<section id="HD9A350F2AE074243A597969045044556" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Summitville Procurement Protection Act</short-title></quote>.</text></section> 
<section id="HD9247D1260994B3597B58DBB63AA4181"><enum>2.</enum><header>Requirements for Federal contractors and subcontractors</header> 
<subsection id="HF0A2AE53A22D459AAF333EC0F9353511"><enum>(a)</enum><header>Requirement</header><text>In the case of a Federal contract awarded by any department or agency of the Federal Government, the contract shall require, as a condition of the contract, that the contractor—</text> 
<paragraph id="H97FC4F8F5A754E588B78F4E9C7E2FFC1"><enum>(1)</enum><text>shall comply with procurement reporting requirements and transparency standards in the performance of the contract;</text></paragraph> 
<paragraph id="H469856C115C54C80A986853020B6F9B4"><enum>(2)</enum><text>shall require any subcontractor under the contract to comply with such requirements and standards; and</text></paragraph> 
<paragraph id="H814D283E53BF4E828ABB1CE14C08F036"><enum>(3)</enum><text>shall submit to the department or agency that awarded the contract a report regarding all subcontracts awarded in the performance of the contract, including the procedures used in awarding the subcontracts.</text></paragraph></subsection> 
<subsection id="HFDED499E001F48CAB3B6AFCF6A1244DE"><enum>(b)</enum><header>Reporting requirements and transparency standards</header><text>In this Act, the term <quote>procurement reporting requirements and transparency standards</quote> means each of the following:</text> 
<paragraph id="H3E85D0055B89445EBEB8E46FED540A96"><enum>(1)</enum><text display-inline="yes-display-inline">A requirement to publicize proposed contracting opportunities.</text></paragraph> 
<paragraph id="H78117BF5BA664A2A80421156AD5358E3"><enum>(2)</enum><text>A requirement to select a contractor based on full and open competition, with the award going to the lowest-priced responsible qualified bidder, in the case of procurements conducted by sealed bidding, or the offeror whose proposal represents best value for the government, in the case of negotiated procurements.</text></paragraph> 
<paragraph id="H593A7946F173475D8D091DA63FD1BFEE"><enum>(3)</enum><text>A requirement to report information on which bidder or offeror received the contract award.</text></paragraph> 
<paragraph id="HE1B3B1BE80DE4993B070112AABE5C86A"><enum>(4)</enum><text>A requirement to disclose certain information to unsuccessful bidders or offerors.</text></paragraph> 
<paragraph id="HC6DDE014890043B4883846CB8B217CD7"><enum>(5)</enum><text>The ability to access a copy of the contract of the winning bidder or offeror.</text></paragraph></subsection>
<subsection id="HE328D85523674D01983EFE3E3F00644A"><enum>(c)</enum><header>Effective date</header><text>The requirements of this section shall apply with respect to contracts entered into on and after the date occurring 90 days after the date of the enactment of this Act. </text></subsection></section>
