<section id="H8706F8E080294918BF90B657E9F8A188" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Coltsville National Historical Park Act</short-title></quote>.</text></section>
<section id="H2257759F090A4418904A9FD326B53C67"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">For the purposes of this Act:</text>
<paragraph id="H542F606FD21B4B85B9346D0157F270A7"><enum>(1)</enum><header>City</header><text>The term <term>city</term> means the city of Hartford, Connecticut.</text></paragraph>
<paragraph id="H4E7CFAB8D59E491B96AF1D4EB2F0DE13"><enum>(2)</enum><header>Commission</header><text>The term <term>Commission</term> means the Coltsville National Historical Park Advisory Commission established by subsection 6(a).</text></paragraph>
<paragraph id="HD845E257A8404F4398EB7D186881DD00"><enum>(3)</enum><header>Historic District</header><text>The term <term>Historic District</term> means the Coltsville Historic District.</text></paragraph>
<paragraph id="HECFE496654C14912947B33560713F980"><enum>(4)</enum><header>Map</header><text>The term <term>map</term> means the map titled <quote>Coltsville National Historical Park—Proposed Boundary</quote>, numbered T25/102087, and dated May 11, 2010.</text></paragraph>
<paragraph id="H40857C3118FA46AFB5EC0AE0F95F62FE"><enum>(5)</enum><header>Park</header><text display-inline="yes-display-inline">The term <term>park</term> means the Coltsville National Historical Park in the State of Connecticut.</text></paragraph>
<paragraph id="H871EBA3E99AE42939DE32D5B15140094"><enum>(6)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph>
<paragraph id="HD0CCFB04007E40F8B156094AEC50A450"><enum>(7)</enum><header>State</header><text>The term <term>State</term> means the State of Connecticut.</text></paragraph></section>
<section id="HE070998E9EB94FB8934C77C6E7DAA9B8"><enum>3.</enum><header>Coltsville National Historical Park</header>
<subsection id="HB267234F9F554509AA4FDFE382F4DF55"><enum>(a)</enum><header>Establishment</header>
<paragraph id="H01B4938531034089884EC0122D37DAF7"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to paragraph (2), there is established in the State a unit of the National Park System to be known as the <quote>Coltsville National Historical Park</quote>.</text></paragraph>
<paragraph id="H3E6960ED4F1A4F52ACB97D57783513E3"><enum>(2)</enum><header>Conditions for establishment</header><text>The park shall not be established until the date on which the Secretary determines that—</text>
<subparagraph id="H06E2212176E840B28A18ADB123CAFAAB"><enum>(A)</enum><text display-inline="yes-display-inline">the Secretary has acquired by donation sufficient land or an interest in land within the boundary of the park to constitute a manageable unit;</text></subparagraph>
<subparagraph id="H80ACAD3613734661AFFA1667D6C0D0D6"><enum>(B)</enum><text>the State, city, or private property owner, as appropriate, has entered into a written agreement with the Secretary to donate at least 10,000 square feet of space in the East Armory which would include facilities for park administration and visitor services; </text></subparagraph>
<subparagraph id="HD467A0D729644420888FE27E3C57C9C4"><enum>(C)</enum><text>the Secretary has entered into a written agreement with the State, city, or other public entity, as appropriate, providing that—</text>
<clause id="H93FEA60627154085A486BBE33FA76952"><enum>(i)</enum><text>land owned by the State, city, or other public entity within the Coltsville Historic District shall be managed consistent with this section; and</text></clause>
<clause id="H78C2F89FDC6A4926968852840D2BD062"><enum>(ii)</enum><text>future uses of land within the historic district shall be compatible with the designation of the park and the city’s preservation ordinance; and</text></clause></subparagraph>
<subparagraph id="H4EA16D95C1604E60AF276CEFFDB3A7A7"><enum>(D)</enum><text display-inline="yes-display-inline">the Secretary has reviewed the financial resources of the owners of private and public property within the boundary of the proposed park to ensure the viability of the park based on those resources.</text></subparagraph></paragraph></subsection>
<subsection id="H97B8C08806044C578190D49A17933CF9"><enum>(b)</enum><header>Boundaries</header><text display-inline="yes-display-inline">The park shall include and provide appropriate interpretation and viewing of the following sites, as generally depicted on the map:</text>
<paragraph id="HD1C36322D5DA4AA08E0127C2412D056A"><enum>(1)</enum><text>The East Armory.</text></paragraph>
<paragraph id="H9912CCB89D4E485C822E4ED73D62DA43"><enum>(2)</enum><text>The Church of the Good Shepherd.</text></paragraph>
<paragraph id="HB9A9F5D31D764EB09490634757E2EDF6"><enum>(3)</enum><text>The Caldwell/Colt Memorial Parish House.</text></paragraph>
<paragraph id="HEE8840D01BFD44ED917A1F1844102703"><enum>(4)</enum><text>Colt Park.</text></paragraph>
<paragraph id="H3263A7427BAA4EE6B150E95E20D3367B"><enum>(5)</enum><text>The Potsdam Cottages.</text></paragraph>
<paragraph id="H8D538B7FF8EC49CF97B94185FBD17909"><enum>(6)</enum><text>Armsmear.</text></paragraph>
<paragraph id="H3119BC4CCDA047AC8340E5467CEDB9BE"><enum>(7)</enum><text display-inline="yes-display-inline">The James Colt House.</text></paragraph></subsection>
<subsection id="HCB0E070CCC5747F58B5B9489720FAD6E"><enum>(c)</enum><header>Collections</header><text>The Secretary shall enter into a written agreement with the State of Connecticut State Library, Wadsworth Atheneum, and the Colt Trust, or other public entities, as appropriate, to gain appropriate access to Colt-related artifacts for the purposes of having items routinely on display in the East Armory or within the park as determined by the Secretary as a major function of the visitor experience.</text></subsection></section>
<section id="H91CC6FB74DA64F2F8762553A324B50F2"><enum>4.</enum><header>Administration</header>
<subsection id="H06C77E5B0A9A4097B62D6D3A35855DF3"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall administer the park in accordance with—</text>
<paragraph id="H7ADB39FCA05C4204A16491560E9F77F3"><enum>(1)</enum><text>this Act; and</text></paragraph>
<paragraph id="H230B8BBE36E543BEB25E2BAB3ADF6B5D"><enum>(2)</enum><text>the laws generally applicable to units of the National Park System, including—</text>
<subparagraph id="HE19458C6AEDA445CA0E1122284440B9A"><enum>(A)</enum><text>the National Park Service Organic Act (16 U.S.C. 1 et seq.); and</text></subparagraph>
<subparagraph id="HB9A028757C7541CC87F526F7020676C6"><enum>(B)</enum><text>the Act of August 21, 1935 (16 U.S.C. 461 et seq.).</text></subparagraph></paragraph></subsection>
<subsection id="H92094E1E460C4EF7B4AF72AF5CF9D293"><enum>(b)</enum><header>State and local jurisdiction</header><text display-inline="yes-display-inline">Nothing in this Act enlarges, diminishes, or modifies any authority of the State, or any political subdivision of the State (including the city)—</text>
<paragraph id="H46324F77CF1042F7AB5A1DEA9E5C9981"><enum>(1)</enum><text>to exercise civil and criminal jurisdiction; or</text></paragraph>
<paragraph id="H7F1F97A11E2946338C1BF421728F6182"><enum>(2)</enum><text>to carry out State laws (including regulations) and rules on non-Federal land located within the boundary of the park.</text></paragraph></subsection>
<subsection id="H868A377498914CA8B3AEE00661BE9B7A"><enum>(c)</enum><header>Cooperative agreements</header>
<paragraph id="H58854C73545242D192BEAEA22CDF68CC"><enum>(1)</enum><header>In general</header><text>As the Secretary determines to be appropriate to carry out this Act, the Secretary may enter into cooperative agreements with the owner of any property within the Coltsville Historic District or any nationally significant properties within the boundary of the park, under which the Secretary may identify, interpret, restore, rehabilitate, and provide technical assistance for the preservation of the properties.</text></paragraph>
<paragraph id="H63F643512ADD4D53AE5FEAA48DA1ADC3"><enum>(2)</enum><header>Right of access</header><text>A cooperative agreement entered into under paragraph (1) shall provide that the Secretary, acting through the Director of the National Park Service, shall have the right of access at all reasonable times to all public portions of the property covered by the agreement for the purposes of—</text>
<subparagraph id="H88CF7AB355AF4959A5471C986A59B624"><enum>(A)</enum><text>conducting visitors through the properties; and</text></subparagraph>
<subparagraph id="HD0548B18E0CA47CEB822FEE900004639"><enum>(B)</enum><text>interpreting the properties for the public.</text></subparagraph></paragraph>
<paragraph id="HC3F6F8FFD68449D0AFAA3242B749179D"><enum>(3)</enum><header>Changes or alterations</header><text>No changes or alterations shall be made to any properties covered by a cooperative agreement entered into under paragraph (1) unless the Secretary and the other party to the agreement agree to the changes or alterations.</text></paragraph>
<paragraph id="H407431F0E4814E54ABFC8A7210A1E76F"><enum>(4)</enum><header>Conversion, use, or disposal</header><text>Any payment by the Secretary under this subsection shall be subject to an agreement that the conversion, use, or disposal of a project for purposes contrary to the purposes of this section, as determined by the Secretary, shall entitle the United States to reimbursement in an amount equal to the greater of—</text>
<subparagraph id="H4FA129377123465FAE03BFA86B9ABBB1"><enum>(A)</enum><text>the amounts made available to the project by the United States; or</text></subparagraph>
<subparagraph id="H97FABEB1E86641ECA08BC4E67CB61DD2"><enum>(B)</enum><text>the portion of the increased value of the project attributable to the amounts made available under this subsection, as determined at the time of the conversion, use, or disposal.</text></subparagraph></paragraph>
<paragraph id="H1A0E2B7CE03A42B79AC0318C88073EFB"><enum>(5)</enum><header>Matching funds</header>
<subparagraph id="H1D70A25C1A654A35A155F87626F85CD1"><enum>(A)</enum><header>In general</header><text>As a condition of the receipt of funds under this subsection, the Secretary shall require that any Federal funds made available under a cooperative agreement shall be matched on a 1-to-1 basis by non-Federal funds.</text></subparagraph>
<subparagraph id="H921BC2EF726045DBB14AC462E8B2BE2C"><enum>(B)</enum><header>Form</header><text>With the approval of the Secretary, the non-Federal share required under subparagraph (A) may be in the form of donated property, goods, or services from a non-Federal source, fairly valued.</text></subparagraph></paragraph></subsection>
<subsection id="H5BC80DE76B224ECE86921A5DBE1CCBC5"><enum>(d)</enum><header>Acquisition of land</header><text display-inline="yes-display-inline">Land or interests in land owned by the State or any political subdivision of the State may be acquired only by donation.</text></subsection>
<subsection id="HFFA92D020211441CB7A2C1A751CDB111"><enum>(e)</enum><header>Technical assistance and public interpretation</header><text>The Secretary may provide technical assistance and public interpretation of related historic and cultural resources within the boundary of the historic district.</text></subsection></section>
<section id="HBC3172E3DE88422E9FB9147747D04BAF"><enum>5.</enum><header>Management plan</header>
<subsection id="H7196EFAFEDDF40A8B97D0A87B9066DEF"><enum>(a)</enum><header>In general</header><text>Not later than 3 fiscal years after the date on which funds are made available to carry out this Act, the Secretary, in consultation with the Commission, shall complete a management plan for the park in accordance with—</text>
<paragraph id="HE01F525AF00741F0A756C77A89E89399"><enum>(1)</enum><text>section 12(b) of Public Law 91–383 (commonly known as the National Park Service General Authorities Act) (16 U.S.C. 1a–7(b)); and</text></paragraph>
<paragraph id="HE419F1761AF54F11AC907A9863131AF4"><enum>(2)</enum><text>other applicable laws.</text></paragraph></subsection>
<subsection id="HB527974B138544A5B4803ED4DA49E6F1"><enum>(b)</enum><header>Cost share</header><text>The management plan shall include provisions that identify costs to be shared by the Federal Government, the State, and the city, and other public or private entities or individuals for necessary capital improvements to, and maintenance and operations of, the park.</text></subsection>
<subsection id="HB6348FE66DDE47BE959BDB5C6504C725"><enum>(c)</enum><header>Submission to Congress</header><text>On completion of the management plan, the Secretary shall submit the management plan to—</text>
<paragraph id="HC06F13B5753F47BCB58EFE12C4C25F6C"><enum>(1)</enum><text>the Committee on Natural Resources of the House of Representatives; and</text></paragraph>
<paragraph id="HA03EF37CBDD0448AA87286251BD5B951"><enum>(2)</enum><text>the Committee on Energy and Natural Resources of the Senate.</text></paragraph></subsection></section>
<section id="H7E80CFCF56CC4309845A7373A1F90774"><enum>6.</enum><header>Coltsville National Historical Park Advisory Commission</header>
<subsection id="H51D7815623DC4B96BBA30FB18EC79CAA"><enum>(a)</enum><header>Establishment</header><text>There is established a Commission to be known as the Coltsville National Historical Park Advisory Commission.</text></subsection>
<subsection id="H8147CCE5B4814C87A8AF62143BDED964"><enum>(b)</enum><header>Duty</header><text>The Commission shall advise the Secretary in the development and implementation of the management plan.</text></subsection>
<subsection id="H5DF63C78835B46F59826BA01DC650985"><enum>(c)</enum><header>Membership</header>
<paragraph id="H4738EA543FE84298886C912CB8AFEBF4"><enum>(1)</enum><header>Composition</header><text>The Commission shall be composed of 11 members, to be appointed by the Secretary, of whom—</text>
<subparagraph id="HCF88618B53894087B8A5F55237D908A9"><enum>(A)</enum><text>2 members shall be appointed after consideration of recommendations submitted by the Governor of the State;</text></subparagraph>
<subparagraph id="HD27AF985716A4CD4B20F1E969FC4726C"><enum>(B)</enum><text>1 member shall be appointed after consideration of recommendations submitted by the State Senate President;</text></subparagraph>
<subparagraph id="H21EA1CEC07D34DF1B49CAA5A71CA04BE"><enum>(C)</enum><text>1 member shall be appointed after consideration of recommendations submitted by the Speaker of the State House of Representatives;</text></subparagraph>
<subparagraph id="H0D713C4078D1466CB7F57D0B47936F5B"><enum>(D)</enum><text>2 members shall be appointed after consideration of recommendations submitted by the Mayor of Hartford, Connecticut;</text></subparagraph>
<subparagraph id="HF9292C33F3A849BE8F71477D9EBA17AA"><enum>(E)</enum><text>2 members shall be appointed after consideration of recommendations submitted by Connecticut’s 2 United States Senators;</text></subparagraph>
<subparagraph id="HC055232E278F41819410D0EC081C19E0"><enum>(F)</enum><text>1 member shall be appointed after consideration of recommendations submitted by Connecticut's First Congressional District Representative;</text></subparagraph>
<subparagraph id="HB72C9C72E78B42F78B1399061B45062E"><enum>(G)</enum><text>2 members shall have experience with national parks and historic preservation;</text></subparagraph>
<subparagraph id="H6E1094F5ABC14F789E3B646B56F80396"><enum>(H)</enum><text>all appointments must have significant experience with and knowledge of the Coltsville Historic District; and</text></subparagraph>
<subparagraph id="HFFF42623431C4210A93C40A7F9D11918"><enum>(I)</enum><text>1 member of the Commission must live in the Sheldon/Charter Oak neighborhood within the Coltsville Historic District.</text></subparagraph></paragraph>
<paragraph id="HD281DA9B5A474AC39A19AE5B0FF3A4E3"><enum>(2)</enum><header>Initial appointments</header><text>The Secretary shall appoint the initial members of the Commission not later than the earlier of—</text>
<subparagraph id="H7FCC2DF60EE74BC6BF7D7C8B0B75FCAC"><enum>(A)</enum><text>the date that is 30 days after the date on which the Secretary has received all of the recommendations for appointments under paragraph (1); or</text></subparagraph>
<subparagraph id="HD33408C771B64DB8BBB4F8E2BAD0EAD5"><enum>(B)</enum><text>the date that is 30 days after the park is established.</text></subparagraph></paragraph></subsection>
<subsection id="H7A334B1BFFAA4132A552F361EC003CCF"><enum>(d)</enum><header>Term; vacancies</header>
<paragraph id="H99804A49A2744FDEA449E7F6F7902F4E"><enum>(1)</enum><header>Term</header>
<subparagraph id="H8153E6D4F2044D6085BD75E71F02B027"><enum>(A)</enum><header>In general</header><text>A member shall be appointed for a term of 3 years.</text></subparagraph>
<subparagraph id="H45C9B0318A2341A9B6D2835C5F6B1650"><enum>(B)</enum><header>Reappointment</header><text>A member may be reappointed for not more than 1 additional term.</text></subparagraph></paragraph>
<paragraph id="H6517B40AEB8C4B6C9DE65319CC2F5610"><enum>(2)</enum><header>Vacancies</header><text>A vacancy on the Commission shall be filled in the same manner as the original appointment was made.</text></paragraph></subsection>
<subsection id="HD029A58B2B204EDB9FA9EA851D9D50D3"><enum>(e)</enum><header>Meetings</header><text>The Commission shall meet at the call of—</text>
<paragraph id="H16C26965A171441FAE0B301E4E9EE44E"><enum>(1)</enum><text>the Chairperson; or</text></paragraph>
<paragraph id="H5724E64FD1B448D6B1BCF4BABBDEEDAB"><enum>(2)</enum><text>a majority of the members of the Commission.</text></paragraph></subsection>
<subsection id="H86432E762E724740B99F245383EE00DF"><enum>(f)</enum><header>Quorum</header><text>A majority of the Commission shall constitute a quorum.</text></subsection>
<subsection id="H4AF19BECD7B64FC18C9A5BC7954394AF"><enum>(g)</enum><header>Chairperson and vice chairperson</header>
<paragraph id="HBC5CAB65692746828A8FCF020D7B99F5"><enum>(1)</enum><header>In general</header><text>The Commission shall select a Chairperson and Vice Chairperson from among the members of the Commission.</text></paragraph>
<paragraph id="H4948893BA7FB4D47B57DA4C3BA43A0DE"><enum>(2)</enum><header>Vice chairperson</header><text>The Vice Chairperson shall serve as Chairperson in the absence of the Chairperson.</text></paragraph>
<paragraph id="HD515B53BB459471FB778A1CC561A9077"><enum>(3)</enum><header>Term</header><text>A member may serve as Chairperson or Vice Chairperson for not more than 1 year in each office.</text></paragraph></subsection>
<subsection id="H258C06CC9E8B4135875E9778D97A17C7"><enum>(h)</enum><header>Commission personnel matters</header>
<paragraph id="HE08103D01EDC4AC591DFECCF0EAB4F2C"><enum>(1)</enum><header>Compensation of members</header>
<subparagraph id="HF8E5391A259A48388EE0D90732E0AAA3"><enum>(A)</enum><header>In general</header><text>Members of the Commission shall serve without compensation.</text></subparagraph>
<subparagraph id="H5F8E889417FE427D85C18FC13C9DA8F3"><enum>(B)</enum><header>Travel expenses</header><text>Members of the Commission shall be allowed travel expenses, including per diem in lieu of subsistence, at rates authorized for an employee of an agency under subchapter I of chapter 57 of title 5, United States Code, while away from the home or regular place of business of the member in the performance of the duty of the Commission.</text></subparagraph></paragraph>
<paragraph id="H656CED8C71B24130A073F2CA59FA3826"><enum>(2)</enum><header>Staff</header>
<subparagraph id="H0FC1B79C4BF84DB2A29A18E1CD7B461F"><enum>(A)</enum><header>In general</header><text>The Secretary shall provide the Commission with any staff members and technical assistance that the Secretary, after consultation with the Commission, determines to be appropriate to enable the Commission to carry out the duty of the Commission.</text></subparagraph>
<subparagraph id="H31BF5A03507B4D09B0C3C859490EB701"><enum>(B)</enum><header>Detail of employees</header><text>The Secretary may accept the services of personnel detailed from the State or any political subdivision of the State.</text></subparagraph></paragraph></subsection>
<subsection id="H6F4C15F0D14E4BEEB9EAA94ED2E48C39"><enum>(i)</enum><header>FACA nonapplicability</header><text>Section 14(b) of the Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the Commission.</text></subsection>
<subsection id="H6DDB2A1C221D46D2B0A3826080E48A0C"><enum>(j)</enum><header>Termination</header>
<paragraph id="H410E520E3201490796B84F295D1CF366"><enum>(1)</enum><header>In general</header><text>Unless extended under paragraph (2), the Commission shall terminate on the date that is 10 years after the date of the enactment of this Act.</text></paragraph>
<paragraph id="HD28C8D65A93A4C7DBE1EDE83A62CA961"><enum>(2)</enum><header>Extension</header><text>Eight years after the date of the enactment of this Act, the Commission shall make a recommendation to the Secretary if a body of its nature is still necessary to advise on the development of the park. If, based on a recommendation under this paragraph, the Secretary determines that the Commission is still necessary, the Secretary may extend the life of the Commission for not more than 10 years.</text></paragraph></subsection></section>
<section id="HA6C0421A0A8D4618817C94119D835991"><enum>7.</enum><header>Authorization of appropriation</header><text display-inline="no-display-inline">There is authorized to be appropriated $10,000,000 for the development of the park.</text></section>
