		<official-title>To amend the Servicemembers Civil Relief Act to enhance
		  the protection of credit ratings of servicemembers serving on active duty, and
		  for other purposes.</official-title>

		<section id="HB9FCDDC80553492E8D2889FEB6B2EDD8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>National Heroes Credit Protection
			 Act</short-title></quote>.</text>
		</section><section id="H0745B74C64C743EB89418C7874EBE1F8"><enum>2.</enum><header>Protection of
			 credit ratings of servicemembers serving on active duty</header>
			<subsection id="HF37E3A9329B44F53896407E3FA20C64A"><enum>(a)</enum><header>In
			 general</header><text>Title II of the Servicemembers Civil Relief Act (50
			 U.S.C. App. 521 et seq.) is amended by adding at the end the following new
			 section:</text>
				<quoted-block display-inline="no-display-inline" id="H7C8A42E87BD8406C8A54D32A19905389" style="OLC">
					<section id="H8286CCAF7153485085A520A27933C8D3"><enum>208.</enum><header>Protection of
				credit ratings of servicemembers serving on active duty</header>
						<subsection id="H2DBDB053E28B4A6CA74CC85EA12FCDD3"><enum>(a)</enum><header>Request for
				military service deployment alert</header><text display-inline="yes-display-inline">After serving on active duty for a period
				of more than 180 days, a servicemember may submit a request directly to a
				consumer reporting agency that it include a military service deployment alert
				in the file of that servicemember at the consumer reporting agency.</text>
						</subsection><subsection id="H5AC1C8786ABB4917B32FB347510C1A1C"><enum>(b)</enum><header>Responsibilities
				of consumer reporting agencies</header><text>Upon receiving a request from a
				servicemember under subsection (a), a consumer reporting agency shall perform
				the following:</text>
							<paragraph id="H3EC5371A88F1452098245B85C7D9CED1"><enum>(1)</enum><text>Include a military
				service deployment alert in the file of that servicemember and provide the
				military service deployment alert to each person who requests the credit score
				or consumer report of the servicemember until the date that is the earlier
				of—</text>
								<subparagraph id="H1EA1F57842E04577957AAD4120500733"><enum>(A)</enum><text>the date that is
				seven years after the date on which the servicemember requests the military
				service deployment alert; or</text>
								</subparagraph><subparagraph id="HD2D3B047FC534B738101DA1A26467228"><enum>(B)</enum><text>the date on
				which—</text>
									<clause id="HB05EB6176B244E1CB46DE932BB19E148"><enum>(i)</enum><text>the servicemember submits directly to the consumer reporting agency a request
				stating that such military service deployment alert be removed from such file;
				and</text>
									</clause><clause id="HFE84D56813C94617BA76066C4C96958B"><enum>(ii)</enum><text>the agency
				receives proof of the identity of the servicemember making such request.</text>
									</clause></subparagraph></paragraph><paragraph id="H965C3E2163CA4A2CAEDEB1DDB8B59C13"><enum>(2)</enum><text>Develop and
				maintain procedures for the referral to other such agencies of any military
				service deployment alert received by the agency.</text>
							</paragraph></subsection><subsection id="HFF09F575D3784CC8BB0D1D097A268F6F"><enum>(c)</enum><header>Duty of reseller
				To reconvey military service deployment alert</header><text display-inline="yes-display-inline">A reseller shall include in any consumer
				report of the reseller on a servicemember any military service deployment alert
				placed in the file of that servicemember by another consumer reporting agency
				pursuant to this section.</text>
						</subsection><subsection id="H25A9FCDA880F4D8DBE470AAFB0DAD64B"><enum>(d)</enum><header>Acknowledgment
				of military service deployment alert</header><text display-inline="yes-display-inline">Any prospective user of a consumer credit
				report containing a military service deployment alert shall acknowledge to the
				servicemember the receipt of such military service deployment alert.</text>
						</subsection><subsection id="HE2ED56E5A519494F8F3D1941EA3B7AEF"><enum>(e)</enum><header>Definitions</header><text>For
				the purposes of this section:</text>
							<paragraph id="H0AC55B32908247049E3FFC0C111BCFF2"><enum>(1)</enum><text>The term
				<term>active duty</term> has the meaning given that term under section
				101(d)(1) of title 10, United States Code.</text>
							</paragraph><paragraph id="HFB23200E099041D5838978B0062DEAD3"><enum>(2)</enum><text>The term
				<term>consumer reporting agency</term> has the meaning given the term
				<term>consumer reporting agency that compiles and maintains files on consumers
				on a nationwide basis</term> under section 603(p) of the Fair Credit Reporting
				Act (15 U.S.C. 1681a(p)).</text>
							</paragraph><paragraph id="H31A1BDAAEE7944B685C61B22F0F415DC"><enum>(3)</enum><text>The term
				<term>military service deployment alert</term> means a code generated by a
				consumer reporting agency that is delivered in conjunction with a consumer
				report or credit score to a user of the consumer report or credit score to
				indicate that the consumer report or credit score of the consumer may have been
				adversely affected during a period in which the consumer was a servicemember
				serving on active duty.</text>
							</paragraph><paragraph id="HB027E46582EA45A5B60811CB22C9ED4C"><enum>(4)</enum><text>The term
				<term>reseller</term> has the meaning given that term under section 603(u) of
				the Fair Credit Reporting Act (15 U.S.C.
				1681a(u)).</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HDD5268BC50444744B6F1404B6734B26D"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of contents in section 1(b) of such Act is
			 amended by inserting after the item relating to section 207 the following new
			 item:</text>

						<toc-entry level="section">Sec. 208. Protection of credit ratings of
				servicemembers serving on active

					</toc>
					<after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H33C9F4B50C2346B0AEFF37EECEFA46D6"><enum>(c)</enum><header>Military service
			 deployment alert not To affect certain future
			 transactions</header><text>Section 108 of such Act (50 U.S.C. App. 518) is
			 amended in the matter preceding paragraph (1) by inserting after
			 <quote>liability of that servicemember</quote> the following: <quote>, or the
			 inclusion of a military service deployment alert in a file of the servicemember
			 at a consumer reporting agency pursuant to section 208, </quote>.</text>
			</subsection><subsection commented="no" id="H8C40EC4972144B789BA66E59F6C2E038"><enum>(d)</enum><header>Effective
			 date</header><text>The amendments made by this section shall take effect on the
			 date that is 180 days after the date of the enactment of this Act.</text>
