		<section display-inline="no-display-inline" id="HAB0249FEEF754168B1134A414B700575" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Kick OPIC Act of
			 2010</short-title></quote>.</text>
		</section><section id="H65A21E353692420880FCC62AC60CE3AB"><enum>2.</enum><header>Termination of
			 Overseas Private Investment Corporation</header>
			<subsection id="H7D4D72C681E84AF9BD5022BFCA3F46F5"><enum>(a)</enum><header>Termination of
			 Authority To Make New Obligations</header>
				<paragraph id="H7CDFF4EC26994CEC8AE5D35BFD0D963E"><enum>(1)</enum><header>Termination of
			 authority</header><text display-inline="yes-display-inline">Effective 60 days
			 after the date of the enactment of this Act, the Overseas Private Investment
			 Corporation shall not issue any insurance, guaranties, or reinsurance, make any
			 loan, or acquire any securities, under section 234 of the
			 <act-name parsable-cite="FAA61">Foreign Assistance Act of 1961</act-name>,
			 enter into any agreements for any other activity authorized by such section
			 234, or enter into risk sharing arrangements authorized by section 234A of that
			 Act.</text>
				</paragraph><paragraph id="H64A7BAE1F5C347279ABA78C138DCBA4A"><enum>(2)</enum><header>Preservation of
			 existing contracts and agreements</header><text>Paragraph (1) does not require
			 the termination of any contract or other agreement entered into before such
			 paragraph takes effect.</text>
				</paragraph></subsection><subsection id="H5B79042677B449D8A9E8D9DAD51EC63C"><enum>(b)</enum><header>Termination of
			 OPIC</header><text>Effective upon the expiration of the 180-day period
			 beginning on the date of the enactment of this Act, the Overseas Private
			 Investment Corporation is abolished.</text>
			</subsection><subsection id="H10D0C1D9A1694D6CB616DCEE920D9FB6"><enum>(c)</enum><header>Transfer of
			 Operations to OMB</header><text display-inline="yes-display-inline">The
			 Director of the Office of Management and Budget shall, effective upon the
			 expiration of the 180-day period beginning on the date of the enactment of this
			 Act, perform the functions of the Overseas Private Investment Corporation with
			 respect to contracts and agreements described in subsection (a)(2) until the
			 expiration of such contracts and agreements, but shall not renew any such
			 contract or agreement. The Director shall take the necessary steps to wind up
			 the affairs of the Corporation.</text>
			</subsection><subsection id="HD9CF61D6D5B942C2AE80F8158336C8D0"><enum>(d)</enum><header>Repeal of
			 Authorities</header><text display-inline="yes-display-inline">Effective upon
			 the expiration of the 180-day period beginning on the date of the enactment of
			 this Act, title IV of chapter 2 of part I of the
			 <act-name parsable-cite="FAA61">Foreign Assistance Act of 1961</act-name> (22
			 U.S.C. 2191 and following) is repealed, but shall continue to apply with
			 respect to functions performed by the Director of the Office of Management and
			 Budget under subsection (c).</text>
			</subsection><subsection id="HD6171397E9434CDC8C49FBE28B33319A"><enum>(e)</enum><header>Appropriations</header><text>Funds
			 available to the Corporation shall, upon the effective date of the repeal made
			 by subsection (d), be transferred to the Director of the Office of Management
			 and Budget for use in performing the functions of the Corporation under
			 subsection (c). Upon the expiration of the contracts and agreements with
			 respect to which the Director is exercising such functions, any unexpended
			 balances of the funds transferred under this subsection shall be deposited in
			 the Treasury as miscellaneous receipts.</text>
			</subsection></section><section id="H35017FDB67CA4F47B24F04534CA10B32"><enum>3.</enum><header>Savings
			 provisions</header>
			<subsection id="H42A8E9938F774AFFBE9D5DF158D2115A"><enum>(a)</enum><header>Prior
			 Determinations Not Affected</header><text>The repeal made by section 2(d) of
			 the provisions of law set forth in such section shall not affect any order,
			 determination, regulation, or contract that has been issued, made, or allowed
			 to become effective under such provisions before the effective date of the
			 repeal. All such orders, determinations, regulations, and contracts shall
			 continue in effect until modified, superseded, terminated, set aside, or
			 revoked in accordance with law by the President, the Director of the Office of
			 Management and Budget, or other authorized official, a court of competent
			 jurisdiction, or by operation of law.</text>
			</subsection><subsection id="HD0E602A77E44411ABA3E751E327C66CA"><enum>(b)</enum><header>Pending
			 proceedings</header>
				<paragraph id="H75920F916C7E4252AA162AC9AC83AF08"><enum>(1)</enum><header>Effect on
			 pending proceedings</header>
					<subparagraph id="HDA5CAA32B74F41FCA0449E2E3F3A0A80"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The repeal made by
			 section 2(d) shall not affect any proceedings, including notices of proposed
			 rulemaking, pending on the effective date of the repeal, before the Overseas
			 Private Investment Corporation, except that no insurance, reinsurance,
			 guarantee, or loan may be issued pursuant to any application pending on such
			 effective date. Such proceedings, to the extent that they relate to functions
			 performed by the Director of the Office of Management and Budget after such
			 repeal, shall be continued. Orders shall be issued in such proceedings, appeals
			 shall be taken therefrom, and payments shall be made pursuant to such orders,
			 as if this Act had not been enacted; and orders issued in any such proceedings
			 shall continue in effect until modified, terminated, superseded, or revoked by
			 the Director of the Office of Management and Budget, by a court of competent
			 jurisdiction, or by operation of law.</text>
					</subparagraph><subparagraph id="H8A55317622DA4F74B74B37ADE0A1EDF3"><enum>(B)</enum><header>Construction</header><text>Nothing
			 in this subsection shall be deemed to prohibit the discontinuance or
			 modification of any proceeding described in subparagraph (A) under the same
			 terms and conditions and to the same extent that such proceeding could have
			 been discontinued or modified if this Act had not been enacted.</text>
					</subparagraph></paragraph><paragraph id="H1C14EBBD1A8D40819611BD5B3AC6121E"><enum>(2)</enum><header>Regulations for
			 transfer of proceedings</header><text>The Director of the Office of Management
			 and Budget is authorized to issue regulations providing for the orderly
			 transfer of proceedings continued under paragraph (1).</text>
				</paragraph></subsection><subsection id="H6CC3C1A9B4D649E3A7DEF11324871372"><enum>(c)</enum><header>Actions</header><text>Except
			 as provided in subsection (e)—</text>
				<paragraph id="H8AE72FBA1A124DF283E32DE15460C13F"><enum>(1)</enum><text>the provisions of
			 this Act shall not affect suits commenced before the effective date of the
			 repeal made by section 2(d); and</text>
				</paragraph><paragraph id="H963119D39EF843278395AF9984D83B4E"><enum>(2)</enum><text>in all such suits,
			 proceedings shall be had, appeals taken, and judgments rendered in the same
			 manner and effect as if this Act had not been enacted.</text>
				</paragraph></subsection><subsection id="H19E4D4B0A9B9492B99EA4F8F5E215ECD"><enum>(d)</enum><header>Liabilities
			 Incurred</header><text>No suit, action, or other proceeding commenced by or
			 against an individual in the official capacity of such individual as an officer
			 of the Overseas Private Investment Corporation shall abate by reason of the
			 enactment of this Act. No cause of action by or against the Overseas Private
			 Investment Corporation, or by or against any officer thereof in the official
			 capacity of such officer, shall abate by reason of the enactment of this
			 Act.</text>
			</subsection><subsection id="H7BE2D493473546C3AADF5ED903459FD9"><enum>(e)</enum><header>Parties</header><text>If,
			 before the effective date of the repeal made by section 2(d), the Overseas
			 Private Investment Corporation or an officer thereof in the official capacity
			 of such officer, is a party to a suit, then such suit shall be continued with
			 the Director of the Office of Management and Budget substituted or added as a
			 party.</text>
			</subsection><subsection id="H72FF7C0EF8A248B386256CF760130E76"><enum>(f)</enum><header>Review</header><text>Orders
			 and actions of the Director of the Office of Management and Budget in the
			 exercise of functions of the Overseas Private Investment Corporation shall be
			 subject to judicial review to the same extent and in the same manner as if such
			 orders and actions had been issued or taken by the Overseas Private Investment
			 Corporation. Any statutory requirements relating to notice, hearings, action
			 upon the record, or administrative review that apply to any function of the
			 Overseas Private Investment Corporation shall apply to the exercise of such
			 function by the Director of the Office of Management and Budget.</text>

			 and Repeals</header><paragraph commented="no" display-inline="yes-display-inline" id="H1A9C4A5682FD463C8D8ACACCD0AC76A0"><enum>(1)</enum><text>Section 222(a) of the
			 <act-name parsable-cite="FAA61">Foreign Assistance Act of 1961</act-name> (22
			 U.S.C. 2182) is amended by inserting after <quote>section 238(c)</quote> the
			 following: <quote>as in effect on the day before the effective date of the
			 repeal of that section made by section 2(d) of the OPIC Abolition
			 Act</quote>.</text>

			 Religious Freedom Act of 1998 (22 U.S.C. 6445(a)(10)) is amended by striking
			 <quote>, the Overseas Private Investment Corporation,</quote>.</text>
				</paragraph><paragraph id="HAFA47ACA48F1484D9A1748E6CEED82BD" indent="up1"><enum>(12)</enum><text display-inline="yes-display-inline">Section 732(b) of the Global Environmental
			 Protection Assistance Act of 1989 (22 U.S.C. 7902(b)) is amended by striking
			 <quote>the Overseas Private Investment Corporation,</quote>.</text>
				</paragraph><paragraph id="HD22ED71F5ABE41169A5F743405F73675" indent="up1"><enum>(13)</enum><text display-inline="yes-display-inline">Section 916(a)(2) of the Energy
			 Independence and Security Act of 2007 (42 U.S.C. 17336(a)(2)) is
			 amended—</text>
					<subparagraph id="H1F8CC41797EC49B4808047128F55B572"><enum>(A)</enum><text>by striking subparagraph (I);
			 and</text>
					</subparagraph><subparagraph id="H35D4DD4185C94F3182E1CB081D3745E6"><enum>(B)</enum><text>by redesignating subparagraphs (J)
			 through (M) as subparagraphs (I) through (L), respectively.</text>
					</subparagraph></paragraph><paragraph id="H61E6047F09684849B97EF3974FD33F95" indent="up1"><enum>(14)</enum><text display-inline="yes-display-inline">Section 6(d)(1) of the Belarus Democracy
			 Act of 2004 (22 U.S.C. 5811 note) is amended by striking <quote>and the
			 Overseas Private Investment Corporation</quote>.</text>
				</paragraph><paragraph id="H6DBBBFDA7A8F417AAFA6E415F4E6AC16" indent="up1"><enum>(15)</enum><text>The following provisions of law are
			 repealed:</text>
					<subparagraph id="H6A99130A9B5A4E418DF1B3C1ED5F7153"><enum>(A)</enum><text>Section 5(b)(2) of the Overseas
			 Private Investment Corporation Amendments Act of 1981 (22 U.S.C. 2194a).</text>
					</subparagraph><subparagraph id="H4B9F707849C74BA2A8D4DBA59F13B03B"><enum>(B)</enum><text>Section 5 of the Taiwan Relations Act
			 (22 U.S.C. 3304).</text>
					</subparagraph><subparagraph id="HE2016C93A5CC4475BD58B25352DFA5E7"><enum>(C)</enum><text display-inline="yes-display-inline">Section 2(c)(12) of the Support for East
			 European Democracy (SEED) Act of 1989 (22 U.S.C. 5401(c)(12)).</text>
					</subparagraph><subparagraph id="HA4686C40DB0C487D9A0DCB8254210088"><enum>(D)</enum><text display-inline="yes-display-inline">Section 9101(3)(H) of title 31, United
			 States Code.</text>
					</subparagraph><subparagraph id="HAD3EEABFBB2B40538F5463FB20BE6B31"><enum>(E)</enum><text display-inline="yes-display-inline">Section 123 of the African Growth and
			 Opportunity Act (19 U.S.C. 3733), and the item relating to that section in the
			 table of contents of that Act.</text>
					</subparagraph><subparagraph id="HB576977E5F7B45128C1039C3F6F333B0"><enum>(F)</enum><text display-inline="yes-display-inline">Section 104 of the Africa: Seeds of Hope
			 Act of 1998 (22 U.S.C. 2293), and the item relating to that section in the
			 table of contents for that Act.</text>
					</subparagraph><subparagraph id="H0EF4D3CD96224A04AEA7CB731B6E914B"><enum>(G)</enum><text display-inline="yes-display-inline">Section 914 of the Energy Independence and
			 Security Act of 2007 (42 U.S.C. 17334), and the item relating to that section
			 in the table of contents for that Act.</text>
					</subparagraph></paragraph></subsection><subsection id="H7177CC19EB5145CD8336B9D78D61FF31"><enum>(c)</enum><header>Effective
			 Date</header><text>The amendments and repeals made by this section shall take
			 effect upon the expiration of the 180-day period beginning on the date of the
			 enactment of this Act.</text>
