		<section id="HC0F2E573CEDE4ED391ED890F1E40FCB0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Haitian Private Sector Encouragement
			 Act of 2010</short-title></quote>.</text>
		</section><section id="H22A1B3684B5A404DB19ADBA4A4FD12BE"><enum>2.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are to
			 promote—</text>
			<paragraph id="H4A0A72A046334E478559D8EA1CA4B7C9"><enum>(1)</enum><text>development of the
			 Haitian private sector, including small business, the agriculture sector, and
			 joint ventures with the United States and host country participants, and</text>
			</paragraph><paragraph id="HD014A656BAFA45C893D5CBDDD3C4AB4B"><enum>(2)</enum><text>policies and
			 practices conducive to private sector development in Haiti,</text>
			</paragraph><continuation-text continuation-text-level="section">through loans,
			 grants, equity investments, feasibility studies, technical assistance,
			 training, insurance, guarantees, and other measures.</continuation-text></section><section id="H245FCC27067E4709BA4197FF09D7D206"><enum>3.</enum><header>Designation of
			 Haitian-American Enterprise Fund</header>
			<subsection id="H1AFA55A3DAD84EA18DE6EA695922DFB4"><enum>(a)</enum><header>Designation</header><text display-inline="yes-display-inline">The President is authorized to designate
			 one private, nonprofit organization established under State law as eligible to
			 receive funds and support under this Act upon a determination by the President
			 that the organization has been established for the purposes described in
			 section 2. For purposes of this Act, the organization so designated shall be
			 referred to as the <quote>Haitian-American Enterprise Fund</quote>.</text>
			</subsection><subsection commented="no" id="H8A2B2CBBFF8A4D9EAA6F5836C26278BE"><enum>(b)</enum><header>Consultation
			 with Congress</header><text display-inline="yes-display-inline">Before
			 designating an organization under subsection (a), the President shall consult
			 with—</text>
				<paragraph commented="no" id="H5AF2111E5C6D452CB1FA1DBC9BBB2410"><enum>(1)</enum><text>the majority
			 leader and minority leader of the Senate; and</text>
				</paragraph><paragraph commented="no" id="H054E45B0076049EDA2ACC688F426C1CE"><enum>(2)</enum><text>the Speaker and
			 minority leader of the House of Representatives.</text>
				</paragraph></subsection><subsection id="H0F11B2BBDCCD45DAB473255FC6AD6BA3"><enum>(c)</enum><header>Additional
			 requirements</header><text display-inline="yes-display-inline">Except to the
			 extent inconsistent with the provisions of this Act, paragraphs (3) through (5)
			 of section 201(d) of the Support for East European Democracy (SEED) Act of 1989
			 (22 U.S.C. 5421(d)) shall apply to the Haitian-American Enterprise Fund to the
			 same extent and in the same manner as such paragraphs apply to the
			 Polish-American Enterprise Fund, the Hungarian-American Enterprise Fund, the
			 Southern Africa Enterprise Development Fund, and other similarly situated
			 enterprise funds established by the United States Government.</text>
			</subsection></section><section id="HD9984A4C576140D9B17CA982DC17945F"><enum>4.</enum><header>Grant to
			 Haitian-American Enterprise Fund</header>
			<subsection id="H84879FF09D4C45D7AC27FC6F84D04093"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The President, acting
			 through the Administrator of the United States Agency for International
			 Development, shall, from amounts appropriated pursuant to the authorization of
			 appropriations under section 7, provide a grant to the Haitian-American
			 Enterprise Fund, which shall be used to—</text>
				<paragraph id="H6577E1571B4F480EB5E60871B4AEF65D"><enum>(1)</enum><text>carry out the
			 purposes described in section 2, including to promote the policies and
			 practices described in subsection (b); and</text>
				</paragraph><paragraph id="HD0A44CAB280F4BD489DCC361913D4BB7"><enum>(2)</enum><text>pay the
			 administrative expenses of the Enterprise Fund.</text>
				</paragraph></subsection><subsection id="HF1E9E4D88E8D4488B20020E47AA988E0"><enum>(b)</enum><header>Policies and
			 practices</header><text display-inline="yes-display-inline">The policies and
			 practices referred to in subsection (a)(1) are policies and practices conducive
			 to the development of private property rights for the citizens of Haiti,
			 particularly Haitian citizens of limited economic means, through integration of
			 extralegal property arrangements employed by some Haitian citizens into
			 comprehensive modern property recordation systems that fix the economic
			 potential of assets, integrate disperse ownership information into one system,
			 hold citizens accountable, make assets fungible, connect citizens to one
			 another, and protect the integrity of commercial transactions.</text>
			</subsection><subsection id="H6E187CB36CDE470388DCD6FA042DD2D0"><enum>(c)</enum><header>Oversight</header><text display-inline="yes-display-inline">The Administrator of the United States
			 Agency for International Development shall monitor the activities of the
			 Haitian-American Enterprise Fund.</text>
			</subsection></section><section id="HFE7539DCA233473E9BC9650E701AEDB5"><enum>5.</enum><header>Treatment
			 equivalent to other enterprise funds; consultation with other enterprise
			 funds</header>
			<subsection id="H50AC90916A354BF8AA834BCAC8DEEBA0"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Except to the extent
			 inconsistent with the provisions of this Act, subsections (f) through (p) of
			 section 201 of the Support for East European Democracy (SEED) Act of 1989 (22
			 U.S.C. 5421) shall apply to the Haitian-American Enterprise Fund to the same
			 extent and in the same manner as such subsections apply to the Polish-American
			 Enterprise Fund, the Hungarian-American Enterprise Fund, the Southern Africa
			 Enterprise Development Fund, and other similarly situated enterprise funds
			 established by the United States Government.</text>
			</subsection><subsection id="HAA5CC0C186BD4946A3D2CBFA1D577ED6"><enum>(b)</enum><header>Consultation
			 with other enterprise funds</header><text display-inline="yes-display-inline">The Haitian-American Enterprise Fund may
			 consult extensively with other similarly situated enterprise funds established
			 by the United States Government in order to seek out best practices relating to
			 the start-up phase and other ongoing business matters of the Enterprise
			 Fund.</text>
			</subsection></section><section id="H9C1034F1262B43AA88E3F2B1256B6629"><enum>6.</enum><header>Haitian-American
			 Economic Oversight Panel</header>
			<subsection id="HAD45B64EF8304D31AF993C216AD3CF41"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The President is authorized to establish
			 the Haitian-American Economic Oversight Panel (in this section referred to as
			 the <quote>Oversight Panel</quote>).</text>
			</subsection><subsection id="H046FA0B3F4624CF5940B07DB5D0590EC"><enum>(b)</enum><header>Duties</header><text>The
			 Oversight Panel shall monitor the activities of the Haitian-American Enterprise
			 Fund and all other economic development initiatives of the United States for
			 Haiti.</text>
			</subsection><subsection commented="no" id="H4837D763A244423289F030465353139F"><enum>(c)</enum><header>Membership</header><text display-inline="yes-display-inline">The Oversight Panel shall consist of
			 individuals appointed by the President after consultation with Congress, from
			 among United States citizens who are not officers or employees of any
			 government and who have demonstrated concern and commitment to the economic
			 development of Haiti.</text>
			</subsection><subsection id="H89521CA4DE414B6E911811D2D6B37C0E"><enum>(d)</enum><header>Report</header><text display-inline="yes-display-inline">The Oversight Panel shall submit to
			 Congress and the President an annual report on implementation of the Oversight
			 Panel’s duties for the preceding year, including a detailed description of
			 incidents of waste, fraud, and abuse relating to economic development
			 initiatives of the United States for Haiti.</text>
			</subsection><subsection id="H90452E35D8DC4664988EA5927C37BD09"><enum>(e)</enum><header>Rule of
			 construction</header><text>Nothing in this section shall be construed to affect
			 the authorities of the Haitian-American Enterprise Fund.</text>
			</subsection></section><section id="HA25EAE9C658A4B9DB09BF897E3E56282"><enum>7.</enum><header>Authorization of
			 appropriations</header>
			<subsection id="HD8BC7B9F0A0E4A63B6109DCFD31890CF"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">There are authorized
			 to be appropriated to the President to carry out this Act $240,000,000 for
			 fiscal year 2011.</text>
			</subsection><subsection id="HD5EA5E902AE845B48DC90E78881B5BF8"><enum>(b)</enum><header>Availability</header><text>Amounts
			 appropriated pursuant to the authorization of appropriations under subsection
			 (a) are authorized to remain available until expended.</text>
			</subsection><subsection id="H9F2A4ED3B486497BBA217F5D73334C61"><enum>(c)</enum><header>Nonapplicability
			 of other laws</header><text display-inline="yes-display-inline">Notwithstanding
			 any other provision of law, amounts appropriated pursuant to the authorization
			 of appropriations under subsection (a) may be expended by the Haitian-American
			 Enterprise Fund for the purposes of this Act.</text>
