<official-title>To amend the Truth in Lending Act to prohibit the servicer of a home mortgage, or any affiliate of the servicer, from holding any other mortgage on the property.</official-title>

<section id="H41E0FCDF4ECF4EC9B877B38D2637487A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Mortgage Servicing Conflict Elimination Act of 2010</short-title></quote>.</text></section> 
<section id="H206C66949F464EDA906CC6C8E4E2862E"><enum>2.</enum><header>Limitation on mortgages held by loan servicers</header> 
<subsection id="H20233AE502CB498F98B1F08F58E1A775"><enum>(a)</enum><header>Limitation</header><text display-inline="yes-display-inline">Chapter 2 of the Truth in Lending Act (15 U.S.C. 1631 et seq.) is amended—</text> 
<paragraph id="H8AC48EB74AF14DCA803BE1EC448492DB"><enum>(1)</enum><text>by redesignating the second section 129, as added by section 201(b) of the Helping Families Save Their Homes Act of 2009 (Public Law 111–22; 123 Stat. 1638), as section 129A; and</text></paragraph> 
<paragraph id="HF57B4949CA194D69A621326793391F3D"><enum>(2)</enum><text>by inserting before section 130 (15 U.S.C. 1640) the following new section:</text>

<section id="H50EFBFD1A7274F3FBAFF4BF0620AEB7A"><enum>129B.</enum><header>Limitation on mortgages held by loan servicers</header> 
<subsection id="HF27F34EF091346708EBE3CE40AEE524F"><enum>(a)</enum><header>Limitation</header><text display-inline="yes-display-inline">Neither the servicer of a residential mortgage loan, nor any affiliate of such servicer, may own, or hold any interest in, any other residential mortgage loan that is secured by a mortgage, deed of trust, or other equivalent consensual security interest on the same dwelling or residential real property that is subject to the mortgage, deed of trust, or other security interest that secures the residential mortgage loan serviced by the servicer.</text></subsection> 
<subsection id="HB5D52D8803FB4A39B7B8E007156D3379"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">For purposes of this section, the following definitions shall apply:</text> 
<paragraph id="H550583CB0CFE4CF180D14AFE737280CD"><enum>(1)</enum><header>Affiliate</header><text display-inline="yes-display-inline">The term <quote>affiliate</quote> means, with respect to a servicer, any person or entity that controls, is controlled by, or is under common control with such servicer, as the Board shall prescribe by regulation.</text> </paragraph> 
<paragraph id="H062C8CA88BE14C55B6F514481E7E3D4E"><enum>(2)</enum><header>Residential mortgage loan</header><text display-inline="yes-display-inline">The term <quote>residential mortgage loan</quote> means any consumer credit transaction that is secured by a mortgage, deed of trust, or other equivalent consensual security interest on a dwelling or on residential real property that includes a dwelling, other than a consumer credit transaction under an open end credit plan or an extension of credit relating to a plan described in section 101(53D) of title 11, United States Code.</text></paragraph> 
<paragraph id="H900E565DA8D647B6997E23386B0E06A2"><enum>(3)</enum><header>Servicer</header><text>The term <quote>servicer</quote> has the meaning provided in section 129A, except that such term includes a person who makes or holds a residential mortgage loan (including a pool of residential mortgage loans) if such person also services the loan.</text></paragraph></subsection> 
<subsection id="HC6BC37FCBBB145D6B41955CB7A2E5122"><enum>(c)</enum><header>Interests</header><text display-inline="yes-display-inline">For purposes of subsection (a), ownership of, or holding an interest in a residential mortgage loan includes ownership of, or holding an interest in—</text> 
<paragraph id="H9ED1B1E798884F56B7B0F2CD05F84A02"><enum>(1)</enum><text>a pool of residential mortgage loans that contains such residential mortgage loan; or</text></paragraph> 
<paragraph id="H92EABBF9FEC04A96A852F71766DA040C"><enum>(2)</enum><text>any security based on or backed by a pool of residential mortgage loans that contains such residential mortgage loan.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H274734468AC54C07AACFC956409653B1"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections for chapter 2 of the Truth in Lending Act is amended by inserting before the item relating to section 130 the following new item:</text>

<toc-entry level="section">Sec. 129B. Limitation on mortgages held by loan servicers.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HB8905979D95540ECAE201E6F31BFD712"><enum>(c)</enum><header>Applicability</header><text>The amendment made by subsection (a) shall apply—</text> 
<paragraph id="H11620DEF91AD4481A3D60C3894404EEE"><enum>(1)</enum><text>with respect to the servicer (or affiliate of the servicer) of a residential mortgage loan that is originated after the date of the enactment of this Act, on such date of enactment; and</text></paragraph> 
<paragraph id="HBBB47D9009B64DE99FE7623090195BA4"><enum>(2)</enum><text>with respect to the servicer (or affiliate of the servicer) of a residential mortgage loan that is originated on or before the date of the enactment of this Act, upon the expiration of the 12-month period beginning upon such date of enactment.</text> </paragraph></subsection></section>
