<subsection id="H194C71EDE4F648D299F77E7CB2F4DD97"><enum>(a)</enum><header>Fiscal year 2011</header> 
<paragraph id="HFE5599B13C29442BA791F360DC43CA81"><enum>(1)</enum><header>In general</header><text>There are authorized to be appropriated to the Secretary of Commerce $1,012,100,000 for the National Institute of Standards and Technology for fiscal year 2011.</text> </paragraph> 
<paragraph id="H748A62CF26F64A57A76321E379B96D79"><enum>(2)</enum><header>Specific allocations</header><text>Of the amount authorized under paragraph (1)—</text> 
<subparagraph id="HF0EB1E8590CA462CAA49F19D94C8214D"><enum>(A)</enum><text display-inline="yes-display-inline">$620,000,000 shall be authorized for scientific and technical research and services laboratory activities;</text> </subparagraph> 
<subparagraph id="H645B4460CFC844D2925B460E25D1BFB1"><enum>(B)</enum><text display-inline="yes-display-inline">$125,000,000 shall be authorized for the construction and maintenance of facilities; and</text></subparagraph>

<subsection id="HC090DD5E23F5468E80E99D8909470465"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 5 of the Stevenson-Wydler Technology Innovation Act of 1980 (15 U.S.C. 3704) is amended—</text> 
<paragraph id="H6A3CAA37E057433C9DD99226FDE37FA5"><enum>(1)</enum><text>in the heading, by striking <quote><header-in-text level="section" style="OLC">Experimental program to stimulate competitive</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">Standards and</header-in-text></quote>;</text></paragraph> 
<paragraph id="HF899114F27A242E788BE295FC554CE3E"><enum>(2)</enum><text>in the heading in subsection (a), by striking <quote><header-in-text level="subsection" style="OLC">Program Establishment</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">Establishment of Experimental Program To Stimulate Competitive Technology</header-in-text></quote>;</text></paragraph>

<paragraph id="HB6CC57B75E274DB897AA003350BE0B24"><enum>(1)</enum><header>Establishment</header> 
<subparagraph id="H9F5E620355764F0AB4F11BF660375A4C"><enum>(A)</enum><header>In general</header><text>There shall be in the Department of Commerce an Under Secretary of Commerce for Standards and Technology who shall serve as the Director of the National Institute of Standards and Technology and perform such duties as provided for in law and as the Secretary shall prescribe.</text></subparagraph> 
<subparagraph id="HC67062ABC38E4130A1A7D2C7B28ED89A"><enum>(B)</enum><header>Appointment</header><text display-inline="yes-display-inline">The Under Secretary of Commerce for Standards and Technology shall be appointed by the President by and with the advice and consent of the Senate and shall be compensated at the rate now or hereafter provided for level III of the Executive Schedule Pay Rates (5 U.S.C. 5314).</text></subparagraph> 
<subparagraph id="H6A41AEE1659A44ED84D4B84F7258F702"><enum>(C)</enum><header>Applicability</header><text display-inline="yes-display-inline">The individual serving on the date of enactment of the <short-title>National Institute of Standards and Technology Authorization Act of 2010</short-title> as the Director of the National Institute of Standards and Technology shall also serve as the Under Secretary of Commerce for Standards and Technology until such time as a successor is appointed under <internal-xref idref="HC67062ABC38E4130A1A7D2C7B28ED89A" legis-path="(a)(2)">subparagraph (B)</internal-xref>.</text></subparagraph></paragraph> 
<paragraph id="H46C0FAC7CE094154BF5A1434B660A805"><enum>(2)</enum><header>Duties</header><text>The Secretary, acting through the Under Secretary of Commerce for Standards and Technology, as appropriate, shall—</text> 
<subparagraph id="H5D161690C48F45FDBB266AD27DD59B16"><enum>(A)</enum><text>conduct policy analysis on innovation and technical standards to improve and promote United States competitiveness in the context of global competition;</text></subparagraph> 
<subparagraph id="HA04A38776E1941018E48A604AD4C41AF"><enum>(B)</enum><text>propose and support studies, in cooperation with other Federal agencies, to evaluate the effectiveness of measures for improving Federal Government technology transfer policies and initiatives;</text></subparagraph> 
<subparagraph id="HCF826C252C1845BCB4F4CFF66AF91905"><enum>(C)</enum><text>provide that cooperative efforts to stimulate competitiveness, job creation, and innovation be undertaken between the Under Secretary and other officials in the Department of Commerce responsible for such areas as trade and economic assistance;</text></subparagraph> 
<subparagraph id="H630BF956095F494DB96D1B00552AE42A"><enum>(D)</enum><text>support the creation of partnerships and other joint initiatives by State or local governments, regional organizations, private businesses, institutions of higher education, nonprofit institutions, or Federal laboratories to encourage technology transfer and innovation;</text></subparagraph> 
<subparagraph id="HD97BA5968BC94C269344F3D883453B3F"><enum>(E)</enum><text>conduct research and support activities to improve training programs and curricula for high-tech manufacturing skills and related skill sets and encourage the dissemination of best practices involving appropriate Federal agencies, State or local governments, regional organizations, institutions of higher education, or nonprofit institutions; and</text></subparagraph> 
<subparagraph id="HCBBAD62CEB8F4994AFED04E3DA100BB2"><enum>(F)</enum><text>serve as a focal point for discussions among United States companies on topics of interest regarding technology innovation, competitiveness, and job retention and creation.</text></subparagraph> </paragraph></subsection> <after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H6FB3FCC594344688BF8F64871C8F8015"><enum>(b)</enum><header>Conforming Amendments</header> 
<paragraph id="HEB034D84F8A74A3FBE80015EA01FDB7E"><enum>(1)</enum><header>Stevenson-Wydler</header><text display-inline="yes-display-inline">Subsection (c) of section 5 of such Act (15 U.S.C. 3704), as redesignated in subsection (a)(3), is amended to read as follows:</text> 
<quoted-block style="OLC" id="H3355746498424EA68BFEC89D775E9A06" display-inline="no-display-inline"> 
<subsection id="HD2CADD1CDCC949168C88F9DACF830CF9"><enum>(c)</enum><header>Coordination</header><text display-inline="yes-display-inline">To the extent practicable, in carrying out subsection (b), the Secretary shall coordinate the program established under such subsection with other programs of the Department of Commerce.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph> 
<paragraph id="H0D6BC6CADD3B4FF5A2C419813D21C3A3"><enum>(2)</enum><header>Title 5, United States Code</header> 
<subparagraph id="H19709583BF5F46F68A7C4BA280ACB3E6"><enum>(A)</enum><header>Level III</header><text>Section 5314 of title 5, United States Code, is amended by inserting before the item <quote>Associate Attorney General</quote> the following:</text> 
<quoted-block style="OLC" id="H27BD846591FF48D0BB21EDDCF8466626" display-inline="no-display-inline"><list level="paragraph"><list-item>Under Secretary of Commerce for Standards and Technology, the incumbent of which also serves as Director of the National Institute of Standards and Technology.</list-item></list><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="HC055FDD82D954B1D82CE4C1BB5C86F11"><enum>(B)</enum><header>Level IV</header><text>Section 5315 of title 5, United States Code, is amended by striking <quote>Director, National Institute of Standards and Technology, Department of Commerce.</quote>. </text></subparagraph></paragraph> 
<paragraph id="H92F0A1A345794643AB104039418632A0"><enum>(3)</enum><header>NIST Act</header><text>Section 5 of the National Institute of Standards and Technology Act (15 U.S.C. 274) is amended by striking the following: <quote>The Director shall be compensated at the rate in effect for level IV of the Executive Schedule under section 5315 of title 5, United States Code.</quote>. </text></paragraph></subsection></section> 
<section id="H0D54B1D5DC214140B82219AFD20B5A38"><enum>4.</enum><header>Reorganization of NIST laboratories</header> 
<subsection id="H4CE415EAC4414DF4846FEB5F5F7222A7"><enum>(a)</enum><header>Organization</header><text display-inline="yes-display-inline">The Director shall reorganize the scientific and technical research and services laboratory program into the following operational units:</text> 
<paragraph id="HCF9AD35CEDB540BF9C0403C415AF03C2"><enum>(1)</enum><text display-inline="yes-display-inline">The Physical Measurement Laboratory, whose mission is to realize and disseminate the national standards for length, mass, time and frequency, electricity, temperature, force, and radiation by activities including fundamental research in measurement science, the provision of measurement services and standards, and the provision of testing facilities resources for use by the Federal Government.</text> </paragraph> 
<paragraph id="H95C62F0609C6412481AD0B507DE990FB"><enum>(2)</enum><text display-inline="yes-display-inline">The Information Technology Laboratory, whose mission is to develop and disseminate standards, measurements, and testing capabilities for interoperability, security, usability, and reliability of information technologies, including cybersecurity standards and guidelines for Federal agencies, United States industry, and the public, through fundamental and applied research in computer science, mathematics, and statistics.</text></paragraph> 
<paragraph id="H726809575DAB4C2B94040FFCC838EBD0"><enum>(3)</enum><text display-inline="yes-display-inline">The Engineering Laboratory, whose mission is to develop and disseminate advanced manufacturing and construction technologies to the United States manufacturing and construction industries through activities including measurement science research, performance metrics, tools for engineering applications, promotion of green infrastructure, and energy efficiency measurements and standards. </text></paragraph> 
<paragraph id="H9E33652488D94F828CC128C47DD60A46"><enum>(4)</enum><text display-inline="yes-display-inline">The Material Measurement Laboratory, whose mission is to serve as the national reference laboratory in biological, chemical, and material sciences and engineering through activities including fundamental research in the composition, structure, and properties of biological and environmental materials and processes, the development of certified reference materials and critically evaluated data, and other programs to assure measurement quality in materials and biotechnology fields.</text> </paragraph> 
<paragraph id="H498E10A4041C409B9EF53C2C8F481353"><enum>(5)</enum><text display-inline="yes-display-inline">The Center for Nanoscale Science and Technology, a national shared-use facility for nanoscale fabrication and measurement, whose mission is to develop innovative nanoscale measurement and fabrication capabilities to support researchers from industry, institutions of higher education, the National Institute of Standards and Technology, and other Federal agencies in nanoscale technology from discovery to production.</text></paragraph> 
<paragraph id="HDFE37DD3B81E49F09BF554C46AC4644A"><enum>(6)</enum><text display-inline="yes-display-inline">The NIST Center for Neutron Research, a national shared-use facility, whose mission is to provide neutron-based measurement capabilities to researchers from industry, institutions of higher education, the National Institute of Standards and Technology, and other Federal agencies in support of materials research, nondestructive evaluation, neutron imaging, chemical analysis, neutron standards, dosimetry, and radiation metrology.</text></paragraph></subsection> 
<subsection id="H3BFA40B620F34F11A285F9E9BC29398D"><enum>(b)</enum><header>Revision</header> 
<paragraph id="H696C5276EAD44694BA06239F3AC57DB4"><enum>(1)</enum><header>In general</header><text>Subsequent to the reorganization required under <internal-xref idref="H4CE415EAC4414DF4846FEB5F5F7222A7" legis-path="4.(a)">subsection (a)</internal-xref>, the Director may revise the organization of the scientific and technical research and services laboratory program.</text></paragraph> 
<paragraph id="HD1503FC9BE4348808D85C4097FCF1156"><enum>(2)</enum><header>Report to Congress</header><text>Any revision to the organization of such program under <internal-xref idref="H696C5276EAD44694BA06239F3AC57DB4" legis-path="4.(b)(1)">paragraph (1)</internal-xref> shall be submitted in a report to the Committee on Science and Technology of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate at least 60 days before the effective date of such revision. </text></paragraph></subsection></section>

<subsection id="H31CAC3C027BD4AB290C51578AA8A9DEC"><enum>(a)</enum><header>Coordination</header><text display-inline="yes-display-inline">Section 2(b) of the National Institute of Standards and Technology Act (15 U.S.C. 272(b)) is amended—</text> 
<paragraph id="HD684C6FA6E4B4268ABA8D44682EC8C25"><enum>(1)</enum><text>in paragraph (12), by striking <quote>and</quote> after the semicolon;</text></paragraph> 
<paragraph id="H7F99EACFEF3A482EAFD57352682052BB"><enum>(2)</enum><text>in paragraph (13), by striking the period at the end and inserting a semicolon; and</text></paragraph> 
<paragraph id="HFDE5D91A93CF4E659C660D10A01003DB"><enum>(3)</enum><text>by adding after paragraph (13) the following:</text>

<subparagraph id="H47522FA8866D45F18F8F721287E93F9E"><enum>(A)</enum><text>coordinate and determine Federal Government positions on specific policy issues related to international technical standards and conformity assessment-related activities; and</text></subparagraph> 
<subparagraph id="HEC7FA6BCA0514AA990A885C5BE8F5B85"><enum>(B)</enum><text>coordinate Federal department and agency engagement in the development of international technical standards and conformity assessment-related activities.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H26D0A1903740409A9CB7462357F1DD72"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">The Director, in consultation with appropriate Federal agencies, shall submit a report annually to Congress addressing the Federal Government’s technical standards and conformity assessment-related activities. The report shall identify—</text> 
<paragraph id="H76B7BEE2F05F4BCBB84B46CB657822A2"><enum>(1)</enum><text>current and anticipated international standards and conformity assessment-related issues that have the potential to impact the competitiveness and innovation capabilities of the United States;</text></paragraph> 
<paragraph id="H61889703791E43AB8A80901ECE6EDCFF"><enum>(2)</enum><text>any action being taken by the Federal Government to address these issues and the Federal agency taking that action; and</text></paragraph> 
<paragraph id="HF4CA57392E31498BBC039FB1CB91D228"><enum>(3)</enum><text>any action that the Director is taking or will take to ensure effective Federal Government engagement on technical standards and conformity assessment-related issues, as appropriate, where the Federal Government is not effectively engaged.</text></paragraph></subsection></section> 
<section id="H74F2F1BE1163436FB58D7A9808ADCF0B"><enum>6.</enum><header>Manufacturing extension partnership</header> 
<subsection id="H173B1190A8E642CB87FC4A7A252AC4B6"><enum>(a)</enum><header>Community college support</header><text>Section 25(a) of the National Institute of Standards and Technology Act (15 U.S.C. 278k(a)) is amended—</text> 
<paragraph id="H75E04D15CBD748F1BA12A61BF72E3F39"><enum>(1)</enum><text>in paragraph (4), by striking <quote>and</quote> after the semicolon;</text></paragraph>

<subparagraph id="HE3EABE3B870F43B2998EA1FF19151896"><enum>(B)</enum><text>accelerating the domestic commercialization of new product technologies, including components for renewable energy systems.</text></subparagraph></paragraph> 
<paragraph id="HFA7BF794F2524764A3BEEB7E335A2878"><enum>(2)</enum><header>Market demand</header><text>The Director may not undertake any activity to accelerate the domestic commercialization of a new product technology under this subsection unless an analysis of market demand for the new product technology has been conducted.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H850C487AFDED473FA3D02F3EEFBE0673"><enum>(2)</enum><header>Grants</header><text>Section 33 of such Act (15 U.S.C. 278r) is amended by adding at the end the following:</text>

<paragraph id="H297ACF96B0A84C199E9F85BE662655B7"><enum>(2)</enum><header>Criteria</header><text>In conducting such assessment, the Director shall use the criteria established pursuant to the Malcolm Baldrige National Quality Award under section 17(d)(1)(C) of the Stevenson-Wydler Technology Innovation Act of 1980 (15 U.S.C. 3711a(d)(1)(C)).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H7D8DB92965654869962E5B7FA6F730D5"><enum>(d)</enum><header>Hollings Manufacturing Extension Partnership Program Cost-Sharing</header><text>Section 25(c) of such Act (15 U.S.C. 278k(c)) is amended—</text> 
<paragraph id="H0D807AF452AA4657A7B2E90A1AE8B271"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), by inserting <quote>, unless otherwise determined under paragraph (3)(C)</quote> before the period at the end;</text></paragraph>

An adjustment to a Center’s cost share in a year shall not affect the amount of Federal funds such Center receives in such year.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph>

<paragraph id="H3F486B78B94741E38C7436E62A5D191A"><enum>(1)</enum><text>biological drug research and development;</text></paragraph> 
<paragraph id="HC2A6592663F2428786CE1F2265CAFC4A"><enum>(2)</enum><text>molecular diagnostics;</text></paragraph> 
<paragraph id="H4385DC54FB864210B40B9F40604FFD8D"><enum>(3)</enum><text>medical imaging technologies; and</text></paragraph> 
<paragraph id="HA56865BA531F48F591159B45E3580829"><enum>(4)</enum><text>personalized medicine.</text></paragraph></subsection> 
<subsection id="H1D67B1586E4342FABF3BE4CAA917BD07"><enum>(b)</enum><header>University Research Centers</header> 
<paragraph id="H685C9B4A2737460FAC3F0BDA9537F308"><enum>(1)</enum><header>Establishment</header><text>The Director may establish research centers at institutions of higher education (in this section referred to as <quote>university research centers</quote>) through a competitive application process to conduct research that furthers the objectives of the bioscience research program.</text></paragraph> 
<paragraph id="H7CE950554F4247598E01E7B977D93F1C"><enum>(2)</enum><header>Application</header> 
<subparagraph id="HEE1D2C856BF946E889867F0A89887392"><enum>(A)</enum><header>In general</header><text>An institution of higher education seeking to establish a university research center under this subsection shall submit an application to the Director at such time, in such manner, and containing such information and assurances as the Director may require.</text></subparagraph> 
<subparagraph id="H3776517956BC40B19A4E82D90B73B66D"><enum>(B)</enum><header>Components</header><text>The application shall include, at a minimum, a description of—</text> 
<clause id="H32EDFB45FDC44997993CBF2A91C830B4"><enum>(i)</enum><text>the relevant research and instructional capacity of the applicant;</text></clause> 
<clause id="HF49D7335DC31445DABDDEA6868862214"><enum>(ii)</enum><text>the research projects that will be undertaken by the applicant;</text></clause> 
<clause id="H3A818B7BA38941CBB8E07E23C41EDC6F"><enum>(iii)</enum><text>the extent to which the applicant will partner with industry and the role industry will play in the research undertaken by the university research center;</text></clause> 
<clause id="HB4AD91B1AAA14BD6AAD0D6BE5AF0C0BD"><enum>(iv)</enum><text>how the applicant will disseminate research results effectively; and</text></clause> 
<clause id="H0F50B4FD28B64BF6B61607BC01B45CF6"><enum>(v)</enum><text>the metrics that will be used to evaluate the success of the projects under clause (ii) and the contribution of the university research center in furthering the objectives of the bioscience research program. </text></clause></subparagraph></paragraph> 
<paragraph id="H828439D5B88A40B481CC4450CFAFF6BB"><enum>(3)</enum><header>Assessment</header><text>Not later than 3 years after the date on which a university research center is established and every 3 years thereafter, the Director shall evaluate the university research center for its contributions to the bioscience research program.</text></paragraph> 
<paragraph id="HE136AB9498DF466281AB175D9BE80F1D"><enum>(4)</enum><header>Annual meeting</header><text>If the Director establishes more than 1 university research center, the Director shall convene an annual meeting of researchers from all of the university research centers and the Institute to foster collaboration and communication.</text></paragraph></subsection> 
<subsection id="H45CDAD7AD0A14D40AFBD1725717EC158"><enum>(c)</enum><header>User Facility</header><text display-inline="yes-display-inline">The Director may establish a bioscience user facility to provide access to advanced or unique equipment, services, materials, and other resources to industry, institutions of higher education, nonprofit organizations, and government agencies to perform research and testing.</text></subsection> 
<subsection id="H1BE42898A3AE4FE7ACB90D695399007F"><enum>(d)</enum><header>Postdoctoral fellows</header><text display-inline="yes-display-inline">The Director shall, to the extent practicable, assign 1 or more fellows from the postdoctoral fellowship program established in section 19 to the bioscience research program.</text></subsection> 
<subsection id="HC496B1B61061415D9BCE62465CDF8BA8"><enum>(e)</enum><header>Programmatic planning document</header><text display-inline="yes-display-inline">The Director shall ensure that the updates to the programmatic planning document transmitted to Congress under section 23(d) include the bioscience research program.</text></subsection> 
<subsection id="H6D66CCC44F614907B476979C840B896B"><enum>(f)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H8AA856787E234FC6B780A028ECEA3830"><enum>(1)</enum><header>Bioscience research program</header><text display-inline="yes-display-inline">The term <quote>bioscience research program</quote> means the research and development program authorized under <internal-xref idref="H9D05545F31194980B264C122EB71E2AB" legis-path="__.(a)">subsection (a)</internal-xref>.</text></paragraph> 
<paragraph id="H33C3193EA5494C108E8DBEDDAE792AC8"><enum>(2)</enum><header>Institution of higher education</header><text>The term <quote>institution of higher education</quote> has the same meaning given the term in section 101(a) of the Higher Education Act of 1965 (20 U.S.C. 1001(a)).</text></paragraph> </subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H301FC20F4DFA4BE8B7AC588820A169F4"><enum>(b)</enum><header>Visiting Committee on Advanced Technology amendments</header><text>Section 10 of the National Institute of Standards and Technology Act (15 U.S.C. 278) is amended—</text> 
<paragraph id="HD6DD7846A1064847977D72B832370ECD"><enum>(1)</enum><text>in subsection (a)—</text>
