		<section id="HD6F1E2CCDF0247A383A99C22C40AAF58" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Defense Sexual Trauma Response
			 Oversight and Good Governance Act</short-title></quote> (the
			 <quote><short-title>Defense STRONG
			 Act</short-title></quote>).</text>
		</section><section id="HA572443F61804C288E4D2F80FA324FD0"><enum>2.</enum><header>Sexual Assault
			 Prevention and Response Office</header>
			<subsection id="HE2229874FF464DF7B4B99BB15EE38FDD"><enum>(a)</enum><header>Appointment of
			 director; duties</header><text display-inline="yes-display-inline">Chapter 3 of
			 title 10, United States Code, is amended by inserting after section 136a the
			 following new section:</text>
				<quoted-block display-inline="no-display-inline" id="H76E870E07BB64BE78659606A58F5C105" style="USC">
					<section id="H28A18E97DB954C10854BB59E67FC890D"><enum>136b.</enum><header>Director of
				Sexual Assault Prevention and Response Office</header>
						<subsection id="H9C45D1C490C34D48A29DBA349BD2396A"><enum>(a)</enum><header>Appointment</header><text display-inline="yes-display-inline">There is a Director of the Sexual Assault
				Prevention and Response Office who shall be a general or flag officer or an
				employee of the Department of Defense in a comparable Senior Executive Service
				position.</text>
						</subsection><subsection id="HA3C6D511EC4B48EAB5B197153682A631"><enum>(b)</enum><header>Duties</header><text display-inline="yes-display-inline">The Director of the Sexual Assault
				Prevention and Response Office serves as the Department’s single point of
				authority, accountability, and oversight for Department policy regarding
				prevention and response to sexual assault and provides oversight to ensure that
				the sexual assault programs of the military departments comply with Department
				policy.</text>
						</subsection><subsection id="H517C46B9A71C4D5CAA87499D80EE069A"><enum>(c)</enum><header>Standardization</header><text display-inline="yes-display-inline">The Secretary of Defense shall require the
				use of consistent sexual assault prevention and response terminology, position
				descriptions, minimum program standards, and organizational structures
				throughout the armed
				forces.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H1E11422C41FB4BAE9312C4684E9173BF"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of sections at the beginning of such chapter
			 is amended by inserting after the item relating to section 136a the following
			 new item:</text>

			</subsection></section><section id="HE6EBA61AF3BB4BAF9FB782D5ED08AA35" section-type="subsequent-section"><enum>3.</enum><header>Sexual Assault
			 Response Coordinators and Sexual Assault Victim Advocates</header>
			<subsection id="HA18B97D09E1944E7A072873408B26CD7"><enum>(a)</enum><header>Assignment and
			 training</header><text display-inline="yes-display-inline">Chapter 80 of title
			 10, United States Code, is amended by adding at the end the following new
			 section:</text>
				<quoted-block display-inline="no-display-inline" id="HD382F9A6A7FF4E1C8E0854B79DDB4DD9" style="USC">
					<section id="H2B6D152027114D3091E36AB3D7CF6A49"><enum>1568.</enum><header>Sexual assault
				prevention and response: Sexual Assault Response Coordinators and Victim
				Advocates</header>
						<subsection id="H5381197A9F1849EFB8F710EE53975191"><enum>(a)</enum><header>Assignment of
				coordinators</header><paragraph commented="no" display-inline="yes-display-inline" id="HC34DC36EAF2449B1A981C26AD4697A83"><enum>(1)</enum><text display-inline="yes-display-inline">At least one full-time Sexual Assault
				Response Coordinator shall be assigned at the brigade or equivalent or higher
				unit level. The Secretary concerned may assign additional Sexual Assault
				Response Coordinators as necessary based on the demographics or needs of the
				unit. Any additional Sexual Assault Response Coordinator for a unit shall also
				serve on a full-time basis.</text>
							</paragraph><paragraph id="H2026CD854175417E91D42739AC85928E" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">To ensure access to members of the Armed
				Forces in response to a report of a sexual assault involving a member, only
				members of the Armed Forces and civilian employees of the Department of Defense
				may be assigned to duty as a Sexual Assault Response Coordinator. Contractor
				employees may not serve as a Sexual Assault Response Coordinator, except on a
				temporary, emergency basis.</text>
							</paragraph></subsection><subsection id="H1CCE8F1AF9AD471497157E9F2A669601"><enum>(b)</enum><header>Assignment of
				victim advocates</header><paragraph commented="no" display-inline="yes-display-inline" id="HF42505E90D4F4AA6B2DF8227A6B15303"><enum>(1)</enum><text display-inline="yes-display-inline">At least one full-time Sexual Assault
				Victim Advocate shall be assigned to each battalion or equivalent unit. The
				Secretary concerned may assign additional Victim Advocates as necessary based
				on the demographics or needs of the unit. The additional Victim Advocates may
				serve on a full-time or part-time basis at the discretion of the
				Secretary.</text>
							</paragraph><paragraph id="H57A9EEED6D954245A2339D5B8D5E9701" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Only members of the armed forces and
				civilian employees of the Department of Defense may be assigned to duty as a
				Victim Advocate. Contractor employees may not serve as a Victim Advocate,
				except on a temporary, emergency basis.</text>
							</paragraph></subsection><subsection id="HD9B56442426440E4917CAC21F5B6D114"><enum>(c)</enum><header>Training and
				certification</header><paragraph commented="no" display-inline="yes-display-inline" id="H3106B8E64E6341DC9A5C53F52ADB4001"><enum>(1)</enum><text display-inline="yes-display-inline">The Secretary of Defense shall establish a
				professional and uniform training and certification program for Sexual Assault
				Response Coordinators and Victim Advocates. In developing the program, the
				Secretary of Defense shall work with the National Organization for Victim
				Advocates. The program shall be structured and administered in a manner similar
				to the professional training available for Equal Opportunity Advisors through
				the Defense Equal Opportunity Management Institute.</text>
							</paragraph><paragraph id="HA0194D4BAC334C32922CF070C3D41439" indent="up1"><enum>(2)</enum><text>Effective beginning one year after
				the date of the enactment of this section, before a member or civilian employee
				may be assigned to duty as a Sexual Assault Response Coordinator, the member or
				employee must have completed the training program required by paragraph (1) and
				obtained the certification.</text>
							</paragraph><paragraph id="H6BFF200D5C3E4C5F92A65F7E24B4B904" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">A
				member or civilian employee assigned to duty as a Victim Advocate may obtain
				certification under the training program required by paragraph (1). At a
				minimum, the Sexual Assault Response Coordinator to whom a Victim Advocate
				reports shall train the Victim Advocate using the same training materials used
				to train the Sexual Assault Response Coordinator under the program.</text>
							</paragraph></subsection><subsection id="H25EDB0EA51DD4BDC88526A07C59E692A"><enum>(d)</enum><header>Performance
				evaluations</header><text>Performance evaluation reports pertaining to a member
				of the Armed Forces assigned to serve as a Sexual Assault Response Coordinator
				or Victim Advocate shall comment on the performance of the member in the
				position.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection display-inline="no-display-inline" id="HE5BAB4C754B04C06B0A5D3E41C61DBC5"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of sections at the beginning of such chapter
			 is amended by adding at the end the following new item:</text>

			</subsection></section><section id="H8B8F1CFF146740CF8EA6A014A84E74F5" section-type="subsequent-section"><enum>4.</enum><header>Sexual assault victims
			 access to legal counsel and Victim Advocate services</header>
			<subsection id="HA8F1C65FAB9D43C08B43BE91082BD137"><enum>(a)</enum><header>Access</header><text display-inline="yes-display-inline">Chapter 53 of title 10, United States Code,
			 is amended by inserting after section 1044d the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="HB2E2B7AF37A54072AD73A9884B7116FE" style="USC">
					<section id="H44F47DE4121F41EE80D815FA71841F78"><enum>1044e.</enum><header>Access to
				legal assistance and Victim Advocate services for victims of sexual
				assault</header>
						<subsection id="HA779406CFC734EE1BA70B8FD3B458704"><enum>(a)</enum><header>Access</header><text display-inline="yes-display-inline">A member of the Armed Forces or a dependent
				of a member of the Armed Forces who is the victim of a sexual assault is
				entitled to legal assistance provided by a military legal assistance counsel
				and Victim Advocate services, regardless of whether the member or dependent
				elects unrestricted or restricted (confidential) reporting of the sexual
				assault.</text>
						</subsection><subsection id="H5C7266642AE449F094924ED70E8EF31C"><enum>(b)</enum><header>Restricted
				reporting option</header><paragraph commented="no" display-inline="yes-display-inline" id="H7EBD6F8F97FB45D1A12AC985AD800466"><enum>(1)</enum><text display-inline="yes-display-inline">A member or dependent referred to in
				subsection (a) may confidentially disclose the details of the assault to an
				individual specified in paragraph (2) and receive medical treatment, legal
				assistance, or counseling, without triggering an official investigation of the
				allegations.</text>
							</paragraph><paragraph id="H1D5CEA1B28B340FC8056FF589970E316" indent="up1"><enum>(2)</enum><text>Individuals covered by paragraph (1)
				are the following:</text>
								<subparagraph id="H4D20B26610A54706B1BD5A525BFEC6F4"><enum>(A)</enum><text display-inline="yes-display-inline">Military legal assistance counsel.</text>
								</subparagraph><subparagraph id="HBDD4878CCB3C4575A546CFFD9BE8FC87"><enum>(B)</enum><text display-inline="yes-display-inline">Sexual Assault Response Coordinator.</text>
								</subparagraph><subparagraph id="HFCED1D48BC914D85921A9847311C8CB6"><enum>(C)</enum><text>Victim Advocate.</text>
								</subparagraph><subparagraph id="HFD2B8672EAC845DC9AACF7E1AB8BA929"><enum>(D)</enum><text display-inline="yes-display-inline">Healthcare personnel.</text>
								</subparagraph><subparagraph id="H929853533C1548E28DDA5D58EDEBC5B7"><enum>(E)</enum><text>Chaplain.</text>
								</subparagraph></paragraph></subsection><subsection id="H2CEF98957DFE496695BB534A6406EFF1"><enum>(c)</enum><header>Privileged
				communications</header><paragraph commented="no" display-inline="yes-display-inline" id="HE60738AA4E5A471984C0333D2DB6CD6C"><enum>(1)</enum><text display-inline="yes-display-inline">Communications between a member or
				dependent referred to in subsection (a) and a Victim Advocate, and records of
				such communications created by or for the Department of Defense, are
				confidential and privileged. Such communications and records may not be
				disclosed to any person or entity without the consent of the member or
				dependent involved.</text>
							</paragraph><paragraph id="H4EBE8E68497D4386850E541F3FD79E9C" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">No part of any communication or record
				referred to in paragraph (1) may be subject to discovery or admitted into
				evidence in any judicial or administrative proceeding without the consent of
				the member or dependent involved.</text>
							</paragraph></subsection><subsection id="H96AC1BF85DA5424C8B097D1689F37BAA"><enum>(d)</enum><header>Definitions</header><text>In
				this section:</text>
							<paragraph id="H7C7A3E0A9380498E92021A1D505D637C"><enum>(1)</enum><text>The term
				<quote>sexual assault</quote> means any of the offenses covered by section 920
				of this title (article 120).</text>
							</paragraph><paragraph id="H0C1B852CEFFB43AF9A2F830F869BA980"><enum>(2)</enum><text>The term
				<term>military legal assistance counsel</term> means—</text>
								<subparagraph id="H55F2D11EA33447B2922C31965E4110F1"><enum>(A)</enum><text>a judge advocate
				(as defined in section 801(13) of this title); or</text>
								</subparagraph><subparagraph id="HCF9F18493DB6414C9930E32F080BF725"><enum>(B)</enum><text>a civilian
				attorney serving as a legal assistance officer under the provisions of section
				1044 of this
				title.</text>
								</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HC43A72F7BC26441EACB6B1E29C3AB12E"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of sections at the beginning of such chapter
			 is amended by inserting after the item relating to section 1044d the following
			 new item:</text>

			 amendment regarding provision of legal counsel</header><text>Section
			 1044(d)(3)(B) of such title is amended by striking <quote>sections 1044a,
			 1044b, 1044c, and 1044d</quote> and inserting <quote>sections 1044a through
			 1044e</quote>.</text>
			</subsection></section><section id="H1A92590E244E4531913477601CFDD19C" section-type="subsequent-section"><enum>5.</enum><header>Inclusion of sexual
			 assault prevention and response training module at each level of professional
			 military education</header><text display-inline="no-display-inline">The
			 Secretary of Defense shall provide for the inclusion of a sexual assault
			 prevention and response training module at each level of professional military
			 education. The training shall be tailored to the new responsibilities and
			 leadership requirements of members of the Armed Forces as they are
			 promoted.</text>
