		<official-title>To authorize public housing agencies to use public
		  housing operating funds as collateral for financing energy conservation
		  improvements and to freeze utility consumption levels for purposes of
		  determining Operating Fund assistance, and for other purposes.</official-title>

		<section id="HAFE28AAE0AC34ED4B45459B2373BAAF2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Public Housing Energy Savings Act of
			 2010</short-title></quote>.</text>
		</section><section id="H5CA99D04863D4187B3C76351EBF9469B"><enum>2.</enum><header>Utility and waste
			 management cost savings</header><text display-inline="no-display-inline">Subparagraph (C) of section 9(e)(2) of the
			 United States Housing Act of 1937 (42 U.S.C. 1437g(e)(2)(C)) is amended—</text>
			<paragraph id="HCB5173EB2BD0472A880571AFB4E85857"><enum>(1)</enum><text>by striking the
			 subparagraph designation and heading and all that follows through
			 <quote>Contracts described in clause (i) </quote> in clause (ii) and inserting
			 the following:</text>
				<quoted-block display-inline="no-display-inline" id="HAE8D0D2643F848C48CF4495D7D9B735B" style="OLC">
					<subparagraph id="H384F3E933B8B43678B927CDB3B854C44"><enum>(C)</enum><header>Treatment of
				utility and waste management cost savings</header>
						<clause id="H3AD11D929BC14EAFAD5A00D564BDC196"><enum>(i)</enum><header>In
				general</header><text display-inline="yes-display-inline">The treatment of
				utility and waste management costs under the formula shall provide that a
				public housing agency shall receive the full financial benefit from any
				reduction in the cost of utilities or waste management resulting from energy
				conservation improvements in one or more of its public housing projects,
				subject to the following:</text>
							<subclause id="H01B79C29F6D44D3BA1F71F5CFBB4939B"><enum>(I)</enum><header>Third party
				contracts</header><text>In the case of energy conservation improvements in
				public housing undertaken pursuant to a contract with a third party, such
				contracts</text>
							</subclause></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph id="HDB5CE05A6B3C4DC0B89C18AF891A9149"><enum>(2)</enum><text>in clauses (iii)
			 and (iv), by striking <quote>clause (i)</quote> each place such term appears
			 and inserting <quote>subclause (I)</quote>;</text>
			</paragraph><paragraph id="HDEDC8353ECA743F89877B152A60F82CF"><enum>(3)</enum><text>in clause (iv), by
			 striking <quote>the date of the enactment of this clause</quote> and inserting
			 <quote>December 26, 2007,</quote>;</text>
			</paragraph><paragraph id="H925D33428FB54279BA1B1A383286BE29"><enum>(4)</enum><text>by redesignating
			 clauses (iii) and (iv) as subclauses (II) and (III), respectively, and
			 realigning such subclauses, as so redesignated, so as to be indented 8 ems from
			 the left margin; and</text>
			</paragraph><paragraph id="H07695C1926D84CB6BDF3EA3A761802DF"><enum>(5)</enum><text>by adding at the
			 end the following new clauses:</text>
				<quoted-block display-inline="no-display-inline" id="H0914632BCF034D2D836E9D7D027A4F1B" style="OLC">
					<clause id="H46ED75CE67564FA695E93F383A641256"><enum>(ii)</enum><header>Financing of
				improvements</header><text display-inline="yes-display-inline">Energy
				conservation improvements may be undertaken pursuant to a contract for the
				improvements only, and the public housing agency may finance such improvements
				for a period of up to 20 years. A public housing agency may pledge operating
				assistance under this subsection as security for such financings in an amount
				not to exceed the lesser of—</text>
						<subclause id="H4353B09821EC47B78C138A5BDC7B1500"><enum>(I)</enum><text>the amount of the
				debt service, plus such appropriate debt service coverage factor as the
				Secretary may establish; and</text>
						</subclause><subclause id="H13F466016D714DF091683E71D36426B8"><enum>(II)</enum><text>the amount of the
				reasonably anticipated utility cost savings resulting from the improvements, as
				determined by the Secretary.</text>
						</subclause><continuation-text continuation-text-level="clause">The Secretary
				may also permit the pledging of the installed equipment related to such
				improvements.</continuation-text></clause><clause id="H764E7D86DE824AB4B2172376A2983438"><enum>(iii)</enum><header>Freeze of
				consumption levels</header>
						<subclause id="HF8223A0464BF4C71AF57D37A2115BAD4"><enum>(I)</enum><header>In
				general</header><text display-inline="yes-display-inline">A public housing
				agency may elect to be paid for its utility costs, including utility
				allowances, under the formula for a period, at the discretion of the agency, of
				not longer than 20 years based on the agency’s average annual consumption
				during the 3-year period preceding the year in which the election is made (in
				this clause referred to as the <quote>consumption base level</quote>).</text>
						</subclause><subclause id="HD55DE4B2BA3C44388D8C15EA50941ACF"><enum>(II)</enum><header>Initial
				adjustments in consumption base level</header><text>The Secretary shall make an
				initial one-time adjustment in the consumption base level to account for
				differences in the heating degree day average over the most recent 20-year
				period compared to the average in the consumption base level.</text>
						</subclause><subclause id="H67F0820855D544B3A004F06865B060F6"><enum>(III)</enum><header>Ongoing
				adjustments in consumption base level</header><text display-inline="yes-display-inline">The Secretary shall make adjustments in the
				consumption base level to account for an increase or reduction in units, a
				change in fuel source, a change in resident-controlled electricity consumption,
				or for such other reasons as the Secretary considers appropriate.</text>
						</subclause><subclause id="H48DE866BD214445092801353181A9642"><enum>(IV)</enum><header>Third
				parties</header><text>A public housing agency making an election under
				subclause (I) may use, but shall not be required to use, the services of a
				third party in its energy conservation program. The agency shall have the sole
				discretion to determine the source, terms, and conditions of any financing used
				for its
				program.</text>
						</subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block>
