		<section id="H7462DC7BA8394BE4A9226B7F804D7AA0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Health Information Technology
			 Extension for Behavioral Health Services Act of 2010</short-title></quote>.</text>
		</section><section id="H09183BF7348A41CC80370EE797180E96"><enum>2.</enum><header>Extension of
			 health information technology assistance for behavioral and mental health and
			 substance abuse</header><text display-inline="no-display-inline">Section
			 3000(3) of the Public Health Service Act (42 U.S.C. 300jj(3)) is amended by
			 inserting before <quote>and any other category</quote> the following:
			 <quote>behavioral and mental health professionals (as defined in section
			 331(a)(3)(E)(i)), a substance abuse professional, a psychiatric hospital (as
			 defined in section 1861(f) of the Social Security Act (42 U.S.C. 1395x(f))), a
			 behavioral and mental health clinic, a substance abuse treatment
			 facility,</quote>.</text>
		</section><section id="HE055565685E14607B831B57493A72C77"><enum>3.</enum><header>Behavioral health
			 information technology grant program</header><text display-inline="no-display-inline">Title XXX of the Public Health Service Act
			 (42 U.S.C. 300jj et seq.) is amended by adding at the end the following new
			 section:</text>
			<quoted-block display-inline="no-display-inline" id="H0F976418A2B44287B7CF3F46A2167C7C" style="OLC">
				<section id="H8D23B64D01A044268E68EA9BF9FD4C31"><enum>3019.</enum><header>Behavioral
				health information technology grant program</header>
					<subsection id="H5CB25567D7E84814AA21253055820291"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Secretary, acting
				through the National Coordinator, shall award grants to eligible entities for
				the purpose of conducting activities described in subsection (b).</text>
					</subsection><subsection id="H4482B5DA171C485EB79E0CAD45625B3F"><enum>(b)</enum><header>Use of
				funds</header><text>A grant awarded under subsection (a) may be used by an
				eligible entity to—</text>
						<paragraph id="HA8DBE61F7CF647A68824032D9219A796"><enum>(1)</enum><text>facilitate the
				purchase of health information technology;</text>
						</paragraph><paragraph id="H8EF91626F7A94CDE95AD6A25DFB86ECB"><enum>(2)</enum><text>enhance the use of
				health information technology, including covering costs associated with
				upgrading health information technology in order to meet the criteria required
				to become a certified EHR technology;</text>
						</paragraph><paragraph id="HB7186945D7E543E7A5D8C4ABCCF9E6B3"><enum>(3)</enum><text>train personnel in
				the use of health information technology;</text>
						</paragraph><paragraph id="H6177154CF6744CCD86A2C04596C9A32B"><enum>(4)</enum><text display-inline="yes-display-inline">improve the secure electronic exchange of
				health information among behavioral and mental health professionals, substance
				abuse professionals, and other health care providers, including those providing
				primary care services;</text>
						</paragraph><paragraph commented="no" id="H39BABB42708B4C7CB7BBCB0C1C847959"><enum>(5)</enum><text>improve health
				information technology for adaptation to community-based behavioral heath
				settings;</text>
						</paragraph><paragraph id="H3E80F55C96944F0590EF7A1CF515F12F"><enum>(6)</enum><text>assist with the
				implementation of telemedicine, including facilitation of distance clinical
				consultations in rural and underserved areas; and</text>
						</paragraph><paragraph commented="no" id="HF40B1C0D95014883978126BC7F0919FF"><enum>(7)</enum><text>collaborate and
				integrate with health information technology regional extension centers (as
				described in section 3012(c)).</text>
						</paragraph></subsection><subsection commented="no" id="H94814395BBE744C5A5BF42D60299DAD2"><enum>(c)</enum><header>Eligible
				entity</header><text display-inline="yes-display-inline">For the purposes of
				this section, the term <quote>eligible entity</quote> means a mental health
				treatment facility, substance abuse treatment facility, or psychiatric hospital
				(as defined in section 1861(f) of the Social Security Act (42 U.S.C.
				1395x(f)))—</text>
						<paragraph commented="no" id="H1C72B6E640AF49979FCF0EDB55502F04"><enum>(1)</enum><text>that is not
				otherwise receiving payment under section 1886(n) of the Social Security Act
				(42 U.S.C. 1395ww(n)) or section 1903(t) of the Social Security Act (42 U.S.C.
				1396b(t));</text>
						</paragraph><paragraph id="H7E350A95F8554EAFA3AE5FF05BB4A522"><enum>(2)</enum><text>at which no
				services are furnished by an eligible professional who is receiving payment
				under section 1848(o) of the Social Security Act (42 U.S.C. 1395w–4(o));
				and</text>
						</paragraph><paragraph commented="no" id="HD21DE231AFE648A1A2BC7714DCBA47F7"><enum>(3)</enum><text display-inline="yes-display-inline">that provides assurances to the
				satisfaction of the Secretary that such facility will use such funds to satisfy
				the requirements to be treated as a meaningful EHR user, as defined in section
				1886(n)(3) of the Social Security Act (42 U.S.C. 1395ww(n)(3)), or to become
				eligible for a payment under section 1903(t) of the Social Security Act (42
				U.S.C. 1396b(t)).</text>
						</paragraph></subsection><subsection commented="no" id="HF926C9A9D79C4741939C81A626BA546C"><enum>(d)</enum><header>Standards for
				acquisition of health information technology</header><text>To the greatest
				extent practicable, the Secretary shall ensure that where funds are expended
				under this section for the acquisition of health information technology, such
				funds shall be used to acquire health information technology that meets
				applicable standards adopted under section 3004. Where it is not practicable to
				expend funds on health information technology that meets such applicable
				standards, the Secretary shall ensure that such health information technology
				meets applicable standards otherwise adopted by the Secretary.</text>
					</subsection><subsection id="H6695131EB9594360951945617752DFF8"><enum>(e)</enum><header>Report</header><text>Not
				later than 2 years after the date of the enactment of this section, the
				National Coordinator shall submit to Congress a report containing such
				information as the Secretary may require.</text>
					</subsection><subsection id="H438E08791AE3447E954367F4A7588032"><enum>(f)</enum><header>Authorization of
				appropriations</header><text>For the purposes of carrying out subsection (a),
				there is authorized to be appropriated $15,000,000 for fiscal year
				2011.</text>
					</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HE8536BF4DBFE494E9B5251FF9859CC53"><enum>4.</enum><header>Extension of
			 eligibility for Medicare and Medicaid health information technology
			 implementation assistance</header>
			<subsection commented="no" id="H706F768E62BE47B98E2DF899E7CE8056"><enum>(a)</enum><header>Payment
			 incentives for eligible professionals under Medicare</header><text display-inline="yes-display-inline">Section 1848 of the Social Security Act (42
			 U.S.C. 1395w–4) is amended—</text>
				<paragraph commented="no" id="HF7101024B7DD44758CB5D6AE58CD94E5"><enum>(1)</enum><text>by amending clause
			 (iii) of subsection (a)(7)(E) to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="HB638B41DB4034803B03543951D3325E2" style="OLC">
						<clause commented="no" id="H4E76FA84A330458DA06209DECC891CA0"><enum>(iii)</enum><header>Eligible
				professional</header><text display-inline="yes-display-inline">The term
				<quote>eligible professional</quote> means any of the following:</text>
							<subclause commented="no" id="HF83BDCFC6CAE483C9838990F68D1CEC0"><enum>(I)</enum><text display-inline="yes-display-inline">A physician (as defined in section
				1861(r)).</text>
							</subclause><subclause commented="no" id="HB5051205A3C04C0AA99D2EC4467FD758"><enum>(II)</enum><text display-inline="yes-display-inline">A clinical psychologist providing qualified
				psychologist services (as defined in section 1861(ii)).</text>
							</subclause><subclause commented="no" id="H639CFECCBE954A8AA2F5C13975F2DE10"><enum>(III)</enum><text display-inline="yes-display-inline">A clinical social worker (as defined in
				section 1861(hh)(1)).</text>
							</subclause></clause><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" id="H58AB85E1760F4437BDBAAE4E60B48CB5"><enum>(2)</enum><text display-inline="yes-display-inline">by amending subparagraph (C) of subsection
			 (o)(5) to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="HE4F30F0E87D2490885A754AB5CF90673" style="OLC">
						<subparagraph commented="no" id="H1A11CF715985448C9DA91A8225CADB07"><enum>(C)</enum><header>Eligible
				professional</header><text display-inline="yes-display-inline">The term
				<quote>eligible professional</quote> means any of the following:</text>
							<clause commented="no" id="H9F39F4DE4AC84E609B2EA675922318C6"><enum>(i)</enum><text>A physician (as
				defined in section 1861(r)).</text>
							</clause><clause commented="no" id="H8EDA50378E964E1B9416D17CA0BF9941"><enum>(ii)</enum><text display-inline="yes-display-inline">A clinical psychologist providing qualified
				psychologist services (as defined in section 1861(ii)).</text>
							</clause><clause commented="no" id="H3FF0DD8715754D4287E7C82F2CDB14BC"><enum>(iii)</enum><text>A clinical
				social worker (as defined in section
				1861(hh)(1)).</text>
							</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" id="H6897FE3785564160BB66A6212E5B4B88"><enum>(b)</enum><header>Eligible
			 hospitals</header><text>Section 1886(n)(6)(B) of the Social Security Act (42
			 U.S.C. 1395ww(n)(6)(B)) is amended by inserting before the period the
			 following: <quote>or an inpatient hospital that is a psychiatric hospital (as
			 defined in section 1861(f))</quote>.</text>
			</subsection><subsection id="HFFDEC6F2666B47EB93FEAB605F72CDC7"><enum>(c)</enum><header>Medicaid
			 providers</header><text>Section 1903(t) of the Social Security Act (42 U.S.C.
			 1396b(t)) is amended as follows:</text>
				<paragraph id="H6F692D7AC0F84ADFA44DBCFAF83A74D4"><enum>(1)</enum><text>Paragraph (2)(B)
			 is amended—</text>
					<subparagraph display-inline="no-display-inline" id="H46B95FF2C8724A209C0CB276B0E47A6E"><enum>(A)</enum><text>in clause (i), by
			 striking <quote>, or</quote> and inserting a semicolon;</text>
					</subparagraph><subparagraph id="HB1CCC26AAC48475F81D2D2EEACC66885"><enum>(B)</enum><text>in clause (ii), by
			 striking the period and inserting a semicolon; and</text>
					</subparagraph><subparagraph id="HA5BE48BF57EB44768C08CDEF7BD3AA36"><enum>(C)</enum><text>by adding after
			 clause (ii) the following new clauses:</text>
						<quoted-block display-inline="no-display-inline" id="HC8EDED4616B34FA68F7060BA4C95D0D8" style="OLC">
							<clause id="H728CF607F80743F2937DE59D0F99BBE0"><enum>(iii)</enum><text display-inline="yes-display-inline">a public hospital that is principally a
				psychiatric hospital (as defined in section 1861(f));</text>
							</clause><clause id="H86037FA794C44B25B3FF60072C808F33"><enum>(iv)</enum><text display-inline="yes-display-inline">a private hospital that is principally a
				psychiatric hospital (as defined in section 1861(f)) and that has at least 10
				percent of its patient volume (as estimated in accordance with a methodology
				established by the Secretary) attributable to individuals receiving medical
				assistance under this title;</text>
							</clause><clause id="HB985A218621D45948157680939490B90"><enum>(v)</enum><text display-inline="yes-display-inline">a mental health treatment facility that has
				at least 10 percent of its patient volume (as estimated in accordance with a
				methodology established by the Secretary) attributable to individuals receiving
				medical assistance under this title; or</text>
							</clause><clause id="H5D820AEC8C524FDA9D90DB531618E93A"><enum>(vi)</enum><text display-inline="yes-display-inline">a substance abuse treatment facility that
				has at least 10 percent of its patient volume (as estimated in accordance with
				a methodology established by the Secretary) attributable to individuals
				receiving medical assistance under this
				title.</text>
							</clause><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H1BBC55E7B64347F09494870C99FBACF4"><enum>(2)</enum><text>Paragraph (3)(B)
			 is amended—</text>
					<subparagraph id="H4B5516FBB6814B338D1884BCBF6F27B6"><enum>(A)</enum><text>in clause (iv), by
			 striking <quote>and</quote> after the semicolon;</text>
					</subparagraph><subparagraph id="H25584263B3994FA785FD545495CB7A07"><enum>(B)</enum><text>in clause (v), by
			 striking the period and inserting a semicolon; and</text>
					</subparagraph><subparagraph id="H71A042A040044F36BEE76567F2C788C0"><enum>(C)</enum><text>by adding at the
			 end the following new clauses:</text>
						<quoted-block display-inline="no-display-inline" id="H5B6B978359894E27AC5CC29CCBD66D14" style="OLC">
							<clause id="HFE1564BC61864C068B3EDA74782C81C0"><enum>(vi)</enum><text display-inline="yes-display-inline">clinical psychologist providing qualified
				psychologist services (as defined in section 1861(ii)), if such clinical
				psychologist is practicing in an outpatient clinic that—</text>
								<subclause id="H2B96B58014A84F708811A151DCF733A3"><enum>(I)</enum><text>is led by a
				clinical psychologist; and</text>
								</subclause><subclause id="HFD09465C89E44C3CBCAB0B2A2CF8A488"><enum>(II)</enum><text>is not otherwise
				receiving payment under paragraph (1) as a Medicaid provider described in
				paragraph (2)(B); and</text>
								</subclause></clause><clause id="HBB908BC8A0BF4B1D8388C90C5E625F77"><enum>(vii)</enum><text display-inline="yes-display-inline">clinical social worker (as defined in
				section 1861(hh)(1)), if such clinical social worker is practicing in an
				outpatient clinic that—</text>
								<subclause id="H3801A8F586A64B9B8654D0FC36D1B6CE"><enum>(I)</enum><text>is led by a
				clinical social worker; and</text>
								</subclause><subclause id="H6CE819F6B1384BEAAC9F2078775B9439"><enum>(II)</enum><text>is not otherwise
				receiving payment under paragraph (1) as a Medicaid provider described in
				paragraph
				(2)(B).</text>
