		<section commented="no" display-inline="no-display-inline" id="H3F14AE4D74BF4E8D903504B2FD8C71A9" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Home Star Energy Retrofit Act of
			 2010</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="H8348A8EECF834E218B3963144A300E0E" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph commented="no" display-inline="no-display-inline" id="H8B9C27B44C584DEAA14B53364744C018"><enum>(1)</enum><header display-inline="yes-display-inline">Accredited contractor</header><text display-inline="yes-display-inline">The term <term>accredited contractor</term>
			 means a qualified contractor—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="HB6C9A1FD0D1C4B2E89F3F966B4EE3EA4"><enum>(A)</enum><text display-inline="yes-display-inline">that is accredited—</text>
					<clause commented="no" display-inline="no-display-inline" id="HD4941DA3094E492091E2F53EE8704771"><enum>(i)</enum><text display-inline="yes-display-inline">by the BPI; or</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="HAB07FC719A224C278A302A6066099819"><enum>(ii)</enum><text display-inline="yes-display-inline">under other standards that the Secretary
			 shall approve or deny not later than 30 days after submittal, in consultation
			 with the Administrator; and</text>
					</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H832A81B8704441FF85637950B6012CDE"><enum>(B)</enum><text display-inline="yes-display-inline">effective 1 year after the date of
			 enactment of this Act, that uses a certified workforce.</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA2BA16A387474A66807E79F647A201F6"><enum>(2)</enum><header display-inline="yes-display-inline">Administrator</header><text display-inline="yes-display-inline">The term <term>Administrator</term> means
			 the Administrator of the Environmental Protection Agency.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5381BCF190A144308EB23B8E428C1B10"><enum>(3)</enum><header display-inline="yes-display-inline">BPI</header><text display-inline="yes-display-inline">The term <term>BPI</term> means the
			 Building Performance Institute.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2221FEFB378C40F28C5EA37ACDE00031"><enum>(4)</enum><header display-inline="yes-display-inline">Certified workforce</header><text display-inline="yes-display-inline">The term <term>certified workforce</term>
			 means a residential energy efficiency construction workforce in which all
			 employees performing installation work are certified in the appropriate job
			 skills under—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="HAC41F60075EA42F59E20D53F5C2C14D1"><enum>(A)</enum><text display-inline="yes-display-inline">an applicable third party skills standard
			 established by—</text>
					<clause commented="no" display-inline="no-display-inline" id="H311A74B9CD1E4DE58430F836851BA02F"><enum>(i)</enum><text display-inline="yes-display-inline">BPI;</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="HD759D4DF8656420784A79265F835A401"><enum>(ii)</enum><text display-inline="yes-display-inline">North American Technician
			 Excellence;</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="HFF95B1B4A07E4C36904EC92DD267F52A"><enum>(iii)</enum><text display-inline="yes-display-inline">the Laborers’ International Union of North
			 America;</text>
					</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H660B6982581E4CA2AA3FC6377EE5F447"><enum>(B)</enum><text display-inline="yes-display-inline">an applicable third party skills standard
			 established in the State in which the work is to be performed, pursuant to a
			 program operated by the Home Builders Institute in connection with Ferris State
			 University, to be effective 30 days after notice is provided by those
			 organizations to the Secretary that such program has been established in such
			 State, except to the extent that the Secretary determines within 30 days of
			 such notice that the standard or certification is incomplete; or</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7B2D67AB06574F9584A049B4ED7628F7"><enum>(C)</enum><text display-inline="yes-display-inline">other standards that the Secretary shall
			 approve or deny not later than 30 days after submittal, in consultation with
			 the Secretary of Labor and the Administrator.</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB37AE53786B041188B72695DFC190D99"><enum>(5)</enum><header display-inline="yes-display-inline">Conditioned space</header><text display-inline="yes-display-inline">The term <term>conditioned space</term>
			 means the area of a home that is—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="HE1718042C4A04F9DBA225109E2EEF1C5"><enum>(A)</enum><text display-inline="yes-display-inline">intended for habitation; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H07741D9E64FE4ED08E6608267782CB31"><enum>(B)</enum><text display-inline="yes-display-inline">intentionally heated or cooled.</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6A75FCC6952E4720B457B3DFD99A12DA"><enum>(6)</enum><header display-inline="yes-display-inline">DOE</header><text display-inline="yes-display-inline">The term <term>DOE</term> means the
			 Department of Energy.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3F304890AE98464F89C42DB285367BF3"><enum>(7)</enum><header display-inline="yes-display-inline">Electric utility</header><text display-inline="yes-display-inline">The term <term>electric utility</term>
			 means any person, State agency, rural electric cooperative, municipality, or
			 other governmental entity that delivers or sells electric energy at retail or
			 wholesale, including nonregulated utilities and utilities that are subject to
			 State regulation and Federal power marketing administrations.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H52624FACC8B34E81ACBEE08C9BF45613"><enum>(8)</enum><header display-inline="yes-display-inline">EPA</header><text display-inline="yes-display-inline">The term <term>EPA</term> means the
			 Environmental Protection Agency.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF988D1ABA70F46CD92ADE02CA2C7EEA4"><enum>(9)</enum><header display-inline="yes-display-inline">Federal Rebate Processing
			 System</header><text display-inline="yes-display-inline">The term
			 <quote>Federal Rebate Processing System</quote> means the Federal Rebate
			 Processing System established under section 101(b).</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H97A71155FF6640D6B392D2C11295BEF2"><enum>(10)</enum><header display-inline="yes-display-inline">Gold Star Home Energy Retrofit
			 Program</header><text display-inline="yes-display-inline">The term <term>Gold
			 Star Home Energy Retrofit Program</term> means the Gold Star Home Energy
			 Retrofit Program established under section 104.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFDD6CF4EF9F142958BC235D046F963A2"><enum>(11)</enum><header display-inline="yes-display-inline">Home</header><text display-inline="yes-display-inline">The term <term>home</term> means a
			 principal residential dwelling unit in a building with no more than 4 dwelling
			 units that—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="HEAC7607C3C914538AA99D029EEDC599F"><enum>(A)</enum><text display-inline="yes-display-inline">is located in the United States; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H89CFA8D82EB24BE381D4F3604AE6CA40"><enum>(B)</enum><text display-inline="yes-display-inline">was constructed before the date of
			 enactment of this Act.</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H304A5980AD4A4766B04BF9E569F4FCAE"><enum>(12)</enum><header display-inline="yes-display-inline">Indian tribe</header><text display-inline="yes-display-inline">The term <term>Indian tribe</term> has the
			 meaning given the term in section 4 of the <act-name parsable-cite="ISDA">Indian Self-Determination and Education Assistance
			 Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/25/450b">25
			 U.S.C. 450b</external-xref>).</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H087E60D688BD4069BDCFB27AA673C601"><enum>(13)</enum><header display-inline="yes-display-inline">National Home Performance
			 Council</header><text display-inline="yes-display-inline">The term
			 <term>National Home Performance Council</term> means the National Home
			 Performance Council, Inc.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA740241BD23B4BC69D1AAD290F5C4D85"><enum>(14)</enum><header display-inline="yes-display-inline">Natural gas utility</header><text display-inline="yes-display-inline">The term <term>natural gas utility</term>
			 means any person or State agency that transports, distributes, or sells natural
			 gas at retail, including nonregulated utilities and utilities that are subject
			 to State regulation.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFB0D43CC4CB148DF9C99640B869E3972"><enum>(15)</enum><header display-inline="yes-display-inline">Qualified contractor</header><text display-inline="yes-display-inline">The term <term>qualified contractor</term>
			 means a residential energy efficiency contractor meeting minimum applicable
			 requirements as determined under section 101(c).</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFB2FBC88B804486EA8400BAFC1E0508E"><enum>(16)</enum><header display-inline="yes-display-inline">Quality assurance framework</header><text display-inline="yes-display-inline">The term <quote>quality assurance
			 framework</quote> means a policy structure adopted by a State to develop high
			 standards for ensuring quality in ongoing energy efficiency retrofit activities
			 in which the State has a role, including operation of the quality assurance
			 program, while creating significant employment opportunities, in particular for
			 targeted workers.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA3D0CCFB0331439EB951E75C58508427"><enum>(17)</enum><header display-inline="yes-display-inline">Quality assurance program</header>
				<subparagraph commented="no" display-inline="no-display-inline" id="H1213909A8CDB451BB61A4CC8FB63DFAF"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The term <term>quality assurance
			 program</term> means a program authorized under this Act to oversee the
			 delivery of home efficiency retrofit programs to ensure that work is performed
			 in accordance with standards and criteria established under this Act.</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2F9A60ED55C9489A8C8E67D5A1F55C31"><enum>(B)</enum><header display-inline="yes-display-inline">Inclusions</header><text display-inline="yes-display-inline">For purposes of subparagraph (A), delivery
			 of retrofit programs includes field inspections required under this Act, with
			 the consent of participating consumers and without delaying rebate payments to
			 participating contractors and vendors.</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H54051E1CE99C445E97ACB40749CAEEA0"><enum>(18)</enum><header display-inline="yes-display-inline">Quality assurance provider</header>
				<subparagraph commented="no" display-inline="no-display-inline" id="HBB9605A4A7C243CA94FEE64169DE3CD1"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The term <term>quality assurance
			 provider</term> means any entity that is authorized pursuant to this Act to
			 perform field inspections and other measures required to confirm the compliance
			 of retrofit work with the requirements of this Act.</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5B8684F06B5840979E410E8FFE9E2E63"><enum>(B)</enum><header display-inline="yes-display-inline">Certification requirement</header><text display-inline="yes-display-inline">To be considered a quality assurance
			 provider under this paragraph, an entity shall be certified through—</text>
					<clause commented="no" display-inline="no-display-inline" id="HBBCA237E8F564158885F7844BD35776C"><enum>(i)</enum><text display-inline="yes-display-inline">the International Code Council;</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="HADC15A8113614631A4C9C52EF4E9C836"><enum>(ii)</enum><text display-inline="yes-display-inline">the BPI;</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="H817DBF66ABF744819A948F2257A48C3B"><enum>(iii)</enum><text display-inline="yes-display-inline">the RESNET;</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="HD71175DC89C4472E8B4CF02BFB3F02CE"><enum>(iv)</enum><text display-inline="yes-display-inline">a State;</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="HFB2C3A8ACE88493B97A33C4BAE01D1C5"><enum>(v)</enum><text display-inline="yes-display-inline">a State-approved residential energy
			 efficiency retrofit program; or</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="HCB7F4C0FC43942FEAFBF22B05EF4CE43"><enum>(vi)</enum><text display-inline="yes-display-inline">any other entity that is accredited under
			 standards that the Secretary shall approve or deny not later than 30 days after
			 submittal, in consultation with the Administrator.</text>
					</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6516D33E76204ADE9DB49444581B0E49"><enum>(19)</enum><header display-inline="yes-display-inline">Rebate aggregator</header><text display-inline="yes-display-inline">The term <term>rebate aggregator</term>
			 means an entity that meets the requirements of section 102.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE385414B7DF64B1C9CE847C463347F55"><enum>(20)</enum><header display-inline="yes-display-inline">RESNET</header><text display-inline="yes-display-inline">The term <term>RESNET</term> means the
			 Residential Energy Services Network.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1C5A6FF6869540B8BD28424B951477AB"><enum>(21)</enum><header display-inline="yes-display-inline">Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the
			 Secretary of Energy.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB35FED6ED78B487FB24C3FD37EC5BA07"><enum>(22)</enum><header display-inline="yes-display-inline">Silver Star Home Energy Retrofit
			 Program</header><text display-inline="yes-display-inline">The term <term>Silver
			 Star Home Energy Retrofit Program</term> means the Silver Star Home Energy
			 Retrofit Program established under section 103.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H35CD917D12DC468A9571ADDFC234DD4D"><enum>(23)</enum><header display-inline="yes-display-inline">State</header><text display-inline="yes-display-inline">The term <term>State</term> means—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="H4742C56A622242C28C30E295EC51CDA4"><enum>(A)</enum><text display-inline="yes-display-inline">a State;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H91632FA4BE7B4B0BAC37D918FAFA3136"><enum>(B)</enum><text display-inline="yes-display-inline">the District of Columbia;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H31EB55671B504E31A47BAA8D2CF3D9F3"><enum>(C)</enum><text display-inline="yes-display-inline">the Commonwealth of Puerto Rico;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H321A905139E54476B8CEA2027C590445"><enum>(D)</enum><text display-inline="yes-display-inline">Guam;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3502262660504AE691CE207920E55964"><enum>(E)</enum><text display-inline="yes-display-inline">American Samoa;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H0B3E4ECB6FC04605893E598AA49D60C7"><enum>(F)</enum><text display-inline="yes-display-inline">the United States Virgin Islands;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HFD9C5165E142443290CBA5C7BB165BC7"><enum>(G)</enum><text display-inline="yes-display-inline">the Northern Mariana Islands; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H32B5067DB73740E08DC00600805006FC"><enum>(H)</enum><text display-inline="yes-display-inline">any other commonwealth, territory, or
			 possession of the United States.</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H225C4564CE81436E867C6BEB62EF6C30"><enum>(24)</enum><header display-inline="yes-display-inline">Targeted worker</header><text display-inline="yes-display-inline">The term <quote>targeted worker</quote>
			 means an individual who is unemployed or underemployed and of an employable age
			 and a resident of an area with high or chronic unemployment and low median
			 household incomes, as defined by the Secretary in consultation with the
			 Secretary of Labor.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC3F91F1D16664409A0221902AAB87505"><enum>(25)</enum><header display-inline="yes-display-inline">Water utility</header><text display-inline="yes-display-inline">The term <quote>water utility</quote> means
			 any State or local agency that delivers or sells water at wholesale or retail
			 through an engineered distribution system.</text>
			</paragraph></section><title commented="no" id="H62FAFEC1D0914AD483A254DC146E39C8" level-type="subsequent"><enum>I</enum><header display-inline="yes-display-inline">Home Star Retrofit Rebate Program</header>
			<section commented="no" display-inline="no-display-inline" id="H802DA8048F87459184881B61F4BA26CF" section-type="subsequent-section"><enum>101.</enum><header display-inline="yes-display-inline">Home Star Retrofit Rebate Program</header>
				<subsection commented="no" display-inline="no-display-inline" id="H50968A54C2C740058FADEB990CBF82B9"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall establish the Home Star
			 Retrofit Rebate Program.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="HAFD16BEF7F6049AB83F01D3B01DA8EF1"><enum>(b)</enum><header display-inline="yes-display-inline">Federal Rebate processing system</header>
					<paragraph commented="no" display-inline="no-display-inline" id="H05205490BC0E4931B6D41937A26D484F"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 30 days after the date of
			 enactment of this Act, the Secretary, in consultation with the Secretary of the
			 Treasury and the Administrator, shall—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="H2B4B8CC0250E46869FB098E71FC8C48E"><enum>(A)</enum><text display-inline="yes-display-inline">establish a Federal Rebate Processing
			 System which shall serve as a database and information technology system to
			 allow—</text>
							<clause commented="no" display-inline="no-display-inline" id="HD2BEA2E8282C4857A3E36E4FFF0B4FF0"><enum>(i)</enum><text display-inline="yes-display-inline">rebate aggregators to submit claims for
			 reimbursement using standard data protocols;</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="H8573AD89EB744EE093EB788D4AB83761"><enum>(ii)</enum><text display-inline="yes-display-inline">quality assurance reports to be identified
			 with the work for which rebates are claimed; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="HF866F40E7C6C49508DC089697CF75700"><enum>(iii)</enum><text display-inline="yes-display-inline">any Home Star loans to be linked to the
			 work for which they are made;</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H07B92817B7EF4B48B23E5727DC0C8299"><enum>(B)</enum><text display-inline="yes-display-inline">establish a national retrofit website that
			 provides information on the Home Star Retrofit Rebate Program, including how to
			 determine whether particular energy efficiency measures are eligible for rebate
			 and how to participate in the program;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB0033FF6C32E4B299F99EFF783CC8636"><enum>(C)</enum><text display-inline="yes-display-inline">establish a means by which a State may
			 obtain confidential access to records of work performed in that State from the
			 database; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H8410436D436141D28A7D787384DE961A"><enum>(D)</enum><text display-inline="yes-display-inline">publish model forms and data protocols for
			 use by contractors, vendors, and quality assurance providers to comply with the
			 requirements of this title.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2FEEF3A1378A4A83BEE0F399F7116EAB"><enum>(2)</enum><header display-inline="yes-display-inline">Model certification forms</header><text display-inline="yes-display-inline">In carrying out this section, the Secretary
			 shall consider the model certification forms developed by the National Home
			 Performance Council.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H988C8650E57447828B967BC1024DA51C"><enum>(c)</enum><header display-inline="yes-display-inline">Qualified contractor
			 requirements</header><text display-inline="yes-display-inline">A qualified
			 contractor may perform retrofit work for which rebates are authorized under
			 this title only if it affirms, in each Home Star rebate application submitted
			 to a rebate aggregator, that it meets applicable requirements,
			 including—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="H479C37DB60D54DF4991BBBF215328DD6"><enum>(1)</enum><text display-inline="yes-display-inline">all applicable State contractor licensing
			 requirements or, with respect to a State that has no such requirements, any
			 appropriate comparable requirements established under paragraph (6);</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA21F9B35EB1A4048AEC1A9DA53403F11"><enum>(2)</enum><text display-inline="yes-display-inline">insurance coverage of at least $1,000,000
			 for general liability, and for such other purposes and in such other amounts as
			 may be required by the State;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB63F132B5D204F4085496864FDDF0535"><enum>(3)</enum><text display-inline="yes-display-inline">agreeing to provide warranties to
			 homeowners that completed work will—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="H11B05FE65EB44EDCAD7736185F2D7787"><enum>(A)</enum><text display-inline="yes-display-inline">be free of significant defects;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H8BA5C0694A074008857FFFB98CACD178"><enum>(B)</enum><text display-inline="yes-display-inline">be installed in accordance with the
			 specifications of the manufacturer; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H413ADAA26CF34D3D92C3B2FF12539425"><enum>(C)</enum><text display-inline="yes-display-inline">perform properly for a period of at least 1
			 year after the date of completion of the work;</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H77C5EF845E75449EA7C3368EE7896552"><enum>(4)</enum><text display-inline="yes-display-inline">agreeing to pass through to the owner of a
			 home, through a discount, the full economic value of all rebates received under
			 this title with respect to the home;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H72E2A97B3CB84E1C857E267E739C601B"><enum>(5)</enum><text display-inline="yes-display-inline">agreeing to provide to the homeowner a
			 notice of the amount of the rebate the contractor intends to apply for on the
			 homeowner’s behalf with respect to the eligible work under this title, before a
			 contract is executed between the contractor and a homeowner covering the
			 eligible work;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4A611AD87DDA4D098822B92CA7104BF2"><enum>(6)</enum><text display-inline="yes-display-inline">agreeing to cooperate with and comply with
			 the requirements of the quality assurance provider assigned to inspect any work
			 done, subject to any appeals or dispute resolution process described in section
			 105(b)(4);</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9DB3F6520365424993263831ACE50098"><enum>(7)</enum><text display-inline="yes-display-inline">certifying that no employee has been
			 convicted of, or pleaded guilty to, a crime of child molestation, rape, or any
			 other form of sexual assault;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H214DF1D69FDC4F879D72E6237CCEBA43"><enum>(8)</enum><text display-inline="yes-display-inline">all requirements of an applicable State
			 quality assurance framework by and after the date that is 1 year after the date
			 of enactment of this Act; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7A8814149B44481F984D7EA260673D6B"><enum>(9)</enum><text display-inline="yes-display-inline">any other appropriate requirements as
			 determined by the Secretary, in consultation with the Administrator.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H2245B1968E3B4014A8558A5E1FCA76CB"><enum>(d)</enum><header display-inline="yes-display-inline">Administrative and technical
			 support</header><text display-inline="yes-display-inline">Subject to section
			 109(b) and (c), beginning not later than 30 days after the date of enactment of
			 this Act, the Secretary shall provide such administrative and technical support
			 to rebate aggregators and States as is necessary to carry out this
			 title.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="HCB5FABE61FC840ED886D905AA38E1A61"><enum>(e)</enum><header display-inline="yes-display-inline">Administration</header>
					<paragraph commented="no" display-inline="no-display-inline" id="H3E88DD3FA4CB412696D932D91AA5A1D9"><enum>(1)</enum><header display-inline="yes-display-inline">Appointment of personnel</header><text display-inline="yes-display-inline">Notwithstanding the provisions of title 5,
			 United States Code, governing appointments in the competitive service and
			 General Schedule classifications and pay rates, the Secretary may appoint and
			 set basic rates of pay for such professional and administrative personnel as
			 the Secretary considers necessary to carry out this title. Such authority shall
			 not apply to positions in the Senior Executive Service. The number of personnel
			 appointed under this paragraph shall not exceed 30 full-time equivalent
			 employees. The terms of appointment of all personnel appointed under this
			 paragraph shall expire upon the termination of the programs established under
			 this title.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HEC0FF48408B74BEA999293E94BC11134"><enum>(2)</enum><header display-inline="yes-display-inline">Rate of pay</header><text display-inline="yes-display-inline">The basic rate of pay for a person
			 appointed under paragraph (1) shall not exceed the maximum rate of basic pay
			 payable for GS–15 of the General Schedule under
			 <external-xref legal-doc="usc" parsable-cite="usc/5/5332">section
			 5332</external-xref> of title 5, United States Code.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H95F489820C274504B28081DABDAE869A"><enum>(3)</enum><header display-inline="yes-display-inline">Regulations</header>
						<subparagraph commented="no" display-inline="no-display-inline" id="H4E48EC7F7C1F4A47B268C2FAD5B3F30F"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Notwithstanding
			 <external-xref legal-doc="usc" parsable-cite="usc/5/553">section
			 553</external-xref> of title 5, United States Code, the Secretary may issue
			 regulations that the Secretary, in the sole discretion of the Secretary,
			 determines necessary to—</text>
							<clause commented="no" display-inline="no-display-inline" id="HE6F04C6804A24F9A8314F684222C8F1E"><enum>(i)</enum><text display-inline="yes-display-inline">establish;</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="H4358BEF5138E461D9CF2FD86B329EA81"><enum>(ii)</enum><text display-inline="yes-display-inline">achieve full operational status within 60
			 days after the date of enactment of this Act for; or</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="HBB5B082BA9594860859B527C6D60A3D2"><enum>(iii)</enum><text display-inline="yes-display-inline">carry out,</text>
							</clause><continuation-text commented="no" continuation-text-level="subparagraph">the Home Star Retrofit Rebate
			 Program.</continuation-text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H4695213C559D4A9CB5F56DA2B127B579"><enum>(B)</enum><header display-inline="yes-display-inline">Timing</header><text display-inline="yes-display-inline">If the Secretary determines that
			 regulations described in subparagraph (A) are necessary, the regulations shall
			 be issued not later than 60 days after such determination.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H275095D815AE46BA999F71899D63D6C7"><enum>(C)</enum><header display-inline="yes-display-inline">Exception</header><clause commented="no" display-inline="yes-display-inline" id="HE97BDE87730B4029B694764807899883"><enum>(i)</enum><text display-inline="yes-display-inline">The Secretary shall not utilize the
			 authority provided under this paragraph to—</text>
								<subclause commented="no" display-inline="no-display-inline" id="H3764A384353E4E07BA8C099736FA8FB9" indent="up1"><enum>(I)</enum><text display-inline="yes-display-inline">develop, adopt, or implement a public
			 labeling system that rates and compares the energy performance of one home with
			 another; or</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="HA6A224D9E4F849C4911C96EDE9D72EB8" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">require the public disclosure of an energy
			 performance evaluation or rating developed for any specific home.</text>
								</subclause></clause><clause commented="no" display-inline="no-display-inline" id="H987C225887C3487886A3162D3CCEC233" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">Nothing in this subparagraph shall
			 preclude—</text>
								<subclause commented="no" display-inline="no-display-inline" id="H18F4059E861F47B08D0EA5D0ED15C330"><enum>(I)</enum><text display-inline="yes-display-inline">the computation, collection, or use, by the
			 Secretary, rebate aggregators, quality assurance providers, or States for the
			 purposes of carrying out sections 104 and 105, of information on the rating and
			 comparison of the energy performance of homes with and without energy
			 efficiency features or on energy performance evaluation or rating;</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="H1ED93167004E46CD9DBFFAE437863E73"><enum>(II)</enum><text display-inline="yes-display-inline">the use and publication of aggregate data
			 (without identifying individual homes or participants) based on information
			 referred to in subclause (I) to determine or demonstrate the performance of the
			 Home Star program; or</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="H5681CBEDB3EA4B8FA9BCB20387611731"><enum>(III)</enum><text display-inline="yes-display-inline">the provision of information referred to in
			 subclause (I) with respect to a specific home—</text>
									<item commented="no" display-inline="no-display-inline" id="H03D6B06B976843F587E661B394FBD11A"><enum>(aa)</enum><text display-inline="yes-display-inline">to the State, homeowner, quality assurance
			 provider, rebate aggregator, or contractor performing retrofit work on that
			 home, or an entity providing Home Star services, as necessary to enable
			 carrying out this title; or</text>
									</item><item commented="no" display-inline="no-display-inline" id="H39F4FD6C94464E2AACFB9EFEDED9216A"><enum>(bb)</enum><text display-inline="yes-display-inline">for purposes of prosecuting fraud and
			 abuse.</text>
									</item></subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD0B85DB547E24671A830CE8DD54B3404"><enum>(4)</enum><header display-inline="yes-display-inline">Information collection</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">Chapter 35</external-xref> of title 44,
			 United States Code, shall not apply to any information collection requirement
			 necessary for the implementation of the Home Star Retrofit Rebate
			 Program.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7CB29911C39F469AB95C63074733F95C"><enum>(5)</enum><header display-inline="yes-display-inline">Effective period</header><subparagraph commented="no" display-inline="yes-display-inline" id="HCC995069B9604D7AAEAFD8C659BE6B6B"><enum>(A)</enum><text display-inline="yes-display-inline">Paragraph (1) shall be effective only until
			 December 31, 2010, except with respect to personnel appointed to support the
			 quality assurance and enforcement of the programs established under this title,
			 for which appointments may be made under paragraph (1) until the termination of
			 the programs established under this title pursuant to section 111(i).</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H4C0DC101F845448D83004EFE6FB44E32" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">Paragraphs (3) and (4) shall be effective
			 only until the date that is 2 years after the date of enactment of this Act,
			 except with respect to regulations and information collection relating to the
			 quality assurance and enforcement of the programs established under this
			 title.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H13A15CD6B72C48F195F4997FADEC5E91"><enum>(f)</enum><header display-inline="yes-display-inline">Program
			 review</header><text display-inline="yes-display-inline">Not later than 180
			 days after the date of enactment of this Act, the Secretary shall prepare and
			 transmit to Congress a State-by-State analysis and review the distribution of
			 Home Star retrofit rebates under this title.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="H7D5F40BAAC1640BAA7953A7C1CADFDB8"><enum>(g)</enum><header display-inline="yes-display-inline">Adjustment of rebate amounts</header><text display-inline="yes-display-inline">Effective beginning on the date that is 180
			 days after the date of enactment of this Act, the Secretary may, after not less
			 than 30 days public notice, prospectively adjust the rebate amounts provided
			 for under this title as necessary to optimize the overall energy efficiency
			 resulting from the Silver Star Home Energy Retrofit Program and the Gold Star
			 Home Energy Retrofit Program.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="HC7C938534C7147379A1427AE9BBB01FC"><enum>(h)</enum><header display-inline="yes-display-inline">Indian tribe participation</header>
					<paragraph commented="no" display-inline="no-display-inline" id="H4A4B672FF2A64C08A17FD4666AE1950C"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">An Indian tribe, within 30 days after the
			 date of enactment of this Act, may indicate to the Secretary its intention to
			 act in place of a State for purposes of carrying out the responsibilities of
			 the State under this title with respect to its tribal lands. If the Indian
			 tribe so indicates, the Secretary shall treat the Indian tribe as the State for
			 purposes of carrying out this title with respect to those tribal lands.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2772BE12979D4F07934A1093326EBC82"><enum>(2)</enum><header display-inline="yes-display-inline">Transition of
			 responsibilities</header><text display-inline="yes-display-inline">The
			 Secretary may permit an Indian tribe, after the expiration of 30 days after the
			 date of enactment of this Act, to assume the responsibilities of a State under
			 this title with respect to its tribal lands if the Secretary finds that such
			 assumption of responsibilities will not disrupt the ongoing administration of
			 the program under this title.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8A617D89AC6541D3B2ECAC5111DFFC6D"><enum>(3)</enum><header display-inline="yes-display-inline">Cooperation</header><text display-inline="yes-display-inline">An Indian tribe may cooperate with a State
			 or the Secretary to ensure that all of the requirements of this title are
			 carried out with respect to the tribal lands.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H097B7D4965EC43F6B1C37CA240D53023"><enum>(i)</enum><header display-inline="yes-display-inline">Implementation by Secretary</header>
					<paragraph commented="no" display-inline="no-display-inline" id="HB0756D0A86794C16A1774D3438A7D089"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">If a State has not indicated to the
			 Secretary within 30 days after the date of enactment of this Act that it is
			 prepared to carry out section 105 or 108, or if at any later time the Secretary
			 determines that a State is no longer prepared to carry out section 105 or 108,
			 to the extent that no Indian tribe assumes such responsibilities under
			 subsection (h) the Secretary shall assume the responsibilities of that State
			 with respect to carrying out section 105 or 108.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8218B737D5584C288FBD791B67B537FE"><enum>(2)</enum><header display-inline="yes-display-inline">Transition of
			 responsibilities</header><text display-inline="yes-display-inline">The
			 Secretary may permit a State, after the Secretary has assumed the
			 responsibilities of that State under paragraph (1), to assume the
			 responsibilities assigned to States under section 105 or 108 with respect to
			 that State if the Secretary finds that such assumption of responsibilities will
			 not disrupt the ongoing administration of the program under this title.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H8DA0CDE056C04803AE3603C2915CA989"><enum>(j)</enum><header display-inline="yes-display-inline">Limitation</header><text display-inline="yes-display-inline">Rebates may not be provided under both
			 section 103 and section 104 with respect to the same home unless the energy
			 savings measures installed pursuant to section 103 are excluded from the
			 calculations performed for purposes of section 104 and the total amount of
			 rebates paid for the home does not exceed the maximum rebate available pursuant
			 to section 104.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="H41BB98A2B67040139CE05A86073C35FF"><enum>(k)</enum><header display-inline="yes-display-inline">Forms for certification and quality
			 assurance</header>
					<paragraph commented="no" display-inline="no-display-inline" id="HEA177805B42D49E6948B4D666B09B03F"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 30 days after the date of
			 enactment of this Act, the Secretary shall make available on the website
			 established under subsection (b)(1)(B), model certification forms for
			 compliance with quality assurance requirements under this title, to be
			 submitted by—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="H85B2FF6BB2EF491AB426F3AAA9B10F19"><enum>(A)</enum><text display-inline="yes-display-inline">each qualified contractor, accredited
			 contractor, and quality assurance provider on completion of an eligible home
			 energy retrofit; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H6577A4F65CF845769D26885ACC0E00E9"><enum>(B)</enum><text display-inline="yes-display-inline">each quality assurance provider on
			 completion of field verification required under this title.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB1720F44F8E94CBE97D088BC9F4E74BC"><enum>(2)</enum><header display-inline="yes-display-inline">National home performance
			 council</header><text display-inline="yes-display-inline">The Secretary,
			 States, and Indian tribes shall consider and may use model certification forms
			 developed by the National Home Performance Council to ensure compliance with
			 quality assurance requirements under this title.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HFE82E26FD1F6439F9042032220BF2B2C"><enum>(l)</enum><header display-inline="yes-display-inline">Public-private partnerships</header><text display-inline="yes-display-inline">A State that receives a grant under this
			 title is encouraged to form partnerships with utilities, energy service
			 companies, and other entities—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="H4AF3591C957A406C92791E9CBAB915FD"><enum>(1)</enum><text display-inline="yes-display-inline">to assist in marketing the Home Star
			 Retrofit Rebate Program;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H217C4C1246CA4D4380C0843234158AB2"><enum>(2)</enum><text display-inline="yes-display-inline">to facilitate consumer financing;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8F0336AB7C2A46B9AF307634074676B8"><enum>(3)</enum><text display-inline="yes-display-inline">to assist in implementation of the Silver
			 Star Home Energy Retrofit Program and the Gold Star Home Energy Retrofit
			 Program, including installation of qualified energy retrofit measures;
			 and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB79A855EBA2648A8AEC5AE2A0CA90D0E"><enum>(4)</enum><text display-inline="yes-display-inline">to assist in implementing quality assurance
			 programs.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H0A5387B5A8E04D869AFA059D48410A37"><enum>(m)</enum><header display-inline="yes-display-inline">Coordination of rebate and existing
			 State-sponsored programs</header>
					<paragraph commented="no" display-inline="no-display-inline" id="H73C38F47EF654123A9C8941C438063D4"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A State shall, to the maximum extent
			 practicable, prevent duplication through coordination of a program authorized
			 under this title with—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="H554779B6E0E24CA1B79B5215A16B9042"><enum>(A)</enum><text display-inline="yes-display-inline">the Energy Star appliance rebates program
			 authorized under section 124 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/15821">42 U.S.C. 15821</external-xref>),
			 and any other Federal programs that provide funds to States for home or
			 appliance energy efficiency purposes; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H40D45DF0C78B4C60B26C61AF2B76AE9C"><enum>(B)</enum><text display-inline="yes-display-inline">comparable programs planned or operated by
			 States, political subdivisions, electric and natural gas utilities, Federal
			 power marketing administrations, and Indian tribes.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB2825082625C4B9F81DCC6525B62D3BA"><enum>(2)</enum><header display-inline="yes-display-inline">Existing programs</header><text display-inline="yes-display-inline">In carrying out this subsection, a State
			 shall—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="H236BAFE3116842BEB68656FD32E35002"><enum>(A)</enum><text display-inline="yes-display-inline">give priority to—</text>
							<clause commented="no" display-inline="no-display-inline" id="H40AE35A0098E4CA3B1288CFA8DD32361"><enum>(i)</enum><text display-inline="yes-display-inline">comprehensive retrofit programs in
			 existence on the date of enactment of this Act, including programs under the
			 supervision of State utility regulators; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="H9C2B545808AA47FD93E17CED099F33D9"><enum>(ii)</enum><text display-inline="yes-display-inline">using funds made available under this title
			 to enhance and extend existing programs; and</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7F228ACF2C0D46EB8A79C3A867E91F06"><enum>(B)</enum><text display-inline="yes-display-inline">seek to enhance and extend existing
			 programs by coordinating with administrators of the programs.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H1C9A6870BD2D4958819255B08B9001E9"><enum>(n)</enum><header display-inline="yes-display-inline">Health and safety
			 requirements</header><text display-inline="yes-display-inline">Nothing in this
			 title shall relieve any contractor from the obligation to comply with
			 applicable Federal, State, and local health and safety code
			 requirements.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="HA6F9E6D3F2E44A3987A796650E3524FD"><enum>(o)</enum><header display-inline="yes-display-inline">Information hotlines</header>
					<paragraph commented="no" display-inline="no-display-inline" id="H3DB39EB7C7814706AE74441209CBBDCB"><enum>(1)</enum><header display-inline="yes-display-inline">Contractors</header><text display-inline="yes-display-inline">The Secretary shall establish and publicize
			 a telephone hotline for contractors to call to obtain information about the
			 programs under this Act.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H267491A8748C402B933C40246D1DA8C8"><enum>(2)</enum><header display-inline="yes-display-inline">Homeowners</header><text display-inline="yes-display-inline">The Secretary shall establish and publicize
			 a telephone hotline for homeowners to call to obtain information about the
			 programs under this Act.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H6A4C66A5202748CE8FB781712F4920C4"><enum>(p)</enum><header display-inline="yes-display-inline">Online chat function</header><text display-inline="yes-display-inline">The Secretary shall determine the
			 feasibility and effectiveness of establishing an online chat function through
			 the website established for the Home Star Retrofit Rebate Program, and may
			 establish such a function as appropriate.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="H9098FEC4EAFC4975BD8481BB776A9506"><enum>(q)</enum><header display-inline="yes-display-inline">Disaster
			 areas</header><text display-inline="yes-display-inline">The Secretary shall
			 ensure that a home in an area declared affected by a major disaster declared by
			 the President under section 401 of the Robert T. Stafford Disaster Relief and
			 Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>) is not denied
			 assistance under the Home Star Retrofit Rebate Program solely because there is
			 no equipment or system to replace due to the disaster.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="H9A0B7FAEF20A415697B32EECE6FC4ACE"><enum>(r)</enum><header display-inline="yes-display-inline">Income threshold</header><text display-inline="yes-display-inline">Homeowners with a gross annual household
			 income of more than $250,000 shall not be eligible for a rebate under this
			 title.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="H04FEA7A3D776498FBB952B277F498187" section-type="subsequent-section"><enum>102.</enum><header display-inline="yes-display-inline">Rebate aggregators</header>
				<subsection commented="no" display-inline="no-display-inline" id="HA28D22FDD3A64875BE52EDEEA282B7F4"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall develop a network of
			 rebate aggregators that can facilitate the delivery of rebates to homeowners to
			 reimburse the homeowners for work provided by participating contractors and
			 vendors for energy efficiency retrofit work. The Secretary shall approve or
			 deny an application from a person seeking to become a rebate aggregator not
			 later than 30 days after receiving such application. The Secretary may
			 disqualify any rebate aggregator, in one or more particular States, that fails
			 to meet its obligations under this title in a timely and competent manner. The
			 Secretary shall consult with States operating existing residential energy
			 efficiency and retrofit programs on how best to coordinate the Home Star
			 Retrofit Rebate Program with such existing programs, including the designation
			 of rebate aggregators.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="H865D49648C05417797B56624B3939EEB"><enum>(b)</enum><header display-inline="yes-display-inline">Availability</header><text display-inline="yes-display-inline">Not later than 60 days after the date of
			 enactment of this Act, the Secretary shall identify a sufficient number of
			 rebate aggregators in each State to ensure that rebate applications can be
			 accepted from all qualified contractors. Not later than 90 days after such date
			 of enactment, the Secretary shall ensure that rebate aggregation services are
			 available to all homeowners in the United States at the lowest reasonable
			 cost.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="H9D1E7A1B3A2647C1BBB2E519A5012DA4"><enum>(c)</enum><header display-inline="yes-display-inline">Responsibilities</header><text display-inline="yes-display-inline">Rebate aggregators shall—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="HCB756C8065944C6793BA92E58CD4AAEF"><enum>(1)</enum><text display-inline="yes-display-inline">review each proposed rebate application for
			 completeness and accuracy;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC778F11AE33443A584FAA94035705138"><enum>(2)</enum><text display-inline="yes-display-inline">review all measures for which rebates are
			 sought for eligibility in accordance with this title;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HBDE04D02D86142959B7C40AE51BB5F50"><enum>(3)</enum><text display-inline="yes-display-inline">not later than 10 days after receipt of a
			 complete rebate application, provide data to the Secretary for inclusion in the
			 database maintained through the Federal Rebate Processing System, consistent
			 with data protocols established by the Secretary;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA3501B3D20E342E7B0107A788DE8CF54"><enum>(4)</enum><text display-inline="yes-display-inline">not later than 10 days after the date of
			 receipt, distribute funds received from the Secretary to contractors, vendors,
			 or other persons in accordance with approved claims for reimbursement made to
			 the Federal Rebate Processing System;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H60279199A05247B6888FC41766E7DFE0"><enum>(5)</enum><text display-inline="yes-display-inline">maintain appropriate accounting for rebate
			 applications processed, and their disposition;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H49687B937C004D2B963CC39F2BD915DC"><enum>(6)</enum><text display-inline="yes-display-inline">review contractor qualifications and
			 accreditation and retain documentation of such qualification and accreditation,
			 as required for contractors to be authorized to perform residential energy
			 efficiency retrofit work under this title; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H09E109BB0E6A4E62AA9832564E66C31D"><enum>(7)</enum><text display-inline="yes-display-inline">maintain information regarding contractors’
			 fulfillment of the requirements of section 101(c).</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HDFF9A54C8A59409F95C474BC22F863EF"><enum>(d)</enum><header display-inline="yes-display-inline">Eligibility</header><text display-inline="yes-display-inline">To be eligible to apply to the Secretary
			 for approval as a rebate aggregator, an entity—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="HAF07328B7EE54A448DFEE549E7664F73"><enum>(1)</enum><text display-inline="yes-display-inline">shall be—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="H6A50A1431E5E4857A81A6E2ACC6ACE5C"><enum>(A)</enum><text display-inline="yes-display-inline">a Home Performance with Energy Star
			 partner;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H57A1B02792914D909CC98DB14307ACF0"><enum>(B)</enum><text display-inline="yes-display-inline">an entity administering a residential
			 energy efficiency retrofit program established or approved by a State;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA07D4AED94FF43ED9EBFD5B34EABCB14"><enum>(C)</enum><text display-inline="yes-display-inline">a Federal power marketing administration or
			 the Tennessee Valley Authority;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5BE57274E0294F40A78F2B6CECAD558A"><enum>(D)</enum><text display-inline="yes-display-inline">an Armed Forces exchange service in the
			 United States that offers for sale energy savings measures described in section
			 103;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H34A895BAEFF647A6BBBCB0CE459DB002"><enum>(E)</enum><text display-inline="yes-display-inline">an electric utility, natural gas utility,
			 or water utility administering or offering a residential energy efficiency
			 retrofit program; or</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA7E5747FEA32462F9B84D33D03C6BD88"><enum>(F)</enum><text display-inline="yes-display-inline">an entity—</text>
							<clause commented="no" display-inline="no-display-inline" id="H0000B39E4DAD453AAE70784136EFF6A6"><enum>(i)</enum><text display-inline="yes-display-inline">with corporate status or status as a State
			 or local government;</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="H908B70E3EF414447A09B522C6CC4DF13"><enum>(ii)</enum><text display-inline="yes-display-inline">who can demonstrate adequate financial
			 capability to manage a rebate aggregator program, as evidenced by audited
			 financial records;</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="H421ECFD59741433DA7210678434B598A"><enum>(iii)</enum><text display-inline="yes-display-inline">whose participation in the program, in the
			 judgment of the Secretary, would facilitate coordination with, and not disrupt,
			 existing residential retrofit programs in the States that are carrying out the
			 Home Star Retrofit Rebate Program under this title; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="H6EBDBF1D778246DCB2190C51577A6BC9"><enum>(iv)</enum><text display-inline="yes-display-inline">whose operational facilities, employees,
			 electronic recordkeeping hardware and facilities, and conventional records used
			 to carry out the responsibilities of a rebate aggregator are located wholly
			 within the United States, to the extent consistent with the international
			 obligations of the United States.</text>
							</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H17400A44DCFF4E49B2636D459082A9E3"><enum>(2)</enum><text display-inline="yes-display-inline">must be able to demonstrate—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="HF099D58FB2CA4D7DA20811867FEADDAD"><enum>(A)</enum><text display-inline="yes-display-inline">a relationship with 1 or more independent
			 quality assurance providers that is sufficient to meet the volume of
			 contracting services delivered;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H19F5D736E019421FBCD4C00863569A2D"><enum>(B)</enum><text display-inline="yes-display-inline">the capability to provide such electronic
			 data as is required by the Secretary to the Federal Rebate Processing System;
			 and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H6C91A5C0ECDD44F481FC34D29D3BC3A7"><enum>(C)</enum><text display-inline="yes-display-inline">a financial system that is capable of
			 tracking the distribution of rebates to participating contractors and vendors;
			 and</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD2E32DDA778C4A3FB872F541E39A8C81"><enum>(3)</enum><text display-inline="yes-display-inline">shall include in its application the amount
			 it proposes to charge for the review and processing of a rebate under this
			 title.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HF6B26E23A07342BFAFF49D495F9E7BF3"><enum>(e)</enum><header display-inline="yes-display-inline">Prompt processing of rebates</header><text display-inline="yes-display-inline">Within 10 days after receiving an
			 application for a rebate consistent with this title, a rebate aggregator shall
			 submit a claim for that rebate to the Federal Rebate Processing System. Within
			 10 days after the Federal Rebate Processing System receives such a submission
			 from a rebate aggregator, the Secretary shall provide the funds to the rebate
			 aggregator necessary to pay such rebates to the qualified contractor or vendor
			 who applied for them and to compensate the rebate aggregator for its services
			 in accordance with this title. Within 10 days of being provided such funds, the
			 rebate aggregator shall pay the rebates to the rebate applicant.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="H0719E311EBEE4286A86A774F5C480F53"><enum>(f)</enum><header display-inline="yes-display-inline">Public utility commission efficiency
			 targets</header><text display-inline="yes-display-inline">The Secretary
			 shall—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="HC8FC0E2CAD694739BC820BC2788B5B9C"><enum>(1)</enum><text display-inline="yes-display-inline">develop guidelines for States to use to
			 allow utilities participating as rebate aggregators to count the energy savings
			 from their participation toward State-level energy savings targets; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6A1CF73EDDB24A428CA086E5FFB6AEA3"><enum>(2)</enum><text display-inline="yes-display-inline">work with States to assist in the adoption
			 of these guidelines for the purposes and duration of the Home Star Retrofit
			 Rebate Program.</text>
					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="HB5680CCEB97645A3A562A6ECA1944D24" section-type="subsequent-section"><enum>103.</enum><header display-inline="yes-display-inline">Silver Star Home Energy Retrofit
			 Program</header>
				<subsection commented="no" display-inline="no-display-inline" id="HFCB69F7C87F94AAF99343A4416E13658"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">During the first year after the date of
			 enactment of this Act, a Silver Star Home Energy Retrofit Program rebate shall
			 be awarded, subject to the maximum amount limitations under subsection (d)(4)
			 and to the availability of funding pursuant to section 109, to homeowners to
			 reimburse the homeowners for work provided by participating contractors and
			 vendors, for the installation of energy savings measures—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="H2EAE4E1178174E7CAF8E57E2A7864BE7"><enum>(1)</enum><text display-inline="yes-display-inline">selected from the list of energy savings
			 measures described in subsection (b);</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HBBDE74BC7EEC4AFB80717DD7734E6D19"><enum>(2)</enum><text display-inline="yes-display-inline">installed after the date of enactment of
			 this Act in the home by a qualified contractor; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H289F95A5DD4C44BA94F070BBE86E6CBD"><enum>(3)</enum><text display-inline="yes-display-inline">carried out in compliance with this
			 section.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H1A6DBCC1004B41538707A48C99DFC783"><enum>(b)</enum><header display-inline="yes-display-inline">Energy savings measures</header><text display-inline="yes-display-inline">Subject to subsection (c), a rebate shall
			 be awarded under subsection (a) for the installation of the following energy
			 savings measures for a home energy retrofit that meet technical standards
			 established under this section:</text>
					<paragraph commented="no" display-inline="no-display-inline" id="H95F8F9A9529B477BAB1185431FC1E09C"><enum>(1)</enum><text display-inline="yes-display-inline">Whole house air sealing measures, including
			 interior and exterior measures, utilizing sealants, caulks, insulating foams,
			 gaskets, weather-stripping, mastics, and other building materials in accordance
			 with BPI standards or other procedures approved by the Secretary.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HBE46418DD22441908742BE12FF0121AD"><enum>(2)</enum><text display-inline="yes-display-inline">Attic insulation measures that—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="H47E32C2ADA3C493EBA296E15920705E0"><enum>(A)</enum><text display-inline="yes-display-inline">include sealing of air leakage between the
			 attic and the conditioned space, in accordance with BPI standards or the attic
			 portions of the DOE or EPA thermal bypass checklist or other procedures
			 approved by the Secretary;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE58B1A62940D42DAB70B2B58A95AC1B9"><enum>(B)</enum><text display-inline="yes-display-inline">add at least R–19 insulation to existing
			 insulation;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H438911177ED041D5BFDA0B3EBA9FB63E"><enum>(C)</enum><text display-inline="yes-display-inline">result in at least R–38 insulation in DOE
			 climate zones 1 through 4 and at least R–49 insulation in DOE climate zones 5
			 through 8, including existing insulation, within the limits of structural
			 capacity, except that a State, with the approval of the Secretary, may
			 designate climate zone subregions as a function of varying elevation;
			 and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA0A20FE81BDF4FD582768359D9F5503A"><enum>(D)</enum><text display-inline="yes-display-inline">cover at least—</text>
							<clause commented="no" display-inline="no-display-inline" id="H2B14921F6AAF444AB8205CEEFB63A057"><enum>(i)</enum><text display-inline="yes-display-inline">100 percent of an accessible attic;
			 or</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="HBCC6ED5E4CBF445E8770210A90FB04D9"><enum>(ii)</enum><text display-inline="yes-display-inline">75 percent of the total conditioned
			 footprint of the house.</text>
							</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5E791F4BFD744096B43772FA6CD7AA7C"><enum>(3)</enum><text display-inline="yes-display-inline">Duct sealing or replacement and sealing
			 that—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="H0FECB47C6F554B9FB240FFB4D2C696FE"><enum>(A)</enum><text display-inline="yes-display-inline">is installed in accordance with BPI
			 standards or other procedures approved by the Secretary; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD85DC01F96AA43DDA6656BAF176D907D"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of duct replacement and
			 sealing, replaces and seals at least 50 percent of a distribution system of the
			 home.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H757B204E930147AAAC86D782C32C55DE"><enum>(4)</enum><text display-inline="yes-display-inline">Wall insulation that—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="HFC47AC72D81849B5BA9BA4F77553E6AF"><enum>(A)</enum><text display-inline="yes-display-inline">is installed in accordance with BPI
			 standards or other procedures approved by the Secretary;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF7E6F6DE8B6E4E429C4B70F7854C6676"><enum>(B)</enum><text display-inline="yes-display-inline">is to full-stud thickness or adds at least
			 R–10 of continuous insulation; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HFA9236E867FF48CB9462E3EEAD83EBAC"><enum>(C)</enum><text display-inline="yes-display-inline">covers at least 75 percent of the total
			 external wall area of the home.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2533021E095C4ED7A6818ECCD13182F0"><enum>(5)</enum><text display-inline="yes-display-inline">Crawl space insulation or basement wall and
			 rim joist insulation that is installed in accordance with BPI standards or
			 other procedures approved by the Secretary and—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="HECC4A317018644EE895AF75F2FDEE32E"><enum>(A)</enum><text display-inline="yes-display-inline">covers at least 500 square feet of crawl
			 space or basement wall and adds at least—</text>
							<clause commented="no" display-inline="no-display-inline" id="HFA41257522F34CD9B54A2E53B078CC3F"><enum>(i)</enum><text display-inline="yes-display-inline">R–19 of cavity insulation or R–15 of
			 continuous insulation to existing crawl space insulation; or</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="H8F532CC0957B46E5804D7B2B23514988"><enum>(ii)</enum><text display-inline="yes-display-inline">R–13 of cavity insulation or R–10 of
			 continuous insulation to basement walls; and</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD7B0BF4884D1457789FC277A767DCA78"><enum>(B)</enum><text display-inline="yes-display-inline">fully covers the rim joist with at least
			 R–10 of new continuous or R–13 of cavity insulation.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H021F1CF0749E450C820AB04D3F7E6A0D"><enum>(6)</enum><text display-inline="yes-display-inline">Window replacement that replaces at least 8
			 exterior windows, or 75 percent of the exterior windows in a home, whichever is
			 less, with windows that—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="H0BFB0930C2D44999986BA8DA73178B57"><enum>(A)</enum><text display-inline="yes-display-inline">are certified by the National Fenestration
			 Rating Council; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HCC2446070978412BB80E803CEEA82456"><enum>(B)</enum><text display-inline="yes-display-inline">comply with criteria applicable to windows
			 under <external-xref legal-doc="usc" parsable-cite="usc/26/25">section
			 25(c)</external-xref> of the Internal Revenue Code of 1986 or, in areas above
			 5,000 feet elevation, have a U-factor of at least 0.35 when replacing windows
			 that are single-glazed or double-glazed with an internal air space of
			 <fraction>1/4</fraction> inch or less.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCCCA5EFD486C49A5A9AFD2DF5FD289C9"><enum>(7)</enum><text display-inline="yes-display-inline">Door or skylight replacement that replaces
			 at least 1 exterior door or skylight with doors or skylights that comply with
			 the 2010 Energy Star specification for doors or skylights.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3EC0C0E3D86E496A92BD8285D6CF8BF3"><enum>(8)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H48920DE10F2B403985F2ECAD1860BA61"><enum>(A)</enum><text display-inline="yes-display-inline">Heating system replacement of—</text>
							<clause commented="no" display-inline="no-display-inline" id="HBA7B7B64BFB8488BB58EC9BBE36A5B21" indent="up1"><enum>(i)</enum><text display-inline="yes-display-inline">a natural gas or propane furnace with a
			 furnace that has—</text>
								<subclause commented="no" display-inline="no-display-inline" id="H1B3759C94E09427DB5B45CBF4D5F559A"><enum>(I)</enum><text display-inline="yes-display-inline">an AFUE rating of 92 or greater; or</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="H2F49ABD6AF3948E298E7B05AADF31311"><enum>(II)</enum><text display-inline="yes-display-inline">an AFUE rating of 95 or greater;</text>
								</subclause></clause><clause commented="no" display-inline="no-display-inline" id="H11F45B8E49FE45F089B4057296A1FFD1" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">a natural gas or propane boiler with a
			 boiler that has an AFUE rating of 90 or greater;</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="H6752A708F50D429787C5651635AD8BD7" indent="up1"><enum>(iii)</enum><text display-inline="yes-display-inline">an oil furnace with a furnace that has an
			 AFUE rating of 86 or greater and that uses an electrically commutated blower
			 motor;</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="H661F190A73AA4A258B0D6448C47FF69D" indent="up1"><enum>(iv)</enum><text display-inline="yes-display-inline">an oil boiler with a boiler that has an
			 AFUE rating of 86 or greater and that has temperature reset or thermal purge
			 controls; or</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="H93F9619FB8634E91970D0FA559F2A7AB"><enum>(v)</enum><text display-inline="yes-display-inline">a wood or pellet furnace, boiler, or stove,
			 if—</text>
								<subclause commented="no" display-inline="no-display-inline" id="HE7E9AD42485C4128A38B11FDDDEE6C5B"><enum>(I)</enum><text display-inline="yes-display-inline">the new system—</text>
									<item commented="no" display-inline="no-display-inline" id="H96818E648BB24D639ECD628A1F14534F"><enum>(aa)</enum><text display-inline="yes-display-inline">meets at least 75 percent of the heating
			 demands of the home; and</text>
									</item><item commented="no" display-inline="no-display-inline" id="H0BDBFDF1EB87458EBD1C4A59851811AC"><enum>(bb)</enum><text display-inline="yes-display-inline">in the case of a wood stove, but not a
			 pellet stove, replaces an existing wood stove, but not a pellet stove, and is
			 certified by the Administrator;</text>
									</item></subclause><subclause commented="no" display-inline="no-display-inline" id="H037F86A4BC1F401F90BB9204BBF5EEA9"><enum>(II)</enum><text display-inline="yes-display-inline">the home has a distribution system (such as
			 ducts, vents, blowers, or affixed fans) that allows heat to reach all or most
			 parts of the home;</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="HE7A03B7589D2495990D99FEC0532ECAD"><enum>(III)</enum><text display-inline="yes-display-inline">in the case where an old wood stove is
			 being replaced, a voucher is provided by the installer or other responsible
			 party certifying that the old wood stove has been removed and rendered
			 inoperable or recycled at an appropriate recycling facility; and</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="HEEAE00AB71E34EA19D6940F9F62533AE"><enum>(IV)</enum><text display-inline="yes-display-inline">an accredited independent laboratory
			 recognized by the Administrator certifies that the new system—</text>

			 value) of at least 75 percent for wood and pellet stoves, and at least 80
			 percent for furnaces and boilers; and</text>
									</item><item commented="no" display-inline="no-display-inline" id="H550877A69ECC488D8AE1DA18CB9724DA"><enum>(bb)</enum><text display-inline="yes-display-inline">has particulate emissions of less than 3.0
			 grams per hour for stoves, and less than 0.32 lbs/mmBTU for outdoor furnaces
			 and boilers.</text>
									</item></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H08CD7810113645598DFB613FEA4F83F0" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">A rebate may be provided under this section
			 for the replacement of a furnace or boiler described in clauses (i) through
			 (iv) of subparagraph (A) only if the new furnace or boiler is installed in
			 accordance with ANSI/ACCA Standard 5 QI–2007.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H76C13DBE4ABA40BA87F6D644EFDD18E7"><enum>(9)</enum><text display-inline="yes-display-inline">Air-source air conditioner or air-source
			 heat pump replacement with a new unit that—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="HDCBA19F4A7A84A0D9C146FA38D5B49EC"><enum>(A)</enum><text display-inline="yes-display-inline">is installed in accordance with ANSI/ACCA
			 Standard 5 QI–2007; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE2548FACE9B947F2900CCFF9CE982F73"><enum>(B)</enum><text display-inline="yes-display-inline">meets or exceeds—</text>
							<clause commented="no" display-inline="no-display-inline" id="HA774FAD4431849CDB8A2F73B6D58528E"><enum>(i)</enum><text display-inline="yes-display-inline">in the case of an air-source air
			 conditioner—</text>
								<subclause commented="no" display-inline="no-display-inline" id="HC42717B1B55E4A4C8180B529C2220C15"><enum>(I)</enum><text display-inline="yes-display-inline">SEER 16 and EER 13; or</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="H7A37A6DA80F44C6885C4A8512CA06DE1"><enum>(II)</enum><text display-inline="yes-display-inline">SEER 18 and EER 15; and</text>
								</subclause></clause><clause commented="no" display-inline="no-display-inline" id="H5729EA1314934B888A76B9030918B1D5"><enum>(ii)</enum><text display-inline="yes-display-inline">in the case of an air-source heat pump,
			 SEER 15, EER 12.5, and HSPF 8.5.</text>
							</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HBF0461A4CD9F458EA856B08DBDC5F7B7"><enum>(10)</enum><text display-inline="yes-display-inline">Heating or cooling system replacement with
			 an Energy Star qualified geothermal heat pump that meets Tier 2 efficiency
			 requirements and that is installed in accordance with ANSI/ACCA Standard 5
			 QI–2007.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H145AED52B1A64485819B6595C2A94778"><enum>(11)</enum><text display-inline="yes-display-inline">Replacement of a natural gas, propane, or
			 electric water heater with—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="H60CD712E05A74F539FC1148E903A94E9"><enum>(A)</enum><text display-inline="yes-display-inline">a natural gas or propane condensing storage
			 water heater with an energy factor of 0.80 or more, or a natural gas or propane
			 storage or tankless water heater with thermal efficiency of 90 percent or
			 more;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9830E832DD794B959AD9B8EBDD7E2D95"><enum>(B)</enum><text display-inline="yes-display-inline">a tankless natural gas or propane water
			 heater with an energy factor of at least .82;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC4B2749A2FA04B2785C5792C3EE5D928"><enum>(C)</enum><text display-inline="yes-display-inline">a natural gas or propane storage water
			 heater with an energy factor of at least .67;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9DE38942B1C5428A9CDAB624F99F9F42"><enum>(D)</enum><text display-inline="yes-display-inline">an indirect water heater with an insulated
			 storage tank that—</text>
							<clause commented="no" display-inline="no-display-inline" id="H0D3CD417ED0A4289B74508951710E624"><enum>(i)</enum><text display-inline="yes-display-inline">has a storage capacity of at least 30
			 gallons and is insulated to at least R–16; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="H0D309AEFC6734E3C9114B9895864B915"><enum>(ii)</enum><text display-inline="yes-display-inline">is installed in conjunction with a
			 qualifying boiler described in paragraph (8);</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H74162507A44F4D3D9CB1553D453CAEFC"><enum>(E)</enum><text display-inline="yes-display-inline">an electric water heater with an energy
			 factor of 2.0 or more;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H8942526F906B4074832966B24B2EFB25"><enum>(F)</enum><text display-inline="yes-display-inline">an electric tankless water heater with an
			 energy factor or thermal efficiency, as applicable, of .96 or more or a thermal
			 efficiency of 96 percent or more, that operates on not greater than 25
			 kilowatts;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7754C7FE382D4057964ACE99620ACEF8"><enum>(G)</enum><text display-inline="yes-display-inline">a solar hot water system that—</text>
							<clause commented="no" display-inline="no-display-inline" id="HBBDC786BDC8C44FD85863E267F42E3C3"><enum>(i)</enum><text display-inline="yes-display-inline">is certified by the Solar Rating and
			 Certification Corporation; or</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="HC5C26D8D8251445997A8EF82A1018681"><enum>(ii)</enum><text display-inline="yes-display-inline">meets technical standards established by
			 the State of Hawaii; or</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H65753672404D4CC3AD4357A50C590264"><enum>(H)</enum><text display-inline="yes-display-inline">a water heater installed in conjunction
			 with a qualifying geothermal heat pump described in paragraph (10) that
			 provides domestic water heating through the use of—</text>
							<clause commented="no" display-inline="no-display-inline" id="HB66DBA712FEE4DB7B1AF84BB80D7B511"><enum>(i)</enum><text display-inline="yes-display-inline">a desuperheater; or</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="H80F410AEEB0A4D33A59EEFE2CB754A09"><enum>(ii)</enum><text display-inline="yes-display-inline">year-round demand water heating
			 capability.</text>
							</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H838ACE5BEED742CAB008CD3031534E4A"><enum>(12)</enum><text display-inline="yes-display-inline">Storm windows or doors that—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="HADB39EFDA4794B5E8B61058723FA37E6"><enum>(A)</enum><text display-inline="yes-display-inline">are installed on at least 5 existing doors
			 or existing single-glazed windows; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H8669613E3BC2412BBA63D4CD0B5557FA"><enum>(B)</enum><text display-inline="yes-display-inline">comply with any procedures that the
			 Secretary may set for storm windows or doors and their installation.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB2271E292C474314BCED0D70BB35F224"><enum>(13)</enum><text display-inline="yes-display-inline">Window film that is installed on at least 8
			 exterior windows, doors, or skylights, or 75 percent of the total exterior
			 square footage of glass in a home, whichever is more, with window films
			 that—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="H27E8D2F16E0341B3A0FDDDD0721A7461"><enum>(A)</enum><text display-inline="yes-display-inline">are certified by the National Fenestration
			 Rating Council; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF907CB68C8964BDEAD6AF247787CFE10"><enum>(B)</enum><text display-inline="yes-display-inline">have—</text>
							<clause commented="no" display-inline="no-display-inline" id="H8F30326752AE4990A87A4D53A21198EF"><enum>(i)</enum><text display-inline="yes-display-inline">a solar heat gain coefficient of 0.43 or
			 less with a visible light-to-solar heat gain coefficient of at least 1.1 for
			 installations in 2009 International Energy Conservation Code climate zones 1–3;
			 or</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="H424725D779AB49EA804E013FA754FE2C"><enum>(ii)</enum><text display-inline="yes-display-inline">a solar heat gain coefficient of 0.43 or
			 less with a visible light light-to-solar heat gain coefficient of at least 1.1
			 and a U-factor of 0.40 or less as installed in 2009 International Energy
			 Conservation Code climate zones 4–8.</text>
							</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H38B084C9A10B4DD5A04C67695DE675D0"><enum>(c)</enum><header display-inline="yes-display-inline">Installation costs</header><text display-inline="yes-display-inline">Measures described in paragraphs (1)
			 through (13) of subsection (b) shall include expenditures for labor and other
			 installation-related costs, including venting system modification and
			 condensate disposal, properly allocable to the onsite preparation, assembly, or
			 original installation of the component.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="HBE5B9C42959444529C4A47B43842A11B"><enum>(d)</enum><header display-inline="yes-display-inline">Amount of rebate</header>
					<paragraph commented="no" display-inline="no-display-inline" id="HE71E5A6DFF4147F892764B44193C4D80"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in paragraphs (2)
			 through (4), the amount of a rebate provided under subsection (a) shall be
			 $1,000 per measure for the installation of energy savings measures described in
			 subsection (b).</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE7CEE9099B3D4B66A2C01D5ABDA61DBC"><enum>(2)</enum><header display-inline="yes-display-inline">Higher rebate amount</header><text display-inline="yes-display-inline">Except as provided in paragraph (4), the
			 amount of a rebate provided under subsection (a) shall be $1,500 per measure
			 for—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="HEC46DFA8C2A14D01956AB8D86B4917EC"><enum>(A)</enum><text display-inline="yes-display-inline">attic insulation and air sealing described
			 in subsection (b)(1) or (2);</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2971FB217DC244B2B145C1AC834AEF70"><enum>(B)</enum><text display-inline="yes-display-inline">wall insulation described in subsection
			 (b)(4); and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H103EC1D4F6A841158CF0E2DE8FF5111E"><enum>(C)</enum><text display-inline="yes-display-inline">an air-source air conditioner described in
			 subsection (b)(9)(B)(i)(II).</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC4DC625637A94FA29171A4173F014EA8"><enum>(3)</enum><header display-inline="yes-display-inline">Lower rebate amount</header><text display-inline="yes-display-inline">Except as provided in paragraph (4), the
			 amount of a rebate provided under subsection (a) shall be—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="HE22F47E841294FF6BDD318E3CF3A72EF"><enum>(A)</enum><text display-inline="yes-display-inline">$125 per door and per skylight for the
			 installation of up to a maximum of 2 Energy Star doors and 2 Energy Star
			 skylights described in subsection (b)(7) for each home;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC066AA9C5EEF4CE49F641C846D8E97A3"><enum>(B)</enum><text display-inline="yes-display-inline">$400 for a maximum of 1 natural gas or
			 propane storage water heater described in subsection (b)(11)(C) for each
			 home;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7C82CAD5A57C4B50BAF92C6C126DA0A6"><enum>(C)</enum><text display-inline="yes-display-inline">$750 for a water heater described in
			 subsection (b)(11)(B);</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HAA4A46EA68A04260A3B7BAACD2196F7E"><enum>(D)</enum><text display-inline="yes-display-inline">$250 for rim joist insulation described in
			 subsection (b)(5)(B);</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H8BA9D00F161D4C26AF686DBB8A0ABF9F"><enum>(E)</enum><text display-inline="yes-display-inline">$50 for each storm window or door described
			 in subsection (b)(12), with a minimum of 5 storm windows or doors and a maximum
			 of 12;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H1141EC6FA413499881FC209E497E4EE0"><enum>(F)</enum><text display-inline="yes-display-inline">$250 each for a maximum of 4 electric
			 tankless water heaters described in subsection (b)(11)(F) for each home;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC0033917D4BE4A9C9DEB4BD5379AA781"><enum>(G)</enum><text display-inline="yes-display-inline">$500 for window film described in
			 subsection (b)(13);</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H36BB4B98B818413B9D2F0C42ECB918A0"><enum>(H)</enum><text display-inline="yes-display-inline">$750 for heating system replacement
			 described in subsection (b)(8)(A)(i)(I);</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE6BCC6F2708541BB9D0A260F7463729C"><enum>(I)</enum><text display-inline="yes-display-inline">$500 for a wood or pellet stove that has a
			 heating capacity of at least 28,000 Btu per hour and meets all of the
			 requirements of subsection (b)(8)(A)(v), except for the requirements of
			 subclause (I)(aa) and subclause (II); and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HBA0838E836CB4FADB950358EFA702F4C"><enum>(J)</enum><text display-inline="yes-display-inline">$500 for a for a desuperheater as described
			 in subsection (b)(11)(H)(i).</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8CE710B5F75640A19EC2598C36DA9E36"><enum>(4)</enum><header display-inline="yes-display-inline">Maximum
			 amount</header><text display-inline="yes-display-inline">The total amount of
			 rebates provided for a home under this section shall not exceed the lower
			 of—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="H701E72266F484554B49202CE3045268B"><enum>(A)</enum><text display-inline="yes-display-inline">$3,000;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H09E9EEF3FAC142C2972A1A0C31CA9C55"><enum>(B)</enum><text display-inline="yes-display-inline">50 percent of the total cost of the
			 installed measures; or</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H1C48F8DA1BB545709D664A9176CD1C70"><enum>(C)</enum><text display-inline="yes-display-inline">if the Secretary finds that the net value
			 to the homeowner of the rebates is less than the amount of the rebates, the
			 actual net value to the homeowner.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HBC9E7CA555EE458390C8120CD36ED567"><enum>(e)</enum><header display-inline="yes-display-inline">Verification and correction of
			 work</header>
					<paragraph commented="no" display-inline="no-display-inline" id="H3A87CCE2C03E4F398448BA9C40FA0E57"><enum>(1)</enum><header display-inline="yes-display-inline">Reimbursement</header><text display-inline="yes-display-inline">On submission of a claim by a rebate
			 aggregator to the Federal Rebate Processing System, the Secretary shall provide
			 reimbursement to the rebate aggregator for energy-efficiency measures installed
			 in a home, subject to paragraphs (2) and (3).</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2798AE4B5FEA438382DA642050621AB2"><enum>(2)</enum><header display-inline="yes-display-inline">Verification</header>
						<subparagraph commented="no" display-inline="no-display-inline" id="HAD95B0BB0F2040BEB464ACF3CED08DD3"><enum>(A)</enum><header display-inline="yes-display-inline">Percentage of retrofits verified</header>
							<clause commented="no" display-inline="no-display-inline" id="H3718E627C2DF4444A29B195AA0E201BA"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in clause (ii), not less
			 than—</text>
								<subclause commented="no" display-inline="no-display-inline" id="HD1EE4732A60C4DFBA768A769FB838F45"><enum>(I)</enum><text display-inline="yes-display-inline">20 percent of the retrofits performed by
			 each qualified contractor under this section with respect to a rebate described
			 in subsection (a) shall be randomly subject to field verification by an
			 independent quality assurance provider of all work associated with the
			 retrofit; and</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="H155D8EE5FB7F48AFA98E5909B00FC11F"><enum>(II)</enum><text display-inline="yes-display-inline">in the case of a qualified contractor that
			 uses a certified workforce, 10 percent of the retrofits performed by that
			 contractor under this section with respect to a rebate described in subsection
			 (a) shall be randomly subject to field verification by an independent quality
			 assurance provider of all work associated with the retrofit.</text>
								</subclause></clause><clause commented="no" display-inline="no-display-inline" id="HBB8BBEFCAD924F688C11700461C6FC08"><enum>(ii)</enum><header display-inline="yes-display-inline">Exceptions</header><text display-inline="yes-display-inline">In the case of a qualified contractor whose
			 previous retrofit work—</text>
								<subclause commented="no" display-inline="no-display-inline" id="H3E7852E7BC8C4BB79E6258A8AEB1DF46"><enum>(I)</enum><text display-inline="yes-display-inline">the Secretary has found to fail to comply
			 with the requirements of this section, the Secretary may establish a higher
			 percentage of the retrofits performed by that contractor under this section
			 with respect to a rebate described in subsection (a) to be subject to field
			 verification by an independent quality assurance provider; and</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="HA671DB8FAAB54027A30EE29833FAD7D6"><enum>(II)</enum><text display-inline="yes-display-inline">the Secretary has found to successfully
			 comply with the requirements of this section, the Secretary may establish a
			 lower percentage of the retrofits performed by that contractor under this
			 section with respect to a rebate described in subsection (a) to be subject to
			 field verification by an independent quality assurance provider.</text>
								</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC8DE7288C9B74DB6983FDEC7515B1524"><enum>(B)</enum><header display-inline="yes-display-inline">Homeowner complaint</header><text display-inline="yes-display-inline">Not later than 1 year after the completion
			 of a project for which rebates are sought, a homeowner may make a complaint
			 under the quality assurance program that compliance with the required
			 specifications for each measure or standards for installation have not been
			 achieved. The quality assurance program shall provide that, upon receiving such
			 a complaint, an independent quality assurance provider shall conduct field
			 verification on the retrofit work performed by the contractor. Verifications
			 under this subparagraph shall be in addition to those conducted under
			 subparagraph (A), and shall be corrected in accordance with paragraph
			 (3).</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H46800DE5D89848B8956581CD4A54EE6A"><enum>(3)</enum><header display-inline="yes-display-inline">Correction</header><text display-inline="yes-display-inline">Rebates under subsection (a) shall be made
			 subject to the following conditions:</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="H154E9F90314D4813B31BB97AE75D7109"><enum>(A)</enum><text display-inline="yes-display-inline">The installed measures will comply with the
			 specifications and quality standards under this section if a field verification
			 by a quality assurance provider finds that corrective work is needed. Such
			 compliance shall be achieved by the installing accredited contractor not later
			 than 14 days after the date of notification of a defect pursuant to a warranty,
			 provided at no additional cost to the homeowner.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HCD3597FC788A42C4A7563E5D3371940A"><enum>(B)</enum><text display-inline="yes-display-inline">A subsequent quality assurance visit shall
			 be conducted to evaluate the remedy not later than 7 days after notification
			 that the defect has been corrected.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H16A1D545343E4544BE95ADA7BCBA1ACE"><enum>(C)</enum><text display-inline="yes-display-inline">The quality assurance provider shall notify
			 the contractor of the disposition of such visit not later than 7 days after the
			 date of the visit.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE43D57380B9C425FA21657A5F51AC7E7"><enum>(4)</enum><header display-inline="yes-display-inline">Access
			 to home</header><text display-inline="yes-display-inline">In order to be
			 eligible for a rebate, a homeowner shall agree to permit such access to the
			 home, upon reasonable notice and at a mutually convenient time, as is necessary
			 to verify and correct retrofit work.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HB6BDADED19E34F6CA797A1ABE81E0E33"><enum>(f)</enum><header display-inline="yes-display-inline">Products Purchased Without Installation
			 Services</header>
					<paragraph commented="no" display-inline="no-display-inline" id="HB4EE110D009E48E3816BB340081C86DB"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A Silver Star Home Energy Retrofit Program
			 rebate shall be awarded for attic, wall, and crawl space insulation and
			 air-sealing products that—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="H0394E519CB764B6E8417B002F61E3D5F"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="H89A0B132D93B44FCAD35FD1D7C82242B"><enum>(i)</enum><text display-inline="yes-display-inline">in the case of insulation, qualify as of
			 the date of enactment of this Act for a tax credit under
			 <external-xref legal-doc="usc" parsable-cite="usc/26/25C">section
			 25C</external-xref> of the Internal Revenue Code of 1986; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="H888A2384732945158822D2C6EAFFC767" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">in the case of air sealing products, are
			 sealants, caulks, insulating foams, gaskets, weather-stripping, mastics, or
			 other air sealing products described in subsection (b)(1);</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC2318380DA89474B8F9B44E6B6E87641"><enum>(B)</enum><text display-inline="yes-display-inline">are purchased by a homeowner for
			 installation by the homeowner in a home identified by its address by the
			 homeowner;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H34470BF1FA364A1F8F035FF6E23C83E2"><enum>(C)</enum><text display-inline="yes-display-inline">are accompanied by educational materials on
			 proper installation of the products, including materials emphasizing the
			 importance of air sealing when insulating; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE6BEA701F08B46A1972729D2FF569110"><enum>(D)</enum><text display-inline="yes-display-inline">are identified and attributed to that home
			 in a rebate submission by the vendor to a rebate aggregator.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H62B0891642A84DA2A23F1CED36BA48C8"><enum>(2)</enum><header display-inline="yes-display-inline">Limitation</header><text display-inline="yes-display-inline">No rebate may be provided under this
			 subsection with respect to insulation or products that are employed in
			 energy-efficiency measures with respect to which a rebate is provided under
			 this section or section 104.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7BA3A286CAA94217A5030DC50202BF9D"><enum>(3)</enum><header display-inline="yes-display-inline">Amount of Rebate</header><text display-inline="yes-display-inline">A rebate under this subsection shall be
			 awarded for 50 percent of the total cost of the products described in paragraph
			 (1), not to exceed $250 per home.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HC7AAA042AC584CB5B7998C83429B76A0"><enum>(g)</enum><header display-inline="yes-display-inline">Review</header>
					<paragraph commented="no" display-inline="no-display-inline" id="H072B2338B30A41BD8F5BD9BB602B53BB"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall determine whether
			 information submitted to the Federal Rebate Processing System with respect to a
			 rebate was complete, and on the basis of that information and other information
			 available to the Secretary, shall determine whether the requirements of this
			 section were met in all respects.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFE26461AB1044EFEB79578115182CBFB"><enum>(2)</enum><header display-inline="yes-display-inline">Incorrect payment</header><text display-inline="yes-display-inline">On a determination of the Secretary under
			 paragraph (1) that a payment was made incorrectly to a party, or that
			 sufficient information was not submitted to the Federal Rebate Processing
			 System to enable such determination, the Secretary—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="HEDF290D6019B4220AD888867C194871D"><enum>(A)</enum><text display-inline="yes-display-inline">may—</text>
							<clause commented="no" display-inline="no-display-inline" id="H8885E9DD37BE47D984F07D15443E173A"><enum>(i)</enum><text display-inline="yes-display-inline">recoup the amount of the incorrect payment;
			 or</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="H91723152E23D40EAAEC2FA18A1EB5ECC"><enum>(ii)</enum><text display-inline="yes-display-inline">withhold the amount of the incorrect
			 payment from a payment made to the party pursuant to a subsequent request;
			 and</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H207FF6F1393C438495756AF646EC6424"><enum>(B)</enum><text display-inline="yes-display-inline">shall, to the extent the Secretary
			 determines the benefit of the rebate was not passed through to the homeowner
			 through a discount on the price of the retrofit work, order the contractor or
			 vendor to pay the amount of rebate benefit not previously passed through to the
			 homeowner.</text>
						</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H88F266BC787B4E1E9D4F21DE38717157" section-type="subsequent-section"><enum>104.</enum><header display-inline="yes-display-inline">Gold Star Home Energy Retrofit
			 Program</header>
				<subsection commented="no" display-inline="no-display-inline" id="H8B37A3DEFF534BDFB6461DFF430EF1FC"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A Gold Star Home Energy Retrofit Program
			 rebate shall be awarded, subject to subsection (b) and the availability of
			 funds pursuant to section 109, to homeowners to reimburse the homeowners for
			 work provided by participating accredited contractors and vendors for retrofits
			 that achieve whole home energy savings carried out after the date of enactment
			 of this Act in accordance with this section.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="H7CFD92DF0989414895F608183B5CD9BD"><enum>(b)</enum><header display-inline="yes-display-inline">Eligible measures</header><text display-inline="yes-display-inline">Rebates may be provided under this section
			 for—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="H761EB6746DA647E3A0641A3BD2D13011"><enum>(1)</enum><text display-inline="yes-display-inline">any measure listed as eligible for Silver
			 Star rebates in section 103; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE93045FDEF10427DBA056088B28556B6"><enum>(2)</enum><text display-inline="yes-display-inline">any other energy-saving measure, such as
			 home energy management systems, high-efficiency appliances, highly reflective
			 roofing, awnings, canopies, and similar external fenestration attachments,
			 automatic boiler water temperature controllers, energy-efficient wood products,
			 insulated vinyl siding, and mechanical air circulation and heat exchangers in a
			 passive-solar home—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="H95A2C5B604BD40B1B60E5243D7E3BF8E"><enum>(A)</enum><text display-inline="yes-display-inline">that can be demonstrated, when installed
			 and operated as intended, to improve energy efficiency; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H09166150C1664AC2B9946E44D63F92CC"><enum>(B)</enum><text display-inline="yes-display-inline">for which an energy efficiency contribution
			 can be determined with confidence.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HDE403C6CDDFD4443A3B7D2C8E01A53B6"><enum>(c)</enum><header display-inline="yes-display-inline">Energy savings</header>
					<paragraph commented="no" display-inline="no-display-inline" id="H834B80EE5CB94D9EB575B6DB8927626C"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Reductions in whole home energy consumption
			 under this section shall be determined by a comparison of the simulated energy
			 consumption of the home before and after the retrofit of the home.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HDA5438DFF3FF4C5888D074CE3596893A"><enum>(2)</enum><header display-inline="yes-display-inline">Documentation</header><text display-inline="yes-display-inline">The percent improvement in energy
			 consumption of a home under this section shall be documented through—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="H40D6C3429682406F9D449D0FBF1AEE56"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="H719469E677464BF6A8A25D9B370F3CEB"><enum>(i)</enum><text display-inline="yes-display-inline">the use of a whole home simulation software
			 program that has been approved under the Weatherization Assistance Program for
			 Low-Income Persons established under part A of title IV of the Energy
			 Conservation and Production Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6861">42 U.S.C. 6861 et seq.</external-xref>); or</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="HF1E2C2934C2E4E1FA91E742B8E7B0CCE" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">a equivalent performance test established
			 by the Secretary, in consultation with the Administrator; or</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H42E6761118E447E488A4F9BCAC50B901"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="H25D8150FF77A4B2F8902213782217DB7"><enum>(i)</enum><text display-inline="yes-display-inline">the use of a whole home simulation software
			 program that has been approved under RESNET Publication No. 06–001 (or a
			 successor publication approved by the Secretary);</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="H11090041C81946C7B9CE3279E8AE3852" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">an equivalent performance test established
			 by the Secretary, in consultation with the Administrator;</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="HC631B4BB12314A9F97AA84497E46279A" indent="up1"><enum>(iii)</enum><text display-inline="yes-display-inline">a State-certified equivalent rating
			 network, as specified by IRS Notice 2008–35; or</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="H8C31B0E30A0E4108856E4741BEDEC1A6" indent="up1"><enum>(iv)</enum><text display-inline="yes-display-inline">a HERS rating system approved or required
			 by the law of the State in which the home is located.</text>
							</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HBA8136DB546B4724AD438317EF821340"><enum>(3)</enum><header display-inline="yes-display-inline">Monitoring</header><text display-inline="yes-display-inline">The Secretary—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="H5D033F07C9F442E9A078E5F9A955FA71"><enum>(A)</enum><text display-inline="yes-display-inline">shall continuously monitor the software
			 programs used for determining rebates under this section; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF00711BDC3104B4398E2CD0D35AB29D6"><enum>(B)</enum><text display-inline="yes-display-inline">may disallow the use of software programs
			 that improperly assess energy savings.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF4C0954E65174F389B3ADBB56808BE08"><enum>(4)</enum><header display-inline="yes-display-inline">Assumptions and testing</header><text display-inline="yes-display-inline">The Secretary may—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="H800D4333462B4E349D7743CC3F230DA2"><enum>(A)</enum><text display-inline="yes-display-inline">establish simulation software program
			 assumptions for carrying out paragraph (2);</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H77B337590635451EBFD656B04B278D89"><enum>(B)</enum><text display-inline="yes-display-inline">require compliance with software program
			 performance tests covering—</text>
							<clause commented="no" display-inline="no-display-inline" id="HD84F547D5353448DB8E8AAF9FA797DFD"><enum>(i)</enum><text display-inline="yes-display-inline">mechanical system performance;</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="H1C22DFCE98ED4CFE992549CFD71CEEC3"><enum>(ii)</enum><text display-inline="yes-display-inline">duct distribution system efficiency;</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="H3225A1D8BF1244AD9AB3E3B4EDD9D322"><enum>(iii)</enum><text display-inline="yes-display-inline">hot water performance; or</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="H2B5D7B031EC84A16ADDD0F6C88023B39"><enum>(iv)</enum><text display-inline="yes-display-inline">other measures; and</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB9D5052E25714F88848F9D94AFFB6BEA"><enum>(C)</enum><text display-inline="yes-display-inline">require the simulation of pre-retrofit
			 energy usage to be determined by verified pre-retrofit energy usage.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB2335F0C468B40F0BECBD6AED53E7F75"><enum>(5)</enum><header display-inline="yes-display-inline">Recommended measures</header><text display-inline="yes-display-inline">Software programs used under this
			 subsection shall have the ability at a minimum to assess the savings associated
			 with all the measures for which rebates are specifically provided under the
			 Silver Star Home Energy Retrofit Program.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H5DD12625E3C34FC69479141F26AE6183"><enum>(d)</enum><header display-inline="yes-display-inline">Amount of rebate</header><text display-inline="yes-display-inline">Subject to subsection (e)(2), the amount of
			 a rebate provided under this section shall be—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="HCE3C96F1E0C640DE83A53C82DCB82A95"><enum>(1)</enum><text display-inline="yes-display-inline">$3,000 for a 20-percent reduction in whole
			 home energy consumption; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H28F5DE81DE1D45D49749ED3B6A6C2C10"><enum>(2)</enum><text display-inline="yes-display-inline">an additional $1,000 for each additional
			 5-percent reduction up to the lower of—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="H6015DD6168FD403697B2B3EF9AE5F3D2"><enum>(A)</enum><text display-inline="yes-display-inline">$8,000; or</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H79E97CD5D7214A05A6273E728ECEB5B8"><enum>(B)</enum><text display-inline="yes-display-inline">50 percent of the total retrofit
			 cost.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H47A6678E2D9D4B91A810EC808BF0D5CD"><enum>(e)</enum><header display-inline="yes-display-inline">Verification and correction of
			 work</header>
					<paragraph commented="no" display-inline="no-display-inline" id="H124EFE198FA24276BD95BCC590FE7A13"><enum>(1)</enum><header display-inline="yes-display-inline">Reimbursement</header><text display-inline="yes-display-inline">On submission of a claim by a rebate
			 aggregator to the Federal Rebate Processing System, the Secretary shall provide
			 reimbursement to the rebate aggregator for energy-efficiency measures installed
			 in a home, subject to paragraphs (2) and (3).</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCAE3CC94B03144D391C6F5E78416C733"><enum>(2)</enum><header display-inline="yes-display-inline">Verification</header>
						<subparagraph commented="no" display-inline="no-display-inline" id="H5A2B5D843CCA4D84B863071602C1F265"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to subparagraph (B), all work and
			 energy savings projections conducted with respect to a home as part of a
			 whole-home retrofit by an accredited contractor under this section shall be
			 subject to random field verification by an independent quality assurance
			 provider at a rate of—</text>
							<clause commented="no" display-inline="no-display-inline" id="H7C793524586E452CA5BF6EC64C56D40B"><enum>(i)</enum><text display-inline="yes-display-inline">15 percent; or</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="HA095D312EAA94612B15069252A230A3F"><enum>(ii)</enum><text display-inline="yes-display-inline">in the case of work performed by an
			 accredited contractor using a certified workforce, 10 percent.</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H76B2638725454939AE40620199904545"><enum>(B)</enum><header display-inline="yes-display-inline">Verification not required</header><text display-inline="yes-display-inline">A home shall not be subject to field
			 verification under subparagraph (A) if—</text>
							<clause commented="no" display-inline="no-display-inline" id="H180F242E07404985A1D6672C9288FC05"><enum>(i)</enum><text display-inline="yes-display-inline">a post-retrofit home energy rating is
			 conducted by an entity that is an eligible certifier in accordance with—</text>
								<subclause commented="no" display-inline="no-display-inline" id="HAA33442E9A604A69BE3DCA59FA51DD79"><enum>(I)</enum><text display-inline="yes-display-inline">RESNET Publication No. 06–001 (or a
			 successor publication approved by the Secretary);</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="H53A6989BC3114522980EA2EA2837D50C"><enum>(II)</enum><text display-inline="yes-display-inline">a State-certified equivalent rating
			 network, as specified in IRS Notice 2008–35; or</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="H27FC7FA00BA84E4EABB947CF5DDDE5E9"><enum>(III)</enum><text display-inline="yes-display-inline">a HERS rating system required by the law of
			 the State in which the home is located;</text>
								</subclause></clause><clause commented="no" display-inline="no-display-inline" id="HA58E182945CB45D89B45BFDCC58B4797"><enum>(ii)</enum><text display-inline="yes-display-inline">the eligible certifier is independent of
			 the accredited contractor in accordance with RESNET Publication No. 06–001 (or
			 a successor publication approved by the Secretary); and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="H83AB0297F24C487FBE3B7D25BCEDA6F3"><enum>(iii)</enum><text display-inline="yes-display-inline">the rating includes field verification of
			 all measures for which rebates are being provided.</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7F4792EE1D034E13AB764DDD26B48FC8"><enum>(C)</enum><header display-inline="yes-display-inline">Homeowner complaint</header><text display-inline="yes-display-inline">Not later than 1 year after completion of a
			 project for which rebates are sought, a homeowner may make a complaint under
			 the quality assurance program that compliance with the quality assurance
			 requirements of this title has not been achieved. The quality assurance program
			 shall provide that, upon receiving such a complaint, an independent quality
			 assurance provider shall conduct field verification on the retrofit work
			 performed by the contractor. Verifications under this subparagraph shall be in
			 addition to those conducted under subparagraph (A), and shall be corrected in
			 accordance with paragraph (3).</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HAA44D1629F294164B0DFEB8176199449"><enum>(D)</enum><header display-inline="yes-display-inline">Access
			 to home</header><text display-inline="yes-display-inline">In order to be
			 eligible for a rebate, a homeowner shall agree to permit such access to the
			 home, upon reasonable notice and at a mutually convenient time, as is necessary
			 to verify and correct retrofit work.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H41080CF8DC7D476DB0F947778070D047"><enum>(3)</enum><header display-inline="yes-display-inline">Correction</header><text display-inline="yes-display-inline">Rebates under this section shall be made
			 subject to the following conditions:</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="H5318EE680B014842854EE5F96D5054D6"><enum>(A)</enum><text display-inline="yes-display-inline">If a field verification by an independent
			 quality assurance provider finds that corrective work is needed, the accredited
			 contractor will correct the work so the installed measures comply with
			 manufacturer and applicable code standards, and reasonably determined energy
			 savings projections indicate compliance with the specifications and quality
			 standards under this title. Such compliance shall be achieved not later than 14
			 days after the date of notification of a defect pursuant to a warranty,
			 provided at no additional cost to the homeowner.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H23036070C7CD424790782EFFFC8F5810"><enum>(B)</enum><text display-inline="yes-display-inline">A subsequent quality assurance visit shall
			 be conducted to evaluate the remedy not later than 7 days after notification
			 that the defect has been corrected.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HAF295F080C504544B07D94BF11208FB7"><enum>(C)</enum><text display-inline="yes-display-inline">The quality assurance provider shall notify
			 the contractor of the disposition of such visit not later than 7 days after the
			 date of the visit.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H4EA3D1DB9231492ABE925A8B8CF7291C"><enum>(f)</enum><header display-inline="yes-display-inline">Review</header>
					<paragraph commented="no" display-inline="no-display-inline" id="H4066D859BAD14DE7988F2D3D06604002"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall determine whether
			 information submitted to the Federal Rebate Processing System with respect to a
			 rebate was complete, and on the basis of that information and other information
			 available to the Secretary, shall determine whether the requirements of this
			 section were met in all respects.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H26AEC08F46644A739CF64DD9993690AA"><enum>(2)</enum><header display-inline="yes-display-inline">Incorrect payment</header><text display-inline="yes-display-inline">On a determination of the Secretary under
			 paragraph (1) that a payment was made incorrectly to a party, or that
			 sufficient information was not submitted to the Federal Rebate Processing
			 System to enable such determination, the Secretary may—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="HCD741A2332654B6480EFF5A95AB30B92"><enum>(A)</enum><text display-inline="yes-display-inline">recoup the amount of the incorrect payment;
			 or</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H125F610425164382B7E7DEA60ED92B87"><enum>(B)</enum><text display-inline="yes-display-inline">withhold the amount of the incorrect
			 payment from a payment made to the party pursuant to a subsequent
			 request.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H59C6157C38E44155A75255C2A45D3B89"><enum>(g)</enum><header display-inline="yes-display-inline">Accreditation scholarships</header><text display-inline="yes-display-inline">The Secretary may provide up to 0.3 percent
			 of the funding available for carrying out this section for need-based
			 scholarships to individuals to enable them to qualify as accredited
			 contractors. In providing such scholarships, the Secretary shall factor in the
			 number of accredited contractors in the State and their proportion to the
			 State’s population.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="HEB766EB197FD40D398EA8FC8F88E8E40"><enum>(h)</enum><header display-inline="yes-display-inline">Exclusion</header><text display-inline="yes-display-inline">For purposes of this section, energy
			 savings measures shall not include the installation or replacement of pool
			 heaters.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="H6571C69C75AB450EAD04CC1142AAF060" section-type="subsequent-section"><enum>105.</enum><header display-inline="yes-display-inline">Quality assurance</header>
				<subsection commented="no" display-inline="no-display-inline" id="H65123339F5B04BA792FB830CF45C8990"><enum>(a)</enum><header display-inline="yes-display-inline">Quality assurance framework</header>
					<paragraph commented="no" display-inline="no-display-inline" id="H7B0C5AA87838404CA3CFDDBB16684853"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">States that elect to carry out a quality
			 assurance program pursuant to subsection (b) shall plan, develop, and implement
			 a quality assurance framework. The Secretary shall promptly solicit the
			 submission of model State quality assurance framework plans consistent with the
			 requirements of this section and, not later than 60 days after the date of
			 enactment of this Act, shall approve one or more such model plans that
			 incorporate nationally consistent high standards for optional use by States.
			 Not later than 180 days after the date of enactment of this Act, each State
			 electing to develop a quality assurance framework shall submit its plan to the
			 Secretary, who shall then approve or reject such plan within 30 days, providing
			 a detailed statement of deficiencies if the plan is rejected. If a State’s plan
			 is rejected, that State may resubmit its plan within 30 days.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7975B3721DF14755815BF8A5F392766C"><enum>(2)</enum><header display-inline="yes-display-inline">Implementation</header><text display-inline="yes-display-inline">A State shall—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="H19BB60FEF57E4CA0AC55CF39A015A0D7"><enum>(A)</enum><text display-inline="yes-display-inline">develop a quality assurance framework in
			 consultation with industry stakeholders, including representatives of
			 efficiency program managers, contractors, community and workforce
			 organizations, and environmental, energy efficiency, and labor organizations;
			 and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3EA19F19A2934BB29D3D1C69E2B59398"><enum>(B)</enum><text display-inline="yes-display-inline">implement the quality assurance framework
			 not later than 1 year after the date of enactment of this Act.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8CF65780D8C1487DB583ED993CA9F9FE"><enum>(3)</enum><header display-inline="yes-display-inline">Components</header><text display-inline="yes-display-inline">The quality assurance framework established
			 under this subsection shall include—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="HD3A351A0FCF14AD98E054C1445336E66"><enum>(A)</enum><text display-inline="yes-display-inline">minimum standards for accredited
			 contractors, including—</text>
							<clause commented="no" display-inline="no-display-inline" id="HA22D2F7EAEA741D7B546E233BE284893"><enum>(i)</enum><text display-inline="yes-display-inline">compliance with applicable Federal, State,
			 and local laws;</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="H3EB13E0D74E6421F9FC533F00441AD5E"><enum>(ii)</enum><text display-inline="yes-display-inline">use of a certified workforce;</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="HA7EB20E436F24BEBBF3867DED8F48890"><enum>(iii)</enum><text display-inline="yes-display-inline">maintenance of records needed to verify
			 compliance; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="HE571E6A6B144433088FC94CED756DF35"><enum>(iv)</enum><text display-inline="yes-display-inline">use of independent contractors only when
			 appropriately classified as such pursuant to Revenue ruling 87–41 and section
			 530(d) of the Revenue Act of 1978 and relevant State law;</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H652AB5FE54994BEAB2FD659F89F3D30E"><enum>(B)</enum><text display-inline="yes-display-inline">maintenance of a list of accredited
			 contractors;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD1AD085F4DF8459588AF81D4EC144279"><enum>(C)</enum><text display-inline="yes-display-inline">requirements for maintenance and delivery
			 to the Federal Rebate Processing System of information needed to verify
			 compliance and ensure appropriate compensation for quality assurance
			 providers;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7EF593E0CDF14AE086E00432E8D7F20A"><enum>(D)</enum><text display-inline="yes-display-inline">targets and realistic plans for—</text>
							<clause commented="no" display-inline="no-display-inline" id="H7875774A6C0C47E0880DD4887995519C"><enum>(i)</enum><text display-inline="yes-display-inline">the recruitment of minority, veteran, and
			 women-owned small business enterprises;</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="HCC8DAC873E594309B69AEDF2152B0A2F"><enum>(ii)</enum><text display-inline="yes-display-inline">the employment of graduates of training
			 programs that primarily serve targeted workers; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="H3F95CD591ED94F87B21CEEB42781244E"><enum>(iii)</enum><text display-inline="yes-display-inline">the employment of targeted workers;</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H95217CAF93604F369391AE76EE22C92C"><enum>(E)</enum><text display-inline="yes-display-inline">a plan to link workforce training for
			 energy efficiency retrofits with training for the broader range of skills and
			 occupations in construction or emerging clean energy industries;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H89862FE450EE4008AF326C65B9BFBFB1"><enum>(F)</enum><text display-inline="yes-display-inline">to the extent practicable, a plan to
			 incorporate existing clean energy and energy efficiency coursework, worker
			 training programs, and worker certification programs at community
			 colleges;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H181CEBD83F81488FB15811028FAB0485"><enum>(G)</enum><text display-inline="yes-display-inline">quarterly reports to the Secretary on the
			 progress of implementation of the quality assurance framework and its success
			 in meeting its targets and plans; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3EFDD4AE1AB64B0E901CA8E1B0AD7934"><enum>(H)</enum><text display-inline="yes-display-inline">maintenance of a list of qualified quality
			 assurance providers and minimum standards for such quality assurance
			 providers.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H87321A50ECE44558AD247508F52F129B"><enum>(4)</enum><header display-inline="yes-display-inline">Noncompliance</header><text display-inline="yes-display-inline">If the Secretary determines that a State
			 that has elected to implement a quality assurance program, but has failed to
			 plan, develop, or implement a quality assurance framework in accordance with
			 this section, the Secretary shall suspend further grants for State
			 administration pursuant to section 109(b)(1).</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HB31E9458BB694E4BB460C2F60870DC7D"><enum>(b)</enum><header display-inline="yes-display-inline">Quality assurance programs</header>
					<paragraph commented="no" display-inline="no-display-inline" id="HC69E839D404444D99B9DFF95813E0EE4"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A State may carry out a quality assurance
			 program—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="H53AB914AC3D447C795E90189E4A671A6"><enum>(A)</enum><text display-inline="yes-display-inline">as part of a State energy conservation plan
			 established under part D of title III of the Energy Policy and Conservation Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/6321">42 U.S.C. 6321 et
			 seq.</external-xref>);</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H6D09CAE1F3DF4FD2B1B04A0252D533CD"><enum>(B)</enum><text display-inline="yes-display-inline">to be managed by the office or the designee
			 of the office—</text>
							<clause commented="no" display-inline="no-display-inline" id="HA210136FF557419F8E364EAFA841DC4D"><enum>(i)</enum><text display-inline="yes-display-inline">that is responsible for the development of
			 the plan under section 362 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6322">42 U.S.C. 6322</external-xref>); and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="HBB570DDA7FC642E6BB951EC6365131B7"><enum>(ii)</enum><text display-inline="yes-display-inline">to the maximum extent practicable, that is
			 conducting an existing energy efficiency program; and</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H29F6D72F708F4C17B59244F7728352B9"><enum>(C)</enum><text display-inline="yes-display-inline">in the case of a grant made to an Indian
			 tribe, to be managed by an entity designated by the Indian tribe to carry out a
			 quality assurance program or a national quality assurance program
			 manager.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFAFAA7A5FE1A47EE8F568F0D8E5F79E6"><enum>(2)</enum><header display-inline="yes-display-inline">Noncompliance</header><text display-inline="yes-display-inline">If the Secretary determines that a State
			 has not provided or cannot provide adequate oversight over a quality assurance
			 program to ensure compliance with this title, the Secretary may—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="H1715415C939247A2B4D683B1C4D53339"><enum>(A)</enum><text display-inline="yes-display-inline">withhold further quality assurance funds
			 from the State; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9191F8FD27C04A06A73059183D06B585"><enum>(B)</enum><text display-inline="yes-display-inline">require that quality assurance providers
			 operating in the State be overseen by a national quality assurance program
			 manager selected by the Secretary.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE044A14C0215469B969728D470F1F8E6"><enum>(3)</enum><header display-inline="yes-display-inline">Implementation</header><text display-inline="yes-display-inline">A State that receives a grant under this
			 title may implement a quality assurance program through the State or an
			 independent quality assurance provider designated by the State,
			 including—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="HEDBD72813FE740519AFBCF3E95B6CF0F"><enum>(A)</enum><text display-inline="yes-display-inline">an energy service company;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9AE7C677793E4619941ABD9FC8E083F1"><enum>(B)</enum><text display-inline="yes-display-inline">an electric utility;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HCF7A419887844F48AA2D33176B54BDBC"><enum>(C)</enum><text display-inline="yes-display-inline">a natural gas utility;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H25DE278F7A514C0E9F37D427A905E0B8"><enum>(D)</enum><text display-inline="yes-display-inline">an independent administrator designated by
			 the State; or</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3B709AAA22154B39B0721ABC8149E773"><enum>(E)</enum><text display-inline="yes-display-inline">a unit of local government.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC92A3AE81C0B404C811E33CB6590700F"><enum>(4)</enum><header display-inline="yes-display-inline">Appeals and dispute resolution
			 process</header><text display-inline="yes-display-inline">A quality assurance
			 program established under this subsection shall include an expedited and final
			 appeals and dispute resolution process.</text>
					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H66D5C027B8CD425392231F8D563EB176" section-type="subsequent-section"><enum>106.</enum><header display-inline="yes-display-inline">Reports</header>
				<subsection commented="no" display-inline="no-display-inline" id="HF40EE508DD814AB48F20E88B05B15FCC"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall submit to the Committee
			 on Energy and Natural Resources of the Senate and the Committee on Energy and
			 Commerce of the House of Representatives a report on this title—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="H30849AB58CCA4410A1F24F4C1E45856E"><enum>(1)</enum><text display-inline="yes-display-inline">not later than 1 year after the date of
			 enactment of this Act; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H59FC15C518CD464D9A08D071A18FC181"><enum>(2)</enum><text display-inline="yes-display-inline">not later than the earlier of—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="H12B9E3D390974B83BB2D61C1D09953C7"><enum>(A)</enum><text display-inline="yes-display-inline">2 years after the date of enactment of this
			 Act; or</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H30948FB31FEA4E31A8104D7DC3B363D9"><enum>(B)</enum><text display-inline="yes-display-inline">December 31, 2012.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H5DAE146618DA447FACA9B63BF30AB50D"><enum>(b)</enum><header display-inline="yes-display-inline">Contents</header><text display-inline="yes-display-inline">The report shall include a description
			 of—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="H27F9C882AA7442F182905D07A5D948D4"><enum>(1)</enum><text display-inline="yes-display-inline">the energy savings produced as a result of
			 this title;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC082EF2BB42D41C0A447CBFFC30D6BBD"><enum>(2)</enum><text display-inline="yes-display-inline">the direct and indirect employment created
			 as a result of the programs supported under this title;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFE8D8D60984C44EFB80CD00902842494"><enum>(3)</enum><text display-inline="yes-display-inline">the specific entities implementing the
			 energy efficiency programs;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA08C3FF0F55348A7AE18377E08326BA1"><enum>(4)</enum><text display-inline="yes-display-inline">the beneficiaries who received the
			 efficiency improvements;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA5B1C2937F78448D8F44EEBBD76023A0"><enum>(5)</enum><text display-inline="yes-display-inline">the manner in which funds provided under
			 this title were used;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H860CE0FA75994F1C8F9D12240565D912"><enum>(6)</enum><text display-inline="yes-display-inline">the sources (such as mortgage lenders,
			 utility companies, and local governments) and types of financing used by the
			 beneficiaries to finance the retrofit expenses that were not covered by rebates
			 provided under this title;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H043E3AE18EFB497F9BD0B24F9215BFBE"><enum>(7)</enum><text display-inline="yes-display-inline">the results of verification requirements;
			 and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3D56FCCD42CE4C35907ACC83BCAC9DBE"><enum>(8)</enum><text display-inline="yes-display-inline">any other information the Secretary
			 considers appropriate.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H4C420CAEA1044B919828C7874D6D0100"><enum>(c)</enum><header display-inline="yes-display-inline">Required information</header>
					<paragraph commented="no" display-inline="no-display-inline" id="H195ADD2C730B46FFBC0FCE39660A7BD9"><enum>(1)</enum><header display-inline="yes-display-inline">Requirement</header><text display-inline="yes-display-inline">Rebate aggregators and States participating
			 in the Home Star Retrofit Rebate Program shall provide to the Secretary such
			 information as the Secretary requires to prepare the report required under this
			 section.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H18EB815A6C81407FB71C71F6857DFB09"><enum>(2)</enum><header display-inline="yes-display-inline">Noncompliance</header><text display-inline="yes-display-inline">If the Secretary determines that a rebate
			 aggregator or State has not provided the information required under paragraph
			 (1), the Secretary shall provide to the rebate aggregator or State a period of
			 at least 90 days to provide the necessary information, subject to withholding
			 of funds or reduction of future grant amounts.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HBBA10DBCAC814D3ABE6DFB2DA0A0F825"><enum>(d)</enum><header display-inline="yes-display-inline">Comptroller General study</header><text display-inline="yes-display-inline">Not later than 2 years after the date of
			 enactment of this Act, the Comptroller General shall submit to Congress a
			 report on the results of a study of—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="HBEEB20E21B8541DD86EFB17FDE597F19"><enum>(1)</enum><text display-inline="yes-display-inline">how much money can reasonably be estimated
			 to be saved by American consumers as a result of the energy efficiency measures
			 undertaken pursuant to this title;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H15B208D3E7E246D7A397AC084CDF223A"><enum>(2)</enum><text display-inline="yes-display-inline">how much energy can reasonably be estimated
			 to be saved as a result of the energy efficiency measures undertaken pursuant
			 to this title; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H933565391B304D5081BB9FF1C6403A5F"><enum>(3)</enum><text display-inline="yes-display-inline">whether the savings from the energy
			 efficiency measures undertaken pursuant to this title are greater than the cost
			 of the implementation of this title.</text>
					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="HEFE32EA2ED17471C8AE5612AE8BDE925" section-type="subsequent-section"><enum>107.</enum><header display-inline="yes-display-inline">Heating and cooling efficiency
			 study</header>
				<subsection commented="no" display-inline="no-display-inline" id="HEEB6B345C3EB4A1C8B4D590CCA023548"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall submit to the Committee
			 on Energy and Natural Resources of the Senate and the Committee on Energy and
			 Commerce of the House of Representatives a study not later than 1 year after
			 the date of enactment of this Act.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="HABAF2FDD60824AD78388D1FBE188D102"><enum>(b)</enum><header display-inline="yes-display-inline">Contents</header><text display-inline="yes-display-inline">The study shall include a description
			 of—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="HF38758EF2B66464EBF04D0DD98232F13"><enum>(1)</enum><text display-inline="yes-display-inline">the efficiency through the life-cycle of
			 air conditioning and heat pump products eligible under section 103; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H491B91A944FA4215ACE35BF57E812978"><enum>(2)</enum><text display-inline="yes-display-inline">a comparison of the efficiency through the
			 life-cycle of air conditioning and heat pump products eligible under section
			 103 to the efficiency through the life-cycle of air conditioning and heat pump
			 products not eligible under section 103.</text>
					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H98DCCB6A30A947F1860CD33C987AE153" section-type="subsequent-section"><enum>108.</enum><header display-inline="yes-display-inline">Penalties</header>
				<subsection commented="no" display-inline="no-display-inline" id="HDE4AAD7B8ED944D1BE5CC07360579F7E"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary may—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="HFA234075325B4A8FA819B12DD8588155"><enum>(1)</enum><text display-inline="yes-display-inline">assess and compromise a civil penalty
			 against a person who violates this title (or any regulation issued under this
			 title); and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H48F636417D8741BCB74B97DF3300FB10"><enum>(2)</enum><text display-inline="yes-display-inline">require from any entity the records and
			 inspections necessary to enforce this title.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H8C57B453F25248C696E059E19A982017"><enum>(b)</enum><header display-inline="yes-display-inline">Civil penalty</header><text display-inline="yes-display-inline">A civil penalty assessed under subsection
			 (a) shall be in an amount not greater than the higher of—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="HEF0CBB2A153F401EA1FDBA398576609D"><enum>(1)</enum><text display-inline="yes-display-inline">$15,000 for each violation; or</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H119911D52387444487E54D6A6D246A51"><enum>(2)</enum><text display-inline="yes-display-inline">3 times the value of any associated rebate
			 under this title.</text>
					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H8B2A8F253F28412588C4D8BC57C7D208" section-type="subsequent-section"><enum>109.</enum><header display-inline="yes-display-inline">Funding</header>
				<subsection commented="no" display-inline="no-display-inline" id="H0BCA19C5704B4523A1C048EACFD78C11"><enum>(a)</enum><header display-inline="yes-display-inline">Authorization of appropriations</header>
					<paragraph commented="no" display-inline="no-display-inline" id="HD69B4488A23540BF8E13774FF8557932"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to subsection (i), there are
			 authorized to be appropriated to carry out this title $6,000,000,000 for the
			 period of fiscal years 2010 and 2011, to remain available until
			 expended.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3CF2758FEFD44028B31FF8A2E8DA3B98"><enum>(2)</enum><header display-inline="yes-display-inline">Maintenance of funding</header><text display-inline="yes-display-inline">Funds provided under this section shall
			 supplement and not supplant any prior or planned Federal and State funding
			 provided to carry out energy efficiency programs. To the extent the Secretary
			 finds that a State has supplanted other such programs with funding under this
			 section, the Secretary may withhold an equivalent amount of funding from
			 allocations for the State under this title.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H576BE1BEB27443C1952A7314C37905EA"><enum>(b)</enum><header display-inline="yes-display-inline">Grants to States</header>
					<paragraph commented="no" display-inline="no-display-inline" id="H29C98B1FDFF64F7091976588D2AEF3DA"><enum>(1)</enum><header display-inline="yes-display-inline">Distribution to States</header>
						<subparagraph commented="no" display-inline="no-display-inline" id="H861C4A6929EB4C2D8AEEB6CF01C71A2E"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as otherwise provided in this
			 subsection, of the amount provided under subsection (a), 3.6 percent is
			 authorized to be appropriated to the Secretary for providing grants to States,
			 to be used for—</text>
							<clause commented="no" display-inline="no-display-inline" id="H62CA0117A9464ED6929BFC9B04199195"><enum>(i)</enum><text display-inline="yes-display-inline">administrative costs of carrying out this
			 title;</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="H187F7E8452E441F6914A2E20A7F27BAB"><enum>(ii)</enum><text display-inline="yes-display-inline">development and implementation of quality
			 assurance frameworks;</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="HE83E0DC5FB8E4219824E0E561A7FD498"><enum>(iii)</enum><text display-inline="yes-display-inline">oversight of quality assurance
			 programs;</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="H7246D803FF2E4D67A0DE007EE06B5663"><enum>(iv)</enum><text display-inline="yes-display-inline">establishment and delivery of financing
			 mechanisms, in accordance with paragraph (2); and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="HA663B06A414341BAAF32BE5A956885C5"><enum>(v)</enum><text display-inline="yes-display-inline">coordination with existing residential
			 retrofit programs and infrastructure development to assist deployment of the
			 Home Star Retrofit Rebate Program.</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD18564A5E4934DF4A5A0A079B6187D12"><enum>(B)</enum><header display-inline="yes-display-inline">Distribution</header>
							<clause commented="no" display-inline="no-display-inline" id="H7336616C03464EDCA5589FF7DA48418A"><enum>(i)</enum><header display-inline="yes-display-inline">Provision of funds</header><text display-inline="yes-display-inline">Not later than 30 days after the date of
			 enactment of this Act, the Secretary shall provide to the State energy offices,
			 or such other State entities as are designated by the Governor, of States that
			 are carrying out responsibilities under section 105, 25 percent of the funds
			 described in subparagraph (A).</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="HA3120E69BF214F2993F59EF6C87CE70B"><enum>(ii)</enum><header display-inline="yes-display-inline">Allocation</header><text display-inline="yes-display-inline">Funds described in clause (i) shall be made
			 available in accordance with the allocation formula for State energy
			 conservation plans established under part D of title III of the Energy Policy
			 and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6321">42 U.S.C. 6321 et seq.</external-xref>).</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="H5446F5344C894E7F9E1E632B8F3EBF3F"><enum>(iii)</enum><header display-inline="yes-display-inline">Fund allocation process</header><text display-inline="yes-display-inline">The Secretary shall allocate the remaining
			 75 percent of the funds described in clause (i) in a manner that may vary from
			 the formula described in clause (ii) as necessary to best support the
			 objectives of achieving energy efficiency gains, employment of underemployed
			 workers, and implementing quality assurance programs and frameworks in
			 participating States.</text>
							</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD759AEF1600F4A24B7C6AB6EEB002C5E"><enum>(2)</enum><header display-inline="yes-display-inline">Financing</header>
						<subparagraph commented="no" display-inline="no-display-inline" id="HEE746BB57A8346E6935C1A719BDBFA4E"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as otherwise provided in this
			 subsection, of the amount provided under subsection (a), 5.4 percent is
			 authorized to be appropriated to the Secretary for carrying out section
			 109.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD185517992B84601A83E4A2D59E5172D"><enum>(B)</enum><header display-inline="yes-display-inline">Distribution</header>
							<clause commented="no" display-inline="no-display-inline" id="H6A6DC9E169E64B6299C42B334E689F30"><enum>(i)</enum><header display-inline="yes-display-inline">Provision of funds</header><text display-inline="yes-display-inline">Not later than 90 days after the date of
			 enactment of this Act, the Secretary shall provide to the State energy offices,
			 or such other State entities as are designated by the Governor, of States that
			 are carrying out responsibilities under section 105, 75 percent of the funds
			 described in subparagraph (A).</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="HC87CB94920E6475D8ADA6295E52C875D"><enum>(ii)</enum><header display-inline="yes-display-inline">Allocation</header><text display-inline="yes-display-inline">Funds described in clause (i) shall be made
			 available in accordance with the allocation formula for State energy
			 conservation plans established under part D of title III of the Energy Policy
			 and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6321">42 U.S.C. 6321 et seq.</external-xref>).</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="H13492502027445C7A1E313E114CD09CD"><enum>(iii)</enum><header display-inline="yes-display-inline">Fund allocation process</header><text display-inline="yes-display-inline">The Secretary shall allocate the remaining
			 25 percent of the funds described in clause (i) in a manner that may vary from
			 the formula described in clause (ii) and reward those States that make the best
			 progress in providing loans to low-income areas pursuant to section
			 109(c)(4).</text>
							</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC3236A7CA593416CB43AA0AA83C6F6DA"><enum>(3)</enum><header display-inline="yes-display-inline">Withholding of funds</header><text display-inline="yes-display-inline">To the extent that the Secretary assumes
			 the responsibilities of a State under section 101(i), the Secretary shall
			 withhold the portion of the funds otherwise transferrable to the State under
			 this section that are attributable to those State responsibilities.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H767F7ED9602C4BEE88659508564F2BEE"><enum>(4)</enum><header display-inline="yes-display-inline">Indian tribes</header>
						<subparagraph commented="no" display-inline="no-display-inline" id="H92BBEE7876CF401FAB7780D7C3521B39"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">If an Indian tribe acts in place of a State
			 for purposes of carrying out the responsibilities of the State under this title
			 with respect to its tribal lands pursuant to section 101(h), the Secretary
			 shall transfer to that Indian tribe, instead of the State, the proportionate
			 share of funds otherwise transferrable to the State under this section.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H584BE5476EEC4CD3A32B3B402503B5D7"><enum>(B)</enum><header display-inline="yes-display-inline">Proportionate share</header><text display-inline="yes-display-inline">For purposes of subparagraph (A), the
			 proportionate share shall be calculated on the basis of the percentage of the
			 population of the State that resides within the tribal lands.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H4D642530895F48B38CBB1B109A3083B8"><enum>(c)</enum><header display-inline="yes-display-inline">Quality assurance and rebate aggregation
			 costs</header>
					<paragraph commented="no" display-inline="no-display-inline" id="HAAFB719F8FDE4E7CB591DBFD84F9E575"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Of the amount provided under subsection
			 (a), not more than 5 percent are authorized to be appropriated to the Secretary
			 to be used as provided in paragraph (2), in accordance with information
			 provided by the State offices or entities described in subsection (b)(1)(B)(ii)
			 with respect to services provided by quality assurance providers and rebate
			 aggregators.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB295B39CB7484055AB98814A1FDB34A7"><enum>(2)</enum><header display-inline="yes-display-inline">Distribution to quality assurance providers
			 or rebate aggregators</header><text display-inline="yes-display-inline">The
			 Secretary shall use funds provided under this subsection to compensate quality
			 assurance providers and rebate aggregators for services provided under this
			 title.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H09D219867C0D43B787F76F6F29A1E4D0"><enum>(3)</enum><header display-inline="yes-display-inline">Compensation</header><text display-inline="yes-display-inline">The amount of compensation provided under
			 this subsection shall be—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="H63B4D4F14EC44FE4B3E739C3B3359899"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="H1B8D144A77644830AEA3A83548A7437F"><enum>(i)</enum><text display-inline="yes-display-inline">in the case of the Silver Star Home Energy
			 Retrofit Program—</text>
								<subclause commented="no" display-inline="no-display-inline" id="H142F3ED8FCC9424ABA6E194BD862B9CC" indent="up1"><enum>(I)</enum><text display-inline="yes-display-inline">not more than $25 to rebate aggregators per
			 rebate review and processing under the program; and</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="HDC74A861421241519307C0037AAA03E1" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">$150 to quality assurance providers for
			 each field inspection conducted under the program; and</text>
								</subclause></clause><clause commented="no" display-inline="no-display-inline" id="H25EA34DF4BC945BCA04495C71FE4086A" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">in the case of the Gold Star Home Energy
			 Retrofit Program—</text>
								<subclause commented="no" display-inline="no-display-inline" id="H3D145AAF3F994178B28B057FECE96D10"><enum>(I)</enum><text display-inline="yes-display-inline">not more than $35 to rebate aggregators for
			 each rebate review and processing under the program; and</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="HE189AF0A4556407E967EEACDBF514EF4"><enum>(II)</enum><text display-inline="yes-display-inline">$300 to quality assurance providers for
			 each field inspection conducted under the program; or</text>
								</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H1B0D30781CC744EF870D12373C23CDFC"><enum>(B)</enum><text display-inline="yes-display-inline">such other amounts as the Secretary
			 considers necessary to carry out the quality assurance provisions of this title
			 to optimize the overall energy efficiency resulting from the Silver Star Home
			 Energy Retrofit Program and the Gold Star Home Energy Retrofit Program.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H18F7321F582F4C20AC89032210623024"><enum>(d)</enum><header display-inline="yes-display-inline">Tracking of rebates and
			 expenditures</header><text display-inline="yes-display-inline">Of the amount
			 provided under subsection (a), not more than 2.5 percent are authorized to be
			 appropriated to the Secretary to be used for costs associated with tracking
			 rebates and expenditures through the Federal Rebate Processing System under
			 this title, technical assistance to States, and related administrative costs
			 incurred by the Secretary.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="H4BA03299F5334DE9BE31E11BE5EE9C5D"><enum>(e)</enum><header display-inline="yes-display-inline">Silver Star Home Energy Retrofit
			 Program</header>
					<paragraph commented="no" display-inline="no-display-inline" id="H6E43977FA991440FA5BB37D3FB497E0E"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Of the amount provided under subsection
			 (a), after subtracting the amounts authorized in subsections (b) and (d) of
			 this section, two-thirds of the remainder are authorized to be appropriated to
			 the Secretary to be used to provide rebates and other payments authorized under
			 the Silver Star Home Energy Retrofit Program.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H08F111751A8A4720A725216CDF1F5051"><enum>(2)</enum><header display-inline="yes-display-inline">Products Purchased Without Installation
			 Services</header><text display-inline="yes-display-inline">Of the amounts
			 appropriated pursuant to this subsection for the Silver Star program, 7.5
			 percent shall be made available for rebates under section 103(f).</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HE0B7A5AE818347D88EEEF9C74D676982"><enum>(f)</enum><header display-inline="yes-display-inline">Gold Star Home Energy Retrofit
			 Program</header><text display-inline="yes-display-inline">Of the amount
			 provided under subsection (a), after subtracting the amounts authorized in
			 subsections (b) and (d) of this section, one-third of the remainder is
			 authorized to be appropriated to the Secretary to be used to provide rebates
			 and other payments authorized under the Gold Star Home Energy Retrofit
			 Program.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="H88FB0E9A247A40299BA6B252FA8BDDD0"><enum>(g)</enum><header display-inline="yes-display-inline">Return of undisbursed funds</header>
					<paragraph commented="no" display-inline="no-display-inline" id="HF2889CA9BB3C4619BA3FB3DC462F60C1"><enum>(1)</enum><header display-inline="yes-display-inline">Silver Star Home Energy Retrofit
			 Program</header><text display-inline="yes-display-inline">If the Secretary has
			 not disbursed all the funds available for rebates under the Silver Star Home
			 Energy Retrofit Program by the date that is 1 year after the date of enactment
			 of this Act, any undisbursed funds shall be made available to the Gold Star
			 Home Energy Retrofit Program.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H47313CD7E0AB4FFAAC16C18CB6444909"><enum>(2)</enum><header display-inline="yes-display-inline">Gold Star Home Energy Retrofit
			 Program</header><text display-inline="yes-display-inline">If the Secretary has
			 not disbursed all the funds available for rebates under the Gold Star Home
			 Energy Retrofit Program by the date that is 2 years after the date of enactment
			 of this Act, any undisbursed funds shall be returned to the Treasury.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9843C144AB8841F0B01DF9A595B47030"><enum>(3)</enum><header display-inline="yes-display-inline">Home star energy efficiency loan
			 program</header><text display-inline="yes-display-inline">If a State, or the
			 Secretary acting in lieu of a State program, has not disbursed or provided in
			 the form of loans all the funds available for such loans under the Home Star
			 Energy Efficiency Loan Program by the date that is 2 years after the date of
			 enactment of this title, any undisbursed funds shall be returned to the
			 Treasury.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HBC0AF0C467764E9DB3096109D8754636"><enum>(h)</enum><header display-inline="yes-display-inline">Sunset</header><text display-inline="yes-display-inline">With the exception of the provisions of
			 section 102(c)(5), (6), and (7), section 109, this subsection, and the relevant
			 definitions in section 2 to those provisions, this title shall cease to be
			 effective after December 31, 2012. Nothing in this subsection shall prevent a
			 State from continuing to implement a quality assurance framework established
			 pursuant to section 105.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="H46BCFB70F1884F93B6139AE756D258E0"><enum>(i)</enum><header display-inline="yes-display-inline">Prohibition on earmarks</header><text display-inline="yes-display-inline">None of the funds appropriated pursuant to
			 this section may be used for a Congressional earmark as defined in clause 9(e)
			 of rule XXI of the Rules of the House of Representatives.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="HF30A0E0266C24E1E9EACC9711A09175F"><enum>(j)</enum><header display-inline="yes-display-inline">Administrative expense
			 prohibition</header><text display-inline="yes-display-inline">No funds provided
			 under this title shall be used for the purposes of conducting travel to
			 gambling or gaming establishments in connection with official duties related to
			 this title.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="H54FE6E6BA8B14E52ABE2D850662D39A0" section-type="subsequent-section"><enum>110.</enum><header display-inline="yes-display-inline">Noise abatement study</header><text display-inline="no-display-inline">Not later than 1 year after the date of
			 enactment of this Act, the Secretary, in consultation with the Secretary of
			 Health and Human Services, shall submit to the Committee on Energy and Natural
			 Resources of the Senate and the Committee on Energy and Commerce of the House
			 of Representatives a study of the effects of the energy savings measures made
			 as a result of this Act on noise abatement.</text>
			</section></title><title commented="no" id="H90CB5941178A45F9B27ACF03B8E69047" level-type="subsequent"><enum>II</enum><header display-inline="yes-display-inline">Energy Efficient Manufactured and Modular
			 Homes</header>
			<section commented="no" display-inline="no-display-inline" id="H228A3F51851A484EB6F8A9C3C7E31741" section-type="subsequent-section"><enum>201.</enum><header display-inline="yes-display-inline">Energy efficient manufactured and Modular
			 homes</header>
				<subsection commented="no" display-inline="no-display-inline" id="H4710B2CFD7804F75815E69EF5D6F74A3"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text>
					<paragraph commented="no" display-inline="no-display-inline" id="HBB665977E95D46D6BB6300EA63E5E1EA"><enum>(1)</enum><header display-inline="yes-display-inline">Manufactured home</header><text display-inline="yes-display-inline">The term <quote>manufactured home</quote>
			 has the meaning given such term in section 603 of the National Manufactured
			 Housing Construction and Safety Standards Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5402">42 U.S.C. 5402</external-xref>).</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H358FE64A334C47929DDC503CFC6FC970"><enum>(2)</enum><header display-inline="yes-display-inline">Energy star qualified manufactured
			 home</header><text display-inline="yes-display-inline">The term <quote>Energy
			 Star qualified manufactured home</quote> means a manufactured home that has
			 been designed, produced, and installed in accordance with Energy Star’s
			 guidelines by an Energy Star certified plant.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5FD3D64B215446A4B4F5843DBBC7000F"><enum>(3)</enum><header display-inline="yes-display-inline">Modular home</header><text display-inline="yes-display-inline">The term <quote>modular home</quote> means
			 a structure that is—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="H8A424AD6F3424157BF39B3E718AE68AF"><enum>(A)</enum><text display-inline="yes-display-inline">designed and manufactured to comply with
			 applicable national, State, and local building codes and regulations;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H1E8A00437C67453AB2A015BC0BDB4310"><enum>(B)</enum><text display-inline="yes-display-inline">transportable in one or more
			 sections;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H97AEEF288C7E403ABB65B8C9780624F4"><enum>(C)</enum><text display-inline="yes-display-inline">not constructed on a permanent chassis;
			 and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H6277CB49F4F3454494692A512903C934"><enum>(D)</enum><text display-inline="yes-display-inline">designed to be used as a dwelling on
			 permanent foundations when connected to required utilities, including the
			 plumbing, heating, air conditioning, and electrical systems contained
			 therein.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4AB248D85B7A44079EE740ABA60C4F6F"><enum>(4)</enum><header display-inline="yes-display-inline">Energy star qualified modular
			 home</header><text display-inline="yes-display-inline">The term <quote>Energy
			 Star qualified modular home</quote> means a modular home that has been
			 designed, produced, and installed in accordance with Energy Star’s
			 guidelines.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HB86AA75258AE4A4EA4A33813B5D3D456"><enum>(b)</enum><header display-inline="yes-display-inline">Purpose</header><text display-inline="yes-display-inline">The purpose of this section is to assist
			 low-income households residing in manufactured homes constructed prior to 1976
			 to save energy and energy expenditures by providing funding for the purchase of
			 new Energy Star qualified manufactured homes or new Energy Star qualified
			 modular homes.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="HEA46E319E6FD481DB7D1BB5BF7E63168"><enum>(c)</enum><header display-inline="yes-display-inline">Grants to state agencies</header>
					<paragraph commented="no" display-inline="no-display-inline" id="HE591D0EB4F5F4A54A1141BD687F3402C"><enum>(1)</enum><header display-inline="yes-display-inline">Grants</header><text display-inline="yes-display-inline">The Secretary may make grants to State
			 agencies responsible for developing State energy conservation plans under
			 section 362 of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6322">42 U.S.C. 6322</external-xref>) (or such other
			 existing State agency that exercises similar functions as the Governor of a
			 State may designate), to provide owners of manufactured homes constructed prior
			 to 1976 funding to use to purchase new Energy Star qualified manufactured homes
			 or new Energy Star qualified modular homes.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H843CDBDF36BA480A9B888B334DE3A756"><enum>(2)</enum><header display-inline="yes-display-inline">Allocation of grants</header><text display-inline="yes-display-inline">Grants under paragraph (1) shall be
			 distributed to State agencies in States on the basis of their proportionate
			 share of all manufactured homes constructed prior to 1976 that are occupied as
			 primary residences in the United States, based on the most recent and accurate
			 data available.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE3FBD7A8AD2743DF905198F36834105E"><enum>(3)</enum><header display-inline="yes-display-inline">Funding</header>
						<subparagraph commented="no" display-inline="no-display-inline" id="H970607924505466D9EF102EEA3F09473"><enum>(A)</enum><header display-inline="yes-display-inline">Primary residence requirement</header><text display-inline="yes-display-inline">Funding described under paragraph (1) may
			 only be made to an owner of a manufactured home constructed prior to 1976 that
			 has been used by the owner as a primary residence on a year-round basis for at
			 least the previous 12 months.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC7EA4B8BF20D49AEACC356E3BC5C4752"><enum>(B)</enum><header display-inline="yes-display-inline">Destruction and replacement</header><text display-inline="yes-display-inline">Funding described under paragraph (1) may
			 be provided only if the manufactured home constructed prior to 1976 will
			 be—</text>
							<clause commented="no" display-inline="no-display-inline" id="HFE02AF5280934EEFA8C99B5F9845BD1B"><enum>(i)</enum><text display-inline="yes-display-inline">destroyed (including appropriate
			 recycling); and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="H9834885800044B838150E5FBE2AB97ED"><enum>(ii)</enum><text display-inline="yes-display-inline">replaced, in an appropriate area, as
			 determined by the applicable State agency, with an Energy Star qualified
			 manufactured home or Energy Star qualified modular home.</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H74C071255BB542BCBE2D2707471D3EA6"><enum>(C)</enum><header display-inline="yes-display-inline">Limitation</header><text display-inline="yes-display-inline">Funding described under paragraph (1) may
			 not be provided to any owner of a manufactured home constructed prior to 1976
			 that was or is a member of a household for which any member of the household
			 was provided funding pursuant to this section.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2DCD350FED7B448B88612D2AB0B971CA"><enum>(D)</enum><header display-inline="yes-display-inline">Eligible households</header><text display-inline="yes-display-inline">To be eligible to receive funding described
			 under paragraph (1), an owner of a manufactured home constructed prior to 1976
			 shall demonstrate to the applicable State agency that the total income of all
			 members the owner’s household does not exceed 80 percent of the area median
			 income in the applicable area, as determined by the Secretary.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HAF89B7E2FE0B454DA66EDB4C23732E35"><enum>(E)</enum><header display-inline="yes-display-inline">Leases</header><text display-inline="yes-display-inline">To be eligible to receive funding described
			 under paragraph (1), an owner of a manufactured home constructed prior to 1976
			 who intends to place the new Energy Star qualified manufactured home or new
			 Energy Star qualified modular home on property leased from another person shall
			 hold a lease to such property of at least 3 years in duration.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8FA93305EDDE428FB4F9BCBACEE37EE9"><enum>(4)</enum><header display-inline="yes-display-inline">Funding
			 amount</header><text display-inline="yes-display-inline">Funding provided by
			 State agencies under this subsection shall not exceed $7,500 per manufactured
			 home or modular home from any funds appropriated pursuant to this
			 section.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5C087E89EABB49CDA76027119178692B"><enum>(5)</enum><header display-inline="yes-display-inline">Use of state funds</header><text display-inline="yes-display-inline">A State agency providing funding under this
			 section may supplement the amount of such funding under paragraph (4) by any
			 amount such agency approves if such additional amount is from State funds and
			 other sources, including private donations and grants or loans from charitable
			 foundations.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2165B0BE02BE48259E826C2F5CAA3B51"><enum>(6)</enum><header display-inline="yes-display-inline">State
			 programs</header><text display-inline="yes-display-inline">A State agency
			 conducting a program that has the purpose of replacing manufactured homes
			 constructed prior to 1976 with Energy Star qualified manufactured homes or
			 Energy Star qualified modular homes may use funds provided under this section
			 to support such a program, provided such funding does not exceed the funding
			 limitation amount under paragraph (4).</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA54FF60A4D5146258EC6086733809E49"><enum>(7)</enum><header display-inline="yes-display-inline">Administration</header>
						<subparagraph commented="no" display-inline="no-display-inline" id="H0EBE6EB5C4C44094B2CE5CAB7FEE65F0"><enum>(A)</enum><header display-inline="yes-display-inline">Controls and procedures</header><text display-inline="yes-display-inline">Each State agency receiving funds under
			 this section shall establish fiscal controls and accounting procedures
			 sufficient, as determined by the Secretary, to ensure proper accounting for
			 disbursements made from such funds and fund balances. Such procedures shall
			 conform to generally accepted Government accounting principles.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9C7F9DA620564EF2A78328C8C556BE50"><enum>(B)</enum><header display-inline="yes-display-inline">Coordination with other state
			 agencies</header><text display-inline="yes-display-inline">A State agency
			 receiving funds under this section may coordinate its efforts, and share funds
			 for administration, with other State agencies or nonprofit organizations
			 involved in low-income housing programs.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H73BFDD99FEB5400AA8C6A95F72DE092A"><enum>(C)</enum><header display-inline="yes-display-inline">Administrative expenses</header><text display-inline="yes-display-inline">A State agency receiving funds under this
			 section may expend not more than 10 percent of such funds for administrative
			 expenses.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H65C622DD8C024B3491E3FB70397A47DB"><enum>(d)</enum><header display-inline="yes-display-inline">Decommissioning</header><text display-inline="yes-display-inline">A person receiving funding under subsection
			 (c) may also be provided not to exceed $2,500 for the decommissioning of the
			 manufactured home being replaced.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="H9FB5637CE5C146D7AF914B79D232559C"><enum>(e)</enum><header display-inline="yes-display-inline">Authorization of appropriations</header>
					<paragraph commented="no" display-inline="no-display-inline" id="H8E93AE06D2D94AA1BA00E11A064303F0"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">There are authorized to be appropriated to
			 the Secretary to carry out this section $200,000,000 for fiscal year 2010 and
			 $400,000,000 for fiscal year 2011, to remain available until expended.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8B827B4F855A4B8AABC7BA6B9DD4BB6C"><enum>(2)</enum><header display-inline="yes-display-inline">Administrative expenses</header><text display-inline="yes-display-inline">Of the amounts available each fiscal year
			 to carry out this section, the Secretary may expend not more than 5 percent to
			 pay administrative expenses.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H41CA5328A43141FBB384B31D9E5E6C8E"><enum>(3)</enum><header display-inline="yes-display-inline">Prohibition on earmarks</header><text display-inline="yes-display-inline">None of the funds appropriated pursuant to
			 this subsection may be used for a Congressional earmark as defined in clause
			 9(e) of rule XXI of the Rules of the House of Representatives.</text>
					</paragraph></subsection></section></title><title commented="no" id="HE13CE311B8F4443D8526FDCB34E79916" level-type="subsequent"><enum>III</enum><header display-inline="yes-display-inline">Waste, Fraud, and Abuse</header>
			<section commented="no" display-inline="no-display-inline" id="HCF4C35A5901E455BAF698A0474FDFBD7" section-type="subsequent-section"><enum>301.</enum><header display-inline="yes-display-inline">Report</header><text display-inline="no-display-inline">The Department of Energy’s Inspector General
			 shall submit a report to Congress measuring the amount of waste, fraud, and
			 abuse occurring in programs created by this Act, which shall include
			 recommendations to prevent additional waste, fraud, and abuse. This report
			 shall be submitted before July 1, 2012.</text>
			</section></title><title commented="no" id="H6B2FE32537694A78B2286F9657085BDF" level-type="subsequent"><enum>IV</enum><header display-inline="yes-display-inline">Deficit Neutrality</header>
			<section commented="no" display-inline="no-display-inline" id="H2DA07D83581D4299A7E7B7BFE76A69F3" section-type="subsequent-section"><enum>401.</enum><header display-inline="yes-display-inline">Sunset</header><text display-inline="no-display-inline">The provisions of this Act shall be
			 suspended and shall not apply if this Act will have a negative net effect on
			 the national budget deficit of the United States.</text>
