><text>eligible high fuel
			 consumption automobiles;</text>
				</paragraph><paragraph id="H0860305E0B04439188D4B1858DF4CE9E"><enum>(2)</enum><text>new fuel efficient
			 automobiles; or</text>
				</paragraph><paragraph id="HD5E557386F7143F1BF98FFB10594E23E"><enum>(3)</enum><text>used fuel
			 efficient automobiles.</text>
				</paragraph></subsection><subsection id="HCAADCB8021FE48CBBE39BEDBAB1DBE7"><enum>(e)</enum><header>Program
			 Specifications</header>
				<paragraph id="HF913BFBB00224D7F95FC10228F00E000"><enum>(1)</enum><header>Limitations</header>
					<subparagraph id="HAB2392C746574122BAC63538B0E6595E"><enum>(A)</enum><header>Vouchers per
			 person</header><text>Not more than 1 voucher may be issued to a person in any
			 period of 3 successive calendar years. A person may be issued a voucher if the
			 person demonstrates, in a manner prescribed by rule by the Secretary, that such
			 person—</text>
						<clause id="H933A28C51015417AADF5D49F25D6B3B0"><enum>(i)</enum><text>is
			 the registered owner of an eligible high fuel consumption automobile;
			 and</text>
						</clause><clause id="H7A9B9B45DA8E47679F85113335887500"><enum>(ii)</enum><text>attests that such
			 high fuel consumption automobile has not been imported into the United States
			 during the previous 4-month period.</text>
						</clause></subparagraph><subparagraph id="H5BB8F10F9BB945D482EAB7DD48800082"><enum>(B)</enum><header>Vouchers for
			 eligible fleets</header><text>A voucher for the purchase of a new or used fuel
			 efficient automobile from a dealer may be issued to an eligible fleet operator
			 for each eligible high fuel consumption automobile for which such eligible
			 fleet operator is the registered owner, as demonstrated in a manner prescribed
			 by rule by the Secretary.</text>
					</subparagraph><subparagraph id="H729F34251FE74CD7AECD5D903742C3E8"><enum>(C)</enum><header>Offset</header><text>A
			 dealer—</text>
						<clause id="HE3CE8E6311124CF9A8C5F1B4BD1F2302"><enum>(i)</enum><text>shall credit the
			 amount of the voucher being applied toward the purchase of a fuel efficient
			 automobile; and</text>
						</clause><clause id="H8EF8E2F4EEF841FFA1C34C011626386C"><enum>(ii)</enum><text>may
			 not offset the amount of the voucher against any other rebate or discount
			 otherwise being offered by the dealer or manufacturer.</text>
						</clause></subparagraph><subparagraph id="H3B65CB612ED44B29866E4767FA324ED7"><enum>(D)</enum><header>Joint
			 ownership</header><text>Not more than 1 voucher may be issued to the joint
			 owners of an eligible high fuel consumption automobile, unless such automobile
			 is operated by an eligible fleet operator.</text>
					</subparagraph><subparagraph id="H61C31710FA704EA28784A39E88CE5E7"><enum>(E)</enum><header>No combination of
			 vouchers</header><text>A person may not apply 2 or more vouchers issued under
			 the Program toward the purchase of a single fuel efficient automobile.</text>
					</subparagraph><subparagraph id="H3EC5447E6CBD442883DF52CA99319C92"><enum>(F)</enum><header>Combination with
			 other incentives permitted</header><text>Notwithstanding any other provision of
			 law, the availability or use of a Federal or State tax incentive or a
			 State-issued voucher for the purchase of a fuel efficient automobile shall not
			 limit the value or issuance of a voucher under the Program to any person or
			 eligible fleet operator otherwise eligible to receive such a voucher.</text>
					</subparagraph><subparagraph id="HEAE9EB4CE8964F89ACB106646F5C8264"><enum>(G)</enum><header>Duration</header><text>Each
			 voucher shall expire 2 years after the date on which the voucher is issued and
			 may not be renewed.</text>
					</subparagraph><subparagraph id="H0102B084E4924949A192E576E76FEA3B"><enum>(H)</enum><header>Prompt
			 fulfillment of redemption requests required</header><text>The Secretary shall
			 provide for the payment of all vouchers submitted to the Secretary for
			 redemption in accordance with the provisions of this Act not later than 60 days
			 after such submission, or within such lesser period as the Secretary determines
			 to be practicable.</text>
					</subparagraph><subparagraph id="H1700E7FD2F65404481C7AB2F77C9A829"><enum>(I)</enum><header>Number and
			 amount</header><text>The total number and value of vouchers issued under the
			 Program may not exceed the amounts appropriated for such purpose.</text>
					</subparagraph></paragraph><paragraph id="H335B33B591D745E38E3967DAFC13B1F1"><enum>(2)</enum><header>Consumer
			 education program</header><text>The Secretary shall carry out a consumer
			 education program aimed at informing persons about the Program, its fuel
			 economy purposes, and the availability of vouchers under the Program.</text>
				</paragraph><paragraph id="H00C2A79CDDF2448B9193B3A6E197E117"><enum>(3)</enum><header>Transit fare
			 credits</header><text>The Secretary shall promulgate regulations that allow
			 operators of bus and rail public transit systems to redeem vouchers properly
			 issued to any person under this Act to offset the purchase price of annual
			 transit passes or any other form of individual transit fare credit designated
			 by the transit system operator. Participating transit system operators shall
			 establish the terms and conditions for the ownership, use, and expiration of
			 any transit fare credits acquired through the use of a voucher issued under
			 this Act.</text>
				</paragraph><paragraph id="HF1DD181AB6CF4D279FCAC5CBBE2575"><enum>(4)</enum><header>Disposition of
			 eligible high fuel consumption automobiles</header>
					<subparagraph id="HC36A343E44634D0C909BCA1EA7A82819"><enum>(A)</enum><header>In
			 general</header><text>Any automobile dealer, dismantler, or scrap recycling
			 facility who receives a certificate of title to any eligible high fuel
			 consumption automobile in exchange for a voucher under the Program shall
			 certify to the Secretary, in such manner as the Secretary shall prescribe by
			 rule, that such automobile and engine—</text>
						<clause id="H0880D4EF42D047EDB96FB3D042FEC186"><enum>(i)</enum><text>have
			 been crushed or shredded within such period as the Secretary prescribes;</text>
						</clause><clause id="H057DA0FE2B5C4F4FB79600FE19AF42AA"><enum>(ii)</enum><text>have been
			 processed prior to crushing or shredding to ensure the removal and appropriate
			 disposition of refrigerants, antifreeze, lead products, mercury switches, and
			 such other toxic or hazardous vehicle components as the Secretary may specify
			 by rule; and</text>
						</clause><clause id="H9C16D3BE1671483783771E784DF3FD7"><enum>(iii)</enum><text>have not been,
			 and will not be, sold, leased, exchanged, or otherwise disposed of for use as
			 an automobile in the United States or in any other country.</text>
						</clause></subparagraph><subparagraph id="H75D36F8032834A23B8BAB8C1BD17F336"><enum>(B)</enum><header>Savings
			 provision</header><text>Nothing in subparagraph (A) may be construed to
			 preclude a dismantler from—</text>
						<clause id="H46C11C7ACFB2484895CD80DF269100AE"><enum>(i)</enum><text>selling any parts
			 of such scrapped automobile other than the engine block and drive train for use
			 as replacement parts; or</text>
						</clause><clause id="HE0E1AE338EE04842839900614B5E6F28"><enum>(ii)</enum><text>retaining the
			 proceeds from such sale.</text>
						</clause></subparagraph><subparagraph id="HCC69DBB08FFF4AA680EB7F963423F2AE"><enum>(C)</enum><header>Coordination</header><text>The
			 Secretary shall coordinate with the Attorney General to ensure that the
			 National Motor Vehicle Title Information System is appropriately updated to
			 reflect the crushing or shredding of high fuel consumption automobiles under
			 this section.</text>
					</subparagraph></paragraph></subsection><subsection id="HC1E9A5B720E44D44963023DF835DBDDA"><enum>(f)</enum><header>Rulemaking</header><text>Not
			 later than 120 days after the date of the enactment of this Act, the Secretary
			 shall promulgate regulations to implement the Program, including—</text>
				<paragraph id="H42AFD85A973F46BAAE0718653C11E31C"><enum>(1)</enum><text>the removal and
			 disposition of toxic or hazardous materials from eligible high fuel consumption
			 vehicles presented for participation in the program; and</text>
				</paragraph><paragraph id="HB06F5FB61F034BE7B81417EDABEB53CD"><enum>(2)</enum><text>the enforcement of
			 the penalties described in section 4.</text>
				</paragraph></subsection><subsection id="HA9B9EDA217464D48916EE0D347C3BF5D"><enum>(g)</enum><header>Disclaimer</header><text>Nothing
			 in this Act or any other provision of law limits the authority of Congress or
			 the Secretary to terminate or limit the Program or the issuance of vouchers
			 under the Program.</text>
			</subsection></section><section id="H0221DF1BEC394946AFA8BF975300E649"><enum>4.</enum><header>Penalties</header>
			<subsection id="H96B58F240FE34AEAAFCE62A5963DA667"><enum>(a)</enum><header>Violation</header><text display-inline="yes-display-inline">It shall be unlawful for any person to
			 violate any provision under this Act or any regulations issued pursuant to
			 section 3(f).</text>
			</subsection><subsection id="HE2AB1C99E5FB423B8F2C6031A2554EDA"><enum>(b)</enum><header>Penalties</header><text display-inline="yes-display-inline">Any person who commits a violation
			 described in subsection (a) shall be liable to the United States Government for
			 a civil penalty of not more than $5,000 for each violation. A separate
			 violation shall be deemed to have occurred for each day the person continues to
			 be in violation of any provision under this Act.</text>
			</subsection></section><section id="H0E4711E5058442FBBDD3009FB9724FDB"><enum>5.</enum><header>Report</header><text display-inline="no-display-inline">The Secretary shall submit a report to the
			 Committee on Energy and Commerce of the House of Representatives and the
			 Committee on Energy and Natural Resources of the Senate every 6 months that
			 specifies, for the most recent 6-month period—</text>
			<paragraph id="HCDD0CF043F6540C6B88011F56E6BA791"><enum>(1)</enum><text>the number of
			 vouchers which have been used under the Program; and</text>
			</paragraph><paragraph id="H464CA6CD5A0547B395106540B0B30077"><enum>(2)</enum><text>the make, model,
			 model year, location of sale, and manufacturing location of each vehicle traded
			 in or purchased under the Program.</text>
			</paragraph></section><section id="H44C5905DCBCE4ABAB8B3DA00DAC6FD62"><enum>6.</enum><header>Authorization of
			 appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated, for each of the fiscal years 2009 through 2014,
			 such sums as may be necessary to carry out this Act, which shall remain
			 available until expended.</text>
