<official-title>To amend the Internal Revenue Code of 1986 to provide an exception to the arbitrage rules for prepayments for electricity generated from renewable resources.</official-title>

<section id="HDFA1505CA1BB477093E5C15C8417604D" section-type="section-one"><enum>1.</enum><header>Exception to arbitrage rules for prepayments for electricity generated from renewable resources</header> 
<subsection id="HAAB9768B7A9C4819BC6C4AE03D7E5E65"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 148(b) of the Internal Revenue Code of 1986 is amended by adding at the end the following new paragraph:</text>

<paragraph id="H312D851F8509457F815D13A8D6E7C131"><enum>(5)</enum><header>Exception for prepaid electricity generated from renewable resources</header> 
<subparagraph id="H1AA842A2FF114F4085E7CA1EFBC958F8"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <quote>investment-type property</quote> does not include a prepayment under a qualified renewable electricity contract. </text></subparagraph> 
<subparagraph id="H8A6490DC232542DA99D656BDD995828B"><enum>(B)</enum><header>Qualified renewable electricity contract</header><text display-inline="yes-display-inline">For purposes of this paragraph, the term <quote>qualified renewable electricity contract</quote> means any contract to acquire electricity if—</text> 
<clause id="HE6D6AE163C5E4B83931271217A0C9A9A"><enum>(i)</enum><text>such electricity is used by the State or political subdivision thereof with respect to which the State or local bond is issued, and</text></clause> 
<clause id="HFF4DC5AEEE3F4DAE98E97EDF39EF7F8B"><enum>(ii)</enum><text>in connection with such contract the supplier of such electricity places in service property which is capable of generating from qualified energy resources (as defined in section 45(c)) the amount of electricity purchased under the contract (and such property is not taken into account under this paragraph with respect to any other contract).</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H71C6E2C5E5884365B0FC428F60B3A5E4"><enum>(b)</enum><header>Effective date</header><text>The amendment made by this section shall apply to obligations issued after the date of the enactment of this Act.</text> </subsection></section>
