<section id="H68FD9F9E0EFD44C6AD148AA4F48059F0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Chapter 7 Bankruptcy Administration Improvement Act of 2010</short-title></quote>.</text></section> 
<section id="H9C8B58AE94B649F584E60C655E4755CB"><enum>2.</enum><header>Compensation for bankruptcy trustees</header> 
<subsection id="H89528ADFD9AA49188D5FF2158CB14353"><enum>(a)</enum><header>New asset adjustments</header><text display-inline="yes-display-inline">Section 326(a) of title 11, United States Code, is amended by striking <quote>(a) In a case under chapter 7 or 11</quote> and inserting the following:</text>

<subsection id="H22D221A2BB4F44C4B6088333E55C6A8E"><enum>(a)</enum> 
<paragraph id="HED9480F39F8B449BBF6B7F9D4DC4A9BD" display-inline="yes-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">In a case under chapter 7, the court may allow reasonable compensation under section 330 of this title of the trustee for the trustee's services, payable after the trustee renders such services, not to exceed 25 percent on the first $50,000 or less, 15 percent on any amount in excess of $50,000 but not in excess of $250,000, 5 percent on any amount in excess of $250,000 but not in excess of $1,000,000, and 3 percent on any amount in excess of $1,000,000, upon all moneys disbursed or turned over in the case by the trustee to parties in interest, excluding the debtor, but including holders of secured claims.</text></paragraph> 
<paragraph id="HF9D050F18B8F4D1881ED454CB02C6013" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">In a case under chapter 11</text></paragraph></subsection> <after-quoted-block>.</after-quoted-block></quoted-block> </subsection> 
<subsection id="H677DF9C9FEDE4169B494C44D306FD9D1"><enum>(b)</enum><header>Compensation</header><text>Section 330(a)(7) of title 11, the United States Code, is amended to read as follows:</text>

<paragraph id="HB9E50D7A01B3414AAB78642395F75CF4" indent="up1"><enum>(7)</enum><text display-inline="yes-display-inline"> In determining the amount of reasonable compensation to be awarded to a trustee under chapter 7, the court shall treat such compensation as a commission, based on section 326(a)(1).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="H7F3241B9BD434D88B9FA6DA97A110B75"><enum>3.</enum><header> Application of amendments</header> <text display-inline="no-display-inline">The amendments made by this Act shall not apply with respect to cases commenced under title 11 of the United States Code before the date of the enactment of this Act.</text> </section>
