		<legis-type>A BILL</legis-type>
		<official-title>To amend the child nutrition laws to require that milk
		  served in school lunch programs be consistent with the Dietary Guidelines for
		  Americans and to expand eligibility for the Special Milk Program, and to
		  establish a pilot program providing low-fat cheeses for school breakfast and
		  lunch programs, and for other purposes.</official-title>

		<section id="H49F9996C0C2B46E29524E7B6956E0F69" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Healthy Milk and Dairy Choices in
			 Schools Act of 2010</short-title></quote>.</text>
		</section><section id="HFBAB3CA3FD9C426FB5EF8984599FF3B3"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
			<paragraph id="H0622CD9D8CEC4D51801A4B438417ECDC"><enum>(1)</enum><text display-inline="yes-display-inline">44 million Americans have low bone mass or
			 osteoporosis, causing $19 billion in hospital and nursing home expenses
			 annually.</text>
			</paragraph><paragraph id="HB2FF2B8EF57846399EA7E32CF1ECF0FD"><enum>(2)</enum><text display-inline="yes-display-inline">Adequate calcium intake and weight-bearing
			 exercise can help build bone mass and prevent debilitating fractures.</text>
			</paragraph><paragraph id="H2387D70631E64B2798DD7F9C712E8157"><enum>(3)</enum><text display-inline="yes-display-inline">98 percent of maximum bone density is
			 reached by age 20, making it especially important that children get enough
			 calcium.</text>
			</paragraph><paragraph id="H3543461D004A4E98BF8F223D6B2311E0"><enum>(4)</enum><text display-inline="yes-display-inline">The United States Department of Agriculture
			 finds that 32 percent of children ages 4 through 8 and 90 percent of girls and
			 70 percent of boys ages 9 through 19 do not meet current calcium
			 recommendations.</text>
			</paragraph><paragraph id="H1480358F53B74C5496BBAAAD1C231CA9"><enum>(5)</enum><text display-inline="yes-display-inline">Per capita milk consumption in the United
			 States has been decreasing for 3 decades. Per capita milk consumption by
			 children fell quickly from 2005 to 2010, and this consumption rate is declining
			 even more rapidly as these children reach their teenage years.</text>
			</paragraph><paragraph id="HE464B697560C43D69BFA05DC55143B27"><enum>(6)</enum><text>Fewer than half of
			 school-age children participate in school meal programs.</text>
			</paragraph><paragraph id="H31B62CBE3A0F4582BCBCA6239FB0BA24"><enum>(7)</enum><text>87 percent of
			 schools sell soft drinks, fruit drinks, and sports drinks on campus through
			 school meal programs, vending machines, and other means.</text>
			</paragraph></section><section id="HC2FB48AC10974881900B7346A99B1838"><enum>3.</enum><header>Fat content of
			 milk in school lunch programs</header><text display-inline="no-display-inline">Section 9(a)(2)(A)(i) of the Richard B.
			 Russell National School Lunch Act (42 U.S.C. 1758(a)(2)(A)(i)) is amended by
			 inserting <quote>consistent with the most recent Dietary Guidelines for
			 Americans published under section 301 of the National Nutrition Monitoring and
			 Related Research Act of 1990 (7 U.S.C. 5341)</quote> before the
			 semicolon.</text>
		</section><section id="H720DA078D03B4F9E9B50B38C98229310"><enum>4.</enum><header>Expansion of
			 special milk program</header><text display-inline="no-display-inline">Section 3
			 of the Child Nutrition Act of 1966 (42 U.S.C. 1772) is amended—</text>
			<paragraph id="H53F6412DEAA34293B052B37B34F2F380"><enum>(1)</enum><text display-inline="yes-display-inline">by striking subsection (b);</text>
			</paragraph><paragraph id="H9F79078073E74BE8AC7F9C61AD545F86"><enum>(2)</enum><text>in subsection (a),
			 by striking paragraph (2) and redesignating paragraph (1) and paragraphs (3)
			 through (10) as subsections (a) through (i), respectively;</text>
			</paragraph><paragraph id="HCB1E2223EB164259AF38F0B1572DB333"><enum>(3)</enum><text>in subsection (a),
			 as redesignated by paragraph (2)—</text>
				<subparagraph id="HD9FE5117D1F64C70848A604C6DD69838"><enum>(A)</enum><text>by striking
			 <quote>, except as provided in paragraph (2), which do not participate in a
			 meal service program authorized under this Act or the Richard B. Russell
			 National School Lunch Act,</quote>; and</text>
				</subparagraph><subparagraph id="H0A98B08CBBFC4731A803FDBACBC51E28"><enum>(B)</enum><text>by striking
			 <quote>, which do not participate in a meal service program authorized under
			 this Act or the Richard B. Russell National School Lunch Act</quote>;
			 and</text>
				</subparagraph></paragraph><paragraph id="H0D0D36A08F6040E7942E8A5C9D1B6F76"><enum>(4)</enum><text display-inline="yes-display-inline">in subsection (d), as redesignated by
			 paragraph (2), by striking <quote>which does not participate in a meal service
			 program authorized under this Act or the Richard B. Russell National School
			 Lunch Act</quote>.</text>
			</paragraph></section><section id="HD10D833558594B42986093AA8119B47C"><enum>5.</enum><header>Pilot program
			 providing low-fat cheeses for school breakfast and lunch programs</header>
			<subsection id="H8588AF700F0341BF8A8CA64D87C77249"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">During the 3-year
			 period beginning on the date that is not later than 60 days after the date of
			 the enactment of this Act, the Secretary of Agriculture shall purchase low-fat
			 cheeses for use in—</text>
				<paragraph id="H326AEDEFF812418F84257B0621CFC7A0"><enum>(1)</enum><text display-inline="yes-display-inline">the school lunch program established under
			 the Richard B. Russell National School Lunch Act (42 U.S.C. 1751 et seq.);
			 and</text>
				</paragraph><paragraph id="H27854556A4394AD191E94D5D58BA6133"><enum>(2)</enum><text display-inline="yes-display-inline">the school breakfast program established by
			 section 4 of the Child Nutrition Act of 1966 (42 U.S.C. 1773).</text>
				</paragraph></subsection><subsection id="HCF25EAAE2633471AAB302308ADFB940A"><enum>(b)</enum><header>Purchase
			 additional to commodity distribution program</header><text display-inline="yes-display-inline">The low-fat cheeses purchased under
			 subsection (a) shall be in addition to commodities delivered under section 6 of
			 the Richard B. Russell National School Lunch Act (42 U.S.C. 1755).</text>
			</subsection><subsection id="H769FFEA289D44D9E9319DA0C32DD2D75"><enum>(c)</enum><header>Evaluation and
			 report</header>
				<paragraph id="H70E72CB9332F494D9F7FC42E72806C80"><enum>(1)</enum><header>Evaluation</header><text display-inline="yes-display-inline">The Secretary shall conduct an evaluation
			 of—</text>
					<subparagraph id="H7481C5E8D58441AFB1E2643DA11A4144"><enum>(A)</enum><text>whether children
			 participating in the school lunch and breakfast programs described in
			 subsection (a) increased their consumption of low-fat cheeses during the period
			 described in subsection (a);</text>
					</subparagraph><subparagraph id="H5E55A7BC8EB94163A3809B0FD2EBB375"><enum>(B)</enum><text>which types of
			 low-fat cheeses are most appropriate for use in such school lunch and breakfast
			 programs, and how such cheeses may best be integrated into such programs;
			 and</text>
					</subparagraph><subparagraph id="H965036DE33994697AA7AB9EAA045F06E"><enum>(C)</enum><text>such other factors
			 related to increasing interest in and awareness of low-fat cheeses among
			 schoolchildren as the Secretary considers appropriate.</text>
					</subparagraph></paragraph><paragraph id="HF51E9CAC8FB44D11802FCC1E556C7939"><enum>(2)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 90 days after the conclusion
			 of the 3-year period described in subsection (a), the Secretary shall submit to
			 the Committee on Agriculture, Nutrition, and Forestry of the Senate and the
			 Committee on Education and Labor of the House of Representatives a report
			 describing the results of the evaluation required by paragraph (1).</text>
				</paragraph></subsection><subsection id="HC89597851DA24B25ABE3DD499B273245"><enum>(d)</enum><header>Low-Fat cheese
			 defined</header><text>In this section, the term <term>low-fat cheese</term>
			 means cheese of any type whose solids contain a percentage of milkfat, to be
			 determined by the Secretary, that is less than the percentage specified for
			 such type of cheese in subpart B of part 133 of title 21, Code of Federal
			 Regulations.</text>
			</subsection></section><section id="H5DF30ECD61F44572B881E7773B44DB66"><enum>6.</enum><header>Budget neutrality
			 offset</header><text display-inline="no-display-inline">Section 6(e)(1)(B) of
			 the Richard B. Russell National School Lunch Act (42 U.S.C. 1755(e)(1)(B)) is
			 amended by striking <quote>October 1, 2003, and ending September 30,
			 2009</quote> and inserting <quote>October 1, 2010, and ending September 30,
			 2016</quote>.</text>
