		<official-title>To amend title 35, United States Code, to provide
		  recourse under the patent law for persons who suffer competitive injury as a
		  result of false markings.</official-title>

		<section id="HB9F0542875004B91809AB8655A3C53FA" section-type="section-one"><enum>1.</enum><header>False marking</header>
			<subsection id="HB5B7824F4B7145849EB4475FB670EF1C"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subsection (b) of
			 section 292 of title 35, United States Code, is amended to read as
			 follows:</text>
				<quoted-block display-inline="no-display-inline" id="HFA6E835F26024EC08E353B842D128BAE" style="USC">
					<subsection id="H2563D6A6A7864B8EB22CBFB36AB5787D"><enum>(b)</enum><text display-inline="yes-display-inline">A person who has suffered a competitive
				injury as a result of a violation of this section may file a civil action in a
				district court of the United States for recovery of damages adequate to
				compensate for the
				injury.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H5529A321D1174FD69D8571425682B585"><enum>(b)</enum><header>Effective
			 date</header><text>The amendment made by subsection (a) shall apply to all
			 cases, without exception, pending on or after the date of the enactment of this
			 Act.</text>
