<section section-type="section-one" id="H9949FAC0BFDE431D85CD087800575CEC" display-inline="no-display-inline"><enum>1.</enum><header>Commission on Freedom of Information Act Processing Delays</header>
<subsection id="H024E28BBF7414AFE801ABF1946255629"><enum>(a)</enum><header>Short title</header><text>This Act may be cited as the <quote><short-title>Faster FOIA Act of 2010</short-title></quote>.</text></subsection>
<subsection id="HF4DAF4D7D3B0451EB7EA136805FAA17C"><enum>(b)</enum><header>Establishment</header><text>There is established the Commission on Freedom of Information Act Processing Delays (in this Act referred to as the <quote>Commission</quote>) for the purpose of conducting a study relating to methods to help reduce delays in processing requests submitted to Federal agencies under section 552 of title 5, United States Code (commonly referred to as the <quote>Freedom of Information Act</quote>).</text></subsection>
<subsection id="H342CCF75640646F2A97BEF37AC99044B"><enum>(c)</enum><header>Membership</header>
<paragraph id="H849D17E5B1D74B4F97B94332DDF4F71D"><enum>(1)</enum><header>In general</header><text>The Commission shall be composed of 16 members of whom—</text>
<subparagraph id="HF62D240C27AB4A93A77BC58440D3F08F"><enum>(A)</enum><text>3 shall be appointed by the chairman of the Committee on the Judiciary of the Senate;</text></subparagraph>
<subparagraph id="H3855B5B1F446496D8A50EECF05A62E6C"><enum>(B)</enum><text>3 shall be appointed by the ranking member of the Committee on the Judiciary of the Senate;</text></subparagraph>
<subparagraph id="H8CA2AB3D8F994F39A786B69FDA6779DA"><enum>(C)</enum><text>3 shall be appointed by the chairman of the Committee on Oversight and Government Reform of the House of Representatives;</text></subparagraph>
<subparagraph id="H15F39E7F39034BC588FD62FF7E501BC8"><enum>(D)</enum><text>3 shall be appointed by the ranking member of the Committee on Oversight and Government Reform of the House of Representatives;</text></subparagraph>
<subparagraph id="H35DC8A189F024F89B5BFF47E7087868F"><enum>(E)</enum><text>1 shall be appointed by the Attorney General of the United States;</text></subparagraph>
<subparagraph id="H2AC4DAC44FE24F30AFE150E57CE3A131"><enum>(F)</enum><text>1 shall be appointed by the Director of the Office of Management and Budget;</text></subparagraph>
<subparagraph id="HA84CBB0413E541AFA3B147F37D86B1B0"><enum>(G)</enum><text>1 shall be appointed by the Archivist of the United States; and</text></subparagraph>
<subparagraph id="H5F0FA4A73F95494BBBD340F89C569267"><enum>(H)</enum><text>1 shall be appointed by the Comptroller General of the United States.</text></subparagraph></paragraph>
<paragraph id="H25FA4E1295514DB4AAD923D2A0DA2332"><enum>(2)</enum><header>Qualifications of congressional appointees</header><text>Of the 3 appointees under each of subparagraphs (A), (B), (C), and (D) of paragraph (1)—</text>
<subparagraph id="HFA2D4ACFE5EF4EECB3441574DE67945D"><enum>(A)</enum><text>at least 1 shall have experience in submitting requests under section 552 of title 5, United States Code, to Federal agencies, such as on behalf of nonprofit research or educational organizations or news media organizations; and</text></subparagraph>
<subparagraph id="H3EC06664BC49402E816BED0FBF11EC2C"><enum>(B)</enum><text>at least 1 shall have experience in academic research in the fields of library science, information management, or public access to Government information.</text></subparagraph></paragraph></subsection>
<subsection id="H398528FA069E4831A0382728A9CC4478"><enum>(d)</enum><header>Study</header><text>The Commission shall conduct a study to—</text>
<paragraph id="HF59E265812934CACA27680BD790BB7BD"><enum>(1)</enum><text>identify methods that—</text>
<subparagraph id="H89FD0380A5B84FA78C3B1B6432B9152A"><enum>(A)</enum><text>will help reduce delays in the processing of requests submitted to Federal agencies under section 552 of title 5, United States Code; and</text></subparagraph>
<subparagraph id="H67A1537D4C234C7D80F9300D5A3F38BB"><enum>(B)</enum><text>ensure the efficient and equitable administration of that section throughout the Federal Government; and</text></subparagraph></paragraph>
<paragraph id="HF2ECC3CBA66E413594E0EC49DE92A710"><enum>(2)</enum><text>examine whether the system for charging fees and granting waivers of fees under section 552 of title 5, United States Code, needs to be reformed in order to reduce delays in processing requests.</text></paragraph></subsection>
<subsection id="H555D96CBF6694CA2B34DC5ABF6647E7D"><enum>(e)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this Act, the Commission shall submit a report to Congress and the President containing the results of the study under this section, which shall include—</text>
<paragraph id="HE54014AFECD64A2FA63B09D6A4269D23"><enum>(1)</enum><text>a description of the methods identified by the study;</text></paragraph>
<paragraph id="HA63AA8BA06E849A0A9869FC6498CF81E"><enum>(2)</enum><text>the conclusions and recommendations of the Commission regarding—</text>
<subparagraph id="H833654747CF84A04A93928C31E1F9361"><enum>(A)</enum><text>each method identified; and</text></subparagraph>
<subparagraph id="H1B7FF71CD0294FD7B9A757FC37EE9232"><enum>(B)</enum><text>the charging of fees and granting of waivers of fees; and</text></subparagraph></paragraph>
<paragraph id="H5756DF3F27E849F6A0B778A896D18452"><enum>(3)</enum><text>recommendations for legislative or administrative actions to implement the conclusions of the Commission.</text></paragraph></subsection>
<subsection id="H8FB557D475054FAB8CD5CCBA6D47D37A"><enum>(f)</enum><header>Staff and administrative support services</header><text>The Comptroller General of the United States shall provide to the Commission such staff and administrative support services, including research assistance at the request of the Commission, as necessary for the Commission to perform its functions efficiently and in accordance with this section.</text></subsection>
<subsection id="H59B63E5122ED4E14AFD1FCA09FDFAB0D"><enum>(g)</enum><header>Information</header><text>To the extent permitted by law, the heads of executive agencies, the Government Accountability Office, and the Congressional Research Service shall provide to the Commission such information as the Commission may require to carry out its functions.</text></subsection>
<subsection id="H3E6F32C8533040E1A40500F53DBEA114"><enum>(h)</enum><header>Compensation of members</header><text>Members of the Commission shall serve without compensation for services performed for the Commission.</text></subsection>
<subsection id="HFE8A56F6FAA64DB9B188A94965DD4018"><enum>(i)</enum><header>Travel expenses</header><text>The members of the Commission shall be allowed travel expenses, including per diem in lieu of subsistence, at rates authorized for employees of agencies under subchapter I of chapter 57 of title 5, United States Code, while away from their homes or regular places of business in the performance of services for the Commission.</text></subsection>
<subsection id="HC1178C2D8A604B88BC43020DB2E6CD53"><enum>(j)</enum><header>Applicability of <act-name parsable-cite="FACA">Federal Advisory Committee Act</act-name></header><text>The <act-name parsable-cite="FACA">Federal Advisory Committee Act</act-name> (5 U.S.C. App.) shall apply to the Commission.</text></subsection>
<subsection id="HB4BFDCD8FCD54D56BBC4250F60F0B6A9"><enum>(k)</enum><header>Termination</header><text>The Commission shall terminate 30 days after the submission of the report under subsection (e).</text></subsection></section>
