		<official-title>To amend title 18, United States Code, to prohibit
		  certain conduct relating to the use of horses for human
		  consumption.</official-title>

		<section id="H1F79089A3D2543D6AE4F7D7728FF1B00" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Prevention of Equine Cruelty Act of
			 2009</short-title></quote>.</text>
		</section><section id="HF6500C62A4624AB8BF00136071D3FB62"><enum>2.</enum><header>Slaughter of
			 horses for human consumption</header>
			<subsection id="HC584CB622AE549908031DADAC32B6279"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Chapter 3 of title
			 18, United States Code, is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H0C3713875FCB4A3587C65011DCEA29EB" style="USC">
					<section id="HFE5D8B29B58C4CC8853190FD626C56C"><enum>50.</enum><header>Slaughter of
				horses for human consumption</header>
						<subsection id="H4D29ABF9E12E4B4FA7AEF44E9D40E198"><enum>(a)</enum><text display-inline="yes-display-inline">Except as provided in subsection (b),
				whoever knowingly—</text>
							<paragraph id="HBD3BC1E4B5FB4E60B600B3BADABBA726"><enum>(1)</enum><text>possesses, ships,
				transports, purchases, sells, delivers, or receives, in or affecting interstate
				commerce or foreign commerce, any horse with the intent that it is to be
				slaughtered for human consumption; or</text>
							</paragraph><paragraph id="H08A3F7A30B8E42E3BF48135BE7A6E415"><enum>(2)</enum><text display-inline="yes-display-inline">possesses, ships, transports, purchases,
				sells, delivers, or receives, in or affecting interstate commerce or foreign
				commerce, any horse flesh or carcass or part of a carcass, with the intent that
				it is to be used for human consumption;</text>
							</paragraph><continuation-text continuation-text-level="subsection">shall be
				fined under this title or imprisoned not more than three years or both.</continuation-text></subsection><subsection id="H045630C452E94A57A1FC11863BC67A5"><enum>(b)</enum><text display-inline="yes-display-inline">If—</text>
							<paragraph id="H89A49F83E6C54539952154B94891502F"><enum>(1)</enum><text>the defendant
				engages in conduct that would otherwise constitute an offense under subsection
				(a);</text>
							</paragraph><paragraph id="H878DDD3C455A44D6A30030CDC0B78B85"><enum>(2)</enum><text>the defendant has
				no prior conviction under this section; and</text>
							</paragraph><paragraph id="H07686986082A402BABC006A5A3F0AFE9"><enum>(3)</enum><text>the conduct
				involves less than five horses or less than 2000 pounds of horse flesh or
				carcass or part of a carcass;</text>
							</paragraph><continuation-text continuation-text-level="subsection">the
				defendant shall, instead of being punished under that subsection, be fined
				under this title or imprisoned not more than one year, or both.</continuation-text></subsection><subsection id="HEEE7073906924F9A00B3808E73E1ECA6"><enum>(c)</enum><text>As used in this
				section, the term <quote>horse</quote> means any member of the family
				Equidae.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HCAE0866BB98D460D9264BB6BF1F5008F"><enum>(b)</enum><header>Clerical
			 amendment</header><text display-inline="yes-display-inline">The table of
			 sections for chapter 3 of title 18, United States Code, is amended by adding at
			 the end the following new item:</text>
